As was evident to all of ua at the publio hearin� at our
last meetin�, the avera�e citizen is somewhat out of hia
depth the first time he attends a public hearin� before
aur Commission. In order for the citizen to partiaipate
knowled�ably in our �a���t��s proceedin�s we have to give
him information which he doe s not normally have . Thi s i s
usually done durin� the hearin� and tends to distraot from
consideration of the subject at hand. It certainly t�nde
to len�then our hearin� s.
I have written up a iew para�raphs on the back�round and
, purposes of public hearin�s which I am attachin� to this
memo. I think that the whole thin� could be mimeo�raphed
on the two sidea of a single sheet of paper. I would
su��est that we have copies o�' thia sheet made and put
them out on the chairs for the audience before az�y 3�
� meetin� at which we have s�'eduled a public haarin�. It'
half th� people there read it before we start, our prob-
lem should be si�ni�icantly decreased.
P�.ease consider my write-up and see if it strease$ the
thin� s which you feel ahould ba made available to people
who are to participate in one oY our hearings. I would

they are -- and �ahat they are not . We hope it will be helpful

To �ain the most from the hearin� and to participate in ft it
most eifactively, you should read throu�h this shest before
tha hearin� be�ins.
A B 0 U T Z 0 N I N G
In I��innesota, cities are allowsd to plan their development.
Zonin� is the method used to turn the plans into reality.
When the plan says that particular land is likely to find
its best use for stores and shops, that land is placed in
�"Commercial" zone. Where the best use is likely to be Por
house s or apartment a, one of the "Re sidential" zone s i s used.
Land 13kely to be best used for industry is plac�d in one
of the ��Manufacturin�'� zone a. The zonin� of the city i s
determined by the City council with the Plannin� Commisaion' s
advice and is adopted as an ordinance. Tod�,y' s zonin� re-
pre sant s the plan for the city' $ development as it exist a
tod�y. Since it is based on likel.v best uses, room Por
differences of opinion on the plan and thue on zonin� exiats.

,A change in zoning ia really a chan�e in plan. A plan made
today may not fit the chan�in� circumstances of another day.
The pers�n who request s a chan�e in zonin really i s sayin�,
"The plan we have today i s not correct . �he chan�e I pro� se
will make it a better plan for all ths peopls of Fridley. /
By the same token, the person who opposes a chan�e in zon�in�
i s really saying ,"The pvopo sed chan� e i s not in the be gt
interest of all the people� of Fridley and, therefore, the
pre sent plan should remain in force ."
P R 0 C E D U R E F 0 R C H A N G E S
Ths procedure ior changin� zonin� within the city is set by
laws adopted by the State Le�islature and by the City Charter.
,� chan�e in the city' s development plan affect s mar�y peopla
in ma�q way s, and the procedure i s de si�ned to offer pro-
tection to each citizen' s interest s. ,� public hearin� is
held by the Plannin� Commission on each reque st it re ceiv e s.
After etudy and consideration, the Commission report s it s
findin�s to the City Council. The �ouncil may accept or
rej act the Commi ssion' s adv ioe, but before the �ounoil make s
ar�y chan�e of zonin� it must also hold a public haarin� on
the requsated chan�e. Only aiter that may a chan�e be made.

The Pact that a hearin� is bein� held does not mean that
the city favors a chan�e. It simply means that a chan�e
has been requested and is bein� considered aa required.
Who can request a zonin� ohan�e?
�nyone with an interest in the property ooncerned.
I like the zoning the way it is. Why do I have to aome down
here and defsn� it?
In plannin�, there are almost always differences in op-
inion. The law requires the city to provide means oP
hearing any opinion which may be voioed on a zonin� change.
Will the zonin� be chan�ed as a result of toni�ht'S hearing?
No. The Commiasion may recommend �ranting or denyin� the
chan�s. The City Council may a�ree or disa�ree with the
Commission, but before any chan�e is made the �ounoil will
hold another public hearin� on the subject.
Will I be allowed to vote on the razonin�?
No. Fridley uses a representative form of �ovsrnment in
which the votera dele�ate the power to decide on zonin�
matters to the Couneil. The citizens may advise the Counoil
o�' .wa. their wi ahe s, but it i a left to the Council to aot
in the be st intere st of the entire city .
What' s the best way to �ive thia advice7
By speakin� at tha public hearing s. You should state your
view of the prablem and the solution that you favor. You
should �ive the reasons for your stand. IP you have exhibits
or document s or other information which will support your
position, you sh�uld submit them and discuss them. ,� calm,
thoughtful, and constructive approach is more likely to
brin� the ac�ion you deaire than an emotional appeal. IY
you favor the changa you should try to show that the chan�e
will benefit the city at large, not just yourself. xXg If .
you oppose the char�e, you should iry to ahow that a chan�e
will ba to the di sadvanta�e of the city at lar�e� not just
to yourself .

