For the benefit of two concerned property owners in the audience, a brief
revtew was given by the Chairman of the request for the proposed plat and Mr.
Fudali explained the map showing each lot colored separately. He explained that
Lincoln Street is a public road which will be improved by the City in the spring.
Outlot B, which runs into Lincoln Street, will be built and maintained by the
developer. '
Chairman Erickson asked for an explanation of the statement made by Mr. Fudali
� at the last meeting inferring he was one of the original owners. Mr. Fudali said
the property was owned by S. G. Pearson. There were five men, N. Craig Johnson,

William bolan, George Halvorson, Clarence Lowe and Paul Roberts who called them-
^ selves "Committee of Five". He was first introduced to the project when litiga-
tion was pending. The man who was supposed to handle the finances resigned when
they ran into difficulties. At the present time, he and Ken Nordling are partners
in the venture, and they have Gus Welter (architect who built Chippewa Park in
Brooklyn Center) as the architect. Mr. Fudali was never initially involved as an
owner in the Five Sands, Inc. What he said was that at one time he was associated
with Dolan and N. Craig Johnson, and when they came to him, he bought out the
interest of one of the men which meant he became associated with the other four.
He had never been before the Planning Commission or Council in regard to the re-
quests of the Committee of Five, and did not receive material pertaining to the
requests until the Council rezoned the property to R-3A.

There was a short discussion regarding the fact that some of the lots are less
than the required area for 59 units.
Mr. Fudali was asked by Mr. Harris if he were aware of "some of the determina-
tion taken at the time of the rezoning". Mr. Fudali felt, as far as he was con-
cerned now, the issue in the case was whether or not the land was properly rezoned,
and he did establish it in his mind that it was.
Mr. Harris referred to the Council meeting of October 6, 1969 approving the
building permits for the first two buildings as presented by Five Sands, Inc.
The question was asked by the City if they were going to apply for a registered
land survey or plat. Mr. Johnson said the land was torrens title, the deed was
clear, and the mortgage company was satisfied with the metes and bounds descrip-
tion as it was under one ownership.
Mr. Fudali said that Mr. Johnson was unable to construct the buildings in
October, 1969. Up until the time that he became an owner, they were going to try
to build five buildin�s at the same time. However, they were unable to build even
two apartments. It would be difficult for him to anewer what was said at that
meeting regarding platting and the mortgage company being satisfied with metes
and bounds descriptions. He and Ken Nordling now feel that in order to simplify
parcel description and to receive separate tax statements on each of the parcels,
they would like the area platted as requested.
Although this situation is a typical condition for a registered land survey,
they would still have to get approval from the Planning Commission and Council.
Mr. Harris then referred to the Council meeting of July 21, 1969 which men-
tioned that the City should acquire 12 feet along East River Road for a future
turning lane. Mr. Fudali said they have given a deed to the City for a turn lane,
dedicating a 12 foot lane on East River Road.
In regard to Lincoln Street, which intersects 79th Avenue, Mr. Fudali explained
they have petitioned to have it constructed -- the bids being let in the fall and
the street to be built in the spring. Outlot B will be a private road in the com-
plex and will be maintained by the complex in the winter and the summer. If
Lincoln Street had been vacated, the complex would have lost one half of it to the
commercial property, and they did not wish to bring commercial any closer to their
property.

The City Attorney said that one of the zoning stipulations was there would
� be no access on 79th Avenue and that Lincoln Street was to be used for access.
The proposed plat was then examined and discussed relative to easements, ingress
and egress. Mr. Juster continued saying if the project would be maintained under
one ownership, the Planning Commission would have a much better control of keeping
things as they are than if you ended up with different ownerships.

The Engineering Assistant said he computed the land area. As he understood
it, the first building site, which is now under construction, would be Lot 1,
Outlot A and B, and as f3r as area requirements are concerned, it would be big
enbugh for a 54.3 unit apartment, but the number of units now under construction
is 59. The second building could contain 62.4 units. Using a combination of
Lot 3, Outlot C and Lot 4 would be large enough for 44.7 units; Lot 5 equals 52.0
units; Lot 6 is 49.0 units; Lot 7 equals 10.7 units. To bring tIte total area
requirements up to what was approved by the Council, one must include tfie 50 foot
right of way of East River Road and is equal in land area to 22 units. Tfii.s 50
foot easement was included in the overall figure of 17 acres. Tha reason tfie
petitioner included it aas because it �as gi��n as an essement and not a dedication.
The figures of the County and City Assessors alsa include the 50 feet as an ease-
ment, so there is a question whether or not it could be used as land area for the
total complex.
Mr. Fttdali was asked if he would be prepared to change the plans to conform
with the City Code. Mr. Fudali answered they would like to keep the buildings
looking alike. He did not quite understand about the square faotage. If at
all possible, he believed that what they could do would be to ask for a variance
if they needed a variance. If they could not do that, they could change the
architectural design on one of the last buildings by eliminating some of the
units. Mr. Erickson felt the problem really starts out with the very first
building.
Mr. Harris said that Lot 7 bothers him. It was his understanding that FFiA
will not mortgage a piece of property that does not have public access. Cfiairman
Erickson said that they prob ably could satisfy FHA by granting a private road
easement.
Mr. Fudali gave the following explanation. An instrument has been given to
the City Attorney which provides Lot 7 with an easement in favor of all the rest
of the property for recreational purposes and provides that each one of these
buildings has the right to use Lot 7 for recreational purposes. In this way,
Lot 7 becomes an integral part of the complex. The recreational agreement was
modeled after one Pemtom drew. Lot 7 would not be mortgaged by FHA as they do
not permit any mortgage financing for pools or recreational buildings. It will be
mortgaged conventional which requirements are for access to a public street, but
not public access. They have created access to a public street by easement. They
also require that there be enough money coming in to meet mortgage payments.
There is an agreement whereby the rest of the property agrees to pay to Lot 7 a
sum of money each month. This sounds subtle, but it is the best way to do it in
order for all of the apartments to use the recreational building.
Mr. Welter is the general contractor and has no financi.al ir•terest in the cor-
poration, and he is building it for Five Sands, Inc. Mr. Fudali and Ken Nordling
have been friends for ten years, but this is the first large project they have
^ had together.

