Mr. David R. Hubers and Mr. Julian Johnson were present to discuss the
� platting.
Mr. I-It�bers ciis�l�yed two ma.ps, the one being the original Amber Oaks plat
and the other the Revised P.S. �69-02 combining the original proposed Amber
Oaks plat and the proposed Southhampton Second Addition by Julian Johnson and
at the suggestion of the Plats & Subdivisions-Streets & Utilfties Subconmittee.
. Darrel Clark said that the hearing w�s advertising just for the northean
part (Amber Osks), aad in order to approve the new combination� the revised
proposed plat would have to be advertised again in order to include the
additional property by Mr. Johnson. Mr. Hubers asked if there was any possi-
bility of waiving that requirement and he was in£oYmed there has to be a hear-
ing. Mr. Hubers was asked to get the names of the people within 300 feet of
the south paxt of the p�oposed plat.
The Engineering Assistant listed the reco�endations of the Subcae�ittee
as follows: recomariended that McKinley Street, now ending in a cul de sac, be
extended further to the South thus enabling the development of the land to
the South. The street pattern would be mo�e favorable to the terrain in both
areas if this were followed.
Mr. Julian Johnson said it was his desire to plat the property in this
fashion. Darrel Clark informed the petitioners the earlieat public hearing
would be April lOth.
Mr. and Mrs. Zanders asked to see the proposed plat. She said ehe felt
^ th�y k�ad axot h�d enough time to study the proposal. She asked hvw long it
would take after the plat was apprwed and then to get w�ter and eewer in.
It was not possible to answer that question.
�hairman Erickson said that if the Planaiing Co�ission felt the matter

The Public Hearing Notice was read by Chainnan Erickson. Exhibit "A",

Mr. Fred Donaldson said he had no conments to make other than he brought
a picture of the proposed nursing home.
Chairman Erickson explained that it was a plat they were considering thie
eves�ing, not what was being proposed to be builte Darrel Clark added that

it was split into foux differen� Uses, clin�.cal, proposed nuraing home in R-1
under a special use permit, multiples and comm�rcial. The plat, as submitted,
will include commexcial, nursing home and apaxtment portions. The petitioner
made application £ox one apart-ment and the Council has graa�ted a�a��eit for
on� apa�^�ee�ag b�:�3 dn.ng, and they are not going �o issue ano�h�r peranit until
the pla� i.s approved. The plat has gone through th� Subcom�itteea 7.'tie p��s�
will show utility easements and drive easeanents which are not defined yet,
but will be on the final plat.

The Board made a few additional sug�estions as to how the asthetics might be
improved by using a little imagination and flipping the plan over.

Mr. Guzy explained to the Board that the building coneiets of three etallg.
Mr. Eotvo� would be occupying the third atall furthest from the aervice roed.
The other two atalle are not in uee at this time. There ie trouble in finciing
tenants as the building doea not face IIniversity. At the time the building
wae being bu�lt, the City Council requested ths�t it face South inetead of
facing IIniversity. Mr. Eotvos will have a five year leaae with ue and he
intends to do light body work only and not major overhauling.
Mr. Harris: Ae I underetand there will be no.outeide etorage.
Mr. Eotvos: I'm going to be real careful to not have any atorage outeide that
will exceed 24 houre. I want to keep it nice and neat as I want the ouetc�er8.
The only reetrictions covering this building in a CR-2 zoning are Section
45•�02, Paragraphs 7 and 9. Paragraph 7 covers; "Storage. All raw msterials,
eupplies, finiehed or aemi-finished producta and equipment ahall be etored �
within a completely enclosed building.", and Paragraph 9.covers; "Performance
Standa.rde. Uses which, because of the nature of their operation, are acao�psnied
by exceeaive noiae, vibration, dust, dirt, emoke, odor, noxious gsaee� glare or
wastee ehall not be permitted.". �
Mr. Harrie abetains from this item on personal reasons.
MOTION by Minieh to close the Public Hearing.

Mr. Adame wae seked why he couldn't move his houae any further back than 45 feet.
He anewered that he would be over the bank.
Mr. Belgum; � am speaking for Mrs. Hartman and myself in saying that we eugport
the propoeed location of thia house. We think it would haxmonize very well with
the housee tha.t are already there. Also, when we built our home, we were allowed
to build very close to the property line and it would loak better if you would
allow Mr. Adams to build closer to the Weat property line. We were allowed to
build close because of a diagonal s�orage easement on our property.
Harris: Have you talked to your neighbor on the other side.
Adama: The homeowner has talked to them and they have no objectiona.
MOTION by Minish to close the Public Hearing.
Seconded by Ahonen. Upon a voice vote, there being no nays, the motion carried
unanimously.

