ORDINANCE N0. 769
AN ORDINANCE AMETIDING AND RECJpDIFYING CHAPPER 602 E[�FfITLED "BEER
LICIIVSING" BY ADDING SECTIONS 602.13 AND 602.15, AND AMENDING
SECTIONS 602.01, 602.08, 602.09, AND 602.11.
The City Council of the City of Fridley does ordain as follavs:
602.01.
The follaaing definitions shall apply in the interpretation and
application of this Chapter and the following words and terms,
wherever they occur in this Chapter, are defined as follaas:
602.08. O�NDITIONS OF LI(�ISE
3. Constmiption By Minors.
No person under the age of nineteen (19) years shall be permitted
to consume beer on the licensed premises.
4. Etnployment Of Minors.
No person under eighteen (18) years of age shall be enployed on the
prenises of a tavern, except that persons under eighteen (18) years
of age may be employed as musicians, bus-boys and kitchen help.

8. Sales of Intoxicating Liquor.
No licensee who is not also licensed to sell intoxicating liquor
and who does not hold a"public drinking place license" shall sell
or permit the constmiption and display of intoxicating liquors on
the licensed premises or serve any liquids for the purpose of
mixing with intoxicating liquor. The presence of intoxicating
liquors on the pr�nises of such a licensee shall be prima facie
evidence of possession of intoxicating liquors for the purpose of
sale.
602.09, HOURS
2. Remairung on Premises.
It shall be unlawful for any persons or customexs, other than the
licensee or their �nployees, to remain on the premises aftex 1:30
a.m. Zhere shall be no conswnption of wine, non-intoxicating malt
liquor, or any intoxicating liquor by any persons, including
licensees or their emplayees, after 1:30 a.m.
602.11. RFSTRICrTONS ON PURCHI�SE AND
1. Age NLtsrepresentation.
Persons under nineteen (19) years of age shall not misrepresent
their aqe for the purpose of obtaining beer.
2, Inducing Purchase.
No pezson shall induce a person under the age of nineteen (19)
years to purchase or procure beer.

3. Procuxement.
No person other than the parent or legal guardian shall procure
beer for any person under the age of nineteen (19) years.
4. Possession,
Persons under nineteen (19) years of age shall not have beer in
their possession with the intent to consume it at a place other
than the household of their �rents or guardians.
6�2.13. LIABILITY INSORANCE
1. Etrery person licensed to sell at retail intoxicating liquor or
non-intoxicating malt liquor at on-sale or off-sale shall, after
March 1, 1983, demonstrate proof of financial responsibility with
regard to liability imposed by Section 340.95, to the Commissioner
of Public Safety as a condition of the issuance or renewal of his
or her license. Proof of financial responsibility may be given by
filing:
A, A certificate that there is in effect an insurance policy
or pool providing the follaaing minimwn coverages:
(1) 550,000 because of bodily injury to any one person in
any one occurence, and, sub�ect to the limit for one
person, in the amount of 5100,000 because of bodily in�ury
to two or more persons in any one occurence, and in the
amount of $10,000 because of in�ury to or destxuction of
property of others in any one occurence.
(21 550,000 for loss of ineans of support of any one person
in any one occurence, and, sub�ect to the limit for one
person, 5100,000 for loss of ineans of support of two or
more persons in one occurence; or
B. A bond of a surety company with minimum coverages as
provided in clause (A) above, or
C. A certificate of the State Treasurer that the licensee has
deposited with the State Treasurer 5100,000 in cash or
securities which may legally be purchased by savings banks or
for trust funds having a s�rket value of 5100,000.
2. An applicant for a license to sell at retail intoxicating
liquor or non-intoxicating malt liquor within the City of Fridley
at on-sale or off-sale shall, after March 1, 1983, demonstrate
groof of financial responsibility as set forth in Section
602.13(1) , to the City of Fridley as a condition for issuance or
renewal of his or her license. An applicant for renewal of such a
license must demonstrate proof of such financial responsibility to
the City o£ Fridley at the beginning of each license year.
3. A liability insurance policy required by Sections 602.13(1) and
(2) shall provide that it may not be canceled for any cause, either
by the insured or the insuxance company without fixst giving ten
days' notice to the City of Fridley in writing of the intention to
cancel it, addressed to the City Clerk of the City of Fridley.

4. A liability insurance policy required by Sections 602.13(1) and
(2) shall provide that the insurance com�ny agrees to contact the
� City of Fridley in in writing and addressed to the City Clerk of
the City o£ Fridley, within ten days' of any claim made against the
policy,
5. A liability insurance policy required by Sections 602.13(1) and
(2) that contains annual aggregate limits of liability shall
require the insured to buy additional coverage after any claim is
made that reduces the coverage under the policy below the
requiranents of Sections 602.13f1) and (2).

6. The operation of a retail intoxicating or non-intoxicating malt
liquor business at on-sale or off-sale, without having on file at
all times with tl�e City of Fridley the liability insurance policy
or other evidence of financial responsibility required under
Sections 602.13(1) and (2) shall be grounds for immediate
revocation of the license. Notice of cancellation of a current
liquor liability policy serves as notice to the licensee of the
impending revocation and unless evidence of compliance with the
financial responsibility requir�nents of Sections 602.13(1) and (2)
is presented to the City Clerk before the termination is effective,
the license will be revoked instantly upon the lapse.
602.15. PENALTY
Any violation of the provisions of this Chapter is a misdemeanor
and is sub�ect to all penalties pxovided fox such violations undex
the provisions of Chapter 901 of this Code.
