The Engineering Assistant said that Council opened the hearing last Monday and continued their action. Chairman Erickson said that at the last meeting, the Carmission had received same petitions presented opposing tia,e conetruction of R-3 in the area and these petitiona were reprinted in the - Agenda for this evening. He stated the Subco�ittee had approved the pre- liminary plat subject to the final plat providing adequate utility and access easements. Mr. Fred Donaldson, representing Highland Park Develo�- ment Company, was asked if he had anything further to say about the plat this evening. He said he did not. Floyd Smith, 7600 Jackson St. N.E.: I completely protest the bui,ldi�g of aay multiple dwellings on this lot. If so, i will �ell my hon�. I ata sure the rest of the people feel the saa�e way. Walter Peterson, 7506 Tempo Terrace: I am al8o oppoeed to thio fas �he ^ simple fact it would overload our schools. 1i►e classrooms are getting to the point where they can handle the children better. �" 2 Plannini� Comnission Meeting - Apri1 10, 1969 Page 2 Chairman Erickson said that the one thing he would like to hear is ^ whether or not there is any particular objection to the plat because thia is what the Plan=►ing Co�ission is to consider. The people were informed that the members of the Planning Comnission were not on the Co�issioa a� the time of the rezoning. The objections have been heard in regard to Che use. � Charles Heid, 7513 Tempo Terrace: I have lived in a brand new fourplex. I have seen what can happen to an apartmeat house in two years. You can't imagine what it is like for the people across the street from one. When we moved in, they said it would be vesy nice, but it wae not kept up. Richard Cartwright, 7503 Tempo Terrace: I am aware you are asking for for a plat. I think there is no objection to that. I am sure this Plannia,g Coumission has a definite influence on whether or not to allow a building permit and you could recommend denial. Wouldn't this influence the Counc�l'e decision to grant a building permit? Chairman Erickson answered that, to his knawledge, the Pla:ming Com- mission has never taken a position on property that is properly zoned, nor have they been asked to do so. Mr. Myhra co�eated that if the land ia properly zoned, it would aeem to him the owner could challenge the Council. Mr. Cartwright asked if the City of Fridley has no other meana of ca�- trol than the zoning as to what is built where? The Chairman answered that other than zoning, he would say that was correct. It would seem we are now gettix�g into a legal field which the Planning Conmission is not properly fitted to handle as they are a recam- mending body only. He would say that the awaer has a right to build what he wants, if he complies with the zoning and City Code. Mr. Cartwright said he was opposed to the building of any apartment buildings in this iu�ediate area. Chairman Erickson aeked h3.m if he were aware that the people,who �zere askiag for the apartment complqc, were building the rest home? Mr. Cartwright anewered that he felt that the petitioners felt they see large econami.c benefits fram the apartment build- ing. He did not see any immediate co:mection between the two buildings. Se was sure their i�ediate concern was haw much money the aparm►ents were going to make for them. Mr. Myhra told Mr. Cartwright that in a sense, he was asking the Plan- ning Commission to make a statement on so�thing before it was presented to them. We have always been very careful if a developer comes in with some- thing that seemed very good, that we would not want to give a etatemeat until it.had gone through the various steps. Mr. Cartwright asked if it were not one of the Coumi�sion'� duties to give their recomnendations to the Council and Mr. Myhra answered that what he was saying wae really Mr. Cartwright ought to give his opinion to the � Council. Every once in awhile, he added, the Planning Coumisaion gets probleffis where there is a conflict between the petitioner and the owner, and sometimes, he felt particularly relieved when the opposition fell on another body. � PlanninA Coflmission Meeting - April 10, I969 Page 3 � The Engineerin.g Assistant eaid that Council had approved the isauance � of the Building pemnit. Mr. Jensen informed Mr. Cartwright that the actual approval has.happened and one building can be started as soon as the builder wished to pick up the permit and that it is rather late to object. Alto, this is a matter that does not require a public notice. The only way any- one can be aware of it is to be aware of all the proceedings of the City Council. It would be incomrenieat for an ordinary citizen to do. It Was also meationed the rezoning was passed three years ago. Mr. Floyd Smith said the neighbor across the street, who lived there in 1965, was never given notice on the rezoning. Mr. Jensen informed the sudience that there is a record kept in City Hall of all notices sent out. If his deed was not filed in time, the notice might have gone to the previous awner. Occasionally the holder of the mortgage is lieted as the fee owner, as they pay the taxes, the notice could have been sent to him. Sametiiaes the large organizations do not have the interest of the people at heart to foxward these notices. This is