The meeting was called to order at 7:30 P.M. by Chairman Jensen.

Because the first three petitioners were not present, Chairman Jensen
suggested the meeting begin with Item �k4 which then becomes Item ��1.
LOT SPLIT REQUEST• L S �k69-06-07-08, GUNDER R__. ANDERSON: Lots 1, 2, 3,
Block 2, Riverwood Manor.
Mr. Anderson was present and explained the reason for the request was
that he had Lot 1 and 3 surveyed because he was going to build a house on
Lot 1. Then the people he was g�ing to build for decided on Lot 3, so he
put the foundation in on Lot 3 five feet from the property line for proper
setback and had the house partly up when a couple of old stakes were found.
He called the surveyor who rechecked it and found a mistake had been made
in the surveying. As a result of the error, the house was 4 feet on the
other person's lot, ma.king a total error of 9 feet. In order to correct
this, there was an exchange of 9 feet on the three lots with no change in
the overall measurements of the lots.
Mr. Myhra asked if this affected the easements in any way and was told
it did not.
Chairman Jensen said it was possible there would be an awful lot of
stakes in the ground, the older stakes and the new stakes, and suggested
the older ones be preserved by pounding them d�awn below the new ones.
All the papers in connection with this lot split, such as letter of
approval by the owners of Lot 2, necessary quit claim deeds and survey
drawing of lot descriptions were in order.
MOTION by Myhra, seconded by Crowder, that the Plats & Subdivisions-
Streets & Utilities Subcom�nittee recommend approval to the Planning Commis-
sion the Lot Splits, ��69-06-07-08 as described by survey drawing received
Ma.rch 6, 1969. Upon a voice vote, all voting aye, the motion carried .
unanimously.
LOT SPLIT REQUEST• L S ��69-02-03-04-05, SMITH & ANDERSON, INC.: Lots 4,
6, 11 and 13, Adams Street Addition.
The Engineering Assistant explained that Lots 4 and 13, 6 and 11 are
being split, and combined with other lots, will make building sites
Parcels K and J, M and L and H and I as indicated on the drawing. �e

purpose of this lot split request is to give a 20 foot sewer easement and
still retain the legal size lots. They are combining lots, and here again
the descriptions are fairly simple. The descriptions on the land survey
are clear, but the changes take a little study.
Mr. Anderson said they had to make the lots larger in order to take
in the easement, otherwise they would end up with a 20 foot strip with no
building on it and no one would own it.
Darrel Clark said the easement falls in line with 57th Place. There
is only one comment and that is the "walk easement" should be termed "street
easement".
Mr. Crowder asked if they could not build if they did not get this split.
Mr. Anderson said if they give 10 feet for a street on the South which
the City needs, he would have two 70 foot lots and one 120 foot lot. He
is attempting to level it out to make usable lots of substantial size.
Mr. Myhra asked if it would have any bearing on utilities, and secondly,
does it resolve some kind of legal descriptions, and are we actually
improving the building situation?
Mr. Anderson replied that they had to put laterals in. The laterals
on one lot were put in wrong in the first place. They are putting their
own services in. He did not want to get involved with a vacant lot.
Parcels G and F are not involved. Washington Street is not in but the ease-
ments are already there. Water is in Washington, and he planned to take
the sewer off the easement into the alley.
The Engineering Assistant said water would be no problem, the water-
ma.in is in Washington and 7th Street. All lots North of the easement are
served by sewer. A manhole could be installed over the sewer line and a
short stub down the alley. We may have to double up and extend the
Washington line also, but there is no problem in serving this area as it is
a short run.
MOTION by Crowder, seconded by Zeglen, that the Plats & Subdivisions-
Streets & Utilities Subcommittee recommend approval to the Planning Commission
of Lot Split, L.S. ��69-02-03-04-05, of Lots 4, 6, 11, and 13 as described on
the drawing received March 6, 1969 identified as Parcels from H to M. Upon
a voice vote, all voting aye, the motion carried unanimously.
3. PROPOSED PRELIMINARY PLAT: P.S. ��69-02 AMBER OAKS DAVID HUBERS: Lot 4,
Auditor's Subdivision ��92.
Mr. David Hubers and Mr. Norman Dalberg were present to discuss the
request.
The Engineering Assistant said he had called Julian Johnson, who was
platting the land south of this request. He had not been able to get any
place with the people to the south of his plat. He thought he might have
to develop his plat as originally planned, and he had no objection going
on the Planning Commission.
This problem started back in 1962 when the Worrels wanted to plat their
land. He came in with several different proposals. No interest was shown

