A��ROVE PLANNING COMMISSION MINUTES: MARCH 14, 1968:
Mr. Jensen asked that the following correction be made on Page 7, the
last sentence of the fourth paragraph from the bottom and instead of being
"would be honored" should read "was being considered".
Mr. Erickson suggested a correction in the motion at the bottom of Page 7,
the last sentence should read "to consider the question of rezoning" instead
of "reconsider the question of rezoning".
MOTION by Erickson, seconded by Myhra, that the Planning Commis�ion Minutes
of Ma.rch 14, 1968 be approved as amended above. Upon a voice vote, all voting

ORDER OF AGENDA•
n The Commission decided to take the Items in the following order: Items
2, 3 and 1 and 4.
1. CONTINUED REZONING REQUEST: ZOA ��68-04, LOUIS MOMCHILOVICH: South 150 feet
front and rear of Lot 9, Auditor's Subdivision ��88. Rezone from R-1 to
multiple.
The Engineering Assistant told the Co�nission there were no recorded
easements as far as the City was concerned. There is a 15 foot private
easement across the West end and the watermain and sewer lines are on
Mr. Momchilovich's property without easement to the City. The lot to the
NorCh has deeded some pxoperty and the lot iron is on that corner rather
than Mr. Momchilov ich's property.
Mr. Momchilovich wondered if the City planned to take the service lane
all the way through to Mississippi Street, but Mr. Jensen said it would
not be in a straight line and there has never been a continued service road
along the Highway up to Mississippi Street.
Mr. Myhra asked that, if the petitioner were to give a 30 foot easement,
what would be the size of the apartments he could build. The Engineering
Assistant replied in R-3, 8 units and in R-3A, 7 units. Mr. Myhra asked
where the approach that goes onto the highway is l�cated. Mr. Momchilovich
answered that if the approach were to continue straight East, it would be
on his property.
/1 In answer to Mr. Jensen's question, Mr. Momchilovich said he would object
to dedicating a 30 foot easement, as it might push his setback line back
further than the buildings South of him. The way the service lane�is now,
if he would dedicate 30 feet, there would be a 20 foot jog into his property.

Mr. Momchilovich asked if there were any plans for a street and was told
that there were no specific plans for a street, but there is nothing to
prevent the Highway Department closing their right of way.

Another question Mr. Momchilovich asked was if it would be O.K. for him
to build in line with the apartments, or he would be willing to put the
building wherever the Planning Commission would suggest. Chairman Hughes
informed him that if he should dispose of the property, the new owner would
not be bound by what he had agreed to.
Mr. Jensen reminded Mr. Momchilovich that if this xezoning were granted,
the value of that property would increase the value of the square footage
of the iand involved.
MOTION by Erickson, seconded by Jensen, that the Planning Commission
_,/ recommend approval of ZOA ��68-04, Louis Momchilovich, being the South 150
feet front and rear of L�t 9, Auditor's Subdivision ��88 ta be rezaned
from R-1 to multiple dwelling, subject to the dedication of the West 30 feet
for service drive purposes and recom�end that there be no waiver of land
area requirements as they relate to the number of units that can be built
on the property. Upon a voice vote, all voting aye, the motion carried
unanimously. � �
Mr. Momchilovich asked if he had a certain length of time and was told
this item will be before the Council two weeks from Monday (April 15th).
He can go before the Council and pxesent his arguments against the Planning
Commission recommendation of densities.
� Mr. Erickson reminded Mr. Momchilovich he was giving up, in one sense,
and gaining in another. He had until the public hearing before the Council
to plead his case. Council can uphold the Planning Commission recommenda-
tian or tuxn it down flatly. The decision of the Planning Conunission was to
recammend approval of the rezoning subject to dedication of the Westerly
30 feet of the tract for service road purposes to R-3A. The main portion of
the recommendation was no waiver of land area requirements for the number of
units he is having.
2. CONTINUED REZONING REQUEST: ZOA ��68-03, ARO INDUSTRIES,.INC.: Lots 1, 2 and
3A Second Revision Auditor's Subdivision ��21 and Lot 1, Brookview Addition.
Rezone from R-1 to R-3A.
Mr. Jacob Aro and Mr. Stanley Guzik were present. An informal discussion
was in order and no decisions were made.
3. CONTINUED LOT SPLIT REQUEST: L.S. ��68-04, LARRY DEAN FERGUSON: Lot 21,
Block 2, Spring Lake Park Lakeside.
The Engineering Assistant showed the certificate of survey which Mr.
Ferguson had brought in. The easements shown on the certificate were to
be drawn up. The easement for utilities in the center of the lot would be
drawn for 10 feet.
MOTION by Erickson, seconded by Jensen, that the Planning Commission recom-
!� mend the Lot Split ��68-04, Larry Dean Ferguson, Lot 21, Block 2, Spring Lake
' Park Lakeside subject to providing the City with a 10 foot drainage easement
centered on the North line of the South parcel and a 25 foot easement along
the South line for road purposes. Upon a voice vote, all voting aye, the
motion carried unanimously.

