Chairman Erickson read the notice of Public Hearing.
Mr. N. Craig Johnson and Mr. Bill Dolan represented the petitioners.
According to the site plan, the actual land area is 17 acrea which would
allow 296 units, but the actual units on the plans are 294. The total required
parking is 441, and their actual parking is open parking 324, garage parking
182, making a total of 506. A rental level of $145.00 to $185.00 is co�templated.

As far as the utilities are concerned, the Engineering Assistant said that
� sewer and water are on 79th Avenue and sewer on East River Road. The sewer
lines are on the East side of East River Road. This portion of the sewer system
does not run into the Riverview Heights Lift Station, but goes direct into a
gravity line on East River Road. In answer to the question of the use of the
property North and South, he said 79th Avenue has apartment houses with probably
� three or four single family dwellings. The zoning on the North is multiple
and as you work towards the tracks, light industrial. Orginally the zoning
of this entire tract from 77th Avenue to 79th Avenue was multiple dwelling
except for a 200 foot strip of M-1 along the tracks. A part of it was changed
to commercial and industrial.
Mr. Myhra said that normally the Commission gets rezoning requests the
other way around -- from residential to commercial. He wondered, in this
instance, why we are moving from comnercial to multiple. To the South we
have commercial and industrial. Is it because right now co�nercial types of
things are not moving? If this were.put into multiple, this would tend to
landlock the zoning.
Mr. Dolan said he felt that the uses to the South are somewhat disconnected
because of the creek. With the uses on the other two sides being residential,
they felt this use of the land would fit in with the neighborhood. They had not
looked into a co�ercial shopping center because they felt the area would be a
little too small.
Mr. Myhra said one of the things he, personally, would find objections to,
and probably also the people across the street, is putting the garages facing
� the highway.
Mr. Dolan said they thought of that, also, and had considered a brick wall.
The Chairman had asked if there was anyone present in the audience who was
interested in this rezoning request, and,until Mr. Paul Burkholder came in,
there was none. He was asked his opinion and he said he thought it was a good
project. It was probably the best use of the land and much better than a
warehouse.
MpTION by Mittelstadt, seconded by Jensen, that the Planning Commission
close the public hearing of the rezoning xequest, Z0A �69-03, N. Craig Johnson
and Committee of Five to rezone the southeast corner of 79th Way and East River
Road from C-2S and M-1 to R-3. Upon a voice vote, all voting aye, the motion
carried unanimously.
Mr. Myhra said he felt a little uneasy about this rezoning, probably
because in the past, for this type , dealing with multiples, he felt that
getting the opinions of the people within the 300 feet required in,the appli-
cation helped the Comomission to make up their minds. Going from com�►ercial
to multiple, he wondered if the matter of revenue for the owner should not be
considered, also. Are we creating a hardship on the owner? He found it was
a difficult answer to give in that he was not certain coae�nercial was suitable,
but also, at the present time, he was not too enthusiastic about the proposal.
^ Mr. Mittelstadt said this was his precinct and that in the past the
people objected to coumercial, as they didn't want warehouses or that type of
structures, but would like this better. This area will never go R-1 because
of the railroad tracks.

The Chairman admitted that he, too did not feel he was ready to make up
^ his mind this evening. Further, he would like to see the Commission supplied
with the past history on the rezoning in this area. Mr. Jensen agreed that a
little research would be in order.
The Engineering Assistant volunteered that the delay at the Planning Com-
mission level will not-delay the hearing before Council.
MOTION by Jensen, seconded by Myhra, that the Planning Counnission table for
further consideration the rezoning request, ZOA �69-03, N. Craig Johnson and
Coarmittee of Five the rezoning of the Southeast corner of 79th Way and East
River Road to be rezoned from C-2S and M-1 to R-3, to the meeting of March 13,
1969 to allow the Coimnission additional time to study the request and to allow
Darrel Clark to search some of the past history of the area. Upon a voice
vote, all voting aye, the motion carried unanimously.

written at his suggestion asking the County Auditor for the status of certain
lots, said this was the land lying north of the proposed Planned Development
and east of Grace High School. The West Half of Lot 49 was single family
residence, Lot 39 a private owner, Lot 44 two homes, and the East Half of
Lot 49, Lots 40, 45, 50, 51, 46 were listed to Arvid E. Carlson, but were
probably sold in 1967 to Rodney Billman. Lots 41, 47, 48 and 52 are presently
tax forfeit to the State of Minnesota. Inasmuch as Mr. Fitzpatrick would
presently arrive, and the fact that he is the Chairn►an of the Parks and Recrea-
tion Cou¢aission, it was decided to wait until he arrived to see if the City
might be interested in these lots.

Mr. Jensen explained that he had talked to Darrel Clark relative to this

hampton Second Addition) and is still in an inconclusive stage. The petitioner
had beea asked and agreed to gather some additional information in the neighbor-

Mr. Jensen stated that he remove himself fram further consideration of
this item inas�uch as he did have a conflict of interest. There were no objec-
tions and the request was granted.
Chairman Erickson read a prepared two sheet suuROary which he had composed.
When he came to Item �7 (Use of the area for R-3 shall be limited to areas-�-)
he referred to the map showing uses of the proposed development. He suggested
use of R-3 being left in areas 4, 6, 7, 8 and 9, and area 5 in the southwest
� corner should not be R-3.

