Mr.. Nordstrom explained that this land is located directly south of the
Studebaker-Onan plant. He made a study as to the feasibility of commercial
1� or industrial for this land which showed that this type of property really
would not be desirable or feasible for cammercial. He checked with Super Valu
and Red OwZ who infoxmed him it was not in the proper location. Small stores
would be strip zoning and he did not believe the City would want that. They
were asking R-3A for the use of the land because, under FHA, all the special
assessments would have to be paid, and that would amount to approximately
$3,500 per residential lot which would mean they would have to pay approxi-
mately $7,000 per lot, and this is out of the question.
The suggested use of R-3A for this land, approximately 29 2/3 acres,
would allow 18 acres for buildable sites. The terrain south of the proposed
apartment compleac could be used as a park. This would be donated by deed to
the City of Fridley if they wished to accept it, or the developers could use
it for a private park, or possibly build single family dwellings on the banks
of the creek. Mr. Nordstrom said that he can obtain the kind of financing
he can live with, and he has the contract to build from Hanmerlund Enterprises,
Inc. He referred to a letter written to the Council asking to be put on their
agenda for a public hearing, but was told they would wait for the Planning
Canmtission to make a recoa�endation, and the first public hearing date before
Council would probably be the second meeting in March. This was satiafactory
to him.
Chairman Ericksnn asked who was the owner of the house at 1500 County Road
H, and Mr. Nordstrom answered the present awner purchased the property from
Mr. Hipp, a tenant lives in the house, and all three have been notified of the
public hearing.
In answer to the questions regarding utilities, the Engineering Assistant
stated that sewer is available on 69th Avenue. T'here is a 10" line on
Ceatral Avenue and an 8" watermain runs down 69th Avenue.
Mr. Nordstrom said there would be no problem with the soil.
Mr. Myhra felt that at this point, perhaps the Co�ission would want an
opi�ion from the Engineering Department with reference to the utility capacities.
According to the Engineering Assistant, it had not been checked. However,
the lines on 69th Avenue are isolated and only serve the people on 69th Avenue.

close the public hearing, ZOA ��68-13, Hammerlund Enterprises, Inc. to rezone

�t Bruce Thomson, President of Pemtom, Incorporated, told the au�ience
this proposed P.D. request consisted of 155 acres, 120 of which we�e in
Fridley. The Compa�ny had built New Brighton Square and Windsor Gr�en. He
then asked Bob Engstrom, Vice President and Officer in charge of 1$nd plan-
ning, to take over.
Mr. Engstrom said he had prepared a presentation which would �ive a
start of what they are trying to accomplish. He said he unders�an¢s under
P.D. they did not necessarily have to submit a proposed use, but g�.ve the
size of the development; that as they were option holders of the p�operty,
i.t was necessary they submit a plan of what the ultimate development would
be. A lot of time has been spent studying the area. They have tried to
ahow respect fox the overall framework of the City of Fridley, tra�fic
pattern, integrating of existing residential neighborhood; they have shown
respect of the land itself. In order to illustrate a couple of th� things
they have accomplished and give a little idea of their attempts, tl�ey
showed pictures of the new concept in Burnsville, Windsor Green, underground
utilities, children on playground apparatus, Walden with much of i�s existing
trees. He said that under P.D. concept, you submit landscape plans, build-
ing plans and deliver what you say you are going to deliver. They looked
on this area as one of the better ones to be developed in the metrogolitan
area.
Mr. Engstrom introduced Mr. Contoski who works on the staff as a planner.
Mr. Contoski used maps for his discussion. He said that the first thing they
have to consider in planning any area is the characterics of the plat
and the surrounding area. The area in New Brighton is relatively flat,
,�"� and the property is more rugged as you go into Fridley. There are steep
slopes, numerous potholes and swamps and is heavily wooded. It offers
beautiful possibilities for certain types of development. Interstate ��694
is directly south and fonas an imposing land barrier. To the East, the
New Brighton side is zoned couanercial and property owned by St. Mary's
Hospital, Grace High School on the North and residential on the West.
They do not �hink the area would be well suited for single fatnily
because of the rugged terrain, but they believe the area would be very suitable
to their townhouse type of development.
Their thinking in respect to traffic pattern: The principle facility
and major entrance would be through Silver Lake Road and would also be the
future major road to the Hospital. A road would continue to Arthur Street.
Gardena Avenue is a significant collector street, being the only street to
connect to Central Avenue and to Silver Lake Road. Second access point to
Silver Lake Road is independent of the hospital access and would connect
with Hillwind Road. Hillwind Road goes around the residential rather than
through it. A connection will be made to Regis Lane from Matterhorn Drive.
The road alignment would be such that it does not encourage traffic into
present residential area.
Because of the gradation of the land, the order of buildings would be
single family townhouses to apartments of inedium density and aparta�ents of
high density as you go East.

