APPROVE PLANNING COMMISSION MINUTES: MAY 6, 1970 Mr. Harris called attention to the omission of asking Paul Brown, Director of Parks and Recreation, to attend a Planning Commission meeting to give the members information on using evergreens for screenings around buildings, and the types of evergreens which would grow best in Fridley. The Commission decided to make this a separate item at the end of the evening. nMOTION by Schmedeke, seconded by Minish, that the Planning Commission minutes of May 6, 1970 be approved. The public hearing notice was read by Acting Chairman Fitzpatrick. Mr. M�schke explained that at the present time, he has 175 feet of frontage, and proposes to use 125 feet. The complete area would be fenced and the lot blacktopped. The proposed building would be approximately 6,000 square feet, 3,000 square feet would be used for the display area. Also, they were not talking of trailers and mobile homes -- it would be strictly recreational equipment. He said the motor homes take an R license and can be driven on parkways. A portion of the site will be required for service, delivery and storage. The camping trailer home is the type that is pulled behind a passenger car. Perhaps in winter, he might have ski equipment. The building would be block and brick and closed in. James W. Gibson, 6289 Highway 4i65 N.E.: He asked what type of building super- structure did Mr. Mischke plan on using. Mr. Mischke answered that it would be cement block with the same decor as in the area. He was agreeable to follow the same pattern facing the highway, b ut it would be too expensive to use it on the back of the building. Mr. Gibson stated the basic complaint was the decor of the area would be changed substantially from what it had started out to be, which was a trend for an offiee park area and the type of business that the petitioner proposed, he felt would not lend itself to be in an office park type of area. Of course, he added,the argument comes along that you have the Sinclair gas station which is ^ an eyesore. His understanding is that, the people who own this filling station would, if the decor of the area is established, go along with the idea of tearing the filling station out and continue the decor. Dr. Kenneth E. Speltz, 6220 Highway 4�65: He asked if Mr. Mischke had a set of the plans now. Mr. Mischke said he had plans of the building drawn, but not with him this evening. The shape of the building is in the form of a T being two 80'x40' structures connected. He was then asked by Dr. Speltz the kind of fencing he planned to have. Mr. Mischke replied that because of the problem of theft, he would have a 6' fence. Mrs. Mary J. Savelkoul, 916 West Moore Lake Drive: She said she was speak- ing on behalf of herself, the residents and Maple Lane Bowlings Lanes. In the first place, she did not think it was the type of business to locate so near to homes. The petitioner does not think he will repair used units on the premises. How do we know what will come of it after this type is allawed. She felt the Planning Commission should consider what some of the neighbors would like. Mr. Mischke: He esid he thought his place would be conducted as well as the bawling lane. He would use an iron fence which would be high enough and private enough so that you can't see through. He felt he could keep as orderly as the places next door. The land was purchased six years ago. Mrs. Rose R. Jasper, 6279 Baker Avenue: She said that she would like to /� know how far up to her home all of this would be. She spoke about used campers and also motor homes and trailers and asked if the motor home was one of the huge things that go in back of cars? Will there be a cost to them, as taxpayers, if he has to have a road. /"� n � Planning Commission Meetin - May 20, 1970 Pat�e 3 The Engineering Assistant called attention to the 40 foot planting strip. Mr. Mischke does not own that. The City could not te11 the people now whether or not there would have to be an assessment for storm sewer. The storm sewer assessment policy was explained. The Engineering Assistant said he was not saying there has to be a storm sewer and he was not saying there won't be. There is an outlet which does go underneath West Moore Lake Drive which drains to Moore Lake. Mr. Mischke was asked if he would have all four walls the same or even have three walls the same. Mr. Mischke thought he could have three walls the same, and he would like to have the building close to the front of the lot. Acting Chairman Fitzpatrick said he felt the people should understand the drainage problem cannot be attributed to the petition because it is already there. Mr. Harris read the ordinance to the sudience which referred to the Uses Allowed by Special Use Permit in all of the C categories, including C-2S which applied to this area. He also said the exterior materials have to be approved by the Building Standards-Design Control Subco�nittee along with the screening. The City does have quite a bit of control over building requests. The planting strip was discussed. Some of the people in