DIREC?IONAL SIGN means a sign erected on public or priva�e property which bears the address and/or name of a business, institution, church, or other use or activity, plus �!irectir�nal arrow for information on location. N DISIRICT refers to a specific zon�ng district as de`ined in the Fridley Lonino Ordinance. 0. FLASHING SIGN means an illuminated sign which centa�ns inter- mittent lights or exhib�ts nottceable chanc;es Zn color or l�ght tntensity. P. FREE STANDING SIGN means a sign e�h�ch is securely attached to the ground and not affixed to any part of any other structure Q. GOUERNMENTAL SIGN means a s�gn which ts erected 6y a governinental um t for the purpose of direct�ng or gu�ding traffic or other public information. R. IDENTIFICATIDN SIGN means a sign vvhich states the name or address or both of the occupant or occuparts of the lot or building where the sign is placed. S. ILLUMINATED SIGN means a sign which �s illuminated by an arti- ficial light source. T. TNFORMATION SIGA! means a sign gn�in, informat�on tc employees, v�sitors, or delivery vehicles, but cor�tatn�ng no aduertising or tdent�fication. U. INSTITUTIONAL SIGNS mears a sign or bulletin board which ident�- fi es the name and oiher char�cteristir,s of a public or private institution on site where the sign is located V. MOTION SIGN means a sign which revolves, rotates, has moving parts, or g�ves the �llusion of motion. W. NON-CONFORMING SIGN means a sign wh�ch lawfu'ly existed prior to the adoption of this ordinance, but does not conform to the newly enacted requirements of this ordinance. X. PERMANENT SIGN means a sign which is intended to be used for an indeftnite period of time. Y. PORTABLE STGN means a si9n so designed as to be movable from one location to anoiher and which ts not permanently attached to the ground, a sign structure, or a 6uilding. Z. PORTA-PANEL means a 6ack to 6ack, mobile advertising device, mounted on wheels and used for commercial as v�e11 as c�v�c promotions. AA PROJECTING SIGN means a sign, other than a wall sign, that pro- ,7ects perpendicular from a buildrng structure. BB RAILRO{ID CROSSING mear,s a railroad trackage w�htch intersects and crosses a street right-of-way at grade with the street. CC. ROOF SIGN means a sign which is erected, constructed, or attached wholly or in part, above the roof of a build�ng. except where the roof ts an extended facade DD. RUMMAGE/GARAGE SIILE SIGN means a temporary sign which advertises or directs the public to an tnfrequent sale of genera1ly used merchandise sold from a private residence. ., r`i � S r ; � Urd�nance No 666 (Cont.) EE SIGN means a lettered board, or other d�splay, and �ts support structure, used to advertise, direct, �dentify, inform, or convey a message to one who v�ews it. FF. SIGN AREA means the total area of the si9n, including the border and the surface wh�ch bears the advertisement, or in the case of inessages, figures, or symbols attached directly to any part of the bu�lding, it �s that area wh�ch is included �n the small- est rectangle wh�ch can be made to circumscribe the message, figure, or symbol displayed thereon. The stipulated maximum s�gn area for a free standing sign refers to a s�ngle fac�ng. GG. SIGN STRUCTURE means any structure which supports, or is capable of supporting, any sign. Said definition shall not include a building to wh�ch the s�gn �s attached. HH. SHOPPING CENTER/MULTIPLE USE BUILDING means a building plannetl and developed for mult�ple occupancy use as commercia] or �n- dustrial enterprise. II. TEMPORARY SIGN means any sign, banner, pennant, valance, or advert�sing d�splay constructed of cloth, canvas, light fabric, or card6oard, wallboard, or other light mater�als with or with- out frames; intended to be displayed for a limited per�od of time not to exceed thirty (30) days JJ. WALL SIGN means a sign which is affixed to the wall of any building. KK. WALL GRAPHICS means a graph�c design or decorattve mural not �ntended for identification or advertising purposes, which is pa�nted directly on an exter�or wall surface. LL. wIND6W SIGN means a sign installed inside a window for the purposes of v�ewing from outside the premises. This term does not include merchandis� located in a window. MM. UNLAWFUL SIGN means a sign wh�ch is in conflict with this or- dinance. SECTION 214 03 GENERAL PROVISIONS GENERAL The following provisions 214.031 - 214.033 shall apply in all PROVISIONS districts. Al1 signs shall be constructed in such a manner and of such mater�al that they shall be safe and substantial, provided that nothing in this Chapter shall be interpreted as authorizing the erection or construction of any sign not now permissible under Chapters 205 - 206, inclus�ve, of this Code. 214 031 SIGNS PROHIBITE� IN ALL �ISTRICTS � A. Polii�cal Signs POLTTICAL SIGNS a) Max�mum size shall not exceed th7rty-two (32) square feet b) Sians shall be removed within five (5) days followinq the election c) A fifteen ($15) dollar deposit will be deposited with the City pr�or to the erection of signs and retained