Executive HRA Director Scott Hickok, Community Development Director Subject: Northstar Rail Property Acquisition & Project Update Property Acquisition On Tuesday April 22 n, , Judge Sullivan granted authorization for the HRA to acquire the property necessary for the Northstar Station site through condemnation. We subsequently deposited the $3,165,000 with the District Court and took title to the property. Main Street Properties has subsequently fired the attorneys they had, hired a new attorney and have now filed a motion for a new hearing and have also filed an appeal of Judge Sullivan's ruling. Krass- Monroe is putting an informational memo together for you on this item and. Jim Casserly will be able to discuss this issue with. you on Monday night. Tunnel Installation BNSF /Park Construction began installation of the tunnel on Tuesday May 27t'and had the installation completed with in 30 hours. Brian Strand has some good photos and video we can share on Monday night. The amount of material, equipment, and crew needed to pull this feat off is amazing. Legislative Action Attorney Casserly will provide up to date information on our proposed changes to our Transit TIF Bill. The changes we sought will allow us to create multiple TIF Districts in the Northstar area, rather than 1 large district. Executive HRA Director Scott Hickok, Community Development Director Subject: Gateway Northeast Property Acquisition Update Sinclair Station - Update After finally receiving a signed purchase agreement for the Sinclair Station, we had Leisch Associates do two test borings for contaminants. One of the borings had contaminants, which are most likely residual from a previous leak on the Citgo Station north of the Sinclair site. The findings were reported to the MPCA as required by law and they are currently investigating to determine if this is residual from a previous leak or if they will start a new file and require remediation. A copy of the Leisch report has been attached for your review. As we had built in provisions to the purchase agreement providing us an out if the site is contaminated, the closing on the property is. being delayed until the MPCA makes a ruling. If this is residual from a previously closed leak, no further action will be necessary and we can move forward with the closing. If remediation is required, we will need to re- evaluate the purchase. Most likely we may want the current owner to clean up the property prior to closing, unless we can be assured through the Department of Commerce that we can be reimbursed from the Petrofund if we undertake the clean up. Tae - Kwan -Do - Update There is nothing new to report this month. The Kim's are still looking at a few other properties for potential purchase and relocation of their business. Alano Society An offer to purchase the property for the appraised market value of $805,000 has been prepared, and we expect the Alano Society Board members to respond back to us within the next few weeks. Acquisition of this property would add nearly 1 acre to the project area of a future redevelopment. Combined with the newer Van -o -lite building immediately north of this site, there may be enough land area to initiate a redevelopment for a medical clinic, senior building or other use. Demolition of Purchased Buildings Due to on -going costs, liabilities, and the condition of the properties purchased, Staff is recommending that the buildings previously purchased be demolished in September or October of this year. Attorney Casserly and I will discuss this with you further on Monday night, but there are actions the HRA could take to demolish the properties at this time and still create a TIF District for a redevelopment project in the future. Chief Building Official Ron Julkowski will go through the buildings on Friday May 30th and I will be able to provide a verbal report on his initial blight analysis to you on Monday night. In addition to displaying the depressing image of these vacant buildings on our busy thoroughfare, we have had continual problems with people dumping garbage, furniture, and electronics on our sites. We also had an exterior stand pipe for the fire sprinklers in the newer Van -o -lite break and flood a portion of the building. Additionally, we have had to keep electricity running in the older Van -o -lite building and keep it heated as a result of an odd water line connection to the Tae - Kwan -Do Center. MNDOT Chain Link Fence MnDot replaced the dilapidated chain link fence on the east side of University with a much more discreet black coated chain link fence. However, they did not bother to replace or even straighten the old fence posts....the term, "lipstick on a pig" comes to mind when I look at the fence. Technics! Executive HRA Director Mike Jeziorski, HRA Accountant Subject: Foreclosures In Fridley In the past few years the numbers of foreclosures have increased drastically as the economy has slowed and adjustable rate mortgages have locked in at higher interest rates. Foreclosures have an impact on a communities resources including increased police calls (as homes are broken into and copper stolen), fire calls, and code enforcement complaints. In 2007 there were 113 homes foreclosed in Fridley. During the 1St quarter of 2008, an additional 42 homes have been foreclosed. In order to address the problems created by these foreclosures City Staff