Curtis Shaw, 1386 Skywood Lane, presented a letter and petition oppos-
ing the rezoning.

July 7, 1969 opposing the rezoning, ZOA �69-10, with twenty-eight sigaa-
tures presented by Curtis Shaw be received by the Planning Coamis.ion and
that the letter dated July 7, 1969 with five etgnatures also be received.

The letter dated July 7, 1969 was read for the benefit of the people.
Chaistioan Erickaon referred to the Building Inspection file on the building
permita. In April 1965, a pe�--sit for a double bungalaw by special uoe
paswit wae ieaued in an R-1 district. Lettera were eubsequently pritten
after sn inepection ahawing there were elsctrical facilities for three
familiee and atating this Wae in violation of the City Code as the building
permit Wae for a double bungalaw. In Auguat, 1965 a letter pas �►ritten by
the Acting City Attorney etating that the se=v icea were not prima-facia
evidence, but that the awner shou�d receive a letter reminding him that only
tNO familiea were a1loMed and no uther occupant would be permitted. In
1967 a letter from the City Attorney indicated a petition wa• received that
three familiee were living in the premieea violating the Code and time t�as
graated for correction. In Auguat of 1968 Mr. Ankrum sent a memo to the
� City Attorney adviaing him of the aimilar situation. No� we have the present
aituation in which they are requesting a special uee permit for three
fmmilies to occupy a double bungalow. A letter written by Hank Muhich, Chief
Buildiag Inapector, on May 22, 1969 stated the petition Wa� denied by th•

^ City Council for three familiee in double bungalaw and they advised reaoning
would be necessary. Since that time, he believed, the City had taken action
through l�gal council on this matter.
The Engineering Aasiatant said that the hearing was before the court on
June 3, 1969 and the court ruled that the petitioner Was in violation and
would have to vacate one unit before June 30, 1969 and this has been done.
At the preaent time, there are only two families living in the d�relling.
It was brought up that it was true that in the liet of people living
within 300 feet, some of the names of adjacent neighbors were left off.
The City relies on the petitioner to supply names.
In answer to Mr. Shaw's queation, he was informed the present occupants
were 1�, and Mrs. Don Thompson and Mr. and Mra. Balthasor.
Mr. Shaw said he was living in the neighborhood at the time of the fir�t
•special use permit, but he was not too interested at that time.
MOTION by Jensen, seconded by Fitzpatrick, that the Plaiming Commission
close the public hearing of the rezoning requeet, ZOA #69-10, George Baltha-
zor, of Lot 3, Subdivision �10, Auditor's Subdivieion �94, to be resoned

Mr. Myhra said he checked the requeat from a financial point of view.

The public hearing was tabled at the last meeting because the petitioaer
was not present.
Becauee of conflict of interest, Mr. Myhra removed himself from the dis-
cuesion.
The following were present for this item: Thomae Swanson, Mr. and Mrs.
B. Novak, Gordon Sangster, Henry C. Dickinaon, Ed Dropps and Don Nielsen.
Mr. Novak stated it was agreeable to them to add their property to the
plat as long as it was only one additional piece. They felt a large lot
would be �re marketable than two smaller ones. They were infoxYned that
easements would be required for public access, water and aewer. Mr. Novtk
would have a short driveway inetead o€ a long one. He asked haw soon the
impranements would be provided. Water and sewer could be under contract this
fall and completed in 1970. The earliest for the final assessment roll prob-
ably wonld be in 1971 or 1972. The platting could be done this year. Mr,
Nielaen stated there would be a drainage problem as the water in the spring
of the year does not run off.
Mr. Sangster, speaking as a resident living in the area�expresced his
deaire to see the exit to East River Road left open so as not to add to the
traffic using Riverview Terrace.