until the signs are removed. If signs are not removed, the deposit will be used to defray the cost of removal. Within one hundred eighty days (180) of the adoption of MULTIPLE USE this chapter, all owners of shopping centers and multiple use BUILDINGS buildings of three or more businesses, must submit a comprehenstve s�gn plan for their center or bu�iding to the City Council for approval. B. SECTION 214.05 GENERAL REQUIREP�lEN7S A Permits• GENERAL REQUIREMENTS 1. Before a sign may be displayed �n the City of Frid1ey, the owner or lessee of the premises on which the si9n is located shall fi1e appl�cat�on with the City Zo m ng Admim strator for permission to display such sign. Permits are required for all existing, new, relocated, modified or redesigned signs except ihose specifically exempt under Section 214.05 A, 4. 2. The issuance of a perm�t may also be sub�ect to add�tional conditions �n order to promote a more reasonable combination of signs and to promote conformity with the character and uses of ad�oim ng property. The conditions wil7 be sub�ect to the discretion of the Zomng Admimstrator ObJections to the conditions can be apoea7ed to the City Council by the applicant. 3 Temporary signs erected by a non-profit or9anization are not exempt from obtai m ng a permit for signs, but the City may waive the fee requirement 4. No permit is required under this section for the following signs• a) W�ndow sign. b) Address sign. c) Signs erected by a governmental un�t or pub1ic school d�strict. d) United States Flag. e) 6ench s�gns. f) Memorial s�gns or tablets contaim ng the names of the building, its use and date of erection, when cut or built into the walls of the butlding. g) Signs which are completely within a bu�ldrng and are not visible from the outside of said building. h) Temporary signs (214.032, H). i) Signs having an area of three (3) square feet or 1ess. B Application. PERMIT APPLTCATION 1. Application for permits shall 6e made to the Zoning Administrator. 2. If a sign authorized by perm�t has not 6een installed within ninety (90) days after the date of issuance of said permit, the permit shall become null and void unless an extension is 9ranted by the Building Inspection �epartment. 3. The Zon�ng Admin�strator may require other information concern�ng safety C Fees; FEES Permit fees and expiration dates shall be as provided in Chapter 11 of the Fridley City Code � License, Fees, Bond LICENSE, FEES, BOND No person, firm or corporation shall engage in the business of erecting stgns under this chapter unless licenses to do so are approved bv the Council. Such license may be granted by the City Council after written application to the City Glerk. The annual license fee and expiration date shall be as provided in Chapter 11 of the Fridley C�ty Code. No license shall take effect until the licensee shall file with the City Clerk a corporate surety bond in the sum of $l,DDO and conditioned that the licensee shall conform to all the provisions of th�s chapter and indemm fy and hold the City, �ts officers and agents, harmless from any damage or claim resulting from, � � 1 Ordinance No. 666 (Con't.) 3 G: 4 or related to the erection or maintenance of any sign in the City, by the licensee. A license and bond shall not be required of any applicant who is not engaged in the business of erecting signs, who chooses to construct and erect their own sign on their own property. E. Exemptions: EXEMPTIONS The exemptions permiited by Section 214 05, A, 4, shall apply only to the requirement of a permit andJor fee, and shall not be construed as relieving the tnstaller of the s�gn, or the owner of the property on � which the sign is located, from conforming with the other provisions of this chapter, F. Maintenance. MAINTENANCE l. The surface and structure of all s7gns shall be mainta�ned ln a safe, presentable, good structural material condition at all times, including replacement of defective parts, parnting, repainting, cleaning and other acts required to prevent the sign structure and surface from becoming hazardous or unkempt �n appearance 2. When any sign for wh�ch a permit is required is removed, the Zom ng Administrator shall be notified and the entire sign and its components shall be removed G. Existing Signs: EXSSTING SIGNS 1. Signs Eligible for "Legal Non-conforming" Status. a) Any sign located within the City limits on the date of adoption of this ordinance which does not conform with the provisions of this ordinance, is eligible as a"legal non-conforming° sign and is permi�ted, provided it also meets the following requ�rements. � 1) The sign was covered by a sign permit on the date of the adoption of this ordinance if one was requ�red under applicable law, or 2) If no sign permit was required under applicable law for the sign in question, the sign was in all respects in compliance with applicable law on the date of the adoption of this ord�nance. � 2. Loss of Legal Pdon-conforming Status a) A legal non-conforming stgn shall immedia�ely lose its legal non-conforming designation, if: 1) The sign is altered tn any way in structure (except for normal maintenance and change of inessages) which makes the sign less in compliance wi�h the requirements of this ordinance than it was before the alterations, or 2) The sign is relocated, or 3) The sign is replaced; or 4) The sign becomes dilapidated or damaged, and the cost of bringing said sign rnto compliance is more than 50! of the economic value of said sign, then the remainder of the sign is to be removed. 