1. INFORMAL HEARING ON ADOPTION OF 1970 UNIFORM BUILDING CODE AND THE
AMENDMENTS THEREOF:
Chairman Erickson said that he had been concerned for some time that,
besaas� the City of Fridley had not adopted the 1970 Uniform Building Code �---_
and had been operating under the 1967 Uniform Building Code,r,�e decided to
request a public hearing on the item, In checking with the Building Inspection
Depa�tment, k�e found they were right up with him and they were going to recom-
mend adoption.
� The City Engineer explained that in 1962, the City of Fridley adopted
� the Uniform Building Code which was compiled in California. A large part
of the Country, basically in the West and Midwest, are adopting, more and

is one of the first few communities who are adopting the updated code of 1970.
Cha?rman Erickson said be believed there were seven communities now who
have adopted ttte Code, some with amendmenCs.
- Mr. Qureshi continued that Minneapolis at one time had their own building

There has been some pressure from contractors regarding trusses. Under
46.021, Framing, one modification proposed is to allow trusses at 24 inches on
cefltez with a heavier sheathing required than under the Uniform Buil.ding Code.
46.030, Masonry walls are proposed to be 12 inches minimum. 46.031 Footings
are to be 4 inches wider than wall thickness. 46.032 Frost Footings are pro-
posed to extend 3'6" below grade on principal structures and accessory
structures extending into side yards ahead of the rear line of the principal
struc�ture.
Recommendations fr�om the Fire Department -- 46.056, Chapter 3804 proposed
to be amended deleting four stories and requiring two stories in height regard-
less of type of construction. Under Fire Extinguishing and Fire Alarm Systems,
45.057, a new subsection was added for an alarm system in multistory or single
story structures with six dwelling units or more. Under Fire Separation,
46.058, "AI1 gypsum joints in such separations shall be rough taped to prevent
penetration of gases and odors" was added.
Under 46.080, permits for one or two dwelling units shall be considered
expired one year after date of issuance. The new permit fee will be based on
the estimated valuation of the remaining construction. The purpose of this
item is to give incentive to the builder to complete the work.
Under 46.2, Security System and Devices, because of the increase in break-
ins it was felt the requirements provided here would give a reasonable ar.iount
of safety and general welfare for persons occupying multiple family dwell:ings.
The comment was made that Brooklyn Center had adopted this method with success.
Section 46.5 relating to Electrical, Heating and Plumbing will be brought
back later.
�he above is the short resume given by the City Engineer, the meeting was
then opened for discussion.
Section 46.021: Framing. As explained by Hank Muhich, there has been
px�essure from the contractors and the public for the City to allow trusses
as more and more trusses are becoming available. The Building Department
proposes to accept trusses approved by the Uniform Building Code at 24 inches

Section 46.022: Sheathing. The City Engineer explained
Building Code allows �" roof sheathing and even goes to 3/8"

�or duplex and sit�gle family structures. If the workmanship would always be
good, there would not be any problems. We are basically following the same
policy of requiring a little extra above what the Uniform Building Code allows
on sheathing as we have done in the past.
Mr. Jim George of Tri-Company, Inc. (builders) asked if any research had
been dane with other suburbs who have used trusses, and if so, have they
changed? He said he realized the City was not dependent upon other suburbs,
but tXUSSes have been used f�r some time. He understood Bloomington and
Edina had permitted trusses, but he was not aware if they have changed the
sheath�ng thickness. As far as his company was concerned, they have had no
complaints where they have used them.
Mr. Muhich went on to say that under 46.022 no plywood which is less
than �" shall be used for purposes of wall sheathing and composition and
quality must be approved by the Building Inspector. The reason the Building
Inspection likes �" is, theoretically, a carpenter is not supposed to miss a
stud, but it happens and �'P will old ett
46.024: Double Wall. This paragraph was read by Chairman Erickson. He
commented that it was not in the Uniform Building Code. The Chief Building
Inspector Muhich explained it was put in the City Code some years ago. Prior
to that time, the Department found that they actually had nothing to tie in
the house where the garage is attached. Now, "All walls between attached
garages and frame buildings shall have sheathing extending from top plate
� to bottom plate" is a requirement of the Code and the purpose is to strengthen
the connection.
Mr. Roger Myer, Tri-Company said in a house, you are going to wind up with
14" or 24" at the end of the house and you have sheathing on that. Your first
wall would be sheetrock. You are sti11 going to line up all four walls with
so much sheathing for strength. The garage is one of the walls rather than
the end of the house.
46.030t Masonry. Chairman Erickson said he did not think there was any-
thin$ to discuss as 12" masonry is �e�I�Pbelow gra fe
46.031: Footinge. The Chairman said that this is another item that has
been in practice for a long time, but had not been written into the City Code.
46,041: Roof Access. Hank Muhich eXplained that some of the utilities
firm$ have had difficulty getting the men to work on a roof at night without
a stairway.
Mr. Richard Harris, 6200 Riverview Terrace: Mr. Harris felt that t�is
would be a burden financially to conatruct a stairway for a small indust�ial
plant. A line should be drawn between what lcind of equipment is being s,�rviced
and the height of the building. He did not think Section k6.041 referr�d to
our community.
^ Nasim Qureshi added that, as a matter of protection, most of the lay�rge
concerns do provide these safeguards.

H�t2s Sondheimer, 5841 6th Street: He explained that he worked for Haar-
stick, Lundgren & Associates, Architects, and he has desipned school build-
ings, commercial buildings and has done inspection work along with designs.
H� would like to emphasize that there should be a difference of type and size
of &trueture. Consideration should be given to the fact that wages are going
up ior electr;icians. They get $11.00 an hour without overtime now, and soon
it w�ll be $12.50. Gonsideration should also be given to the equipment used.
For example, air conditioning could tze le:ft �or several hours before being
repair�d.
M�. Minish asked if there had been any request from the utility companies.
Mr. Muhich answered that this section was almost word for wvx'd with what they
gave l��.m.
46.OS6: Fire. '�his is a condensed version of the iTniform BuildinR Code
and referred to Class A cities. The original copy refers to occupancies of
four stories high, but to conform to our standards, the Fire Inspector re-
quested the wording be changed to two stories high.
/+6.057: Fire Extinguishing and Fire Alarm Systems. Mr. Sondheimer re-
ferred to a fire alarm system which goes off when the temperature reaches 136
degrees or 190 degrees. A lot of damage could happen before the alarm sounded
or th� sprin�Cling system be activated. He felt this would not give security,
but just added cost. It was pointed out that the system required was mostly
manual, .
46.058: Fire Separation. It requires a cover of 5/8" gypsum board.

