�,,,� 1. PUBLIC HEARING: SPECIAL USE PERMIT, SP �70-11, C. H. BENJAMIN: Lots 1 thru
S, Block 4, Adams Street Addition, to build a second garage on Lot 2.
Fridley Code Section 45.051-2A.
Chairman Erickson, referring to Council minutes of October 5, 1970, stated
Mr. Benjamin could receive a building permit upon receipt of a petition signed
by the surrounding neighbors saying they did not object to the second garage.
Mr. Benjamin called attention to the fact that the Building Inspection
Department told him to get the names of the people a�ithin 200 feet, while the
application form given him by the Engineering Department stated 300 feet.
Chairman Erickson request the Engineering Department check this with the Ordinance
and City Code.
Mr. and Mrs. David Pohl, 5891 West Moore Lake Drive, and owners of Lots 1
and 2, Block 1, Adams Street Addition were present. Mr. Pohl said they had no
objections to the proposed second garage. q
Mr. Benjamin stated his plans were to build a second unattached garage on
Lot 2 even with the existing dwelling on Lot 3. He stated he had many chances
to sell two lots, but unless he could find a buyer for the "whole package", he
wouldn't sell.
Referring to the existing garage, he said that it is at the back of Lot 3
abutting the alley and there is a steep drop off on the West side of the alley
making it impossible for him to use it in the winter. The alley has never been
P"\ opened, and Mr. Benjamin has had to do whatever maintaining necessary in order
to get out. When the houses on the lots in back of his property were built,
the contractor took the dirt from the alley, and when he was asked who gave him
permission, the answer was no one told him it was an alley. Tfie Chairman�aeke,d
him how he got in and out of the alley. Mr. Benjamin said "you back doti+ti aad
pull out or pull out and back down".
Mx. Benjamin commented an the width of Jefferson Street saying that ozigit�aliy
it was a full 30 foot street. The Council decided to offaet the street ��.ve
feet and the people were left with about a 20 foot street.
Mr. Benjamin said that after the neighbors were assured he was asking for
just a two car garage, there were no objections. He presented a list o£ the
names of the property owners within 200 feet.
1NnTION by Schmedeke, seconded by Fitzpatrick, that the Planning Commission
xeceive the list of property owners within 200 feet of 5708 Jefferson Stteet as
presented by C. H. Benjamin (Zater on identified as Exhibit "A"). Upon a vaice
vote, all voting aye, the motion carried unanimously.
Mr. Benj �nin stated the second garage would be used for his c�s, and th�

The driveway would nqt be blacktopped, but he would use black dirt and clay atad
cobblestones for the front of the drive out towarde the street.

Use Perrait, SP �Y70-11, be reopened for the purpose of receiving the letter
addressed to Oliver R. Erickson, Chairman, Planning Comrai.ssion, and heze�t`t�t be
referred to as Exhibit "B", being a statement by Mr. Benjamin as to the circum-
stances anpl manner in which the Special Use Perm.it was presented. D,pon a voice

Planning Commission has recoaomended a�proval of the request for a second garage and
ask that it go before Counci,l on Tuesday, October 13, 1970.

Mt. Fitzp atrick asid that he brought this up at the last Parks & Recreation
Co�aiasion meeting. The Co�niseion is still working on it and the information
will be ready in the near future. The Parks and Recreation meets on the 4th
x�aay of the month, and he extended an invitation for any of the Planaing Com-
ffi�sioa members to attend.

Mr. Don Harstad and Mr. Dick Johnson were present to present the request.
Mr. Harstad explained their present office is located on Lot 4�nd at the
time they bought Lot 4 they had to buy Lot 11 in order to get out to the
highway. Lot 11 was a narrow lot originally and with the land asked for by
the City for the service road and easements it was cut down considerably. He
said it was getting to the point where they will have to get some income from
the property as the money paid out in assessments fox the water main, sewer
lateral, water lateral, storm sewer and taxes has been quite high. Thexe is
also a pending street assessment and a pending sewer connection charge that
will have to be paid.
Photos of the lot and a survey showing the proposed building and parking area
were ahawn to the Board.
Mr. Johnson stated the two existing permanent buildings, D. W. Harstad Company
and Minnesota Door Company, were originally set back 60 feet but naw with the
land being dedicated for the service road they are only set back 30 feet and
the proposed building will be in line with them. Becauae of the ehape of the
lot, the building will have to be a long narrow type of building. The proposed

^ building is 25 feet by 100 feet and will have 10 parking spaces which is the
mini.mum parking requirement. He stated the building will possibly be rented
out as dental offices or a chiropractic clinic. The type of business will
be limited to a type that will not generate a large amount of traffic. Mr.
Johnson said they would like the parking in the front of the building as the
lower level in back does not lend itself to parking because of the steep
incline. The two adjacent buildings have the same type of parking at the
front of the lots. Mr. Johnson added further that there should be no problem
with the backyard variance as the the back of the lot abuts Rice Creek.

Seconded by 0'Bannon. Upon a voice vote, there being no nays, the motion
carried unanimously.
MOTION by 0'Bannon to recommend to the��City Council approval of the variances
for the following reasons:
1. The hardships are the amount of land that had to be dedicated to the City
for the service road that considerably restricts the size of any building
that is built on this lot and also the number and amount of assessments
that have been placed on this property making it necessary to build a
building that will bring in same income.
2. There is no other way to build on this lot than what is proposed because
of the easements.
3. The proposed building conforms to the other buildings on the service road.
4. Locating the parking to the rear of the building would not be practical
because of the steep incline.
Seconded by Ahonen. Upon a voice vote, there being no nays, the motion carried
unanimously.
