� Member Jensen referred to Page 4, Item 6, the second sentence from the
last paragraph which should be corrected to read "For the record, these
suggestions are for designation purposes only and must be restudied before
being included in the construction program".
Member Jensen referred to Page 5, under Section 45.08, ��2, the word
"therefore" should be changed to "therein" reading as follows: ��2. Multiple

1. PUBLIC HEARING: REZONING REQUEST (ZOA ��67-03) BOISE CASCADE CORPORATION:
Rezone to M-2 all that part of SE� of Section 12 not presently zoned M-2.
Present, representing the petitioner, were Larry Griffith and Robert
Aspelin, Operation Manager of Studebaker Corporation.
The notice of the public hearing was read by the City Ma.nager.
Chairman Hughes explained that the procedure at a public hearing is to
allow the petitioner to describe his desired change, then to give the
Commission the opportunity to ask questions of the petitioner, and then to
make time available to the public for questions.
Mr. Griffith stated Boise Cascade Corporation owns the land, and he
is representing Studebaker Corporation who has taken an option on the land
with the idea of possible construction of a new plant site on the property.
Briefly, the rezoning is to reconcile the Northwest corner and the two 50
foot strips on the north and south of the parcel which were once used as a
setback guard. He stated they hoped that Studebaker will be able to build
out here. The plans are still tentative, and because we are only under an
option, the plans which we have are somewhat preliminary. �ao maps, one
an architect's preliminary conception of the exterior view of the proposed
buildings, and a blue print of proposed buildings and landscaping, were put
on the wall. Mr. Griffith introduced Mr. Aspelin who would answer questions
of the Commission and public.
Chairman Hughes mentioned that the Commission, in considering rezoning
requests of this type, while preliminary plans are of interest, must consider
this in terms of the impact of the change on the land.
Member Erickson asked what they have in mind for the use of the building.
Mr. Aspelin answered the owners are ma.nufacturers of engines and generators
and primarily this is what we would be doing here. We checked your code ,.
and we know that we can live within the code.
Regarding landscaping, Mr. Aspelin stated there is a grove of trees
which we would like to keep, will have grass and shrubs along 73rd Avenue,
Central Avenue and to the east end of the building. There would be no
outside storage as the .product is not such that can sit outside.
Regarding access, there will be three on 73rd Avenue and two on
Central.
In answer to the question if he could comment as to what the remainder
of this one quarter section would be devoted to, Mr. Aspelin said that we
are going to use all of the 1900 feet coming down to the railroad tracks,
but as far as future development at this point, we do not know.
The approxima.te footage of the structures is 400,000 square feet for
the plant and 100,000 square feet, including office buildings, which will
have three floors. •
� Paul L. King, 1301 Norton Avenue N.E.: You mentioned that you would
have a dock coming out onto Central Avenue.

Mr. Aspelin replied that a road will be put in through the central part
of the property to the docks, but the traffic will come out on Central
Avenue.
Mrs. Michael Silk, 7006 Pleasant View Drive, Mounds View; Will there
be any type of fumes? Answer: The only thing would be the steam in the
winter time, but that does not contaminate the air.
Mrs. Silk: How much trucking? Answer: There are seven truck docks
on the main plant and three in the other. I presume we have twenty-five or
thirty trucks a day, but they are not all diesel.
Mr. King: Are the docks enclosed? Answer: The docks downtown are
not enclosed except in the warehouse.
Mr. Silk: Do you have protection and dust facilities? Answer: We do.
Mr. Aspelin continued that the plant downtown is running two shifts,
and we expect to be down to one shift with the new plant. We have checked
the noise and we can go within the code easily. With the muffling we are
proposing, I do not think you are going to notice any more noise.
Mr. King: Once you get up into cheap rates over the rail, you would
probably be using the railxoad track more. Answer: Most transportation
is by truck.
^ Mrs. Wesley Ehlers, 6929 Pleasant View Drive, Mounds View: I�am not
familiar with the zoning of Fridley and wonder if there is a buffer zone
on the border. Does the industrial line go right up to the City line?

