The petitioner, �'homas Swanson, could not be prese.nt and Mr. Ed.tain A.
Dropps represented him at the meeting.
The Cha,irma,n brought the proceedings up to date noting �he public hearzxxg
was aloaed on July 9, 1969 and the laet meeti:ng was August 6, 1969. The unsolved
problems were the North�South road and the East�West road, whether or not access
would be on East River Road or Riverview Terrace. Mr. Swanson ha.d been called
regardi,ng tabling of his petition and he had not objected. Because of the .number
of people present, the Planning Commission had no obj�ctions to re-opening the
discussion at this time.
Mr. Dropps said that Mr. Nielsen had. agreed to dedicate his 25 feet on the
Eaet side o� his lot, and Mr. Swanson had a verbal agreement with Mr. Novak to
work out other easements„
Mr. Nielsen, owner of Lot 31, asked that if by dedicatixig 25 feet, this
would leave him with a lot too small to be bui�t on. His lot was approximately
80'x227' with the house being on the East side. He would be left with about 202',
and taking 102� for the lot with the house, the second lot would be 100'. The
solution would then be to go to the Board of Appeals and ask for a waiver of the
lot size froru 9,000 square feet to closer to 8,000 square feet.
Evelyn Goldma.n, 3518 Madison Place: Mr. Niel�en does not have a road, but
� a,� easement for access, and the school takes care of it. He wants ta sell and has

^ purchased a house in another area, but he is penalized because of the street,
as he cannot get an FHA loan.
Gordon Sangster, 7169 Riverview Terrace: He felt that by bringing the
East�West road through to Riverview Terrace it would encourage truck traffic
where tYiere is no tr_affic now, He said he recognized the objections to East
River Road access and felt the corner would not be any worse than coming out
on Alden Way and Stonybrook. It would permit trucks getting i.n and out of the
area without going through the residentiaJ_ streets and this would be a safety
factor.
The school board indicated a willingness to dedicate for a road going
Ea.st�West, but they objected to a cul de sac as it would interfere with the
playgroundo
Mr. Nielsen wondered if a less expensive blacktopped road could be
built, probably be a aead end, or go out to East River Road. He was told the
City would object to a dead e.nd because of the difficulty of plowing.
It was felt that the schoolboard could control the truck and bus traffic
on the road if it went through to Riverview Terrace.
Mrs. Ho Dickinson, 7175 Riverview Terrace: We are against the road con-
necting to Riverview Terrace. You would be bringing all these trucks in on the
sharp turn on Riverview Terrace where all tY�e children play around Loga.n Paxk.
We have bee.n aga,inst it from the very beginning. There should be only a walk-
i"1 way up the proposed street and fence the walkway from Riverview Terrace to the
schoolgrounds. Then the street should go out to Ea.st River Road.
Mr. Benedict Novak sa,id that he would just as soon see the street go
out to East River Road.
Jensen said that the City has been criticized by the County and by
private individuals about safety on East River Road. It is a County road and
not particularl.y safe one because of the volume of traffic. There axe a great
number of interseetions. The City has had under consideration, without speci-
fically adopting it, a pla,n for reducing the number of i.ntersections along East
River Road from end to end. This is not o�.ly one more intersection, but happens
to be a dangerous one because of the curve on East River Road.
Mr. Sangster said this is the same inconsistency as in Stevenson School.
There are ma.ny single dwelling lots faci.ng East River Road. He did not feel
they are ma,king a problem to pass along if the road goes out to East River Road.
Further, he did not think this is a dangerous intersection if it is properly
signalized. The School purchased three lots to change the entrance to Riverwood
5chool. Mr. Jensen said it was the traffic coming o.n Ea,st River Road whieh is
the problem.
Mx. Novak said he had not agreed t� having his land divid�d i.nto three
parcels. If Mx. Swanson wanted to buy it, all right, but otherwise he would keep
it for himself. He was in favor of the road going East.

