minutes of July 27, 1967 be approved. Upon a voice vote, all voting
aye, the motion carried.
RECEIVE BOARD OF APPEALS MINUTES: JULY 26, 1967:
MOTION by Myhra, seconded by Jensen, that the miriutes of the Baard
of Appeals meeting of July 26, 1967 be received. Upon a voice vote,
all vcting aye, the motion carried.

MOTION by Jensen, seconded by Myhra, that the Planning Commission
receive the minutes of the Plats'& Subdivisions-Streets & Utilities Sub-
com�nittee meeting of August 3, 1967. Upon a voice vote, all voting aye,
the motion carried.
ORDER OF AGENDA:
It was decided that Items 2, 3 and 4 should Ue discussed in that
order and Items 1 and 5 at the end of the evening.
1. CONTINUED PLANATED DEVELOPMENT DISTRICT, ZOA ��66-16, HAROLD SCHROEDER: '
Bourdeaux s Spring Brook Park Addition. Problem of access from East River
Road. Set public hearing date for September 14, 1967.
Chairman Hughes said that when this request was before the Planning
Commissi�n on July 27, 1967, questions were raise.d cancerning traffic.
This was then turned over to Plats & Subdivisions-Streets & Utilities '
Subc�n�mittee. They considered the traffic problem at the August 3, 1967
meeting and continued the study to tne meeting on August 31st.
T4r. O. Reuben Johnson, representing Buetow & Associates, and Howard
Dumphy �aere present.
The Engiiieering Assistant Clark informed the Commission that he had
called the State Highway Department for additional in£ormation and they
told him they were swamped and it would be two or three weeks before they
could get the information for us. The County liighway Department said

in 1964, by actual. count, there were 6,000 vehicles a day on East River
^ Road, and the projected figure for 1985 was 5,0OQ vehicles. The 1964
� figures were taken before rerouting of Highway ��10 to University Avenue,
and another reason for the reduction in traffic was new cross roads.
Mr. Johnson hoped that the Subcommittee could present their final
report on the effect of traffic as it relates to their property and the
development as a whole at the August 31st meeting inasmuch as the time
element is important. He requested that the Public Hear.ing be scheduled
for September 14, 1967, which was consistent with the presentation made
at the July 27th Planning Commission meeting. He also suggested that
whatever pressure could be brought upon the State Highway Department
for their traffic information would be appreciated.
. MOTION by Ylinen, seconded by Jensen, that the Planning Commission
set a public hearing on September 14, 1967 far ZOA ��66-16, at 8:00 P,M.,
Harold Schroeder for a Planned Development District of Block 1 and
Lots 10 through 12, Block 2, Bourdeaux`s Spring Brook Park Addition,
Lots 2 through 9, Block 2, Bourdeaux`s Spring Brook Park Addition and
. Block 1, Spring Brook Park 2nd Addition. Upon a voice vote, all voting
aye, the motion carried.
Engineering Assistant Clark asked that it be noted if the plan is
adopted, it weuld necessitate vacations, although this would be included
in the plans. �
n 2. REZONING'REQUEST: ZOA ��67-08, DALBERG REALTY'FOR TH�S BRICKNER: Part
of Lot 6, Revised Auditor's Subdivision No. 10, rezoning from R-2 to R-3.
Mr. Arne Folstad, representing Dalberg Realty Company and Mr. Thomas
Brickner, the applicant, were present.
Inasmuch as it has been the practice in the past to suggest to the
petitioner of R-3 zoning that he request R-3A, which permits only multiple
dwellings, Mr. Brickner was asked if it would be agreeable with him to
do so in this case. He answered that it would be all right.
Mr. Brickner had plans of the type of buildings proposed, two bedroom
units and one story in the back. He stated the existing house on the
land will be removed. Mr. Brickner requested a public hearing for
September 14, 1967. �
MOTION by Jensen, seconded by Myhra, that the Planning Commission
set a public hearing date of September 24, 1967 at 7:30 P.M. for the re-
zoning request, ZOA �F67-08, Dalberg Realty for Thomas Brickner, for part
of Lot 6, Revised Auditvr's Subdivision No. 10 to rezone from R-2 (limited
multiple family dwellings) to R-3A (multiple family dwellings only). Upon
a voice vote, all voting aye, the motion carried.
City Attorney Herrick entered at 8:00 o'clock.