Mr. Myhra said that the Subcoumittee discu.sed the fact that Lot 8A
would need an additional acce�e on the East if it ehould aver be split.
Mr. Wells explained they live on Lot 8A which ie 100 feet in width and theq
o�n the North 100 feet of Lota 8C and 8B. Lot 8C is going to be put on the
market, and becauae their houae is situated in auch a fashion that they
would look directly into the backyard of the nep lot, they Mould like to
take 12 feet from the Eaet line to be added to Lot 8B �rhich ia nar used'as
yard.
Mr. Wells had turned in the legal description prepared by an attorney
which is as follawa: Parcel #1: North 100 feet of Lot 8C, �xcept the Ba�t

The Coamiission discussed the curve in Seventh Street. The curve is
South of the Gallagher property and the extra width was taken off the Riedel
property. In checking the width of the boulevard, it was felt there would be
� enough land for aidewalks if they should ever be required.

the letter dated June 19, 1969 from the League of Women Voters in Fridley
opposing the YMCA proposed Suburban Facility on West Moore Lake Drive. Upon

Mr. Myhra said, in talking about the number of apartments for the past
six months or more since he has been on the Planning Coaanission, it seemed
to him that to suddenly decide, because the Planning Couunission has become
concerned with the problem of the number of requests for apartments, to
start talking about stopping action on requests, was not good thinking.
If the Comnission can foresee a need for apartments in the area by Onan's,
euch as this one, they should look at it on its own merits.
At the Planning Comnission meeting of May 22, 1969, the Co�ieaion felt
� a report such as that of the Roseville Administrative Staff would be of
^ benefit to Fridley. This was "A Study to Examine the Tax Advantage or Dis-
advantage of the Apartmenta in Roseville and Their Affect On The Local
Schools". The Engineering Assistant said this information could be compiled
for Fxidley without too much trouble if Council would so direct.

^ The Commission felt a atudy would be useful in answering questions
from the public and helping them to make decisions. It was felt a study
would be completed within 30 days. The headinga should consist of haw
many units in Fridley; how many could be built under our pzesent aoning,
how msay school children, particularly on average per unit; and tax dollars
and return.
The Engineeri,ng Assistant reported a survey was made in 1963. The
Coormission would be comparing this report with the propoaed survey. In
answer to the query of declaring a�ratorium while the study was going
on, the Co�ission felt they "should do business on a nornial basis",
taking each request individually.
In regard to Mr. Weaterlund's request, Mr. Myhra said the Planning
Co�ission wa� concerned with the el�vation lines. Using the County Auditor's
deacription, the rezoning request is for the North 824.7 feet of Parcel 300.
The balance of the lot was not included. The South end of the lot has a
drop which ie not buildable. The petitioner plans to leave the South part
as is. So�e of the neighbors were concerned about the setback of the
apartments and were informed the setback was shown to be 180 feet vith
future garagee to take up eome of it. Mr. Westerlund vas to have a certi-
ficate of survey prepared.
MOTION by Jensen, seconded by Myhra, that the Planning Conmission
reconmend approval of the rezoning request, ZOA �69-08A by Kaye Westerlund
of the North 824.7 feet of the W� of the NE� of the NE� of Section 13, to
/'1 be rezoned from R-1 (single family dwellinge) to R-3A (Apsrtmente only)
with the condition that the developer deed to the City the South 60 feet
of the described tract and further agree that no diaturbance of the creak
bank below elevation of 880 would take place and that the developer would
further agree that the front aetback would be a minimum of 100 feet. Upon
a voice vote, all voting aye, the motion carried unsnimously.
Mr. Jensen added that this particular tract ie appropriate for the
proposed use. It happens to be on the boundary of a large industriel
tract; it also abuts the tract that was recently rezoned for �ultiple
dwellinga; and on the South side a natural buffer of Rice Creek bottom
land exiets. Accees to the property from the South would be extremely
difficult becauae of the terrain and natural wooded area. The only area
that remains to be considered is the area to the West and it ia sparsely
populated and would not be adversely affected at thie time. It Would give
them an opportunity to develop �hat property using the beat design factor•
that could be developeci to allow an interface between R-1 and R-3 soning.

