MOTION by Jensen, seconded by Mittelatadt, that paragraph 4 on page 3
("It was agreed there might be a conflict with the zoning 452 feet and the
buildix�g to be adjusted.") be deleted. Upon a voice vote, all voting aye,
the motion carried unanimously.

minutes of December 5, 1968 be approved subject to the above correction.

1. CONTII�IUED PUBLIC HEARIIQG : APPROVE PRELII�NARY PLANS FOR PD DEVELOP'MED1T
(ZOA �68-10 and �68-10A) HOWdRD DU1�I3Y:
Mr. Howard Dumphy was present and etated he had received a letter from
the City Attorney, but he had not tiad time to evaluate it, and until then,
he would like to table his PD rezoning request. He was not certain his plan
aow was economically feasible or if he should choose to abaadon the whole
project. �
Ct�airman Erickeon asked if he could read the letter to the audience which
the City Attorney had mailed to Mr. Dumphy. The attorney's letter, dated
December 4th, answered the Planning Co�ission's requeat for aa opinioa of the
preseat atatus of'Mr. Dumphy's rezoning request.
A citizen asked how long the PD rezoning, if graated, would continue once
it ie approved but aot developed. He was iaformed it waa a perpetual zoning,
the same as if a piece of land were rezoned B-1.
N�TION by Mittelstadt, seconded by Myhra, that the Platmiag Co�ission
close the public hearing of ZOA �68-10 and �68-10A, approviag preliminary
plane for the PD area of Howard Dumphy. Opon a voice vote, all voting aye,

A citizen asked if anyone who coatinually came to the Planaing Coa�iasion
/`-. meetings aad signed in, would be notified of the meetiags. The public meetings

j- would be published in the Fridley Sun and the notices also would be mailed to
the adjacent property ownera.
Mr. Dumphy said about three years of good work has gone iato this PD plan.
Basically, the plan developed here is appareatly a good job and he could see
�ao real objectioa. It is a good area for this type of developmeat. He felt
the objections could be overcame and worked out with the people.

INC., CLARENCE D. NORDSTROM, AGENT: .
Mr. Clarence D. Nordstrom and Mr. A. T. Ha�erlund were present.
Mr. Nordstram asked to present his proposed plan which they hope to call
Bice Creek Park. The property is on County Road H, North of Rice Creek and
abutting Stinsoa Boulevaxd on the East composing 29 2/3 acres. About 14
acres are not true buildable sites and this they will either deed to the City
of Fridley for the sum of $1.00 for park or will use it for a private park.
Mr. Nordstrom said he would like the Planning Coummission to look aver the
^ plans, and would not expect a decision, and then they will make an application
for rezoning. The Planaing Co�ission thought the plaa was of one use, there-
fore his petitioa for rezoaiag should be for �ultiple dwelliags.
Mr. Nordstram left one set of plans with Darrel Clark aad made arrangements
with him to begin processing the rezoaiag.

Mr. Edmund Contoski, Mr. Robert Engstrom and Mr. James Hill represeated
Pemtom, Iac.
Mr. Engstram asked if they were in the same category as Mr. Nordstram as.
they had wiahed to present their proposed plan for the development of the SF,�
of Sectioa 24 and get the reaction o.f the Planniag Coarmissioa. A discussion
followed coacerning the traffic pattern through the area usiug Silvex Lake Road
for tiie maia collector street. Mr. En�strom esid he underatood another request
for PD was requeated and aeked the opinion of the people to the West. Their
proposed plan calls for single family residences abutting the housea on Regis
Trail. As part of this plan would go over iato New Brighton� the City Engineer
asked if they kaew if there wae a possibility of ueing some of tt►e facilities
of Piew Brightoa for sewer. . ,
There was ao action, but the petitioners were goiag to study the PD Ordin�ce
aad return with an application.

The Chairnoan recalled the Planaiag Co�iesion, on October 10, 1968.
raco�ended to Council approval of the lct aplit subject to a building permit
for oaly one house until the land is rezoned to B-1, and Council cac�curred
at their October 21et meeting. An applicatioa for rezoning was etmt to Mr.
Wilsoa, but he has not returaed it. A builder talked with the �giatesiag
Aseiatant and it was explaiaed to him that the laad hae to be rezoned to
single f�ily dwellings before he could build on the two lots. To date ao
pesmit has been takea out for a house.

The Chairman explained that Mr. Chapmea of Naeon, Wehrman, Rnight �
Chapman, Iac. would be unable to be present at a public meetiag on Jaauary 9,
1968.

accept the notice of the informal public hearing prepared by the Eagiaeering
Departiment for Wednesd�y, January 8, 1968 with amendments as indicated. Upoa
a voice vote, all voting aye, the motion carried unaaimously.
The Chairman requesiced the recosdi�g aecretary to send the letters to the
n people of Sqde Park Additioa on Decembes 24, 1968, aad that mention of the

meeting be made in the J�auary 2nd is�ue of the Fridley Sun.