Inspector said that this always has been the policy of the City but never
been spelled out.
46.059: Fire Separation. This referred to the one hour fire wall
separation. There were no comments.

46.060: Fire Walls: This was put in at the request of Robert Aldrich,
Fir� Inspector. Chairman Erickson felt the Fire Walls section should be
studied further.
46.080: Permits. This states "All permits for one and two dwelling units
shall be considered expired one year after date of issuance. The new permit
fee will be based on the estimated valuation of the remaini�g construction".
�he City Engineer said that there have been cases where the building of
a houge has stretched out for several years. The builder would construct a
certain amount, let the unfinished building stand a year and then begin again.
The lot and part o� the building would be just an eyesore to the neighborhood.
�hairman Erickson asked what they could do to make the builder complete
his work -- you can�t. Mr, Qureshi said that was true, but it is hoped this
^ would be an incentive to complete the work. The builder can come in and ask
for an extension.

46.081; Fees. Elevators and grain storage was deleted. Mr. Richard Harris
said that the last time they took out a permit, they got charged a plan check
fee. He realized that Uniform Building Code allowed a normal building permit
and a plan check fee, but he felt they were charged double. The permit fee is
suppo�ed to go for inspecting the building. Plan check fee is that somebody,
such �s a consultant firm or company which plan checks for communities, checks
this plan for the p1an check fee. What profess�onal service checked his plans?
46.2: Security System and Devices: This refers pXimarily to multiple
dwellings. The police have suggested the type of locks referred to in this
section. Brooklyn Center has been using this type of system for two years.
Bob Eibensteiner of Kootenia Builders, said he had planned to build a six
unit apartment house in the City of Fridley, but because of the security
systems and devices, he could not do it. It was impossible to build a foyer in
add�tion to the hallway. He has built some units in Edina, but not with all the
secur�ties listed in the proposed ordinance.
Ctiairman Erickson read the following list of communities which have
adopted the 1970 Ed�tion of the Uniform Building Code: Bloomington, Chaska,
Circ1� Pines, Eagan, Hopkins, Minneapolis and Orono. In addition to this
list, the municipalities of Minnetonka, Roseville and St. Louis Park hope tc
have the 1970 edition adopted.within the coming month. All will, however,
r-�.
attach some amendments to the code.
Mr. Richard Harris said it came to his attention in the past year or so,
a new product on the market called "High Density Carpeting" was being installed
in apartment building hallways. Would it be possible to require safety meas-
ures to go with carpeting? It was proven that this type of carpeting, when
it catches fire, gives off poisonous gases and heavy smoke.
Mr. Minish asked that the following information be given the Commission:
A memo from the Fire Department , as it wpuld be helpful. A copy of the request
fram Minneapolis Gas Company regarding roof equipment access. How many other
communities in the metro area are adopting the Uniform Building Code?
�he Planning Commission decided to continue, without motion, the Informal
Hearing on the Adoption of the 1970 Unifp�m Building Code and the Amendments
Thereof.to the April 7, 1971 meeting.
The City Engineer distributed pamphlets on a proposed State wide building
code.
2. (JONSIDERATION OF CITY ZONING ORDINANCE TO REQUIRE A DOUBLE GARAGE FOR A
SINGLE FAMILY DWELLING AND A FOUR STALL GARAGE FOR A TWO FAMILY DWELLING:
�'he City Engineer said there were comments made by different people who
felt that we have only a limited amount of single family building sites left
� in �'r�dley. There are areas where we have problems because the people now
wish they had double, rather than single garages. The Planning Commission has
eleeted to study the proposed ordinance.

star�d, but they are acting as a sounding board for the public. They had never
discussed the ordinance as a Commission.

I,�s1ie G. Svendsen, 7332 Oakley Street: He said that he was present as
part of a gxoup who feel that this proposal is not in the best interest of the
commun�ty. There are three objections. This kind qf proposal is completely
unn�ce$sary. A second car garage does not improve the quality of life in Frid-
ley. �t increases the cost. Many people do not wa�t or can afford two cars.
It seems unnecessary that we require them to build a two car garage. Residents
may sotaetime wish to add a garage. It would seem a more sensible way to advise
them tp make pxeparation for this, such �s building the h�me six feet off
center of the lot -- this woulrl enable them to add �bout 12 feet. It seems
unnecessary to impose a$300 to $800 for garage as well an addition of $24.00
to $45.00 to the property tax. If the concern was to increase tax revenue,
he quertioned whether or not all the lots available would be developed if this
kind of requirement had to be met. A lot with no home does not bring in tax
xevenue.
2) This requirement would be detrimental to the image of the community
as it could be considered as discriminatory. It would prohibit many low in-
come families to settle in the community. He was certain it was not the intent
but it could be the effect. It would be significant in making Fridley a closed
co�nun�ty. Many persans would not be able to affo�d to build with a double
garage, plus increased property taxes. Many of the people who live in Fridley
now probably would not live here if the requirement had been here before.
�
3) This kind of requirement is essentially in conflict with the Housing
Section of the Metropolitan Development Guide adopted by the Metropolitan
Council. Metro Council would assign a low priority in the review of Federal
Funding to the community who did not provide for low cost housing. Mr.
Svendsen sa,id that he spoke with a member of the Metro �ouncil who indicated
before a Federal Grant is approved, the Metro Council revi�ws the request
and makes Xecommendations to the Federal government. This would put the City
of Fridley on dangerous grounds when it came to securing Federal Funds. Unless
we shpuld think the Metro Council are powerless, Federa� Funds have been
allocated to many projects which the Metro Counci� have reco�nended. The
Federal Government seems to consider their recommendations.
Chairman Ericicson asked Mr. Svendsen if the gentleman from the Metro
Counci.l approved of being quoted. Mr. Svendsen said he would call the man and
let Mr• Erickson know the answer.
Mrs. Helen Treue�fels, 5248 Horizon Drive: She would like to second Mr.
Svendsen's statements. She referred to a zoning map of the City where the
vacant land was colored. She s aid she felt that in the Innsbruck area, the
requirement of the zoning ordinance could be met. She asked if the Commission
felt that in the Riverview Heights area homes could be built with such condi-
tions imposed? Instead of having houses that would pay their way and taxes,
thers would be empty lots.
The City Engineer said the City of Fridley has existing homes in all price
rangsa from $15,OOQ to $100,000. City is not trying to eliminate low income
^ housing, but the proposed ordinance referred to certain size lots that would
meet the requirements, and the proposed require�nt for double garages will
not app�y to lots less than 9,000 square feet. We have lots along Riverview

Heights which are less than 9,000 square fe�t. There �re only a few large areas
le£t fox single family dwelling developments. Houses in Chis area woul.c:

issued £or single family dwellings have been with double garages in the recent
years. ,
M�. Svendsen said that Edina, Spring Lake Park, Coon Rapids Councils have
passed requirements concerning one car garages, not doubJ.e garages. He
realized fOr 5ma11 lots this ordinance would not be accepted. He thought a
young coupl� may want to build on that lot and should not be penalized if they
could flot afford to build a garage right away. The ordinance was discriminatory.
Fridley is his home, he wants to live here. This may be very hard for him.
ConsidsX employ ees of new industries. Are we going to penalize their employees?
There should be more leadership on the part of our communities -- leaders to
see that housing is provided for people of all income levels.
Mrs. Richard Phillips, president of the Fridley League of Women Voters,
Xead a statement in which the Planning Commission was commended for inviting
public opinion regarding mandatory garage requirements. The League of Women
Voters were opposed to the ordinance for the following reasons: At this time,
when there is a housing supply shortage, no government should place unnecessary
restri.ctions on housing; the proposed requirement is an unnecessary require-
ment, as they felt it would serve to exclude families who could afford a decent,
if les� expensive, home; proposed adequate planning for a garage to be built
later; if tax base is the reason, why isn't the City's study on tax return
and pub�.ic service requirements for various classifications publicized? As
they understand it, the study showed that single family homes do not pay their
way --� they cost the other taxpayers money -- that industry breaks about even,
and that apartments, multi-f amily dwellings and commercial development more
than carry their load and lighten the tax burden on the rest of us; regulations
ax'e pending which would penalize communities which have unnecessarily restric-
tive zoning regulations making it virtually impossible for the community to
obtain Federal Funding fox' any project.

following suburbs in the Minneapolis area to see if they had an ordinance in
regard to mandatory garages: Edina does demand two car; Richfield, none; �p-
p1e Va�ley, no specifications; Burnsville, double car gaxage and surfaced
dxiveway; Blaine, none; New Brighton, none; Golden Valley, none; Crystal, none;
Broaklyn Center, none; Braoklyn Park, none; St. Louis Park, none, Spring Lake
park, douale car garage, (:oon Rapids, one car g�ra�e but not in effect; Anoka,
none; R.oseville, none; Hopkins, none.

Chairman Erickson explained that there had been a lot of problems come up
when people, who wanted to build a garage onto an existing structure, did not
have enough land to conform to the City requirements, and would have to go
t�efore the Board nf Appeals for a variance.
Mr. Fitzpatrick thought the proposed ordinance was also, to some degree,
discriminatory.
Chairman Erickson explained that the City had to have a side yard require-
ment. Sometimes a person would want to build a double garage in the rear of
�he lot, or having bui�t a single garage, would like to add on to it. These
are conditions where the sideyard requirement would go down to two feet.
Should the City turn down these requests?
A citizen asked if the request would depend upon the approval of the
neighbor and not the Planning Commission?
Mz. Minish said, as Chairman of the Board of Appeals, that Body has been
invol.ved in a good many requests for a waiver of a sideyazd requirement. The
'� neighboxs within 200 feet are given notices. The apprqval of the neighbors
is not necessarily a factor in the decision. When the Board of Appeals have
g�anted approval for a variance, each case was considered separately. Some-
times the house is placed in the center of the lot. Sometimes it is placed
to one side or the a�her to allow for a future garage. He felt if the proposed
ordinance were to be seriously considered, it should be geared to secure
footage of the houses.
Mr. Svendsen said that made a good deal of sense to him.
M�. Fitzpatrick said he could not have built his house on his lot at the
time he did and left room for a second car garage. You are still saying to
a man you can have only a certain size house to allow for a garage.
Mr. Schmedeke said he would like to remind the people present that the
Planning Commission were not the originators of this ordinance and it seems
the Cot�►ission is getting the heat. If he were build�ng a home,
he would like
to be able to choose whether or not he could put up a one car garage or two
stall garage. A solution might be a smaller sideyard footage if they could
leave room to put a two car,garage in the back.
Mx. Fitzpatrick said his first reaction to the proposed ordinance was
negative.
Mr, Zeglen agreed that it was his first reaction also. But he felt ig a
� person built a$35,000 home with one stall garage, there was too much money
invo7,ved in the investment, and he would have a better selling point with a
two car garage.

M�s. Eleanor Phillips said she was wondering if the Commission felt there
might be a problem in the future. Could the probl�m be met without an ordin-
ance?
C1�airman Erickson said he would have to disagree raith the type of ordin-
ance that attempts to establish the niunber of stall� according to the valuation
of the house. An ordinance is an attempt to protect. Public transportation
would help solve the problem of a family needing two or three car garages. He
had expressed lnis opinion as being much opposed to the ordinance on a number
of grounds. A man has the right to live in a house of his own choosing and
this applies as to whether or not he wants a single family garage. He realized
it can be a problem building on a garage later on. Our ordinance prob ab ly
should make some condition for expansion to accommodate a garage later on.
Perhaps a 13 foot sideyard would do it. He was definitely opPosed to the
proposed ordinance as it was now written.
Mr. David P aulson said that Apple Valley garage ordinance reads a garage
could not cover more than 30% of the size of the house. If you are on a small
lot, and have room for one garage, you would have to live with that. There
are a number of alternates, such as limiting the si�e qf the garage. Economics
will generally determine a one or two garage. If a man wants to build a house
without a garage, he should be able to do so.
MOTION by Minish, seconded by Zeglen, that the Planning Commission recom-
�,,,\ mend to Council that the Ordinance Amending 5ection 45.055 relatinq to garage
requirements in the R-1 District and Section 45.065 rela�ing to garage require-
ments in the R-2 District NOT be adopted. Upon a voice vote, all voting aye,