by the people on the north or south in trying to work out the street pattern.
The request was held up six months. Finally the Planning Commission and
Council decided they were not getting any place so Worrel's was platted
without an overall pattern in mind.
About a year ago Julian Johnson started a platting procedure and again
the same problem came up. People to the south are not interested in platting.
For the new members, Chairman Jensen explained that the people are not
very cooperative to the south. The Subcommittee spent some time out there on
the grounds. It is an area of lush poison ivy. There are tremendous big
trees, woods and steep slopes, This is why there has been a great deal of
concern by the Subcommittee and Planning Comanission over the years. In order
to try and make the best use of this country, they keep striving for some-
thing better. For example, in 50 feet, it goes up 20 feet.
Mr. Myhra asked what kind of topography is at the southwest corner.
Chairman Jensen said it was low and it has a draw. Darrel Clark said Mr.
Zander, who owns the property to the west, is in agreement with Mr. Hubers.
If the street went through, Chairman Jensen said, there will be an
enormous cut below Zander's house. Mr. Julian Johnson had been asked to
try and see if he could get cooperation in order that his plat could be done
in a different fashion that would not demolish all the wooded character of
the property. Apparently he had no more success than the people did in 1962.
It was felt a north-south road was the answer to the property. Chairman
Jensen said the property south of Worrel's levels off to a great extent.
If we proceed with the Southhampton plat, these two are compatible. It was
mentioned that this proposed plat fits into the Rice Creek Raad/Central Avenue
street plan.
The petitioner was asked if he would have any objections to running
McKinley Street through all the way to the south line. He said he would work
with Mr. Johnson. The road pattern was discussed, but no action was taken.
Chairman Jensen said that with cooperation and coordination with Julian
Johnson a very fine development should result.
MOTION by Crowder, seconded by Myhra, that the Plats & Subdivisions-
Streets & Utilities Subcommittee recommend approval to the Planning Commission
of the Preli.minary Plat, P.S. ��69-02, Amber Oaks, David Hubers, of Lot 4,
Auditor's Subdivision ��92 and the Drawing received on March 6, 1969, also
reco�nending to them that McKinley Street, now ending in a cul de sac, be
extended further to the south end of the property line thus enabling the
development of the land to the South, providing that agreement is reached
with the adjoining property owners to the South. Upon a voice vote, all
voting aye, the motion carried unani.mously.
4. LOT SPLIT REQUEST: L.S. ��69-09. SHEI.DON A. MORTENSON: 140 feet North of
North property line of Central View Manor, Block 1, between T.H. ��65 and
Central Avenue.
Sheldon Mortenson was present. He explained he wanted the lot split
line to line up with the existing zoning. This is the first thing he would

