receive the minutes of the Building Standards-Design Contr.ol meeting of

RECEIVE BOARD OF APPEALS MINUTES: AUGUST 16, 1967:

MOTION by Jensen, seconded by Myhra, that the P?anning Commission
receive the minutes of the'Board of Appeals meeting of August 16, 1967.
Upon a voice vote, all voting aye, the motion carried.
1. CON'lINUED DISCUSSION OF ORDINANCE FOR VETERINARIAN CLINIC:
The proposed ordinance submitted by the City Attorney was discussed,
and the following additions and revisions were made:
Section 45.19 (14) Animal Clinics and Veterinary Hospitals in C-1,
C-1-S, CR-1, C-2, C-2-S, CR-2, M-1, M-2, provided the following conditions,
which are minimum, are met in order to eliminate excessive noise and odors.
1. The building shall be of masonry construction, outside wall
minimum thicicness to be 8",'with a precast concrete roof.
In discussing the precast concxete roof, it was felt this would be the
most economical, sound proof and fire proof.
2. This paragraph was adequate with the correction in spell.ing of
"double 1� azed windows with a fixed sash".
3. Add "No outside runs or exercise areas will be permitted."
� 4. Add "The burner should be located within the interior of the
principle structure." (Insert minimum specs)

The types of burners would be referred to James Hensley, Health Inspecto�
of Fridley, to check and give a sununary of how large a furnace this should be,
� along with some other specifications.
S. Anv ventilation svstem shall be desi�ned so that no odors or
organism will spread between wards or to the outside air.
The Commission requested the Qrdinance be amended subject to the
above revisions and subject to insertion of specifications for the incin-
erator. A copy of the corrected ordinance will be attached to the mintues.
MOTION by Myhra, seconded by Jensen, that the proposed ordinance
pextaining to the construction of animal clinics and veterinary hospitals
be recommended to the Council for passage, subject to the stated amend-
ments and the insertion of minimum specifications for the special high
temperature furnace. Upon a voice vote, all voting.aye, the motion
carried.
2. CONTINUED DISCUSSION OF "BONDING AND CONTRACTORS":
Continued to September 7, 1967.
INFORMAL DISCUSSION:
I.OT SPLITS: The Commission felt that inasmuch as some lot splits
are so simple in character, perhaps they could go directly to the Council
to save time for the petitioner. If a lot split is going directly to the
� Council and bypas� the Subcommittee, the Planning Commission would like
. some guide lines to be set up by the Council.
RICE CREEK PLAZA NORTH ADDITION: It was brought to the attention of
the Planning Commission that some rather large islands have come into
existence due to the recent dredging of Rice Creek and it might be worth-
while for the City to look into this praperty for park purposes.

1. PUBLIC HEARING: REZONING REQUEST ZOA ��67-09, FEDERAL LUMBER COMPANY BY
SAM ROSENBAUM TREASURER: Lots 5 thru 8, Lots 25 and 26, Block 2, Commerce
Park Addition. Rezone to CR-2 or M-1.
Mr. and Mrs. Sam Rosenbaum, Mr. Louis Segal, Mr. James Segal and
Mr. Sam Rosenberg were present.
The Acting City Manager Brunsell read the Notice of Hearing.
Chairman Hughes reviewed the procedure of the Hearing before the Plan-
ning Commission, and asked if the petitioner wished to be heard.
Mr. Rosenbaum explained that primarily in that area which would be
parallel with University Avenue, they would have their general offices.
This would be their main office and general offices and would face
University Avenue, and, in addition, a major sales and display room would
also face University Avenue.
He continued, primary storage of lumber will be a considerable distance
back from University Avenue. It might well be west of Commerce Lane. They
have submitted to the Council a general idea and plot plan showing tentative
layout of buildings. All things considered, they felt they would have
considerable less trouble meeting requirements of the City if they were �
granted M-1 classification. This would be because of setbacks and other
problems that exist under CR-1 and 2. We would have more than adequate park-
ing facilities for our own people and the public. Warehouse and office
facilities would be very attractive for our use and for appearance as well.
Member Jensen asked to see the layout of the proposed plans which then
were explained by Mr. Rosenbaum. He stated that they had purchased the
property west of Commerce Lane for access to the railroad tracks. In the
front of the property would be g�neral offices and sales, model homes and •
cabins or garages, and customer access would be from University Avenue.
The trucks would almost always come in on Conunerce Lane. The heavy lumber
storage would be as close as possible to the railroad spur.
� >. �,In.answer.to the question about cover for outdoor storage, Mr. Rosen-
baum said they hoped to put them under rough cover only. Lumber is never
enclosed in a building because it is uneconomical to handle. We would put
up the kind of fence surrounding property of the City's choice. The
visibility of lumber as such, from either Osborne Road or University Avenue,