�,.� $eg�s Lane: The original purpose was to give the children dir�ct access
to the school. At the present time most of the children from this $rea
would probably be bussed. The Matterhorn extension would be for thQ catholic
school.
Hillwind Road - Central Avenue: They talked to the Highway Department,
shawed them the plan, and the Highway Department said they will very� definitely
do something to this intersection. They will ait down and work out which way
Fridley wants to go with it and expressed interest in sitting down with
Fridley and working.
Review Density - Townhouse Area: Mr. Contoski said there were 1,220
units in the whole area, and of that amount, Fridley had 780. He said they
did not, as yet, design specific buildings for this area. It will be
several years before it will be developed and then it will be in definite
stages.
Mr. Engatram said they would atteanpt to establish two tawnhouse neigh-
borhoods with two different architectural designs. Generally the price8
range in excess of $35,000. At the rate of rising construction costs, they
� are experiencing an increase of 10% per year. Regarding the character of
the multiple dwellings, they will attempt to follow a aimilar pattern as far
as being able to come up with a special design to adapt to the terraine and
be compatible with the other architecture. Mr. Engatrom said they were
interested in starting one of the townhouse neighborhoods as soon as utilities
would be available. When asked about the closing date for the whole procedure,
Mr. Engstrom answered in about four years. The Fridley aide is really the
� key to the whole area. It is a smaller parcel and without the approval of
the Fridley area, they would be in no position to start the project. The
thirty-five acres in New Brighton is under option.
James Polzak, 1527 Trollhagen Drive: (Attorney, advisor and director
of Iunsbruck Home Owners) I want to point out first that, frankly, we ask
this rezoning be not approved. Much has been said about the tiaffic pattern.
We have a concern for Fridley as a whole. In all of Fridley, you r�ally
do not have too many area developments to support $35,000 homes. W� would
like to see the same kind of development as we have in Innsbruck. It is
about the only area left to support that kind of dwelling. We urge, for
the interest of the City, not to rezone.
Herman F. Bergman, 5503 Regis Trail: Pemtom has done a tremenc�ous job.
The slides were interesting because of comparisons between their tawnliouses
and trailer courts. I would like to see slidea of canparisons of s�ngle
family residencea. The intention of rezoning is for multiple family dwel-
lings and my opinion of their intentions is they should have come fazward
with a request for R-3. They are asking for Planned Development. �'he plans
they have shawn or have been identified are merely current thought. If that
is true, if they are asking for P.D. on that basis, what they are reall�
asking for is wide open zoning.
Mr. Bergman continued that the traffic pattern was preaented f�irly
well. I would like to point out there really is no access to the West as
i'� shawn. (Mr. Bergman used the chart). The traffic dawn Hillwind Road to
Highway �65 involves six corners plus entrance to a gas station at �his
intersection. It is a fairly hazardous entrance. (A member from tY�e

