The meeting was called to order at 7:00 o'clock P.M. by Chairman Schmedeke.

1. LOT SPLIT RE UEST: L.S. ��70-11, CHARLES E FOSTER• Lot 1, Block 1, Oak
Creek Addition Plat 4�2. Taking 85 feet for an additional building site.
Mr. Foster explained that his lot has 28,500 square feet and he was split-
ting off 85 feet for a new building site. His present house is located on the
East end of the property, and the proposed lot would be on the West side with
access to Glen Creek Road. The split would leave him a lot 131'x136'. His
present garage would be about 8 feet from the new lot line. Mr. Foster said
the present fence is about 5 inches from the lot line.
The Engineering Assistant commented that the water and sewer lines go
down Glen Creek Road. Mr. Foster has the utility easement on his property
and the road easement is on the property to the North. He said that many
years ago, about 1962, it was usual to assess sewer and water on the building
site instead of the front footage site. Mr. Foster was told it might be
advisable for him to check this. The description would be a simple one -- the
Westerly 85 feet of Lot 1, Block 1, Oak Creek Addition Plat �E2.
MOTION by Crowder, seconded by Meissner, that the Plats & Subdivisions-
Streets & Utilities Subcommittee recommend approval to the PZanning Commission
of the .Lot Sp1i t, L.5. #70-I1, by Charles E. Foster, of Oak Creek Addition
Plat #Z, specifically the Western 85 feet of this particular lot with the
recommendation that SS feet be the minimum width. Upon a voice vote, a11 voting
aye, the motion carried unanimously.
2. CONTINUED PROPOSED PRELIMINARY PLAT: P.S. 4�70-01 ROGER M. JONES: Part
of the SW� of the NW1� of Section 2 for golf driving range - M-2 zoning.
Mr. Jones and Mr. Alvin E. Davies were present.
Mr. Meissner, the Subcommittee member who was absent at the June 24, 1970
meeting, said he had read the minutes, looked at the site and did not see any-
thing he would object to.
The Engineering Assistant said the pattern of the streets ha�s been set
with those of Bob's Produce Ranch to the South. The island of 1.3 acres was
created to prevent traffic congestion on University Avenue. Chairman Schmedeke
questioned whether the��should consider making the island lot larger.

This was not enough land to meet the requirements of the Zoning Code for an
industrial site, but it would meet those for a gas station. Mr. Meissner
believed a precedent had already been set at Bob's Produce and Commerce Park.
MOTION by Crowder, seconded by Meissner, that the Plats & Subdivisions-
Streets & Utilities Subcommittee recommend to the Planning Commission approval
of the proposed preliminary p1at, P.S. #70-01, University GoZf Estates, as
shown on the Document dated May, 1970. Upon a voice vote, aI1 voting aye, the
motion carried unanimously.
3. LOT SPLIT RE UEST: L.S. ,��70-10, ROBERT T JOHNSTON: Split off 10 feet
from Lots 6 through 10, Block 9, Spring Brook Park and add to Lot 5,
Block 9, Spring Brook Park for driveway to garage.
The reason for a request of a lot split was given by Mr. Johnston. His
neighbor owns Lots 6 through 10 from Ely Street and Mr. Johnston's present
driveway is on the Westerly 10 feet of these lots. There is a row of bushes
bordering Mr. Johnston's driveway. The driveway was used by Mr. Johnston, but
his neighbor paid the taxes. Now there is a new owner and if Mr. Johnston
would ever want to sell, he could have a legal problem.
Mr. Crowder called attention to the two unattached garages on the neighbor`s
property, and that the garage on Lots 8 and 9 would be 2� feet from the new
property line.
MOTION by Zeglen, seconded by Meissner, that the Plats & Subdi visions-
Streets & Utilities Subcommittee recommend to the P.Zanning Commission approva.Z
of the Lot Sp1it, P.S. #70-Z0, by Robert T. Johnston, for the Westerly 10 feet
of Lots 6, 7, 8, 9 and .ZO, Block 9, Spring Brook Park to be added to Lot 5,
Block 9, Spring Brook Park for driveway. Upon a voice vote, all voting aye, the
motion carri�d unanimously.
4. PROPQSED PRELIMINARY PLAT, P.S. ��70-02, GEORGE N. NELSON: Lots 30 and 31,
Auditor's Subdivision No. 129. Public hearing July 22, 1970.
Mr. George Nelson, Sr. was present.
The Engineering Assistant explained that Mr. Nelson has also requested a
Special Use Permit for the area on the North Half of Lot 30 and the North Half
of Lot 31, except the North 125 feet, to permit parking, recreational areas
and accessory uses. The Public Hearing for the Special Use Permit will be heard
the same evening as the Preliminary Plat.
There is a row of single family dwellings planned along Onondaga Street.
The buildings on the South Half of Lots 30 and 31 would face 73rd Avenue. The
street pattern will be the same as the earlier one proposed for this area.
There would be a 30 foot easement down to a point 25 feet from the center of
the block to provide for one half of the right of way that may be necessary
if a street would be extended West. The lots for residential on Onondaga Street
are plenty large. The necessary easements for streets and utilities will show
on the final plat.

MOTION by Crowder, seconded by Meissner, that �the PZats & Subdivisions-
Streets & Utilities Subcommittee receive the original ink sketch, dated Jul� 8,
1970, showing the proposed preliminary plat, P.S. #70-02, by George N. NeZson
for Lots 30 and 3Z, Auditor's Subdivision No. Z29. Upon a voice vote, a11 voting
aye, the motion carried unanimously.
MOTION by Meissner, seconded by ZegZen, that the Plats & Subdivisions-
Streets & Utilities Subcommittee recommend approval to the Planning Commission of
the proposed Preliminary PZat, P.S. #70-02, by George Nelson for Lots 30 and 31,
Auditor's Subdi vision No. 129 as shown in the sketch received this evening
(dated JuZy 8, 1970) subject to the necessary easements for the road aZong the
Northwest side of the p1at; aZso subject to any required utiZity easements and
contingent upon the Special Use Permit being approved. Upon a voice vote, aZZ
voting aye, the motion carried unanimously.

PROPOSED PRELIMINARY PLAT
INC.: That portion of the
.S. �f70-03, BLACK FOREST ADDITION BY VIF
z of the Slz of Section 24. (Acres, Inc.
A brief resume of the history of this property was given by Darrel Clark.
He said the property was owned by Acres, Incorporated. The land contained hills
and woods and an old gravel pit on the New Brighton side. It has been reported
that New Brighton would take quite a bit of the sewage. The City checks the
plans for water and sewer sizes and depths, but does not have the facilities or
personnel to check the plans in detail.
Viewcon, Inc. plans to develop the land into two basic uses. The Westerly
portion will be single family dwellings and the East will be multiple. They
contemplate purchasing into New Brighton for continuation of multiple. Because
they have tied up money for a limited amount of time, they are asking that the
preliminary plat and the rezoning request be considered at the same time. Plans
will be available at the next meeting.