from a number of departments met last week to discuss their role in a solution. As we met it became apparent that once the property has been foreclosed on, there is no role for the HRA to play. The HRH's role lies in educating homeowners of the various options available to help them avoid foreclosure. Staff is currently developing an educational hand out that will be sent to every Fridley homeowner early this summer. Impact on Our Home Improvement Loan Program In investigating the impact of foreclosures on our loan portfolio, staff discovered some relatively good news. We had originally assumed that we had a number of delinquent/slow loan payments, based on the past few monthly reports from our loan servicer, Community Reinvestment Fund. As we looked further into this issue with CRF, we found an error in their reporting spreadsheet. In total, there are only 3 loans that have been consistently late and /or delinquent in payment. Mike prepared the following analysis: Housing Loan Portfolio Analysis The City of Fridley HRA captures all of the activity involved with its housing loan program in fund 265. Currently the HRA has outstanding loan balances with 85 borrowers totaling roughly $1,033,317. Of this $1,033,317 only three loans totaling $40,847 (4.0% of the total portfolio) are delinquent. Though the property has been foreclosed, party A is still not relieved of the debt owed to the HRA and CRF continues with collection efforts. It is highly likely that Party A will file for bankruptcy and then be relieved from paying back the HRA loan. Loan B belongs to an elderly couple, with very little income, who have run into some unexpected medical expenses. Staff suggests moving this loan into our deferred loan program. This will require filing of a new mortgage, but will ensure the HRA is reimbursed upon sale of the home. Loan C belongs to a couple in which 1 of the wage earners is out of work and the other wage earner receives commission checks. They have a history of paying their outstanding balance every 4 -6 months, dependent upon the wage earners commission checks. Loan Application Analysis Staff further analyzed the reasons for the numbers*of loan applications received /processed to the number of loans issued by CEE over the past year. Initial assumption was that fewer people were qualifying for our loan program because of personal financial problems and /or CEE was using more scrutiny in approving people for our loans. Upon further investigation, the news was not as bad as we had assumed. Looking at the past 18 loan applications received /processed, though only 7 of them were issued loans, only 3 of them were denied. The remainder of the applications received /processed are in various states of activity: some have put their project and others or are still taking bids or trying to find a contractor. r ri QTY of fRIDLEY May 19, 2008 INFORMATION ITEM HRA WORK SESSION OF JUNE 25 2008 TO: Minnesota Solutions' Participants FR: Bonnie Balach RE: Summary of Community Development Provisions Following are some highlights of community development provisions that passed as part of the tax, supplemental appropriations and bonding bills on Sunday. A more detailed summary of all provisions that passed will be distributed probably later this week: Foreclosure: As I noted above, there are other foreclosure - related provisions that have travelled in various bills. This is just two tax provision. It looks like an exemption is provided to levy limits for a city,(3.9 for three years) for the costs reasonably and necessarily incurred for securing, maintain, or demolishing foreclosed or abandoned residential properties. A city must have either (1) a foreclosure rate of at least 1.4% in 2007, or (2) a foreclosure rate in 2007 in the city or in a zip code area of the city that is at least 50% higher than the average foreclosure rate in the metropolitan area. Foreclosure rate means the number of foreclosures, as indicate by sheriff sales records, divided by the umber of household sin the city in 2007. This seems to be in place of foreclosure grants and this old house provisions that were included in the initial tax conference committee report. I'll have to comb through the language more carefully. There is another provision in the tax conference committee report that allows a cities to levy special assessments for the recovery of delinquent vacant building registration fees under a municipal program designed to identify and register vacant buildings. Business Subsidy. The amount of subsidy that a business must receive in order to trigger compliance with the statute is raised from $25,000 to $75,000. A city still has to develop criteria, though, for loans equal to or more than $75,000 or actual subsidy amounts equal to or exceeding $25.000. Corporate Subsidy Add Back Provisions: It looks like no language made it into the tax provisions agreed to by the Legislature, Senate and Governor. We most likely owe the Governor for that. Mortgage Registry Tax and Deed Tax. No increase was granted for counties requesting the use of thus tax for remediation programs. HRA Levy Increase: The increase is up to .0185 of taxable market value —from the previous level of .0144. Tax Exempt Bonding Allocation: Language was adopted that allows Minnesota to utilize a temporary bump in tax exempt bonding authority that may come forward during the interim.
