"Mayor Nee stated that he believes the Council should try to help this
property owner resolve the problem. He stated that there is an existing
building upon this property, and the property awner may wish to split the
remainder of this property into two additional lots. The City Engineer
stated that the lot split would result in small lots for com�nercial
.�' buildings, and that the property owner would probably need a waiver of
' the front yard setback requirement. The City Engineer $tated further :'
that the existing building of the property owner is only .two feet from
�the street right-of-way. Mayor Nee noted that an easement existed or
was shawn upon the back of this lot and asked whether the City or the

Section 51.01. In order to provide minimum requirements for the
protection of life, limb, health, property, safety, and welfare of the
general public and the owners and occupants of residential buildings,��there
is hereby established a Housing Code for the City of Fridley and is desig- -
nated as Chapter 51 of the Fridley City Code.
Section 51.02. Uniform Code by Reference. That subject to such ,
exceptions, modifications and changes as noted herein, the 1964 Edition�'
of the Uniform Housing Code published by the International Conference of
Building Officials is hereby adopted by reference and established as`the
Housing Code of the City of Fridley.�� ,
^ Section 51.03. Repeal of Existing Code. Any code or regulation
heretofore in effect in the City of Fridley and any provision thereof whick -
is contrary to or inconsiseent with the prbvisions of said Housing Code
and the exceptions, modi�ications and changes as noted herein, is of no
further �force and effect immediately upon the effective date of this
chapter, and the same is repealed. • �
Section 51.04.' Exceptione. The following exceptions, modifica-
tione an�l changes in the provisions of said Uniform Housing Code are made
with reapect to said Code and shall be in force in the City of Fridley:
;, (a). The Planning Coc�miission of the City of Fridley, as pro-
vided for in chapter 40 of the Fridley City Code s1�a11
. constitute the Housing Advisory and Appeals Board as �
provided for in Section H-203 of said Uniform Housing Code.
(b) The penalty for the violaCion of this chapter shall be the
penalties provided in Chapter 105 of the F'ridley City Code
and not the penalties set forth in Section H-204 of said
" Uniform Housing Code.
- (c� Buildin� Official. The City Manager is hereby designated
as the Bui�Iding Official ae provided for in the eaid Uni-
'form Houaing Code. The Citq Man6ger ie authorized to
designate one or more of the offici�le or employees of

WHEREAS, the elimination of sluma and blighted areas and the prevention of
their future growth is a major obje�tive of the City Council of the City of St. Louis
Park; and,
WHEREAS, the City has the right under its Charter to regulate the ma.intenance
and occupancy of all buildinge. and structurea within its boundariee; and, �
WIs..EREAS, the City Council is of the opir�ion that the enactment of this Ordinanco
is neceooary in order to protect the public health from the dangers of alum conditionE,
�lighted areas and aubstandard housin�; and,
WHEREAS, the City hae the right and duty to adopt and enforce euch police,
health and sa.nitary regulations as are neceaeary in order to prevent the spread of
disease; and,
WHEREAS, the experience of all cities has demonstrated that slum and blighted
areas recult from improper maintenance of dwellings, inadequate sanitation, over-
crowdiag of dwellings and general community neglect; and,
WHEREAS, the City Council deems the enactment and enforcement of this
Ordina,nce vitally essential in order to z�naintain and promote the peace� lives,
health, security and property of our inhabitants and to �romote the genexal welfare
of the City; and,
�NHEREAS, in the City of �t. Louis Park there are, or may in the future be
dwelling structures which are so dilapidated, unsafe, dan�erous. unhygienic, or
insanitary as to constitute a menace to ihe health and eafety of the people of this City
of St. Louis Fark.

SECTION 1. That maintenance, occupancy, and uae of d'wellinge and premises
are hereby regulated as follows:

. �ection 5:2101. Sectione 5:2101 to 5:2503, �nclusive shall be known as the
"H�uein� Code", may be cited as Euch and will be referred to herein as "this Code".
�ection 5:2102. The purpoao of this Code is to provide minimum require-
menta for the protection of life, limb, health, property, safety, and welfare of the ,
general �ublic and the ownera and occu;�ants of reaidential buildings.
- aection 5:2103. (a) Applicatio�. The provisions of this Code ehall apply
to all buildings or portiona thereof, uaed, or designed or intended to be used, for
human habitation. Such occupancieo ir_ existing buildir_�e may be continued as pro-
vided in 4ection 5:104 (g) of the St. C�ouis Park Building Code, except auch etructures
as are found to be substandard as defined in thig Code.
�:�here any buildin� or portio:i thereof, is usecl or intended to be uaed as
an apartment house or hotel, the provisions of this Coc�e shall apply to the separate
portions as if they were aeparate buildi��s.
(b) Alteration. Exiatin� buildings which are altered or enlarged shall be
made to conform to this Code insofar as the• new work is concerned and in accordance
with Section 5:104, Subdivisions a, b, c, d, and e of the St. Louie Park Building Code.
/1 (cj Relocation. Existing buil�ings which are moved or relocated shall be
considered as new buildings and shall comply with all the requirementa of this Code.
Section 5:2104 ��� �ut:3critl.Tae Building Official is hereby authorized
and directed to enforce alt the provisions of this Code.
(b) Ri�ht of Entry. Upon preEentation of proper credentials the Building
Official or his duly authorized representatives may enter at reasonable timee any
buildir_�, structure, or premises in the City to perforra any duty imposed upon him
by this Co3e. .
(c) Responsibilities Defined. Every owner remains liab�e for violations
of duties imposed upon him by this Code ,even though a:i obligation is also imposed
on the oceupants of his building, and even though the owner has, by agreement,
impose�? on the occupant the duty of furnishing requirecl equipment or of complying
with this Code.
Every owner, or his agent, i:� addition to being responsible for maintaining
his buil�i:�g in a sound structural condition, shall be re�ponsible for keeping that
part of the building or premises which he occupies or controls in a clean, sanitary,
and eafe condition including the shared or public areas in a building containing
two or more dwelling units. �

Every owner shall, where required by thia Code, the health ordinances
or the health officer, furnish and maintain such approved sanitary facilitiea as
� required, and shall furnieh and maintain approved devices, equipment, or faci-
-" lities for the prevention of insect and rodent infestation, and where infestation ha8
taken place, shall be responaible for the extermination af any insects, rodents,
or other peste when such extermination is not specificall� made the responsibility
of the occupant by law or ruling.
Every occupant of a dwelling unit, in addition to being responsible for
keepin� in a clean, sanitary, and aafe condition that part of the dwelling or dwell-
ing unit or premises which he occupie� and controla. shall diapoae of all his rubbish,
garbage and other organic waste in a manner required by the health ordinance and
approvEd by the health officer.
Every occupant shall, where required by this Code� the health ordinance
or the health officer, furnish and maintain approved devices, equipment or facili-
tiea neceosary to keep his premises safe and sanitary.
Section 5:2 202. All buildin�E or poxtione thereof which are determined to
be eub�tandard as defined in this Co3e are hereby declared to be public nuisances
and shall be abated by repair, rehabilitation, demolition, or removal in accordance
with the procedure apecified in Sectiona 5:1025 to 5:1036, both inclueive. of ttie

� Section 5:2 204. It shall be unlawful for any person, firm, or corporation
to erect, construct, enlarge, alter, repair, move, improve, remove, convert, or
demolish, equip, use, occupy� or ma.intain any buildin� or structure in the city, or
cause or permit the same to be done, contrary to or in violation of any of the pro-
visions of this Code.
Any person, firm, or corporation violating any of the proviaions of this
Code eh.all be guilty of a misdemeanor, and each such person shall be deemed
guilty of a separate offense for each and every day or portion thereof during which
any violation of any of the provisions of this Code is cornmitted, continued, or
permitted, and upon conviction of any such violation such peraon shall be punished
by a fine of not more than one hundred �ollara ($100.00) or by imprisonment for
not to er.ceed ninety (90) days.
� ection 5:2301. No peroon, firm., or corporatien shall erect, construct,
enlarge, alter� repair, move, improve, remove. convert, or demolish any build-
ing or ctructure, or cause or permit the aame to be done, without first obtainin�
a aeparate building permit for each such building or etructure from the City of
St. Louis Park in the, manner and according to the applicable conditions prescribed
in St. �,ouie Park Building Code.

Section 5:2303. All buildin�s or atructurea within the scope of thie Code
^ and all construction or work for which a permit is required ehall be subject to in-
apection by the Building Official in accordance with and in the manner provided by
this Code and the St. Louis Park Building Code.

Sectioa 5:2401. For the purpooe of this Code, ccrtain abbreviations�
terms, rhrases, words, and their derivatives ehall be construed ae specified in
thia Chapter. Worda ueed in the sin�ular include the plural and the plural the
singular. Words uaed in the masculine �ender include the feminine, and the
femiaino the masculine. Terme� worcla, phrasee� aad thoir dorivatives umod but
not apecifically defined in this Code shall have the meanin� defined in Chapter 4
of the Uniform Building Code, ae adoPted by reference as a part of the St. Louis
Park Buil3ing Code.
Apartment. Apartment shall :nean a dwelling unit as defined in this Code.