^ Mr. Fudali continued that he would like five separate tax statements because
he may have five separate mortgage companies. FHA requires a reserve for taxes
and replacements. The bookkeeping would be kept separate in order to find out if
one building is not doing as well as another and would be easier to spot.
Mr. Harris asked about Outlot C. Mr. Fudali said there is an easement over
Outlot C which picks up an easement going West to Lincoln Street. Rather than
describe it by metes and bounds, they chose to describe it as Outlot C.
Referring to the turn around on 79th Avenue and the railroad tracks, Darrel
Clark said the City would like to get a crossing at the railroad tracks. If it
is impossible to get a crossing, then the turn around will be put in.
Speaking of the ditch that runs adjacent to the property on the South side,
Mr. Harris asked if they were contemplating improvements.
Mr. Fudali answered that he had discussed with the City Engineer the under-
ground storm sewer they were building �hich wmuld empty into the ditch. Also
they had talked to the fellaw from the Pool Company who cn,ms the land to the South.
They had a conversation about doing something with th� whole creek area and the
possibility of giving easements for additional recreatio�al area. It was just
preliminary conversation.
Mr. Harris questioned the advisability of having the storm water drain into
the creek because there is a problem at the present time. The Engineering
�,,,\ Assistant said this will get worse as more streets and parking lots are put in.
The culvert underneath the railroad tracks is not adequate.
Answering the que�tion of what is going to be built on Outlot A, Mr. Fudali
said it is part of the mortgage for Lot 1 and Outlot B, and other than land-
scaping, they are not going to build anything.
The Engineering Assistant, spe�king to Mr. Fudali, said that the City Engineer
and he would like to knaw if there was any possibility of Outlot A being combined
with Lot 1, Block 1, Pearson's lst Addition which is a commercial piece of property
on the corner of East River Road and 79th Avenue. They were going to ask the
commercial owners for an easement in the Northwest corner of this lot. The
City would like to put in a turn lane and in order to do that, they would have
to get some property from the owners. If they could get that corner, then make
a trade for Outlot A with you. Mr. Fudali answered that at the present, he could
not think of any major problems, but would like to see what Outlot A looks like
after the project is built. They might be able to do something with the Outlot as
far as landscaping is concerned. He would hesitate, wondering what the co�aercial
lot would do with Outlot A, as it would be getting too close to the complex.
Mr. Minish asked if the reasonlfor requesting a plat is basically to simplify
the original description. Mr. Fudali said they thought they could accomplish
everything they e�cpected to in the way of shorteninq tt;�_ description, and record-
ing easements with the exception of separate taxes.
Chairman Erickson said it was his understanding the County has been filing
metes and bounds descriptions.

Answering Mr. Harris` question about the bottom half of the property owned
� by Pearsons, Mr. Fudali said that they have a contract for deed. Ae met with
James Pearson and Leonard Samuelson and showed them the plat. They will sign
the plat if it is.approved. The plans are that on March 1, 1971, they will be
paid in full. The Engineering Assistant volunteered that a copy of the contract
is in the City file.
Mr. Schmedeke asked the City Attorney if the City had any legal objections
to the request for a plat. Mr. Juster replied that he did not anticipate any
legal problems with the easements and plat as such. If it is platted, it is
much easier to build on Lots 1 and 2. They could stop building and sell off
Lots 3, 4, 5, 6 and 7. If the project were one unit, it would be more difficult
to sell.
MOTION by Minish, seconded by Fitzpatrick, that the Planning Commission close
the public hearing of the proposed preliminary plat, P.S. #70-04, Five Sands, by
Five Sands, Inc., being a renZat of B1ock 2, Pearson's Zst Addition and Parcel
8400. Upon a voice vote, a11 vc�ting aye, the motion carried unanimously.
The question asked by Mr. Fitzpatrick was if the Planning Co�nission approved
this plat, knowing tlie intent and number of ut�its, what was the implication?
Chairman Erickson replied that if the Commission approves the plat, they allow
the petitioner to go ahead with the project in violation of the ordinance.
Mr. Fitzpatrick continued that if approving the plat, which is simply the
� division of the land, what check would the City have on the petitioner? Mr.
Juster answered that if the plat is approved, he did not think it meant they
approved the units for the balance of the area. Before Mr. Fudali could build
on Lot 3, he would have to come in for a waiver. The Planning Commission would
not actually affect the two buildings coming up, but from now on, a new problem
would be created. If he came in for a waiver and the Planning Couunission felt
he was carrying on the initial concept, it could be granted. Mr. Juster did not
think the plat itself would be material either way.
Chairman Erickson said that Lots 3, 4 and 7 combined are still short of land.
He continued that the Planning Commission has to keep in mind the purpose and the
basic understanding the City has regarding this request. He felt the Commission
pretty well agreed thi5 was proposed as one project and had every intention com-
pleting it that way. It appears the buildings could be built and mortgages filed
and the project comple�ed without a plat. It was his own opinion it should be left
until the project is far enough along to determine if it is going to be finished.
He felt the petitioner still had not explained to him why they are requesting a
plat. The only purpose he can see for platting is to split the taxes and that
could be accomplished between mortgage companies. Because of the background of
this property and opposition to roads by neighboring property owners, the project
should be completed as originally presented to the City.
Mr. Minish said he was somewhat of the same mind, that everything can be
accomplished as stated by the Chairman.
Mr. Schmedeke said an important factor to him was that if the owner of the
^ South part of the proposed plat, thought it would not be developed, he was certain
he would be here this evening. It seems to prove to him that the party who owns
the South part feels the project is going to be completed. We should face the ,

