AN ORDINANCE TO PROVIDE MINIMUM REQUIREMENTS FOR THE PROTECTION
OF LIFE, LIMB, HEA�TH, PROPERTY, SAFETY, AND WELFARE OF THE
GENERAL PUBLIC AND THE OWNERS.AND OCCUPANTS OF RESIDENTIAL BUILD�
INGS AND PROVIDING A PENALTY EOR THE VIOLATION TI�;REOF AND TO BE
KNOWN AS THE ''HOUSING CODE" AND DESIGNATED AS CHAPTER 51 OF THE �
CITY CODE OF FRIDLEY.
The Coutncil of the City of Fridley do ordain as follows:
Section 51.01. In order to provide minimum requirements for the�
protection of,life,,.limb, health, property, safety, and welfare of the `,
general public and the owners and occupants o£ residential buildinga,;,there
is hereby established a Housing Code for the City of Fridley and is desig-
nated as Chapter 51 of the Fz�idley C�ty Code.
SecEion 51.02.. Uniform Code�b� Reference. ' That subject to such
exceptions, mddifications and changes as noted herein, the 1964 Edition
of the Uniform Housing Code published by the International Conference of
Building Officials :is hereby adopted by reference and established as the
Hnusing Code of the City of Fridley.\
/"� � Section 51::03. Repeal of Existing Code. Any code or.regulation
heretofore in effect in the City of Fridley and an� provieion thereof which
is contrary..to..or i�consistent with the prbvisibns of said Housing Code �'. '
and the exceptions; modiEicafions and chenges as noted herein, is of-no
further �force,and effect immediately upon the effective date of this
chapter, and the same is repealed.
Section�51:04: Exceptions. The following exceptions, modifica-.
tions and�chaages'�i,'n the provisions of said Uniform Housing Code are made '
with respect:to said Code and shall be in force in the City of Fridley: '�

"(a) The Planning Commission of the City of Fridley, as pro-
vided for in chapter 40 of the Fridley City Code shall. ��':

(b) The penalty for the violation of this chapter shall be the �

WHEREAS, the elimination of slums and blighted axeas and the prevention of �
their future growth is a major obje!;tive of the -City Council of the City of St. Louia +

WHEREAS, the City has the rigl7t under its Charter to regulate the maintenance
and occupancy of all buildinge, and structuree within ite boundaries; aMd,
WY..EREAS, the City Council is of the opinidn that the enactment of this OrdinancQ
ie neceaaary in order to protect the public health from the dangers of alum conditions,'
b�ted areas and substandard housin�; and,
WHEREAS, the City hae thE right and duty to adopt and enforce such police, �
health and sanitary regulations as are neceasary in order to prevent the spread of
disease; and,
WHEREAS, the experience of all cities hae demonstrated that elum and blighted '
areas re�ult from improper maintenance of dwellings, inadequate sanitation, ovex-
crowdi�g of dwellings and general community neglect; and, `'

- SECTION 1. That maintenance, occupancy, and uEe of dwellinge and premises r
` are hereby regulated as followst :'

�ection 5c2101. Sectiona 5:2101 to 5:2503� inclueive shall be known as the �
"Housing Code", may be cited as such and will be referred to herein as "this Code".
�ection 5:2102. The purpoao of this Gode is to provide minimum require-
ments for the protection of life, limb, health, property, safety, and welfare of the ,,'
general rublic and the ownera and occu;�ants of reaidential buildings. .
�ection 5:2103. (a) Applicatio�z. The provisions of this Code ehall apply
to all �uildings or portione thereof, u�ed, or designed or intended to be ueed, for
human habitation. Such occupanciea ir cxieting buildin�s may be continued as pro- ?: •`
vided in section 5:104 (g) of the St. Louis Park Building Codo, except euch structures ':
as are found to be aubetandard as defined in thie Code.
'��here a.ny building or portio_i thereof, is usec? or intended to be uaed as
an apartment house :or-hotel, the proviaions of thie Code shall apply to the separate
portionE as if they were separate buildi�gs.
(b) Alteration. Exiatin� buildings which are altered or enlarged ehall ,be
made to conform to this Code inaofar as the new work is coneerned and in accordance
with Section 5:104, Subdivieions a, b, c, d, �and e of the St. Louie Park Building Code. .

