RECEIVE BUILDING STANDARDS-DESIGN CONTROL SUBCOMMITTEE MINUTES; JULY 16, 1969:
MOTION by Jensen, seconded by Fitzpatrick, that the Planning Commission
receive the minutes of the Building Standaxds-Design Control Subcommittee
dated July 16, 1969. Upon a voice vote, all voting aye, the motion caxried
unanimously.
1. PUBLIC HEARING: PROPOSED PRELIMINARY PLAT, P.S. ��69-09, MIKE 0'BANNON:
Lots 11, 12, 13 and 14, Auditor's Subdivision ��22 and Lots 1 thraugh 16,
24, 25 and 26, Block l, Irvington Addition.
Mr. 0'Bannon was present.
The Notice of Hearing was read by Chairman Erickson. He commented that
the Subcommittee had approved the preliminary plat with apparently no
instructions.
Mr. 0'Bannon explained that there were three property owners involved
with the platting -- Mr. John C. Carrol, James W. Skog and himself, He
planned to put the sewer and water in himself and will submit his plans to
the City. There will be no storm sewex. The sewer and water would go in
this fall and then the road next summer.

Mrs. Ted Gonsior and Mr. Ervin Kassow were included in the discussion.
They were shown the overall plan of the Rice Creek Road/Central Avenue Study
and Chairman Exickson said that Mr. 0'Bannon's plan follows the original
^ one almost to the letter.
The Commission asked for a slight change in the alignment of.Lot 4
enlarging it.
MOTION by Fitzpatrick, seconded by Jensen, that the Planning Commission
close the public hearing of the proposed preliminary plat, P.S. ��69-09,
Mike 0'Bannon, of Lots 11, 12, 13 and 14, Auditor's Subdivision ��22 and
Lot l through 16, 24, 25 and 26, Block l, Irvington Addition. Upon a voice
vote, al1 voting aye, the motion carried unanimously.
MOTION by Jensen, seconded by Fitzpatrick, that the Planning Commission
table the proposed preliminary plat, P.S. ��69-09, Mike 0'Bannon, of Lots 11,
12, 13 and 14, Auditor`s S�bdivision ��22 and Lots I through 16, 24, 25 and
26, Irvington Addition stating that the layout has the general concurrence
of the Planning Commission, and it seems to be done in accordance with the
ovexall plan adopted for the area. However, the Planning Co�mnission wants
to be able to look at a more finished drawing showing the topography and
lot dimensions prior to final action; requesting that the Council set a
public hearing at their earliest opportunity; the drawing should show the
existing houses in relation to the lot lines. Upon a voice vote, all voting
aye, the motion carxied unanimously.
2. PUBLIC HEARING:_ PROPOSED PRELIMINARY PLAT, P,S, ��69-10, GALLAGHER ADDITION,
WILLIAM H. GALLAGHER: West 5 acres of NW� of SE�, except South 4 acres,
Christie Addition.
The Public Hearing Notice was read by Chairman Erickson.
Mr. and Mrs. Gallagher were present and als� Leif Henriksen.
The Engineering Assistant explained that at the last meeting, there
was some discussion about the boulevard width at the Southwest corner. A
f�eld check indicated an existing boulevard of about 5 feet. The recommen-
dation of the Engineering Depaxtment was that there should be at least
13 feet, so that an additional.right of way should be obtained of about 8 or
9 feet off the corner. Mr. Gallagher said the lot was big enough to allow
this. He was asked if he knew how far from the West line his hause stood.
He thought about 18 to 20.feet, and about 32 feet from the East line.
MOTION by Jensen, seconded by Fitzpatrick, that the Planning Commission
close the public hearing of the proposed preliminaxy plat, P.S. ��69-10,
Gallaghex Addition, William H. Gallagher of the '�ESt five acres of the
Northwest Quarter of the Southeast Quartex, excegt the South four acres of
Christie Addition. Upon a voice vote, all voting aye, the motion caxxied
unanimously.
Mr. Gallagher was asked to get a certificate of survey and show the
existing building. The suggestion was ma.de.to change the 75 foot lots to
^ 80 feet ma.king them mor� buildable. Mr. Gallagher said he would do so if
he would not lose his txees,

� MOTION by Fitzpatrick, seconded by Jensen, that the Planning Gommission
recommend to Council approval of the proposed preliminary plat, P.S. ��69-10,
^ Gal�agher Addition, William H. Gallagher, of the West five acres of the
Northwest Quarter of the Southeast Quarter, except the South four acres,
� Christie Addition with the provision that there be a minimum of 13 feet for
the boulevard provided on the Southwest corner of the plat and that there be
a certificate of survey submitted showing the position of the existing
structure befare final approval by Council. Upon a voice vote, all voting aye,
the motion carxied unanimously.

Auditor's Subdivision ��77 lying East of the East line of Block 1, Mississippi
View Addition. Upon a voice vote, all voting aye, the motion carried
unanimously.
4. CONTINUED REZONING REQUEST: ZOA ��69-08, R. W, WORMSBECKER: NWw of NW�,

The meeting was called to order at 7:30 P.M: by Chairman Jensen.

l. VACATION REQUEST: SAV ��69-09, LEO 0. LEMKE: Vacate 47th Avenue between
Third Street and University Avenue (Lot 30, Block 9, Plymouth Addirion).
Mr. Lemke was present.
The Engineering Assistant explained that there is one utility in the
street and that was a storm sewer 13 feet South of the centerline of the
street. This takes the water from University and carries it West, There
is an opening to drive in on the street, but no one is using it presently.
There are no garages to use the street. Half of the vacated street would
be deeded back to Mr. Lemke and the other half to the owner to the North .
However, if the owner to the North did not wish the vacation, Mr. Lemke
� could request vacation of half the street.
Mr. Lemke explained that he owned just Lot 30 and needed the extra
land to make the lot buildable.
The City would have to keep a portion of the vacated land where the
storm sewer lies and this would amount to 20 feet which would give Mr.
Lemke seven feet more buildable area. The Subcommittee discussed the foot
path to University Avenue on 47th Avenue, whether or not it would be ad-
visable to discontinue it. It seemed pretty evident that there never would
be a street crossing over University Avenue at 47th Avenue, but there might
be the possibility that some day a pedestrian crossing might materialize.
If an easement were taken down the center of the street, it could be used
€or a pedestrian path. .
The Commission felt the neighbors within 300 feet should be notified
of the Planning Commission meeting on August 6, 1969 and asked to attend
for an informal hearing.
MOTION by Myhra, seconded by Zeglen, that the Subcommittee recommend
approval to the Planning Commission of the vacation, SAV ��69-09, by Leo
O. Lemke, to vacate 47th Avenue between 3rd Street and University Avenue
subject to the Planning Commission holding an informal hearing of the
surrounding property ownexs to get their opinions, and also subject to
consideration being given to the foot path that presently runs through the
^ property, and also subject to getting the necessary easement. Upon a voice
vote, all voting aye, the motion carried unani.mously.

2. LOT SPLIT REQUEST: L.S. ��69-21, WALTER E. WITTMAN: South Ha1f of Lot 1,
Block 1, Spring Valley Addition.
� Mr. Wittman was present and expJ�ained that he owned 15D feet along
� Arthur Street and wanted it split into two 75 foot building sites. He has
owned the lot since 1955, and in 1965 sent a letter to the Gity of Fridley
asking for a lot split and received a letter stating this was alxeady done.
The City must have referred to the original split when Mr. Wittman purchased
the property.
It was explained to Mr. Wittman that an overall street plan for the
area called for an East/West street midway between 64th Avenue and Mississippi
Street t� sexve the internal lots in the block when split. The lots in the
area which have been split have dedicated twenty-five feet for the street.
This is a fairly well established precedent.
Mr. Wittman was informed that it would be to his advantage if he would
consider purchasing twenty-five feet from Mr. Larson, owner of the North
Ha1f of Lot 1, in order to have two buildable lots. Mr. Wittman asked if
the Subcommittee was sure the rest of the property owners would want that
road. Chairman Jensen answered thai he did not know the answer, but
experience has been in lot splits similar to this, that the people in the
older plats with one or two acre lots, decide that they are tixed of big
lots and paying taxes on them. The Planning Commission has developed a
' street plan, after a series of hearings, explaining that they axe not
talking about building roads now, but want to adopt a plan so that if any-
one wants to divide the property, it could be done with this road plan.
It may take ten to fifteen years before the last lots are split, but this
^ plan is working. As the lot splits come in, the road plan is followed.
Mr. Wittman was told a 75 foot corner lot is narrow and he would have
trouble building on 75 feet because of setbacks. It would almost force
building a 12 story honse.
MOTION by Crowder, seconded by Myhra, that the Plats & Subdivisions-
Streets & Utilities Subcommittee recommend the lot spli.t, L.S. ��69-21,,
Walter E. Wittman, of the South Half of Lot 1, Block 1, Spring Valley
Addition that this Body expressed disapproval to the Planning Comn�ission
of this split. The reasons behind the disapproval involve a 25 foot road
easement which this Body deems necessary, thereby yielding a lot which is
not suitable to give two buildable lots, thus there is no logic behind
approving the lot split request. Upon a voice vote, all voting aye, the
motion carried unanimously.
3. LOT SPLIT REQUESTt L.S. ��69-20, FRANK DIRCZ: Combine 10 feet of Lot 29
with Lot 30, Block 1, Plymouth Addition.
The petitioner was not present.
The Engineering Assistant explained that Mr. Dixcz was told that there
wexe several variances that would have to be granted before he could build.
He went before the Board of Appeals for a series of variances to build on
� a 45 foot corner lot. This lot was tax forfeit and was purchased in 1963.
Because 49th Avenue is a State Aid road and heavy traffic carrier, tlze S�ab-
committee felt an 11 foot setback is inadequate inasmuch as the street is
using alm�st all of the right of way leaving little boulevard. There are
too many var�.ances needed to build on the lot, and it was not the intent

of the ordinance that a11 yards and spaces could be reduced at once.
The Subco�unittee is not directly opposing the statements of the Board of
Appeals, but the factors that they overlooked.

MOTION by Crowder, seconded by Myhra, that the Plats & Subdivisions-
Streets & Utilities Subcommittee recommend to the Planning Commission
denial of the Lot Split �69-ZO, Fxank Dircz, to combine 10 feet of Lot 29
with Lot 30, Block l, Plymouth Addition for the following two reasons:
1) the proposed lot would have on one side 49th Avenue which is a heavily
traveled main artery affording little boulevard, and Che propased lI foot
setback seems very inadequate. 2) the total of five variances already
granted from the Board of Appeals does not seem to meet the intent of the
City ordinances designed to prevent this sort of thing. Upon a voice
vote, all voting aye; the motion carxied unanimously.
4. CONTINUED �OT SPLIT REQUEST: L.S. ��69-19 NORTH AIR HOME ASSOCIATION,
J. R. PLEMEL: South 150 feet of Lot 18, Brookview Addition subject to
road easement over th.e South 50 feet.
Mr. Plemel was present.
It was noted that the land acquixed for the lot split was a swamp,
and being zoned R-3, the lot would n�t be buildable. The Subcommittee
wanted to check the amount of land purchased, and wondexed if it would be
to the benefit of the Knights of Columbus to purehase additional land
to the North in oxder to get a buildable lot. Mr. Plemel said this was
all the land the Knights of Columbus purchased and they had no further
plans for. expansion in that direction as they just needed additional
parking space.
MOTION by Myhra, seconded by Zeglen, that the Plats & Subdivisions-
Streets & Utilities Subcommittee recommend approval of the lot split,
�69-19, North Air Home Associat�.on, J. R. Plemel of the South 150 feet
of Lot 18, Brookview Addition subject to road easement over the South
50 feet, subject to further investigation fox the possible need of a
sewer easement. Upon a voice vote, all voting aye, the motion carried
unanimously.
Mr. Plemel said the easement is in the present paxking lot.

Mr. Fsickson was present to prese.nt his requeat. He brought with him a surve�r of
Lot 4 showing the layout of the house on the lot. The structures on either
adjacent side lot were also shown on the survey for the purpoae of denoting how
many feet there would be between the proposed structure and the existing structures.
Mr. Erickson explained that there is a treme.ndous bank on the back of this lot
and it would require removing a lot of dirt to build back farther on the lot.
To build on the lot as it is .now requires the two variances. Without the
variances the lot would be unbuildable.
MOTION by Minish to receive a survey with three property owners signa,tures on
it stating they know about but do not object to the requested variances. The
signatures are: Ben Douglas, 6054 Woody Lane, T.G. Schnagel, 6053 Central and
Richa,rd Inlow, 6057 Central Avenue.

MOTION by Harris to approve the requeat for the followizlg reasons:
1. The fro.nt yard setback is compatible with the adjacent atructure�.
2. The building is well situated on the lot to alloW a 5 foot sideyard aetback.
The structure does abut a drainage and utility easement, which is a ten foot
ea�ement, so there should be no problem with distance between this structure
and any future structures that may be built by the adjace.nt property c;aner.
3. In order for the applicant to build on this lot he does need the vaxiances.
This lot would be unbuildable without them.
4. Th� a.pplicant also maintains the 15 feet between his structure and the struct�e
on the South.

Mr. L. StanJ.ey, 7661 �ast River Road, was present to find out more about the
proposed buildi.ng. He ha.d no objections to the building but wanted to make
� sur� that there would be an adequate parki.ng area planned for the building
and that they would have adequate refuse facilities.
Mr. Silker explained what the buildi.ng will look like, lar�dscapin� and layout
on the lot, drainage, etc., to the Board. He also explained th�t the building
can't be moved back as they need the room it: the back �f tt�e lo � ior an
�.deauat� parking axeao The corner involved could be removed but it would rui.n
the aesthetics of the building.
MOTION by Minish to close the public hearingo
Seconded by Ha.rrisa IIpon a voice vote, there being no n.ays, the motion carried
unanimously.
MOTION by Minish to approve the request for the following reasons:
1. The vaxiance is for only o.ne corner of the building and to remove that
corner from the building would be a hardship as it would ruin the aesthetic
value.
2. Adjacent property owners had no objectiox�s to the building.

MOTION by Jensen, seconded by Myhra, that the Planning Commission receive
the minutee of the Building Standards-Design Control Subcommittee dated
July 2, 1969. Upon a voice vote, all voting aye, the motion carried unanimously
ORDER OF AGENDA•
Chairman Erickson reported that Item 5, continued re:oning request,
ZOA �69-08, by R. W. Wormsbecker be tabled for two weeka at the request of
the petitioner.
Mi0TI0N by Myhra, aeconded by Jensen, that the Planning Commission table
for two weeks the continued rezoning request, ZOA �69-08, R. W. Wormsbecker,
for the NW'� of the NW�, except North 16.6 Acres and SW'� of NW� of Section 2;
also the North 34.68 Acres of NE� of NE� of Section 3 to be re�oned fram M-2
(heavy industrial) to R-3 (general multiple dwellings). Upon a voice vote,
all voting aye, the motion carried unanimausly.
Chairn►an Erickson also added Item 10: Apartment Survey.
�1. PIJBLIC HEARING: REZONING REQUEST, ZOA �69-10, GEORGE BALTHAZOR: Lot 3,
Subdivision �10, Auditor'e Subdivision #94. Rezone from R-1 to R-3A.
Mr. and Mrs. Balthazor were present, but did not wish to comment.
^. . Chairman Erickson read the Notice of Public Hearing.
Curtia Shaw, 1386 Skywood Lane, presented a letter and petition oppos-
ing the resoning.
MOTION by Myhra, seconded by Fitzpatrick, that the Petition dated
July 7, 1969 opposing the rezoning, ZOA #69-10, with twenty-eight signa-
turea presented by Curtis Shaw be received by the Planning Commission and
that the letter dated July 7, 1969 with five stgnatures also be received.
Upost a voice vote, all voting aye, the motion carried unanimously.
The letter dated July 7, 1969 was read for the bmefit of the people.
Chairman Erickson referred to the Building Inspaction file on the buildin�
permits. In April 1965, a pe�it for a double bungalar by apecial use
pasmit wae isaued in an R-1 district. LetEers were subsequently �rrittsn
after an inspection sho�ing there were elsctrical facilities for thrae
families and stating this was in violation of the City Code as the building
permit Was for a double bungalaw. In Auguat, 1965 a letter pas vritten by
the Acting City Attomey stating thet the servicee were not prima-facia
evidence, but that the owner shou�d receive a letter reminding him that only
tMio familiet were allaaed and no .::ther occupant would be permitt�d. In
1967 a letter from the City Attorney indicated a petition was received that
three families were living in the premisea violating the Code and time Wae
graated for correction. In Auguet of 1968 Mr. Ankrum sent a memo to the
City Attorney advieing him of the eimilar situation. Naw we have the present
^ situation in which they are requesting a apecial uae permit for three
families to occupy a double bungalo�. A letter written by Hank Muhich, Chief
Building Inepector, on May 22, 1969 stated the petition was denied by ths

City Council fox three families in double bungalaw and they advised reaoning
would be neceasary. Since that time, he believed, the City had taken action
through legal council on this matter.
The Engineering Assistant said that the hearing was before the court on
June 3, 1969 and the court ruled that the petitioner was in violation and
would have to vacate one unit before June 30, 1969 and thia has been done.
At the preaent time, there are only t�o families living in the d�►elling.
It was brought up that it wae true that in the list of people living
within 300 feet, some of the names of adjacent neighbora Were left off.
The City reliea on the petitioner to supply names.
In answer to Mr. Shaw's question, he was informed the preaent occupants
were Mr. and Mrs. Don Thompeon and Mr. and Mra. Balthasor.
Mr. Shaw said he was living in tha neighborhood at the time of the first
special uee permit, but he was not too intereated at that time.
MOTION by Jenaen, seconded by Fitapatrick, that the Pla:ming Co�ission
close the public hearing of the rezoning request, ZOA #E69-10, G�orge Baltha-
zor, of Lot 3, Subdivision #10, Auditor's Subdiviaion #94, to be resoned
from R-1 to R-3A. Upon a voice vote, all voting aye, the �otion canied
unsnimouely.
Mr. Myhra said he checked the requeat from a financial point of view.
^ Ae added, it is hard to go bi�k and recon�truct the thinking through the
qears. Deliberate violation of the lav i• pratty hard to knaW. Mr. Baltha-
sor feele he has to have a�ltiple �rellixt� to make it feasible. The other
aide is the age old problem of spot soning -- you are helping aa individual
out of a problem aad cx��ting a problem tor other people. He did not iuurr
if he was ready to act on this.
Mr. Fitzpatrick said, that in via� of tl� fact� that hava come up
toaight which are new, he pas raady for a motion to tabla.

The public h�earing was tabled at the last meeting because the petitioner
was not preaent.
Because of conflict of interest, Mr. Myhra removed himself from the dis-
cuasion.
The following were present for this item: Thomae Swanson, Mr. and Mrs.
B. Novak, Gordon Sangster, Henry C. Dickinson, Ed Dropps and Don Nielsen.
Mr. Novak stated it was agreeable to them to add their property to the
plat as long as it was only one additional piece. They felt a large lot
would be more marketable than two smaller ones. They were informed that
easements would be required for public access, water and serwer. Mr. Novtk
would have a short driveway instead of a long one. He aeked haw soon the
impravemeat8 would be provided. Water and sewer could be under contract thia
fall and completed in 1970. The earliest for the final assesement roll prob-
sbly would be in 1971 or 1972. The platting could be done this year. Mr.
Nielsea stated there would be a drainage problem as the water in the spring
of the year does not run of£.
Mr. Sangster, apeaking as a reaident living in the area�expreased his
� desire to aee the exit to East River Road left open so as not to add to the
traffic ueing Riverview Terrace.
MOTION by Fitzpatrick, aeconded by Jensen, that the Planning Comni�sion
cloae the public hearing of the proposed preliminary plat, P.S. �69-07,
Brentwood Eatates (Revieed), Thomea Swanson, for all that part of Lot 34,
Revised Auditor'a Subdivision #7 lying East of the East line of Block 1,
Mi�aiasippi Vigw Addition. Upon a voice vote, all voting aye, the motion
carried unanimously.
With the approval of the petitioner and the interested parties present
this evening, the follawing motion was made.
MOTION by Jensen, aeconded by Fitzpatrick, that the Planning CoIImission
table until Member Mittelstadt arrived, the proposed preliminary plat, P.S.
#69-07, Brentwood Estatee (Revised) by Thomas Swanson of all that part of
Lot 34, Revised Auditor's Subdivision #7 lying Bast of the Eaat line of

Mr. Ronald Geramundson, 1390 69th Avenue: What would the setback be from the
road? We have the third lot to the West. All of us on 69th are at least 100
feet back. Also what kind of parking for the cars?
Mr. R. V. Pritchard, 4528 58th Avenue: Our plan shows aome cars under roof
parking. Our plana also show about 180 feet that we left as open ground area.
There will be grass, shrubbery, and the garages or buildings will be 35 feet
from the trees. This would show 180 feet for aetback, which would be an open
area and for overflow parking.
The drop off at the South end of the land was discussed. The Engineering
Asaistant brought in the Half Section topog map of the area. By allowing the
petitioners to use dawn to 860, the number of apartments would be 104 and not
108.
MOTION by Jenaen, seconded by Fitzpatrick, that the public hearing be closed
for the rezoning request, ZOA #69-08A Kaye W. Westerlund, of the North 824.7 feet
^ of the West Quarter of the NE� of the NE'� of Section 13, to be rezoned from R-1
to R-3A. Upon a voice vote, all voting aye, the motion carried unanimously.

The applicant, Mr. Swanson was not present. Mrs. Novak, wife of the owner
of the property, was present.

vote, all voting aye, the �tion carried unanimously.
The Engineering Aasistant said this proposed preliminary plat would be part
of the final plat, as he understood Mr. Swanaon purchased the extra lot and
wants to make one final plat.

Mrs. Novak said that no purchase had been made. She was asked to identify her
husband's signature on the application form, which she did. Inasmuch as Mrs.
/'1 Navak did not understand the purpose of platting, Mr. Jensen explained that in the
act of platting their property in conjunction with what Mr. S�anson previously had
approved, they did not lose any title to the property with the exception of 25 foot
right of way along the East line. They will atill be owners as they are today.
However, they will have three separate parcels instead of one large one. Mrs. Novak
said they still want one large piece.
Chairman Erickson explained the process of the final plat in which signatures
of all the owners are required, confirming that platting does not mean a change
of awnership.
Donald Nielson, 115 71st Way (Lot 31) said he had been contacted in regard to
selling 25 feet for s road easement, but could not come to terms with Mr. Swanson
about the price.
Mr. Gordon Sangster, 7169 Riverview Terrace, said his property abuts the pro-
posed plat. His objections were the eize of the lots were not compatible with
the area, the traffic from the lots would use Riverview Terrace.
1��OTION by Jensen, seconded by Fitzpatrick, that the Planning Commission continue
the public hearing of the proposed preliminary plat, P.S. ��69-07, Brentwood Estatee
(Reviaed) by Tom Swanson, for all that part of Lot 34, Revised Auditor's Subdivi-