Chairman Hughes explained that Fridley has different buffer zones for ,
each category. For example, there is not a separate zoning category..along
the e.dge of property. Rather we write into the zoning code for each
particular category the setbacks, screening requirements, etc. In the
case of heavy industrial zoning, l00 feet is the setback. In this case,
the boundary will be 50 feet plus the ��reet.
Mr. King: If they are going to plan on building a plant of this size,
I think it would behoove the City of Fridley to have railroad crossing
signals put in on Central Avenue.
Chairman Hughes stated they (Studebaker) would not cross Old Central
with the railroad traffic as they are on the East side of Central Avenua.
Mr. Aspelin said they would probab.ly have about 10 cars a month.
Mr. Griffith stated, if at all possible, we would appreciate it if
action could be taken on the ma.tter some time this evening.inasmuch as
we are operating under a short term option. We have to have an answer on
the proposal in order to make a determination on the option. This is only
an option situation and that the decision has not been finally made to
locate here.

MOTION by Erickson, seconded by Myhra, that the public hearing of the
^ rezoning request (ZOA ��67-03), Boise Cascade Corporation, to rezone to
M-2 all that part of the Southeast Quarter of Section 12 not presently
zoned M-2 be closed. Upon a voice vote, all voting aye, the motion carried
_. unanimously.
Chairman Hughes stated that it appears from the way this land is presentl:.-
zoned that what is being requested is essentially to correct the existing
zoning. We have a circumstance of commercial and residential in small
parcels surrounded on two sides by industrial property. It seems likely
that if we were zoning this territory for the first time that we would
make it a major industrial tract. The petition is completely justified
and should be considexed in terms of a correction of what, at best, was
a mistake in the first place. The City Manager added that this was zoned
that way in 1955, probably for the matter of convenience only.
MOTION by Erickson, seconded by Ylinen, that the Planning Commission
recommend to the City Council that the rezoning request (ZOA ��67-03) Boise
Cascade Corporation to rezone to M-2 all that part of the Southeast Quarter
of Section 12 not presently zoned M-2, be granted. Upon a voice vote, all
voting aye, the motion carried.
2. REOPEN LOT SPLIT ��65-14, H. M. NYGARD: Part of Lot 14, Auditor's Subdivision
��129 .
Member Ylinen reviewed the discussion and motion of the Plats & Subdivi-
sions - Streets & Utilities Subcommittee meeting of Ma.rch 30; 1967, the �
� minutes of which are in this agenda.
MOTION by Erickson, seconded by Jensen, that the Planning Co�nission
Concur in the second portion of the Plats & Subdivisions - Streets & Utilities
Subcommittee motion in their minutes of March 30, 1967 and recommend to the
City Council approval of the Lot Split ��65-14, H. M. Nygard, being that
part of Lot 14, Auditor's Subdivision ��129 lying west of east 273.0 feet,
excegt west 17.0 feet taken for Central Avenue and except easement over
north 30 feet for road purposes for the modification of the request being
175 feet for the lot facing Central Avenue and 75 feet for the lot to the
east. Upon a voice vote, all voting aye, the motion carried unanimously.
3. LOT SPLIT REQUEST: L.S. ��67-01, MYLO PARKS: Parcels 2000, 2010 and 2020,
Auditor's Subdivision ��10 (Revised) - splitting for special ass.essmenCs.
The City Manager explained the circumstances of receiving the request
at the last minute. The lots were split in Anoka because of taxes, but the
County will not split assessments. The former owners have sold portions
and have not gone through the formality of a lot split. One of the present
owners will have to pay the assessments on land which he does not own, in
addition to his property, if the lot split is not granted.
The Engineering Assistant was requested to make a drawing to be ready
for the Council meeting on Monday, April lOth, showing the lots to be,
^ from West to East, approximately 110 feet, 125 feet, 109 feet, and.90 feet
of Lot 10, Auditor's Subdivision �610 (Revised).
MOTION by Jensen, seconded by Myhra, that the PTanning Commission
recommend approval of Lot Split ��67-01, all of Lot 10, Auditor's Subdivision
��10 (Revised) with frontages on Mississippi Street from West to East of