3. REVIEW AND FORMULATION OF POLICY REGARDING FUTiJRE DEVELOPMENT OF GAS
STATIONS:
Nasim Qureshi told the Commission that there has been a large increase in
the number of gas stations in the City of Fridley. In the last five years, the
number of gas stations have doubled. Since November, 1969, the last change
in the ordinance regarding gas stations (Ord. No. 419), a special use permit
was z�quired to construct a gas station in C-1 and C-2 and M-1 and M-2 Districts.
Since its adoption there have been three or four requests for gas stations.
City has gone along with it. He would like to see if the City wants to set a
policy stating how many more stations the City should have and where they
should be allowed. Xou don't have to give them a permit if you feel it was
not fox the betterment of the area.
It� Brooklyn Park a special use permit was req�ti.red, the Council denied it,
the pe��tioner went to court and the court upheld �he decision. Fridley has
22 basically gas stations, 5 car washes and pumps, 6 grocery type, making a
total p£ 33 gas stations for a population of 30,OOQ. Also, does City want
four gas stations on four corners of an intersectiqn?
� T�.e question before the Commission is whether or not there is the need
for additional gas stations. The area we are concerned with now is North of
Osborne Road. How many gas stations do we need an�l how f ar ap art? Should
another type of development be encouraged? The se�vice road loopbacks are
rea],ly large ez�qu�l� t� d�y��p�a okher types o€ faci�itie�, but they are especially
attraCtive for gas stations. �

Chairman Erickson had another thought for the Co�ssion -- was that type
of service road detachment a reasonable approach to the intersections?
The City Engineer indicated that he would like to discourage service roads
along �he highway and wauld like the roads to be set back 300 feet away from
the highway to service the properties along the highway.
The Planning Commission decided to continue without motion the Review
and Formulation of Policy Rega�ding Futur_e Development pf Gas Stations to the
d�pril 21,, 1971 meeting.
G. PRELIMINARY DISCUSSION WITH PLANNING COMMISSION REGARDING ELEMENTS AND
PROCESS OF COMPREHENSIVE PLANS FOR THE CITY:
The City Engineer explained that the City adopted a comprehensive zoning
map in 1.956 and over the years we have changed zoning, road patterns, crossings,
etc. What comprehensive planning does is putting all this information together,
what we have done before and what we are going to do in the future. The exist-
ing zoni�ng ordinance is what we have done. You have approved plats and rezonings.
We have tried to put all these pieces together and show you what has happened
and wha� we are to do now. Any kind of Federal grant requires a comprehensive
plan. '].'his plan does not mean a new zoning map, but it gives the City a direc-
tion fox� future planning and development.

A colored Zoning Map with existing Land Use was studied. Mr. Qureshi ex-
plained that sometimes the property is used for something other than basic
use allowed under the zoning district. He pointed out the areas remaining
which w�.11 require further studying. If a developer is interested in commer-
cial, he can be told where it is.
The Flanning Coumission decided to continue without motion the Preliminary
DisGUSSion with the Planning Commission Regarding Elements and Process of
Comprehensive Plans for the City until the April 21, 1971 meeting.
5. REVIEW AND REEVALUATION OF EXISTING PLANNING NORTH OF OSBORNE ROAD AND
WEST OF UNIVERSITY AVENUE TO CITY LIMITS:
M�'. Qureshi said that the purpose of this presentation is to review the
past planning done in this area, especially regarding road patterns, railroad
crossings and zoning. The Planning Commission has recommended rezoning an
area along University Avenue from M-2 to C-2. Part of the area has already
developed into a small piece of comanercial. The time of strip crnnmercial
zoning is gone. Now you have to have large commezcial areas. The people tend
to go to large comanercial centers.
Cxossovers and Signals: As far as we are coneerned, we would like to
get away from service roads.
� Mr. Schmedeke felt th� loopbacks should be made larger so that it would
eneouxage other types of business, instead of gas statipns, to go in there.
He said th at most filling stations have autos for sale. Referring to his copy
of the Dealer's Guide of the State of Minnesota, it is unlawful to engage in
selling cars without a dealer's license.

Inasmuch as Mr, Keith Harstad was present, Chairman Schmedeke asked him
to revi�w his request. Mr. Harstad explained that the preliminary plat was
an L-shaped paxcel of land with 100 feet €ronting on Rice Creek Road located
1Q0 feeC West from the intersection of Rice Creek Road and Stinson Boulevard.
The Nprtl� and South dimension is 435 feet, and on the South portion of the
pareel �acing Sti.nson Boulevard are three 75'x120' lots, and West of these three
lots �r� two 75'x90' 1ots. The two 75'x90' lots show a cul de sac because
this is what the overall plan of the area suggested. He said there was plenty
o� land for a 1ot facing Rice Creek Road, and this, with the three lots on
St�insan Bou�.evard, were the ones he was interested in platting and developing
now. The rest of the land could be an Outlot.
The Ci.ty Engineer stated that, as long as we did not know at this time,
how the land to the West and South would develop, the best thing would be to
have th� lats platted abutting Stinson Boulevard and Rice Creek Road and the
rest of the �and left as an Outlot. The problem was the utilities. The
pxAperty owners of the whole neighborhood would have to work together which
will Cak.e time.
Th� City Engineer continued that Stinson Boulevard and Rice Creek Road
have water and sewer already available. The suggestion was made that the
P�annir�g Go�nission could recommend developing the lots on Stinson Boulevard
and R�c� Creek Road and then the rest of the property could be left as an
Outla� until the owners of the property on the West and South would come in
wi.�h a proposal.

� Th� City Engineer said the purpose of this study would be to bring up to �
date ttic� street planning for this area. This area is one of the largest
indust�'�al areas left in the City of Fridley, and it is hoped that we would
coordinate all the planning. Just North of Osborne Road is East Ranch Estates,
lst �nd 2nd Addition, and recently the Viking rezoning approval by the Plan-
ning Cot�unission, and a golf driving range was installed. There has been some
concern about the railroad crossovers. On 77th Way and the railroad tracks
there was a serious accident. From Osborne Road to 83rd Avenue there are
four rai�,road crossings. The planning is crossings North of 79th Avenue and
South o� 83rd Avenue be relocated to line up with 79th and 83rd. A street
pJ�an should be formulated to keep industrial traffic out of the residential area.
TMe study should include, whether or not, the unprotected railroad crossing
at 77th Way should be maintained or closed, and consider holding hearings to
see if the people want the crossing at 77th Way closed.
Mr. Qureshi continued there is no great urgency for the Subcommittee to
come in with a quick decision, but the next time a petition is requested,
then we wquld know where we want to go. It is good to have controlled
access. Osborne Road does have a stop flash sign on the railroad crossing.
Mr. Crowder asked if the road had been platted for the corner of Osborne
Road and University Avenue by Bob's Produce. Mr. Qureshi said the plat has
never been filed with the County for East Ranch Estates 2nd Addition, but
that is in the process of being taken care of now.
� Mr. Crowder continued that if the Subcommittee recommended that the two
unprotected crossovers be closed, would that cost the City money?
Mr. Qureshi answered that it would be just a minimal amount, but before
that would happen, there would have to be public hearings. The City has
already entered a mutual agreement with the railroad in regard to these rail-
road crossings.
Speaking of semaphores, Mr. Qureshi said the City has semaphores at
Osborne Road and we ax'e going to have one at 85th Avenue and University
Avenue• The question of traffic will be the deciding factor for future
signals. He noted that Spring Lake Park is a contributing factor traffic
wise fo� signals on University Avenue.