the area use it for gardening, others just take care of the portion adjacent to their property, but no one seemed to know who really was responsible. It seems this strip has been there since 1956. MOTIDN by Schmedeke, seconded by Minish, that the Planning Commission close the public hearing of the Special Use Permit reqvest, SP #70-0�, by Recreation Equipment Sales, Inc., G1enn W. Mischke, to permit retail of campers, txailers, motor homes, recreational equipment in a C-2S District to be located on Lots 1 and 5, Block 1, Herwal 2nd Addition. Upon a voice vote, all voting aye, the mo�ion carried unanimously. _ The Engineering Assistant explained that there is an easement running North and South between Lots 1 and 5, and has a sanitary sewer in it, and any structure built on the 2nd lot would have to avoid this easement area. Mr. Gibson asked about the setback, which is 80 feet, but Mr. Mischke could go to the Board of Appeals to get a variance. Mr. Harris wondered if the planting strip would not be a good place to put evergreens. Mr. Schmedeke said that he thought Mr. Mischke should put up a fence, because the evergreens would be too small now to be used as a screening, but by the time the fence begins to look worn, the trees would be large enough for a screening. He hoped to meet with Paul Brown, Director of Parks and Recreation to see what kind of evergreen could be used. Mrs. Savelkoul stated that if the Planning Commission approve this request, they won't be thinking about protecting the neighbors at all. Mrs. Jasper wondered if there would be a lot of noise when people, who were buying the equipment, would be trying them out. Mr. Mischke said it would be no �tore noisy than cars starting up. �lannin� Comm�ission Meetin �- Mav 20, 1970 Page 4 ^ Darrel Clark said the requirement of the Code for planting does provide for a 20 foat green area between the parking lot and the street. Mr. Minish said they were dealing with a rather difficult piece of property with Hwy. 4�'65 to the East and residential to the West. When the veterinary clinic and the mortuary were brought before the Bosrd of Appeals, he did not recall any strong objections from the neighbors on Baker Street. However, he did feel that the proposed petition was not consistent with the type of existing structures. His feeling would be to recommend against the special use permit as he thought the major objection of the neighbors was the open storage. Mr. Schmedeke stated that the lot is quite narrow, and it was not the proper width under the new ordinance, but there was enough square footage. Mr. Mischke said if he were to move the fence in another 20 feet, it would be 60 feet from the property line of the residential area. He was not against doing that, but it would be hard to maintain. MOTION by Minish, seconded by Harris, that the Planning Commission recommend denial to the Council of the_5pecial Use Permit request, SP #70-02, by Recreation Equipment Sa1es, Inc., GZenn W. Mischke, to permit retail sales of campers, trailers, motor homes, recreational equipment in a C-2S District to be Iocated on Lots 1 and 5, Block 1, Herwal 2nd Addition. Upon a voice vote, Minish voting aye, Harris and Schrnedeke voting nay, the MOTION FAILED. ^ Mr. Harris felt the Petitioner should bring in his plans before the Planning Com�ission should make a decision. He added a pencil sketch showing the placing of the structure, landscaping, storage and display areas would be ade<f,uate. MOTION by Harris, seconded by Schmedeke, that the Planning Commission continue until the next regular meeting (June 3, 1970) the request for a Special Use Permit, SP #70-02, by Recreation Equipment Sales, Inc. to permit retail sales of recrea- tional equipment in a C-2S District to be located on Lots 1 and 5, Block 1, Herwal 2nd Addition, and at that time the petitioner wi11 present a sketch or plot plan. Upon a voi ce vote, a11 voting aye, except Minish who voted nay, the motion carried. Mr. Minish asked that the minutes show he was opposed to open storage. The audience were informed there would not be another public hearing before the Planning Commission and therefore they would not receive a notice for �he June 3rd meeting. 2. , LOT SPLIT REQUEST: L.S. 4�70-06, GEORGE L. WALQUIST: Lot 6 and S'� of Lot 7, Block 1, Erco's lst Addition. Site for dental clinic. Mr. Walquist was present. The Engineering Assistant stated that the Plats & Subdivisions-Streets & Utilities Subcommittee recou�mend approval of the lot split. The Council had ^ approved the variance. The Subcommittee, referring to the N'� of Lot 7 being tied in with Lot 8, and under one ownership, would help solve the problem of an under- sized lot under the present zoning ordinance, and platted long before the present ^ � Planning Cominission Meetin� - Ma 20, 1970 Pa�e 5 ordinance. The Subcommittee had no objections to the proposed building. Mr. Walquist was asked if he had plans for the N� of Lot 7 and all of Lot 8. He said nothing was developed yet, but he would try to put an office type of building in there. . Referring to the