The Planning Commission, meeting as a Committee of the Whole, met at 9:30 P.M.
in the Conference Room at City Hall.

(Continuation of New Section 7 R-3 Limited Multiple Dwelling
R-5 Multiple Dwelling)
Delete Article 11 concerning "extension of a use into a district where boundary
puts lot into more than one district."
Consider moving Article 13 to Section 3 or in the Special Use Permits, Section
45.19.
II. Requirements on Lot Dimensions
R-3 A. Lot Area Requirements
(The phrase "consisting of 8 dwelling units or less" to be added
t� I, A, 2 Multiple Dwellings.)
A lot area of not less than 15,000 square feet for building with up
� to 4 units, 3,000 square feet shall be required for each additional
unit.
R-5 - Minimum lot area of not less than 27,500 square feet, with 2500
square feet per unit. ,
(A question exists about the difference between the R-3 8 unit at
27,000 square feet and the R-5 11 unit at 27,500 square feet.)
Note: We need to add in the Principal Use - position of R-3 and R-5 a
statement indicating that lot dimensions requirements of lower density districts
apply when built in these districts.
B. Lot Width Requirements
R-3 A minimum lot or parcel width of not less than 85 feet is
required for each building.
R-S A minimum lot or parcel width not less than 100 feet is required
for each building.

PARK DEVELOPMENT - BOND ISSUE PROGRESS REPORT:
Chair.man Hughes met with City Manager Ankrum, Mayor Kirkham, City Attorney
Herrick, Finance Director Brunsell and Bond Consultant Ehlers last week and dis-
cussed in detail the structure of the Bond and what it would cost the taxpayers.
Land Evaluation, Assessed Values and Limit on Bond Indebtedness were also gone
over in discussion. A possible 20.year pay plan on the General Obligation Bonds
was suggested.
FEDERAL FUNDS - Are they available? Can we apply for them? These are
questions that were raised. The Commission needs more information on this sub-
ject. Mr. Braddock and Mr. Brown were asked to investigate this matter and come
back with information and recommendations. �
BROCHURE MATERIAL PRESENTED - Mr. Braddock and Mr. Brown then presented to
the. Commission for their suggestions and study a City map with neighborhoods out-
lined and specific areas where the bond issue would prevail in respect to land
acquisition and development. Commission then discussed what they wanted and what
they felt the people will want to know. Commission requested map to be revised
with all discussion and suggestions included for next meeting.

CITIZENS COrM-IITTEE - The need for a Citizens Committee is critical. All
members are to search for and come up with as many people they feel would be of
help in promoting this upcoming bond issue. People from all parts of Fridley will
be needed. A meeting will then be scheduled and all participants will be brief-
ed on park bond program. Members are to have contacts made by next meeting.

There being no further business, the meeting was adjourned at 10:20 P.M.

8:00 P.M.

The meeting was called to order at 7:30 P.M. by Chairman Jensen.

There was no change in the order of Agenda. The lot split request,
L.S. �68-07, by Mrs. Gedig was added to the Agenda as Item ��5.
LOT SPLIT REQUEST: L.S. ��68-04. LARRY DEAN FERGUSON: Lot 21, Block 2,
Spring Lake Park Lakeside.
The Subcommittee and Mr. Ferguson discussed easement for road and
utilities. The Engineering Assistant volunteered to check the easement for
drainage and power lines. The house�and garage were checked in connection
with the new lot lines.
MOTION by Myhra, seconded by Albrecht, that the Plats & Subdivisions-
Streets & Utilities Subcommittee recommend approval to the Planning Commis-
sion of Lot Split ��68-04, Larry Dean Ferguson, Lot 21, Block 2, Spring Lake
Park Lakeside and with a parcel dimension of 146.5'x100' for the North lot
and 125'x100` for the South lot, contingent upon a certificate of survey
and a street easement over the South 25 feet of the South lot. Upon a voice
vote, all voting aye, the motian carried unanimously.
Mx. Ferguson was told that the item would go to the Planning Commission
on March 14th.
LOT SPLIT_REQUEST: L.S. ��68-02 ARTHCTR CHRISTENSON: All of Lots 2 and 3
and paxt of Lots 20 and 21, Block 2, Rees' Addition to Fridley Park.
Mr. Christenson was present and explained he wished the split because
of assessments. The reason for splitting in this way was because the
prbperty line would match with that of •t�e lots•to the North. He did�not
feel zoning was a factor because the land was used for�parking. The park-
ing lot that is presently occupied, is zoned C-1 and M-1,
MOTION by Albrecht, seconded by Myhra, that the Plats & Subdivisions-
Streets & Utilities SubcoIIUnittee recommend approval of the Lot Split ��68-02,
Arthur Christenson,.of Lots 2 and 3 and part of Lots 20 and 21, Block_2,
Rees' Addition to Fridley Park, that Lots 2 and 3 and the Easterly portion
of Lots 20 and 21 form a parcel 179.3' by 88', as per sketch submitted by
Mr. Christenson on page 6 of March 6, 1968 agenda, and call the attention
of the Planning Commission to the split zoning of M-1 and C-1. Upon a voice
vote, all voting aye, the motion carried unanimously.