dep�r�ds upon how many miles of streets are built in the City. There is 0.46
miles of State Aid Street mileage available to be designated and this affects
� maintenance monies appropriations from the Minnesota State Highway Department.

for ce�'tain situations. The system now is fairly complete and the recom-
menda�ian is that this street be redesignated. According to the pattern

public parlcing lot would be iu the front of the Hospital and on Osborne
Road. The doctor's parking lot would be a controlled lot where it is
necessary to have a card to get in. The employee's lot will be behind the
Hospital, This lot wi11 have two entrances on Lyric Lane. They will be
iucreasiag their parking from 267 spaces to 648 spaces.
The Board asked Mr. Nordgren if there was a way they could direct the employees
towards Osborne Road. Ae said there wi11 be a road along the West side of
the Hospi.tal aut to Osborne Road and perhaps the Hospital could direct the
e�nployee¢ to use this as the means of egress. He did not feel that a ticket
gate would work as this area will be used by delivery trucks also.
The Boa�d questioned the drai,nage. They wondered if the storm sewer on
Madison Street would be adequate for the additional drainage from the
blackto�► areas and asked tha� this be checked with the Engineering Department.
It was also mentxoned to Mr. Nordgren that the blowing dirt would have to
be controlled as much as possible throughout the summer. Mr. Nordgren said
he was �ure the contractor would take care of this. He also said that the
employee and doctor's parking lots would be completed by July 15, 1971, and
t�is shquld help somewhat.
Mr. Muhich presented a letter to the Board from the Hospital stating that
they would be responsible for all landscaping work. Mr. Nordgren said that
they w�re going to save as many trees as possible when putting in the
p�rkin� lots.

on side of building. They also have 15 parking spaces according to the
Code. There will be sod around most of the building as shown on the plan.
The Board asked Mr. McLaughlin if they had any outside lighting. He said
� they would have approach lights to the station and also the canopies would
be lit. �.3.ghts will be left on inside the building after closing hours.
The Board asked Mr. McLaughlin to consider using a couple of lights on the
outside of the building for their protection and also to help the police.
Mr. McI�aughlin said that the plans he had were standard plans and require-
ments such as for footings, etc. would be changed to meet City Codes.

painted block for future expansion so they will not have to cover up a brick
� wall again. The foundation will be built with a brick ledge so that should

th� addition onto the station the City asked for a 5' sidewal�k easement so the
ex�.stin� si�n sits in the m,iddle of this easement and it is up to the property
lines on bQth sides. The proposed sign will be located on the East side of
tli�: property along the Uz►iversity Avenue Service Road. We are asking for 46'
as we chec�ted �he building permit for the Phillips "66" sign, which is across
Mississi.pp3. St�eet fxom us, and the height of that sign was 46', We are only
asking �ox the same hBighG as our competitor as now their sign hides our sign.
We also wan� the height to get away from the maize of poles, lights and signs.
The height wpu�d give the sign better visibility for the north bound traffic.
Q1 Bagstad sCated the Engineering Department was interested in talking to the
,E�nexican Oi.�. Company aboufi obtaining a 12' easement for an extra lane along
Mississippi because of the traffic backing up in this area.
Mr. Iiousenga stated he could not say if the company would agree to this as this
is the firs� tf.me he has heard anything about it.

make the sign hig,hex than the 24 feet we are proposing to clear the trees

Sever�l ci�i�ens wexe present tp make the suggestion that a Ski Team be offere
by the City of Fridley fox the 1971 - 1972 Winter Season. Th�y explained that
theTe was a di€ference be�ween the Ski Team and a Ski Club. A Ski Team would
be involved-primarily in competition with other schools and a Ski Club is a group
of people who get together �or the purpose of Skiing together. I£ competition is
invo�.ved, it'd be only in fun and among themselves. A Ski Team c,auld even be
invpJ.ved �n the State Competition,
Tram �rickner was the spokesman £or the group and he ex�lained that he had done
sQme r�search on ather schools and theix Teams. Cooper gives $1,500.00 toward
a�ki Team. Whits Bear Schools provide $150,00 plus transportation. If Fridley
w�re to become a.nvalved in this type of activity, they would hav� to join the
conferenc�. Thay would probably be with Stillwater, North St. Pau�., Blake, etc.
The �ost would involve special poles and transportatian. It wouldn't necessarily
�.nvolve many special types of skis. Mr. Brickner had inc{uired at several of the
�lopaa to get som� type of idea-as to the money it would involve if they were to
h,ave ski practi.ce ev�ry night after school. I�ift tickets are $1.00 a night at
airch Fark, �ar $25.OQ a season, This would have to be paid by the individual.
Ken� Farks, Youth Advisor from School District #14, and also a member of the
Fridley High School Ski Club, told the Commissian that there were approximately
72 students on the rolls and 58 were active.