suggestion of legally binding N� of Lot 7 to Lot 8, Darrel C1ark said it would be difficult to do, as, if someone wanted to purchase Lot 8, you would have a hard time to deny it. However, it should be mentioned in the minutes. Mr. Minish suggested that perhaps covenants on Lot 8 to tie it together with the N'� of Lot 7, could be drawn. Or the Commaission could approve the lot split subject to the petitioner presenting some sort of document which would tie the N� of Lot 7 with Lot 8 and could request him to have his attorney draw up these papers. MOTION by Minish, seconded by Harris, that the Planning Commission recom- mend approval to the Council of the Lot Split request, L.S. #70-06, by George L. Walquist of the S3� of Lot 7, Block 1, Erco's lst Addition subject to the owner preparing a covenant or other recordable document that would tie the North Xa1f of Lot 7 to Lot 8 so that a good marketable title to Lot 8 could not be conveyed without tying in the North Ha1f of Lot 7. Upon a voice vote, a11 voting aye, the motion carried unanimously. 3. COMMUNICATION FROM CITY ATTORNEY TO CITY MANAGER: The letter of May 18, 1970 from Leonard T. Juster, City Attorney, to the City Msinager regarding the letter of Oliver Erickson of April 17, 1970 concern- ing variances, was passed on to Oliver Erickson, Chairman of the Planning Com- mission. No action. 4. PLANTING OF EVERGREEDTS IN FRIDLEY: CONSULT PAUL BROWN, DIRECTOR OF PARKS A1�TD RECREATION : MOTION by Schmedeke, seconded by Harris, that the Planning Cormnission ask the Director of Parks and Recreati.on to come before the Planning Commission with a recommendation of the species of evergreens and a list of the trees and shrubs that wi11 do we11 in Fridley soil and suqgest types for screeninq between com- mercial and residential areas. Upon a voice vote, all voting aye, the motion carried unanimously. 5. SCHEDULE FOR PLANNING COMMISSION MEETINGS: Acting Chairtnan Fitzpatrick stated he would be gone part of this summer. The Commission talked about a sum�er schedule and decided they would let ^ the requests and petitions be the deciding factor when they would meet using their regular days. The members present expressed a preference for meeting at 8:00 o'clock. However, if the Subcoumnittee did not meet at 7:00 o'clock on the same evening, they would go back to 7:30 P.M. The members of the Subcommittee read the letter sent to the City Manager from the City Attorney regarding the communication of Oliver Erickson dated April 17, 1970 concerning variances. , Referring to the City Attorney's letter, the Engineering Assistant explained ^ that the way he interpreted the letter, is that on older plats, if variances are requested, unless there is some specific reason why it should not be granted, it should be approved. The land owned by Mr. Walquist was plaCted long.before the ordinance and according to the City Attorney, the variance shduld be granted. In this case, the split of the lot and description would be sfmple enough so that it would not be difficult to follow. The Subcommittee wondered if the ordinance could be changed so that Xequests involving the older plats could be,considered according to the ordinance. Crowder commented that the Subcommittee is being asked ta split an 83 foot lot and what would they do if tY�ey got a request regarding th� development of the N� of Lot 7 by itself. The Engineering Assistant said th� petitioner could be requested to plat the three lots (Lots 6, 7 and 8), but that would be quite costly. In answer to Mr. Crowder's question that, from the standpoint of the City, was there anything detrimental in the situation, Darrel Clark said that, as long as the Board of Appeals and Council approved the vari�nce, this Subcom- mittee should think about the lot split only. For the record, Mr. Crowder asked that it be shown that splitting Lot 7 /�1 , would create a fo�ty-one and one half foot 1ot. STUDY OF TRAFFIC SIGNS AT T.H. 4�47 AND INTERSTATE ��694: The Police Department furnished the statistics of traffic accident survey from 53rd Avenue N.E. to 57th Avenue N.E., North and South of Hwy. 4�694 on Hwy. ��47 (University Avenue), East River Road and Hwy. 4�65. Zt was noted there were two fatals on East River Road. After a discussion of the difficulties the motorist has a�t the ramps under 4�694 going North and South and left and right turn lanes, the Subcommittee agreed that signs should be placed on the bridge overhead indicating where each lane of traffic is to go. This would be especially helpful at night as the motorist would get advance warning signs. The Chairman submitted a dra�wing of suggested signs for the South side of the bridge over T.H. #47 (University Avenue} and the North side. MOT.ZON by Meissner, seconded by Zeqlen, that the PZats & Subdivisions-Streets & Utilities Subcommittee instruct the Engineerinq Assistant, Darrel CZark, to draw up a resolution requesting the Minnesota Hiqhway Departme�t to consider pZacing lighted signs on the Interstate #694 bridges for the t�affic qoing North or South at the intersections of East River Road, University Avenae (T.H. #47) and T.H. #65 at the Moore Lake intersection. Upon a voice vote, aZ1 voting aye, the motion carried unanimously. 