approximately 110 feet, 125 feet, 109 feet and 90 feet, subject to verifi-
^ cation and clarification by the Engineexing Department. Upon a voice vote,
alI voting aye, the motion carried unanimously.
It was noted there are two zoning categories in the above parcel, but
the Cammission felt that no further action was reguired now, but there is
the possibility of a request later on to extend the commercial zoning.
4. APPLICATION TO BOA.RD OF APPFALS: S, CHMIELEWSKI: Lot 12, Block 2, Osborne
Ma.nor, special use permit for two family dwelling.
Member Ylinen said he visited the property and talked to adjacent
property owners and only one indicated mild disapproval. He stated it was
a good lot. The petitioner lives in one of the adjacent homes. The
proposed structure would be two stories.
MOTION by Ylinen, seconded by Jensen, to recommend approval of the
petition of Severin or Eleanor Chmielewski, to the City Council for this
two family dwelling on Lot 12, Block 2, Osborne Manor with the specifica-
tion that there be a garage stall for each dwelling unit, connected to
the street with a hard surfaced driveway, and the remainder of the l�t
shall be sodded including the boulevard, and further stipulate that the
owner enter into an agreement with the City in connection with the above
requirements that if the owner does not comply with said requirements, the
City shall complefie said requixements and assess the cost back to the
property. Upor. a voice vote, all voting aye, the motion carried unanimously.
^ 5. THIRD STREET PATTERN:
Copies of the letter from Erickson Petroleum Corp. indicating their
desire not to participate in plans concerning carrying Third Street
through to 57th Avenue were passed out to the Commission members.
�n answer to Chairman Hughes question, Member Jensen (chairman of
the Plats & Subdivisions-Streets & Utilities Subcommittee) said it is
pretty hard to summarize. It involves literally months of study by the
Subcommittee and resulted in a fairly complete division of opinion as to
the merits or demerits of the proposal. The Subcommittee made two motions,
the first motion failed which favored the recommendation of the proposal.
Since there seemed to be no real feeling for continued review of the
pr�blem, it seemed to be the wisest move to forward it to the Planning
Couanission. This letter from Erickson Petroleum Corp. is a complete
surprise in view of the Subcommittee meeting cahicli took place on March 30th.
In a very short time they have more or less reversed their feeling. Mr.
Wagner called me after a discussion with Bob Rote so that I would be aware
of the reversal and I called Bob Rote, because the comments made to me
really did not say anything except they were no longer favoring this pro-
posal. Bob Rote informed me they own additional property north of 57th
Avenue across the street of their present site and it is the feeling now
of Bob Rote and the management that the street which they have in the gast
proposed could actually become a deterrent in the development of this
^ property. They could be in the position of having fostered a road which,
in a year or two, they might wish not to be there at all. They have not
developed specific plans at this writing, but did not wish to delay any
action if the Committee wished to continue the study.
Chaixman Hughes said that sometime ago a number of the members toured

