RECEIVE MINUTES OF BOARD OF APPEALS MEETING: JUNE 28 1967:
MOTION by Jensen, seconded by Ylinen, that the Planning
Commission receive the minutes of the Buard of Appeals Meeting
of June 28, 1967. Upon a voice vote, all voting aye, the motion

MEETING: JUNE 29, 1967:
MOTION by Ylinen, seconded by Jensen, that the Planning
Commission receive the minutes of the Plats & Subdivisions-
Streets & Utilities Subcommittee meeting of June 29, 1967.
Upon a voice vote, all voting aye, the motion carried.
ORDER OF AGENDA•
There was no change in the order of agenda.
1. PUBLIC HEARING: REZONING REQUEST, ZOA �r63-02Z MRS. FLORENCE SWANSON
AND BERNAR.D JULKOWSKI: Easterly end of Ironton and adjacent to
Ashton Street, Auditor's Subdivision �f103 and Ironton Industrial Park.
Engineering Assistant Clark saicl one of the reasons bringing
this item back to the Planning Commission is that the City is
contemplating paving Hugo Street. It is in need of a turn around
or a street going north to Ironton. Our department talked to
Mrs. Swanson about getting the right of way, but feels the problem
of zoning should 'oe solved first, then she is willing to dedicate.

It has been suggested that the City purchase this land
for park purposes, but we do not know what she feels the land
is worth.
Vice Chairman Erickson said on Page 19, Memo Number
CM ��67-25 from the City Engineer, Paragraph ��1, there is
a statement that water and sewer utilities are running
between Hugo and Ironton. They would be in the proposed
right of way.
� In answer to the Vice Chairman's question of wishing to
know exactly what the rezoning request is now, is it the same
as you originally proposed, the Engineering Assistant answered
"yes". He added, there was a motion for denial before the
Planning Commission and the Council. Mr. Qureshi asked that
it be advertised and put on the agenda.

Hugo Skrandies, 195 Hugo: I asked Mrs.Swanson why she
can't build homes there? Why apartments? What kind of apart-
ments can she build other than second-class when there is
industrial across the street. I am opposing the rezoning.
Mrs. Florence Swanson, 3254 Arthur St. N.E.: The City
Engineer called me to his office to discuss a cul de sac for
Hugo Street and also plan what the remainder of my property
could be used for. We ran into problems such as how we can
have access to the back yards without having the homes face
the factory. Also, we can't get financing. I understand that
eventually in the future, they would like to vacate a portion
of Ironton Street because of truck traffic. If it can't be
rezoned to R-3, I would like to have some indication what I
should build there.
Ralph Officer, 315 Hugo St. N.E.: We talked about
Bernard Julkowski as being involved in the request. Property
boundaries indicate in the notice that Mr. Julkowski does not
own any of the land we are considering tonight.
The Engineering Assistant said the hearing notice covers
just the Swanson parcel. The notice itself does not include
anything below Mrs. Swanson's property.
Mr. Officer distributed maps colored to show Mrs. Swanson's
property, Mr. Julkowski's property, the new Planned Development
project owned by Howard Dumphy, and the undeveloped area west of
Julkowski' property.
It was explained that the Plat (Ironton Industrial Park) has not

been recorded and that is why Mr. Julkowski is not a fee owner, however,
^ it was approved about three years ago. Ashton Avenue will not be a
� dedicated street until the plat is recorded.
Norman Tuomie, 304 Ironton St. N.E.: He wished to voice a contrary
opinion in opposition to this type of rezoning. The area is basically
residential. My parents and myself have our homes here under the assump-
tion it would be a residential area. The rezoning from residential to
multiple dwellings would be spot zoning. I would be opposed to it.
Robert Venne, 200 Hugo Street: He wished to voice his opposition
to allowing the change in zoning to R-3A. I understand the utilities
are on Ashton Avenue. Is it impossible that Ashton Avenue could be
changed. The answer was that it depends upon how the sewer and water could
be utilized. He asked "Is there a plan to vacate Ironton Street so as
to not allow traffic to go through Ashton Avenue?" The answer was negative,
although there was a proposal by the City Planner to do so. He then asked
that if it were vacated, would it be from Mrs. Swanson's property to
Ashton? He was informed that Ironton could not be vacated unless there
were a street to the north. It is proposed to go all the way through to
University Avenue. He asked why Ashton was put where it is, and that if
the edge of Ashton had lined up with the edge of M-1, there would be a
natural barrier.
Mrs. Swanson commented that these people are objecting to living close
to apartment buildings, but they are asking someone to build homes and
^ these homes will be across from a factory. The factory has no landscaping
r� and it is not attractive, certainly a good looking apartment would be much
� nicer to look at.
Mr. Skrandies: I would suggest that this land be sold for individual
homes and believe the property is good for homes. She wants to sell the
whole property or build an apartment.
Mrs. Kenneth Sporie, 301 Ironton St.: I went to the meeting a year ago.
It seemed it was approved. What happened to Ashton Avenue?
Acting Chairman Erickson said in that area we have an industrial area
created some time ago and we would like to get the traffic in and out of
there. Ashton is a designated municipal state aid street.
Mr. Venne showed on the blackboard another proposal for Ashton Avenue
but after discussing setback.requirements, etc., it was not feasible.
Mr. Charles Seeger, 324 Ironton St.: Would you have to buy some of
the property if you cannot get it dedicated? Is it correct that if you are
going to run a street, the City would have to buy enough to make it 40 feet
wide? How is the value of the land you are going to purchase determined?
If you have to buy 40 feet of 200 feet,it is 20% of the property. Why not
buy it all for park purposes?