Mx. Wenholz stated that if the present program was changed to a Babe Ruth Program,
the boys would b� eligible to participate in the District and State Babe Ruth
Tournaments. It would be the same basic program, requirin� the same things
pxpvided by the City in the past. Last year our program had six teams and we
could starx the new program with this number.
M�. Wenholz contacted the Little League people and they are willing to support
such a program.
Mr. McPherson, President of �ittle League, was present to discuss the proposed
program. He stated that Little League involved boys from ages 9 to 12. Itla in
was s�arted in Fridley in 1964, and they had 500 boys enrolled last year, p y g
14 scheduled games. They lease property from the City, directly behind the
school, £or their games and pr�ctices. It covers approximately a 2 block area.
Each year, they spend between $2,000.00 and $4,000.00 for uniforms, equipment,
etc, This year, they hope to �xpand to two divisions. Little League could
include boys ages 13, 14, � 15, but it hasn't in the past.
Mr. We�holz stated that the Babe Ruth Program has a very strong State organization.
Mr. Brown said that the City could not provide uniforms. They would probably have
to play without uniforms ihe��ixst year and then pick a sponsor who would provide
unifoz�ns and other necessary equipment.
^ The Gommission asked if all boys would be able to play. Me. Wenholz said that all
b�ys would be encouraged to play. They would be divided into teams, using a
draft method, wh�re each coach would choose one boy at a time, in turn.

Kent Parke was present, at the invitation of the Commission, to represent the
Fridley Hi.gh School Student Council. Mr. Fitzpatrick explained, briefly, what
the Commission had in mind, regarding Youth Advisory to the Commission. Basically,
he explained, the Commission requested the presence of some member or members
o£ the Student Council, to attend the meetings on a quarterly basis, or oftener,
ii tl�ey so.desire, to voice their opinions on the success or present programs and
hpw they can be improved, and also, to discuss proposed programs and how to get
more students involved in them.

Mr. Mike 0'Bannon, Anaka County Commission, was present at the invita�ion o�
�he Commission. Mr. F�tzpatrick stated that the County Gommissioner has attended
meetings of the Comm�ssion on a regular basis, in the past, and asked Mr.
p�Bannon for his opinian. Mr. Q"Bannon will try ta maintain the same schedul�
of attendanee.

Mr. Q'�annon stated that he feels the County should participate more in the
park� within �he City. He said that if development af roads, etc., are required,
�he Gp���Y has the manpower and equipment to do it and should.
Mr. Q'Bannon will plan to attend the February, May, August, and November meetings,

�he Comnnission rece�ved a petitio� from t�e Citizens of Fridley, regarding land
�ACated eas� of O1� Central. The land is generally located between Mississippi
Street and Rice Greek Road, Stinson Boulevard and Arthur Street. The petition
�e�uests tha� the majox portion oi this property be left in its natural state
fp� educatipnal �nd ecologica� value.
This property is presently, privately owned and is a low land which would involve
a draina�e problem before many improvements could be made. The people who own it
want �o dev�lap it. We don't control it at the present time. The petitioners are
aski�g us to buy i� as a park land.

su$gested that a possible solution cauld be found in the "Green Acres Act". This
is a State Act. This would cut the citizens taxes and leave this area as open
space and no one wauld builcl on it, but the taxes wouldn't be increased because
o� it, Sh� didn�t know if this land would qualify or not.

Mr. Brown called the Commission's attention to the letter from the I�linnesota
Recreation ana Fark Association, dated blarch l, 1971, informing us that a new
Commission Section of the M.R.P.A., had been o.rganized, and inviting the Fridley
Parks and Recreation Commission to join the State Organization. The Commission
presently belongs to the National Organization, with annual dues of $50.00. The
State Organization has annual dues oF $25.00. -
r'� Boards whicli take out memberships receive copies of the M.R.P.A. Quarterly,
special reports, annual reports, and other information which will help the
individual Commissioners to better serve their boards. Mr. Broian also pointed
out that the Board of Directors, of which he is Treasurer, has a member at
large, at present, under the Commission Section.
Mr. Stimmler said that he felt we should decide whether or not we were going to
participate in this program, before we decide to join. He asked if we actually
benefited from this program? b1r. Brown said that we did and he fe'_t the
Corunission should belong to the State group as well as the National organization.

each weekday in April and D4ay, from 3:00 to 5:30 p.m., for the junior high school
athletics. C�Ir. Brown asked the Commission to consider this request for facilities.
Mr. Fitzpatrick asked if this would interfere wzth any of our other organized
activities? T4r. Brown said it �ti�ould not. Mr. Fitzpatrick pointed out that there
� had been sorne problerns over the Tennis Courts last year. He reminded the
Commission that when the coux•ts are t�ed up every afternoon for two months, no
one else, meaning citizens of Friciley, not being students at the Jur�ior High
School, would be allowed to play Tennis. This is where the problerns arose last

The Commission's attention was draian to the hlemorandum from Paul Brown, requesting
a change in the policy for registering six year olds for the Summer Playgrounds
Frogram. The minimum age limit for registerin� a child for this prograr� is six.
Each year, the pxd�lem arises, where a child is going to be six during the time
the program is in process, or the parent feels the child is really capable of
participating in the program because they've already gone to school for a year,
but won't be six until fall. The ladies who register the children are placed in
a difficult situ�tion because the mothers ask the age limit and in some cases, if
their child is too young, they'11 take the form back and ctiange the date of birth
to conform with tlie minimum requirement. The ladies who are registering the
children can't c<tll the mothers liers and yet they can't r�gister a five year old,
either. Mr. Brocvn told the Commission that there was a certain amount of risk
involved in registering a child who is too young f�r the program. Liability
alone, if for no other reasons, should be evidence enough for wanting to have a
more rigicl policy governing the registration of six year olds.
The new policy for registering six year olds for the summer recreation progrum
is proposed to read as follows:

A group of inen representing the Fridley Youth Football Association, iaas present
at the meeting to discuss their 1971 program. Mr. Tom Nielsen, President of the
^ Association, was the spokesman for the group and he informed the Commission that
there ��ere thirty to thirty-five active men in the Association and they'd made
some minor revisions in their program.