tragic. Mr. Myhra said that the Planning Co�ission recognized that appareatly these people are unanimously opposed to the building of apartments and we want you to realize we do recognize this. It seemed to him, Mr. Jenssa said, that the question the Plaiming Com- mission have before them fs the propriety of the proposed divieion lines on a large tract. Thie is a relatively uncamplicated plat that has aix parcels originally knawn as Outlot 1, M�elody Manor 4th Addition. It runa between Lyric Lane and Oeborne Road and bounded by hames alon,g Jackson. It is being divided up for the purpo�e of simplifying legal descriptions for deed purposes and the request was made by the City Council to plat the property so that additional buildings could be built on the property atnd each have their separate lots. This was the purpose of granting a single permit for a single large tract. A citizen said they were told what would be put up there is differeat fram what is going up there. Same of them found out from the City Hsll that it was zoned R-1 and nothing bigger than duplexes would be allawed. Mx. Jensen said it is a confueing tract of land, depending on where you live. The people on Lyric Lane could have been told the zoning was R-1 and it is true. However, it is permissible to get a special uae pesmit to build a nursing home in an R-1 area. It is understandable there could be some confusion. Mr. Cartwright asked if the minutes of this meeting are given to the Council. He would like to go nn record, and he imagined hia statements wera accepted by the people present, and recoadnend the City Council not give the building permit until the objection is aired. He would like to diecuse the rezoni�g of this area to R-1. Mr. R. Swift, 7577 Lyric Lane: As I uaderstand it, this ie a11 one plat with different zoning. It ia not being zoned. � Chairmaa Erickson explained there are three different �onings. Platting is to simplify legal descriptions of the property. There follawed a ehort� I discussion of probable taxes. � Plaaning Commission Meetiag - April 10, 1969 Page 4 Chairman Erickson said the Planning Comnission is faced with a situation � that exists and they do not have the power to change it. A citizen said there will be approximately 70 units in the apartment buildings. He believed there would be quite a few children in the elementary.and high schoole. He asked if there were anything they could do to fix the taxes on this land that will be developed so that this would not raise their property taxes. Chairman Erickson said that there is r�othing the Planning Comnission can do in this respect. Apartments get a high valuation. Mi0TI0N by Fitzpatrick, seconded by Mittelstadt, that the Planniag Com- mission close the public hearing on the preliminary plat, P.S. �69-03, Maple Manor Addition, Highland Park Development Company of Outlot l, �ielady Manor 4th Addition, except the North 400 feet of the West 217.8 feet. Upon a voice vote, all voting aye, the motion carried unanimously. Mr. Myhra said that the Planning Co�ission is back to the same thing. This is something for the Council. He didn't see anythis�g to be gained by holding the request up, and if it is held up, Council.cxn't ta?ce action. It is to the benefit of everyone to move it along. He asked the Engineering Assistant about the roads and utilities. Darrel Clark answered that they seem to meet the requirements the Co�ission spoke of at the last meeting. MOTION by Myhra, seconded by Jensen, that the Planning Comnission recap- mend to the Council appraval of the Preliminary Plat, P.S. �69-03, Maple Manor Addition, Highland Park Development Company of Outlot 1, Melody Manor 4th Addition, except the North 400 feet of the West 217.8 feet. Mr. Myhra suggested to the audience that those who were interested in the request should keep in touch with City Hall for the date it would appear on the Council agenda. 2. PUBLIC HF.ARING: PROPOSED PRELII�NARY PLAT, P.S. �69-02, AI�ER OAKS, DiAVID R. HUBERS, JULIAN JOHI�TSON: Lot 4, Auditor's Subdivision #92, Lot 1, $loc,k 3, and Outlot 2, Worrel's Addition. Chairman Erickson explained that this item was tabled at the last meet- ing of the Planning Camnission and the combined plats of Amber Oaks and Southhampton 2nd Addition were re-advertised. The public hearing notice was read by the Chaisvian. Mahlo=► Moe, 5955 Benjamin St. N.E.: I have aome property a little South of the proposed plat. We have never been able to get a atreet through there. Are there any plans made for the streets between Stinson and Benjamin? I have a 150'x300' parcel of land and I can't get a building permit nor can I sell the property. (Mr. Moe's land is platted as Acorn Hill.) Mrs. Lorraine Winkler, 1641 Gardena Ave.: I have beea trying to aell my house and I can't do it until I have a road Z can ca11 my owa. If I � can have a road in the back of my property, I think I could sell. J PlanninA Como4issian M�eeting - April 10, 1969 � Page 5 The Winkler property is 160'x180' and a driveway is used to get out to � Gardena. Mr. Moe referred to the cul de sac shawn on the preliminary plat and said he believed if it were extended another 300 feet to the corner of the Winlcler property, it would open the access to all of their lots. He said the last time they got Mr. Mitchell to agree, but