The meeting was called to order at 7:30 P.M. by
Chairman Jensen.
ROLL CALL:
Members present: Nagel, Albrecht, Jensen, Myhra, Schmedeke

ORDEft OF AGENDA:
The Subcommittee decided the order of the agenda would
be as follows: Items 3, l, 2, and 4.
l. DRIVEUTAY ACCESS FROM LOTS 5 and 6 BLOCK G RNERVIEW HEIGHTS:
Robert D. DeGardner 8180 East River Road .
Mr. DeGardner said he owned Lots 7 and 3 and the house
built on these lots face East River Road. Lots 5 and 6,
Block G, Riverview Heights will be sold, but he did not
want to sell until some kind of decision is made regarding
the access. The lots are 30'x110' each, and it appears the
only access is onto East River Road. There is about five
feet for the boulevard and a 35 foot setback is required for
the house. It was mentioned that if it were possible to put
a turn around at the back yard, he could come out on East
River Road facing frontwards. ,
Because the lots were platted before the present reg-
ulations, the code permits building on small lots.
Inasmuch as Members Schmedeke and Nagel did not have the
opportunity to look over the property, the,y stated they would
like to.
The Subcommittee agreed the� were not prepared to make
a recommendation this evening, but will inspect the property
prior to the Planning Commission meeting of May 25�, and
hope to make a recommendation at that time. The members would
look over the lots and give their recommendations to Chairm�.,.�.
Jensen,,who would, in turn, inform the Planning Commission
of the decision at the May 25�' meeting.
No further action was taken.
2. DISCUSSION OF PROPOSID ROAD PLAN FOR SEa OF SECTION 13: 0'Bannon,
Cochran, Carlson, Scherer, & Chies.
Mr. Cochran told the Subcommittee that 0'Bannon, Chies,
Cochran and Carlson met as agreed and talked over the plans
presented at the previous meeting but agreed to use the grade

already established. Two of the parties have plats accepted
and approved for drainage.
Mr. Carlson added that one of the things in this overall
plan and any wa,y �ou want to work it, you are involving 7 or 8
parties. In order to make this thing work, everybod�r has to be
united to do it, and there could be legal entanglements which
could tie up the whole procedure for some time. We have three
plans workable without involving the rest of the propert,y until
such time as 0'Bannon wants to develop his and attach it to ours.
The plats have been accepted pa�tially and can be worked in the
future and possibly the new plan would not be as workable as we
� felt.
Member Schmedeke said he walked over this area ,yesterday
and saw hills, scenery and pheasants. He did not think Mx'.
Cochran would have too big a problem in his opinion. He didn't
� lrnow exactly where the propert,y lines were. The onl� problem he
could see was Mr. 0'Bannon's propert,y, especially the 909 hole.
He said it looked as if there were some kind of old logging road
that went through to Old Central Avenue at one time.
Mr. 0'Bannon said he would like to run a road west to Central
Avenue but it would have to go through paxt of Rev. Henderson's
property and he won't give permission. He could go through the
north but he would have to buy some property to do so.
Chairman Jensen said, do I understand right that you four
prbperty owners are not particularly interested in an,y of the
proposals that were developed by the planner? You prefer not to
use an,,y of these plans or any variance? You would prefer to go
back to what �rou had previously developed on your own as the solution?
Caxlson: Basically, yes. In order to get an� kind of.work-
able solution, you have to get all four parties together and
agree on a plan, whether this or tre plan we alread,� have. The
plan we have has a lot more lots for sale that the planner's
layout. The Planner's lots would probably bring a bigger price
because the lots are larger and more landscape.
.Mr. Jensen said that, at this time, we have not considered
the size of lots or laid them out.
Mr. Carlson said that to get the cooperation of the other
owners was one of the main concerns. The four parties here this
evening were in agreement.
It was pointed out that they were talkin.g about 75 acres
of land in a relatively raw state �.nd the Subcommittee felt it
was important enough to develop this correctl�r and in the best
' possible manner.