� Mr. Dropps asked that the Planni.ng Commission make a decision this
evening either for or against the petition.
MOTTON by Mittelstadt, seconded by Fitzpatrick, that the Planning Commis-
sion re-study the secondary plan and return the request to the Plats & Subdiv�-
sions-Streets & Utilities Subcommittee with the possibility of getting access
on East River Road.
The Commission decided there were no new factors as Mr. Swanaon does not
own the property, and the request has been made to reach a decision this evening,
Mx. Mittelstadt withdrew the motion and Mr. Fitzpatrick the second.
THE MOTION FAILID.
MOTION by Jensen, seconded by Mittelstadt, that the Planning Commission
recommend approval of the platting requests, P.S. #69 ,01, and P.S. #69-07,
Brentwood Estates (Revised) bei,ng the rear 43�•6 feet of Lot 35 and rear 4�7-•9
feet of Lot 33, Revised Auditor's Subdivision #77 (P.S. #69-01� and that part
of Lot 34, Revised Auditor's Subdivision #77 that lies East of East line of
Block 1, Mississippi View Addition (P.S. #69-07) with the recommendation that
street access be provided to Riverview Terrace including the recommendation of
the Subcommittee as follows: (Feb. 6. 1969) appxove with the stipulation that
a 20 foot utility easement be provided from the cul de sac to East River Road.
Upon a voice vote, all voting aye, except Mittelstadt who voted nay, the motion
caxried.
� The Commission felt the Northwest corner of the North�South road should
�e curved �cu1 de sac� rather than a square corner for safety reasons.
Mr. Nielsen sa�.d that if he dedicated 25 feet, he would rather not split
the lot at the present time.

Present for this requeet were Mr. Albers, and Mr. and Mrs. Robert Oulicky,
The Commissio� felt that, as long as they received this request juat this
evening, they would like to look over the property before making a decisio.n.
Mr. Albers explained that at the North end is #694, the South end is the
Fridley water tower. The land, as it atands right now, has half the land being
kept by himself and his ne�,�hbors, the Oulickys. The area to the South is a
collection spot because no one gives it any care. The whole xeasan for this
petition is that he needa the additional land to put up a decent sized attached

The Comm�.ssion fel� there would not be a delay in actiox� if they tabled
the item until the next meeting aa�d Council could be asked to set the public

presented the new plans for the Developmento
The explanation of the Engineering Assistant was that the reason Mr,
Dumphy went to court was that he had asked for rezoning on Lots 32, 33 and 34,
Block 10, Spring Brook Parko A compromise was reached that these lots should
not be rezo.ned but could be used for�parki.ng under a special use permito A
new house had been built on Lots 32 and 33 and the developer can exercise the
right to sell or keep the houseo If the house should be sold, part of the back
of the 1ot will have to be retained as a buffero Mr, Dumphy stated it was his
impression that the square footage of the lots, walk and boulevard would be
counted in the overall footage for the complex, He could also construct a
building up to the lot line of Lot 350�
Mr, Dumphy added that the commercial property was goi.ng to be exactly
as originally gresented, They have lost the previous cbmmittments and will
have to start all over, In regard to access, he said that would be worked out
with the engineering department as to how they would work the boulevard and

The Commission felt a check should be made to see if Fridle,y's Code
is obsolete as it pertains to parking requirementso

� has, or is, going to get a deed from the State for ToHo #47 West Service
- Road from 57th Avenue to 57th Place which will then be abandoned, Third
Street will be paved from 57th Place to 57th Avenue by Erickso.n Petroleuma
They have asked that 18 feet of 57th Place be vacated to�be �.sed for
boulevard and parking loto He felt that in all cases, the Cit.y should
retain an utility easemento The Gas Company has acquired a separate
document for the easement covering themselves,
� called attention to the fact that, according to the
Ordinance, a minimum of 50 feet is required for a street making this
request only 2 feet below the City req�zirement, He felt the City should
not be in violation of this Ordinance. ^s long as the additional land
was to be used for parking and boulev�.. with a fence or hedge, the
Commission wondered if the request coula be modified so that the vacation
would be for 16 feet and then stay within the limits of the Ordinance,

A RESOLUTION REGARDING IlKPROV.II�NT OF EAST RIVER ROAD
AND INTfftSTATE HIGHWAY N0. 694 INTERCHANGE
BE IT RESOLVID by the P�anning� Commission of the City of
Fridley, Anoka County, Minnesota as follows:
Wf�iEREAS, the Interchange of East River Road and Interstate
No. 694 presently creates a traffic hazaxd which endangers life
and property and does not permit the safe a.nd efficient movement
of traffic and
WHIIiEA.S, existing traffic patterns axe confusing, co.ngested
and sight distances limited due to poor design and
WHF�tEAS, Ea,st River Road is an �.noka, County Hi$hway and
Interstate Highway No. 694 is a State controlled highway,
THII3EF'ORE, BE IT RESOLVID that the.Fridley Planning
Commission urges the Fridley City Council to take whatever
^ steps possible to study, ma,ke sugg�estions and encourage the
proper governing authorities to eorrect t�i� extremely
accident prone interchange.
