Engineering Assistant Clark said one of the reasons bringing t�!is item back to the Planning Co�issian is that the City is contemplating paving Hugo Street. It is in need of a turn around or a street going north to Irontor.. Our department talked to Mrs. Swanson about getting the right of way, but feels the problem of zoning should be solved €irst, then she is willing to dedicate. � Planning Commission Meeting - July 13, 1967 Page 2 It has been suggested that the City purchase this land for park purposes, but we do not know what she feels the land is worth . Vice Chairman Erickson said on Page 19, Memo Number CM ��67-25 from the City Engineer, Paragraph ��1, there is a statement that water and sewer utilities are running between Hugo and Iron,ton. They would be in the proposed right of way. In answer to the Vice Chairman's question of wishing to know exactly what the rezoning request is now, is it the same as you originally proposed, the Engineering Assistant answered "yes". He added, there was a motion for denial before the Planning Commission and the Council. Mr. Qureshi asked that it be advertised and put on the agenda. Hugo Skrandies, 195 Hugo: I asked Mrs.Swanson why she can't build homes there? Why apartments? What kind of apart- ments can she build other than second-class when there is industrial across the street. I am opposing the rezoning. � Mrs. Florence Swanson, 3254 Arthur St. N.E.: The City Engineer called me to his office to discuss a cul de sac for Hugo Street and also plan what the remainder of my property could be used for. We ran into problems such as how we can have access to the back yards without having the homes face the factory. Also, we can't get financing. I understand that eventual?y in the future, they would like to vacate a portion of Ironton Street because of truck traffic. If it can't be rezoned to R-3, I would like to have some indication what I should build there. Ralph Officer, 315 Hugo St. N.E.: We talked about Bernard Julkowski as being involved in the request. Property boundaries indicate in the notice that Mr. Julkowski does not own any of the land we are considering tonight. The Engineering Assistant said the hearing notice covers just the Swanson parcel. The notice itself does not include anything below Mrs. Swanson's property. Mr. Officer distributed maps colored to show Mrs. Swanson's property, Mr. Julkowski's property, the new Planned Development project owned by Howard Dumphy, and the undeveloped area west of Julkowslci' property. It was explained that the Plat (Ironton Industrial Park) has not Planning Commission Meeting - July 13, 1967 _ Page 3 been recorded and that is why Mr. Julkowski is not a fee owner, however, � it was approved about three years ago. Ashton Avenue will not be a dedicated street until the plat is recorded. Norman Tuomie, 304 Ironton St. N.E.: He wished to voice a contrary opinion in opposition to this type of rezoning. Z`he area is basically residential. My parents and myself have our homes here under the assump- tion it would be a residential area. The rezoning from residential to multiple dwellings would be spot zoning. T would be opposed to it. Robert Venne, 200 Hugo Street: He wished to voice his opposition to allowing the change in zoning to R-3A. I understand the utilities are on Ashton Avenue. Is it impossible that Ashton Avenue could be changed. The answer was that it depends upon how the sewer and water could be utilized. He asked "Is there a plan to vacate Ironton Street so as to not allow traffic to go through Ashton Avenue?" The answer was negative, although there was a proposal by the City Planner to do so. He th�n asked that if it were vacated, would it be from Mrs. Swanson's property to Ashton? He was informed that Ironton could not be vacated unless there were a street to the north. It is proposed to go all the way through to University Avenue. He asked why Ashton was put where it is, and that if the edge of Ashton had lined up with the edge of M-1, there would be a natural barrier. Mrs. Swanson commented that these people are objecting to living close to apartment buildings, but they are asking someone to build homes and ^ these homes will be across from a factory. The factory has no landscaping and it is not attractive, certainly a good looking apartment would be much nicer to look at. Mr. Skrandies: I would suggest that this land be sold for individual homes and believe the property is good for homes. She wants to sell the whole property or build an apartment. Mrs. Kenneth Sporie, 301 Ironton St.: I went to the meeting a year ago. It seemed it was approved. What happened to Ashton Avenue? Acting Chairman Erickson said in that area we have an industrial area created some time ago and we would like to get the traffic in and out of there. Ashton is a designated municipal state aid street. Mr. Venne showed on the blackboard another proposal for Ashton Avenue but after discussing setback requirements, etc., it was not feasible. Mr. Charles Seeger, 324 Ironton St.: Would you have to buy some of the property if you csnnot get it dedicated? Is it correct that if you are going to run a street, the City would have to buy enough to make it 40 feet wide? How is the value of the land you are going to purchase determined? If you have to buy 40 feet of 200 feet,it is 20% of the property. Why not