Representing Pemtom, Inc. were Robert Engstrom and Edmund Contoski.
^ Responding to the suggestion of removing �5 from R-3, Mr. Engstrom said he
could not say positively what their reaction would be to this suggestion
as it is a joint venture with Borson Construction, Inc. and they came in with
a 6.5 density, which is relatively low. Their plans called for eight units
to the acre which Was one of the reasons why they did not put townhouses
there originally. They were talking substantially price range and did feel
the freeway traffic could be a factor in selling individual homes.
Chairman Erickson said if they would want to replace that density in an
Easterly area of �3, he did not think he could say at this time whether or not
he would vote for it.
A member of the audience said that if Hathaway were cut off, then there
would be even more traffic on Regis Lane. Chairman Erickson replied that he
didn't know how you can cut Regis Lane off in that area no matter what is
built up there.
Another citizen wondered if a service road could be established going
East adjacent to the freeway over to Silver Lake Road, but he was infoxmed
it would be tremendously difficult because of the terrain.
The question was asked what role the Planning Commission would play in
the closing of the Ma.tterhorn bridge. Chairman Erickson answered that he did
not knaw whether or not consideration would be given to closing that bridge
especially as it relates to Fire and Police protection.
^ Mx. Myhra referred to the paper presented by Chairanan Erickson by say ing
he did a good job, particularly on Items 1 and 2 on the first page. However,
he did not think they had a camplete answer to �1. He guessed the stickler is
�2 -- will the development have an adverse effect on the adjacent residential
property. He had made some inquiry and understood it does not have any
adverse effect. He said you make a judgment on belief, but then you do not
have the answer until it iB �'^-�e. Once again, it seemed the owners should not
be overlooked. The Chairman .nade a good point that the City has been using
the land as a park, that is the residents. We can hardly expect sameone to
sit with valuable property, pay taxes and expect they ought to furnish this
kind of facility for the residents.
�
Mr. Mittelstadt said that he'd like to make a few points which he did not
believe have been thought about. It is by a study of the University of
Minnesota that multip?: dwellings of one or two bedrooms do pay for their way
in a tax structure. On th:. average, tne �taxes to the school accrued from
moultiple dwellings of this type would be about $165.00 per child annually.
Their cost to the school is about $54.00, so you can see it does pay for itself.
Now this area is in School District ��13. In the City of Fridley, School
District #13 is abvut 23% or 26% of the total area of Fridley. Therefore, the
administrative cost, which would come from the entire City of Fridley in terins
of services of fire and police protection, would have a major impact on the
other two school districts -#14 and �16. In other words, I am saying that
76% of Fridley would have a�nicipal burden, an increase in a municipal tax
base because of the high population density in this area. The major portion
of the school district is in Columbia Heights, the sexv ices are being rendered
by the City of Fridley, therefore, in terms of any school tax gain, the major
portion of Fridley would not benefit.

Mr. Myhra asked him if he were saying that this area would not pay enough
^ taxes to pay for its municipal services? Mr. Mittelstadt replied that he was
eaying that the taxes collected from here go mainly to District #13 schools
and yet the municipal boundaries would include all of Fridley and all would
pay the tax to municipal services. Mx. Myhra said that, if it is self-support-
ing, it wouldn't matter, would it? Mr. Mittelstadt replied that the services
would increase and he didn't feel it would support itself.
Chairman Erickson said that it seems then that what we must ask ourselves
is what municipal services are going to be increased because of the develop-
ment of the area. I presume you are considering police and fire and street
maintenance, yet I find this development of the area needing far fewer streets
than if it would be under single family. Mr. Mittelstadt's answer was that if
it were single family, the number of units would be down to around two or
three per acre versus 8.5 on this concept. Mr. Erickson said that if it were
single family, the streets would increase in length by two or three times and
would increase the maintenance budget by that.
There is one important item, Mr. Mittelstadt said, that no one has com-
�nted on so far this evening and it is that approximately 97% of the public
that we have heard from are against this proposal. That fact cannot be ignored.
Their main argument, I feel, is the traffic problem and that argument has the
biggest impact with me. Fridley streets are not ready for this volume of
traffic nor are its traffic patterns. Mr. Myhra said he though that was a good
po int .
� And, Mr. Mittelstadt continued, there is another item to consider -- the
future of an emrironment like Pemtom's. For the first ten or fifteen years,
I am sure the project will remain in reasonable condition, but as years go by,
it could very well become a ghetto area with problems for Fridley that would
be unbelieveable.
Mr. Myhra said th8t one of the objections of the residents is for monetary
reasons. He thought that if someone wished to sell his house, it might be easier
to sell if he had an "Innsbruck 5th" next to his property, but then this brings
us right back to Item 7. What about the owner? What rights does he have?
Does it mean because these people would like their residences to increase in
value, he should be denied some type of rezoning?
Chaizvoan Erickson said he had no sympathy for the owner of the property
inasmuch as he bought the land under R-1, but because of the fact the property
is difficult and expensive to develop, he personally felt the plan was a
beneficial one and one which would allow the land to remain as it is.
Mr. Myhra said he took exception, saying he realized people have said "I
purchased with the idea in mind it was R-1 and did not expect it to change",
but once again they must recognize conditions do change. If conditions have
changed, he did not think they should set their thoughts back. Then what bear-
ing does past history have on it? At this point, we stop considering all
changes. It still gets down to conflict of interests of the three parties
involved: the owner, people wha '.'--� in the surrounding area and the Planning
Coumnis s ion.
� Of all the camments he heard at the public hearings, Mr. Mittelstadt said
the only one he felt that really held weight, was traffic pattern. Chairman

Erickson said that in any type of development, we are going to have traffic.
There followed a short discussion on traffic pattern.
Mr. Fitzpatrick said he could not add anything to what had been said. He
did not under estimate the amount of objections and the unanimity of the group
of property awners directly to the West and he agreed with the things that
are being said and, perhaps, the most legitimate is traffic. As plans go,
he thought this one was a good one, although Don (Mittelstadt) has brought up
a question whether we are ready for any plans in this area. He believed
rezoning Planned Development does give the Planning Comnission continued con-
trol of the development of the area. All these things have been said and it
is a matter of balance, weighing one with another.
Mr. Myhra said that this brings us back to the points of Chairman Erickson's
comnents. 1. Thinking of access to Matterhorn Drive fram Hathaway and the
closing of a street, what is the policy in the closing of the streets? Darrel
Clark answered that there was no right of way and there is no street there.
The street would have a 12% grade which would not be too goocl for an access to
a high density area. This is a State Aid route to connect Matterkno�rn Drive to
Central Avenue.
2. Matterhorn has been under consideration for five or six years.
Arthur Street has been dedicated down to the North liae and with no real plan
where it would go from there.
3. In getting acceptance from New Brighton for two streets coanecting to
� Silver Lake Road with the neirthboring umunicipality would have to be investigated.
� The Engineering Assistant sa:.0 that the City has set no precedence with New
Brighton. They have connected up to Gardena and made it a through street to
Silver Lake Road, a;id also have connected up with Mississippi Street. Apparently
their interest in agreement are running with ours.
4. Can we change setbacks as part of a plan? Chairman Erickson said we
can make stipulations, if necessary. Referring back to Item �3, he said he had
talked to the manager of New Brighton and they are waiting until we take action.
The suggestion was made by the City Manager that a joint committee may have to
come out of it. He can anticipate probably same problems with the joint
uti,lity situation.
Mr. Myhra said he made another note. Whenever they have started talking
about large developments, they get imiolved with utilities. Darrel Clark said
there is access to a large transmission watermain running up Matterhorn Drive.
From the standpoint of sewer, we could not handle this whole area at this
density. There has been same correspondence with New Brighton and it could be
solved either by retention or perhaps all of the sewage go to New Brighton.
Mr. Mittelstadt asked if the City had made studies in the area for the develop-
ment of streets and utilities and the Engineering Assistant replied theae
studies are not made until the a--ner requests them. Answering a question, he
said the averall density of Fridley is 6.5. The Consulting Engineer of
Pemtom's suggested three solutions: retention tank and discharge during off
peak hours; put part in Fridley and part in New Brighton; or all go to New
Brighton. All three plans were reported to be economical as far as the develop-
^ ment of the property was concerned.