��partment Houae. Apartme:�t house is any builctan�, or portion thereof,
which i� desi�ned, built, rented, lea�ed, let, or hirecl out to be occupied, or
which ia occupied aa the home or resiclence of three or more familiee living in-
depen�ently of each other in dwelling unita as defined in this Code. �
Approved. Approved as to materials and types of construction, refera
to approval by the Building Official aE the r�esult of investigation and teste con-
ducted by him, or by reason of accepted principles or testa by national authoritiea,
n technical or scientific organizations.
Basement. Basement is that portion of a buildin� between floor and ceil-
ing, which is partly below and partly above �rade, as defined in this Chapter, but
so located that the vertical distance from grade to the floor below is less than the
vertical distance from grade to ceiling.
Board of A peals. Board of A;�peals when used herein shall mean

Boarding House. Boarding houoe is a lodgin� house in which meals are
provided.
Building. Buildin� shall mea�z any buildin� or structure, or portion
thereof, which is used, or designed or intended to be uaed for human habitation
for livin�, sleeping, cooking, or eatin� purposes or any combination thereof.
Building, Existin�. Existin� building is a builclin� erected prior to the
adoption of this Code, or one for which a legal buildin�; permit has been iaBUed.
Buildinp, Official. Building Official ie the officer charged with the admin-
� istration and enforcement of this Code, or his regularly authorized deputy, to-wit:
the Building InapecLor• also known as tho Supervisor of Protecti�re Inspection. aad
the Health Officer with respect to eaaitation and heatth provieions hereof.

Ceiling Hei,�ht. Ceiling height shall be the clear vertical distance from .'��:�
the finiehed floor to the finiehed ceiling.

Cellar. Cellar is that portion of a building between floor and ceiling which
is wholly or partly below grade, as defined in this Chapter, and so located that the
vertical distance from grade to the floor below is equal to or greater than the vertical
distance fxom grade to ceiling.

Court. Court is an open, unoccupied space extending not more than 24
inchea below finish grade and bounded on two or more sides by the walls of the
building. An inner court is a court entixely within the exterior walls of a buildiag.
All other courts are outer courte.
Dormitory. Dormitory is a room occupied by more than two gueste.
Dwellin�. Dwelling is any building or any portion thereof, which ia not 8ri
"Apartment House", a"Lodging House", or a"Hotel" as defined in this Code, which
contains one or Lwo "Dwelling Units" or "Guest Roorns", used, intended, or designed
to be built, used� rented, leased, let, or hired out to be occupied, or which ara
occupied for living purposes.
Dwelling Unit. Dwelling unit is a.auite of two or more habitable roorne
which are occupied or which are intended o� deaigned to be occupied by one family
with fa�ilities for living, sleeping, coo!�:ing and dining.
Efficiency Living Unit. Efficiency living unit is any room having cooking
facilities ueed for combined living, dining, and sleepi:�� purpoees and meeting the
requirementa of Section H-503 (b). Exception.
Exit. Exit is a continuoua and unobstructed means of egresa to a public
way� and shall include intervening doorways, corridors, ramps. etairways, smoke-
proof enclosures, horizontal exita, exterior courts, and yards.
.^, amily. Family is an individual or two or more persone related by blood
or ma,rriage, or a group of not more than five persons; excluding aervants, who
need not be related by blood or marria�e, living together in a dwelling unit.
.Grade (Ground Level). Grade (Ground Level) is the average of the finished
ground level at the center of all walls of a building. In case walls are parallel to
and within five feet (5') of a aidewalk, the above ground lovel ahall be measured
at the eidewalk.

Guest Room. Guest room in any room or rooms used, or intended to be
used by a guest for sleeping purposes. Every one hundred aquare feet (100 eq. ft. )
�^ of superficial floor area in a dormitory ia a guest room.
Habitable Room. Habitable room shall mean any room meeting the require�
ments of this Code for sleeping� livin�,cooking or dini::� puxpoaes excluding auch
enclosed places as cloaeta, pantriea, bath or toilet room�, service rooms, connect-
ing corridore, laundries. unfinished at�ice, foyers, storage apaces, cellara,
utility rooma and aimilar apaces.
iiealth Officer. Health officer shall be the le;ally deaignated head of the
Department of Health of this City� or his duly authorizec representative.
Hot Water. Hot water shall be water at a temperature af not less than
120°�'.
Hotel. Hotel ie any buildin� containing six or more guest rooma intended
or designed to be used, or which are usad, rented or hired out to be occupied, or
which aro occupied for sleeping purpo�ea by guests, whether rent is paid in rr;oney,
good, lak�or, or otherwiee. It does not include any jail, hospital, asylurri, sani-
tarium, orphanage, prison, detention home, or other institution ia which huma.n
beinge are housed and detained under Ie�al .reatraint.

