Drawings of the plans, Scheme 1 and Scheme 2 were exhibited for the Com-

� Mr..Solveson explained that since the last meeting with the people
in the audience, they have redesigned the building, two parcels in the
corner are now included in the pr.oject, and made two complete studies.

For both Scheme 1 and 2, the buildings basically are the same shape. They still
� have the same number of units and parking stalls. The house on Lots 32 and 33
will remain as it is. There will be an evergreen planting along the West and
North, and possibly an underground parking ramp. There will be a twelve unit
module interconnected with a stairway breaking up the complex, and a swimming
pool. The City has been given a 24 foot easement along East River Road. There
is a 35 foot setback on the East and 60 feet on.the North and 85 feet on the
South .
Scheme 1 is for a 12 unit building, interior pool area, firewalls separting
the modules, 24 two bedroom units and 84 one bedroom unit.
Under Scheme 2, the buildings are much the same shape, but they are further
away from the house situated on Lots 32 and 33. Some of the parking is to be
underground if possible, the recreation area is outside and includes a patio
area. The setbacks are 35 feet on the East and 70 feet from the creek. These
buildings would have 3b two bedroom units and 72 one bedroom unit. The elevation
is basically the same.
Mr. Myhra said he recalled there was somefihing in the ordinance referring
to a change of plans, and he wondered if the fixst plan had any bearing on the
one presented this evening. The consensus was the first plan had no bearing on
the new one .
Chairman Erickson asked if the Engineering Assistant had checked into the
� � use of the area on the Northeast corner. Darrel Clark said that it cauld be
used for parking, but he wasn't sure about the.axea occupied by the house.
tinder the PD ordinance, there is no specific area requirements.
The following people from the area, Jerry Potts, 8066 Ruth Street, William
Forster, 298 Ely Street and William Young, 8121 Ruth Circle were present and
expressed concern about the buffer of trees along Ruth Street suggesting poplar
and evergreens, and questioned the garbage disposal, traffic patterns, parking,
commercial area and proposed bri.dge on East side of shopping center. They also
wanted to know of the controls the City had over the plans. Chairman Erickson
read that part of the PD Ordinance which referred to the controls the City had
over the details of the final plan, and what was required at the preliminary
stage.
It was explained to the audience that at the pxevious hearings, there was
a traffic study by Bather & Associates. Their opinion was the traffic on East
River Road was not heavy enough to warrant signals at this location until a
later date when a traffic pattern could be studied. The Planning Commission did
take some action in that they asked East River Road be widened to provide for
ri.ght and left turn lanes at the ent�ance of the commercial area. This was the
pxinciple reason why an additional right of way had to be provided by the
developer. Chairman Erickson said the Planning Commission would be very much
opposed having another exit on East River Road, mainly because of the problem
o€ elevation. There is a difference in elevation between the road�and the com-
plex of about 15 feet -- a drop from the complex to the creek.
nRegarding parking, Mr. Solveson said the parking was figured at 1.5 stalls,
or 162 parking stalls. The Commission felt underground parking would be the
answer for either Plan and asked Mr. Solveson to try to incorporate this in the