buy it all for park purposes? � 1�e Engineering Assistant said that we already are occupying 30 feet. Planning Commission Meeting - July 13, 1967 Pa4� 5 � Acting Chairman Erickson asked for the rep�rt request at the last meet- ing regarding the home owners and residents on Third Street. Engineering Assistant Clark explained the information sheet showir_g the owners, legal description of their property and date purchased, the vacant land and apartment buildings. The first change of zoning in that area was Ordinance No. 98 published on July 10, 1958 fr�m C-1S to R-2, and Ordinance No. 231 published April 4, 19G3 rezoning from R-2 to R-1. Mr. Charles Root explained that the examiner of titles of Anoka designated the people who were to be served notice of registration and the three gentlemen present, Lyndale Builders who sold to Clemron, Inc. were the only ones who received notices. Mr. Chester Brozak, 5110 3rd Street N.E.: Opposed the rezoning as he built his home here because he expected the neighborhood to remain residential. The petitioners were asked exactly what they were planning to build. As far as the number of buildings, they did not know until they went through the Building Standards-Design Control Subcommittee, but it probably would be a 22 story building, total 24 units. Mr. Root said the remaining lots across the street would remain residen- tial, Mr. Brozak said he did not believe people will buy homes for residential ^ across from apartment buildings. MOTION by Ylinen, to close the public hearing, ZOA ��67-04, S& S Invest- ment Co., represented by William Shaw of Lots l-6, Carlson's Summit Manor Annex 2nd Addition to be rezoned from R-1 to R-3A. The motion was out of order inasmuch as the hearing was closed at the Planning Commission meeting o€ June 8, 1967. Acting Chairman commented that the property on the Easr side of Third Street between 49th Avenue and 53rd Avenue is all multiple zoning. It seems rather sensible to continue it and finish up multiple. I understand the problem of the people living across the street. The structure need not be unattractive and the Building Standards-Design Control Coz�nittee will have to approve it. Member Jensen said he concurred with Acting Chairman Erickson's opinions. MOTION by Jensen, seconded by Ylinen, that the Planning Commission recom- mend approval of the rezoning request, ZOA ��67-04, S& S Investment Company represented by William Shaw of Lots 1 thru 6, Carlson's Su�nit Manor Annex 2nd Addition to be rezoned from R-1 to R-3A to the Council for the reason that a more or less continuous strip of multiple dwellings presently a�uts University Avenue in this area from 53rd. Avenue to 49th Avenue and that reasonable and proper access to a major thoroughfare is available and that the character of the neighborhood is suitable for multiple dwellings. Secondea � by Ylinen. I did not make the motion because of the t�ao homes on 4th and Sth lots, and finally we should Planning Commission rieeting - July 13, 1967 Page 6 realize �ahatever control we do have and.see that the structure is suitably faced, adequate parlcing and other special.requirements. ^ Acting Chairman Erickson told the audience this will come up to the - .Council on Monday, July 17th. The Council will make the final decision. All the Planning Commission can do is to recommend. 4. VACATION REQUEST: SAV ��67-03, ROBERT MINDER: Vacation of Charles Street between Anna Street and Mississippi River. Mr. Minder was present and an informal discussion took place. The prob- lem of access to Chase Island was discussed. It would be necessary to get parking lot area from the School. It was suggested a re.port in writing regarding access from the Engineering Department concerning road access to .. the Island and an agreement �aith them for parking to be requested. The Vacation Request (SAV ��67-03) was continued until July 27, 1967 and the Parks and Recreation Commission should be contacted to give their opinion by July 27th. The Planning Cornmission suggested advertising. 5. DISCUSSION OF ZONING FOR VETERINARIAN CLINIC: � . Dr. Leonard Fogelson caas present to inquire the status of the zor_ing for veterinian clinic. � ^ The Engineering Assistant reported that he talked with the City Attorney who said he could draft an ordinance so that it could be discussed and have � it up for your approval probably at the August meeting and then go to Councii in September. ` � Dr. Fogelson said they plan to start building, if the zoning can be resolved, in September. In the spring they will be ready to open their clinic. This item will come up again at the August 10, I967 meeting. DISCUSSION OF SE4 OF SECTION 13: Meeting with Cochran, Chies, Garlson and 0'Bannon, the four major property owners. The property owners present were 0'Bannon, Carlson and Don Chies. Chairman Jensen commented that the new plan called "Suggested Plat for Rice Creek Road/Central Avenue Area" to be reviewed this evening � prepared by Kermit Crouch, in general, looks pretty practical. They have dealt fairly with the small property owners and being a relatively fluid plan, no pressure would have to be put on any small individual property owner. Mr. 0'Bannon discussed his road problem, and it was decided to discuss this at the August 3rd meeting. The problem of placing houses on cul de sacs in relation to the rest of the street was gone over. The three property owners were asked individually their opinion of the latest and final plan and they all agreed this was a fine job, the best one yet. It was felt the gxades should be left up to each property owners. Mr. 0'Bannon said he would like to meet with Mr. Scherer and Mr. Morey in the engineering office before the August 3rd meeting. No action. 