fact that the land is either going to be developed by the Five Sands, Inc. or the
owner would eventually develop it himself.
Chairman Erickson said he did not question the intent of the petitioner. How-
ever, he did not see why it should be the burden of the City to see this project
through. The complex could be built first and then the platting can be accomplished
for taxes. Mr. Schmedeke wondered if it were not the tight money market that is
a factor in platting now. Chairman Erickson said he did not believe that seemed
to be the problem.
Frank Liebl, Councilman, stated when the Georgetown Courts complex was rezoned,
the buildings were sold while they were being built and Council accepted the
overall plan from Maurice Filister and then later on, after he completed a few,
Mr. Filister came in and asked for a registered land survey. It was not until he
completed the complex that he split them up and they are individually owned by
individual mortgage companies. They were platted after they began building. There
were no problems in regard to the requirements of land, but Mr. Filister came
befor� the Council and had a Registered Land Survey approved.
Chairman Erickson said he would not say he would object to the plat after the
project is developed.
Mr. Minish said that plans do not always develop the way they are presented.

denial of the proposed preliminary plat, P.S. #70-04, Five Sands, by Five Sands,
� Incorporated, being a replat of Block 2, Pearson's 1st Addition and Parcel 8400,
as i t was presented for the following reasons:
1. The lots are too sma11 for 59 unit bviZdings as proposed.
2. The creation of lots without public access.
3. If platted now, the City wi11 Iose what control it has over the project.
4. This was not part of the oriqinal plan wherl presented for rezoning
and building concept approval in 1969.

MINUTES OF REGULAR PARKS AND RECREATION COI�AMI�SION MEETING, NOVEMBER 23, 1970.
Meeting was called to order at 7:45 p.m. by Chairman Fitzpatrick.

MOBILE WARMING HOUSE.
The Commission received a copy of the City Council Minutes, dated November 16,
1970, and reviewed the portion which discussed and approved the purchase of a
Mobile Warming House / Playground Shelter. Mr. Olson asked what the unit was
to be constructed of. Mr. Brown said that it was a steel structure (steel
frame and outside siding) with insulation and wood paneling on the inside. Mr.
Olson questioned the safety of such a unit and whether or not the insulation
was fire proof. Mr. Brown indicated that thexe are two doors, both on one
side. Mr. Olson pointed out that the unit would be heated by bottle gas or by
direct hook up, and that this was definitely a hazard when the warming house
becomes filled with people. Mr. Brown said that the shell would very closely
match that of a mobile home.
Mr. Olson again pointed out that this could be a fire hazard and that when the
building becomes crowded, the risk is even greater. He asked that since the
unit was just being ordered and construction had not started, perhaps we should
contact the manufacturer and present the situation and request that a fire proof
insulation be used. All agreed and Mr. Brown will contact Cliff Industries, by
� phone, regarding this matter.

DONATION OF PARK LAND.
Mr. Fitzpatrick called the Commission's attention to the letter from Mr. Robert
Jaeger, 4130 Ximies Lane North, Minneapolis. Mr. Jaeger owns lots 1, 2, 3, 4,
and 5, Block Z, Riverview Heights Addition, and he wishes to donate these lots
to the City of Fridley (preferably to the Fridley J.C.'s) for park development.
He asked that the City assume responsibility for the delinquent taxes and any
legal fees deriving from this transaction.
Mr. Fitzpatrick asked what was known about this property. Mr. Brown said that it
is located just Northwest of our Riverview Heights property. There are some homes
located between our present property and the property in question. The property
in question is bordered on one side by Spring Brook, and the other side by the
River. It's low land and is affected by Spring flooding.
Mr. Fitzpatrick said that he was in agreement with Mr. Brunsell, Acting City
Manager, that the City could make no deals with Mr. Jaeger as far as his.donating
the land to the Fridley J.C.'s, with the City accepting the responsibility of the
delinquent taxes and legal fees, were concerned.

The Commission questioned whether or not Mr. Jaeger had said what he meant in his
letter. They wondered if he should have presented this directly to the City
Council, with the Council �lax�ifyin$ the legal aspe�ts as far as the delinquent
taxes were concerned.

DONATION OF PARK LAND (con't):
Mr. Brown said that he felt it was advantageous for a Parks and Recreation
Department to acquire any and all pQrtions of land which border bodies of water,
rivers, and streams. Mr. Fitzpatrick agreed that this is generally the plan.
Mr. Ash indicated that if it was possible to obtain the land between our present
property and the property in question, it would make one large tract of land which
could be developed into quite a suitable area for another Park.
Mr. Novitsky questioned whether or not it would create a maintenance problem.
He pointed out that the City seems to have quite a few areas which are presently
undeveloped and are maintained onl�+ once a year. Would this be just another
area which the Maintenance Men would cut once a year for the next ten years
and the park never developed? He pointed out that rve presently own many small
plots of land which are spread out over the City, and none of them being large
enough to develop into anything special. Mr. Novits�Cy said that he felt we
should upgrade our present facilities before considering the renovation of this
property. It would have to sit vacant for a long time before it could be
developed.