plans, If the garages could go underground near the apartments, it would el.iminate
building by the creek. The Planning Commission asked Mr. Solveson to try for
two stalls per unit.
In regard to the exit on Ruth Street, Mr. Solveson said it was a requirement
to have two exits from the area.
The suggestion was made to use evergreens, poplars, and a redwood fence for
buffer between the house on Lots 32 and 33 and the complex. Mr. Dumphy said they
may sell the house because, at the present time, it is rented, but it would be
better to have the owner live in it.
Mr. Dumphy said the commercial area was the same as.before. The building
will have two floors. The entrance to the East would be primarily used by the
people from that area. A bridge could be built across the creek,.and a foot-
path leading to the residential area. This path would be adjacent to the lot
of Mr. Potts who said the people cross his backyard now.
Regaxding the procedure for the preliminary development plans, the audience
were told that, at this time, all the Planning Commission had to consider was
the overall plan. Upon the approval of the Planning Commission, the plan would
go to the Counciland anothex public hearing would be held. When the preliminary
plan goes before the Council, it becomes a final plan upon its approval. The
small details pertaining to the buildings, landscaping, sidewalk and traffic
problems will be handled by the Building Standards-Design Control Subcommittee
^ and if a variance �rould be needed, the Board of Appeals. Al1 work will be done
in accordance to the PD Ordi.nance under the directions of the departments
affected. Whatever permits are given by the Building Standards-Design Control
Subcommittee will be after a public hearing is held. The public hearings of the
Subcommittees will be the final public hearings for the pxoject.
Chairman Erickson added that, as far as he was concerned, he was about ready
to vote with a couple of additional suggestions. 1) More specific detai.l on
screening and planting of trees giving species and size.2)Statement of intent and
guarantee to protect present foliage along cxeek route. 3) Provision made for
future parking either at the time of the approval of the preliminary plan or a
guarantee they would add additional parking. 4) He liked Scheme 1 with Scheme 2
paxking incorporating underground parking. This would necessitate soil tests
and gxade plans wi.th specific proposed elevations throughout.
The parking 1ot facing Ruth Street could be depressed with a raised exit as
you drive out. Mr. Solveson asked if the exterior of the buildings, being stu.cco
and brick, met with their approval, and was told it appears to be what was asked
for. .
MOTION by Myhra, seconded by Mittelstadt, that the Planning Commission
continue the public heaxing to November 5, 1969 of the approval of the Preliminary
Development Plan fox the Planned Development District by Howard Dumphy and the
reason for doing so was to give the petitioner a chance to move forward on sug-
^ gestions as outlined by the Chairman listed above. Upon a voice vote, all voting
aye, the motion caxried unanimously,

^ 2. VACATION REQUEST: SAV ��69-08. CITY OF FRIDLEY: South 18 feet of 57th Place
lying East of line extended North that is 20 feet East of West line of Lot 7,
Block 7, City View Addition and West of the line that is 57.5 feet-West of
�enterline of Southbound lane of T.H. ��47.
3. VACATION REQUEST: SAV ��69-09, CITY OF FRTDLEY: Vacate 33 foot Street
between 57th Place and 57th Avenue lying East of Lot 15, Block 8, and
West of Lot l, Block 7, City View Addition.

The explanation was given that there is an agreement between the City of
Fridley and Erickson Petroleum Company to substitute the 3rd Street for the 33
foot street asked for in the vacation request. Erickson Petroleum owns both
sides of the 33 foot street.
The suggested exchange of property is as follows: the 33 foot vacated
street could be used for a parking lot; they have received from the Highway
Department a 57 foot strip adjacent to University Avenue and, in return,
dedicated a 6D foot right of way for 3rd Street. The street will be improved
. to City standards.
The people in the area were notified by public hearing natices.
MOTION by Mittelstadt, seconded by Myhra, that the Planning Commission
apgrove the request, SAV ��69-08, City of Fridley, for the vacation of the
South 18 feet of 57th Place lying East of a line e�tended North that is 20
feet East of the West line of Lot 7, Block 7, City View Addition and West of
/"'1 � the line that is 57.5 feet West of centexline of Southbound lane of T.H. ��47
and the request, SAV ��69-09, City of Fridley, for the vacation of a 33 foot
street between 57th Place and 57th Avenue lying East of Lot 15, Block 8,
and West of Lot 1, Block 7, City View Addition with the stipulations as follows:
SAV ��69-08: 1)reduction of the 18 feet vacation right of way to 16 feet leaving
the City with a 50 foat right of way; 2)consideration of the fact that we have
a street without a tuxn around; 3) that the remainder of the street not being
used could present"a maintenance problem; 4) unless'properly graded, there
could be a drainage pxoblem; 5) that the,City retain the utility easements in
the vacated portia�a: SAV ��69-09: Recommend the City retain all the appropriate
utility easements, according to the stipulations as passed by the Plats & Sub-
divisions-Streets & Utilities Subcommittee in their minutes of October 15, 1969.
Upon a voice vote, all voting aye, the motion carried unanimously.
4. CONTINUED VACATION REQUEST: SAV ��69-IO, THOMAS ALBERSt Vacate Johnson
Street on the West line of Lot 1, Block 2, Swanstrom's Courto
Mr. Albers was present. Also present were R. C. Staats, 536$ Matterhorn
Drive, Raymond Prestemon, 1391 53rd Avenue N.E., Clarence Engebretson, 5376
Matterhorn Dxive, and Robert Oulicky, 5332 Matterhorn Drive.
The Engineering Assistant explained that the Subcommittee decided, rather
than consider just one lot, that the abutting property owners shou�ld be sent
letters for the vacation of the full length 'of Johnson Street requesting 'their
^ opinions at the October 22nd Planning Commission meeting. The original request
was for alongside Lot 1. The Subcommittee felt the street, inasmuch as it had
never been txaveled, was of no use and could foresee no reason for it to be
opened in the future, but that the City should retain an utility easement. The
street, if vacated, would revert totally to the lots on the West side, and the
owners would dedicate the easements back to the City.

