The City Council of the City of Fric7ley does hereby orc7ain as follows:
30.01 �'�� OF P(H,ICY
The City of Frictley deens it desirable to regulate lawful gamb].ing within its
�urisdiction as authorized by Minnesota Statute, Section 349.213.
30.02 I�II�IIT�OddS
The definitions in Nlinnesota Statute 349 are adopted by reference in this
chapter.
30.03 PWSrTf1BS SALE IN �-SALE �N7►PTF'.R 603 ��T�
The sale of pull-tabs in on-sale licensed premises slzall be conductecl by
qualified anci state licensed charitable oraanizations. In addition to
satisfying the qualifications set forth in Minnesota Statutes, Chapter 349,
� the follaaing reyulations and qualifications must be compliec� with by all such
charitable organizations:
L Ztaenty cents of each dollar of gross recei�ts fram lawful garibling withir,
the city shall be pledqed and contributed to lawful purposes as defined in
Minnesota statutes (1984) Chapter 349.12 subd.11, (a)(b) and (c), of which
four cents shall be appropriated to the city for distribution to charitable
purposes, six cents shall be distributed to orgamzations for city charitable
Furposes, and the remaining ten cents shall be used for all other lawful
purposes or expenses.
2. Must fi].e with the City Clerk annually a list cantaining the names and
addresses of all current men�ers.
3. Must file pull-tab financial reports monthly with the City Clerk.
4. May not have a pull-tab sale operation in more than two premises in the
City.
5. Must exhibit and sell pull-tabs in a method as required by the City.
6. Workers or managers may not divulge the niu��ber of or the dollar amount of
the winners at any time.
7. Shall not w-mingle game carcls.
8. Shall psy enployees a minimimi of the Federal minimwn wage anci no nore than
50� above Federal mimmwn wage.
� 9. Shall com�ly with all the provisions of Minnesota 8tatute 34R.
10. Gambling managers compensation shall not exceed $50.00 per week for
managing pull-tabs.
11. Shall register with the State Gambling Boara all equipment anc� supplies
used in a licensed on-sale liquor establishrnent.

12. The charitable orqanization shall not use a pull-tab which does not return
to the players a minimwn percentage of 75g nor a maximum percentage of 800,
which percentage shall include free plays awarcied.
13. The charitable orgamzation will be responsible for the booth anci other
equiFsnent used in the operation ot pull-tabs.

1. Lawful yambling exempt fran a license uncer Minnesota Statute, section
349.214, shall require a city pexmit. Applicatien for a�ermit shall be maae
to the City Clerk with �ayment of the specified fee in Chapter 11 of the City
Code.
2. To qualify for a city permit an orgamzation must be in existence for at
least three years and have at least 15 active mer�rs.
30.05 SE�ER2IBII,ITY
Every section, provision or p�rt of this Chapter is declared se�:arable fron
every other section, provision or part to the extent that if any section,
provision, or psrt of this Chapter shall 6e held �nvalid, such holding shall
not irroade any other section, provision or �art thereof.
30.06 P�HfLTIES
Any violation of thls Chapter is a misdemeanor arrd is sub�ect to all penalties
provided for such violations under the provisions of Chapter 901 of this Code.
