216.01. S°PORM WATER DRAINPC,E UTILITY ESTABL1S�tLY�
�'s-,� mu�iiciLaGi sLOrm sewer system shall be operated as a public utility
pursuant to t�4innesota Statutes, Section 444.D75 from whlch revenues will be
derived subject to the provisions of this Chapter and P�linnesota Statutes. The
storm water drainage utility will be part of the public works department anc3
under i:he adrninistration of the public works director.
216.02. RESIDIIV`iIAL EI�UIVALENP FACPOR
A Residential Equivalent Factor (REF) is the ratio of the average volune of
runoff qenerated by one (1) acre of a given land use to the average volurne o£
runoff generated by one (1) acre of typical single family residential land
use, during a standard one (1) year rainfall event.
216.03. L1�P➢7 USE CLASSIFICATION
The REF values for various 1�z� uses are as follows:

For the purpose of calculating storm water drainage fees, all developed one
iamily and duplex parcels shall be considered to have an acreage of one-third
(1/.�) acre. The storm water drainage rate sha]1 be 55.25 per quarter per
REF-acre.
216.05. CRIDITS
The Council may adopt policies recommended by the public works director, by
� resolution, for ad�ustment of the storm water drainage fee for parcels based
upon hydrologic data to be supplied by property owners, which dat�
demonstrates a hydrologic response substantially different irom the stanclards.
Such ad�ustments of storm water drainage fees shall not be made retroactively.

216 .06 , EXFT4PTIONS
The followinq land uses are exe�npt from storm water drainage fees:
1. Public rights of way.
2. Vacant, unimproved land with ground cover.
216.07, PAXMEN`1' OF �EE
Statements for storm water drainage fee shall be computed every three (3)
months and invoiced by the finance department for each account on or about the
tenth (lOth) day of the month follaaing the c�uarter. Such statement shall be
due on or before the last day of the month in which t.he statement is mailed.
Any prepayment or overpayment of charges shall be retained by the City and
applied against subsequent quarterly fees.
216.08. RECAI�Q7LATION OF FEE
If a property owner or person responsible for �ying the storn water drainage
fee questions the correctness of an invoice for such charge, such person may
have the detexmination of the charge recomputed uy written request to the
public works director made within twelve (12) months of mailing of the invoice
in question by the City.
216.09. PENALTY FOR LATE PAYMENT
Each quarterly billing for storm water drainaye fees riot paid when due shall
incur a penalty charge of ten percent (10%) oL- the amount past due.
216.10. CEIZCIFICATION OF PAST DUE FEFS �I TAXES
Any past due storm water dralnage fees in excess cf nlnety (90) da�js past due
on October 1 of- any year may be certified to the Countp Auditor f�r collecton
witn real estate taxes in the follaaing year pursuant to Tflinnesota Statutes,
Section 444.075, Subdivision 3. In addition, the City shall also have the
nght to bring civil action or to take other legal remedies to collect unpaid
fees.
