Zoning Code, they couldn't put a�rtuary in by a Speeiel Use Permit,
that � mortuary cauld be in an R-3 but not in an R-Z district and
their e���,,•.n� tJOUl.d be to rezone or amend the Zoning Code for a mort-
uary. The City Manager stated the Plannin� Co�mission was
suggesting the C3ty Cauncil amend this Section �5.19 of the code to
add funeral homes as they had recently added nnreing homes and double
bunga.lows and they could direct tlae City Attorney to prepare euch
an amendment. Counci3man Johanson 3nqufred iP there taere no zonings
at present� fox mortuaries and was told there was. Acting City
ATtorriey Juster explained the problem tiyas considered and it was
eaid a mortuary coul.d be pu� in an R-I distriat bu� they are pro-
perly 3ocated in a C-2 district. A9r. Andre�� Kohlan� attorney at
law, stated it was diffiaul� p��tting something by Special Use Permit
in an R-1 district. Meyor Nee replied that when they had is8ued
these on Speeial Use permits for double bunga.lows, they had required
four votes. Mr. Kohlan asa�rted that when they had allowed Special
Use Permits in R-1 sreas, they ha.d had same troub2e. Councilma.n
Sohaneon iaquired if it were possible to obtain a co�mittment f'ron
Mr. Millera the owner of the funeral home. Mr. Kohlan f�irther
asserted this had beea why Special Use Pexmits were not inclvded
in R-1 distsicts.
A discussion period was held regardin� the lacation of the proper�ty�
its uses, etc. Mayor Nee stated that both attoraeys present
seemed to think the City Council would be better a8eised to rezone
the property. '
Motion by Johanson to instruet the City Attorney to draw an
ordina.nce which would amend the Zoning Ordinance to permit the
construc�ion of funeral homes in A-1 on the basis of a Special
Use P+ermit by being rePerred to the Planning Coa�nissian, to the