1971 BUDGET.
Mr. Brown told the Commission that the Budget has been approved and printed and
that as soon as it is assembled, he would be sending the copies out to them,
along with possible revisions. The overall total will remain the same. These
possible revisions will have to be approved by both the Commission and the City
Council.
The Commission will be sent copies of the finalized Budget, along with Mr. Brown's
suggested changes and these will be discussed at the December 28th meeting, before
going to the City Council for approval.
EMPLOYEE WORK POLICY.
The question was raised last swnmer regarding City Employees working with other
groups and organizations, preparing for events which will take place in the
City, and whether or not the City should be reimbursed for the wages which are
paid to said employees while performing such services.
Mr. Brown informed the Commission that he and the Acting City Manager have
discussed this problem at great length and they are in the process of developing
a draft policy, to be approved by the City Council, regarding such activities

Mr. Brown presented a petition to the Commissioaa from some Citizens who live
in the area of Hayes School. These Citizens are requesting that two rinks be

Mr. Swartz has severed the contract for a rink on his property and the people

YOUTH ADVISOR.
The Commission's attention was again drawn to the Quarterly Memorandum which
suggested that a representative of the Student Council or some school representative
in a similar ca�pacity, be invited to attend �he Commission meetings, to voice an
opinion as to wh�ther or not an actidi�y would be desired and succes§ful �s far
as they were concerned. This would �ell the Commission i£ they are satisfying
the desires of the youth in the City. This was originally brought before the
Commission in September of 1969, and has been discussed on several occasions
since that time, but nothing definite has been planned and the school has not
been approached regarding this matter. Mr. �rown stated that he ttaought it had

Council minutes which corresponded to the Youth Advisor matter and it coulc� be
discussed again at the December 28th meeting.

TREES AND SHRUBS FOR FRIDLEY.
^ The Commission made reference to the report on "Trees and Shrubs for Fridley",
which was prepared by Ralph VQlkman, Park Foreman. The Commission felt that
perhaps the list should be sent to Shirley Behrens at the Fridley Sun, and other
Civic minded groups and interested persons. The Commissioners felt that this
information would be on interest to all the Citizens in Fridley and that they
would put this report to good use if they knew of its availability.

OAK WILT.
The Commission discussed the problems of Oak Wilt in Fridley. There is presently
an ordnance regarding Dutch Elm Disease, whereby the City can inform the owner
of the property that he has a diseased tree and warn him that it will have to
be removed. If the owner doesn't comply within a certain length of time, the
City �an go onto the property and remove the tree at the owners expense.

Mr. Olson asked if the City Council had approached the County, regarding aid in
purchasing the North Park area. Mr. Fitzpatrick said that he didn't believe they
had and Mr. Olson recommended that the Commission approach the Council for just
such action. �
Mr. Fitzpatrick stated that the Commission itself was not in a position to approach
the County for aid, but that we could present the proposal to the City Council for
action.
Mr. Blair pointed out that if the City tried to purchase the land on its own, it
would create a terrific burden on the taxpayers.
Mr. Olson wanted to go on record as stating that he feels that the Commission
should approach the City Council with the idea of requesting County aid in the
purchase of the North Park area.
Mr. Fitzpatrick suggested that each Commissioner contact his Councilman regarding
this matter. Mr. Blair said that he felt the Commission should act as one body
in approaching the City Council for action.

1. CONSIDERATION OF A REQUEST TO CONSTRUCT AN ADDITION TO THE EXISTING UNITY
HOSPITAL TO BE LOCATED AT 550 OSBORNE RQAD, FRIDLEY, MINNESOTA, THE LEGAL
BEING AS DESCRIBED ON THE ATTACHED SHEET. (REQUEST BY WITCHER CONSTRUCTIO]
COMPANY. 400 SECOND AVENUB SOUTH, MLNNEAPOLIS, MINNESOTA 55401.)
Mr. Wayne Nordgren from Smiley and Associates and Mr. Gerald Stuth of Witcher
Construction Company were present to present the,request.
Mr. Nordgren explained that the addition was going to be done in two stages.
The first stage would encampass a new west wing and an addition to the boiler
room. The second stage will include remodeling in the present building, the
addition of a wrap around the present building, and the landscaping work.

The exterior of the new addition will match the existing building using face
brick and exposed concrete with a sealed finish. The brick used on the addition
will be obtained from the same manufacturer as those on the present building
so matching should be no problem.
Tf�e west wing will consist of 3 corridors on a floor with 16 rooms in each
corridor. T�ese all meet at one point where the central nursing station will
be located. There will also be a nursiag station in the intensive care areas.
The corridor running to the existing hospital will be enclosed with curtain
wall consisting of aluminum frame and bronze glass panels. All the stairways
in the building will be concrete.
After discussing the over-all plan of the addition, it was questioned whether
the sanitary and storm sewers were adequate. A copy of a letter fr� Comstock
& Davis, Inc., Consultiag Engineers, was given to Mr. Nordgren regarding the
sanitary sewer and a map showing the cul de sac as needed at the end of the
street. It was stated that some land dedication would probably be necessary.
Mr. Qureshi, City Engineer, stated that the storm sewer was adequate for the
new addition.
The Board asked i� any data from the soil tests had been submitted to either
the Building Inspection Department or the Engineering Department. Mr. Qureshi
stated that they had been requested but so far they had not received any. The
^ Board then stated that this would be necessary before the issuance of a building
permit.

^ The Board told Mr. Nordgren that a landscaping plan would be required before a
permit would be issued on the second stage. They sug�ested that some type of
screening be put on the Lyric Lane side of the hospital because this faced a
resideatial area.

MOTION by Tonco to.reco�mmend approval of the concept of the addition including
both stages, a building permit for the first stage only, and that a permit for
the second stage be issued only after a c�plete site plan is submitted and
approved. Also, that the building permit for the first stage not be issued
until data from the soil tests is submitted to the Building Inspection Department.
Seconded by White. Upon a voice vote, all voting aye, the motion carried
unanimously.
2. CONSIDERATION OF A REQUEST TO APPROVE THE CONCEPT OF A PRELIMINARY PLAN FOR A
TOWNHOUSE DEVELOPMENT TO BE LOCATED ON LOTS 3 AND 4, BLOCK 2, HAYES RIVER LOTS,
THE SA1� BEING 5950 ANNA STREET N E, FRIDLEY, MINNESOTA. (REQUEST BY NEW

Mr. Hoffineyer and Mr. Emil Novak were present to present the request.
Mr. Aoffineyer stated that there would be a total of 56 townhouses. They will
be put in 4 clusters of 3 units each and 2 end buildings. The front buildings
^ are at a higher grade than the back buildings so they will all overlook the
river. There is 1,563 square feet in each unit. Each unit is individually
heated. The exterior of the buildings will be brick veneer with accent brick
on the corners. Each unit will have a private patio enclosed with a redwood
fence.
The parking area will be in tY►e center of the complex with one access from
the front. There will be a 7 foot planting strip in the center to aid in
snow removal. There will also be a sidewalk around the entire parking lot.
The Board stated that the access would have to be widened to 26 feet because
there was only one access and the parking spaces enlarged to 10' X 20' to
meet the City code.
The Board asked what type of maintenance would be used.
They stated that they would probably have a resident manager to take care of
the maintenance. It had not been decided exactly. It was also stated that each
townhouse would have its own garbage can enclosed in the redwood fence.
Mr. Hoffineyer said that they were going to clean up the river bank but would
leave the existiag trees.
MOTION by Tonco to recommend approval of the concept of the townhouse develop-
ment with the stipulation that the access to the parking area and the size of
the parking spaces be increased to meet City code.

Mr. Roger Patch was present to present the request.
�, Patch stated that this building will be a training area for children up
to 12 years of age with an I.Q. range of 50 or less. These are children which
do not fit in public schools. They will be busing the children to the center.
There will be about one teacher to every four children.
The center will be in a residential area and was, therefore, designed to fit
the other buildings in the area. The building will have an asphalt shingle
roof which has been approved by the Fire Marshal. The building will have a
walk-out basement into a fenced-in backyard. The backyard will be a play area
for the children. In order to put in a blacktop driveway, they will make curb
cuts which will match the others in the area.
Mr. Patch was informed that before a pernnit was issued, a complete landscape
plan would be required. Mr. Patch said to contact Mr. Dave Torkildson at Anoka
County Park Department for this.

Chairman Erickson commented that the Planning Commission has been tabling
this item'for some tiine because Mr. Pritchard has not been he e, and it was his
understanding that Mr. Pritch�rd was going to gather more inf rmation before
bringing it back before the Planning Commission.

showing them the proposed yard and how Silica Sand w uld be
affected by the railroad. He also stated that the a jac�nt pr�perty
will not have a megaphone effect.
Mr. Mittelstadt felt that the City Council shou d look into

Mr. Jensen said that the Planning Commission is committed to the stz�eet
plan. The Planning Commission felt this street could be ela�ina ed across
lots 30 and 31. The design really would have ax� adverse effect n the
neighbors by eliminating the sect�on across ttais lo�e Lo� �a. Yre th�s ca�e,
Mr. Marxen has provided and others to the East have provided f� street
so the City must provide them an outlet for that street. This w ole plan is

Notice is hereby given that the Planning Commission of
the City of Fridley will meet in the Council Chatnber of the City
Hall at 6431 University Avenue Northeast at 8:00 P.M. on Wednesday,
December 9, 1970 to consider the following matter:
A request for a Special Use Permit, SP ��70-12,
for Alvin A. Nitschke, to permit the construc-
tion of a two family dwelling in an R-1 District
as per Section 45.19 (2A) Fridley City Code, to

45.14. TOWNHOUSE DEVELOPMENT

Townhouse Development
The purpose of this section of the Zoning Ordinance __

�-�- -- is to provide far and-`�ncourage advances in �housing
design; changes in types of dwellings; more flexibility ,
in layout and site planning; the development of the
life-cycle environment; and the more efficient use of
land, open space and public facilities.

