Mr. Myhra called attention to the fact that, according to the
Ordinance, a minimum of 50 feet is required for a street making this
request only 2 feet below the City requirement. He felt the City should
not be in violation of this Ordinance. As long as the additional land
was to be used for parking and boulevard with a fence or hedge, the
Commission wondered if the request could be modified so that the vacation
would be for 16 feet and then stay within the limits of the Ordinance.
Chairman Jensen said that when 18 feet is vacated, this would
leave a 48 foot roadway. Could not the same plan be used and vacate
16 feet with the City retaining a 50 foot right of way and not be
violating the City Code. Regarding drainage, there aould be a problem
in that area.
MOTION by Myhra, seconded by Crowder, that the Plats & Subdivisions-
Streets & Utilities Subcommittee recommend approval to the Planning Commis-
sion of the vacation request, SAV #69-08, by the City of Fridley of the
South 18 feet of 57th Place lying East of a line extended North that is
20 feet East of the West line of Lot 7, Block 7, City View Addition and
West of the line that is 57.5 feet West of the centerline of the south-
bound lax� of T.H. #47 with the following provisions: l� reduction of

the 18 foot vacation right of way to 16 feet leaving the City with a 50 foot
right of way; 2� consideration of the fact that we have a street without a
turn arou.nd; 3� that the remainder of the street not being used could present
a ma.i.ntenance problem; 4� unless properly graded, there could be a
drai.nage problem; 5) that the City retain the utility easements in the
vacated portion. Upon a voice vote, all voting aye, the motion carried
unanimously.
2. VACATION REQUEST: s�v #6g-o9, CITY OF FRIDLEY: Vacate the 33 foot
street betwee.n 57th Place and 57th Avenue lying East of Lot 15,
Block 8 and West of Lot 1, Block 7, City View Addition.
The Engineering Assistant explained that the 33 foot street was
part of the origi.nal plat, but never maintained by the City as a street.
The only utility in is a Minneapolis Gas Company main, but the City
should keep the utility easement because a need for some utility may
come up later, unless Erickson Petroleum has some specific plans in
the future.
MOTION by Crowder, seconded by Zeglen, that the Plats & Subdivisions-
Streets & Utilities Subcommittee recommend to the Planning Commission
approval of the vacation request, sAV #6g-o9, to vacate a 33 foot street
between 57th Place and 57th Avenue lying East of Lot 15, Block 8 and
West of Lot l, Block 7, City View Addition and to further recommend
that the City retain all the appropriate utility easements on this
property. Upon a voice vote, all voting aye, the motion carricd
unanimously.
3. VACATION REQUEST: SAV #69-10, THOMAS ALBEftS: Vacate Johnson
Street on the West line of Lot 1, Block 2, Swans��om's
Court.
While Johnson Street from 53rd Avenue to Highway #694 is
shown on the Half Section map, the street is not open or used.
There is no plan to build a street there. Twenty feet off the
West right of way line is a watermain. The whole street could be
vacated, with the City keeping a 23 foot right of way and Mr.
Albers getting ten feet. While he could not use the twenty-three
foot right of way to build on, it could be used as part of the
yard or a garde.n, but no structure could be built upon it. The
garage could be built up to the twen-ty-three foot line.
There is no problem with gas or electric utilities.
The Subcommittee decided to suggest vacati.ng Johnson Street
from 53rd Avenue through to Highway #694 thereby eliminating any
future problem of vacation.

The Engineering Department was requested to notify abutting
property owners of Johnson Street asking them to make their wishes
known at the next Planning Commission meeting of October 22, 1969.
MOTION by Zegle.n, seco.nded by Crowder, that the Plats & Sub-
divisions-Stre�ts & Utilities Subcommittee recommend approval of the
vacation request, SAV #69-10, Thoma.s Albers, to vacate Johnson Street
on the West line of Lot 1, Block 2, Swanstrom's Court with the
retention of the appropriate utility easement from Johnson to
Highway #694. Upon a voice vote, all voting aye, the motion carried
unanimously.

divisio.ns-Streets & Utilities Subcommittee meeting of October 15,
1969 be adjourned at 5:30 P.M. Upon a voice vote, the motion
carried.