/� The property owners wanted to know how much the tax would be, but that
couLdn't be answered at this time. Mr. Engebretson was not opposed to the
vacation of the street. The answer to another question was that a building
could be put up right along the easement line. A fence could go right on the
lot line. If the whole street were vacated, and an owner did not wish to acquire
the land, he could sell it to.a neighbor.
It was suggested to Mr. Prestemon that if he were not interested in
acquixing the property for h�mself, he might talk ta the two rieighbors to the
East to see if they would be interested in enlarging their backyards.
MOTI�N by Jensen, seconded by Fitzpatrick, that the Planning Commission
recommend approval of the vacation. request, SAV ��69-10, Thamas 9ibers, to vacate
Johnson Street on the West line of Lot 1, Block 2, Swanstrom's Court with the
pxovision that an utility easement be maintained over the East 23 feet of the
proposed vacation and that, further, a vacation of the remaining portions of
Johnson Street North of Skgwood Lane and North of 53rd Avenue be considered at
the same time, providing that the adjacent property owners who would be receiv-
� ing the vacated street would not object to it. Upon a voice vote, all voting
aye, the motion carried unanimously.
5. REZONTNG REQUEST, ZOA ��69-11, NORTHERN PACIFIC RAI�.WAY COMPANY: That
porta.on between 40th and 41st Avenues N.E. and in the vicini.ty of Grand
and California Streets - approximately 2.19 acres -- to be rezoned from
^ R-1 to M-2 (heavy industrial).
Representing the Northern Pacific Railway Company were Iiouglas Shoemaker,
James Anderson and Jerry Masters. The request is to rezone R-T property to M-2
for the construction of a portion of railroad classification yard (departure
tracks and slope excavation in this area).
The Ordinance xequires 1500 feet between railroad switching yards and
residential, and the Noxthern Pacific Railway Co. is going befoxe the Board of
Appeals for a variance of the 1500 feet.
The Planning Commission were shown the proposed plans for modernizing the
railroad yard and explained in detail by Mr. Shoemaker, Anderson and Masters.
MOTION by Myhra; seconded by Mittelstadt, that the Planning Commission
set a public hearing date of November 19, 1969 for the rezaning request, Z0A
��69-11, Northern Pacific Railway Company, that portion between 40th and 41st
Avenues Northeast and in the vicinity of Grand and California Streets, approxi-
mately 2.19 acres from R-1, single family residence to M-2, heavy industrial.
Upon a voice vote, all voting aye, the motion carried unan unously.
6. EAST RIVER ROAD: TURN LANES FOR UNDERPASS NORTH AND SOUTH OF. HWY. ��694:
� �or the benefit of the audience, the Resolution regarding the improvement
of East River Road and Interstate Highway No. 694 Interchange, which was being
sent on to the Council for their consideration and approval,was read, No action.