Mr. Engstrom said that, regarding his presentation to the Planning Comm�is-
^ sion of New Brighton, they are in no position to do anything in New Brighton
until Fridley has given a decision. Regarding the density, Section 3 on the
map, they have to study quite carefully because of the freeway and the topography
of the area. He said they would work with the road on the West.

The following letter from Mr. Rodney Billman, dated February 7, 1969,
addressed to the P:lanning Cotmnission was read by Mr. Myhra:
"Gentlemen:
Some one and one-half years ago I stated to a Planning Commission meeting that
it was not feasible to build pexsonal residences on the North Innsbruck area
for the following reasons:
1. Difficulty of landscaping terrain, and
2. Cost of developing, particularily utility installations.
I am still of the same opinion. The price one would have to charge a
prospective home o��ner for a home site in this area would, in my opinion,
be such that there would be no market for the sale of such hame sites.
I have not authorized any one to use my name to express an opinion
different than the above.

Mr. Myhra said the point he wanted to make was, if this was an actual
fact, he tended to agree with Mr. Billman, and believes the Planning Co�ission
will be faced constantly with developmental plans. Those people who have
worked with Pemtom, Inc. (this includes the neighboring cammunities) have been
pleased with the kind of de�•elopment they have and how carefully they are
preserving the natural terrain.
A citizen asked if these plans were adopted, have you formiulated what
plaa to use? Is there any plan as to haw it could be altered?
Chairman ErickE -n az...wered, "No': exactly as it is very difficult to say
at this time what an exact street pattern would be". As far as he was con-
cerned, he did not believe that the traffic to the West was going to be in-
creased any greater than it would be with single family development. North
and East would be easy to solve. Cars per unit would be 1� in a multiple.
He was certain they were talking about 2 or 3 in single family type in that
area.
A citizen asked about Matterhorn being s state aid street. The Engineer-
ing Assistant said .hat it is a designated state aid route. The design has
� not been made for Matterhorn. About 20'� of Fridley streets are designated as
State Aid. EWery year the City goes aver the list, and for various reasons,
some are removed and other added. '

Mr. Bergman asked for clarification of the parties involved in the develop-
^ ment of this area,as Pemtom, Inc. is the only one mentioned. Borson Construction,
Incorporated is the construction firm and has the other half of the project.
Chairman Erickson said there is nothing to say that Pemtom will be the only one
working.on this development. It is possible the development can change. This
is something we know can happen, but he felt the ordinance will take care of
that. Pemtom, Inc. is building the single family townhouses and Borson the
apartment buildings.
MOTION by Myhra, seconded Mittelstadt, that the Planning Coueaission
recomnend to the Council appraval of the rezoning request, ZOA �k69-01, Pemtom,
Incorporated being that part of the SE� of Section 24 that lies North of Highway
��100 right of way to be rezoned from R-1 (single family dwelling areas) to
PD (Planned Development) with the stipulations as presented in the ten (10)
points listed by Chairman Erickson as follows:
1. Access to Matterhorn Drive from Hathaway be eliminated but utility
easements be retained.
2. Matterhorn Drive and Arthur Street must be extended and improved to Gardena.
3. The two streets shown on the proposal connecting with Silver Lake Road must
be dedicated and accepted by New Brighton together with an agreement to
improve such streets within a reasonable time.
4. Construction on the East side of Matterhorn must be set back at least 60
^ feet from the street right of way.
5. Interior street right of ways must be at least 66 feet.
6. The density of the town house acreages shall nat exceed 4.2. No
increase shall be allowed in other proposed densities.
7. Use of the area for R-3 shall be limited ta Areas 4, 6, 7, 8 and 9, and
area 5 in the Southwest corner should not be R-3.
8. Appraval of New Brighton for zoning of any areas overlapping uaunicipal
boundaries. '
9. Approval of the zoning does not necessarily mean approval of the proposed
plan, except that the townhouse concept is approved.
10. Receipt of any agreement fram the petitioner and owners which the City
Council and City Attorney decide would be needed to prohibit any major
change in density at a later da.te, without the consent of affected
residents.
Mr. Myhra asked to make a.:.atement explaining his position. He said,
"I realized when I made this motion that I am displeasing a good 99% of the
people in the audience. I don't think we ever make these kinds of motions
lightly and I'm sure you will agree that we have given this one a lot of consid-
eration. This is not so �uch a plea for your sympathy for me as a little bit
^ of understanding of my purpose in making this motion. As I told you earlier in
� my remarks, as I see it, there are at least three somewhat conflicting interests