45.141. Procedure For Townhouse Development
Approval
1. Preliminary Plan:
A, The application shall be filed at the
Building Inspection Department of the City
of Fridley.
B. The application shall be submitted to the
Building Standards-Design Control Sub-
committee for review and recommendations.
C. The recommendations of the Building Standards-
Design Control Subcommittee will be submitted
to the Planning Commission for their review
and recommendations.
D. The recommendations of the Building Standards-
Design Control Subcommittee and the Planning
Commission will then be submitted to the City
Council for approval of the preliminary plan.
2. If Council approval is granted, the following
procedure for the final plan will follow:
A. A final plan will be filed at the Building
Inspection Department.
B. The final plan shall be submitted to the
Planning Co�nission_for their __ _ _.
recommendations.
C. The rec�ommendations of the Building Standards-
Design Control will then be submitted to the
City Council for final action.
45.142. Application
1. Preliminary Plan
^ The owner of any contiguous parcel (s) of land
containing five (5) or more acres in any
residential districC may apply to the City

Application
Application for Townhouse Development shall be made
by the owner of the property except that an option
holder may ��n�y for T:�wnhouse Development provided
his applicatinn is accompanied by signed letters
stating no objection from the owner or owners of
all land included in the application.
The application shall be filed in the Building
Inspection Department and shall be accompanied
by a minimum of three (3) copies of the preliminary
plan containing the following information.
A. Plot plan showing building, parking areas,
curbing, driveways, sidewalks, fencing, drainage
and outside utilities, etc.
B. Landscaping plan showing outside surface develop-
ment including sodding, blacktop, concrete, etc.,
and plantings.
C. Architectural plans, sections and elevations
specifying the exterior material to be used. �
D. Density of land use.
E. Height of all buildings.
F. Size of all buildings.
G. Feasibility study for disposal of sanitary waste
and storm sewer.
H. Proposed water service.
I. The proposed geographical staging and timing of
the plan.
2. Final P1an:

The final plan shall be filed in the Building Inspection
Office no later than 90 days after approval of the
preliminary plan is given by the City Council. The final
plan shall include,but not be limited to,three (3) copies
of the following materials.
A. A final plan indicating placement and type of all
buildings and their uses.
B. An elevation drawing of the proposed development
which will best indicate the height and
size of all structures.

C. A copy of all deed restrictions, and covenants
and a copy of the by-laws of the proposed
association of owciers including but not being
limited to the provision of the "Apartment
Owaership Act", Chapter 457, Laws of 1963,

E. Any changes in the final plan caused by amend-
ments to the preliminary plan by the City Council.
The fee for filing a Townhouse Development which
includes the fees for processing the application by
the City shall be $100.00.
45.143. Standards
1. Lot Requirements and Setbacks
A. Lot Coverage.
The maximum ground floor area for the sum of all
buildings in the project shall not exceed 25% of
total land area in the Townhouse Development.
B. Densities

NOTE: The lot area required per dwelling unit
shall be computed by including the entire
development, including the streets, walks, and

A. The staging of any plan for Townhouse Development
shall include the time for the beginning and
completion of each stage. Such timing may be
modified by the City Council on the showing of
good cause by the owner.
B. Any and all common open space shall be labeled
as such and as to its intent or designed function
and provisions for maintenance, ownership, and
preservation shall be made in accordance with the
provisions of the "Apartment Ownership Act",
Chapter 457, Laws of 1963 (MSA 515.01 to 515.29).

The Planning Commission has pending a rezoning request on L ots 30
and 31 arid are very reluctant to make a recommendation without first
having a zoning plan for the entire block. For this specific reason
the Planning Commission is inviting you and your neighbors to a

the Planning Commission members that every property owner will attend

� 2. LOT SPLIT REQ,UEST: L.S. #69-14, STANLEY C. DAHLBERG: Lot 11, Block 2,
Spring Valley Addition.
Mrs. Stanley Dahlberg and Curtis Dahlberg were present.
Mr. Myhra said the action of the Subcommittee, was to approve the lot split
as shown on the diagram, which split the South 131.78 feet into two 62.5 lots,
and dedicating 25 feet for a street and utility easement.

Curtis Dahlberg speaking for his father, said part of the area had lot
splits on this order, and they wished to split for two building sites.
Mr. Myhra stated the Subcommittee felt that as long as this pattern had
already been established in the area, and all the houses are on the front of
the lots, which are large lots, they could see that something would have to
be done as there was no road down the middle of the block.
Curtis Dahlberg said these lots would have to be split at some time. He
felt if they were split now, the rest of the people may start splitting their's.
In other undeveloped areas, the City has a proposed street pattern to be followed
at a later date. As long as the logical street pattern is at the South edge
of the lots, and they dedicate 25 feet, why couldn't that be applicable now?
^ MOTION by Mittelstadt, seconded by Fitzpatrick, that the Planning
� Commission recommend to the Cit,y Council that the Lot Split Request, L.S.
#69-14, of Lot 11, Block 2, Spring Valley Addition b,y Stanley Dahlberg be
granted, splitting the North 144 feet of Lot 11, Block 2, Spring Valley
Addition. Upon a voice vote, all voting aye, the motion carried unanimousl.y.
3. CON'I'INUID REZONING REQUEST: ZOA #69-02, GEORGE M. NELSON: N2 of Lots 30
and 31, Auditor's Subdivision #129, excep� the North 125 feet.
Mr. George Nelson,.Mr. Howard Mo.ore and NI�TM. �ennis Herbst were present.
Darrel Clark reviewed the previous meetings with the Subcommittee. The
owners of Lots 28, 22 and 24, really do not want their property zoned, nor a
road, unless the,y had a buyer. �A road for access out North or South would
satisfy them, but not at this time.
The street under discussion was the West 25 feet of Lot 30 from Onondaga
Street South to a poix�t 25 feet Sauth of the South line of Lot 28. The people
were informed that if sewer and water were not assessed against R-3 property
the value of a lot could not pay for the assessments. The same cost,
assessed against ��-1 property, would not be co-�:,�red by R-1 value.
Mr. Moore said that Mr• Nelson would be agreeable to the plan for the
West 25 feet to the South line of Lot 28. They would request that the area
involved in the easement be credited to them ar�d returned eventually. They
would like to see some type of agreement worked out where by if the South
� 110 feet of Lots 24, 26 and 28 were combined into a common ownership that the
street could be va,cated.