� 7e METROPOLITAN PLANNING CONIMISSION:
The Chairman received a letter from the Metro.politan Planning Commission
regarding a meeting to discuss public ownership of the Ttain City Lines. He
felt he was not in a position to answer because he did not use the bus. A
suggestion might be made to cut some of the stops, as they need something that
gets downtown quicker. It seems relatively few people depend upon the bus.
MOTION by Myhra, seconded by Fitzpatrick, that the Planning Commission
request the Chairman to write a letter in lieu of going •to the meeting. Upon
a voice vote, all voting aye, the motion carried unanimously.
8. MEETING OF ANOKA COUNTY MUNICIPALITIES PLANNING MEETING: October 29, 1969:-.
Chairman Erickson would plan to attend.
9. ZONING ORDINANCE: REVIEW OF PARKING STALLS FOR APAR.TMENTS:
The discussion centered around the original zoning and the areas yet
to be developed. The Commission felt that the present zoning ordinance require-
ment of 1.5 stalls was inadequate at this timeo There was no action, but the
members were individually to do their own checking and report at the next meeting.

10. MULTTPLE DWELLING STUDY IN THE CITY OF FRIDLEY:
The Engineexing DeQartment compiled a booklet on Apartment Study in
Fridley in relation to the tax structure and school tax. The fact was discussed
that some of the income tax money is returned to Fridley as State Aid, and the
Commission felt this should be explained and put in the report as this would
more accurately reflect the tax load. No action, as the study was not completed.

Mr. W. C. Tuckfarber, Executive Vice-President of La Maur, and Mr.
James Slawin, Project Manager, of Cunningham-Limp Company, were
present to submit the plans and present the request to the Board.
There was a discussion on the storage area and on the chemicals that
will be used in the plant. A sample of the exterior metal panel
used on the building and a sample of embedded aggregate, were shown
to the �oard.
The landscaping plans submitted were deemed preliminary and a
recommendation was made, that phased landscaping plans be submitted,
to the Building Inspection Department, in 60 days.
The treatment of colored brick and block was nozed on the plans.
� MOTION by Biermann to approve of a full permit, subject to the
notations on the plans, with occupancy contingent on the submission
and execution af the landscaping plan.

submission of landscaping plan being approved by this Board within

MINUTES OF THE REGULAR MEETING OF SEPTEMBER 22, 1969
MOTION to accept the Minutes of the Regular Meeting of September 22, 1969.
The Motion Carried.
HOCKEY ASSOCIATION AGREEIyENT
The revised Hockey Association Agreement was signed by Member Blair,
President, Hockey Association of Fridley; Chairman Fitzpatrick; and
Paul Brown, Director.
MOTION by Stimmler, seconded by Cochran, to accept the signing of
the Agreement. The Motion Carried.
ORDINANCE ON PROHIBITING VEHICLES ON PARK LAND
T�ie Commission discussed the memorandum sent to the City Attorney from
the Director in which the Commission requests an Ordinance prohibiting
^ the use of motorized vehicles within the boundaries of the City park
areas.
CONCESSION STAND POLICY
The Commission reviewed the policy on concession stands within the City
that are located on park property. The Commission members requested
that the Director write a letter to the concessionaire at the Moore Lake
Beach House and ask what his schedule will be this coming winter. The
Director noted the license for the concession stand would terminate in
April, 1970.
1970 BUDGET ADOPTED BY CITY COUNCIL
The adopted budget will not be ready for two weeks. Chairman Fitzpatrick
suggested a special meeting be set up on November 10, 1969, specifically
to discuss the 1970 budget. This was agreed upon, providing the budget
comes through by that date.
PUBLIC RELATIONS AUTHORITY
The Commission discussed and reviewed the need for better Public Relations
coverage of our Parks and Recreation Department and to better inform
the general public of our many programs and accomplishments during the
year. Vice-chairman Cochran stated that we owe it to the public to let
them know what is available in our City parks. It was noted that our
� Director's weekly column in the Fridley Sun Newspaper;did cover our
Department, in gea►eral, but there should be special coverage on what
our parks can specifically offer the public. .