and it is nice when you can look at one of tl�ese intexests and say, in our
/'\ judgment, it overrides the others by such a margin that you can, without any
fear of having done the wrong thing, go ahead and ma.ke that motion or make
the wish for pleasing a particular par�y.
"As I look at this, I said earlier in my remarks I think that at least paxt
of the concern here is a psychological concern on your part and, honestly,
that �ust be considered. As one lady expressed it the other night, she woaa�d
like to have an Edina on the north in her backyard, and I think that is a valid
wish, but I am not so certain that it is the kind of thing that we can make
motions on at the Planning Co�nission. I think that we have to look at the
whole base. So it gets down pretty much to this, and this is my reason for
making the motion. I think in the balance, it is my feeling that the interest
of the City, as I see the interest of the City, at least this situation fits
tightly in this balance, and I guess what it gets down to then is that I
would like to make this motion, I would like to have it passed by this Body,
in order that it gets to the Council where we get more people thinking on it.
I think I could sit here two more weeks, two more meetings, and not be any
further along in my own mind. It seems to me that we are an advisory body and
that at this time, at least as far as I am concerned, it is appropriate to
move this along to the City Council and get the thinking of another body on
it. And, of course, as you people know, once again there are public hearings,
and you people have had exnerience in presenting your case and it seems to me
that it gives you a chance again to make a presentation to another body of
people, and in your case, perhaps hope that they will reverse our position.
^ "There is one comment I would like to see carried on to the Council if
this body should vote in favor of the motion and it is that the Council should
be aware that there is a sewage problem in the area that should be solved
before any development can take place."
Mr. Myhra added that he thought it was i.mportant enough, if agreeable
with the Planning Couanission members, to include it as Stipulation �11.
Mr. Myhra amended his MOTION to add:

providing utilities for this area.
Upon a voice vote, Jensen abstaining, Mittelstadt voting nay, Myhra,
Fitzpatrick and Erickson voting aye, the motion passed.
A citizen asked if he could have a copy of the Chaix�aan's Sumnary. Chair-
man Erickson said that he had no objection to the public receiving it, and he
did not believe the City would object. A citizen asked if the petitions
presented to the Planning Co�nission would be passed on to the Council. He
was informed all the petitions would be forwarded to the Council together
with the petition presented this evening, but not received.
The Planning Commission decided to pass the Chairman's Su�ary to the
Council.

Block 2, Riverwood Manor.
Mr. Anderson was present and explained the reason for the request was
that he had Lot 1 and 3 suxveyed because he was going to build a house on
Lot 1. Then the people he was going to build for decided on Lot 3, so he
put the foundation in on Lot 3 five feet from the property line f�r proper
setback and had the house partly up when a couple of old stakes were found.
Ae called the surveyor who rechecked it and found a mistake had been ma.de
in the surveying. As a result of the error, the house was 4 feet on the
other person's lot, making a total error of 9 feet. In order to correct
this, there was an exchange of 9 feet on the three lots with no change in
the overall measurements of thie lots.
Mr. Myhra asked if this affected the easements in any way and was told
it did not.
Chairman Jensen said it was possible there would be an awful lot of
stakes in the ground, the older stakes and the new stakes, and suggested
the older ones be preserved by pounding them down below the new ones.
All the papers in connection with this lot split, such as letter of
approval by the owners of Lot 2, necessary quit claim deeds and survey
drawing of lot descriptions were in order.

by the people on the north or south in trying to work out the street gattern.
^ Ttte xequest was held up si.x months. Finally the Planning Commission and
Council decided they were not getting any place so Worrel's was platted
without an overall pattern in mind.
About a year ago Julian Johnson startsd a platting procedure and again
the same problem came up. People to the south are not interested in platting.
For the new members, Chairman Jensen explained that the people are not
very cooperative to the south. The Subcommittee spent some time out there on
the grounds. It is an area of lush poison ivy. There are tremendous big
trees, woods and steep slopes. This is why there has been a great deal of
concern by the Subcommittee and Planning Commissian over the years. In order
to try and make the best use of this country, they keep striving for some-
thiag better. For example, in 50 feet, it goes�up 20 feet.
Mr. Myhra asked what kind of topography is at the southwest corner.
Chairman Jensen said it was low and it has a draw. Darrel Clark said Mr.
Zander, who owns the property to the west, is in agreement with Mr. Hubers.
If the street went through, Chairinan Jensen said, there will be an
enormous cut below Zander's house. Mr. Julian Johnson had been asked to
try and see if he could get cooperation in order that his plat could be done
in a different fashion that would not demolish all the wooded character of
the property. Apparently he had no more success than the people did in 1962.
� It was felt a north-south road was the answer to the property. Chairman
Jensen.said the property south of Worrel's levels off to a great extent.
If we proceed with the Southhampton plat, these two are compatible. It was
mentioned that this proposed plat fits into the Rice Creek Road/Central Avenue
' street p1an.
The petitioner was asked if he would have any objections to running
McKinley Street through all the way to the south line. He said he would work
with Mr. Johnson. The road pattern was discussed, but no action was taken.
Chairman Jensen said that with cooperation and coordination with Julian
Johnson a very fine development should result.

Streets & Utilities Subcommittee recommend approval to the Planning Couunission
of the Preliminary Plat, P.S. ��69-02, Amber Oaks, David Hubers, of Lot 4,

recommending to them that McKinley Street, now ending in a cul de sac, be
extended further to the south end of the property line thus enabling the
development of the land to the South, providing that agreement is reached

The area is 4.3 acres and the reason for asking for a split is that he has
a buyer for the East one half. Mr. Jensen asked if he realized he would be
landlocking the land on the West end.
Chairman 3ensen fihen explained the study for the Council of 73rd Avenue
and 732 Avenue.
Mr. Mortenson was informed he could take out a building permit for one
building on the land the way it is now.
Mr, Crowder asked what were the items of concern between M.r. Mortenson
and the Subconuuittee in splitting this property? Mr. Myhra said if they
O.K. this split, Mr. Mortenson has a problem with Lot A in that it would be
landlocked. There was a discussion of contacting Pete Rrook regarding a
service road which would connect to Fireside Drive. Mr. Mortenson agreed
to contact Mr. Brook.
The Subcomanittee set the next two meeting dates: one for Ma.rch 20, 1969
and one April 17, 1969.
MOTION by Myhra, seconded by Zeglen, that the Plats & Subdfvisions-
Streets & Utilities Subco�nittee table for further consideration until
Ma.rch 20, 1969, the Lot Split Requsst, L.S, ��69-09, Sheldon A. Mortenson,