Chairman Jensen said we realize that we probably can't get -
unanimous approval, but that could be taken caxe of at a
later date. Full cooperation would be giver� b� the Subcommittee
helping to establ.ish ke� roads so that adequate access can be
obtained for the development on a reasonable time schedule. It
is possible for the N.W. corner to lay dormant from two to ten
years and still your propert� could be developed in an orderl�
fashion. All we would have to sa� is when part of the area is to
be developed, this is the overall plan to follow.
At this point, the plan which was considered at the meeting
of the four propert� owners, was discussed. The problem of moving
dirt when construction was to begin was brought up and also
placing of streets taking into consideration the hills and dep-
ressions. The streets, as planned, would keep traffic down to a
minimum and yet give the residents an easy way out to collector
streets. Most of the roads in the area would not carry heavy
traffic and could get a waiver for width.
One of the reasons the property owners wanted to use their
original plans was that the� could develop over half the area
without bothering ar�rbod.y.
Chairman Jensen stated he feels that we still can begin a
development program in this area without involving the rest of
the people, and as soon as the,y want to do something, we have a
plan already begun.
Mr. Caxlson explained that when they purchased the land, they
did so on the presumption that they would get so man,y lots and so
much dirt. If we are going to get half as much dirt out as we
figured, we will lose.
Mr. Caxlson stated that he believes it is good to have an
overall plan which everybody is going to participate in. One �
reason for working with Mr. Chies and Mr. Cochran is there would
be agreement.
It was pointed out that if th� City could show there was a
plan for the area, it would be easy to talk to the people who were
questioning the work.
The Subcommittee decided to call a meeting for Tuesday
night, Ma.y 23, 1967 at 7:30 at the Chies property. Mr. Kermit
Crouch was to be contacted by the Engineering Assistant Darrel
Clark. If it were raining, there would be no meeting.

3. VACATION REQUEST: SAV #67-01, ST. PHILIP'S CHURCH: Vacate
30T service road on west side of T.H. #65 between West Moore
Lake Drive and West Moore Lake. Dr. Deane Richardson, president.
Chairman Jensen stated that inasmuch as he would have to make
the presentation of the vacation as he was on the committee for
the church parking lot, he turned the gavel over to Member
Albrecht, who took the chair.
Mr. Jensen stated St. Philip's Church has put in a request
to the City to vacate the service drive between West Moore Lake
Drive and West Moore Lake. This service drive is a City wtreet
and has never been used except as a right of way. It is being
used at the present time as a drive for the Church and there is
some parking taking place. Right now they are going to construct
a parking lot and a plan was developed which would completel�
do away with the need for a service drive. Inasmuch as the
service drive services no other property, other than the Church
propert�, we felt it would be a reasonable request. There would
be some advantage to the City as far as maintenance is concerned.
If the Church were to request a service road, the entire cost
would be borne by the Church but snow plowin.g and maintenance
would be a burden to the City; therefore, I believe there is
no disadvantaga in the vacation of this service road.
He also said the entire service road area would be used
for landscapin.g and parking and the dxiveway woul3 be entirely
on the parking lots. The traffic would be onl� Southbound.
This is going to be a stage development and the� will go as far
as the mone� goes.
MOTION by Schmedeke, seconded b� M,yhra, that the Plats and
Subdivisions - Streets and Utilities Subcommittee recommends
vacation (SAV #57-01) of the 30' service road on the west side
of T.H. #65 between West Moore Lake Drive and West Moore Lake
bein.g Outlot 2, Block 2, Moore Lake Highlands 4� Addition. Upon
a voice vote, all voting a�e, the motion carried unanimously.
Actin.g Chairma.n Albrecht turned the gavel over to Chairman
Jensen, who returned to the table.
4. VACATION REQUEST: SAV #67-02, ELMER JOHNSON: Vacation of West
end of turn around in Johnson's Riverlane Addition.
It was mentioned that this was a cul de sac until street
; was put in, and it is part of a recorded pTat. Riverview Terrace
does run down to 63rd Way, but it is not blacktopped. The
Ehgineering Assistant continued that tY�ere would be no problem
with utilities, and if there are stop boxes they can be pulled
out and put in another place.
The Cit�r Manager was asked to consult with the City Attorney
to see if it were necessary for this application and that of St.
Philip's Church to be published inasmuch as the request does not
affect anyone except the requestors. .

Chairman Jensen called attention to the fact that, if the
actual intent is to pull the street out of there, that any cost
will be borne by the requestor either as an assessment or at his
own expense. It was suggested to include the wording that the
petitioner will remove the street on the proposed vacated property
and repair the street to City standards at his own expense.
MOTION by Myhra, seconded b�r Schmedeke, that the Plats and
Subdivisions - Streets and Utilities Subcommittee recommend to
the Planning Commission that the vacation request (SAV #67-02�,
Elmer Johnson, of the cul de sac at the west end of the turn
around at Mississippi Place in Johnson's Riverlane Addition, be
granted and include the wording that the petitioner will remove
that portion of the street, and any damage to the street surface
be repaixed to Cit� standards and the curbin.g be continued, and
an.y cost to be borne by him ior repair of the street to City
standards at his own expense or b�r assessment. Upon a voice vote,
all voting aye, the motion carried unaminousiy.