(c) Relocation, Exieting builclings which are moved or relocated ahall be °
considered as new buildings and shall comply with all the ,requirements of thie Code.
Section 5:2104 ��� �uthcrit�r.The Building Official is hereby authorized
and directed to enforce alt the provisions of this Code.
(b) Ri�ht of Entry. Upon preaentation of proper credentials the Building
Official or his duly authorized repres:entatives may enter at reasonable times any
buildir_�, atructure, or premiaes in the City to perforr�a. any duty imposed upon him
by this Code. �
(c) Reaponsibilities Defined. Every owner remains liable fvr violations �
of duties imposed upon him by this Co�e ,even though a� obligation ia a18o imposed
on the occupants of his building, and even though the owner has, by agreement.
impose� on the occupant the duly of furnishing required equipment or of complying
• with thie Code.
Every owner, or his agent, irt addition to being reaponsible for maintaining ..
his buil�ing in a sound structural condition. shall be responsible for keepiag that
part of thc building or premiees which he occupiea or controls in a clean, earutary,
and safe condition includiag the eharoc� or public areae in a building coataini�g

Every owner shall, where required by this Code, the health ordinances
or the health officer, furniah and maintain such approved sanitary facilities as
�required, and shall furnish and maintain approved devicea, equipment, or faci-
lities for the prevention of insect and rodent infestation, and where infestation has
taken place, shall be responaible for the extermination of any inaecta, rodents,
� or other pests when such exterminatian ie not specifically made the responsibility
of the occupant by law or ruling.

Every occupant of a dwelling unit, in addition to being responsible for
keepin� i:z a clean, sanitary, and aafe condition that paxt of the dwelling or dwell-
ing unit or premises which he oceupie� and controla, shall di8pose of all his rubbiah,
garbage and other organic waete in a manner required by the health ordinance and
approvEd by the health officer. •
Every occupant ahall, where r�quired by this Code, the health ordinance
or the :�ealth officer, furnish and maintain approved devicee, equipment or facili-
ties neceoaaxy Lo keep hie premisea safe and sanitary.
Section 5:2 202. All buildings or portions thereof which are determined to
be aub�tandard as defined in this Code are hereby declared to be public nuisances
and shall be abated by repair, rehabilitation, demolition, or removal in accordance
with the procedure epecified in Sectiono 5:1025 to 5:1036, �oth inclueive. of ttie
St. Louio Park Ordinance Code. �
� Section 5:2204. It shall be unlawful for any person, firm, or corporation ,
to erect, construct, enlarge, alter� repair, move� improve, remove, convert, or
demolish, equip, use, ..occupy, or ma.intain any building or structure in the city, or
cause or permit the same to be done, contrary to or in violation of any of the pro--
visione af this Code. _ _
Any person, firm, or corporation violating any of the proviaions of this '
Code s!�all be guilty of a misdemeanor, and each such person shall be deemed
guilty of a separate offense for each anc� every day or portion thereof during which
any violation of any of the proviaione of this Code ie committed, continued, or
permitted, and upon conviction of any such violation such pereon shall be �punished ''
by a fine of not more than one t�undrod dollare ($100.00) or by imprieonment for
not to er.ceed ninety (90) days.
� ection 5:2301. No peraon, firm, or corporatien shall erect, conatruct,
enlarge, alter, repair, move, improve, remove, convert, or demolish any build- '�,

Section 5:2303. All buildings or atructures within the acope of this Code
and all construction or work for which a permit ia required ehall be subject to in-
'�spection by the Building Official in accordance with and in the manner provided by � .
this Code and the St. Louis Park Building Code.
Section 5:2401. For the purpo�e of this Code, certain abbreviations,
terms, rhrases, words, and their derivatives ehall be conetrued as epecified in ,,
this Chapter. Worda used in the singular include the plural and the plural the � �
singular. Words uaed in the maeculine �ender include the feminine, and the •
feminine the masculine. Terms, worcla, phrases, and their derivatives used but �
not apecifically defined in this Code shall have the meaning defined in Chapter 4 .
of the Uniform Building Code, ae adopted by reference as a part of the St. Louie
Park Buil3ing Code. '
Apartment. Apartment shall :nean a dwelling unit as defined in this Code.

is wholly or partly below grade, as defined in thie Chapter, and so located that the

Court. Court is' an open, unoccupied apace extending not more than 24
inches below finish' grade: and bounded on two or more eides by the walle of the
building. An inner `court is a court'entixely within the exterior walle of a building. {�,

