AN ORDINANCE RELATING TO POLICE PENSIONS; REQUIRING POLICE
OFFICERS HIRED AFTER SPECIFIED DATES TO BECOME MEMBERS OF
P.E.R.A. POLICE AND FIRE FUND; AND PERMITTING OTHER POLICE
OFFICERS TO BECOME MEMBERS OF SAID P.E.R.A. POLICE AND FIRE
FUND.
THE CITY OF FRIDLEY DOES ORDAIN AS FOLLOWS:
Section 1. Notwithstanding the provisions of any aeneral or special
law, all police officers employed by the City after the effective date of this
Ordinance shall be members of the Public Employees Retirement Association
Police and Fire Fund, and shall not be eligible for membership in the Fridley
Police Relief Association.
Section 2. Notwithstanding the provisions of any general or special law,
all police officers employed by the City prior to effective date of this
Ordinance may request transfer from the Fridley Police Relief Association to
the Public Employees Retirement Association Police and Fire Fund; said request
to transfer shall be subject to all applicable Minnesota Statutes and rules
and regulations of the Public Employees Retirement Association. Application
for transfer shall be subject to the approval of the City Council of the City
of Fridley.
Section 3. If any section of this Ordinance is for any reason held illegal,
invalid, or unconstitutional by the decision of any court of competent jurisdic-
tion such decision shall not affect the validity of the remaining sections hereof.
The Council hereby declares that it would have passed this Ordinance and each
section hereof, irrespective of the fact that any one or more sections be de-
clared ille9al, invalid, or unconstitutional.