That if th� ave�age front yard set back of the prape�ty within 100
feet o� each side of the p�operty in question is not �or• than six
feet greater or six feet less than the required set back the� the
set back for the property in question shall not be less th.an this
average set back of the p�operty within 100 faet on either side of this
property. For exaaiple: if the required set back is 3$ fest and the
average of the prop@rties on either side of the property i� question
, is within the ra�g� of 29 feet to 41 feet, then the set back for the
p�oparty in question �ay not be less than the average of the
p�operties within 100 feet of the property requesting the set back.
If, on th• other hand, the average of the propertiea on either side
of the property in question be more or less than the 29 feet to 41
feet �at back, assuming the exan�ple above, the� the watter should go

Hearing of the Planning Commission of the City of Fridley'

he wauld be glad to give same. He wondered if he should hold up his request
for awhile. If he platted the land, giving a 30 foot east-west easement,
he would fall in the category of setback problems.

R�ferring to-the 20 foot streer, Mr. biortenson 'said it actually is not
a service road, it is just a driveway to the property until such time a
road would go through with a"dead end" to that property. '
�MQTION by Myhra, seconded by Crowder, that the recommendation of the
Plats & Subdivisions-Streets & Utilities Subconunittee for the Lot Split
request, L.S. �69-09,,Sheldon A. Mortenson, of the 140 feet North of the
North property line o€ Central View Manor, Block 1, beCween T.H. ��65 and
Central Avenue, does not, in the judgment of the Subcananittee, meet the
requixements of a lot split, but would be a satisfactory plat, the Subcam-
mittee recommends that the petitioner present such.plat to the Planning
Couani.ssion, and that, further, the Subcommittee recommends approval of said
plaC subject to a frontage road to the north or south along the west edge
of said plat and e�iting onto a public street; th� petitioner to pay the
$10.00 additional fee fox platting. Upon a voice vote, a11 voting aye, the
motian carried unanimausly. .
The Engineering Assistant suggested Mr. Mortenson wait a cauple of weeks
before presenting his petition.
PROPOSFD PRELIMINARY PLAT: P.S. �69-d4, EAST RANCH ESTATES 1ST ADDITION,
ROBERT SCHROER: East 621.87` of that part of NW� of h'W�, as ineasured along
the North li.ne thereof of Section 11, lying northerly of centerline of
Osborc�e Road, subject to portion taken for T.H. �47, Osborne Road and St.
Paul Watexworks easement.
Mr. Robert Schroer and Mr. Richard Harris were present.
Mr. Schroer said that when he brought the original plan, the storm sewer
went through on 78th Avenue. �
Mr. Harris was interested in the ditch as his plat, Onaway Park, lies
west of the pxoposed plat. He said they thaught if the storm sewer was
brought down 78th Avenue, where there is a platted street, then there would
be no need for easements in the Onaway plat. Darrel Clark said it would be
better to go right down the street.
Chairman Jensen suggested at this point that P.S. ��'69-Q5, East Ranch
Estates 2nd Addition be set aside and the Subcommittee consider P.S. ��69-04,
East Ranch Estates 1st Addition.
Darrel Clark said the. St, Paul Water Works easement contains an air vent
which will cost $1,350.00 to remove. This lies in the service drive. An
Agreement between the City and the St. Paul Water Commissioners will probably
state we will have to pay for the removal of the air vent and other conditions
as far as the road construction is concerned. The costs Grill pxobably be
borne by the plat in the improvement costs. Chairman Jensen noted the service
drive all the way up the east edge and said it will be dedicated in the plat
itself. Darrel Clark added that the reason why they are having two plats
is in the gurchase of the propexty, two�different fee owners are involved,
and rather than get mixed up in title problems and signatures, it was
decided to have twa plats. _