Mr. Fred Donaldson repxesented the Highland Park Development Company.
The Engineering Assistant explained that there were six lots with three
different zones: Lot 5 is commercial, Lots 2, 3 and 4 are multiple, and 1
and 6 have a special use permit for a nursing home. The reason for the odd
shaped lots is to gain proper amount of square feet.
Mr. Donaldson said that nothing was planned for Lot 6. They have the
special use permit, approved in November, 1968, but not issued. Council
also approved the two 34 unit buildings. When asked about the parking
arrangements for the nursing home, Mr. Donaldson said they tried to get it
as far away from the nursing home as possible.
Darrel Clark brought up the fact that should Lots 2 and 3 evex have
di€ferent ownerships, Lot 2 would need an easement to get up to Osborne Road.
Chairman Jensen suggested that all easements be indicated on the plat which
�,.1 would eliminate tfie necessity of preparing deeds and recording them.
On Lot 4, proposed apartment, it was noted there was 50 feet between
the West property line and the facing of the building. They felt this was

just adequate for driveway and parking. There would be only a 5 foot space
to park cars across the front or length of the building. It allows for 14
cars.
Mr. D�naldson said all the land is vacant now. There are some trees.
The commercial piece has most gf �h�m.
Also, it was mentioned that water is on Osborne, sewer and water on
Madison and Lyric Lane.
MOTION by Myhra, seconded by Crowder, that the Plats & Subdivisions-
Streets & Utilities Subcammittee recommend approval to the Planning Commission
of the Pxeliminary Plat, P.S. �69-03, Maple Ma.nor Addition, Highland Park

400 feet of the West 217.8 feet subject to the Final Plat providing adequate

Chairman Jensen explained that, inasmuch as Mr. Walquist could not be
present this evening and had asked that the Subcommittee act on the item
tonight, he would give a brief resume. He said Council had requested that
1�Ir. Walquist provide additional parking space for the mortuary. There is
a 20 foot north/south easement on the East side of Lot 4 which would be
used fox the driveway from the mortuary to the propased parking lot. Darrel
Clark said he received these easements today; however, one of the deeds has
not baen filed yet.
MOTION by Myhra, seconded by Crawder, that the Plats & Subdivisions-
Streets & Utilities Subcommittee recommend approval to the Planning Commission
of the Lot Split request, L.S. ��69-01, George L. Walquist, of the North 1Q0 feet
of Lot 4, Herwal 2nd Addition, subject to filing the necessary easements for
the road connecting the mortuary property with parking facilities. Upon a voice

DIRECTORFS REPORTS
A recreation activities participation survey was explained to the
Commission by the Director. The School District #14 school board
rec{uested this survey and also felt that greater supervision
should be supplied when the recreation department is using the
school�s faciliti,es. Player'�s Passes have been passed out to all
of the participants 3n our programs which involve the schools.
Also a member of the school personnel has been hired to supervise
the school in general when it is being used by our department.

Parks and Recreation Memorandum and the February Parks Work Progress

DEVELOPMENT OF WEST MOORE LAKE - ROTARY CLUB
Mr. Robert Minder, President o£ the Rotary Club, spoke to the
Commission and offered any available help in developing West Moore
Lake by the Rotarians, The Commission has given this completely
undeveloped park a hiigh priority, Mr, Minder mentioned that
although not a great deal of help can be offered financially, it
is their desixe to donate services within the Club along the lines
of planning, movin� dirt, planting trees, sodding, hand labor,
etc, The Chairman thanked Mr. Minder and the Rotary Club for
their generous offer,
COUNTY COMMISSIONERS - MR, HARVEY PETERSON AND MR, AL KORDIAK
Mr, Ed Braddock, Park consultant, briefly explained his plan for
^ the development of Riverview Park for the benefit of Mr. Peterson
and Mr, Kordiak, Mr, Kordiak stated that in order to allocate
money for developing a parcel o� land, the County requires that
the parcel is only approximately 14 acxes, if it were developed
as a boat launchii�g area, it would receive much inter-municipal
use since tfie first such area South of Anoka is located in Camden.

d'eveloping of Bunkex Prairie Park as a majar county recreational
facility. They have discussed the'possibility o£ eliminating
the County Fair and developing this area into a major complex
that could be used the year around instead of only 3 days of the

�Ir, �fomer Ankrum, City Manager, presented to the Commission, a
Five Year Comprehensive Plan Draft that has been written by the
Director and himself, It contains descriptions of Fridley�s
physical features,, existing park facilities and proposed parks and
�ecr�ation facilities, in addition to charts and maps showing
income statistics for Fridley, taxable valuation and millage rates,
population and growth, capital improvements program, etc. He
rec{uested the Commission analyze what they want tio do in the
next five years and camplete the plan, This plan is needed as
soan as possible by the administrators of the Housing and Urban
Development so that they can start processing the applications
for aid sent to them in 1968 by Fridley,
CHAIRMAN'S REPORT
Chairman Fitzpatrick reported that the Parks and Recreation
n Department has received many offers from various clubs and organ-
izations to help either £inancially or physically in developing
our parks or in the betterment o� the recreation programs, The
Commi,ssion suggested that a list be made up of the areas where
help can be used, and that it be made available to inc{uiring groups.
PRELIMINARY PLAN �OR 1970

Member Stimmler reported that he has studied the Minneapolis
Park Board Ordinance Book and finds that approximately one-third