would be pretty hard to see from the highway. They want an attractive
/1 building to attract people. Being able to start from scratch, he said,
gives them an opportunity to build the lumber yard as they would like •
to see it. It is their hope to eventually have every bit of lumber under
attractive cover.
Marvin Wagner, 7501 University Avenue, said he would much rather look
out at apartments, multiple or something that brings higher taxes. The
multiple dwellings would help buffer the noise of the highway. Also,
Fridley has two lumber yards now and Spring Lake Park one, all within 22
miles, and he felt another one was not needed.
Francis Ellerbush, 7505 University Avenue, said he was not trying to
down grade the area, but feels that the bulk of lumber yards are a sight
for sore eyes.
Mr. Rosenbaum said the appearance of the lumber yard will be subject to
Fridley Building requirements.
Mr. Rosenbaum said they went ovex the CR-2 Ordinance with Mr. Herrick
and they felt it would be entirely too restrictive for them. They actually
felt that M-1 classification is what they would like, but it would be up to
the Planning Commission and the Council as to whether they would approve
variances because they would not be able to build a lumber yard under the
present CR-2. Also, M-1 specifications includes lumber yards.
^ After a discussion of the differences in CR-1, C-1,M-1, M-2, the fol-
� lowing motion was made.
MOTION by Jensen, seconded by Myhra, that the Planning Commission close
� the Public Hearing of the rezoning request, ZOA �k67-09, Federal Lumber
Company, of Lots 5 through 8, Lots 25 and 26, Block 2, Commerce Park Addi-
. tion. Upon a voice vote, all voting aye, the motion carried unanimously.
Chairman Hughes was asked to read CR-2 Ordinance, and stated that this
area, Commerce.Park, about a year ago was the subject of considerable dis-
cussion by the Planning Commission. At that time the question was raised
as to the desirability of making the entire area commercial. The discus-
sion centered around C-2. It was felt that if this were to be done, the .
request was for a strip along University Avenue 2 block deep would be
zoned commercial and would result in a continuation of the general charac-
ter of University Avenue. The Planning CoIIUnission agreed it was not a
desirable thing to have that type of development continued to the North of
Mississippi Street and it was, in an effort to avoid that, that the CR-2
zoning was applied to that area. Osborne Road and University Avenue were
to be held as commercial on the basis it could provide a snopping center
development. Using CR-2 in the South would complement that without adding
a distinct commercial atmosphere along the street. To consider this appli-
cation in light of this effect, the uses proposed are probably M-1 district.
He added, it probably would not be wise to consider retaining the CR-2 or
C-1 if we feel it is wise to bring these uses to the area. The land is
`.� `open at�this point. There is no other use presently in that entire plat.
Our decision is going to determine what we must do in the future.
Member Ylinen asked if the present CR-2 district to the South came
about as a result of a petition and wondered if there were some plans that