r''� Trunk Highway �65. The one which is most difficult to negotiate ie Z3i�lwin�i
Road. It ia very seldo� used because Old Central ie the through street and
has primary shot at the Highway.
Mr. Bergman concluded that Pemtom's objective is to get good det�sity
out of this land and that is exactly what we can't stand. 3ingle f�nily
residences would mean lawer density and that's what should go in. T'tiis land
is landlocked and we are landlocked now.
Waldo Hoftmaa, 1333 Hillwind Road: He preeented a petition from 100%
of the hame owners on Hillwind Road which are in opposition to the rezoning.
MOTION by Jensen, seconded by Mittelstadt, that the Planning Co�ission
receive the petition circulated by Mr. Waldo Hoffman opposing the rezoning
request, ZOA �69-01. Upon a voice vote, all voting aye, the motion �arried
unanimously.
Richard E. Hudrlik, 5502 Regis Trail: I seriously question rezpning
fram R-1 to P.D. It seems they are really asking for R-3.
Mr. Hudrlik presented a petition with.25 names of people of the Hathaway
Lane area who are opposed to the rezoning.
MOTION by Jenaen, seconded by Myhra, that the Planning CamaieaiQn receive
the petition circulated by Mr. Hudrlik dated January 20 and 21, 1969 opposing
the rezoning petition, ZOA #69-01. Upon a voice vote, all voting aye, the

R. J. Reed, 1204 Regie Terrace: He etated the schools are already
crawded and that Columbia Heighte is building a temporary school. P,D.
rezoning would increase the density to a point where it would be too �ch
of a burden on the schools.
Mr. Reed presented a petition against the rezoning.
Py0TI0N by Myhra, seconded by Mittelstadt, that the Planning Commiesion
receive the petition circulated by Mr. R. J. Reed dated January 20, 1,969
opposing the rezoning petition, ZOA #69-01. Upon a voice vote, all voting
aye, the motion carried unanimously.
Lawell C. Mellum, 5517 Regis Trail: He had a petition signed bp 26 hom�e
owners on Regis Trail. He wiahed to state they have invested a con�iderable
amount of money in the co�unity, and feel their requeet ia really for A-3
zoniag. A buffer zone of 135 feet is a small buffer. It is unlikely anybody
would buy these lots with 170 unit to�wr�houses, 1200 unit apartments, and with
a petition, could double that depending how the land goes.

receive the petition circulated by Lowell C. Mellum dated January 20, 21 and

When we moved here eeven years ago, only four families were in this area:
There was practically ao traffic problem; the school is two blocks away.

� We inquired about the �and behind us and was told it was zoned residential.
This is the second time we have had to come here. I was told that th� City,
when originally laid out their property, laid it out commercial, residential,
m�ltiple to consider what is the best for the City. Now why do you h�ve to
review this every year. I don't think it is right. This is a petitiqn fram
Lynde Drive.

In answer to Mr. Polzak's question, Chairman Erickson said the president of
Acres, Inc., John Johneon, signed the owner's request for rezoning.
Jean Bukovich, 1244 Regis Terrace: She stated she had a petition of 24
names of the residents on the south side of Lynde Drive, and they feel very
strongly the land should remain residential for the benefit of the City of
Fridley.

Henry Wahlberg, 5659 Regis Trail: I think the image of the City of
�„1 Fridley must be considered, also. I don't know if this is the total i,mage we
want. I feel if this area was developed it►to a nice residential area, it
would be a much greater asset to our City instead of apartment development.
If this is developed ��tne as in Innsbruck, we could be proud, but not
if it is apart�ent development.
MOTION by Mittelstadt, seconded by Myhra, that the Planning Coc��aeioa
receive the petition circulated by William A. Dietz dated January 20, 1969
opposing the rezoning petition, ZOA ��69-01. Upon a voice vote, all voting aye,
the motion carried unanimously.
William D. Shontz, 5547 Regis Trail: He said the area is fairly well
saturated with tawnhouses at the present time. Under the P.D. rezoning, the
developer could claim hardship in a number of years claiming the townhouse
is no longer feasible and that the whole area should be put into apartXnents.
I understand there is some problem with P.D. in the past.
He presented a petition signed by 100% of the people living on Hathaway
Lane.
MOTION by Mittelstadt, seconded by Myhra, that the Planning Comnission
receive the petition circulated by William D. Shontz dated January 19, 1969
opposing the rezoning petition, ZOA ��69-01. Upon a voice vote, all voting
aye, the motion carried unanimously.
� Bill Shaw, 5212 Capitol Street N.E.: He asked what density is allawed
� in P.D. development. (No density has been established.) He asked if �.t ie
ca�on practice for the zoning comnission to consider rezoning without having
proposed plans.