then Mr. Winkler dis- agreed because there was a garage where the turn around would be a�d he felt he should be compensated for it. He did not knaw whether they could get Mr. Mitchell to agree with it naw. Chaixman Erickson said that oae of the problems of a cul de sac con- cerns the Fire Department and Police Department. The legal length, accoxd- ing to the City, is 500 feet and to include the other property would be to add another 300 feet, which would be against the ordinance. Mr. Moe asked if it would be possible to put the street through to Gardena which would eliminate a long cul de sac. It was mentioned there are buildings that would be in the way. Mr. Jensen said that he certainly had sympathy with their problems, and it is something the Planning Co�iseion has got to look at. The Co�m►ission read the records of the studies made in this area for streets about a month ago aad the studies went on month after month fram year to year, and the people that wished to divide the Worrel Addi.tion were held up with a total lack of agreement among the neighbors, and once again Mr. ^ Julian Johnson tried to plat, and we have held him up about six montha. Now the key to.a good development for Mr. Johnson was when the plattiag of the property to the north came in with a plan that seemed to match with his. It was the feeling of the Subcam�ittee that the combination of the two plats would be quite ideal to malce the best use of the property and make building lots of really high quality. Naw to try to contimie the cul de sac 300 feet to the south, would be in violation of the ordin- ance. The platting ordina.nce stated the cul de sac mmust not be more than 500 feet and it is now 400 feet. He did think the Planning Cairmission has to face the problem the people brought up, but hia personal opinion is this would not be the way they should try to get the solution. Mr. M�oe said he would aot want to put eomethiag through that would not help the whole neighborhood, but it is hard to pay the high taxes and not be able to build. Mr. Costello asked if Mr. Mitchell would be agreeable, could eomething be worked out. The Chaisman said if Pir. Mitchell were agreeable, a road could come in from Stinson. He has a large parcel that could be divided up into probably seven lota. The only aolution is for the people owning land and needipg to acquire accese to thie propexty, to ask the City . to condema laad. It is up to the Council. He would auggest that if they really felt they a�ust get accesa in the area'to their property to the back, to come in and sit down xith the City Eagineer, even if it /'1 means some condeuasations have to be done. He did not think it would be `- fair to hold up this plat. _ __ 6 Planning Commission Meetin� - Apxil 10, 1969 Page 6 MOTION by Mittelstadt, seconded by Myhra, that the Planning Co�ission /'1 close the public hearing of the proposed Preliminary Plat, P.S. #69-02, Amber Oaks, David R. Hubers and Julian Johnson, of Lot 4, Auditor's Sub- division #92 and Lot 1, Block 3 and Outlot 2, Worrel's Addition. Upon a voice vote, all voting aye, the motion carried unanimously. Mr. Mittelstadt stated that the Planning Commission got the opinion of the people for an additional road in the area to the south and realize they do have a problem there in order for them to get access road, but the business before the Planning Caamission this eveni�g is the proposed preliminary plat of P.S. ��69-02, Amber Oaks. 1�OTION by Mittelstadt, seconded by Jensen, that the Planning Comnis- sion reco�nend approval to the Council of the Prelitninary Plat, P.S. �69-02, Amber Oaks by David R. Hubers and Julian Johnsmn of Lot 4, Auditor's Sub- division #92 and Lot 1, Block 3 and Outlot #2, Worrel's Addition. Upon a voice vote, all voting aye, the motion carried unanimously. Mr. Myhra asked about drainage and Darrel Clark said the grades could be worked out on the streets and the water, at present, goes to Stiason Boulevard. There is one utility easement to be granted at the lot line out to Stinsoa Boulevard. The reason for the easement is looping of watermain. , Mr. Jensen said this particular area does not have a stoxm sewer so water is running on the streets for miles, which is really not proper. � He would like to state that the street gradea that they checked at the last meeting were not positively apprwed and they are definitely goiag to have to be examined carefully by the Engineering Department relative to elevations. Mr. Hubers asked at what point could they start to build. Daxrel Clark answered that, legally, they could take out one or two building permits naw. Upon a voice vote, all voting aye, the motion c���ie� u�it�pu�ly. ���,•�`�:.,: � [1 Planning Commiesion Meeting - April 10, 1969 �'�s � Darrel Clark said the original prelisninary plat of Eaat Ranch Eetates � 2nd Addition shawn before the Subcammittee did not have the easement run- ning through the center of the plat to line up with 78th Avenue. The plat has been re-drawn and this has been corrected. There are a feaa more lots on the new plat, but othezwise no changes. The reason.the developer requested two plats was that the land originally was uader twu o�mershipa and he used each ownership for a plat to facilitate legal matters. The i,aduatrial lots are 215' x 315' and 