Dormitory. Dormitory is a room occupied by more than Lwo gueste. �
Dwellin�. Dwelling ia any building or any portion thereof, which ie not �
"Apartment House", a"Lodging House", or a''Hotel" as defined in this Code, which �
containn one or two "Dwelling Units" or "Guest Rooms", used, intended, or designed
to be built, used� rented, leased, let, or hired out to be occupied, or which are
occupied for living purposes. .
Dwelling Unit. Dwelling unit is a suite of two or more habitable roome
which are occupied or which are intended o� designed to be occupied by one family
with facilities for living. sleeping, eoo!ting and dining. :
Efficiency Living Unit. Efficiency living unit ie any room having cooking .,
facilities uaed for combined living, dining, and sleepi�� purpoaes and meeting the
requirements of Section H-503 (b). Exception.
Exit. Exit is a continuous and unobstructed meana of egresa to a public
way, and shall include intervEning doorways, corridor$, rampe, etairwaye, smoke-� �� .�
proof enclosures, horizontal exita, exterior courts, and yards.
r amily. Family is an individual or two or more peraons related by blood
or marriage, or a group of not more than five persons; excluding servants� who
need not be related by blobd or marria�e, living together in a dwelling unit. -
Grade (Ground Level). Grade (Ground Level) is the average of the finished
ground level at the.center of all walls of a building. In case walls are parallel to
and within five feet (5') of a eidewallc, the above ground level shall be measured
at the eidewalk. _

(c) Whatever is dangerous to human life or is detrimental to health.
(d) Overcrowding a room with occupante.

Rooming House. Rooming House ehall mean the same as Lodging House.
�ervice Room. Service room shall mean any room ueed for atorage, bath
or utility purposea, and not included in. the definition of habitable roome. •
�tory. Story ia that portion of a building included between the upper surface
of any floor and the upper aurface of the floor next above, except that the topmoat
atory Bhall be that portion of a buildin� included between the upper surface of the
L•opmost floor and the ceiling or roof above. If the finished floor level directly
above a basement or cellar is rriore than six feet (b') above grade such basement or
cellar chall be considered a etory.
�uperficial Floor Area. Superficial floor aroa shall mean the net floor
area within the enclosing walls of the room in which the ceiling height ie not leee
than fivo feet (5'), excluding built-in equipment such as wardrobes, cabineta, ` �
kitchen unita, or fixtures.
Uniform Buildin� Code shall mean thoae portions of the Uniform Building
Code� 1958 Edition, published by the International Conference of Building Officials
adopted by reference by the City of St. .Louie Park as a part of ite building code
nwhich fa referred to herein as the St. 'Louis Park Building Code. References herein
to Chapter 203 of the Uniform Buildin� Code or eubsectiona thereof, ehall mean and
refer to corresponding section of the St. Louis Park Ordinance Code relative to
removal, xepair or to demolition of buildings ae found in Sectiori 5:1025 to
5:1036 thoreof.

- Vent Shaft. Vent ahaft is a court used only to ventilate or light a water ` 1�
closet, bath, toilet, or utility room or other service room. `
:FJindow. Window ahall mean a glazed openin�, including glazed doors,
which open upon a yard, court, or recose from a court, or a vent shaft open and
unobstructed to. the sky. :
Yard. Yard is an open, unoccupied space, other than a court, unob-
siructed from the ground to the sky, e.:cept where specificaily provided by this
Code, o� the lot on which a building is aituated.
Section 5:2501. Adoption of Houaing Code by Reference. There is hereby
adopLed by the City of St._ Louie Park for the purpoee of prescribing regulationa
governing maintenance, -occupancy, and uee of dwellinge and premisea, that �
^certain code entitled the !'Uniform Houeing Code� . 1961 Edition" prepared by • ,

�ection 5:2502. Appeal8� inihenever the Building Official ehall take actio�i
which is disputed, or when it is claimed that the provieions of the code do not apply ,
or that the true intent and meaning of the code have been misconstrued or wrongly
interpreted, the aggrieved party may appeal f�orn the docieion of the Building
Official to the Building Conatruction Code Advieory Commisaion for its recommen-
dation within 30 days from the dato of the decision of the Building Official and to ` 1
the City Council for final decision.
Section 5:2503. Separability. Should any section, subdivision� clause,
paragraph, sentence, or word of this ordinance, or of thQ code hereby adopted, �
be declared by a court of competent juxisdiction for any reason to be invatid, guch "
decision ahall not affect the validity of the ordinance ao a whole nor any part thereof �
other than the part so declared to be invalid� it is the intent of the City Couricil that
it would'have passed aIl other portions of t�is ordinance independent of the elimin-
ation herefrom of any Buch portion as may be declared invalid. �.
SECTION 2. This ordinance shall take effect fifteen days after ite publication. �
