'DESicrrExs nNn rLnnnv�es of the Interstate hig�way sys-
tem are stuck on the homs ef a dilemma created by the
Federal Aid Highway Act of 1956, which provided that
the Interstate system be designed to accommodate traffic
volumes and tqpes predicted for 1975. Planning for
farther ahead is now justified, in fact demanded.
In 1956, designing for a lead time of 19 years was
ample. However, for a project going on the drawing
boards in 1963, the lead time after ope�ing the com-
pleted section to traffic has shrunk to less than 10 years.
Such short-range planning is manifesdy absurd.
One logical solution to the problem would be to
amend the Act to allaw designers to provide capacity
sufficient for traflic predicted 20 years from the time
the project enters the construction stage. Congress
should seriously consider such an amendment. �`he
�eed for resetting our sights on Intersta desig�
sta�dards is vital. /
The Unsettled Colo
TxE z�xanrrioNni. LnsT woxn sometimes represented by
a Supreme Court decision appears to he only the signal
for the next round in the long dispute between Arizona
and California over Colorado River water rights. And
the contest should continue because there has never
been a meeting of minds on Colorado water rights except
in the Supreme Court.
In the opinion favoring Arizona in its 11-year-old suit
against California (ENR June 13, p. 24), Justice Hugo
L: Black argued at great length that the Court majority
had been able to discern the intent of Congress in the
proposals, debates and discussions leading up to enact-
ment of the Boulder �Canyon Project Act in 1928, even
if not in the wording of the Act itself. Yet he prefaced
the majority conclusions not with a strong assertion that
here was a judicial reaffirmation of original legislative
intent, but rather with an almost apologetic explanation
that something ought to be done: "Unless many of the
issues presented here are adjudicated, the conflicting
claims . . . will continue . . . to raise serious doubts. . . .
In this situation we should and do exercise our juris-
dic#ion."
Justice William O. Douglas took the majority to task
for turning to the "proposals and counter proposals over
th� years" instead of finding -the intent of Congress in
the wording of the Act, as he, alone of the eight par-
ticipating justices, managerl to do, at least to his own
satisfaction.
We offer another dissent, and this from both the
Black and Douglas opinions: Namely, Congress never
stated its intent on Colorado allocations, and could not
because it never had a collective intent.
The Boulder Canyon Project Act clearly authorized

c�nstruction of Hoover Dam and the All-American
Canal, but the construction provisions carried along
with them a pathetically confused and ambiguous group
of suggestions on dividing up Colorado River water.
Granted, the confused wording may be explained by
t e fact that it was created in fierce debate in which
e ry phrase was hotly disputed, and to change a word
on e adopted was to undo a whole precariously com-
pr mised clause. Nevertheless it remains that Congress
in 1928 could not reach sufficient agreement to enact a
di 'sion of water, but could only agree to agprove in
ad ance a suggested interstate compact on dividing it in
ca e the states should agree later on a compact (they
n ver did ). Furthermore, the 1928 Congress could not
en clearly and consistently identify the water at issue
s mainstream only or mainstream plus tributaries.
In the face of this demonstrated inab�lity to agree on
its intent, the 1928 Congress is by proxy of the Supreme
Court in 1963 posthumously instilled with a decisive
resolution it never had on Colorado water allocations_
The Court has retroactively made up the mind of a
Congress unable to make up its own collective mind, and
has given the force of law to provisions not enacted in
1928 because they could not be enacted.
The 1928 Congress can be excused for not setding
Colorado allocations. The issue was hot politically,
but the critical time when somebody would actually have
to give up the disputed water �vvas still far in the future.
Now, however, the critical time is here; in fact, it can
be said to have arrived in the 1950s after Congress
shelved the Central Arizona Plan pending clarification
of Colorado water rights.
Into the vacuum of legislative indecision have moved
the judiciary and the executive: the Supreme Court and
the Interior Department. And why not7 As Justice
Black properly made plain, somebody had to do some-
thin�. But somebody ought to do more. Both A.rizona
and California have huge stakes riding on the Colorado,
and so does the country as a whole because these two
states and the river are joint parts of the country's fastest
growing seciion, a great concentration of political and
economic power. It is not appropriate to decide the
vital issues of today for such an important area by �
elaborately constructed guesswork as to the intentions �
of protagonists of 35 to 4U years ago who could not agree i�
then on what they meant and whose conclusions, even ,
if they had agreed, might be inapplicable now.
If Colorado water allocations were a proper char�e r
of Congress in 1928, they still are, and Congress should ,r�
reassert its authority in the issue. Interior Secretary �
Stewart L. Udall's conciliatory move to bring the lowe;f,�r
Colorado Basin states together for constructive coopera'
tion is laudable, but the discussions ought to take plac,i
in a framework unquestionably erected by Congress ap�;
not in one assembled by the Supreme Court as a res.c'
of congressional default. `�
