MOTION by Jensen, seconded by Myhra, that the Planning Comnission
apprave the Planning Carmnission Minutes of July 23, 1969. Upon a voice
vote, all voting aye, the motion carried unanimously.

Myhra called attention to Page 2 of the minutes and the wording in the
motion for lot split �69-21 by Walter Wittman asking that the intent of the
motion be clarified. The first sentence of the motion should read "recom-
mend denial of the lot Split, L.S. #69-21,----".

receive the minutes of the Plats & Subdivisions-Streets � Utilities Sub-
counnittee dated July 30, 1969 and include the above clarification. Upon •

RBCEIVE BOARD OF APPEALS MINUTES: JULY 30, 1969:
MOTION by Mittelstadt, seconded by Myhra, that the Planning Commiss�on
receive the minutes of the Board of Appeals dated July 30, 1969. Upon a
voice vote, all voting aye, the �tion carried unaniuwusly.
ORDER OF AiGENDA •
Chairman Erickson explained that the two requests received this evening
would be taken in the following order: (10) Lot Split �69-22, Richard
Gjevre and (11) Arthur Deys referred by Board of Appeals.
1. CONTINUED REZONING REQUEST: ZOA �69-10, GIBORiGE BALTHAZOR: Lot 3, Subdivi�
sion �10, Auditor's Subdivision �94. Rezone from R-1 to R-3A.
Mr. and Mrs. Balthazor were present.
Reviewing the facts discussed at the last meeting, Mr. Myhrs said that
one of the things suggested was the fact that this would be an economic
hardship if denied. There is evidence right from the beginning that the
^ City tried to make it clear to the petitioner it was a duplex which allawed
only two families.

The Chaixman said he could understand that a retired person, Iiving o�n a
� fixed income� could find that keeping the house and paying the taxes would be
difficult. However, to rezo�e the property would be bad spot zoning of the
worst type. He was not sure he would be willing to ask the Ci,ty Council t4
allow the pe�it�,oner to have use of the property as three family dwelling
under the present ordinance.
Mx. Mittelstadt asked to have this request and the Peterson request on
69th Avettue clarified. The differenee was that Mr. Peterson was going to build
on a lot where there was no structure, and Mr. Balthazor's structure was a].-
ready there.
The Chairman suamned up the discussion by saying it seemed to him that
what the Planning Commission is trying to say to the petitioner is that if
he can't put three families in the dwelling, he would have to sell. This may be
true. It would not make any difference to him if a retired person, living in
a single family dwelling, would want to put a family in the basement, but put-
ting three families into a two family xesidence should not be granted.
1�OTION by Jensen, seconded by Myhra, that the Planning Comaission deny the
rezoning request, ZOA �69-10, George Balthazor, of Lot 3, Subdivision #10,
Auditor's Subdivision �94 to be rezoned from R-1 to R-3A for the reasons that
it would be a very flagrant example of spot rezoning and that such rezoning
would be detrimental in the center of a single family neighborhood. Upon a
voice vote, all voting aye, the motion caxried unanimously.
2. CONTINUED PRUPOSED PRELII�NAIZY PLAT, P.S. #69-09, MIKE 0'BANNON: Lots 11, I2,
� 13 and 14, Auditor's Subdivision #22 and Lots 1 through 16, 24, 25 and 26,
Block 1, Irvington Addition.
" The Chainaan stated the Planning Commission had asked for a preliminary
plat with topog and more specific details as far as lot eize were concerned.
Mr. 0'Bannon came forward with the topog map. He showed the plans for the
sewer and road and acknowledge that he had forgotten to have the location of
the Skog house shown. His measurements showed a little over 35 feet of setback.
The Chairn�an said he was satisfied with the preliminary plat, except for one
thing -- that the building should be shown. Mr. Jensea auggested Mr. 0'Bannon
get a boundary survey showing the buildiugs and the lot lines. This would be
for his own protection. In a spirit of cooperation, Mr. 0'Bannon is working
details out with the two owners. He would have no objections if the road were
to move one way or the other a couple of feet. This is the kind of thing
that ought to be considered in the actual computing of the final plat. The
Engineering Assistant said the Council is looking at a preliminary plat, and
until after the final plat is made, no boundaries are required.
MOTION by Jensen, seconded by Mittelstadt, that the Planning Ca�ission
recomnend approval of the proposed preli.minary plat, P.S. #69-09, Mike 0'Bannon
of Lots 11, 12, 13 and 14, Auditor`s Subdivision #22 and Lots 1 through 16, 24,
25 and 26, Block 1, Irvington Addition as shown on the drawing labeled "Pro-
posed Plat, P.S. �69-09, August 6, 1969" including the area outlined tn a
red pencil on this print subject to the provision that the petitioner pravide
a boundary survey which indicates that the existing buildings on the property
^ wili fit on the lots as described by the zoning ordinance prior to the accept-
ance of the final plat. Upon a voice vote, all voting eye, the motion carxied
unanimausly.

MOTION by Myhra, seconded by Mittelstadt, that the Planning Commission
continue until September 3, 1969 the proposed preliminary plat, P.S. ��69-07,
Brentwood Estates (Revised), Thomas Swanson. Upon a voice vote, all voting
aye, the motion carried unanimously.
4. CONTINUED REZONING REQUEST: ZOA #69-08, R. W. WORMSBECKER: Northwest Quarter
of Northwest Quarter, except North 16.6 acres and Southwest Quarter of North-
west Quarter of Section 2; also the North 34.68 acres of Northeast Quarter
of Northeast Quarter of Section 3, to rezone from M-2 to R-3.
Mr. Wormsbecker said his plan was ct�at they have found some of the
ground is good and some is bad, and until they can get the City Engineex
to tell them the elevation of the service road on University Avenue, they
cannot develop the property. The ground is generally sloping towards the
river and they might have to put in four or five feet to make it level.
He said he would like to put in a shopping center, but you have to have
people and there is enough land to put in S00 families. This would be
adequate for a shopping center.
He asked the Planning CoAanission to pass the request to Council inasm�.tch
^ as they have a couple parcels of land they could sell to industrial.
Darrel Clark said the Federal Government approved Fridley's request for
Federal Aid for Park Development. The Federal Govermnent approved the xe-
�uest for park acquisition, but the City must bond itself for the entire
cost and after that is done, the Federal Government would reimburse 50%.
This procedure would take some time. Mr. Wormsbecker wondered if it would
be feasible to rezone the South 40 acres and keep the part the City would
be interested in abeyance. The Chairman felt this would put the City in a
peculiar position because if they rezoned the 40 acres and the project did
not go through, the land would be rezoned for apartments in the middle pf
an industrial area.
Mr. Wormsbecker said that if the park did not go through, and if the
City would rezone the land to multiples, they would fill it with apar�nts,
and in time they will get a shopping center and some industrial -- it would
not be spot zoning, but apartments, shopping center and industry.
The Chairman listed items to be considered: 1) whether or not this
corner should be R-3 development. 2) whether or not the park bond issue is
decided 3) whether or not any decision should be made until the Planning
Caamission complete the study of multiple dwellings in Fridley, but the
petitioner has practically solved this decision because he wants a decision
this evening.
^ MUTION by Myhra, seconded by Mittelstadt, that the Planning Comni.ssion
recommend denial of the rezoning request, ZOA #69-08, R. W. Wormsbecker o£

proposal for this area of open space the Planning Coumissionccould not in good
judgment change the zoning at this time. The petitioner has related some intox-
a►ation to us that presumably could affect the decision on the part of the Council
but did not think that the Planning Commission could use it as part of their
judgment. Upon a voice vote, all voting aye, the motion carried unanimously.

5. LOT SPLIT REQUEST: L.S. 4�69-21, WALTER E. WITT1�fE1N: South Half of Lot 1, Block 1,
Spring Valley Addition.
Mr. Walter Wittman was present.
The Subcommittee at their meeting of July 30, 1969 recoa�ended denial of the
lot split request, the prime factor being the fact that the half road was needed
on the South and would not leave enough land to split.
Mr. Wittman said he still would like to get two buildable lots. Referring
to the easement for road, he said there were only two lots in the area that
dedicated the easement. He wondered if he could build on a smaller lot next to
Larsen and have a bigger lot on the South end so that if the easement did go
through, he would still have a good sized lot. He had not talked to Mr. Larsen
about either buying some of his property or selling part of his lot. He checked
the area and found there were homes build on 60 foot lots. If the easement is a
maust� he continued, he would give enough land for easement, but he still wants
two buildable lots.
Mr. Myhra said that those houses built on 60 foot lots were either built
earlier or else built under variances. They could have been built on lots platted
prior to the present ordinance. Mr. Jensen said it is obvious that people in
this area with very large lots will someday think in terms of getti:tg rid of
some of their property. If we were to start on the end where Mr. Wittman's parcel
is without a street, and then find, in the future, the rest of the people want
to split the back off their lots and dispose of some of their property, we would
not have a road to get to the internal lots.
Mr. Wittman was informed that if the City decided a street should go through,
then they could condemn. If a 25 foot easement were given, Mr. Wittman would have
a 125'x125' lot. Mr. Wittman did not feel that he could build a house on the
land,without the lot split�which would sell because the neighborhood has smaller
homes. He felt the kind of house that should be built to conform with the neighbor-
hood, could be put on two lots. He said he could not have a 75 foot corner lot
if he gave 25 feet. He has owned the property for twelve years.
I�OTIOTi by Jensen, seconded by Myhra, that the Planning Cotmnission concur with
the reco�endations by the Subcommittee to deny the Lot Split, L.S. #69-21,
Walter E. Wittman, of the South Half of Lot 1, Block 1, Spring Valley Addition;
the reasons behind the disapproval involve a 25 foot road easement which is deemed
necessary, thereby yielding a lot which is not suitable to give two buildable
lots, thus there is no logic behind apprw ing the lot split. Upon a voice vote,
all voting aye, the motion carried unanimously.
� 6. VACATION REQUEST: SAV �69-06, LEO 0. LEMI�: Vacate 47th Avenue between 3rd Street
and University Avenue (Lot 30, Block 9, Plymouth Addition).

� Mr. and Mrs. Leinke were present.
Mr. Lemke said he acquired the lot tax forfeit in 1962. He bought it
as a 40 foot lot and found out later it was only 38'� feet. He kept the lot
and paid the taxes. Since 47th Avenue was closed, he hoped to �ut a house on
it. The sewer lateral is in the road so the City probably would want to retai.n
the easement.
The Engineering Assistant explained that it is a storm sewer located 1�
feet South of the centerline of 47th Avenue. The City's recommendation is
to retain ten feet on either side of the pipe. This would give Mr. Lemke 7
feet more to build on and the rest would be lawn.
MOTION by Mittelstadt, meconded by Myhra, that the letter from Mr. and Mrs.
Gerald Haxwell, 4710 3rd Street Northeast referring to SAV �69-06, Leo 0. Lemke,
be received. Upon a voice vote, all voting aye, the motion carried unanimouely.
The Engineering Assistant said he received a call from Mrs. R. E. Gordon
who said she did not object to the vacation, but did see a dire need for a
walkway to cross the highway to the bus stop. She had talked to the neighbpr-
hood and felt there would be quite a few at the meeting.
In the discussion regarding the walkway, the coament was made that because
the party on the north side of 47th Avenue did not respond to the notice mailed
to him, he was not interested in the vacation. In that case, the City could
retain the North Half for possible walkway. Mr. Jensen said the path is well
� worn and there is old surfacing on it.
Referring to the alley adjacent to T.H. �47, the Comaission felt some
right of way should be maintained to keep access to it.
1�TION by Mittelstadt, seconded by Jensen, that the Planning Carmission
reca�nend approval of the vacation request, SAV �69-06, by Leo 0. Lemlce, to
vacate 47th Avenue between Third Street and University Avenue, vacating only
the South Half of 47th Avenue and that the petitioner should grant an easement
to the City on all but the South 7 feet for utilities. That said vacation
would be only to the West line of the alley and should not be closed off at
this time. Upon a voice vote, all voting aye, the �otion carried unanimously.
7. LOT SPLIT RBQUEST: L.S. #69-20, FRANK DIRCZ: Combine 10 feet of Lot 29 with
Lot 30, Block 1, Plymouth Addition.
Mr. Dircz was pr�sent.
The Chairman said the action of the Subcam�ittee was to reco�mend denial
for two reasons, one being the fact that the proposed lot would have on one
side 49th Avenue which is a heavily traveled main artery affording little
boulevard, therefore the proposed 11 foot setback seemed very inadequate and
that the total of five variances,already granted fram the Board of Appeals,
does not seem to meet the intent of the City ordinances designed to prevent
this sort of thing.
� Mr. Dircz presented a petition by the adjoining property owners approving
the building of a suitable home to be built on Lot 30. The petition was signed

receive the petition, dated August 5, 1969, refexring to Lot Sp1it, L.S.
�69-20, by Fxank Dircz approvi�g the building of a suitable home on Lot 30.
Upon a voice vote, all voting aye, the motion carried unanimously.
MOTION by Mittelstadt that the Planning Co�nission recaamend approval
of Lot Split request, L.S. �69-20, by Frank Dircz to combine 10 feet of Lot
29 with Lot 30 and also approve recomnendations made by the Board of Appeals
to grant the following variances: Section 45.29 reduce lot width from SQ feet
to 45.12 feet; Section 45.29 (2C) distance between living areas from 20 feet
to 15 feet; Section 45.24 street side corner lot from 17� feet to 12 feet;
Section 45.28 reduce lot area requirement from 7500 to 5820 square feet;
Section 45.23 sideyard reduced from 10 feet to 5 feet on existing home, to
allow the applicant to split his lot for a saleable home.
The P�OTION FAILED for lack of a second.
Mr. Jensen explained that he did not think it would be appropriate to
grant the proposed lot split with its many variances. The minimum lot size
is 60 feet. With these numerous variances, the lot is really not suitable
for a single f�nily dwelling. It was his own impression that this lot would
be more suitable purchased by the City or County in all or part for a road
right of way. There is a most serious shortage of right of way in this axea.
^ The boulevard for the lot would be five feet. Plawing a street with a�ive
foot right of way is not wide enough, and a sidewalk is needed on that side
of the street. For children to be walking in such a street is ridiculous.
He thought it would be a far more appropriate thing for the City or CounCy
to acquire part of that lot and Mr. Dircz retain what is deemed necessary.
MOTION by Jensen, seconded by Myhra, that the Planning Co�ission recom-
ment denial of the lot split request, L.S. 4�69-20, Frank Dircz, to combine
10 feet of Lot 29 with Lot 30, Block 1, Plymouth Addition and concur with
the recamnendations of the Subcomonittee as follows: 1) The proposed lot
would have on one side 49th Avenue which is a heavily traveled main artery
affording little boulevard, and the proposed 11 foot setback seems very
inadequate. 2) The total of five variances already granted from the Board
of Appeals does not seem to meet the intent of the City ordinancea desig�ed
to prevent this sort of thing. 3) The City should study this lot as a pos-
sible area to acquire more right of way to, perhaps, provide room for fu�ure
turn lanes and sidewalks. Upon a voice vote, all voting aye, except
Mittelstadt who voted nay, the motion carried.

^ The Engineering Assistant reported that there was no need for a sewer
easement for this request because the sewer was located about 12 or 15 f�et
onto the property of the Knights of Columbus in Harstad Addition.

mend approval of the lot split request, L.S. #69-19, North Air Home Association,
J. R. Plemel of the South 150 feet of Lot 18, Brookview Addition, subject to
road easement over South 50 feet. Upon a voice vote, all voting aye, the
�tion carried unanimously.
9. LOT SPLIT REQUEST: L.S. �69-22, RICHARD GJEVRE: Splitting a strip of land
approximately 10 feet wide along the Westerly edge of Lot 4, Block 1, Sand-
hurst Addition for additional yard.
The Engineering Assistant explained that the purpose was to acquire
more yard for Lot 5. Mrs. Lori Rakos, owner of Lot 4, signed the petition,

recomnend approval of the lot split application �69-22, by Richard Gjevre
which calls for selling a strip of land approximately ten feet wide along
the Westerly edge of Lot 4, Block 1, Sandhurst Addition. Upon a voice vote,
all voting aye, the m�tion carried unanimously.
10. LOT SPLIT R�7QUEST: L.S. ��69-15, ARTHUR DEYS: Lots 3 to 5, Block 7, Hyde Park
Addition. Referred to Planning Comnission by Board of Appeals at their me�t-
ing of July 30, 1969.
The Chaixman explained that the Board of Appeals requested denial of the
lot split until the old house was torn down and then Mr. Deys return for the
lot split.'

I�OTION by Jensen, seconded by Mittelstadt, that the Planni�g Comnission
acknowledge the action of the Board of Appeals and table the lot split request,
L.S. �69-15, Arthur Deys, for Lots 3 to 5, Block 7, Hyde Park Addition until
such ti.me as Mr. Deys comes back. The lot split is to be granted at such time
as the new house is built and the old house torn down and the application be
made for the lot split showing that there are no variances other than those
already granted. Upon a voice vote, all voting aye, the motion carried unani-
mously.
11. AMBER OAKS PLAT: To correct platting error, returning "triangle" from Lot 1,
Amber Oaks to Lot 2, Block 2, Worrel's Addition.
The Engineering Assistant explained that in the Worrel's Addition, part
of Outlot 2, a 50 foot strip out to Stinson Boulevard was proposed for future
street and a radius was included with it. However, in the plat of Amber Oaks,
this street was changed which caused this portion to be part of Lot 1. There-
fore, part of Lot 1, Amber Oaks is actually in front of Lot 2, Block 2, Worrel's
Addition.The owner of Lot 2 in Worrel's Addition is willing to accept a deed
for the emall triangle which would result in a straight lot line between
adjoining lots.
MOTION by Mittelstadt, seconded by Myhra, that the Planaing Commiasioa
has no objections to splitting off the "triangle" from Lot 1, Amber Oaks,
provided a proper lot split application is signed by the petitioner and the
^ party it is being sold to, being the property lying south of the south line
of Ambsr Oaks. Upon a voice voLe, all voting aye, the motion carried unanimously.

� Mr.Jensen couanented that normally the Planning Cammission asks that the
criteria for a lot split be a simple description, but in this case, the plat
has already been filed and the parcel involved is�so small, that the
' d�scription part of the ordinance should be waived.
12 . I�TLTIPLE D�+iELLING ST[1DY IN THE CITY OF FRIDLEY :
The Engineering Assistant said the data is completed, but is being
checked and has to be typed. Because there would not be a xegular meeting
an August 2Q, 1969, the Commissian would take that time to study the facts
compiled for the Multiple Dweiling Study.

There being no further business, Chaixtnan Erickson adjourned the
meeting at 10:20 P.M.

would enhance the neighborhood and improve the property values.

Chairman Mittelstadt explained to the audience what took place at the last
meeting, August 13, 1969, and that the Board had tabled the item to allow Mr.
� Olson time to consult with his builder for the reason �f drawing up alternate
plans that would come closer to the City Code sideyard requirement. He then
asked Mr. Olson if he had brought such plans with him.

Mr. Darrel Durand, Route �3, Stillwater, builder for Mr. Olson, explained to the
Board the alternate methods Mr. Olson and himself had gone over and the
difficulties they had encountered with each alternate plan. He also stated the
reasons why the original plan would add the most to the appearance of the home
and would give the Olson family adequate living space. He also said the cost
of other alternate plans would be a great deal higher due to the work involved
than this one. The proposed addition is 15 feet by 26 feet and will be added
onto the South end of the house making the i�ome a total of 45 feet by 26 feet.
The addition would consist of a living room with bedrooms above.
Mr. William Keefer, 2408 Central Avenue, attorney representing Mr. Olson, stated,
Mr. Olson was living in a home in Minneapolis, but has had to sell as his family
was outgrawing the home and at this time he could not afford to build onto it.
Mr. Olson explained to the Board that he has his wife, 5 children (4 boys and a
girl) and his brother-in-law living with him at the present time.
Mr. Keefer continued that Mr. Olson went ahead with the closing costs, on the
Minneapolis home and gave his tenants a 30 day notice at 5614-5th Street as his
family wanted to move back to Fridley. Mr. Olson thought he would be allowed
to enlarge this home as he had received Mrs. Adelmann's approval for the addition.
This is a small 2 bedroom house that is almost 20 years old. The Olson's ire
planning on bringing this home up to date by stuccoing the house and the garage
and refurnishing the inside. He stated further that Mr. Olson is in a rather
awkward position at this time. �

Minutes of the Board of Avpeals meeting of Au$ust 27, 1969 Pa$e 2
Mr. Speakman, 118 East Main, Anoka, attorney representing Mrs. Adelmatin, stated,
he had brought with him a petition, against the requested variance, signed by
14 property owners (Note: 6 were within 200 feet of the property in question.)
and included in the names are the people living directly across the street. He
presented this petition to the Board along with pictures that showed the lot line
and where the proposed addition would be. He further explained that Mrs. and Miss.
Adelmann had just gotten home fram vacation and were rushed when Mr. Olson came
over asking for their approval for the addition. They did not take time to
think about what Mr. Olson was planning on building and signed the "no objection"
letter but they have since thought about it and have changed their minds. Also, the
Easterly window on the proposed addition w�ll look directly into Mrs. Adlemann's
bedroom window.
Mr. Olson stated that he had asked, at the last meeting, if a petition would do
hiin any good and the Board had said it would have no bearing. OtheYwise, he to
would have passed one around.
Chaix�an Mittels�adt informed the applicant that the Board would take that into
consideration.
MDTION by Minish to accept the petition, against the requested variance, presented
to the Board by Mr. Spealanan.
Seconded by Ahonen. Upon a voice vote, all voting aye, the motion carried
unanimously.
Mr. Gary Cheney, 5609-5th Street. He could see no reason as to why Mr. Olson
should not be allowed the variance as in driving axound the neighborhood there
is an equal number of homes that are 5 feet away from the lot line and homes
that are 10 feet away from the lot line. In fact 4 people on the petition have
their houses within 5 feet of the lot line.
Mr. Younglove, 5545-5th Street. What are the requirements of the City Code
concerning sideyards?
Chairman Mittelstadt explained the City Code requirements on sideyards and also
the rsquirements of space between structures.
Mr. Younglave wasin favor of those requirements and he didn't feel that the City
shoal.d allaw houses to vary in those requirements even though some houses are
closer to the lot line thatn the City Code permits.
Mrs. Walter Johnson, 5643-4th Street. Our objection to breaking the City Code
is that we have a house to the South of us that is in a condition where it will
have to be torn down in the near future. We will not want them to ask for a
side}tard variance when a new house is built there. If we let them (Olson's)
vary the sideyard requirement we will be setting the neighborhood precedent,
and anyone can come in and ask for a variance can't they?
Chairman Mittelst$dt explained everyone has the right to come before the
^ different Boards of the City to ask for variances of the City Code requir ements.

Upon a request from the audience, Chairman Mittelstadt explained the plans for the
proposed addition.
Mr. Durand then explained in more detail the plans to Mrs. Adelmann and the reason
why they want the plans the way they are and the reasons against other alternatives.
Mr. Burton, 5604-5th Street, asked if the City Code had any restrictions on how
many people can sleep in a bedroom.
Chairman Mittelstadt answered that there is no such restriction in the City Code.
Mrs. Adelmann; If he is going to enlarge his house, he will �e taking away from
his yard and then where will his kids play. They will be on our yard. I think
he should put up a fence the whole length of his lot line between the two houses.
Mr. Olson:

I do intend to fence in the back yard.
Is there anyway the two principle parties could compromise.
Mr. Olson: I would be willing to cut down the addition from 15 feet to 12.5 feet.
The drawing submitted would be the same except the 2.5 foot closet area between
the present hane and the proposed addition would be eliminated. Also, the
Easterly window, facing Mrs. Adlemann's home will be changed and will be placed
further West so it won't be directly across from their bedroom window.
Mrs. Adle�mann did not approve this compromise.

Mr. Donald Fleigle was present to present the request.
(NOTE: Mr. Fleigle brvught his house plans in to the Building
Inspection Department on June 18, 1969. The plans were checked
and a permit was issued at this time. On Au�ust 27, 1969, the
adjecent property owner, Mr. Doug Lumby, called the Building
Inspector about the position of this home on the lot. The
Building Inspector went out and checked the location, and noted
an oversight had been made in checking the plans. The plans that
were submitted showed a living area over the garage and according
to the City Code, this requires a 10 Poot sideyard. The Inspection
Department in checking the plans did not notice the living area,
over the garage, and allowed the applicant to place his home, on
the lot, with a 7 foot sideyard as the City Code states an attached
garage may be 5 Peet Prom the property line.
At the time that the Building Inspector noted the oversight,
he asked Mr. Fleigle to stop work on the home and to Pill out an
application to appear bePore the Board o;t Appeals P�r a variance
oP the sideyard requirement. Mr. Fleigle was very cooperative ia
doing so.)
Mr. Fleigle explained his house plans to the Board and to the
audience. He said he had not planned on breaking any oP the City
Codes and did not know that he was doing so, as the Building
Department had approved the plans. IP the overeight had not been
made, he could have moved his home over 2 Pset on the lot and
decreased the size(length) by 1 Poot, which would have been in
line with all the requirements, but at this time the Poundation
has been built. To correct the mistake the whole thing would
have to be to�n out which would involve a sum �t money (approa.
$2,000.00) and a great deal of time loss.

Mr. Dnug Lumby, 40 Rice Creek Way, asked the Board what the
requirements were on sideyards.
Mr. Harris explained to him, and the audience, what the requirements
were on sideyards and slso the requirements on space between livable
and nonlivable structures.

of his home. iiis resson being the home would be 3 feet closer to
his than the City Code requires and also being it is a 1� story home

There was then some discussion, between Mr. Fleigle, Mr. Lumby and
the Board on how Mr. Fleigle would landscape his lot se he wouldn't
be draining onto Mr. Lumby's l.and. The Building Inspector explained
the drainage pattern for this lot.
Mr. Lumby did state that he was not against tYie house but he was
concerned about his own property.
Mr. Bob Stuart, 17- 67th Way asked iP this variance, if granted, set
a precedent in the neighborhood.
Chairman Mittelstadt stated that each case that comes bePore the
Board is treated individually and the Board's decisions are not
� based upon what happened to other va.riances. The decisions are
based on what is presented at the meetings as to whether there
is a hardship involved or not. No decision would set a precedent
in a nei�hborhood.
Mr. Stuart explained that he was against the variance as it would
Purther cramp the neighborhood. He does have 2 empty lots next to
him and he wouldn't like them to ask for the same kind c�'variances.
Mr. John Mayer, 33-66� way, stated that he felt it is the City's
problem as there was a gross oversight made on the part of the
City.
Mrs. Betty Blair, 40-66� Way said she felt the people at the meeting
were objecting more �o the house than to the three Poot variance.
She stated Purther that there are other 1� story homes in the area
that overlook ramblers.
There was a discussion on the grade oP the land in the area and
if turning the house ar�und wculd lower the height oP it at a11.
Mr. Fleigle explained that his garage Ploor is 18 inches above the

MINUTES OF THE REGULAR MEETING OF JUNE 23, 1969
MOTION by Blair, seconded by Stimmler, to accept the Minutes of the Regular
Meeting of June 23, 1969. The Motion Carried.
HARVEY PETERSON - ANOKA COUNTY CON1�fISSIONER
The Director said that County and State Officials have studied the Riverview
Heights Property and state that the river depth is not enough to warrant any
type of boat launch. They are now studying the depth of the river around
Chases Island for a possible future boat launch. Mr. Peterson said that the
County probably would not give funds for the development of a park this size
without a boat launch because it would not be used Uy all of the residents
of Anoka County.
Mr. Peterson informed the Commission that the Columbia Arena will be closed
all of this week while they prepare the ice and facilities for the onslaught
of hockey activities.
FEDERAL FUNDING - MEMO FROM CITY MANAGER
Councilman Harris was present at the meeting to answer questions that the
Commission may have regarding the memo from the City Manager on park grants
from the Bureau of Outdoor Recreation and the State. Councilman Harris said
that the money is now available but there is a time limit and the City must
act as soon as possible. Member Stimmler stated that the Commission has two
obligations to the citizens: one of these is to acquire land for future use
and the other is to develope parks to service the needs of the people now.
Member Blair stated that he thought it only fair that if we are going to
acquire more land for future use, then some of the now existing park pro-
perty should be developed at the same time. Councilman Harris answered that
in two years, the North Park Area could be considerably higher in price due
to the installation of water mains and the assessment incurred. The land is
available now and may not be in five years. The City has a possible popula-
tion saturation of 44,000 and many parks would be needed to service this many
people. He emphasized that the grants from the Bureau of Outdoor Recreation
and the State are for acquisition only and not for development.
MOTION by Blair, seconded by Stimmler, that the City Council make the
necessary arrangements to have the three areas, Spring Lake Park Area,
Parcel #30; Rice Creek Park Area, Parcel #620 and 640; and North Park
Area, Parcels #10, 300, 3000 and 3200, appraised. The Motion Carried.
Councilman Harris asked that the Council be reminded in the Minutes to review
the ro ress bein made in the urchasin of the S rin Lake Park Area and also
the Commission's motion from the May 26, 1969 Meeting requesting t e administra-
tion to have the City Attorney prepare a draft ordinance regarding prohibiting
motorized vohicles from c�riving o� parking in parks other than designated areas.

Program with the exception of the Indoor Figure Skating Lessons being further
studied and possibility of the Broomball games being played at a later time.

PARK ORDINANCE REPORT
Member Stimmler reported that he has studied the Park Ordinance Book from
the City of Minneapolis and said that some of the ordinances would apply
to the Fridley Park System but many would be of no real value. Vice-Chair-
man Cochran requested him to select approximately twelve ordinances that
could apply to the City.
FRIDLEY YOUTH FOOTBALL ASSOCIATION
With the Youth Football Program beginning soon, Vice Chairman Cochran said
that his main concerns in the program are that there be a guarantee of fizll
participation and an emergency plan in the e�ent of injury. The Fridley Youth
Football Association Board of Directors met with the Commission at their March
24, 1969 Meeting and the Commission was satisfied that these items would be a
part of the program.

Councilman Sheridan commented that it seemed senseless to him to vacate the
street and not the alley. The City Engineer said that the vacation is only
for the south � of the street. There would still be access into the alley,
but to his knowledge it is not being used. He said that if this is passed on
first reading, then before the second reading is given, there should be the
easements required, and the access to the property settled. Councilman
Sheridan said that he did not think that it should be vacated at this time
and the proper action would be to deny the request.
MOTION by Councilman Liebl to deny the Vacation Request SAV #69-06 by Leo O.
Lemke to vacate the south half of 47th Avenue between.3rd Street and University
Avenue. Seconded by Councilman Sheridan..� Upon a voice vote, all voting aye,

Mr. James Nelson said that the only change is that they would like to use
rough sawn cedar on the exterior rather than stucco. He then came forward and
presented the Council with tY�e plans and said that he hopes to have the buildings
complete by next June. Councilman Harris asked if he still met the require-
ments regarding the brick. The City Engineer said yes, and that he would re-
commend approval subject to obtaining easements and drainage plans.

edge Way apartments and approve the permit subject to the City qetting the

he would recommend approval of the plot plan, authorization for the Public
Hearing for the vacation of the 18' roadway for October 13 1969, and

is a franchised, sit-down type restaurant. They plan on a brick and cedar
exterior. •
MOTIDN by Councilman Harris to approve the plot plan as presented and set
October 13, 1969 for the Public Hearing on the vacation of the roadway and
also the 30' on the west side of the apartment building. Seconded by Council-
man Liebl.
Mr. Keith Holvenstot of Erickson Petroleum Corp. said that he appreciated
the help given him by the City Engineer. There was then some discussion of
the drainage plans with the Council. Mr, Holvenstot said that they had already
agreed to the sidewalks along the west side of the property, but it did not
seem likely to him that there would be very much pedestrian traffic alony the
south property line, and that t;his sidewalk would be wasted money. He said
that it would also seem unlikely that there would be a need for a sidewalk
along the north side of 57th Avenue as this would be the back of the apartment
house. Councilman Sheridan said that he 4rould aqree with him,'if he would be
willing to give an agreement for future sidewalks when they are put in from
Main Street to University Avenue. Mr. Holvenstot said that they ��ould agree
to do this and that the sidewalks may still be five years away. Councilm�n
Harris said that sidewalks may be developed along University, or possibly along
3rd Street for access to Holiday for the peo�le living to the norzh. Mx-.
Holvenstot said that they have no arguement with the sidewalks on the east
side of 3rd Street, that they plan on putting them in, and that he will further
agree to sign an agreement for future sidewalks to �onform to a future plan
at the City's discretion.
THE VOTE UPON THE MOTION, being a voice vote, all voting aye, Mayor Kirkham
declared the motion carried.
The City Engineer said as to the sign permit request, that it is too big,
and suggested that they come into the office and he will help them work on it.
APPROVAL OF PLOT PLAN DEVELOPMENT FOR SEARS STORE IN SHOREWOOD SHOPPING CENTER:
The City Engineer said that Mr. Saliterman has complied with eleven of the
things the Council wanted him to do, but there are two that he does not want to
do. He is objecting to sidewalks and the bicycle path. Mr. Williaan Jensen
said that he is providing a sidewalk easement along the service road and pro-
viding sidewalks along the south edge of the building. He said that he is
also providing parking as required, and a planting strip. Councilman Harris
suggested an agreement for the sidewalks along the north side. Councilman
Sheridan agreed that when the sidewalks between Central Avenue and Highway #65
are completed then he should have to put in tHe sidewalks, but at this time,
there is nothing to the east or west. The City Engineer pointed out that he
is platting this area also, and there are no easements for this par�ticular
piece, except as shown on the plans. Mr. Jensen said that the parking lots on
the north and west sides of the buildings are blacktopped and the parking lot