The Engineering Assistant answered that this was a legal question, as he did not
^ know if a dedication would be handled in that way. Mr. Moore said if it could
be done in the instrument itself, it would be fine, �ut if not, a letter of
intent from the City could be satisfactor.y.

Mr. Jensen asked Mr. Moore if what he is asking for is that he wants a
street and utilityes easement so that the owner:�hip would still remain a pa��''.
of the street, but if it were never used for a street, it would still be a
matter of keeping the street, but not being able to construct a building on
it and a reasonable base for a buffer. As far as the petitioner is concerned,
Mr. Moore comment��., that area would be included for density purposes.
Mr. Dennis Herbst said that he did not want construction any further North
than the middle of his lot as he would have to give 25 feet and he did not
want the back of the apartments practically in his backyard.
MOTION by Jensen, seconded by Fitzpatrick, that the Planning Commission
recommend approval of the rezoning xequest, ZOA #69-02, in its modified form
from R-1 (single family dwellings� to R-3A (general multiple dwellings� that
part of the North half of Lots 30 and 31, except the North 125 feet with the
provision that the petitioner �rovide an easement for street and utility purposes
on the West 25 �'eet from Onondaga Street to a point 25 feet South of the
Southeast corner of Lot 28 and provide no vehicular access be allowed from
the multiple zoning to the street easement, and that such area of this said
easement be allowed in computing densit,y of the multiple dwelling project in
the R-3A. Upan a voice vote, all voting a,ye, the motion carried unanimously.
4. LOT SPLIT REQUEST: L.S. #69-15, ARTHITR DEYS: Lots 3 to 5, Block 7, Hyde
Park Addition. ,�

The Subcommittee recommended approval of the lot split with provision that
the�,present garage will be moved across the line so that the garage will be
on the same land as +he old house, and tha+ a five foot w�rk and repair
easement be obtained.
Mr. Deys said the house he is living in at the present time is set way back
on the lot. He would like to build his new home this summer.
The Chairman informed Mr. Deys ari Ordinance was passed so that a new home
could not be built in front of an existing home on an adjoining lot. In erder
for Mr. De,ys to bizild his naw home on the new lot, he would have to get a
variance from the Board of Appeals. The Board would probably act favorably
because the old home is to be torn down. Mr. Deys was asked to get a
certificate of sL:�ve,y because the Board of Appr�,ls would not act without it.

table the lot split request, L.S. #6g-�5, Arthur Deys, of Lots 3 to 5, Block 7,
Hyde Park Addition, until Mr. Deys can provide a certificate of survey�. Upon

Mr. Deys was asked to notif.y Darrel Clark if he was able to obtain the

receive the Parks and Recreation Commission minutes of Apri1 28, 1969. Upon
a voice vote, all voting aye, the motion carxied unanimously.

Inasmuch as Item 3 is directly concerned with Item 1, Chairman Erickson
suggested it be heard with Item l.
1. INFORMAL PUBLIC MEETING: Area bounded by Onondaga Street, Stinson Boulevard,
73rd Avenue and Hayes Street.
2. CONTINUED REZONING REQUEST: ZOA ��69-02, GEORGE M. NELSON: NZ of Lot 30,
N'� of Lot 31, Auditor's Subdivision ��129 except the North 125 feet.
Chairman Erickson explained that a rezoning petition had been presented
by Mr. Nelson, and there had been some opposition before the Planning
Commission. At that time, the request for rezoning was the entire parcel
and the Planning Commission recommended denial. Mr. Nelson then changed
the rezoning request reducing the size of the R-3A by putting six R-1
lots facing Onondaga for Council's consideration. Council sent the
request back to the Planning Commission who, in turn, suggested the
possibility of rezoning all of the propert,y along 73rd Avenue from
Ha.yes Street to Stinson Boulevard and to a line of one lot depth on
Onondaga. It would be feasible for any streets which were previously
^ planned or suggested in the area within the inte�ior of that block, to be
abandoned and new access from Onondaga to 73rd would be discussed. There
is no proposal being suggested at the..meeting, as this is strict ly a
discussion.

Dennis Herbst (Lot 28�, 1482 Onondaga: M,y garage is within 20 feet of
the East propert.y line, and was built in 1963. I am against;putting
a street through as it would involve the rear half of the lot.
George Hanson (Lot 20), 1476 Onondaga: He felt the area needed a
North�South street, especially for the safety of the children going to
the Park. He knew of at least 4 lots that the owners would not want to
be rezoned. The people like the size of their lots, and if the time
should come when it would be a hardship to keep them, they would need
the street to sell the propert,y. He was not interested in any type of
rezoning unless the street would go through.
Leo Hitzeman (�,ot 25), 1461 Onondaga: He asked if there was an,y idea
where the road would start from and where it would be. He said his
house was not worth much, but the land is worth mone.y for apartment
houses. ne felt in the future, there would be all apartments. He was
definitely against the road. � �
Mr. Hitzeman was informed the.street would run along his North property
line and part of the cul de sac would be in the Northwest corner.