Chairman Erickson said that rezoning can be acted on without atny plans,
�"� but the plans came later and can be turned down.
Mr. Shaw said he wondered if it would not be wise to have 8omething dawn
before P.D: is considered. There is nothing biading to what they pre�ent.
Chairman Erickson anewered that there is nothing binding on either the
City or petitioner. He then asked if it is the general feeling that �he
major problems are density and traffic.
A citizen said there would still be a fair amount of objections -- lack
of buffer and subsequent effect of property values. A lot of the p�ople who
moved to the suburbs did so to get away from congeation and traffic. He did
agree the primary objection of many is that of safety relative to tra�fic.
The audience were infoxmed by the Chairman that the petitioner wauld have
to present a plan agreeable to the Planning Comonission and City Counc�l and
would require a public hearing the same as the one held for rezoning.
Willard Unke, 1422 Trollhagen Drive: I think P�mtom has an outs�anding
reputation. They don't build little houses on hillsides. He asked the Plan-
ning Conmission: 1) Do you people feel that you can exercise proper control
if it is rezoned to P.D. 2) How long do you expect to consider this petition?
3) Is it possible that you can go ahead with your plans by lowering the
density?
Chairma.n Erickson said in answer to 1) I think the density can be con-
� trolled. 2) He, personally, •�•as not ready to act on the rezoning request
tonight, but how many meetings it would take, he did not know.

Mr. Engstrom said in answer to Item 3, they have proposed 6.5 per acre,
which we feel is modexate, and that the terrain would prohibit single
unattached dwellings, and if develaped, could not be done without damaging
the natural amenities of the site. We are not interested in going in there
on a single family subdivision. We are not interested in going in and ruining
that piece of land. Let me tell you we do not go in and sell the Pla�ning
C�ission and Council a layout and a schedule and then come back with another
thing. We don't do that. We would layout a schedule and we do not deviate
from that. The density under R-3 is considerably higher than what we are
askiag for. We have to present to the Planning Coaaaission and Council the
denaities and a sketch.
Mr. Polzak said that when Acres, Inc. bought that property, it was
assumed that the same kind of development would be built acroas the road. He
thought it would be in the interest of the City of Fridley that it remain in
R-1 zoning.
A citizen added that they would like a nice residential area over there
which they could be proud of. She ob�ected to P.D. She said she was not
questioning their integrity, but suppose they started on apartment bu�ldings
and got all of them built in five years, and then what could happen -- they
might sell the rest of the land.