Member'Stimmler have agreed to study th'is further and report at

h[ARMING HOUSE
Chairman Fitzpatrick described to the Commission the action taken at the last
City Council meeting authorizing the moving of Schroer's Market Building to
The Commons Park to be used as a warming house during the tiVinter month. The
following description was read aloud to the Commission; "The Council received
the minutes of the Parks and Recreation Commission meeting of February 24, 1969
and approved the Parks and Recreation Department expending $700 for the building
from within allocated funds. A request for txansfer of funds to be submitted
to the Council indicating what is to be reduced in order to purchase the build-
ing and change in budget program necessary." Further discussion was involved
in additional expenses for heat, lighting and general reconstruction.
MOTION by Cochran, seconded by Donlin, �� decline the offer of Robert Schroer
with regrets and thanks, but with the lack of budgeted funds to move the struc-
ture and to put it in necessary condition as required it becomes impossible to
accept the gift. Further, the subject of warming house facilities should be
brought up for Commission action at the time of the 1970 budget considerations.
The Motion Carried.
REZONING - TAX FORFEIT
�- Chairman Fitzpatrick informed� the Commission of the Planning Commission meeting
of February 27th where they red tagged tax delinquent property. They are:
Auditor Sub. 92, Lot 41 Auditor Sub. 92, Lot 48
Auditor Sub. 92, Lot 47 Auditor Sub. 92, Lot 52
These parcels have been recommended to the Council to be withheld from public
sale by the County for one year. They will be reviewed by the Commission for
park consideration.
SCHOOL FACILITY USE
The Commission discussed the article appearing in the Fridley Sun Newspapers of
February 26th pertaining to use of school facilities by the Parks and Recreation
Department. The Commission directed the Chairman to confer with the City Manager
and submit a written communique to the City Council.
FRIDLEY YOUTH FOOTBALL ASSOCIATION - HOCKEY ASSOCIATION OF FRIDLEY
MOTION by Donlin, seconded by Blair, that the Commission request an organizational
meeting with the Board of Directors of the Fridley Youth Football Association at
our Regular March meeting and another organizational meeting with the Hockey
Association of Fridley's Board of Dixectors in September. Subject: Review agree-
ments, procedures, regulations, facilities, duties and responsibilities. The
Motion Carried.
^ VOLLEYBALL CHAMPIONSHIPS - Letter �
MOTION by Cochran, seconded by Blair,to receive letter from the Volleyball Club
of Minnesota, further to move that the City Co-Sponsor the Gopher State Champion-

In 1959, under the autihorization of the City Council Resolution
#82-1959, we conducted a comprehensive study of the existing
sanitary setiver connectian system of the City of Fridley in
accordance with conditions as existed on April 1, 1959• Your
attention is calZed to this report entitled "Comprehensive Study
and Report on Existing Sanitary Sewer Collection System."
You will note on Page 27 a compilation of figures entitled "Flow
Tabulations", and in particular, Line "F", which is the East
River Road Trunk Sanitary Sewer. The check point entitled "F-2"
is representative of the conditions which you and the Planning
Commission are concerned cvith at this time. You v��ill note the
pipe capacity at this check point is.1.65 cfs and the future
ultimate peak flour is estimated to be 2.034 efs. You will note
in reviewin� the above referenced report that the system vras
analyzed on a cannection basis. For purposes oi reviewing check
point "F-2", a fi�ure of 800 gallons per connection per day was
used as the rate determining factor for peak flow calculations.
You will also see that the report recommends,.for purposes of
future design of facilities, that a higher rate be used to
determine peak flow calculations.
Since the submission of the 1959 report, Fridley Sanitary Sewer
System flows have been analyzed for submission to•the North
Suburban Sanitary Sewer District on a basis of zoning and
applicable f1oUr rates for various zoning classifications. It
should be noted that the C2S zoning flota rate is approximately
125� of the R-1 zoning, and the R-3 zoning is approximately
210� of the R-1 zoning. Should the North Sutaurban Sanitary
Sewer District proposal for the construction of interceptors
located along the Easterly railroad right-of-way become a reality,
provisions can be made in the future to alleviate any overloading
of the East River Road Trunk Sewer by constructing relief sewers
from the East River Road Trunk Seurer to the North Suburban Sanitary
Sewer District interceptor.

the pipe capacity of the 24" trunk seurer at the South extremity
of the City to be 6 cfs, and the estimated future ultimate flow
at that point is 15.6 cfs. In this connection, it shoul.d be
noted that tYie future ultimate flow� does not include the area of
Fridley, South of Highway #100 and tir�est of the Great Northern
Railroad. The Norihern Ordinance, Minneapolis G7ater Plant and
PRunicipal Liquor Store 0utle� No. 3 are now discharging sa.nitary
sewage to the City of Niinneapolis directly under separate agreements.
The conclusions and recommendations contained on Pages 30, 31 and
32 may be of interest to the Planning; Commission.

The meeting was called to order by Chairman Bill Jensen at 7:30 P.M.

1. FROPOSED PRELIMINARY PLAT: P.S. �69-01. BRENTWOOD ESTATES, THOMAS R. SWANSON:
The rear 431.6 feet of Lot 35 and rear 401.9 feet of Lot 33, Revised Auditor's
Subdivision No. 77. (Approximately 2.5 acres) Owner: Mrs. Edith Hale.
Mr. Swanson was present to repxesent the petitioner.
Darrel Clark explained that this �rea was studied as early as 1961 and
that at that time, the east-west street (72nd Way} right of way was set
at SO feet and was approved by the District No. 14 School Board. However,
no easements have been acquired from them to date._ Also in 1961, a street
plan was approved that is the same as the preliminary plat we are now
reviewing.
The 72nd Way right of way was again discussed in 1966 with reference
to a proposed house to be built on Lot 3, Block 1, Mississippi View Addition.
At that time the minutes indicated that a total right of way for 72nd Way
could be narrowed to 40 feet. In the plat of Riverwood Manor, 30 feet was
dedicated leaving l0 feet to come from the north of which 9 feet has already
been dedicated leaving 1 foot more yet to be acquired from Lot 3. The owner
of this lot, Gordon Sangster, was in today and explained that he would give
the additional foot or two needed to bring the total to 40 feet.
I apoke with Jim Hedren of School District ��14 by phone and he indicated
he thought the school would be agreeable to dedicate property for some
additional right of way and Council is meeting �aith the school board next
Monday and will discuss this further at that time.
It was also mentioned that the feeling in the past was to close off the
access to East River Road as it enters on a curve and, therefore, is hazardous
to negotiate. '
Mr. Swanson presented his proposed glat and when asked whether adjoining
property owners were in agreement with this proposal, stated that the owner
of Lot 34 was against the plat and that the owner of Lot 31 wanted to sell
his property to him.
The Subcommittee noted that street_r.ight of.way would be necessary from
properties outside the area being platted. The Subcommittee also saw need
for a utility easement to be extended from the cul de sac to East River Road

MOTION by Myhra, seconded by Crowder, that the Plats & Subdivisions-
Streets & Utilities Subcommittee recammend to the Planning Commission approval
o£ the Preliminary Plat, P.S. ��69-01, Brentwood Estates, Thomas R. Swanson,
with the stipulation that a 20 foot utility easement be provided from the
cul de sac to East River Road. Upan a voice vote, all voting aye, the motion
carried unanimouslq.
The Subcommittee again noted tteat street right of way outside zhis plat
would be necessary for lots in this plat to gain public access.