�urin� the past year �ae have gona throu�h thrse rounds of effort
a� improvin� our zonin� ordinance . The re sult s of the se effort �,
the CR-1, CR-2, and PD zonin� cate�ories, aPPear to be worthwhile
additions to the code. In reviewin� the ordinance a�ain, I have
the imprassion th�t our work is still not done. Three problem
areas seem to be appropriate tar�ets for our next effort.

problem we have faced and shied away from several times in the
past, namely, how do we �o about un�rading our zonin� ardinance
whsn chan�es affect existing zonin�. If we are to solve the
three problem�s mantioned, zae are �oing to havs to make chan�es
in �xistin� zoning re�ula�ions. If we are �oing to do that we
must �et settled, once and for all, to cahat de�roe and by what
methods we mus't establish that our chan�es are in the interest
of the public health, safety, welfare, etc., etc.

SPECIFIC PROBLEMS
Ir�proper Uses ;�,llowed
In looking at the lista of uses permitted in our various zonin�
cate�ories, it abPears to me that there are a number of uses
permitted which should n�t be allowad in the zones specified,
and perhapa should not be allowed anywhere in the City. Fridley
has chan�ed since the list s of permitted uses were drawn up. It
wa� conceivable to our "�ounding Fathers`� that raisin� of cattle
on a dairy farm would c�ntinue forever in the City. It now ssems
unlikely that thi s usa will be de sired. It seems even more un-
likely that it is to the public interest that such a use be per-
mitted, especially in R-1 areas. Truck tsrminals with their
associated noise, clutter, and heavy traffic do not seem to be
-proper uses for c�mmercially zoned land where a�reat deal of
shopper traffic is normal and where merchants prefer clear,
uncluttered, and attractive settin�s for their businesaes.

I have listed the incompatibls uses I can see in our ordinance
^ in ,�ttachmsnt 1 to this memo. Soane of the�se uses probably should
be removed completaly from our permiited list. T�Zany of them
should be cr,anged from one type of area to anothar. Some of them,
which require use pernits, should havo more explicit basea �iven
for the �rantin� of use permit s.
Hei�ht Limits
As our ordinance now stands, I feel that wa have a si�nificant
problem in the varia�ion of buildin� hei�hts allowed at boundaries
betwesn zones. In some cases, ther6 is a similar problem within
a sin�le zone. Fi�ures 1 and 2 show in sketch form the sort of
thin� I a� thinkin� of. ri�ure 1: �hows the situation which can
exi st a,t the boundary betwsen R-1 or � 2 and R-3, C-2, or Tvi 1.
�� 45 foot hi�h buildin� can be built zaithin 22 feet of the near-
est sin�le family dviellin�. :� 65 fo�t hi�h buildin� can be built
tiaithin 30 feEt. The right side of Fi�ure 2 shows similar problems
at the boundary between R-1 or R-2 and i��2 or P areas. Here, in
addit it�n to the 45 and 65 foot hei�ht s, a 100 foot high Structure
can be built within 40 feet of the neareat sin�le family struc-
t ure .
�ven within the � 1 zones, a height problem can exist, though it
is somewhat less severe and somewha.t less likely to be a problem.
Churches, schools, public and semi-public buildin�s can be eracted
to a maximum hei�ht of 75 feet so lon� as all setbacks are increased
� by 1 foot for each 2 feet of buildin� height over 35 feet. The
dottad line on tha left side Qf Fi�ure 2 shows the h��a�Y�t s�ahich
tnis rula allows. �, similar rule exists within C-1 areas with
the exception that the basic sCtbacks are different and the basic
maximum hei�ht to which incrementa are added is 45 feet instead
of 35 feet.
Y� final problem on buildin� hei�ht s exi st s in that the hei�ht
limits in all zones are waivsd with respect to '�belfries, cupolag,
doma s, spire a, monument s, roof hou�es, airway beacona, radio
towers, tiaindmills, fla�polea, chimney s, ...bulkheads, alevators,
water tanks, or poles, towers, and other structureg...not occupyin�
mora than 25 percent of the area of such roof." (`.Che roof of the
building in quastion.} �,s I read it, this says that thers is really
no si�nificant hei�ht limit that can bs snforc�d excapt on the
lar�est roof area of the buildin�. Pregumably it would be le�al
to build a theater in a�-2 zona with the ba�ic roof hei�ht at
65 fest and thsn build a sta�e housa (or fly gallery) to any
da sirsd hei�ht ( 50 to 60 feet would not b� unusual) above that .
The hi�h back vaall of this structure could be located within
30 feet of a house in an adj�ining R-1 area.

I' m not sure Trlhat items 3 and 4 mean, but at first dlanca thEy
^ scsm �o say that if the Cit3� can show that a chan�e in zon3.n� or
z�nin� re�ulations is reasonable and •r�orks to the benefit of the
public haalth, safety, etc., stc.; then the property owners in-
volved pretty well have to acce�t the situation. I'n sure we
need le�al advice on that.
The c,ue st ion ha s been rai sed as to ��ahether we nave the ri�ht to
initiats chan�es in zonin� or zonin� ra�ulations. The 1965
l��iinnesota Plannin� ,�ct, Cr.u�ter 462, D�vision 462.3�7, Subd. 4,
.�mendman � s say s, ' An ar�endMent �o a zonin� ordinanca nay be in-

at least, seas the Planning Cornmission as an active body with
��als of it s own ( or rather ��ith �oals for the city ) rather than
a Pa saive �raup which wait s for the developer to come in with the
request and tnen tries to fi�ht ths raar �uGrd action to protect
the s'tatus quo.