� Mr. Jensen ssid he would like to clear up one point. The co�enz about
480 hames in that area, he thought was really an error in judgment because
this would be aomewha� in excess of our mininoum atandards under the ordinance
naw.
Mr. Mellumt Do you have any P.D. in Fridley right naw? Spring Brook Park
apparently has flopped according to the Fridley Sun. I sat in the l�et meet-
ing and a very similar plan was developed. This plan was turned flatly dawn
by the Planning Cammission. We have a new Planning Camniesion and new Chairman.
They come in with a similar plan, yet we reconsider. There may be a change of
thought with a change of inembera on the Comnission. There is no continuity
as such. This P.D., as I see it, can go with the wind. I doubt very much if
I would buy property abutting Planned Development.
The Chairma.n said that under R-3 zoning, the ordinance established a
deneity and there is not much that can be done about it.
Mr. Myhra said the Planning Caamission has been erroneouely attacked
about Spring Brook Park. I don't think anyone deliberately did this. I came
on when it first came up. I saw plana in the very beginaing. There was no
to�wahouse. Sameone said townhouses were planned. It was not true ap far ae �
the Planaing Coc�isaion was concerned. A number of hearinga were he�d and
people were in agreement. Someone bought a home and felt he had been stung.
It is importaat, when this sort of thing happens, that the Planning �ommission
does not put itself in the position to being the scapegoat and there ia a
corresgonding responsibility on the part of the public.
Lester G. Gable, 1434 Trollhagen Drive: Part of your coneideration is
taxes that may generate from a particular plot of ground. I'd like to find
out what the capital investment would be with a development like thi� and
what it will be with 320 to 350 single family development.
Mr. Thomson quoted the figurea given him by Columbia Heighta Scl�ools
pertaining to schools which showed the plans as proposed would be a benefit
to the community.
Mr. Bergman stated that quite a bit of time has been spent on d�nsities.
He asked what the ttvrmal density is for R-1. Mr. Jeneen answered that it all
relates to the ordinance and the maxim�mm in Fridley would be approximately 3,
aad in an area of rugged terrain, it would be considerably lower than that,
poasibly lower than 2.
Mr. Bergman said that comments were made about the desirability of
samething like this rather than houses on the aide of a hill. When Acres, Iac.
bought that land, they were not going to build little houses an the hill.
High cost homes should be built in that land to com�e out on top, pos:ibly
the same density count be accomplished as in Innebruck. The areas in North
Oaks -- density is low, high priced houses, entire area ia besutiful. He
thought 130 acres could be developed as in North Oaks and would be a besutiful
reaidential area and would not be economically unfeasible.
� Mrs. Boka.vich added that Fridley is filled up with residential.
Mr. Thomaon said he thought that all the people were concerned about
traffic. His coacern is what happens to this piece of land. We are a young

�.,� company and we want to be around for awhile. We think we have came vp with
a decision of 6.5 and would preserve the nature of the area and he d1d not
think the people will lose anything.

Mrs. Pettersen (speaking o�.;Regis Trail) said there is no actua� road
between Regis Trail and proposed;M�tterhom Drive. She asked why woyld not

Streets & IItilitiea Subcommittee. They felt the City could not initiate the
vacation because of the ownership problem on-either side of 73� Avenue. The
trading would have to be done now because of the atreet improvement
project is acheduled for 1969. The motion of the subcommittee indicated that
if the 140 foot wide strip of land to the North of Central View, which would
be hsrd to develop by itself, were combined with Block 1, Central View, t�ro
building sites could be created. One, a five acre commercial eite with
acceae to a service drive along Highway #65, the other, a five acre industrial
eite with accesa to Central Avenue and that all of Block 2 could develop,
as is, with frontage along 73rd Avenue.
They recalled that Mr. Soreneon did not want 73� Avenue vacated, and
Mr. Thoe had no objection but he had a problem with the storage tanks.
Mr. Jensen said that you cannot assume anything about the size or ahape
of the future development of a commercial or industrial tract. The only thing
the Subcommittee could do logically was to recommend that the street could
not be closed a.nd state that they felt they would reco�e.nd f�.vorable
coneideration of an alternate scheme allowing the closix�g of 73� Avenue
upox� the request of the individuals to vacate and with the acquisition of
a service drive from 73rd Avenue to Fireside Drive along Highway #65 so that
all propertiea could be properly aerved by the street.
MOTION by Jensen, eeconded by Mittelstadt, tha,t the Planning Commission
recommend to Council tha.t, while the vacation of 73� Avenue ia probably a
� deairable action, it cannot be recommended because abutting property owners
axe not i.n agreement and vacation would deprive some owners of atreet
access to their properties. If at a future date abuttixig property owners
favor this vacation proposal, a service drive should be considered along
T.H. #65 from 73rd Avenue to Fireside Drive. Upon a voice vote, all voting