200' x 315'. The only xecammendation the Subco�ittee made was that some day Main Street should continue down and line up with Cotmnerce Lane. Mr. Richard Harris said they owned Block 3, Onaway Addition and sane other scattered parcels. Their objection to the original preliminary plat was the easemeat through the ceater of the plat did not line up with their lot lines, but this has becn corrected. Qureshi and Peter Herlof�ky, Senior Engineering Aide, were present. __ 8 Planning Co�ission Meetiag - April 10, 1969 Paste 8 Mr. Qureshi referred to the Miscellaneous Remarks of December 9, 1968 ^ by Chairman Erickson which were being studied. The study thia eveaing __ began with the industrial land, which is most of the land left in Fridley, and finished checking out the remarks. Chainuan Erickson, on behalf of the Planning Cacmission, complimented Mr. Qureshi and Mr. Herlofsky stating it was a pleasure having two men who would go ahead and camplete the zoning study and in such an able maaner. MpTION by Mittelstadt, seconded by Fitzpatrick, that the Pla�ing Co�mission recammend to the City Council the adoption of the Proposed Zonin� Ordinance Review with the stipulations discussed this evening. Upon a voice vote, all voting aye, the motion carried unaaimously. 7. HYDE PARK ADDITION REZONING ST(TIK: Nason, W�s�an, Ki►fght � Chapman' Iac. Chairman Erickson referred to the new plans, dated Apri1,1969. CoaanenC- ing on the final page of the report, he said that it lacked the in�o�tion of the feasibility of clearance and c'�st for land on Plan D-1. It seemed thQ last sheet in the report which referred to this, was left out. (This sheet is now Page 17 and has been added on Friday,, April 12th) MpTION by Jensen, seconded by Fitzpatrick, that the Planning Co�ission, receive the Final Study of the Hyde Park Additioa Rezoning Study dated April, 1969 together with Alternative Scheme A-1 and Alternative Scheme D-1, and recarmnend payment be made for the Study. Upoa a voice vote, all voting aye, tt�e motion carried unanimously. The City Engineer stated the City Manager was making a atudy of the area with the Council. , Mr. Jensen said he really felt quite uncomfortab�e about this whole thi�g. Sameone has put the Planning Commission in the position of being appoaed to an A�ninistrative or City proposal. He felt it was tragic to have a public hearing without a discussion with the Planning Coaaniasion as it would be a pretty bad place to start "washing things out". Chain�an Erickson reported that on Saturday, April Sth, the Planning Ca�nission spent several hours and came up with, what they considered, a pretty good plan and also an Alternative to that plan. Mr. Jensen and he met with Mr. Chapman on Monday noon. Mr. Chapman was informed of their choice, and they were given the Study together with a feasibiiity study ior the Alternative plan for D-1. He said it was rather ridicu2ous to spend so much time on a study and then throw the who2e thing out the window without letting the Planning Commission know. The follawing co�nents were made on Plan A-1: Vehicular acceas was t�ot provided for those co�ercial lota off 57� Avenue ia order to separate com- mercial traffic from residential traffic. They would like to have 61st Avenue continue West across the railroad tracks to East River Road, as the � increase in density is going to require other major thoroughfares be construGt�� ,� as that density ia reached. �i Plaimiag Commission Minutes - April 10, 1969 P8$e 9 /-� xeferring to Plan D-1: There is a dxafting error on 2nd Street between 58th and 59th Avenues -- it is shaded and should be light. Vehicular cam- mercfal access is to be prohibited to com�ttercial area from 2� Street between 57� Avenue and 60th Avenue and 3rd Street fram 59th Avenue to 60th Avenue. The purpose of this is to keep cam�ercial traffic out of the residential area. xelative to the timing of zoning, Mr. Jensen said Plan A-1 would take imnediate steps for R-1 rezoning at the Noxth and also Cos�snercial zoning on the South. Rezone existing s�ultiple dwellings to R-3, then adopt a guide plan for R-3 development on the remainder and set up criteria for the success- ful rezoning including area requirements and other pertinent requirements and the City could possibly develop some rigid requirements for the future. fle aaid they would not want to force anyone to go R-1 where there is exfsting multiple dwellings. They probably would have to get the owner's to si$n an agreement. The potential density will increase about three times and will bring a need for a park for the pre-achool children, which the Planning Com- miasion felt was extremely important and necessary for enjoyment of living in the area. The park, in either plan, is located in the satne plaee because there would be a minimum amount of acquisition problems because there are just two buildings there. Again referring to Plan D-1, use same reco�nendations for R-Y, every- thing South of 57th Place can be zoned i�nediately, and having a guide plan to cover the area between 57th Ylace and 60th Avenue, it would be some- vhat more important to have the criteria under which you would rezone Can- ^ mercial property. Coa�nercial property wants to be contiguous with previously zoned property, and therefore, the plan needs a rezoning.