Chairman Mittelstadt explained to the people that were present to voice
their opinions, that the Board had decided to table these two requests.
The main reason being a quorum of the members was not expected to be at
this meeting, and also, since there were 4 other requests on the a.genda
to be considered at this meeting, the Chairman felt the Board would not
have sufficient time to go over the two items as much as they would like
to.

Pacific would be present to answer any questions they might ha.ve.
MOTION by Minish to table the two requests by Northern Paci�ic Railw�,y

Mr. Paul Amundson was present to present his request. Mr. John Polymeros,
representing the Sussel Company, was also present.
Mro Amundson presented to the Board a letter writt�n by his nieghbor,
Mr. Fred Glany, 7400 Concerto Curve, which atates that he does not object
to Mr. Amundson building a ga,rage 3 feet from the proNerty line.
MOTION by 0'Bannon to accept the letter from Mr. Glany.
Seconded by Minish. Upon a voice vote, there being no nays, the motion
^ carried unanimously.
Mr. Polymeros explained to the Board that the garage will be 21 feet by
26 feet, which is the minimum width for a double garage, in this case,
as we need room to install three steps going into th� house from the
garage.
A survey of the land and pictures taken by the Building Inspector, were
shown to the Board for their review. The survey showed Mr. Amundson's
house to be 24.01 feet from the lot line and 34.01 feet between structures.
A discussion followed on how the garage was to be joined to the house..
MOTION by 0'Bannon to close the public hearing.
Seconded b,y Harris. Upon a voice vote, there being no nays, the motion
carried unanimously.
Mr. Harris felt that although the applicant has the concurrance of his
nei�hbor, there still should be 15 feet between structures and in this
case there would be onl.y 13 feet.
Mr. Polymeros stated that they could put 5�8 inch sheetrock on the wall
facing the neighbors house so they would have a 1 hour fire wall.

Mr. Minish felt that that a hardship had not been shown as a single gara�e
� could be built in the same location without asking for a variance, and a
double garage could be built in the back yard as there was no difficult
terrain to deal with. He also stated he knew that a single garage was not
as desirable as a double garage but since the applicant could stay within
the limits of the City Code by building a single garage that a hardship was
not shown.
Mr. 0'Bannon was in favor of the variance as the applicant prefers a
double ga,rage and the abutting neighbor daes not object and there were no
other people present that objected. He also felt that a single garage
was just about useless and that a double garage would increa,se the value
of this house and also increase the valu� of the neighborhood.
Chairman Mittelstadt was in favor of the variance i.f the applicant would
agree to sheetrocking the far end wall along with the ceiling and the
common wall.
MOTION by 0'Bannon to approve the variance for the following reasons and
one stipulation:
1. The abutting neighbor does not object .
2. The construction of the house does not permit the necessary space
needed to build a double garage.
Stipulation:

1. The ga,rage be sheetrocked with 5�8 inch sheetrock on the common wall,
ceiling and on the far end wall.

Mr. Klein was present to present his request. Mr..Jim Thayer was also
present.
Mr. Klein present to the Board a letter from his adjoining, Mr. Joseph
Christenson, 460-67th Avenue N.E., stating that he did not object to the
variance but he did have one stipulation. That stipulation was "That all
drainage and run-off from this said structure will not interfere or drain
on the East abutting propert,y, and no part of this or any attached structure
will over-lap the East abutting property."
MOTION by Harris to accept the letter from Mr. Christenson.