brought about the CR-2. Acting Chairman Hughes said that when University
Avenue was widened for T.H. ��47,'it left just about 25 or 30 feet of R-1
^ behind the M-l. The owners petitioned the land be rezoned commercial.
The Planning Commission and Council at that time could not bring themselves
to agree to connnercial and CR-2 was a compromise. At this point, the -
Engineering Assistant Clark referred to the Hodne layout which was recom-
mended at the time of the original request. On the basis that there was a
fairly high expectation of a shopping center South of 73rd Avenue, Hodne
thought the whole block should be zoned the same.
Member Jensen said that he agreed with the comments about the rezon-
ing consideration to M-1, but if we rezone a parcel in the center, we
might just as well broaden our sites and zone the entire block. The second
owner has not expressed any interest in rezoning on the remainder of the
block. The relat3_onship of the remainder of the block to the parcel which
is under consideration would be a perfect example of spot rezoning.
Chairman Hughes said it seemed to him the main point is whether the
type of operation, as planned, fits the intrent the City has for the
development of the area at large. Essentially, that is the question
which has to be resolved. •
Member Myhra said he could not imagine what would go in CR-2 in that
area and wondered about the possibility of it being developed C-1.
Member Jensen suggested that if the retail sales of the general
^ offices for the lumber company were in the front part of the land, it
would fit rather nicely with CR-2 Ordinance. However, somehow it would
have to be entirely divorced from the outside storage yard. He continued,
this could be done by pushing the outside storage operation for the retail
sales to the West side of Coinmerce Lane, and somehow divide the zone in
this block to allow M-1 along Commerce Lane and continue CR-2 facing the
servic.e drive.
Mr. Rosenbaum said that in their present plan, the storage in the
main warehouse would be attached to their office salesroom and is enclosed.
Storage of vehicles is rio problem, as they would autnmatically be at the
back of the yard. He continued that the kind of lumber yard they are
proposing to build has not come to our part of the country yet, and is very
attractive. T'he appearance of the operation from the front would enriance
many shopping centers which he has seen in Fridley and it is to their
best interest to make it attractive. They would have it look from the
front as a large house would look. Their colors are white, red and blue.
T'here will be adequate parking. They want this lumber yard to be a
credit to Fridley and to themselves.
Chairman Hughes said that it is his feeling on the proposal to con-
sider the rear half as M-1 and the front half CR-2, that, essentially,
we are back to a strip along the streeto
The Planning Commission discussed the effects of the zoning categories
at great length.

MOTION by Jensen, seconded•by Ylinen, that the Planning CoTmnission
/1 recommend to the Council the rezoning (ZOA ��67-09) of Zots 5 and 6,
Block 2, Commerce Park to CR-2 zoning and Lots 25 and 26, Block 2, . '
Commerce Park to M-1 zoning with the further recommendation to the Council
that in the instance of CR-2 zoning, recommending that no variances be
favorably considered relative to subsections three (3) through seven (7)
and ten (10) of Ordinance No. 332. Upon a voice vote, all voting aye,
the motion carried unanimously.
Chairman Hughes explained that the portions not affected against
variances are those having to do with exterior building material. There
would be no recommendation against variances in that case. Concerning
performance standards, which are essentially generally common sense
items, are not under questions.
Mr. Rosenbaum said that he was not as familiar with the details of
�R-2 as he would like to be. He said he would like to set down with the
Building Inspector, Fire Chief and Engineering Assistant to determine
whether in CR-2, it will, in any way, be so restrictive as to make it
impractical for them to operate from the standpoint of ease of operation.
He did not believe it would be a problem, but he thought it would be wise
if he could arrange a meeting with the City personnel, and that he
appreciated the recommendation and the consideration the Planning Commis-
sion had given them.
Member Jensen said that the Planning Coiranission recognize� the
^ reasonable possibility of the extension of M-1 zoning in the property
abutting Commerce Lane being probably in the best interests of the City
and the fact that we are retaining CR-2 character of the property abut-
ting the service road on University Avenue. We feel this is also a
fairly important feature of this recommendation and it would be in the
best interest of the City as a whole to retain this character, particu-
larly in relation to the C-1 zoning to the North and the residential
� property on the East side of University Avenue.
Chairman Hughes added that, in terms of the recommendations against
variances of certain portions of CR-2 Ordinance, it is important to
point out that the area involved here is one of the main entrances tc
Fridley, it is very desirable to avoid, if possible to do so, the neon
junk type of appearance which could be developed in this type of situa-
tion. To all appearances, the potential here offexs no problem in
that regard, but bearing in mind•the possibility of future changes, we
feel it is in the best interest of the community, to prevent such
change of policy.
Member Myhra said on the variances which affect the appearance of
University Avenue, while some people may not feel that it is really
important, it is very much so, especially to �he people in the residen-
tial area. 'I'he Council ought to look Iong and hard at any request that
violates that purpose, particularly with buildings along this area for
the future.

