Upon a voice vote, all voting aye, the motion caxried unanimously, RECEIVE BOARD OF APPEALS MINUTES; JULY 2, 1969s MOTION by Jensen, receive the minutes of vote, all voting aye, seconded by Fitzpatrick, that the Planning Co�nission the Board of Appeals dated July 2, 1969. Upon a voice the motion carried unanimously. RECEIVE BOARD OF APPEALS MINUTES: JULY 16, 1969: n MOTION by Jensen, seconded by Fitzpatrick, that the Planning Commission - receive the minutes of the Board of Appeals dated Ju1y 16, 1969. Upon a voice I vote, all voting aye, the motion carried unanimously. � RECEIVE BUILDING STANDARDS-DESIGN CONTROL SUBCOMMITTEE MTNUTES: JULY 16, 1969: MOTION by Jensen, seconded by Fitzpatrick, that the Planning Co�ission receive the minutes of the Building Standards-Design Control Subcommittee dated Ju1y 16, 1969. Upon a voice vote, all voting aye, the motion carried unanimously. � 1. PUBLIC HEARING• PROPOSED PRELIMINARY PLAT, P.S, ��69-09� MIKE 0'BANNON: Lots 11, 12, 13 and 14, Auditor's Subdivision ��22 and Lots 1 through 16, 24, 25 and 26, Block 1, Irvington Addition. Mr. 0'Bannon was present. The Notice of Hearing was xead by Chaixman Erickson. He commented that the Subcommittee had appxoved the preliminary plat with appaxently no instxuctions. Mr. 0'Bannon explained that there were three property owners involved with the platting -- Mr. John C. Carrol, James W. Skog and himself. He planned to put the sewer and water in himself and will submit his plans to the City. There will be no storm sewer. The sewe�c and water would go in this fall and then the road next summer. They were shown the overall plan of the Rice Creek Road/Central Avenue Study and Chairma.n Erickson said that Mr. 0'Bannon's plan follows the original � one almost to the letter. The Commission asked for a slight change in the alignment of.Lot 4 enlarging it. MOTION by Fitzpatrick, seconded by Jensen, that the Planning Co�ission close the public hearing of the proposed preliminary plat, P.S. ��69-09, Mike 0'Bannon, of Lots 11, 12, 13 and 14, Auditor's Subdivision ��22 and Lot 1 through 16, 24, 25 and 26, B1ock 1, Irvington Addition. upon a voice vote, all voting aye, the motion carried unanimously. MOTION by Jensen, seconded by Fitzpatrick, that the Planning Couunission table the proposed preliminary plat, P.S. ��69-09, Mike 0'Bannon, of Lots 11, 12, 13 and 14, Auditor's S�bdivision ��22 and Lots 1 through 16, 24, 25 and 26, Irvington Addition stating that the layout has the general concurrence of the Planning Cou�►ission, and it seems to be done in accordance with the overall plan adopted for the area. Howevex, the Planning Commission wants to be able to look at a more finished drawing showing the topography and lot dimensions priox to final action; requesting that the Council set a public hearing at their earliest opportunity; the drawing should show the existing houses in relation to the lot lines. Upon a voice vote, all voting aye, the motion carried unanimously. 2. PUBLIC HEARING• PROPOSED PRELIMINARY PLAT, P.S. ��69-10,_GALLAGHER ADDITION, WILLIAM H. GALLAGHER: West 5 acres of NW� of SE�, except South 4 acres, n Christie Addition. The Public Hearing Notice was read by Chairman Erickson. Mr. and Mxs. Gallagher were present and also Leif Henriksen. The Engineering Assistant explained that at the last meeting, there was some discussion about the boulevard width at the Southwest corner. A field check indicated an existing boulevard of about 5 feet. The xecommen- dation of the Engineering Department was that there should be at least 13 feet, so that an additional.right of way should be obtained of about 8 or 9 feet off. the corner. Mr. Gallagher said the lot was big enough to allow th3s. He was asked if he knew how far from the West line his house stood. He thought about 18 fio 20.feet, and about 32 feet from the East line. MOTION by Jensen, seconded by Fitzpatrick, that the Planning Commission closa the public hearing of the proposed preliminary plat, P.S. ��69-10, Gallagher Addition, William H. Gallagher of the West £ive acres of the Northwest Quarter of the Southeast Quarter, except the South foux acres of Christie Addition. Upon a voice vote, a11 voting aye, the motion carried unanimously. Mr. Gallaghex was asked to get a certificate of survey and show the existing building. The suggestion was made to change the 75 foot lots to 80 feet making them more buildable. Mr. Gallagher said he would do so if � he would not lose his trees. Planning Co�►ission Meetin� - July 23, 1969 Page 3 � MOTION by Fitzpatxick, seconded by Jensen, �hat the Planning Commission recommend to Council approval of the proposed preliminary plat, P.S. ��69-10, �'^1 Gallagher Addition, William H.�Gallagher, of the West five acres of the Northwest Quarter of the Southeast Quaxter, except the South four acres, • Christie Addition with the pxovision that thexe be a minimum of 13 feet for the boulevard provided on the Southwest corner of the plat and that there be a certificate of survey submitted showing the position of the existing structure before final approval by Council. Upon a voice vote, all voting aye, the motion carried unanimously. 3. CONTINUED• PROPOSED PRELTNaNA.RY PLAT, P.S. ��69-07, BRENTWOOD ESTATES (REVISED) THOMAS SWANSON: All that part of Lot 34, Revised Auditor's Subdivision ��77 lying East of the East line of Block 1, Mississippi View Addition. 4. MOTTON by Fitzpatrick, seconded by Jensen, that the Planning Commission continue the continued proposed preliminary plat, P.S. �69-07, Brentwood Estates (Revised) by Thomas Swanson for all that part of Lot 34, Revised Auditor's Subdivision ��77 lying East of the East 13ne of B1ock 1, Mississippi View Addition. Upon a voice vote, a11 voting aye, the motion carried unanimously. CONTINUED REZONING REQUEST: ZOA ��69-08, R. W. WORMSBECKER: NW� of NW�, except North 16.6 acres and SW� of NW'� of Sect3on 2; also the North 34.68 acres of NE� of NE� of Sec�ion 3 to be rezoned from M-2 to R-3. MOTION by Jensen, seconded by Fitzpatrick, continue until the nex� meeting, the continued � R. W. Wormsbeckex of the NW� of the NW�, except of NW� of Section 2; also the North 34.68 acres ' Section 3 to be rezoned from M-2 to R-3.