3. MEETING NIGHT: ^ The Subcommittee agreed that they would like to continue meeting at 7:00 P.M. when the Agenda is a light one and could be taken care of within the hour, but if the Agenda were a long one, they could meet on the Wednesday either preceeding or following the Planning Commission meeting nights. In every instance, the' Engineering Assistant would contact the Chairman before the Agendas were sent out. He explained that he had been before this Board in June of 1969 with 5 variances on �he same land and the variances had been approved by the Board but denied by the Council. He has since been granted a lot split, on the land, by the City Council and is now before the Board with only 3 variances. The Board was shown a sketch of Lots 28, 29 & 30 which located �he buildings that are presently on Lot 2$ and part �i 29. Chairman Minish stated that Lot 30 was a tax forfeit lot that Mr. Dircz bought for back taxes and which he has kept up even though it was considered unbuildable, Mr. Dircz stated the taxes on the lot are now quite high and he would like to be able to build a house on it to sell. He stated further that he has cut down on the size of the house since last yea�'s request and that he will maintain the 15 foot requirement between structures. MOTION by Ahonen to close the public hearing. Seconded by Drigans. Upon a voice vote, there being no nays, the motion carried unanimously. MOTION by Ahonen to approve the 3 variances for the following re�sons: � 1. Chairman Minish explained to the Board that he had received a call from ^ Mr. Harold Swanson asking if he could appear at tonights meeting with his request as he would like to start building as soon as possible. Chairana.n Minish had answered that Mr. Swanson could appear if he could acquire the signatures of all the property owners within 200 feet of his property, stating they had no objections to the request for the varisnce. Chairman Minish al.so told Mr. Swanson that the Board would receive the request but that they might not agree to act on it, at this meeting, as it was not the regular procedure. Mr. Swanson came forward and presented to the Board a petition s�.gned by all the property owners, within 200 feet of his property, stating they had no objections to the variance. MOTION by Sondheimer to receive the petition. Seconded by Drigans. Upon a voice vote, there being no nays, th� motion carried unanimously. Mr. Swanson explained they need the variance as the back of theiz lot is very steep and if they had to maintain the 35 foot setback, the house would be placed back behind the crest of the hill. This would mean hauling in a considerable amount of fill which would run into quite a bi� of money. ' Mr. Swanson explained further that the house to the North of his lot is located completely behind his proposed house and the dwelling loeated on the second lot to the North is further back yet. Mr. Drigans asked Mr. Swanson if he had realized before, that he would need a variance before he could build on this lot. Mr. Swanson answered that the contractor had not staked the house on the lot beforehand, and when it was staked out with the required 35 foot setback, it was discovered that the fill would be necessary in order to l�uild. Mr. Heskin agreed to make the following changes to comply with the ordinances. They would move the two buildings together so that they �aould have a common wall. He woula also change the roof elevations of the two buil�fng so that they would be of equal elevation and reduce the width of the rock garden between the buildings from 10 feet to two feet or change to a two foot Concrete walk. The Board asked Mr. Heskin if he couldn`t put some brick on the self service car wash so that the two buildings would match better when combined. Mr. Heskin stated that because of economics it would be impossible to add any brick to the self service car wash. He also stated that the two car wash's would be operated by two different people so he would like them to look like two separate buildings and still blend well together. Mr. Gnerre felt that the brick and stucco would look all right together because many houses have brick fronts and the rest of the house is stucco and they look all right. SUI�IIT SQUARE PARK CITIZENS Several citizens were present from the Summit Square area to discuss the ball playing in the park. After discussion between Mr. Brown and Mr. Ankrum, the City Manager, earlier this week, a permanent sign was posted in the park on May 22, saying "NO BASEBALL OR SOFTBALL PLAYING." Those citizens present seemed�to think the sign was working. Mr. 5chroeder wanted to go on record as requesting that an age limit be placed on the park. This would mean that only children under a certain age limit could play ball in the park. The Commission felt that this would cause more problems than a sign. Mr. Fitzpatrick stated that this park was never meant to be used for ball playing and that the b�st