�,,, this axea. This is a sample of an area on the boundary of an existing
primarily residential area and an existing commercial area, and typically,
we find at such a boundary, there is pressure for change. We have several
items for consideration. One is the ultimate use of this area. The other
is traffic flow from North and South to the Holiday Stores, and further
consideration of traffic flow within this immediate neighborhood. The
neighborhood is set off by Main Street, University Avenue, 61st Street and
57th Street to the South. This neighborhood is zoned from 57th Place and
North R-2 at the present time. 57th Place and 57th Avenue abut commercial
and residential. There are Uses still existing from the time of the origin-
al zoning which are non-conforming under our present Code and these are
not to be disregarded. With the advent of University Avenue with no service
road along that side of the property facing the high�vay, there was some
si�nificant division of opinion how the property should be resolved.
�
Mx. Schmedeke, a visitor, stated that within a week the party he
figured would come to the meeting with him backed out so that he was only
a listener until things are clarified to him what has happened. He was
not notified of the change until 4:00 o'clock.
The Commission wondered, because the prime petitioner had withdrawn,
if it might not be desirable to continue this matter until a later meeting.
Chairman Hughes asked Member Jensen that, as Chairman of the Subcoirunittee,
did he feel it would be desirable to study the preblem here and try to reach
some conclusion on the basis of likely development of the area?
Member Jensen said he could see no point or purpose in bringing it
back to the Subco�nittee, in view of the letter giving full consideration
of what Erickson Petroleum Corp. really desired. We have had some good
discussions and there certainly are no hard feelings regarding the outcome,
as far as I am concerned. We have no new approach to study it at the
present time.
Member Ylinen felt the Planning Commission should continue to give
a lot of thought to the problem of the area so that they can come to a
conclusion, as it has been on the Plats & Subdivisions-Streets & Utilities
Subcommittee agenda for three months. There has been some expression from
the residents living on 3rd Street regarding a way out to the South, and
their desires should be considered.
Member Erickson said that the Commission has not heard from the rest
of the people in the area, and should not forget Mr. Zizak who wanted a
vacation on 572 Avenue.
• Chairman Hughes said it seemed the Co�nission was in general agreement
along the line to continue the item for a period of 30 days.
MOTION by Erickson, seeonded by Ylinen., that the Planning Commission
continue the Third Street Pattern until the first meeting in Ma.y (May llth)
^ and further that we invite the residents or anybody else affected by thi�
proposal so that we can get the feeling of the people other than the peti-

It was agreed this could be done on an informal basis.
The City Manager was asked to send letters to the residents on the
West side of 22 Street between 57th and 61st Avenues all the way to
IIniversity, and to residents on both sides of 572 Place from Main Street to
University Avenue. Erickson Petroleum was to be invited and asked if they
can formulate their plans more definitely. It was to be understood that.
at this hearing a final decision will not be made in order to give the
people ample time to be heard.
Chairman Hughes said, as the Subco�nittee has not given a recommenda-
tion, it is reasonably clear the members of this Commission are not in a
position to make a recommendation. The Commission does not feel it would
be helpful to take the matter back to the Subcommittee and it does feel
it would be helpful to have the opinion of the people in that neighborhood.
6. REZONING INFORMATION: A. L. WILLIAMS: Lots 6 thru 9, Block 5, Spring
Brook Park. Rezone from R-1 to R-3 including study of area between
Ashton and railroad tracks.

Chairman Hughes reviewed the problem by stating that the Commission
indicated they would like to consider the matter, not only for these
four lots but also for the general vicinity. We have both manufacturing
and single family residences in both blocks. 1) We should not have a
dividing line, between zones, running down the middle of the block.
2) Rezoning these four lots is spot zoning. 3) Problem concerning
setbacks on all sides.
The area East of Ashton Avenue and North of 79th is presently under
multiple type uses ranging from single family dwellings, multiple dwel-
lings and industrial. Ashton Avenue is not in as a street. Between
Longfellow and Liberty there is a half block of dirt street, the closing
of which is in dispute. It was felt park area should be considered as
this area is cut off entirely from other areas.
The engineering department was asked to prepare a map showing how
the area would look with a street through as discussed in the meeting
and give it to Mr. Williams at the meeting of the 27th of April and ask
him if he wants to circulate a petition.
MOTION by Erickson, seconded by Ylinen, to ask the Engineering Depart-
ment to prepare a sketch showing the thinking that we have ap�lied to
this tract tonight and to have it ready for our meeting of April 27, 1967.
Upon a voice vote, all voting aye, the motion carried unanimously.
FUTURE LOCATION OF PUBL•IC WORKS GARAGE AND YARD:
Engineering Assistant Clark said the appraisals for th� suggested
locatior_s of Public Works garage and yard have not.been returned.
MOTION by Myhra, seconded by Jensen, that inasmuch as appraisals

