In reviewing the ordinanoe a�ain, I have � the impre asion that our work i s still not done. Three problem are�8 seem to be appropriate tar�ets for our next effort. If we are �oin� to do that we ' must @cet settled, onoe and for all, to wh�t de�ree aad by wha,t methode we mu st e stabli ah that our ohan�e s are in the int ere at �� of the publio health, safety, welfare, eto.,.eto. � SPECIFIC PROBLEMS Improper Uses �llowed In looking at the li at s of use s Permitted in our various zonin� cate�ories, it apPeara to me that there are a number of uaes permitted whioh should not be allowed in the zone$ epeoified, and perhaPa should not be allowed anywhere in the City . Fridley has ohan�ed sinoe the liste of permitted uses were drawn up. It was oonoeivable to our "'�ounding Fathers'� that raiein� of oattle on a dairy farm would Qontinue forever in the City. It now seems unlikelg that thi s u�e will be de sired. It �eems even more un- likely that it is to the publio interest that auoh a use be per- mitted, especially in R-1 are�s. Truok terminal8 with their� associated noiae, olutter, and heaey traPfio do not seem to be proper uses for oommeraially zoned land where a�reat deal of shopper traYfia is normal and where merohants prefer alear, , unaluttered, and attraotive settin�e for their businesees. . E = �� - 2 - I have listed the inaompatible uses I oan see in our ordinanae ^--, in �t t achment 1 t o thi a memo . 9ome o f the�se u ae s probably ahould �� be removed oompletelg from our permitted liat. Many of them should be ohanged from one tqpe of area to another. Some of them, whioh require use permita, ehould have more explioit basee �iven for the grantin� oP use permit s. Hei�ht Limit s �s our ordinanoe now stands, I feel that we have a ei�nifiaant problem in the variation oP buildin� hei�hta allowed at boundaries between zones. In some oases, there ia a similar problem within a ain�le zone. Fi�urea 1 and 2 ahow in sketoh form the aort of thin� I am thinkin� of. Fi�ure 1 ahowa the situation whioh oan exist at the boundary between �1 or I�2 and R-3, C-2, or I�i l. ��+5 foot hi�h buildin� oan bs built within 22 Pe-et of the near- eat single famil� dwellin�. ,� 65 Poot hi�h buildin� oan be built within 30 feet. The ri�ht aide of Fi�ure 2 shows similar problems at the boundary betwsen R-1 or R-2 and N�-2 or P areas. Here, in addit i�n to the 45 and 65 foot hei�ht a, a 100 foot hi�h 8truature oan be built within 40 feet of the neareet ein�le family struo- ture. Even within the R-1 zonee, a hei�ht problem oan exiet, thou�h it � i s eomewhat le ss aevere and eomewh�t le ss likely to be a P�blem. Churahes, sahools, publia and sem��publio buildin�s oan be erected to a maximum hei�ht of 75 feet so long as all setbaoks are inoreased � bg 1 foot Por eaoh 2 feet of buildin� hei�ht over 35 feet. Presumabl� it would be le�al to build a theater in a C-2 zone with the basio roof hei�ht a� 65 fest and then build a eta�e house ( or fly �allery) to any „ dasired hei�ht ( 50 to 60 feet would not be unuaual) above that. '1'he - apPlioant muat pre sent drawin� s showing hia pl�nned parkin� spaoe, . draina�s, landsoapin�, stora�e areas, loadin� zones, etc. The new zoning aate�ories also spell out a means of enforoin� these plana, ones apAroved. The �+ity is authorized, after notice, to �� in and do work neaeseary to make the $ite oomply with the aPP�ved plan and char�e the owner for the work. Varioua st�ndard$ are set Por various types of areas. Our older zoning aate�orieg do not set very etrict standards for developere, and do not aet out any means of enforoin� thoae that exist. I feel that we ahould look at the entire area of performance atandarda with the idea of addin� to eaoh zonin� cate�ory the st�ndards which properly sh�uld be aPplied to it and should also provide a means of enforcing all these standards. ,�ND NOW THE REALLY BIG PROHLEM �1 reourring theme in our di scussions of problems faoin� the City �in aettin� up a well thou�ht out zonin� arran�ement has besn, !�`, "We oan't reallq ohan�e any�hin� that exiata without the owner�s permisaion. It may be only partially true,. and if that 18 true we have some sort of door open before us for makin� ohan�es. The openin� may not be wide, but if .it exiata we' really must find out how we can uae it. � �The U.S. Chamber oP Commerce; Construotion and Civio Development � Department, in Zon1n� and Civic DeveloPment published in 1950, � listed a number of zonin� prinoiples whioh have been universally aaoepted my the oourte. The A.9.P.0., at least, seea the Plannin� Commission ae an aotive body with �oals of it s own ( or rather with �oals for the oity ) rather than a Passive �roup whioh waits far the developer to oome in with the request and then triea to fi�ht the rear �uarci �otion to proteot the statua quo.