solution would be the sign indicating no ball playing allowed. TENNIS AT THE CO1�1pNS. ^ School District #14 has a permit to use the Tennis Courts at the Commons, five days a week, in the afternoon, throughout the Spring months. This permit was discussed in regard to the use of the courts by the citizens of Fridley. The Parks and Recreation Department has been spraying for years, but this is about all that can be done. PITCH, HIT, AND THROW The Phillips Petroleum Company sponsored a Pitch, Hit, and Thraw Contest at The Commons Park on Saturday, May 23, 1970. Don Blair, a member of the Commission and Paul Brown, Director of Parks and Recreation, helped with the event. They reported that 98 boys entered the contest and they felt it was a good showing for the first year. 1971 BUDGET DISClJSSION. The Locke Park Well House is to be finished by fall. The building has been approved by the City Council and the Commission discussed the possibilities of building an ice skating rink and installing lights in the area adjacent to the Well House. The Commission discussed the necessities oi pay phones in the Warming Houses. The need derives from injuries at the rinks during the last season. The need for improvements in the Ruth Circle and North Park are�s was discussed. This appears to be on option of the Council as provided in 462.354 af the Minnesota State Sta.tutes as this subdivision goes on to state that in a municipality where the Council does not serve as the board, the governing body may provide that the decisions of the board on matters within its jurisdiction are final subject to judicial review, or are final subject to appeal to the Council *��** or are advisory to the Council. Dear Homer: The Statutes of the State of Minnesota we�^e amended in 1967 and in Section 462.354 � they authorize munici�alities having a zoning ordinance ar official map to provide by ordinance for a Board of Appeals and A'djustments. In granting to - the municipalities that authority, it fur�her limited that authority by stating that the Board shall have the powers set forth in Section 462.357 Subd. 6, and Section 462.359 Subd. 4. ^ The Fridley council by ordinance adopted November 3, 1969, did, pursuant to statutory authority, establish a Board of Variance ard Appeals, the powers of the Board being set out in the ordinance sections 45.18 through 45.188. The Fridley ordinance has no provisions for public hearings. However, the state sta�ute would govern the procedure since the Board of Appeals and Variances is a creature of the statute. The State statute which authorized the creation of �he Board of Appeals does state in Section 462.354 �ubd.-2.the following: "Hearings by the board of appeals and adjustments shall be held within such time and upon such notice to interested parties as is provided in the ordinance establishing the Board." M.S.A. 462.359 Suhd. 4 has an appeal provision where a permit for building is denied and grants the Board of Appeals and Adjustments the power, upon appeal filed with it by the owner of the land, to grant a permit for building in a loeation where the Board finds that the statutory provisions require a permit to be issued. Said Section states, °In addition to the notice of hearing required by Section 462.354 Subd. 2, a notice shall be published in the offi�ial newspaper once at least ten days before the day of hearing." 3 �' � F� � . Homer-Ankrum � Page 2 May 21, 1970 7herefore, it is my opfnion that the two sectians referring to the establi5hment of a Board of Appe�ls and Variances as established by the City of Fridley definitely indicates that the ordinance should provide for a hearing provision and does leave the exact type of hearing procedure to the council. The only requirement of the statute and of the courts wauld be that the City adopt a' reasonable hearing procedure and publish a notice in the official newspaper once at least ten days before the day of hearing. Section 45.381 of the o1d City Code, which has been repealed by the new zoning code, did establish,a Board of Appeals and Section 45.382 provi.ded the following: °Notice of hearing of any appeals before the Board of Appeals shali be pubTished in the official newspaper once at least ten days befiare the day of hearing. In addition,� mail notice sha11 6e sent at least ten da s before the date of hearin 'to t ose arties and ersons nown to ave an interest in t e a ea . HQwever, failure to give mailed notice s all not invalidate � e public hearing or juris- diction of the Board of Appeals.° The new zoning cade does, in 45.184, provide "Natice of such hearing shall be mailed not less than ten days before the date of hearing to the person or persons who filed the appeal.° and leaves out the language underlined above. ^ It is my opinion that the new 45.184 is defective and does not provide a proper -� notice to the affected parties. . It is my opinion and recommendation that the Board of Appeals does incorparate in 45.184 the above underlined sentence so that notices are mailed to those parties and persons known ta have an interest in the appeal.
