AN ORDINANCE ADOPTING CHAPTER 99, SECTIONS 99.011 THROUGH
99.201 PRESCRIBING A PENALTY FOR THE VIOLATION THEREOF AND
ADOPTING MINNESOTA STATUTES RELATING THERETO AND REPEALING
CHAPTERS 96, 97, 98, and 99 OF THE CODE OF THE CITY OF FRIDLEY.
THE COUNCIL OF THE CITY OF FRIDLEY DO ORDAIN AS FOLLOWS:
99.011.- Adoption of Minnesota Statutes Sections 609.05, 609.085,
609.175, 609.22, 609.27, 609.37, 609.375, 609.40, 609.475,
609.485, 609.50, 609.505, 609.51, 609.515, 609.52, 609.525, 609.53,
609.535. 609.545, 609.555, 609.565, 609.57, 609.575, 609.595, 609.60,
609.605, 609.615, 609.65, 609.655, 609.66, 609.675, 609.68, 609.685,
609.705, 609.715, 609..72, 609.725, 609 J 35, 609.74, 609.745, 609.75,
609.755, 609.775, 609:78, 609-.785, 609.79, 609.795, 609.805, 609.81,
609.815, 609.82, 340.96 and 614.57, are hereby adopted and sha11 be
in full force and effect in the City of Fridley insofar as applicable.
99.021, Violation a Misdemeanor. The violation of any of the sections
or subsections of this ordinance by any person, firm or corpor-
ation, partnership or legal entity shall be deemed a misdemeanor and shall
6e punished by a fine o� not more than one hundred dollars or by imprisonment
in the county jail for not more than ninety (90) days. The violation of each
section or subsectioa hereof shall be deemed a separate violation, each to be
deemed a separate misdemeanor.
99.031, General Principals. Liability for Crimes of Another.
609.05.
Subdivision 1. A person is criminally liable for a crime committed
by another if he intentionally aids, advises, hires,,
counsels, or conspires with or otherwise procures -'
the other to commit the crime,
Subdivision 2. A person liable under Subdivision 1 is also liable
for other crime committed in pursuance of the
intended crime if reasonably foreseeable by him as a probable
consequence of committing or attempting to cammit the crime intended.
Subdivision 3. A person who intentionally aids, advises, hires,
counsels, or conspires with or otherwise procures
another to co�it a crime and thereafter abandons his purpose and
makes a reasonable effort to prevent the commission of the crime
prior to iCS commission, is not liable if the crime is thereafter
committed.
Subdivision 4. A person liable under this section may be charged
with and convicted of the crime although the person who directly
committed if has nnt been convicted or has been convicted of some
other degree of the crime or of some other crime based on the
same act.
99.041. Anticipatory Crimes, Conspiracy. 609.175.
Subdivision 1. To cause arrest or prosecution. Whoever conspires
with another to cause a third person to be arrested
or prosecuted on a criminal charge knowing the charge to be false �
may be sentenced to imprisonment for not more than 90 days or to
payment of a fine of not more than $100.00,
Subdivision 2. To co�nit crime. Whoever conspires with another
to courcnit a crime and in furtherance of the
conspiracy one or more of the parties does some overt act in
furtherance of such conspiracy may be sentenced as follows:
(1) If the crime intended is a misdemeanor, by a sentence to
imprisonment for not more than 90 days or to payment of a fine
of not more than $100.00;
Subdivision 3. Application of section. This section applies if;
(1) The defendant in this state conspires with
another outside of this state; or +

(2) The defendant outside of this state conspires
with another in this state; or
(3) The defendant outside of this state conspires
with another outside of this state and an overt act
in furtherance of the conspiracy is conanitted within
this state by either of them.
99.051. Offenses against the person. No person shall coc�nit an offense
against the person of another or of violating any of the following
sections of Minnesota Statutes:
(a) 609.22 Assault.
Whoever does any of the following commits an assault and may be sentenced
to imprisonment for not more than �90 days oi to payment of a fine of not
more than $100.00:
(1) Does an act with intent to cause fear in another of immediate
bodily harm or death; or
(2) Intentionally inflicts or attempts to inflict bodily harm upon
another.
99.061

99.071 Offenses against the Family._ No person shall commit an offense
against the family by violating any of the following Sections of
Minnesota Statutes:
(a) 609.375. Non-support.
99.081. Offenses against the Government. No person shall commit an off�nse
against the government by violating any of the following Sectioas
of Minnesota Statutes:
(a) 609.40. Flag violation.
99.091. Crimes Affecting a Public Officer of Employee. No person sha11
commit an'pffense again3t or affecting a public officer or employee
by violating any of the following Sections of Minnesota Statutes:
(a) 609.475. Impersonating an officer.
99.101, Offenses against the Administration of Justice. No person shall
commit an offense against the administration of justice by violating
any of the following Sections of Minnesota Statutes:
(a) 609.485 Escape from custody.
(b) 609.50 Obstructing Legal Process or arrest.
(c) 609.505 Falsely xeporting crime.
(d) 609.51 Simulating legal process.
(e) 609.515 Misconduct of judicial or heaxing officer.
99.111. Offenses of Theft. No person shall conmiit an offense of theft
by violating any of the following Sections of Minnesota Statutes:
(a) 609.52 Theft.
(b) 609.525 Bringing stolen goods into state.
(c) 609.53 Receiving stolen property,
(d) 609.535 Issuance of worthless checks.
(e) 609.545 Misusing credit card to secure services.
99.121. Offenses of Damage or Trespass to Property. No person shall commit
an offense of damage or trespass to property by violating any of
the following sections of Minnesota Statutes:
(a) 609.565 Simple arson,
(b) 609.57 Attempted arson.

(c) 609.575 Negligent fires.
(d) 609.595 Damage to property.
(e) 609.60 Dangerous trespass and other acts.
(f) 609.605 Trespasses and other acts.
(g) 609.615 Defeating security on realty.
99.131. Offenses of Forgery and Related Crimes. No person shall commit
an offense of forgery or other related crime by violating any of
the following Sections of Minnesota Statutes:
(a) 609.65 False Certification by Notary Public.
(b) 609.655 Alteration or removal of identification number.
99.141. Offenses Against Public Safety and Health. No person shall coimnit
an offense against public safety and health by violati.ng any
of the following Sections of Minnesota Statutes;
(a) 609.66 Dangerous weapons.
(b) 609.675 Exposure of unused refrigerator or container to children.
(c) 609.68 Unlawful deposit of garbage, litter or like.
(d) 609.685 Use of tobacco by children,
99.151. Offenses of Public Misconduct or Nuisance. No person shall commit
an offense of public misconduct or nuisance Uy violating any of
the following Sections of the Minnesota Statutes:

99.171. Offenses relating to communications. No person shall commit an
offense relating to couununications hy violating any of the following
Sections of Minnesota Statutes:
(a) 609.775 Divulging telephone or telgraph messages; non-delivery.
(b) 609.78 Emergency telephone calls.
(c) 609.785 Fraudulent long:distance telephone calls.
(d) 609 J 9 Making anonymous telephone calls,
(e) 609.795. Opening sealed letters, telegrams, or packages.
99.181 Offenses Relating to a Business. No person sha11 comiit an offense
relating_to business by violating any of the following Seceions
of Minnesota Statuies:
(a) 609.505 Ticket scalping.
(b) 609.81 Misconduct of pawnbrokers.
(c) 609.815 Misconduct of junk or second-hand dealers.
(e) 609.82 Fraud in obtaining credit.
99.191 Miscellaneous Offenses, No p��rson sha11 co:zanit an offense as
regards intoxication, vagrancy, etc. by violating any of the
following Section of Minnesota Statutes:
(a) 340.9� Intoxication.
(b) 614.57 Vagrancy.