The meeting was called to order at 7:30 P.M, by Acting Chairman Myhra.

ORDER OF AGENDA•
The order of agenda was to be considered as written.
1. CONTINUED DISCUSSION OF ROAD PATTERN OF SE4 OF SECTION 13: PUBLIC MEETING:
Rice Creek Road/Central Avenue Area.
For the benefit of those people who had not attended the August 3rd
public meeting, Acting Chairman Myhra explained that the way the Subcommittee
got this item was from the Planning Commission, who had been given permission
by the Council to engage tlie services of Hodne and Associates. Jim Richards,
of Hodne and Associates, after walking the land and discussing the needs of
the area with the City Engi.neering Assistant and the Chairman of the Plats &
� Subdivisi�ns and Streets & Utilities Subcou�ittee, presented in person three
plans for discussion. These, in turn, were revised until the present plan
� appeazed to be the kind the Subco�3:ttee could go ahead with, even if all
parties concerned were not ready at this time to move. On August lOth, the
Subcommittee heard a lot of pros and cons, and the people asked for more
time. The public meeting was scheduled for tonight and the suggestion was
made that those people who were not at the meeting that night, should be
notified by mail, which they were.
Acting Chairman Myhra read the following three letters the Subcommittee
received: G. J. Morley dated August 28, 1967, Ervin Kassow dated August 4,
1967 and Rev. Douglas M. Henderson, Chairman of the Board, Peoples Church,
dated August 31, 1967.
When Acting Chairman Myhra asked the writers of the letters if they had
further comment, Mr. Kassow answered that he had no additions to make as he
believed he explained his stand quite fully in the letter. Mr. Morley had
no co�nents.
Mr. Ed Bauler, 1420 Rice Creek Road, said he agreed with Mr. Kassow.
The road is useless to him and would be an added expense.
Rev. Henderson said the Church had not been idle and that several
builders had been out. He had talked with Mr. Minder and with several
members of the Planning Commission. He nas been told they have a lovely
five acres and it is a choice piece of ground. They had not considered
�-� building on the property at this point.- Ae did not believe the proposed
road location wou13 provide the proper drainage for their property. He
said that somewhere in the back of•their minds, they could have a wrap

around street with cul de sac and build all the way around their circle,
and this would drain to Central Avenue. Z'hey do object to the present road
plan.
Mr. Theodore Theilman, 1540 Rice Creek Road, said that the area being
considered is a long isolated one and they are objecting very much so. He
asked on what basis does the City want to plat their property?
Acting Chairman Myhre explained that, when an area is develoged, the
concern of the City is in the road patterns -- the City does not plat the
lots, but the road has a definite bearing on the lots. The Subcommittee's
concern is strictly with City roads in tliis area. He added that if there
is going to be 200+ residential homes in this area, we have got to have a
systematic road layout. The City is not interested in having the roads
just happen to grow without an overall plan to go by. Also, they are look-
ing ahead as to what kind of r�ads are needed when the City is settled.
Mr. Theilman thought a grid pattern would be much more satisfactory to
the area because having all these little lots with houses, the area would
end up with only four exits which would not take care of the 8:00 o'clock
traffic. Also, he added, a cul de sac on this end shows there are Iots
facing two streets. Mr. Theilman discussed streets in conjunction with a
map he obtained from the County.
Member Albrecht explained that this is a proposed plan, and some
variations are to be expected.
Member Nagel said that the Subco�nittee talked about a grid pattern
as it was originally proposed, and he thought the feeling generally on the
part of the Subcommittee was that pushing a grid pattern through this area
leaves something to be desired. A straight grid pattern would be difficult
because there are a lot of h.ills in the first two areas, but on the right
there was basically a grid pattern. .
Member Schmedeke mentioned there were a few suggested variations for
the road coming out on Central Avenue, and that Rev. Henderson had come up
with one, using a cul de sac on his property.
Mr. Kassow asked about cul de sacs as he understood they were not
being used extensively be:.ause of the expense of maintenance of the street.
He was answered that cul de sacs make for nicc living on residential lots,
and it was the unanimous opinion on this by the SubcoBanittee they approved
of them, and that the City might have to acquire special snow removal equip-
ment for them.
Rev. Henderson and Mr. Morley were interested in the type of home which
would go in the 0'Bannon area, and Acting Chairman Myhra said that it bears
repeating that some of this property dictates the type of home that will be
built. For example, a builder will not put a sma11 inexpensive home on a
large hilly lot.
Rev, Henderson said the people have been involved in this land before,
but it was only three weeks ago that_ the small property owners received
notices. He asked if the objectors would have the opportunity to propose
their own plans?

