Chairman Jeneen explained that this was an informal hearing wi.th the xe�idants adjacent to 56th Avenue between 4th and 7th Streets. The puxpose hRi=�g that Mr. Bruasesu, who lives at 5546 Sevemth Street, made a xaquest that S6th stxest be opened in order that he could make better uae of hia g$rage and have a simplex accesa to it. The question arose whethsx t'hs Rmtix'� atreet f�om l+th street to 7th street should be vacated. We £Q1�, �.� order to be a little better in£ormed as a Subco�ittee studyit�g th� queatian, we would like to have an expression of interest one way or a�nother on the possibility of vacating 56th Avenue. Part af the thi�lciag iA this direction was the blocks to the South of 56th Avenue are x�ow very ahar� because the frontage road along the Freeway changed the charactex af the neighborhood. One of the points is that the normal practice, in this ca�e af a stree� vaaatioa, is that the City does retain a utility easement suffiaient to give us the right to maintain utilities either presently ex�.sting ox plaax�ed for the future. Secondly the street, if it were vacated, one half of it would $o to the property abuttiag on each side. Joha Casaerly, 5965 5th Street N.E.: Se is the owaer of The pxoperty att 52S and 527 56th Avenue (Lots 14 and 15, the West 64 feet af B1oGk 2� Hr�mil- to�'� Addi�tion to Mechanicsville). He stated that i.f S6th Avenue wexe vacated, it would take away his only access to a street, therefaxe he ie nqt 1A favar of the vacation. rir. Jensen informed Mr. Casserly that there was no particula7c caus� fox coacern as this is not a specific proposaT. The Subcomnittee is intexe�ted ia comments and they have no direction at this time as far as a xeal e�foxt is coACerned to close this street. This is a more or less informatipA gathexing, but comments are going to weigh heavily on any decisiona made here. Subcommittee - July 18, 1968 PaQe 2 to their benefit. � Larry Brusaeau, 5546 7th Street N.E.: He said he was the one who or:Lgin�lly bxought up the question. His main concern is the area betweea 6th Street and 7th Street. The driveway entrance is through the propexty on the neighbor's lot facing 6th Street, and although he has the permission� a� the owners to use it, he feels it would be betCer for him and the propexty owner if he could exit on his own property. It is impractical the way it is naw. He was not in favor of leaving the street as it is. There �s a big pile of sand, weeds, broken glass and material from the tornado and it is not to his benefit to have it looking like that. He would xather 3mprove the pxopexty if he could. He also said the people who awn the lot behind him on the Southeast coxner of 56th Avenue and 6th Street were unable to attend and instructed him to give their opinion and they would like to have it vacated. Tf the stxeet were cut through, his driveway would exit on 56th Avenue. Mr. Jaeger said they would like to know what would fiappen to the street if it were vacated. Mr. Jensen answe�ed that they were at somewhat of an early stage for final determination of this sort. This is a new situati�n as there has never been a hard surfaced street vacated. His own opinion was there would be a certain amount of flexibility in what condition it would be left as the City would be interested in removing the re�ants so that the people could landscape it. However, he felt that if someone were making use of the hard surface for an entrance to the garage, that, perhaps, a part of the hard surfacing could be left to serve the driveway and then � the propexty owrier making use of it, would maintain it as his owa expense. Mr. Jaeger wanted to know how wide the easement would be. Chai�an Jensen said, depending on the facilities that exist, it would probably be 12' to 15' from the centerline. The individual maintains the ow�,ership but cannot build structures, although the City may dig to repair. The street right of way is 30 feet, the boulevard 15 feet, and the remaining easement would presumably be where the hard surfacing is at this time. David Peterson, 5600 5th Street N.E.: He said the driveway to their garage is right in the middle of the block and they back the car right off into the street. They would like to have their driveway as it is. The Clarks, who live at 5500 Sth Street, asked them to express their wishes which were that they would like to have the road left as is. Carl Sorenson, 4615 University Avenue N.E.: Mr. Sorenson asked if the street were closed, does the property automatically go to the people who live there? He was told that would be handled by the City Administra- tion. Mr. David Peterson said that he would liri�e to leave the street the way it is as he would have to change his driveway if it were vacated. Mr. Jaeger asked if there was a possibility of having an alley instead of a street. The Engineering Assistant said it had been a thought, but never really considered. � ....� � Plats & Subs.