Church plans to sell, which ie everything North of the South lina of Lot 24,

� 2� lots. The cemetery ie in Block 10 and was purchased in 1915. Referring
to 5th Street, he said the dedicated portion ie 30 feet wide. Fifth Street
was dedicated a long time ago, and there are twenty-two graves on the East
half. Off 54th Avenue there was only one grave. There are nine grave�
within 22" of the fence on Sth Street. There ie room for 4,000 additional
graves on the property the Church intends to keep. The plat of Hamilton'a
Addition to Mechanicsville was recorded in 1886.
The Church felt this was a good piece of land, but more land than they
could use. They had hoped to eell off the portion they didn't need and keep
the reet for the cemetery.
The Coimmission diacu8aed the fact that the East aide of Sth Street pas
vacated all the way up to the Freeway. They discussed a pravieion that tha
East half of Sth Street be dedicated on the front of the area to be developed
�ltiple and along the Freeway providing a service drive aver to 7th Street.
Thia would give the apartments accest to the EaBt or Weat.
MOTION by Myhra, aeconded by Fitzpatrick, that the Planning Co�ission
reco�end to Council approval of the rezoning request, ZOA �69-09, Sacred
Heart Pariah, of Lote 5, 6, N� 7, Block 10, Hamilton's Addition to Mechanics-
ville to be rezoned from R-2 (limited multiple dwellinga) to R-3�A (apartmenta
only) from the North line of the South Half of �,ot 24 to the North line of
the present cemetery property and a right of way for the continuance of the
service road between Fourth and Seventh Street. Upon a voice vote, all voting
^ aye, the motion carried unanimously.
For further clarification, Jensen said this reaoning would add only five
uaits to the number of apartments that could be built on the already aoned
property and provides the Cemetery Association the opportunity to put the
�and to another use. Their agreement to tt►e condition� of the motion would
asaiat eolving street and traffic probleme that they noa have.
9. VACATION REQUEST: SAV #69-03, GREAT NOBTI�RN RAILWAY CQ�ANY; Alley and
Streeta in Block 6, Berlin Addition.
No one was present for the petition.
The Chairman reviewed the requeat a�ying that the petition came to a halt
on one particular item, that of Northern States Power. 7�o exiating earvices
in the Eaot/We�t atreet aketch indicated what portion that the Northern 3tat�s
PoMer has a�ked to be maintained as utility easements. It was decided that
Northern Statea Power should draw up a private eaee�nt �ith the Great Northern
Railroad, as thie would be the simplest way of handling it.

Continuing the subject of an Apartm�nt Survey for the City of Fridley,
after reviawing the Memo from the City Engineer, CM #69-10, to the City
Maaager, the following tentative liat for etudy was suggested:
List of buildings presently occupied.
Number of unite.
Tax base and what they would have paid.
Age of building.
Asseased valuation: school tax and regular tax.
Number of School children.
Ratio apartmente to single family.
Economic factor: dollar return.
Residente per acre.
It is hoped that by comparing this atudy with the one in 1963 preaented
thie evening by the L�igineering Aeeistant, the Planning Co�iaeion will be
helped in deciding haw mauy apartments the co�inity needs.
Further co�ents were: Fitspatrick: There ehould be County Wide plsn-
ni�ng, as we have obligations to our neighbors. Jensen: One school of
thought is housing ahould be concentrated. Tranaportation is alm�et impos-

Mr. Alder was present to present his request to the Board. He brought with him
a memo entitled "To the Board of Appeals, From Richard W. Alder". The memo
stated the reasons why Mr. Alder wants to build the proposed addition and garage
onto the dwelling and the reasons why he tho�ht it was necessary to have the
variances.
MOTION by Harris to receive the memo from Mr. Alder.
Seconded by Minish. Upon a voice vote, all voting aye, the motion carried
unanimously.
Mr. Alder explained that there would be 14 feet between his lot line and the
next structure and 20.7 feet between the proposed structure and the next structure.
He is bringing the garage 4 feet ahead of the house to avoid the complications in
tying the two roofs together, as the house has a hipped roof. If he were
required to line up the garage with the house the materials needed, in tying the
two�structures together, would run into money. The addition being added on behind
the proposed garage will become the family eating area. The present eating axea �
is approximately 6 feet by 6 feet.
MOTION by Minish to receive two lettersfrom Mr. Alder, signed by the ad�jacent
property owners, stating they know about and do not object to Mr. Alders ga,rage
and addition.