Mr. Jensen said the criteria used by most planners is to change zonings
� at the rear lot line so that single family homes would not face multiple
dwellings. He was sure this was part of the reason this idea has been
proposed. If .you do put a street in along the rear property lines, then
this back half of the North lot will be facing multiple dwellings. This
should be kept in mind.
Mrs. Leonard Hjort (Lot 22), 1434 Onondaga: We are against the rezoning.
We like the land the way it is.
Larry Gunn �Lot 27), 1475-73rd Avenue: I do not�want the road. I have -
paid $2,300+ in addition to what has been added on recently. We like the
lot the way it is. I am opposed to the road.
Tom Marxen (Lot 5�, 773-83rd Avenue N.E., Mpls: He stated as far as he was
concerned, he would benefit from the rezoning.
When Chairman Erickson asked if anyone would object to the extension
of Arthur Street through to 73rd Avenue, Mr. Hanson said it would seem to
him you would almost have to have a street through there as it would give
access to the park.
Mr. Ed Kennedy (Lot 29)� 4240 James Avenue, Mpls: He asked about the
assessments in the past.
The Engineering Assistant said that in this area, improvement costs
/� have been exceptionall,y high, due principally ta the high water table
and storm sewer. If the street would go in as an East�West street, the
assessments would be at least �2,500 per lot.
Joe Saba (Lot 29), 1485-73rd Avenue: I would lose my garage if you took
land for a road.

Roy Warner (Lot 8�, 7360 Stinson Boulevard: I wonder wh.y .you consider
rezoning all the way to Stinson?
He was told it would be an expensive road for the property lying North
and the propert.y already zoned R-3. He was asked if he would be interested
in any portion of the lot facing Stinson being rezoned to R-3A. NIr.
Warner said his assessments were large enough now. He would just as soon
keep the land the way it is. Another possibilit.y is Lot 7, which is a
large lot with one small home. If that were rezoned, he would not like
to see a multiple dwelling come in there.
The feelings of the Commission are that there should not be any
multiple d?aellings on Onondaga. It seemPd to them the majority of the
people are against any road, in any direction, within the area as it
would not be advantageous to the property at this time.
Mr. Marxen wondered if it would be possible to make it mandatory for
a whole parcel to be purchased together so that there would not be a
landlocked piece of propert,y left in the middle. Chairman Erickson

said he did not think it would be difficult to convince the people to
� expand, but he did not feel you could force them to buy it. You would
also have to have a waiver of the land requiremen-ts in order to get a
higher density on the property zoned.

Mr. Howard Moore, representing the petitioner, stated that in his
opinion, d:° far as the Cit,y is concernec: to rezone up to the resident:�:al
lots on Onondaga would create a valuable increase in the tax base. There
is a real need in this general area for apartments. You now have a
Iarge corporation right across the street and there is another large
plant under construction. People seem to be prett,y well divided in
their opinions of the rezoning and the streets. Some want it, but not
now. The prime argument against the rezoning is increased traffic, and
yet if you don't want to see much traffic, you would want to limit the
streets. If you put in Arthur Street, it would seem to take two garages
and would increase the traffic flow to permit traffic from multiple
areas up on Onondaga. It would seem to him that the multiple zoning of
other parcels North of the centerline would, in the long run, be of
substantial benefit to them. Rezoning is not requiring a person to do
something he did not want to. He would find it difficult to increase
the value of a lot if it were not actuall.y used.
MOTION by Mittelstadt, seconded b.y Jensen,that the Planning Commission
close the Informal Public Meeting of May 8, 1969 of the area bounded
by Onondaga Street, Stinson Boulevard, 73rd Avenue and Hayes Street.
Upon a voice vote, all voting a,ye, the motion carried unanimously.
Chairman Erickson said that there is a scheduled hearing before the
Council on Monday, Ma.y 12th, on the reduced proposal from the original
publiahed proposal which was for the entire lot and the Planning
Commission recommended denial of that. Now the petitioner is asking for
a reduced area of R-3A and the Council is to consider the smaller area.
It seems to him if we were gaing to cor�sider the reduced proposal, we
would have to consider it another time. There were two choices, to
recommend denial or recommend approval, but he felt he could not vote
on it as this time.
It was felt the Plats & Subdivisions-Streets & Utilities Subcommittee
should act on this e�ren without some zoning plan as provisions for some
streets are still desired for the future.
Mr. Nelson said they were thinking about proposing a plat for the lots
on Onondaga. The six lots are 85 feet wide. If you are considering the
street through the back of.the lots, .you must take into consideration
the cost of the improvements, as you would have to sell the lot to pay
for the im~?rovement and come out even. Tt is an economic factor that
should be considered b.y the Committee and people who have big lots to
be split off. `
The Chairman felt that action should be delayed on the rezoning
request for further consideration of the streets.

Mrs. Londa Englund was present and explained the purpose of platting
is to sell the lots.
The Plats & Subdivisions-Streets & Utilities Subcommittee considered
the proposed preliminary plat and recommended approval. The Ordinance
requires at least a 20 foot easement to the street and that the easement
should also be for utilities. The lots are large enough to meet the
area requirement. Lots 2 and 3 are on the river and Lots 1 and 4 are on
Riverview Terrace. Referring to the access, it would be privately
constructed and maintained.
Mrs. Glenn Klingensmith (Lot 15�, 6�18 Riverview Terrace: Asked if
single family dwellings were to be bui t. The land is zoned for single
famil.y dwellings, and there would be a public hearing if the land were
to be rezoned for any other.category, but this was a hearing on the
platting onl.y. �
_ . Mr. John Metcalfe (Lot 16�, 6419 Riverview Terrace; His question �
was how large the pwrcel was and +he figures given him were 300 feet on
the South line, 350 feet on the North line and 218 feet on the West. Then
Mr. Metcalf� asked if there were an.y requirements as to how a house faced.
He was told that the Commission is not in a position to force people to
build a house facing a certain direction. These lots would meet the side
• yard requirements, and the question remaining would be whether or not
the house would face the easements or the street.