the meeting of July 9, 1969 expecting Mr, Swanson to make an appearance at that

Chairman Erickson com�ented that he was particularly bothered by the fact that
the petitioner has not made an attempt to complete the access road of the original
plat which leaves it mandatory for the City to condemn the land to get a road in
there. The possibility is that the Novak's may not go along with this platting
if it is approved. He would like the two parties present.
3. PUBLIC HEARING: REZONING RDQUEST: ZOA ��69-09, SACRED HEART PARISH: Lots 5, 6, and
N� of Lot 7, B1ock 10, Hamilton's Addition to Mechanicsville. Rezone from R-2 to
R-3A.
MOTION by Jensen, seconded by Fitzpatrick, that the Planning Coumnission waive
the reading of the official public hearing notice. Upon a voice vote, all voting
aye, the motion carried unanimously.
The Engineering Aseistant said that the Church plans to sell off the North part
pf the cemetery which is not being used as a cemetery. Most of the property is
already zoned R-3 except the piece in the rezoning request. This will square up
the saleable portion. Access would come from Fifth Street.
Brunis Smoka, 2513 St. Anthony Boulevard: He explained that he represented the
Church. They have a large piece of land which could be used for some other purpose
than lying vacant. They have about 175 burials in the other part of the land that
they intend to keep. They want to rezone the unueed portion so that the land can
be put up for aale for multiple dwellings.

Mr. Frank Dircz was present to explain his plans to the Board.

4 The appli�ant wae unable to get a copy of a survey of the property so a drawn
diagram wae presented to the Board, ahowing the existing lot lines, the proposed
lot line, the present house and garage, and the propoaed dwelling.
Mr. Dircz explained to the Board membera that he would not be-able to build on
this piece of land without the requested vaxiances and unless he was allowed to
.build on this �1ot he would ha,ve to let it go back on the tax rolls as he could
no� afford the taxes on it. He thought he would be able to build a 24 foot by
36 or 38 foot dwelling on the lot if the variances were granted. He would face
the p�oposed home toward 3rd Street to make the houses uniform. The propoeed
g�rage would be placed as far back on the lot as poseible.
MOTION by Minish to cloae the public hearing.
Seconded by Ahonen. IIpon a voice vote, all voting aye, the motion carried.
MO'I'T@N by Miniah to grant the requested variances for the following reaeons;
1. In view of the as$eeaments on the lot, a hardahip would be areated if the
variancea were not allowed as the lot would be unbuildable and possibly would
go back on the tax rolls as tax forfeit land.
2. The_applicant has maintained this corner lot even though it was unbuildable.
3. There were no objectiona from acjjacent property owners.
Seconded by HarriB. Upon a voice vote, all voting aye, the motion earried
unanimouely.

Mr. Arthur Deys.was present to present his request to the Board.A Survey and pi�tures
of the property were ahown to the Board. The survey ehowed that the lot ia beira�
split in an angular manner.
A discussion followed which involved where the present garage could be located,
having the garage torn down all together, having the house, which is presently
there, torn down before the lot split. They also diecussed the distance between
'� ^ the preeent atructure and the propoaed structure. As it now stands, there will be
10 feet between them and the aode does call for 15 feet for fire control.
The Board did recommend to the appZicant that he should split his lote into 60 foot
lats instead of in the angu�lar manner. "
�MOTION by Miniah to table the request until July 30, �969 to al�.ow the applicant
' to bring in a preliminary eketch showing how the proposed home is to be positioned
' on the lot. This will ehow the Board a truer picture of the exact measurements