Mr. Klein explained he could not build the garage in the backyard because
^ of the slope of the land.
Chairman Mittelstadt asked the Building Official if the Building
Inspection Department had gone out and measured the distance between the
present structures. The Building Official stated that they had measured
29 feet between structurea. He also said that Mr. Klein had started
building the garage.
Mr. Klein told the Board that he was under the impression he could start
building� as he felt he had, in a way, applied for a building permit by
applying for a variance. He also said the Building Inspector ha,d inspected
the footings. �
Further discussion followed which included the drainage, present house and
roof line, overhang, joining the house a�d g�.ra,ge together and the situation
of the garage.
Mr. Triayer was interested in how the garage and the hou�e were �oing� to be
joined together. He did state that he felt N1r. Klein had no other place
to build the garage except the place he was now building it.
MOTION by 0'Bannon to table this item until the November 12, 1969 meetin�
for the following reasons:
1. Get a memo from the Building Inspector stating that there are
/1 frost footings.
2. Bring a plan of roof line and the elevation of the building.
3. Get measurements from present house to the lot line and measurement
between structures.

Mr. Roger Jones and Mr. Al Davies were present to present the requesto
Mr. Jones presented a sketch to the Board ehowing the layout of the golf
range and where the buildings will be located. He explained the soil
is good for a driving range and the water is in in this area but there
is no sewer available, so a cesspool would be provided.
Chairma.n Mittelstadt felt since we don't have an overall plan for this
area that this golf range will start to open up this land.
Mr. Harris felt that although we don�t have a plan for this area as yet,
the golf range would be good for the area as we would be cleaning up some
of the weed problem and we would be creating some motion in land development
in this area.
Mr. Minish felt the golf rang� would not be incompatible with anything that
is the area and for that reason it would not inhibit anything that might
come up.

Mr. Harris stated we will be improving the area and it can't do anything
but help us. It may speed up the development of the area and it �,y move
the Cit.y to make up a long range plan for the area.

MOTION by Harrie to approve the request as the Board agreed it would
be an improvement to the area in every way.

The Building Official presented a letter to the Board, from Mr. Robert
Olson, 5614-5th Street, which stated that he still plans to stueco his
addition to his home but due to a change in the orig�inal estima.te he
is forced to delay this work for a time.
Mr. Robert Olson was before the Board of Appeal� for th� addition to the
house and one of the agreements was that he stucco the additiun to match
the house.

The City Attorney said that unless there'is more evidence for the two
northerly crossinos, he would recot�unend that an appeal not be talcen on these,
but that the City wait until there is a more pressi_ng need. Mayor Kirkham
said that it migi-« strengthen tlle appeal to drop t�e others, and make a
strong appeal for the 61st crossing. The City Attorney saicl th�i i� ar� appeal

Mayor Y•irkham asked if the City Attorney could determine what an appeal
would cost, and if just an ubjection is filed, or is there a chance to
present new evidence to strerigthen our position. The City Attorney said he
would be prepared to diseuss this at the joint meeting wi.th the School �oard.
—Couiicilman Li.ebl said that many of the-people that live in the 61st Avenue
area have objected to this crossing, and i_f it is granted, they are inteiested
in the type of crossing, and safety measures will have to be taker�. He said
that some people have suggested the possibili.ty of. asking for a crossing at
57th Avenue also for better bargaining. Mayor Kirkham said that strategy
does not do much good with the railroad, and real facts are needed to back
up the Ci.ty's position. Councilman Sc1R1UCI.S011 felt the City Attorney should
prepare ari appeal for the 61st crossing right a�aay because of the 20 day limit.
Council.man Sher.idan said that the appeal can be fil.ed, and the Council can
discuss it wi_th tiie School �oar.d at their meeting next week.