The Commiseion were given a lar�e acale map of the axea prepaxed by
the Engineering Depertment. They felt these were a definite help to them
in seeing the eituation more cleaxly and suggested they be available to
the Council.
9. �CCAVATION ORDINANCE:
The City Manager was aeked what concern the Planning Commiasio.M
should coneider. He said the problem is the condition of the street after
an excavation. Such things as improper backfillixig or compe,ction w�ich
would not x�ecesearily ehow up right away, need attention.
Mr. Fitzpatrick aeked how much of a safety factor axe we dealing with
here and if we axe to provide a safe operation, it aeemed to him it could
be done in many other ways, auch ae individual's responsibility, or by
ordinance.
The purpose of the ordina.nce wae discusaed. One of the items
�1 diecusaed was the poating pf a surety box�d. The Commissiox� felt this would
be u.nfair to the person doing a very small piece of excavation and this
feeling included the psragraph on in�urance. They also eaid that any

RIVERVIEW HEIGHTS
The Commission is interested ir� the poss�bility of obtaining matching funds
or aid from the County in the development of Riverview Park. Chairman Fitz-
patrick and Vice Chairman Cochran agreed to contact Mr. A1 Kordiak and have
him express any interest that the County may have in this project. Both Mr.
Kordiak and Mr. Harvey Peterson, County Commissioner, are scheduled to attend
the February meeting.
WEST MOORE LAKE
Mr. Robert Minder, a member of the Rotary Club, had previously planned to
attend the meeting but was unab�,e to due to illness. The next step in this
project is to find out what the Rotary Club plans in regard to the development
of West Moore Lake and perhaps show them the preliminary plan that was drawn
by the Park Consultanfi.
pIRECTOR'S REPORT
Regarding the January Memorandum, under Old Business Items, the Commission
felt that item "g", Park Acxeage Study, should be marked completed. Member
Blair suggested that the Comm�ssion of£er its help to the Jaycees in organizing
item "h", Junior Olympics Progxam. Chairman Fitzpatrick reported on item "k",
School Board Meeting.of December, 1968, which the Director and he attended.
The School Board feels that more supervision is needed in the activities which
utilize schools facilities.
MOTION by Cochran, seconded by Blair, that the December and January Memorandums
and the December and January Pxpgress Reports be accepted. The Motion Carried.
PROGRAM FOR PARKS AND RECREATION C01►�NISSIqN ACTIVITIES
The Com�nission reviewed and updated the Program for Parks and Recreatiqn Com-
`j� mission Activities for 1969. A few changes were made. The Commi,ssion felt
that it would be more beneficiai to them to review the 1968 Summer Program
at the same time that the 1969 Summer Program is adopted and the same with
the Winter Programs. They also requested that the Department contact the
Park Consultant to see if an arrangement.can be made by which th� Park Consul-
tant attend a minimum of four meetings to be scheduled according to the Com-
mission's need for his services.

MOTION by Blair, seconded by Stimmler, that Mr. Thomas Cochran serve as Vice
Chairman to the Parks and Recreation Commission for the year of 1969. The
Motion Carried.
MOTION by Stimmler, seconded by Cochran, that Mary Lou Erickson serve as
Secretary to the Parks and Recreation Commission for the year of 1969. The
Motion Carried.
PLAN FOR 1970
The Chairman received a call from a citizen requesting more activities for
^ young girls through the Summer months. The Commission suggested that possibly
a drill team or baton lessons could be offered but wished to check further with
the Director as to the available activities.
Member Blair suggested exploring the possibility of the Department offering
Boy's Basketball on Saturdays. Again the Commission requested that the Director
look into this.
Under the section, Park Development, the following additions were discussed
by the Commission:
The Commons: Members Blair and Stimmler stated that there is a great
need for an additional hockey warming house.
Locke Park: Vice Chairman Cochran pointed out to the Commission that a
South entrance in addition to the planned North entrance would be a great
asset to the park.
Broad and Hugo Park Property and Glencoe Park Property: Since these two
parks are located so close together, the Commission felt that perhaps just
one should be developed at this time. They will study this further.
Under the section, Land Acquisition Site Proposals, item 4, West, the Commission
wished to add the area:South of Locke Lake and East of the railroad tracks for
further consideration.
The Commission agreed that another area for their consideration, section D,
^ should be the restoration of both sides of Moore Lake. This could possibly
be just a study at this time.
MOTION by Cochran, seconded by Stimmler, to accept the Plan for 1970 with the
comments and changes as noted. The Motion Carried.