Member Schmedeke felt a vote of hands wr�uld be in order, and he thought
the people should have more time to consider the road plan.
^ Acting Chairman Myhra asked for a show o£ hands: How many object to
something in this plan? 9 people. How many are in basic agreement? 4
people. �
Wayne Larson, 1521 Ferndale Avenue, said this was his first meeting.
He asked how large the cul de sacs were going to be? The answer was 60
foot radius.
John Peebles, 1511 Ferndale Avenue, asked if the cul de sac on the
South would take care of all three lots on Ferndale. The area was studied
on the map. �
MOTION by Albxecht, seconded by Nagel, that the public meeting of the
Discussion of Road Pattern for Rice Creek Roac?/Central Avenue Area be
closed. Upon a voice vote, all voting aye, the motion carried.
Mr. Theilman asked if they could talk to the City Engineer to draw
up a grid pattern. He was told they would have to bring in a pattern they
liked before the Engineering Department could give advice.
Member Schmedeke stated be believed the small property owners have to
have more time and they stiould be given at least four months for study.
He said that he still thought people who own property have a right to
plan the way they would like. If they are interested in a cul de sac on
^ 0'Bannon's corner, it is possible to cut off the proposed road.
MOTION by Schmedeke, seconded by Nagel, that the Plats and Subdivisions-
Streets & Utilities Subcommittee give the smaller property owners at least
four months to study the Rice Creek Road/Central Avenue Area plan, and to
bring to the Subcommittee whatever new plans they have decided upon.
Member Albrecht addressed the audience saying that these ideas which
the people will present must not involve their site only. He emphasized
that the Subcommittee is trying to accomplish a street pattern for the
area as a whole, or at least propose some kind of guide lines for the future,
so that a road in one parcel will end up in a logical place. This is what
they should bear in mind when they come in with proposals.
Acting Chairman Myhra told the audience that if they would put them-
selves in the Subcommittee's place, the plans ought to fit into the overall
pattern.
The audience were told the best time to bring in their plans would be
during the third week of the month or the first part of the fourth week
i.n order for an agenda to be prepared for the Subcommittee before the
meeting. This would give the members the weekend to go over the property
personally with the new plans. ,
Upon a voice vote, Nagel and Schmedeke voting aye and Albrecht voting
nay, the motion carried.