3. Abandoned Signs Except as otherwise provided �n this ordinance, any sign which identifies a 6ustness that has stopped operatton for a period of three months or more, or any sign wh7ch pertains to a time, event, or purpose which no longer applies, shall 6e deemed to have been abandoned. Permanent signs applicable to a business temporarily suspended because of a chan9e of ownership, or management of such a business, sha11 not be deemed abandoned unless the property remains vacant for a period of three months or inore. An abandoned s�gn is prohibited and shall be removed by the owner of the sign or the owner of the premises. �y �.a Ordrnance No. 666 (Con't.) SECTION 214 06 ENFORCEMENT A � C �� E ZonTng Administrator Responsible. ENFORCEMENT l. The Zoning Adm�m strator or agents shall be respons�ble for the enforcement of this chapter. Violations of Code: Any sign that does not comply w�th the prov�sions of this char.ter. 2. A sign that �s a hazard to the safety and welfare of the public Not�fication of Violation of Code 7. If the Zom ng Administrator or agents, sha77 find that any sign regulated by this chapter is unsafe, insecure, or is a menace to the public, or has been constructed or erected without a permit first being granted to the owner of the property upon which said sign has 6een erected, or is in violation of any other provis�on of this chapter, said Administrator shall give written notice by certif7ed ma�l, return receipt requested, of such violation of the owner and/or permit holder thereof. If the owner fails to remove or alter the siqn so as to comply with the provisions set forth in this chapter with�n twenty (20) calendar days following receipt of said notice, such signs may be removed by the City. The cost of th�s removal, includ�ng City expenses, shall be as a special assessment against the property upon wh�ch the sign is located and shall be so noted in the written not�ce to the owner and/or perm�t holder. 2 The Zon�ng Admim strator or agents may cause any sign or other advertising structure which is an immediate publ�c hazard to be r•emoved summartly after a reasonable attempt has been made to have the owner and/or permit holder remove the sign immediate7y. 3. When the City sends the notice of v�oiation, they will send a copy to both the permit holder and the landowner, �f they are dtfferent Penalty for Violat�on of Code• 1 Any violation of this chapter is a misdemeanor and is sub�ect to a11 penait�es prov�ded for such violations under the provisions of Chapter 9D1 of the Fridley City Code. Each day the violation continues in existence shall be deemed a separate violation. All signs are su6,7ect to such penalty for violation of the requirements of the dtstrict within which they are located, even though they may not 6e requ�red by this chapter to pay a fee or acquire a permii. Appeals• To prov�de for a reasonable interpretation of the prov�sions ef this chapter, a permit applicant who wishes to appeal an interpretation by the Zon�ng Admi m strator may file a notice of appeals with the Zoning Admim strator and request a hearing before the Appeals Commission, The Commiss�on shall hear aopeals and/or requests and make their recommendation to the City Council in the following cases• 1 Appeals where it 1s alleged that there 1s an error �n any order, requirement, decision or determination made by the administrative officer in the enforcement of this chapter. 2. Requests for variances from the literal provis�ons of th�s chapter in �nstances where there strict enforcement would cause an undue hardship. Before the Commission shall grant a vartance, it is the responsibility of the applicant to prove l. That there are exceptional or extraord�nary circumstances applicable to the property or to the �ntended use that do not apply generally to other property in the same vicinity and zomng district, � , ' � � � %` + ; , Ordinance No. 666 (Con't) 2. That the variance is necessary for the preservation and en,7oyment of a substantial property right possessed by other property in the same vic�nity and zone; but which is denied to the property in question, 3. That the strict applicatton of the ordinance would constitute unnecessary hardship, and �}. That the granting of the variance would not be materially detrimental to the pu6lic welfare or in,7urtous to the property or �mprovements in such vic�m ty or zone �n which the property �s located. SECTION 214.07 REPEAL REPEAL Chapter 214 of the Fr�dley City Code as it existed prior to the adoption of this ordinance is hereby repealed.