2. REZONING REQUEST, ZOA �P63-02, MRS. The City Engineer asked Mrs. Swanson to present her rezoning request again so that there might be a way to solve Mrs. Swanson's problem of selling her land and the street problem in that area. A public hearing was held at the last Planning Commission at which time there were a large number of the neighboring residents in objecting to multiple dwellings on this tract. I believe the Planning Conanission felt reluctant to approve and decided there should be further study. Mrs. Swanson said she had offered to sell the property to the City far park. There seems to be lack of real organization in this request. It was sent back to this subcommittee and to the Parks and Recxeation Commission. � Looking at Hodne's plan dated March 24, 1966 (Commission No. 6553), Chairman Jensen continued, you wi11 n�te the key to his plan is a connec- tion between Hugo and Ironton which does not exist at this time. The continuation of Ashton Avenue from Ely north to the future MSA street that connects East River Road and University, could actually eliminate the Ironton Street connection with Ashton. Industrial traffic is already being generated in M-1 and is more or less filtered out through Ironton. By eliminating connection with Ironton and pushing up to MSA, this objectionable industrial traffic will be kept out of the residential neighborhood and the need.for the proper landscaping barrier, which is shown in some detail in the Hodne sketch, shows how hedges and trees ^ would provide screening to the residential area on the west. Member Harold Albrecht entered. It was noted that there is now a petition to improve Hugo Street. This is a long street that goes nowhere, but ends in someone's yard. This was the reason Mrs. Swanson was asked to come in. According to Hodne's plan, Ironton Street would be closed so that it would not become a cross street between Ashton and East River Road, then Ashton becomes a north-south thoroughfare from 79th to 83rd Avenues. Ironton Avenue traffic will then be forced to go out on East River Road. MOTION by Nagel, seconded by Myhra, that the Plats & Subdivisions - Streets & Utilities Subcommittee recoimnend adoption of Hodne's Plan, as far as the street pattern is concerned, dated March 24, 1966, with the e�cception that the right of way connecting Hugo Street.and Ironton be forty feet rather than sixty feet. Upon a voice vote, all voting aye, the motion carried unanimously. 3. LOT SPLIT REQUEST: L.S. ��67-03, EMMY H. RIEDEL ESTATE BY DONALD LAMM, ATTY.: Parcel 4850 sold to Dr. Trezona to be split off for special assessment. The real estate portion of Riedel Estate to be taken care of by � Paul A. Skjervold. � Plats & Subs. & Str. & Util Subcommittee meeting - July 20, 1967 Page 3 � It was again no�ed that the logical time and place for this type of lot split, which has not gone through the regular City channels at the ti.me of purchase, should be in the Registrar of Deeds office. The Engineering Assistant said that one time there was a sign in the court house warning the person filing the deed about the City Ordinance. MOTION by Myhra, seconded by Schmedeke, that the Planning Commission , request Darrel Clark, Engineering Assistent, to see if a sign exists that informs the lot owner to follow the course of action prescribed by his city government before filing a lot split. LETTERS Letter from Commission to City Council - Subject: Summit Square Park MOTION by Spence, seconded by Cochran, that the Commission is not in a�ree- ment with the action taken by the Council at their July 5th meetinQ in terms that it was contrary to the Commission's recommendation concerning the base � ball playin� on the south �arcel of. the park. � ' During�discussion of the motion, the reasons given as to why this area is inadequate for baseball playing were there are streets on both the east and north side of this parcel and with the lengths of 180 feet and 140 feet, this would cause some extremely hazardous situations and with the close situation of houses on the west and south sides, foul balls falling into the yards would cause problems. The Commission recognizes the intense public interest in the completion of this park and the objection is not intended to stop or slow the progress of this park. The Commission still plans to recommend the installation of drain tiles in this parcel to discourage baseball playing. Upon a voice vote, the Motion Carried. � Memo to City Manager - Subject: Melody Manor Property The Commission feels that as long as the Melody Manor Property is already approved, the federal aid allotment should continue to be used here. � � PARKS AN� RECREATION C��MIISSION MINUTES, JULY 24, 1967 Page 2 DIRECTOR'•S REPORT � Parks and Recreation Memorandum and Work Pro�ress Report Miami Congress The Commission agrees that it is important that the Director attend the Congress for Recreation and Parks benefiting both the Commission and the City. MOTION by