been returned, this item should be carried over to the April 27th

^ Member Jensen wished to suggest a possible site for the Public Works.
Department -- the property of A1 Johnson which is in Seetion 2 and zoned
industrial. Mr. Johnson is taking some test holes to find out how goo� or
bad his property is. The price is $2500 an acre. It has a ditch, it is
zoned properly and in not a bad spot.
8. DISCUSSION OF ZONING FOR VETERINARIAN CLINIC:
Chairman Hughes explained that at the last meeting of the Planning
Commission there was a request to consider the possibility of locating
a veterinarian clinic in a commercial zone North of St. Phillips' Church.
The amount of land involved is two or three lots. A mortuary is planned
for the corner and a clinic north of there.
Under the present zoning, veterinary clinics can be located only
in M-1 or M-2. The question is whether we want to reconsider the special
use to the extent of saying veterinary clinics can be located in com-
mercial zone; consider the possibility of a small industxial zone, or
Section 45.19 Use Permits.
Member Jensen recommended that this item be carried forward and
considered in a further study of Chapter 45. As the two gentlemen
indicated they were not in a big hurry, perhaps we can just continue
this item in an orderly fashion.
MOTION by Erickson, seconded by Ylinen, that the Planning Conunission
^ table this item until the meeting of April 27, 1967. Upon a voice vote,
all voting aye, the motion carried unanimously.

Mr. Osterhus, a representative for Erickson Petroleuai Corporation, discussed
the house location on the lot and agreed to resubmit a revised survey showing
the house 15 feet from the west lot line. He also agreed to install a drive-
way, post a$200 performance bond, and submit a basement plan for permit.
MOTION by Hauge, seconded by Tonco, to approve the Moving Permit subject to
the provisions noted. The Motion carried.

The applicants were advised of the variances_needed, plot plan indicating planting
must be submitted, and engineered plans presented for approval.
MOTION by Tonco, seconded by Dittes, to approve building as presented provided

to the rear for future parking was mentioned by Reverend Gilbertson, also
that one of his parishoners was donating some of the excavating if the work
was permitted soon.

5. RECONSIDERATION OF USE OF TRUSS ROOF CONSTRUCTION, CONTINUED FROM MEETING
OF THE COMMITTEE OF MARCH 21, 1967:
Ferndale Builders, Homedale Builders and representative from Stewart Lumber
were present.
Various aspects of truss, such as camber, connector plates, partitions and
sheetrock conditions were reviewed. Mr. Hauge stated that engineers were
reluctant at this time to approve prints with this type of trussing.
MOTION by Tonco, seconded by Dittes, that this Board approve the use of
this "Truss Wall" system only on 24" O.C. provided that ceiling material
^ butt joints be made on truss cords, �" gypsum lath or �" sheetrock nailed
6" O.C. minimum. That ventilation in the attic be to the ratio of 1 to
150 and that �" ply is used on roof pitches greater than 4�" to 12" and
5/8 on roof pitches less than 42" to 12" with ply clips or equivalent used
at edges centered between reafters be also minimum. Upon a voice vote,
Erickson, Tonco, Dittes voting yes; Hauge voting no, the motion carried.