Mr. Schroer explained that the ranch ar�hitecture theme would be used
on the service drive on University Avenue frpm 77th Way to 79th Avenue.
The proposed Block 1, Lots 1, 3,6 and Block � are zoned industrial. Lots 2
and 4, of progosed Block 2, are in the futuri� fnr rezc�ning to commercial
when they came in for platting, and part of �.ot 5 is also to be rezoned.
Lot 1, Block 3 will also be zoned commercial, 77th Way will have half of
it dedicated on the glat. 79th Avenue is on the North. They felt the roads
shown were sufficient at this time, as they �did not want to encourage mixing
industrial and commercial traffic.
Then followed a discussion about a possible crossaver at 79th Avenue,
althaugh there is an access there now. The North Suburban Sanitary Sewer
District has an easement on 79th Avenue. Darrel Clark mentioned that the
service drive has a watermain. Mr. Schroer said Comstock & Davis are
dropping a test well and he has agreed to gi»ve the City permission to put in
the test well. ,
Mr. Ric�ard Harris referred to the property they own and the problems
connected with developing them. They get a deluge of water fram Spring Lake
Park. The ditch cannot handle all of it. A proposal was made to have an
open ditch, partial closing of �he ditch, a� comgletely closing it. Chair-
man Jensen said there is certainly a proble� in putting in a storm sewer up
thexe. He felt it would be more desirable and econornical to run a pipe
that went in a straight line. Mr. Harris said if the ditch were abandoned,
and moved it to 78th Avenue, you would be adding at least anothex 200 feet
of pipe. Mr. Myhra wondered if the proper�y owner on proposed Block 1
would be assessed if.the ditch went through it, There would be no difference
as ft would not change the drainage boundax}r. .
Chairman Jensen asked Mr. Schroex if h� wuld adjust the lot lines to
line up caith 7$th Avenue. Block l would �avre ta�move north about 138 feet
to center it up with the street. Mr. Schro�r said he believed he would
split it into four lots. Chairman Jensen s�id he thought there were advantag
fn going to smaller lots,�rather than combi�ing two or three the othex way.
The Ghairman told Mr. Schroer if he split i�to four lots, he �aould have 12
acres or more. That would eliminate asking,for lot splits later on.
Mr. Harris asked if there were anything in the new code as far as the
amount of buildings per square feet. He was thinking about a two acre parcel
You could put about 30,000 square feet of buildings there. Darrel Clark said
on the newer plats theYe is a limit of the size to tracts about one acre.

going to utilize the 1and. We are gaing to want it 12,000 square feet in
area and we have to have a large water supply because of the sprinklers,
and we would want the pipe large enough the first time. We will be short
of water if we don't act now. �
Chairman Jensen said that if`that easement went straight across
Univexsity Avenue over to 78th Avenue, the other easement would have to
move down about 33 feet south. It would make Lot 5 worthles,s and Lot 4
even more so. Then that line could go across square with 78th Avenue.
It was mentioned that Spring Lake Park has an outfall that opens in the
highway ditch. He added it looked like it wouldn'C line up perfectly
square from 18th Avenue to Onaway -- chances are tremendous it �,rould not
line up. It is not•an industrial adjustment. It makes sense to make it
square through Fridley and make the ad�ustment in the highway right of way.
Darrel Clark asked Mr,Schroer if he had any reason for not dedicating
a street right of way making it 33 feet instead of 3�1 feet. It would give
more for boulevards if 79th Avenue would become a State Aid street.
Richard Harris couanented that if the City would want two feet from
$ob Schroer, they would want two feet from him, and then he would have to go
to the Board of Appeals for a variance because of the size of his lots.
Mr. Schroer said he would not mind it on 79th Way.
MOTION by Crowder, seconded by Myhra, that the Plats & Subdivisions-
Streets & Utilities Subcoirnnittee reco�anend to the Planning Co�nission
approval of the proposed preliminary plat, P.S. ��69-05, East Ranch Estates
2nd.Addition, Robert Schroer, of the SW� of the SW� of Section 2 subject
to portion taken for T.H. �47 and subject to easement for sanitary sewer
purpases over the South 33 feet thereof, subject to the following stipulatio-
that the present 30 foot easement shown for 79th Avenue be changed to read
33 feet; the east-west storm easement as shown on the plot be changed to '
run more directly with 78th Avenue an the west such that this storm sewer
easement runs predominately east-west through the property. Upon a voice
vote, all voting aye, the motion caxried unanimously.
4. LOT SPLIT REQUEST: L.S. �69-10, CUS��IAN K. D. MINAR, JR.: Westerly 20 feet
of Lot 2, (front and rear) Block 2, Innsbruck 5th Addition. Purchased to
add onto Lat l, Block 2, Innsbxuck 5th Addition.
Mr. Minar was unable to be present.
Da.rrel Clark stated Mr. Minar's house is on the carner lot and is
crowded at the rear of the lot. Lot 2 is presently owned by Rodney Billman.
. He talked to him and Mr. John Johnson, president of Acres, Inc. Also, a
� letter was xeceived from their attorney that it was agreeable with all
parties that Lot 2 be divided. The remaining dimensions o£.Lot 2 are 85' x
130'. Chairman Jensen said the description does not look controversial.