The audience were informed that this recomnendation would go to the
City Council on Monday. The Council will or will not set a public hearing
date. The petitioner may desire to continue it and he has that privilege.
He may decide to withdraw.

Mr. I�omchilovich brought a plan of the area for the Plaaning Cammiseion
to study.
Eugene Lang, 1132 Mississippi St.: His home is on the South side of
Mississippi Street and he has lived there 20 years. He asked if the property
North of Mississippi is zoned R-1, single family and wondered if coamercial
would be requested.
The Chairman said there has been no request for anything other than
what is requested now. Mr. Momchilovich discussed his plans with Mr. Lang.
MOTION by Mittelstadt, seconded by Jensen, that the Planning CoQmission
close the public hearing, ZOA ��68-11, Louis Momchilovich, of the Weet 47 feet
of the South 120 feet of Lot 10, Auditor's Subdivision �88 to be rezoned
fram R-1 to R-3A. Upon a voice vote, all voting aye, the motion carried
unanimously.
MOTION by Jensen, seconded by Mittelstadt, that the Planaing Conmiesion
reco�nend appraval of the rezoning request, ZOA #68-11, Louis Momchilovich,
of the West 47 feet of the South 120 feet of Lot 10, Auditor'a Subdivision
�88, to rezone from R-1 to R-3A as it being the logical expanaion of the
R-3A zoning previously granted to Mr. M�omchilovich allowing him to make
better use of his property, and subject to the signature of the fee owaer.
Upon a voice vote, all voting aye, the motion carried unanimously.
The Chairman stated that the Planning Cammission should have the signa-
ture of the fee owner since Mr. Momchilovich does not have the title to
this property.

^ Mr. Swanson was present and stated he would be $lad to answer any ques-
tions. He distributed maps to the Conmission.
The Plats & Subdivisions-Streets & Utilities Sub�co�ittee at their
meeting of February 6, 1969 recommended approval of �he Preliminary Plat
with the stipulation that a 20 foot utility easement;be prwided from the
proposed cul de sac East to East River Road.
Mr. Swanson volunteered he was not able to contact both parties for
the easements as yet.
Benedict Novak, 115 71st Way N.E.: He said he o�med Lot 34 which wae
south and west of the proposed preliminary plat. He has access to his
property over a small road maintained by the school fpr deliveries to
their building. He was worried about the assessments because of the south
and east frontage.
Darrel Clark said the school had sewer and water along the south line
for the school which is not used by the residents in that area. If they
used the lines, they would be assessed. He had talked with Jim Hedren
who stated this idea was brought before them in 1961 q�f dedicating more
right of way. The school board now would like to see a topog map before
final approval.
Chairman Erickson asked the Novak's if they plan,to divide their lot
and would the proposed preliminary plat fit in with tlneir future plans.
^ Mr. Novak said he did not know how �uch would be takem off for a road. If
the proposal was for 25 feet, the south side of his lot is the front yard
and would not leave him enough land.
Mr�c. Novak said they come in off East River Road on what used to be
71st, but now it ie not exactly a street but an easem�nt. Mr. Jensen said
the school board plows this easement to get supplies into the school.
Mr. Novak asked if he could have the cost of street, curb, sewer and
water.
Darrel Clark told him if his property were divided into two lots facing
72nd and the present house facfng the proposed north-south street, sewer
and water would be assessed on frontage only. The st�eet would be assessed
along the frontage and one third on the aide yard. H�s lot may be large
enough to divide into three parcels.
Mr. Novak said the street is 100 feet from the hause and if you took
anything more off for the street, there would not be e�nough left.
Mr. Jensen told him that, depending what the acti;on of the school board
is, it might not be necessary to ask for any additional right of way on the
south side of his lot. Thexe was a short discussion regarding the present
cost of assessments.
� The people living north of the proposed plat said they bought their
property becauae they did not want to live in somebody;'s backyard. They
couldn't afford more taxes either. The wells and cesspools have given
th� no trouble.

Mr. Myhra said one of the questions to be answered wa�t that of
utilitiea. Darrel Clark said he did ct�eck the capacity of both sewer aad
water and there would be �o pxoblem serving a complex of this multitude.
Mr. l�yhra added that the#ce wae eao� question about part of this land
being deeded to the Gity for p�xk, and asked if the Planning Coirmission
ahould be taking aay k�d of pf#icial actioa on this until they had some
feeling from the City i� this fi�gard as the petitioner ia willing to deed
it.

that the creek bottom be main�sined in its present form. It ehould not be
� filled and no structure ehould be allowed to be built an that creek bottom
where it would impede the fl�rw of wa�er. This chaanel ie required to carry
the water. It ia reallq a trench because it ha8 been eroded fram time to
time. There follawed e discusa�,on of the elevations of the creek. Clark
aaid that looking at the �opog, Central Avenue is 863 feet above sea lrvel.
The Conmission discusaetd allaw��pg the rezoning of the land North of the
creek aad keeping the Greek bpttom and bluffa in their existing condition.
At this point, Mr. No�dstrom was aeked to briag up his plane for dis-
cusaion and etudy.
The Co�issicnc� took an infoXmal poll of the n�embers to determine what
the feeling was as to the rezonipg i,tself being proper. Mr. Myhra said he
wa� not really pleased with the �ayout of the auggeeted apartment complex.
He added it does seem we have a,n area about as ideal for multiples as we
are going to fiad what wiCh Onan's on the north. Chairman Ezicic�on agreed.
Mr. Jeasen wondered about the raad along the New Brighton side. Darrel
Clark said a road would not serve auy more lots, but would carry traffic
from one side of the cr�ek to another. He had not heard of any plane to
extead Stinson Bauleyard.
A discussion of the watexshed area of Rice Creek was asked by Mr.
Jensen. A dam could be put it1 to hold the water up aad a paqd near Central
Aveaue. The report of �h� floqd plain informatian survey, which will be
done by the Corps of Ea�in�ers, wil,l be ready by the first of July. Mr.
� Aakrum said that la�t year we w�xe not included, but naw we should be the
first one this year.