Mr. Stimmler was appointed by the Chairman to read through the Minneapolis Park
Board Ordinance Book and advise the Director which ordinances would benefit the
Fridley Park System if adopted. The Commission will again discuss this at their
February Meeting.
PARKS RESOLUTION 1-1969
The draft resolution regarding encroachments on park property was reviewed,
revised and adopted by the Commission. See Attachment.
MOTION by Cochran, seconded by Stimmler, that the revised resolution be
adopted and presented to the Council. The Motion Carried.

A RESOLUTION ADOPTED JANUARY 27, 1969 BY FRIDLEY PARKS AND
RECREATION COi�fISSION TO THE CITY COUNCIL, CITY OF FRIDLEY,
MINNESOTA
BE IT RESOLVED, by the Parks and Recreation Commission of the City of
Fridley, Anoka County, Minnesota as follows:
WHEREAS, the land area of the Fridley parks system has lost 1.57 acres
to the Water Department over the past eight years, as detailed below; and
WHEREAS, the park system here has lost 1.50 acres of park land to the
necessary construction of a traffic way at 69th Avenue at Locke Park; and
WHEREAS, the park system can continue to expect this nibbling attrition
and loss of park lands; and
WHEREAS, the Comstock and Davis "Supplement to Preliminary Report on
Water Utility, Fridley, Minn." of October, 1968, on Page 2, Paragraph 3,
states in discussing new well locations, "Possibly one of the greatest prob-
lems will be site cost and site availability". We respectfully submit that
l°� park lands are not "free". They are taken at the expense of park users; and
WHEREAS, the City of Fridley plans to undertake a well drilling program
commencing December, 1968 which should see, at maximum, as many as six wells
with pump houses and other facilities constructed at sites,
BE IT HEREBY RESOLVED by the Fridley Parks and Recreation Commission
that the City of Fridley be requested to replace park area lost to well site
development on a"when done" and "as done" basis. Be it further resolved
that the City of Fridley be requested at the earliest possible time, to
arrange to replace the 1.57 acres already lost by our park system to the
water system, and
BE IT FURTHER RESOLVED that the Council adopt a policy establishing
conditions under which park property may be used for non-recreational pur-
poses.

Mr. Swanson was present to represent the petitioner.
Darrel Clark explained that this area was studied as early as 1961 and. -
that at that`time, the east-west street (72nd Way) right of way was set
at 50 feet and was approved by the District No. I4 School Board. However,
no easements have been acquired from them to date. Also in 1961, a street
plan was approved that is the same as the preliminary plat we are now
reviewing.
The 72nd Way right of way was again discussed in 1966 with reference
to a proposed house to be built on Lot 3, Block I, Mississippi View Addition.
At that time the minutes indicated that a total right of way for 72nd Way
could be narrowed to 40 feet. In the plat of Riverwood Manor, 30 feet was
dedicated Ieaving l0 feet to come from the north of which 9 feet has already
been dedicated leaving l foot more yet to be acquired from Lot 3. The ownex
of this 1ot, Gordan Sangster, was in today and explained that he would give
the additional foot or two needed to bring the total to 40 feet.
I spoke with Jim Hedxen of School District ��14 by phone and he indicated
he thought_the school would be agreeable to dedicate property for some
additional right of way and Council is meeting with the school board next
Monday and will discuss this further at that time.
- It was also mentioned that the feeling in the past was to close off the
access.to East River Road as it enters on a curve and,_therefore, is hazardous
to negotiate.
Mr. Swanson presented his proposed.plat and when asked whether adjoining
property owners were in agreement with this proposal, stated tha� tl�e ow�er �
. af Lot 34 was against the plat and that the owner of Lot 31 wanted to sell
his property to hi.m.