the new nylon, stretch fabric and should be easier to keep up than the old
style. The old jerseys will be used for scrimmage.
Mr. Nielsen said that as far as they were concerned, the biggest problem is the
playing facility. There's little grass at the start of the season and none at
all at the season's end. They reqaest better maintenance of the field.
They would also like the use of other parks which have lights, such as Madsen,
Sylvan, Logan, etc. Moore Lake doesn't have lights now, but they are also
requesting a light standard to be installed at that location. Regular games
would be played at The Commons at their lighted field, but they'd like to save
the grass as much as possible by practicing elsewhere.
A third reQuest would be to have the full 100 yards of playing field, roped off
on both sides during the game. People stand so close to the £�,eld that, at one
time last year, a player was down with a minor injury, and the coach couldn't
see it. The Commission felt this was a reasonable request.
,^ Mr. John Reeves, a member of the Association, as well as a coach, reported that
he had a rather serious injury last season and he felt it was partially due ta
/ the condition of the field. He stated that, in his opinion, the field was a real
hazard. Mr. Reeves suggested that a possible solution to the watering problem
would be to bank up the sides of the field and flood it like you would a hockey
rink, until an irrigation system could be installed.
The Commission asked b1r. Nielsen if the changes they'd made in their program
would in any way, change the agreement that they had with the Department? I�,r.
Nielsen said that the only thing that was different, was that the age limit
was extended to 14 years old (during the given year). He said that they didii't
want any age group left out.
Mr. Olson suggested that one possible solution to the grass problem wo�ld be to
plant a combination rye and fast grass to tie over until a sprinkling system
could be installed and good grass either seeded or sodded.
POSSIELE PARK LAND EAST OF OLD CE('dTRAL�
Mr. Olson asked if there'd been any progress with the idea of developing a park
east of Old Central? b1r. Fitzpatrick said that the area discussed by the
petitioners has never been brought up again by the Planning Commission. The
recommendation has gone from the Planning Commission to the City Council for
action on a zoning change for double bungalows.
^ The area that Viewcon, Incorporated i��as talking.about donating to the City for
park purposes, was again discussed. The Conunissioners asked if there'd been
any new developments. Curti.s Dahlberg, Park Planner, said that Mr. Brown had
spoken with the Vie�acon people after tlie Council m�eting, but as far as he knew,
there was nothing definite. Mr. Brown was trying to get the contractor to
develop the park before donating it to the City, so it wouldn't be idle acres
until the Budget could include t}ie necessary improvements.

quite a sizeable number of the population who could not get across Rice Creek
and the Commissioners agreed that there was def.initely a need for a south
access to Locke Park.

today. Thexe are two other service stations on this corner. Ther� is aZso a Stand-
dard station on University Ave. at 73, this W�ould p7.ace t�ro Standard S-taio�,s with in
a m�.le of eaeh o�h�r. �
The co;n�r of Osborne & U�iversity is alre^.dy th� scene of too n�y acci�ents. A
third gas station will. only a�d to probl�m. There is Ur.it� Hospital, t�?o church�s
and several a�artm�nt buildings already'feedin; traffic into this interssction and
this p?�a�oose3 third s�rti-ice station could rrzll beco�e a fatal bottle neck.
I hope we donot feel tha1; a service station on a11 four corners of every major
inters�c�ior� is nec2ssary.

Notice is hereby given that the Planning Commission of the
City of Fzidley will meet in the Council Chamber of the City Hall
at 8:00 P.M. on Wednesday, April 7, 1971 to consider the following
matter:
Consideration of a request for a Special Use Permit,
SP 4�71-03, by the American Oil Company for the construction
of a service station in a C-2 District as per Section
45.101, 3E of the City Code to be located as follows:
Commencing at the intersection of the East right of way
line of University Avenue and the Northerly right of way
line of Osborne Road; thence 248 feet Northeasterly along
� said Northerly right of way line of Osborne Road to a
point; thence deflecting to the left 90 degrees approxi-
mately 144.0 feet to a point; thence deflecting to the
left a distance of 208.0 feet to a point on the East right
of way line of University Avenue, said point being 206.3
feet from point of beginning; thence South along said East
right of way line 206.3 feet to the point of beginning„
lying in Section 11, T-30, R-24, City of Fridley, Anoka
County, Minnesota.
Generally located at the Northeast corner of University

Mr. Housenga and �Ir. Brooks were present to represent Standard Oil. :'ir. Housenoa
presented his companies proposal to the Board. He had three complete olans,
surveys and photc�graphs of his proposed building.
There was a petition of landocaners presented to the Board �,Tith 9 far�ilies in the
area requesting denial. There was also a letter from Reverend Denyes, addressed
to Mayor Kirlcham, requestino denial. Chairman rlittelstadt read the letter to the
members and visitors.
MOTION by Ahonen, seconded by :Iinish, that the request for a Special Use Fermit,
in order to constrt�ct a service station on the N�rtheast corner of Osborne and
University, be denied for the follo:�ling reasons;�
1. There was no reasoning presented �ahy the property could not be used
for its originally zoned purpose of R-3 developem�nt. ' .

Mr. Brooks at this time made an appeal on behalf of Standard Oil. He stated
that Standard Oil bought the property in 1958 £or the purpose of putting a
service station on that corner. Then the company patiently waited until the
volume of traffic could support a service station. He also stated that it
would be very difficult to replace the property. _ .
After additional discussion, Chairman riittelstadt asked for a vo� on the
motion as presented. Upon a voice vote, Minish and A�onen voted yes, riittelstad�

Chairman r1ittelstadt stated that he voted no only to give Mr. Brooks a chance
to meet personally with the petitioners before the Council Meeting of January 8,
i96s.
ITEM 1 CONTINUED - LUPIENT REQUEST;
Chairman riittelstadt stated that although the petitioner was still no� present,
the Board would hear the several persons who appeared in ogposition to the
proposal. .
Mr. Roger Axmark submitted a petition with 19 dwellino owners' signatures asking
for a denial of the request.
Chairman Mittelstadt opened the floor for discussion. The complaints concerning
t6e proposal were:
1. It would present a parking problem.
2. The driveway would be �in a dangerous position near the underpass.
3• The parking would be in line with adjacent front yards.
4. There would be no play area for children.
5. The apartment would probably decrease their property valuation.
6. The proposal is extremely short of the required land area.
Mr:_S'Iinish made a motion to deny the request for the following reasons:
1. The gross nature of the variance.
2. 19 Adjacent property owners are opposed to the variance.
3. The parking would present a problem.
4. There is insufficient play area.
The motion was seconded by Ahonen. Upon a voice vote, �honen, riinish, and
Mittelstadt voted yes. The motion was unanfmously approved.