� Continui�g, Mr. Jensen said he thought it is important for the City to
acquire creek bottoms when available and without being concerned by usefulness
as developed park. In the opinion of the Chairm�aa, the City should acquire
bottom land, but not necessarily for park purposes.
In answer to the question of the constzuction schedule, Mz. Nord�tram
said he had been to City Hall a number of times and is ready to go ahead --
fiaancial cammittnments have been made.
Chairman Erickson said that in order to get aomething moving, he would
suggest that the property south of the 860 contour line be deeded to the City
aad that no constructioa of residenti$1 buildings be allawed below the 880
line. The City would be provided with access easements needed fram the
property.
One of the objections by Mr. Myhra was the use of auto�wbile parking
all the way around the complex for a buffer. Mr. Nordstrom said he would
work on that.
It was felt that a slope eas�t should be requeated ao that the 20 foot
vertical bank of the creek would not be diaturbed and that the area north of
the 860 be the zoniag boundary. This would amount to about lOT. of the whole
area. Darrel Clark wondered if thia could be handled by agreement rather
thaa easement.
I�TION by Jensen, seconded by Fitzpatrick, that the Planning Coomission
� recommend approval of the rezoning request, ZOA #68-13, Hamaerlund Enter-
prises, Inc., Clarence Nordstrom, Applicant, of the North 903 feet of the
East 3/4 of the NE� of the NE� of Section 13 (Parcel 10 and 200) to rezane
from R-1 to R-3� subject to the followiag conditions: That the petitioner
agrees to sell to the City of Fridley the remainder of the total parcel South
of the North 813 feet for the sum of one dollar and other considerations as
pre�viously offered and that an easement be pravided aver the South 160 feet
of the North 813 feet for purposes of maintaining slope and that a euitable
access easement be provided to the previoualy mantioned parcel which the
City is to acquire, location to be negotiated between the owner aad the City.
The Planning Coamission does not feel that the plan se presented ia necesaarily
a part of this action. It was noted that the petitioner should be granted
eaough land to acco�odate 312 apart�neat units at 2,500 s�are feet per unit.

Mr. Thayer said it was very difficult for him and Mr. Sangster to make
^ a decision regarding the giving of an easement for road purpoees. The
echool site of Riverwood School is rather emall and the property has to be
utilized to the fullest. Aay amount they would dedicate to the City would
reduce the playground area. They would have to knaw what the specific request

Mr. Thaqer said the easement to the north of the achool wae used for
delivery trucks. If the deliveries came to the front door, they would have
to be carted to the back.
The Chairman said he did not eee haw the Planning Coamission could allow
a plat of this type to go in if there were no way to get to it.
The members of the school board requested a topog map for their study.
Thep requeated the matter be held up until March llth, the next �eting of
the school board whea Mr. Hansen will be back in ta+n. They asked that the
8ngineering Department make an approximation as to haw the property will be
a:seased.
It was explained by Derrel Clark that there would be more work imolved
ia detesmining asseasments than the topog map. It would be very difficult
to malce an aesessment figure. There was a discussion elaborating aa this
problem.

treated as thep would any other property owner.
The School has already put in water and sewer services.

Briefly, Gt�der R. Anc�erson and his wife, L�lores A. An�3erson, own or
� are the aontract for laeed purrhas�rs of Lots 1, 3 anci 4, Bloc�c 2, River-
weod Manor. Mr. �ndersan is also the purchaser of other lats in that
area. San�time ago, Mr. Ander�on started aonstructian of a cka�lling on
Lot 3 and, d� to an error in the surv�y, the north edge of the foimrlatian
was plaoed fotar feet north of the south line of Lot ?.. With the fi�t�
foot sic�e Yard requirenent the total error a¢nou¢�ted to nine feet. The
o�st of oorrecting this error ses�ed prohibitiv� so � Agreement was
entered into between the Andersons and Rdaert G. DeVries and Janet De�Iries,
ar�ntract purdlas�r� of sai.d Lot 2 and betc�en the Anc�ersons and Jaa�ul.yn
J• Banbuiy and Eldonna I. Doerr, fee owners of said Lot 2, whereby the
s�uth nine feet of said Lat 2 was oanveyed to the Andersons and the
Anc�rsons oonv�yed the south nine feat of Lot 1 to the fee cxaner of said
Lot 2. The G�tract purcilaser and the fee awner then anended their
Contract for I�ed to include the new descriptian.
Sinoe the Anc�rscns a,�m Lot 4 and the agrn�rnent �ertaining to the
a�nstructicm on Lot 3 and the sale of Lot 3 call for an 85 foot frontage,
Mr. Anderson wishes to attach tfie south 9 feet of Lot 3 to Lot 4. Actually,
the ovarall f�ntage has nat be�n disturbed, there has just been an in-
ternat reaxramgement.

Qn Sunday February 16, 1969, Vallep View Christian Church held a congregational
meeting to discuss the Church's position regarding the proposed zoning change
of the Acres Inc. property bounded by Va11ey View Christian Church on the west,
Interstate 694 on the south and Silver Lake Road on the east.
During the meeting considerable discussion took place concerning the rezoning
to the "planned development" cZassification. The following resolution was passed
:,� by a unanimous vote:
,�, "That the Valley View Christian Church go on record as opposed
ta the proposed zoning change to planned development because
the proposed change may cause traffic conditions such that our
various Worship Services will be disrurbed by the increased
traffic flow."
"Also since the property is locked in by existing developed property
and by the Interstate, the traffic patterns to and from our church
will be almost impossible for members to easily arrive and depart
from church. The bottleneck at Central avenue, Highway 65 and
Hathaway Street.will possibly be a cause for increased traffic
accidents. We at Valley View are concerned with these traffic
� patterns."
We at Valley View want the City of Fridley to grow - for as the City grows so do
we. We feel that the present zoning of this property is still adequate for the
future growth of the City of Fridley.