Mr. Rotter explained to the Board where the land ie located, and that it is 160
feet wide and 325 feet deep. He also explained that they feel Highway #65 is the
beat loaation they could find for a mobile hone ealea eetabliehment as 90 per cent
of the traffic travels on Hi�hway #65. We don't require a very large piece of
land as we only plan to have around 11 mobile homes, and this lot ia what we are
looking for. We would be leasing thie land, from Mr. Harstad, for a three yeax
period. He hae indicated he ia not #ntereated in selling the land.
Mr. Rotter was aeked what type of a building would the main office be.
�1 He answered they operate out of a mobile home that has been partitioned into
officee. It would be 12 feet by 60 feet long. To put up a permanent structure
would be a disadvantage for them.
Mr. Harris asked if they were planning on blacktopping any area of the property.
Mr. Rotter said they were planning on blacktopping the entrance and perking �ea.
The area where the mobile homea are parked would be rock.
Mr. Harria asked if they had any sanitary facilitiee as the City Code calle
for two reetrooms.
Mr. Rotter said they would install two restrooms inside of the main office mobile
home.
The Board was shown eketches, of the proposed layout, drawn up by Macey aig�ns. '
The Board asked about the propoeed lighting and fencing.
Mr. Rotter said they planned on having quartz lights, colored lights and security
lighte. They had not planned on any fencing.

to come into the City to requeet more spot rezoning along Central Avenue. He felt
it would be better if the applicant would look for a piece of land where they
could have permanent occupa.ncy inatead of asking for a Special IIse Permit where
they would only be assured of a three year occupa.ncy.

Notice is hereby given that there will be a Public Hearing
of the Planning Commission of the City of Fridley in the City
Hall at 6431 University Avenue Northeast on July 23, 1969 in the
Council Chamber at 7:30 P.M. for the purpose of:
Consideration of the proposed preliminary plat (P.S. #69-10),
^ Gallagher Addition, by Wm. H. Gallagher being described

Recent criticism of the Fridley Planning Commissions decisions in connectian
with apartment rezanings and the overall relati�n of' rezoning to school district
problems has prompted this letter. While the Planning Commission feel its
decisions in connecti�n with rezoning have been properly macie after due conai:lertion
af all fscts inv�lned, I feel that some response must be given to recent charges
that the Cammission is insensitive to sehool overpo�nzlation and ha,s closed its eyes
and ears to the problem, if it is indeed a prablem.
Last spring, bet'ore ax�y comments were made by the 5chool Board or other members
af the public, the C�mmission requested inf'ormation i'rom the City stai'f regarding the
. number of apartment units built, the number which could be built under present
� 7�oning, the number of school children per unit, � the tax dollar return per schooi
child and a number of other f'acts which will hopefully enable us to reach reasonable
decisions in rezoning requeste.

of apartment building (in Dist 14) could exceed 4,OU0 units by the end of the year".
� The facts, according to infarmation dated June 25, ly6y fr�m Fridley recorda indicate
that on ,Ta,nuary 1, 1969, Fridley had 1501 units, permits issued far an additnnal 298,
and 6(3 possible additional units for which no building permits had been issued and
h�ve not been issued to this date.
The tax burden seems somewhat questionable at this point since a 1y63 study made
by the City Administration indicated thst the school population in apartments at
that t�me was approcimately 1�8 child per unit, and the taxes to the School
District were between 969UO.OU and semething ever �2UOU.UU per school child. It
is doubtYul that a�2U,OU0 h�me with two children was contributing as much as �150
per child to the school$. Our new survey should indicate whether or not there has
been a substantial change in the relative figures. We ha�netha.t the Schoml Board
has additional econamic information tm supply.

hou�ing iH increasing in cost at a rate that is taking it out o#' the reach of the
avera�e person. If we are responsible peo�le, w� must solv� the problem that
we are creating. It is not sufficient to say to our children, "DTow that we have
spa,wned and weaned y0u, mo�re out to smme other commmnity because we don't have
room for you here" or tm say to industry, " We want your tax base and your p�yroll
but not your people". This is not to say that we must rezone everythirg or even

if it means that we �ay have to add to aur scheal system someday. The School
Board must be complimented on doing an excellent jab of pxmjecting school population