It was the decision of the�Subcommittee to corzsider Item 2 as the first
one on the Agenda.
LOT SPLIT REQUEST: L.S. #67-02, J.Ro IhzMOUCHEL: Part of Lot 2g, Block 1,
Marian Hills Addition.
Mr. DuMouchel was present, and explained that he owned Lot 30, Block l,
and North of his lot is Lot 29 which has been left vacant since most of the
lot was taken for 52nd Avenue leaving this triangle. The land la� idle for
quite a long time. He and his neighbor, Mr. Propokovich, purchased the
trian.gle and agreed how �+ would be divided. He picked up the piece along
his lot, had it surveyed, paid back taxes, and with legal counsel had papers
drawn. We axe asking your consideration that the lot lines will be approved.
This land will not be sold or built upon, just adding it to oux lots and
making the area look better. •
Chairman Jensen asked Mr. DuMouchel if he had the actual description,
and was told that the deed was home, but Mr. DuMouchel would be glad to get • .�
it. Chairman Jensen said the reason for concern is the standard for des-
criptions that has been more or less fo].iowed in lot splits is that in order
to make the division of property there must be a simple description.
Irregular property becomes difficult and if we were to allow indiscriminate
situations of this sort, it becomes too long and makes the job of administering
the City's business extremely difficult. It would be well to have the deed
as drawn by the attorney to consider the description because this is a
worthy purpose that you have in mind.
Mr. 0'Bannon said that he built Mr. Propokovich's home, so that he is
familiar with the area and that triangle was a collector of all the garbage,
and if the City of Fridley would have more people who would take a piece of
property like this and improve it, it would be a fine thing.
Chairman Jensen told Mr. DuMouchel that if he would be willing to get tlxe
deed and return tonight, the Subcommittee will consider it at that time. Mr.
DuMouchel agreed.

Chairman Jensen revieu�ed what led to this more or less forward looking
^ study of the Subcommittee. We had some activit.y in the area under study
(South Half of the Southeast Quarter of Section 13�. There have been a
number of people interested in various types of development and various uses
of this property in the past few �ears. There has been new interest in the -
last two or three .years and as a result a couple of small plats have been
filed along Cochran's property and some proposed activity in the past few
months and it was the opinion of the Subcommittee some time should be spent
looking at the entire parcel. It is one of the few residential areas that
are still able to be developed along some sort of orderl� plan. The planners
for the City were authorized to proceed with some sort of a master plan.
They returried.with three different street plans on a very preliminary basis.
We looked over the three street plans and determined that, as far as the
Subcommittee was concerned, two had more merit that the other. We had a
meeting last week and came down to one that we thought would fit more than
the other. We made an attempt to pass out copies of these plans to the owners.
In answer ta the question who the planners were, Chairman Jensen said Hodne
and Associates with Kermit Crouch handling it. He is doing that work for
the City and it was our feelings that we do not feel adequate for this type
job, and we feel we would be doing the best job for the City be having him
do this for us.
The three plans were displayed and discussed one at a time, Chairman
Jensen reading from the minutes of the Plats & Subs.-Str. & Util.mee+ing of
Maxch 30, 1967 the comments of Mr. Crouch. �
Plan #1 specialized in walkways with very few crossings of streets.
^ Children are to walk to schools on the walkways. Plan #2 had free use�of
rear lot line walkways, and cul de sacs. Plan #3 was the most simple
and still have quiet livin.g areas.
The Subcommittee felt they did not particuiarly favor Plan #1 and thought
the other two plans had more to offer.
After some stlzd�, it was the feelin.g of the Subcommittee that Plan #2 had.
built-in difficulties relating to property lines, and because of the properties
involved in obtaining mutual cooperatian at exactly the same time, it was more
difficult than the 3rd plan. The street grades.would be somewhat more
difficult than in the 3rd plan.
The question was asked if the City would maintain the cul de sacs and
axe they mor.e expensive to maintain. It would take special equipment, but if
there were enough cul de sacs �o warrant special equipment, it would have to
be considered.
Mr. Caxlson felt that Plan #3 took too much out of his property for
streets in proportion to the balance, but they would absorb their fair shaxe.
He felt it was a wonderful idea to get the four major proper�.y owners together.
It was mentioned there are ways to arrive at a fair distribution of the
road. You can alwa,ys set a value on the right of way and to include it in the
� cost of repairing of the street. -
Member Schmedeke said he did not go along witih all these parks.