Interior Lot. Interior Lot is a lot other than a corner �ot.

Kit�c.hen. Kitchen ehall mean a room u8ed, or deaigned to be used, for
the preparation of food.
Lodging House. Lodging house i� any buildin� or portion thereof, con-
*.aining not nnore than five guest rooms which are uaed by not more than five
gueats where rent is paid in money, �oods, labor or otherwise. A lodging house
shall �comply with all of the requiremer_ts of this Code for dwelling$.
Nuisance. The following shall be defined as nuisances:
(a) Any public nuisance .know±z at common law or in equity juriaprudence.
(bj Any attractive nuisanco wnich may prove detrimental to children
. whether in a buildin�, on the premiseg of a building� or upon an
unoccupied lot. Thie includes any abandoned wells, . shafts, base-
ments, or excavations; abandoned refrigerators and motor veh�cles;
or any structurally unsound fences or structure3; or any lumber,
trash, fences, debria, or vegetation which may prove a hazard
for inquisitive minora.
(c) Whatever is dangerous to human life or is detrimental to health.
(d) Overcrowding a room with occupante.
(�) Inavfficient ventilation or illumination.
� (f) Inadequate or insanitary aowerage or plumbing facilities. �
' (g) Uncleanlinesa.
(h) Whatever �rendere air, food, or drink unwholesome or detrimental'to
the health of human bein�s.

Occupied Space.• The tota.l area of all buildings or structur�a on any lot
or parcel of ground prajected on a horizontal plane excluding permitted projectione
�1 ae allowed by this Code.
Roomin� House. Rooming House ehall mean the same as Lodging House.
�ervice Room. Service room shall mean any room ueed for storage, bath
or utility purposes� and not included in the definition of habitable rooms.

�torY. Story ia that portion of a building included between the upper surface
of any floor and the upper surface of the floor next above, except that the topmost
atory shall be that portion of a buildin� included between the upper eurface of the
topmost floor and the ceiling or roof above. If the finished floor level directly
above a basement or cellar is more than six feet (6'� above grade euch basement or
cellar ahall be considered a atory.
�uperficial Floor Area. Superficial floor aroa shall mean the net floor
area withia the enclosing walls of the room in which the ceiling height ie not lesa
than fivo feet (5'), excluding built-in equipment auch as wardrobes, cabinete.
kitchen units, or fixturea.
Uniform Buildin� Code shall mean thoae portions of the Uniform Building
Code. 1958 Edition, published by the International Conference of Building Officials
adopted by reference by the City of St. _Louis Park as a part of its buiiding code
�which fe referred to herein as the St. Louia Park Building Code. References herein
� to Chapter 203 of the Uniform Buildin� Code or subsections thereof, ehall mean and
refer to correeponding aection of the St. Louis Park Ordinance Code relative to
removal, repair or to demolition of buildings ae found in Section 5:1025 to
5:1036 thoreof.
Used. Uaed ehall mean used or designed or intended to be used.

Vent Shaft. Vent shaft is a court used only to ventilate or light a water
closet, bath, toilet, or utility room or other service room.
:FJindow. Window ahall mean a glazed opening, including glazed doora,
which open upon a yard, court, or recese from a court, or a vent shaft open and
unobatructed to the sky.
Yard. Yard is an open, unoccupied space, other than a court� unob-
structed from the ground to the sky, e°cept where specificaily provided by this
Code, oz the lot on which a building is situated.
Section 5:2501. Adoption of Houeing Code by Reference. There is hereby
adopted by the City o# St. Louis Park for the purpose of prescribing regulations
governiag maintenance, occupancy, and use of dwellinge and premiaes� that

�ection 5:2502. A eals. lnihenever the Building Official shall take action
which is disputed, or when it is claimed that the provieions of the code do not apply
or that the true intent and meaning of the code have beer_ misconatrued or wrongly
i�nterpreted, the aggrieved party may appeal from the docision of.the Building
Official to the Building Conetruction Code Advisory Commiesion for its recommen-
dation within 30 days from the date of the decision of the Building Official and to
the City Council for final decision.
Section 5:2503. Separability. Should any aection, subdivision� clause,
paragraph, sentence, or word of this ordinance, or of tchQ code hereby adopted,
be declaxed by a court of competent jurisdiction for any reason to be invalid, such
decieion ahall not affect the validity of the ordinance aa a whole nor any part thereof
other than the part so declared to be invalid. it is the intent of the City Council that
it would have pa8sed all other portione of th�is ordinance independe�t of the elimin-
atioa herefrom of any such portion ae ma.y be declared invalid.
SECTION 2. This ordinance ahall take effect fifteen days after ite publication.