Councilman Samuelson said he did not agree caith the existin� utilities
either being rerouted around the proposed buildings or encased, because
the street for the conmiercial center is going to be a"U" shaped street,
' and it would make no difference if one was cut. The City Engi_neer said
that they recommend encasing only for tlle live util.ities, and that the
contractor is agreeable.

he is appearing tonight to shaw ho�a the additional land coulc� be
incorporated into th�; district, and pointed out th�t the land pro-
vides for more recr�ational area. He said that he f�lt that this
was the b�st use of the land. He said that at the onset, an
apartm�nt house was planned as presented by Mr. Schxo�der and was
incLuded in tlie booklet the Planning Commission and Council re-
ceived shoi�ing 108 units. He said that it was found at th e ons�t

Mr. Walberg if he felt that the Council had deceivod him. Mr.
Walberg replied no. _
Mr. Jerry Potts, �3066 Ruth Street, said that he had voicea an
objection before, and has not had a chan�e of heart. He said that
there vJere still the landscaping problems, traffic, and the apart-
ment house rather than the tawn houses. iie said that he bouyht his
house �Erom Mr. Schroeder and he felt that Mr. Schroeder was•unfai.r
to him and was not honest with him, as he gave him no indic�tion
that the zoni�ng in this area was going to changee He �said that he
did t�ke the precaution before purchasing his house of checking a
zoning m�p, but of course he would have no way of knowing ��hat
was being proposed unless Mr. Schroeder told him. Mr. Bourdeaux,
440 Hugo Street said that in his o�inion Mr. Schro�der took ad-
vantage of Pairr. Potts. Mr. Potts said that this is not a case o£
a feva people being against this, that there was a rath�r large
petition against it.

before the Council agaa.n for final appr.oval of plans. Mr. Potts
said that the zoning m�ps sh��r com.*nercial lots, but not those

Vacate two streets: Sames Street lying East of Lot 6, Pearson's lst
gddition and West of Railroad tracks and the street lying East of
Block l, Pearson's lst Addition and lying Wes-� of Lot 1, Block 2,
Pearson's lst Addition.
In discussing the vacation request, the Subcommittee stated the
vacation would not change the_dimensi�n.s of the plat bec�,use tt_e streets
wauld be used as acces�. The only one gaining is the City because +hey�
would not have to maintai_n the streets. The main opening was closer_ to
East River Road. It would not be x�ecessary to retain the easemezzts because
the storm sewer is in the axea North of 791:h Ave.nu� and goe: down Libe�ty
Street to the Creek.
This is a self-contained piece AS the sewer and water utilities are
installed. Because of this, the Subcommittee felt the easement on th� South
of Block 2 could be vacated as there is no longer a need for it.
MOTION by Zeglen, seconded by Myhra, that the Plats & Subdivisions-
Streets & Utilities Subcommittee recommend to the Planning Commission
approval of the vacation, SAV #69-0%,'The Five Sands, represented by Richard
Fudali, Attorney, to vacate two streets: James Street lying East of Lot 6,
Pearson's lst Addition and West of the Railroad Tracks, and the street lying
East of Block 1, Pearson's lst Addition and lying West of Lot 1, Block 2,

The Subcommittee was questioned regarding rezoning to commercial in c�se a
praspective buyer was interested, and he was told that the use would have to
be industrial unless rezoned. Anderso.n Trucking Service purchase� the eleven
ac;res although for their purposes, they a.re using a,pproximately 470 feet on
the Soutt�. This will be a proposed trucking terminal and the trucks will be
serviced ae they come in and go out. They will reaily be despatching from
this terminal. The main entrance will be on Old Central and the movement
will be from Old Central to Osborne Road and across.
In the discussion of sanitary sewer, it was.point�d ou tha the struc-
tures on the South side of Osborne Road are service�+ an e su geation was
made that A�idersor� Trucking run a sewer line on the`back of the proposed lots
1, 2 and�� and give an easement of sufficient width for the s�nitary sewer.

of the preliminary plat, P.S. �69-11, Anderson Development, by Anderson

the NE`� of the NE� of Section 12, as shown on the drawing.entitled And�rson
Development, revised edition of October 1, 1969 with the further recom�enda-
tion that the fina.l plat show proper sanitary sewer easement along tha Fa.st�
West line af the plat, approximately 250 feet South of the Northern boundary.