Mayor Kirktiam said that Mr. Schmedeke has already had a review of the
report, and it would be in order to receive the report. He astced rlr. Eldon
Schmedeke if lie had any further questions. rlr. Schmedeke asked if it was
the Council`s advice that he go to the Planning.Commission. Mayor Kirkham
said that the next step for him �•�ould be to follow the normal procedures
on rezoning and go to the Planning Commission next. Mr. Schmedek� said
that he would be bringing up the possibility of a slip-off ramp on 60th
Avenue, as this area did not get a service drive, and he asked if the
Council thought he should request this at the same time he requests the
rezoning. riayor Kirkham said he did not know whether it would be better
to request both at the same time or not, but he thought that if the zoning
was settled first, the request for the slip ramp would have more weight.
MQTION by Councilman Sherinan to receive the report from the City Attorney
and City Engineer regarding the zoning of the Schmedeke property. Seconded
by Councilman Liebl. Upon a voice vote, there being no nays, Mayor I:irkham

The City Engineer revie�aed the report for the Council and said that the
property is presently zoned P.-3. He said that the Planning Conmission
discussed rezoning the property for only a certain length of time, and
then have it revert back to the previous zoning, but rezoning canr.ot be
done in this caay, and with the present zoning they �aill r.eed a Special
Use. Pe.rmit. .
Mr. W. G. Housen�a and Harry Brooks, representino the American Oil Comp?ny,
came to the Council table. They e.xplained that on December Z0, 1967, they
had appeared before the Board of Appeals in re�ard to buildin� a service
station with a Special Use Perr:iit, r1r. Housen�a presented pcitures of the
type of station proposed an�( sho�aed the plans. He said they meet all
buildi.ng and special requirenents. He showed a plastic model of the building
proposed. Mr. Housenga said that american Oil had bought this property in
195s for a station, and has been c•aaiting for the area to develop.
The Council pointed out that there G;as a parcel. of land across from this ,
� corner that was designed for a service station, and ].�+nd to the 4;est of
- tlleir parcel zoned for a service station without a Special Use Perr�it.

^ appearance of a service str,tion, and did not feel another station would be
adding anythino to the CiL-y. rlr. Broolcs said that the American Oil
Company has plans to rejuvenate and streamline their stations to upgrade
their image.
Mr. Brooks s.�id that at the Board of Appeals meeting 17 property o�•�ners
representing 9��omes had presented a petitior. requesting denial of the
permit. He said he contacted these people and had secured 21 statements .
(representing 6 homes) stating that the people now have no ojections. He
said 2 of the residents �aere only living there temporarily and could not
sign, and 2 oth�:L people had only signed to be neighborly. r1r. Broo�_s
said that twa home owners still did not feel they �aanted to see a station
in the neighborhood. He sho�zed the Council a copy of the original petition
and the paper on cahich the people had signed they had no objection, and
compared the na.mes.
Mayor Kirkham said that this parcel is next to a large undeveloped area
in Spring Lalce Park Village, and approving the Special Use Permit may
interfere with something they are planning. He said that it may be of
help to the developers if this plan was sho�•�n to the Spring Lake Parlc
Council. Councilman Harris said that the City has to plan in advance
for access around the station for stacking room, so there is never a
traffic prob2em again, such as they encountered on Mississippi Street.
He said tiiat they may never c�evelop to that extent, but it has to be
�� considered. Councilman Harris scid that the rlinnesota High�aay Department
may want to loolc at this also, and it should be brought to their attention.
•-' Councilman Sheridan suggested that the special problems that Fridley has
had with stacking at intersections could be pointed out to Spring Lake
park as any necessary land acquisition c�ould have to be made on the
Spring Lal:e Park side. Councilman Harris suggested that the City Engineer
explain what is happenin� on 61st Avenue and 65th Avenue on University,
so the prevention of this problem could be incorporated in any long
range plans. Councilman Sheridan asked if the station could be moved
further �•�est or closer to T.H. ,�47 for more visual access. Mr. Brooks
said there was a 75 foot �imit on the G:est approach:
MOTION by Councilman Harris to table the consideration of this Special
Use Permit for the purpose of study and discussion with the Minnesota
Higtitti�ay Department and Spring Lake Park. He said that this w ould allow
more time to study and consider the problems. The City Engineer pointed
out that the Board of Appeals has denied the request, but the American
Oil Company can request another public hearing before the Council. .•tayor
Kirkham stated that this can be brought back on the agenda when the City
Engineer and American Oil Company are ready to discuss it further.
Mr. James rlcDonald, also representing American OiI Con:pany, came to the
Council table ancl said tilat he had tal.ked to someone at Sprin� Lake Park
on the telephone, and they had no plans at present for the area of land
. next to [his parcel. He said that the laad has an industrial zonin�, and

the special assessments and se�aers to caork out more desirably, and he said

The City Attorney said that one of the requirements adopted by the City
Council in the rezoning of the Herringer - Target property was that p�blic
access be provided to tt�e Glover property. He said that the Target Company
has provided ttle easterly 30 feet of Lot 1 and approximately an additional
19 feet for a total of 48+ feet of access to the Glover property. He said
it would be his recommendation tha.t this 48-+-�`'unciimanCLiebleaskedsif this

land if the as=��ssments �aere paid as they ccr.e due, and be paid on a
yearly basis, instead of having to pay for it alI at once and the land
just sitting vacant. Councilman Sheridan said that this would be binding

be fine if the la.zd was to be used in the near future, but he felt it would
be wasti_ng taxpayers money, if the land lay not being used.

We are presently preparing a revised layout of the service station locatior.,

Mr. Housenga and Mr. Brooks were present to represent Standard Oil. Mr. Housenga

area requestino denial. There was also a letter from Reverend Denyes, addressed

in order to construct a service station on the Northeast corner of Osborne and
University, be denied for the following reasons:
1. There was no reasoning presented �ahy the prop��rty could not be used

2. The surrounding property owners, who are representpd by thE petition
and letter, are opposed to the special use.

Mr. Brooks at this time made an appeal on behalf of Standard Oil. He stated
that Standard Oil bought the property in 1958 for the �purpose of putting a
service station on that corner. Then the company patiently waited u�1ti1 the
volume of traffic could support a service station. He also stated that it
would be very difficult to replace the property.
After additional discussion, Chairman Mittelstadt asked for a vo� on the
, motion as presented. Upon a voice vote, Minish and Ahonen voted yes, rlittelszadt
� v oted no. The motion passed.
Chairman rfittelstadt stated that he voted no only to g'ive Mr. Braotcs a chance
� to meet personally with the petitioners before the Council rleeting of January 8,

Chairman riittelstadt stated that although the petitioner was still no� present,
the Board would hear the several persons who appeared in opposition to the
proposal. �
Mr. Roger Axmark submitted a petition with 19 dwelling owners'
for a denial of the request.

I. It would present a parking problem,
2. The driveway would be in a dangerous position near the underpass.
3• The parking would be in line with adjacent front yards.
4. There would be no play area for children.

6. The proposal is extremely short of the required land area.