_ TREASURER: Lots 5 thru 8, Lots 25.and 26, Block 2, Commerce Park Addition.
Rezone to CR=2 or M-1. �

stated that either zoning classification would be agreeable with them.
Chairman Hughes agreed the proble� is to determine what category this
application should cover. It was suggested the advertisement include
both categories which will give more time to study the request. �he
City Attorney.asked if the agenda included the memorandum he wrote to
the Council which would give additional interpretation of lumber yards.
(The agenda did not, but this memo will be sent to the Planning Commis-
sion members by mail.) Mr. Herrick continued, I think the question is
one of examining the CR-2 -0rdinance to determine if a lumber yard of
the type that the applicant is talking about is within your contempla-
tion of what could go in GR-2, and whether Mr. Rosenbaum could and want
to meet the requirements of CR-2. If you feel that the lumber yard is
within the intentians of that zoning, perhaps this is the road to take.
If not, then the only other way to permit retail lumber outlet to be
built on this land would be to rezone it to M-1.
Mr. Rosenbaum said he understood the application for the public
hearing would have both categories. Under CR-2, he would have to request
a considerable number of variances; under M-1, the changes would be
minimum. Their plot plans include a major retail operation centered and
facing University Avenue, distribution and storage further back towards
Commerce Lane. East of Co�nerce Lane the area is now M-1, so as a
practical matter, most of their operation would be unloading and storage
of lumber and it would be concentrated on Commerce Lane, which is M-1.
Mr. Segal stated they would like to have M-1 in their plans because
they would be allowed a little more freedom. In CR-2 variances would
have to�be requested. '-
MOTION by 3ensen, seconded by Myhra, that the Planning CoBUnission
hold a public hearing �n September 7, 1967 at 7:30 P.M. for ZOA ��67-09,
Federal Lumber Company by Sam Rosenbaum of Lots 5 thru 8, Lots 25 and 26,
Block 2, Commerce Park Addition to be rezoned as follows: rezone from
C-1 (local business) to CR-2 (limited business) Lots 5, 6 and 26, Block 2
or rezone from C-1 (local business) and CR-2 (limited business) to M-1
(light industrial areas) Lots S through 8, 25 and 26, Block 2, Commerce.
Park Addition. Upon a voice vote, all voting aye, the motion carried
unanixnous ly . "
Inasmuch as this is a special meeting, the Planni.ng Commission re-
quested there be no other item on the agenda.
4. DISCUSSION OF ZONING F.OR VETERINARIAN CLINIC: Ordinance draft study.
The City Attorney asked for suggestions from the Commission, whether
or not to follow the,pattern in the present Code.
After discussion with the City Attorney, the Commission agreed there
wauld be more flexibility using a special use permit to state the minimum
qualifications in the ordinance that must be met before a permit is
granted. In reviewing the criteria for a veterinary clinic or animal
hospital, the following items were considered: construction of�the build-
ing, interior and exterior, eiimination of noise that would disturb the
generaZ neighborho�d, disposal of waste material sa that there would be
no odor, high temperature gas furnace, air conditioning, separate over-
head ventilation system, 8" thick blocic wall for entire structure, no

windows in the rear or double glazed fixed sash (two thicknesses of
glass and non-openirig), and_the zoning categories where it may be
^ pe.z-mitted. It �as suggested that James Hensley, Health Inspector,
_ be consulted regarding the types of incinerators, furnaces and approved
models that could be used for disposing of buxnable refuse without
creating smoke or odor.
The City Attoxney stated he would have a draft of this ordinance
for study at the next meeting on August 24th.
5. BONDING AND CONTP�ICTORS: Referred by Council.
The City Attorney, in explaining this referral, said he believed
this procedure has worked successfully in at least one other community.
The purpose is to give the City better control over development, so
. that a situation will not arise where the developer is supposed to put
in blacktop, shrubbery or special landscaping, and one year later it is
still not done. An alternate could be withholding certificate of occu-
pancy until completion and posting a bond or escrow at the time they
are not able to complete it.
Chairman Hughes asked to be excused at 9:30 P.M, and turned the
meeting over to Member Jensen.
The City Attorney asked if this item could be continued until the
, meeting of Au�ust 24th in order to give him more time to get additional
information.
nActing Chairman Jensen suggested Councilman Samuelson be asked to
attend this meeting.
The item "Bonding and Contractors" was continued until the
August 24, 1967 meeting.