Acting Chairman Myhra said he would like to repeat that the Subcommittee
is trying to get a road pattern f6r the Rice Creek Road/Central Avenue Area,

and lot lines never should have been left in the plans. The people are
free to do whatever they like with their propexty.
^ Engineering Assistant Ciark said that we are not trying to build all
the roads in at one time. For example, if we have a satisfactory overall
plan, Lenny Cochran could develop his land at any time and it would not
affect Rev. Henderson's land. Z'he purpose of the overall plan would be
to make certain that when a parcel was platted, that it would fit into the
stxeet plan for the entire area.
2. ACCESS TO PLANNED DEVELOPMENI' DISTRICT, ZOA ��66-16, HAROLD SCHROEDER:
Problem of access irom East River Road.
Mr. Dumphy and Mr. Schroeder were present.
The Engineering Assistant Clark said he received a letter from the
State Hightaay Department regarding future traffic pxojection figures.
The.traffic count on Anoka County Highway No. 1(East River Road) SoutYi
of the junction with old T.H.. ��10 i.n April of this year was 4,000 vehicles
a day. The projected traffic count in 1985 Noxth of Osborne Road in the
immediate vicinity of CSAH 1(East River Road) is 10,000 a day. This
does take into considexation the bridge that will be built over the Missis-
sippi River in the vicinity of 85th Avenue.
Mr. Schroeder told the Subcommittee that what they are trying to do
is to develop the proper.ty to its highest usE. They went to the expense
of hiring DZr. E. Bather, traffic engineer, and it was his opinion that the
^ count of traffic generated by the shopping center would not create any
worse problem than exists there now. In his apinion, it would not be
necessary to have a semaphore or signals. If the traffic increased from
8,000 to 10,000 trips a day, maybe a semaphore would be necessary. He
said they have given the Subcorunittee all the information they could obtain
at this time, but they think, at this point, it would be up to the Plan-

be good for Fridley.
Member Nagel said he looked at the property and did not think there
was any question that if the shopping center did not go in, it will be
somewhere else. He didn't believe that there were any traffic projections
of East River Road ever taking on the traffic nature of T.H. ��47. If it
were necessary to put in a traffic signal, he could not see how it would be
unbearable. He said he was in favor of the shopping center.
Member Albrecht called attention to the road from the apartment building.
This would be 100 feet from East River Road for stacking from the parking
lot.
Mr.. Schroeder said they �vere willing to design access or egress any
way the City reconunends. The plan could be �.pproved with a certain reserva-
tion of detail. They will do the plans to the best of their judgment, he
continued, but who is qualified in the City of Fridley to make an evaluation
that this is the way it should be done. He ad�ed that they were looking
� for some direction. They had hired Mr. Bather, but did not want to go to
- that expense unless his specifications would be honored.
Engineering Assistant Clark pointed out that the first question to be
answered was whether the City wants further commercial development along

East River Road. If so, then time should be spent in the designixig of
access to the development. Criteria that may be considexed are such tliings
^ as its alignment (r.orth and south) preferably in line with a street apposite
it. If not opposite, then it should be 150 feet or more away frozn a street�
opposite to pzevent diagoxial crossing, left and right turn lanes, decelera-
tion and acceleration lanes, center islands arid signals.
MOTION by Nagel, seconded by Albrecht, that the Plats & Subdivisions-
Streets & Utilities Subeommittee recommend approval of the concept of
the Planned Development presented by Mr. Schroeder for Spring Brook Park
Addition as far as it affects the street pattern and traffic projections.
Upon a voice vote, all voting aye, the motion carried unanimously.
Left turn lane would be in order and deceleration lane off East River
Road turning into the property. Should thexe be a single entrance, or
two entrances separated by some distance deserves m�re study by the
designers.

He said Lhat storm setaer was the best solution for the Reidel property but
because ttie property will be tied up for a�ahil.e, there may be a feasible <<�ay
to do it without a storm sewer. The City Attorney asked if this would create
any drai.nage problems to the people on the south. The City Engineer sai.d
that the property on tne south drains to�aard the south. The City En�i.neer
also pointed out that there is a lo�a hole on Arthur Street where water sits
on the school property. He e�cplained the way the City will put in a permanent
street part �aay and then a temporary one for a little way, and �•rhen the storm
sewer is finished, then they will include this little section.

utilities in. He said that the people in Sylvan Hills had caanted assurai�ce
that tliey would never nave backup trouble again, and the Ccnsultin� Engineer

would go along with this is pending. The Ci•ty i�fanaoer suagested the Council