Upon a voice vote, all voting aye, the rtotion carried unanimously.
Acting Chairman Erickson said the only thing the Planning Cossnission
can do as far as the road which has not been dedicated, is to ask the City
to try to get the dedication. This particular Corraission is composcd of
four nec•� members. We would like to get this problem settled before the year
is out. tlnyone in the conL�unity can ask for a rezoning. I hope you ���ill be
patient cvith us as we have complete opposino views concerning t11� rezoning.
There cvill be a Parks and Recreation Conanission meeting on July 24, I9o7
and this item caill be turned over to them to eonsicler purct�asing the property.

� Acting Chairman Erickson asked for the report request at the last meet-
ing regarding the home owners and residents on Third Street.
Engineering Assistant Clark explained the information sheet showir_g the
owners, legal description of their property and date purchased, the vacant
land and apartment buildings. The first change of zoning in that area was
Ordinance No. 98 published on July 10, 1958 from C-1S to R-2, and Ordinance
No. 231 published April 4, 1963 rezoning from R-2 to R-1. Mr. Charles Root
explained that the examiner of titles of Anoka designated the people who
were to be served notice of registration and the three gentlemen present,
Lyndale Builders who sold to Clemron, Inc, were the only ones who received
notices.
. Mr. Chester Brozak, 5110 3rd Stxeet N.E.: Qpposed the rezoning as he
built his home here because he expected the neighborhood to remain residential.
The petitioners were asked exactly what they were planning to build.
As far as the number of buildings, they did not know until they went through
the Building Standards-Design Control Subcommittee, but it probably would be
a 22 story building, total 24 units.
Mr. Root said the rema.ining lots across the street would remain residen-
tial.
Mr. Brozak said he did not believe people will buy homes for residential
^ across from apartment buildings.
MOTION by Ylinen, to close the public hearing, ZOA ��67-04, S& S Invest-
ment Co., represented by William Shaw of Lots l-6, Carlson's Summit rianor
Annex 2nd Addition to be rezoned from R-1 to R-3A. The motion was out of
order inasmuch as the hearing was closed at the Planning Commission meeting
of June 8, 1967.
Acting Chairman cotmnented that the property on the East side of Third
Street between 49th Avenue and 53rd Avenue is all multiple zoning. It seems
rather sensible to continue it and finish up multiple. I understand the
problem of the people living across the street. The structure need not be
unattractive and the Building Standards-Design Control Committee will have
to approve it.
Member Jensen said he concurred with Acting Chairman Erickson's opinions.
MOTION by Jensen, seconded by Ylinen, that the Planning Commission recom-
mend approval of the rezoning request, ZOA ��67-04, S& S Investment Conpany
represented by William Shaw of Lots I thru 6, Carlson's Summit Manor Annex
2nd Addition to be rezoned from R-1 to R-3A to the Council for the reason
that a more or less continuous strip of multiple dwellings presently abuts
University Avenue in this area from 53rd Avenue to 49th Avenue and that
reasonable and proper access to a major thoroughfare is available and that
the character o� the neighborhood is suitable for multiple dwellings. Seconded
n by Ylinen. Upon a voice vote, all voting aye, the motion carried unanimously.
Member Ylinen concurred with the above remarks. I did not make the
motion because of the t�ao homes on 4th and 5th lots, and finally we should

realize whatever control we do have and.see ti�at the structure is suitably
faced, adequate parking and other special recuirements.
Acting Chairman Erickson told the audience this will come up to the
Council on Monday, 3uly 17th. The Council will make the final decisio7.
All the Planning C�mmission can do is to recommend.
4. ~ VACATION REQUEST: SAV ��67-03. ROBERT MINDER: Vacation of Charles Street
between Anna Street and Mississippi River.
Mr. Minder was present and an informal discussion took place. The prob-
lem of access to Chase Island was discussed. Tt �vould be necessary to get
parking lot area fro� the School. It was suggested a report in writing
regarding access from the Engineering Department concerning road access to
the Island and an agreement with them for parking to be requested.
The Vacation Request (SAV ��67-03) was continued until July 27, 1967
and the Parks and Recreation Commission should be contacted t� give their
opinion by �uly 27th. The Planning Cormnission suggested advertising.
5. DISCUSSION OF ZONING FOR VETERINARIAN CLINIC:
Dx. Leonard Fogelson was present to inquire the status of the zoning
for veterinian clinic.
� The Engineer�ng Assistant xeported that he talked with the City Attorney
who said he could dxaft an ordinance so that it could be discussed ar.d have
it up for your approval probably at the August meeting and then go to Council
in September.

Dr. Fogelson said they plan to start building, if the zoning can be
resolved, in September. In the spring they �oill be ready to open their clinic.
This item will come up again at the August 10, 1967 meet.ing.