-Str. & Util, Subco�anittee - Julv 18 1968 Pa e..3_� Mr. Sorenson said there is an easement for alley off S6th Street that never has been used and wondered if there had been talk of closing it. n Mr. Jensen answered that the discussion never reached that point of action. 1'he E�ngineexing Assistant said if there is no use for it, it could be vacat�d. Chairman Jensen reviewed the comunents as follows: �'he property owners between �+th and 5th Street were against vacating; between 5th and 6th Stxeet weze against; between 6th and 7th Street (2 owners) were in favor. The Chai.rnian informed the audience that the public meeting xelative to the question of closing 56th Avenue will be closed. If anythin$ fuxChex pccurs relative to this matter, they wi11 be notified. If thexe are addi- tional public meetings before the Planning Co�nission, and ult �pateJ.y a legal public hearing before the City Council, they will be no�i�ied in plenty ti�pe to prepare comments regarding it. There will be no iurtk�er action �ox �hose who expressed opposition of closing the street. Darrel Clark agreed to write to the utility companies regarding the placing of the utilities and the vacation. MOTION by Nagel, seconded.by Albrecht, that the Plats & Subdivisiona- Streets and Utilities Subconmittee reco�end to the Planning Co�nission the vacation of 56th Avenue from 6th Street to 7th Street with the City retain- ing �ufficient easement for utilities and also for the Engineering Depart- ment to proceed to contact the affected utilities companies to get their approval for this vacation. Mr. Nagel added the amendment to elose the �tudy af the vacation of 56th Avenue between 4th Street to 7th Street. n Upon a voice vote, all voting aye, the motion carried unanimously. 2. VACATION REQUEST: SAV 4�68-05, PETER J. LINDBERG: The 24 foot servi�e drive easement (lying West of and parallel to East River Road and North of Mississippi Street). Pxesent to discuss this problem were Peter Lindberg, Robert Schroer and Italph Wormsbecker. Mr. Lindbexg said he represented the owners. The request is far the vacation of a 24 foot easement that is now separated from the West line of Bast River Road by a strip of private property approximately 10 feet to 15 feet. The parcel is zoned comnercial. It was his understanding that the plan for the intersection of East River Road and Missiasippi Street is to be scheduled for construction. Because there will be a 24 foot road coming into the intersection, he felt there would be no use for the service road. The Engineering Assistant explained that this is a street of xight of way. The County, at one time, arbitrarily narrowed up the right oE way as they somehow determined that an error in the survey was made and they moved the right of way line. He said he had talked with the City Engin,eer who asked if there was any interior plan as far as the traffic is concerned. They looked at the apartment house plan and noted that there would be � an entrance at the North line for the apartments and a separate entrance f4x the cominercial lot approximately 300 feet South of the apart��t entrance. 4/ �lats & Subs.-Str. & Util. In that instance, a service dxive woul.d be necessary to the North to allow a common entrance in order to r�duce entrances on East River Road. There may be some change i� aiaintaining aT� easement -- he was not saying that particular 24 feet is goad or necessary but he was concerned about long range aspect. The Engineering Assistant said the County had 50 feet from the centexli�n� to tha West. Mx�. Lindberg said because of the 24 foot easement they could na� ��t a gpod �itle on the property. It was agreed by the Subcoamittee that if Anoka County could gxov�.d� a righ� of way map, it would help them in making a decision. Chairman Jensen said he believed this specific location �or easement i� �Qt necessary for anybody and did not think this particular loca�ion ha� at�y merit, but if he knew where the edge of the road was, a decision cauld be made. Mr. Lindberg said they would not like to develop as planned aad then fi�d they would have to tear up the shrubbery. Chairman Jensen said that they did not know where the centerline waa and who was the proper owner of the right of way. Regarding County roads, he said �he County agrees to build roads, but the City holds the title o� the � right of way for the public use. In case of County roads where $dditioAa�. �i�ht of way is needed to make a particular improvement, they will demand the City provide the right of way. This is why we have to be coacexned abnut long range plans. The fact there is an application for a v�cation o� a 24 foot street is all the real request you need. The County Highway has to preaent the facts, i.e, their boundary line and they have to pxQSen� evidence which shows where they think that line was. Mr. Nagel said he was not ready to make a move one way or another because of th� boundaries and possible road plan.