Cochran, seconded by Dunphy, that the Commission authorize the Director to attend the Congress for Recreation and Parks being held this year in Miami, Florida, December 3 through 7. The Motion Carried. The question of whether or not a member of the Commission will also attend • this Congress will be decided at a later date. Swimming Attendance The question of whether the swimming program attendance has suffered be- cause of the school program was brought up. The Director informed the Commission that it has not; the attendance is running about 100 children more than last year. Beach Allotment The City does not receive the $1,500.00 beach allotment from Anoka County /�' because beach permits are sold. However, since these permits are a restrict- ion on the parking facilities and are not a participant restriction, Chair- � man Hughes will write the county commissioner, Harvey Peterson, and ask that eonsideration be given the �ity of Fridley in this matter. Draft Agreement with Consultant MOTION by Dunphy, seconded by Spence, that the Commission recommends that the City of Fridley enter into this agreement as written which we have be- fore us tonight, with Mr. Braddock provided he is Iike-minded. The Motion Carried. OLD BUSINESS Land Acquisition 1'he degree of urgency in acquiring and developing specific parcels of land was discussed by the Commission. A special meeting was scheduled at which time this subject will"be the main item. NEW BUSINESS Flanery Park A request was received from b1r. Fowler that the backstop be moved in Flanery Park /1 from t�ie northeast corner to the north�aest corner due to balls landing in his property. � MOTION by Dunphy, seconded by Spence, that this item be tabled until the next regular meeting. The Motion Carried. , PARKS AND RECREATION CO�IlNISSION MINUTES, JULY 24, 1967 Page 3 Park Maintenance Magazine /� The members of the Commission expressed their wishes not to receive this maga- zine at their homes, but that a copy be kept in the Director's office for future reference. � Rezoning Request - Delegation of Citizens Requesting Park A delegation of citizens from the Ironton and Hugo area west of the railroad tracks was present at the meeting; their interest being the rezoning request from Mrs. Florence Swanson and Bernard Julkowski, owners of property at the easterly end of Ironton and adjacent to Ashton Street, auditor's Subdivision #103. The request was that this land be rezoned for multiple dwelling. A petition for a park in this area was received last year and the citizens feel this property could be purchased by the city for park land. Norman Tuomie, 304 Ironton Street N.E., stated that tentative rezoning has been for some time and he would like some conclusive thoughts on this matter. He has met with the Planning Commission last year and this year and the issue is still in the air. Mrs. Swanson, owner of the property, said that a previous rezoning request had been turned down. Ralph Officer, 315 Hugo Street N.E., explained a multi-color- ed map showing the property in question and which also showed that most of the area is zoned for light industrial. If one area is rezoned for multiple dwell- ing, other areas will request to rezone as such, Charles Seeger, 324 Ironton Street N.E., asked if this area.would be large enough for a neighborhood park. Randy Lobash, 314 Riton, referred to a park between t;1e Mississippi River and East River Road on Hugo where there •is no apparatus anu only a skating rink in the winter. If the city buys this land for park land, what would become of it. �• Chairman Hughes stated that most agree that there is not enough park land for a city of 27,000. This area is not large enough for even these two streets. He feels that the Planning Commission should plan the whole area first. Member Dunphy voiced his appreciation t0 the citizens for coming to the meeting tonight. People should organize to work toward the betterment of their specific area. Mr. Seeger inquired as to whether it was more popular to set up a series of small parks rather than one large park. Chairman Hughes feels that parks are too small for the activities that children want to engage in such as baseball and softball. Mr. Tuomie thought that this property could be used as a springboard and possibly in the future land to the north could be purchased. Mrs. Kenneth Sporre, 301 Ironton, asked if there was another piece of land that would be better suited. Chairman Hughes stated no, although the Commission has looked at much land from Spring Brook to 79th. Member Dunphy said that the Commission ia conscious of the problem and hopes that they can get land in the future. No park can be developed from setting aside a little tax money each year from a specific area". This property is now zoned for single dwelling and the people in the area are against multiple dwelling. If Ashton Avenue is to go through, the owner of the property must request it. MOTION by Dunphy, seconded by Cochran, to recoemmend that the Planning Commission not further increase density of population by changing zoning to R-3A. There is no publicly owned park land in this area. The park problem is being studied at present time with high priority with the Parks and Recreation Commission. There is a possibility that the Commission would be interested in acquiring this area for park land.