change so that it would not leave a portion of a lot zoned differently.
The area is 4.3 acres and the reason for asking for a split is that he has
a buyer for the East one half. Mr. Jensen asked if he realized he would be
landlocking the land on the West end.
Chairman Jensen then explained the study for the Council of 73rd Avenue
and 73� Avenue.
Mr. Mortenson was informed he could take out a building permit for one
building on the land the way it is now.
Mr. Crowder asked what were the items of concern between Mr. Mortenson
and the Subcommittee in splitting this property? Mr. Myhra said if they
O.K. this split, Mr. Mortenson has a problem with Lot A in that it would be
landlocked. There was a discussion of contacting Pete Rrook regarding a
service road which would connect to Fireside Drive. Mr. Mortenson agreed
to contact Mr. Brook.
The Subco�nittee set the next i�ao meeting dates: one for March 20, I969
and one April 17, 1969.
MOTION by Myhra, seconded by Zeglen, that the Plats & Subdivisions-
Streets & Utilities Subconanittee table for further consideration until
Ma.rch 20, 1969, the Lot Split Request, L.S. ��69-09, Sheldon A. Mortenson,
for the 140 foot strip North of the North property line of Central View
Manor, Block 1 between T.H. ��65 and Central Avenue. Upon a voice vote, a11
voting aye, the motion carried unanimously.
The Subcommittee also told Mr. Mortenson he would probably have to plat
this parcel because of the complexity of the descriptions.
5. PROPOSED PRELINIINARY PLAT: P.S. ��69-03, MAPLE MANOR ADDITION, HIGHLAND PARK
DEVELOPMENT CO�ANY: Part of Outlot ��1, Melody Manor 4th Addition.
Mr. Fred Donaldson represented the Highland Park Development Company.
The Engineering Assistant explained that there were si.x lots with three
different zones: Lot 5 is co�nercial, Lots 2, 3 and 4 are multiple, and 1
and 6 have a special use permit for a nursing home. The reason for the odd
shaped lots is to gain proper amount of square feet.
Mr. Dona.ldson said that nothing was planned for Lot 6. They have the
special use permit, approved in November, 1968, but not issued. Council
also approved the two 34 unit buildings. When asked about the parking
arrangements for the nursing home, Mr. Donaldson said they tried to get it
as far away from the nursing home as possible.
Darrel Clark brought up the fact that should Lots 2 and 3 ever have
different ownerships, Lot 2 would need an easement to get up to Osborne Road.
Chairman Jensen suggested that all easements be indicated on the plat which
would eliminate the necessity of preparing deeds and recording them.
On Lot 4, proposed apartment, it was noted there was 50 feet between
the West property line and the facing of the building. They felt this was

just adequate for driveway and parking. There would be only a 5 foot space
to park cars across the front or length of the building. It allows for 14
cars.
Mr. Donaldson said all the land is vacant now. There are some trees.
The co�ercial piece has �st:�€ th�m.
Also, it was mentioned that water is on Osborne, sewer and water on
Madison and Lyric Lane.
MOTION by Myhra, seconded by Crowder, that the Plats & Subdivisions-
Streets & Utilities Subco�nittee recommend approval to the Planning Co�nission
of the Preliminary Plat, P.S. ��69-03, Ma.ple Manor Addition, Highland Park
Development Company of Outlot 1, Melody Manor 4th Addition except the North
400 feet of the West 217.8 feet subject to the Final Plat providing adequate
utility and access easements to the planned development. Upon a voice vote,
all voting aye, the motion carried unanimously.
6. LOT SPLIT REQUEST: L.S. ��60-01, GEORGE L. WALQUIST•� North 100 feet of
Lot 4, Herwal 2nd Addition.
Chairman Jensen explained that, inasmuch as Mr. Walquist could not be
present this evening and had asked that the Subcommittee act on the item
tonight, he would give a brief resume. He said Council had requested that
Mr. Walquist provide additional parking space for the mortuary. There is
a 20 foot north/south easement on the East side of Lot 4 which would be
used for the driveway from the mortuary to the proposed parking lot. Darrel
Clark said he received these easements today; however, one of the deeds has
not been filed yet.
MOTION by Myhra, seconded by Crowder, that the Plats & Subdivisions-
Streets & Utilities Subcommittee recounnend approval to the Planning Commission
of the Lot Split request, L.S. ��69-01, George L. Walquist, of the North 100 feet
of Lot 4, Herwal 2nd Addition, subject to filing the necessary easements for
the road connecting the mortuary property with parking facilities. Upon a voice
vote, all voting aye, the motion carried unani.mously.

Streets & Utilities Subcommittee meeting of March 6, 1969 be adjourned at