2. LOT SPLIT REQUEST: L.S. ��68-05, WALTER R. MACIASZEK; Lots 18-20, 26-28, Block 2
Oak Grove Addition.
The area was checked on the aerial map. The question was asked if it were
necessary to ask the petitioner to provide a survey and descriptions. It�was
decided that at this level a drawing is sufficient because if changes have to
be made, it will be of less cost to the owner than having a survey changed in
the beginning.
MOTION by Albrecht, seconded by Schmedeke, that the Plats and Subdivisions-
Streets & Utilities Subcommittee recommend approval of L.S. ��68-05 by Walter R.
Maciaszek of Lots 18 thru 20, 26 thru 28, Block 2, Oak Grove Addition subject
to certificate of survey for consideration of the Planning Co�mnission, splitting
Lot 27 in half with half going to each of Lots 26 and 28 making tw� 60 foot
building sites and them the same on Lots 18 and 19, splitting into building
sites of 60 feet each. Upon a voice vote, all voting aye, the motion carried
unanimously.
3. LOT SPLIT REQUEST: L.S. ��68-04, LARRY DEAN FERGUSON: Lot 21, Block 2, Spring
Lake Park Lakeside.
� The Engineering Assistant produced a street pattern which had been adopted
several years ago. It showed that Lots 20 and 21 will have access on the rear
of the lots. The back half should be red tagged as far as building is concerned
until water and sewer are put in. However, the Subcommittee felt they needed
more information. The garage should also be tied in.
MOTION by Albrecht, seconded by Schmedeke, that the Lot Split request,
L.S. ��68-04, Larry Dean Ferguson, Lot 21, Block 2, Spring Lake Park Lakeside,
be continued until March 6, 1968. Upon a voice vote, all voting aye, the motion
carried unanimously.
4. LOT SPLIT REQUEST: L.S. ��68-02, ARTHUR CHRISTENSON: All of Lots 2 and 3, and
part of Lots 20 and 21, Block 2, Rees. Addition to Fridley Park.
The Engineering Assistant said the location of the land is North of the
telephone building. The rear (Westerly line) is one foot from the old City
Hall garage which was moved to that property, He said Lots 1 and 2, Block 2,
are zoned C-1 and Lots 3, 4, 19, 20, 21 and 22 are zoned light industrial.
The Professional Building is commercial as well as 1, 2, 3, Block 1, and the
telephone building is light industrial. LoCs 2 and 3, the way they are zoned,
are basically impossible to build on, as they would have to maintain a 35 foot
clearance. They are still under one ownership,.but Mr. Chxistenson wants to
have the split for special assessments for now. .
Being the request for the split was in two different types of zoning, the
Subcommittee believed this was more of a zoning problem than lot split. If
h both lots were zoned the same, there would be no problem of setbacks, and if
� they approve this lot split, an illegal sideyard would be created. �

° Member Schmedeke, who lives in that area, asked that, because of a possib'
conflict of interest, he would refrain from voting on this request.
The Chairman tabled the item of the Lot Split Request, L.S. ��68-Q3,
Joseph Zizak of Lots 6 through 9, Block 27, Hyde Park Addition until the
meeting of March 6, 1968 for consideration and study and because of a lack
of a quorum.
PROPOSED PRELIMINARY PLAT: P.S. ��68-01, AL ROSE ADDITION, ALBERT M. JOHNSON:
Lot 36, Revised Auditor's Subdivision �k23.
Engineering Assistant Clark explained that Mr. Johnson was out of town
and wouldn't be back until after the first of March.
In examining the preliminary drawing, the Subcommittee felt there was
a question about Lot 6, inasmuch as it was not a legal lot. It would be
turned down under our Building Code. They mentioned combining Lots 5 and 6
by moving the lot lines of 4 and 5, making three lots into 2 lots.
MOTION by Albrecht, seconded by Schmedeke, that the Preliminaxy Plat,
P.S. ��68-01, A1 Rose Addition, Albert M. Johnson ot Lot 36, Revised Auditor's
Subdivision No. 23 be tabled for further consideration and stipulation that
Lot 6 must be improved as it is not suitable building site in its present
dimensions. Upon a voice vote, all voting aye, the motion carried unanimously.