Chairman Jensen asked if the property owners would give their opinions
on the plans. Don Chies said that he liked the cul de sacs. It seemed to him
^ that the steep hill would be difficult for walkways. Ed Chies said he under-
stands this is a ver� preliminary pTat and the next step is to relate the pl�:ns
to the topography. Mr. Carlson wanted to know if there was any consideration
as to the value of homes that were to be placed in this area. We have quite
a range price in homes now in that area. The consensus was that the range
would be �20,000 and up.
Chairman Jensen said he would like to ask one question of Mr. Carlson and
Mr. Chies. What sort of a time schedule would you speculate on as far as
completing the earth work phase of your propert�? Mr. Carlson said he
anticipated to present the preliminaries to the Board almost any time. Our
permit runs out September '68. This is strictly on the proposed grade�
Suburban E`ngineering drew up. We may like to put up a home on Rice Creek Road
immediatel�.
Mr. Chies said our propert� is actually pretty close to grade. There are
still two high spots. According to our plan, we are pretty close to grade.
Chairman Jensen showed another plan which the Subcommittee worked on at
their special meeting of April 11�, using the same topog map. The� compromised
the lot lines and grades. There were several small parks which were aboat 100'
square. He asked for comments on the plans.
Mr. Carlson said they all have merit. Ed Chies said that as far as the
Caxlson and Don Chies property axe concerned, it could be pretty well wor�ed
^ out. He would like to have the four propert� owners meet with the planner. Mx
Carlson said there is an intent to develop the propert� and not drop it, so
we can present this plan to the owners of the rest of the land.
The propert� owners were asked if they could meet together and talk over
the plans. Don Chies said the only problem he could see with Plan #2 is that
the lots are steep and the back �ards would be difficult to mow, but he likes
the concept of cul de sacs. There was a short discussion of the back of the
houses facing the street. �
Chairman Jensen said he felt there were two factors which must be con-
sidered,l� Cut dowh. the number of points of access to Rice Creek Road �nd
Stinson Boulevard; 2� Drainage problem.
The propert� owners present agreed to meet among themselves, and, if the�
wished to meet later with the planner, they are to contact Chairman Jensen.
The question about walkways in the back was discussed a short time. It
was noted that some of the new projects are using sidewalks with the utilities
easement on either side.
Chairman Jensen told the propert� owners the Subcommittee would wait to
hear from them at our next session.

MOTlON by Albrecht, seconded by Schmedeke, that the Plats & Subdivisions-
Streets & Utilities Subcommittee recommend approval of the Lot Split #67-02,
J.R. DuMouchel, of paxt of Lot 29, Block 1, Marian Hills Addition, pointing
out that the description is more complex than usual, but due to the fact that
it is not a building site, it would not be economical to plat. Upon a voice
vote, all voting aye, the motion carried unanimously.
3. ALIGNMENri' OF 83F�.D AVENUE: Favre Gasoline Station:
A short resume was given of this problem. Mr. Favre had come in with an
application for a building permit and Council did say to go ahead and acquire
the right of wa,y, but Superior Oil is urging him to rebuild his station. � oon
Rapids was contacted and asked if they would be interested in cooperating, but
they.were not. The City Attorne� was consulted regarding annexing land for
the road from Coon Rapids, but he said it would be too involved.
It was noted that the Planning Commission at their meetin.g of June 23,
1g66 moved to concur with the Streets and Utilities Subcommittee recomnendation
that 83rd Avenue N.E. be considered as part of the logical street pattern and
^ that the Cit�r of Fridle,y take the necessary steps to carry out that pattern
as the need arises and that right of wa,y which is needed, be acquired before any
additions to the Favre Gasoline Station are made. �

The motion by the Council at their regular meeting of July 5, 1966 stated
they would "concur with the recommendation of the Plannin.g Commission and '
instruct the administration to proceed with the necessar� steps to obtain an
easement for 83rd Avenue in the City of Coon Rapids".
It was the unanimous opinion of the Subcommittee that they should go
right along with the motion of the Council at their regulax meeting of July
5, 1966 as stated above, and ask the Engineering Assistant to draw a map showing
a 60 foot road in Coon Rapids approximately 200 feet long. If.it is possible
to buy a piece 60 feet wide and about 200 feet long from the land North of
Favre's Station, then there is �, way for the road to be build. It was also
an unanimrnis agreement that the previous actions taken were proper.