The Subcommittee noted that street right of way would be necessary from

Notice is hereby given that there will be a Public Hearing
of the Planning Commission of the City of Fridley in the

The City Engineer said that this was for a 10 unit apartment
building. �he Council had the first reading ot the Ordinance
• August 19, 1968, with the second reading to be witlZheld until
all the plans are ready. Councilman Liebl pointed out that the
Building Standards - Design Control recommended approval subject
to drainage and grading plans being approved by the City Engineer.
The City Engineer said that in the front, ths drairiage is taward
the front and in thE back, the drainage is to the back. Iie said
.,_ that he will.work with the applicant on th is. He said that the
parking lot is along the side. As the City has requested a 30'
road declication on the west af the property, he has acquired
additional prop+�rty, but this will have to go to the Planning
Co�dission for rezoning before the Council can act on it. Z'ize -
action before the Council at this tims is only for the original
request area. Z'he City Attorney`asked if any of the building is
located on the second section. The City Engineer said no, only
the original portion.

�'T`hs City Manager exPlained that after the first reading, this
ordinance will have to be reviewed by Judges to determine fairness.
The City Attorney agreed and elaborated that the list of mi�demea-
nors and fines are merely suggested. The Court will have to deter-
mine what the fines will be after passage on first reading. He-
explained that this ordinance's purpose is not to raise money, but
rather to obtain compliance with our ordinances. He said that it
would take a lot less money for the Inspection Department to issue
a tag than for Court costs and Attorney's fees.
Cauncilm�n Liebl asked the City Attorney if, in his legal opinion,
these fines would be upheld in Cou rt. �I'he City Attorney explained
that the fines were taken from Edina, St. Lauis park, and Blooming-
ton_`s ordinances, and that the Council may wish to make the fines
in certain areas sm�ller-or larger. He said this is the equivalent
of the policy for issuing a traffic ticket.
The City Manager said that this ordinance was requested to allow
imm�d�ate action and e�iminate a lot of paper ��ork.

Councilman Samuelson said that he had gone up there with the En-
^ c�ineering Assistant and the problem with this home is that it sit�
side�ways on a corner lot. There is about Z0' setback, so the
prablem is the nearness of the building to the property line,
and the fact that sloping the yard would greatly disturb their trees,
yard light, etc. He said that there just is not enough room to
achieve a good slope. He said that this was the only case like
this in the project.
�'he City Engineex said that the wall could be 5' from the curb to
alla� for snaw storage. The wall is to be on the Super's property.
Mayor Kirkham commented that he recalled that this has been done
for other people occasionally. Councilman Sheridan asked if the
' Supers woulc7 be agreeable to splitting the cost. Councxlraan Samuel-

Notice is hereby given that there will fi�e a Public Hearing of
the� Planning Commission of the City of Fridley in the City Hall at
6431 University Avenue Northeast on February 13, 1969 in the Council
Chamber at 7:30 P.M. for the purpose of:
Consideration of a proposed preliminary plat, P.S. #69-01,
Brentwood Estates, by Thomas R. Swanson, that part af Lot 35,
Revised Auditor's Subdivision #77 lying Easterly of the
Northerly extension of the Westerly line of Lot 33 and lying
Westerly of the following described line: Beginning at a
point on the Northerly line,of said Lot 35, said point being
421.38 feet Easterly of the intersection of the said North
line and the Northerly extension of the Westerly line of
Lot 33; thence Southerly to a point on the South line of
said Lot 35, said point being 431.6 feet Easterly of the
Northwest corner of said Lot 33 and thereby terminating.
Also, that part of Lot 33, Revised Auditor's Subdivision #77
lying Westerly of the following described line: Beginning
at a point on the North line of said Lot 33, said point
being 401.4 feet Easterly of the Northwest corner of said
lot; thence Southerly to a point on the Southerly line of

Sonie one and one-half years ago I stated to a Planning Comnission
� meeting that it was not feasitile to build personal resider.ces on
' the P3orth Innsbruck area for the following reasons:
I 1. Difficulty of landscaping terrain, and
2. Cost of developing, particularily utilifiy insta].lations.
'; �I am still of the sane opinion. The price or�e would have to charge
j a prospective home owner for a home site in this area woulri, in my
'; opinion, be such that there would he no market for the sale of
' such home sites.
