Page 1, Item 1, first sentence -- strike out the word "becauee", put a period

BY KEITH HARSTAD: Part of Lot 7, Auditor's Subdivision �i22 (Rice Creek
Road and Stinson Boulevard - approximately 1'� acres).
MOTION by 5chmedeke, seconded by Fitzpatrick, that the Planning Comrcussion
waive the reading of the Public Hearing notice for the Preliminary P1at, P.S.
#71-01, Silver Oaks West by Keith Harstad. Upon a voice vote, a11 voting aye,
the motion carried unanimously.
Mr. Schmedeke explained that the Plats & Subdivisions-Streets & Utilities
Subcommittee approved the preliminary plat, P.S. 4�71-01. He continued that there
are three lots facing Stinson Boulevard and one lot facing Rice Creek Road. The
� lots in the center of the preliminary plat were made into one outlot because
they could not be serviced with water and sewer at this time.. The petitioner
agreed to this and on that basis, the Subcommittee approved the request.
The cul de sac shown on the outlot was a part of the original street plan
for this area. Mr. Harstad agreed with the cul de sac unless they could come
up with somethi.ng superior. Mr. Schmedeke explained the Subcommittee felt the
cul de sac could be moved depending on the way the outlot was developed.
Darrel Clark said that Mr. Cochran, owner of the property to the West, sold
it to Mr. Robert Miller. Mr. Miller was in the office recently and he did not
offer any comments whether or not he liked the plat.
Mr. Schmedeke said that he went through the area before the request came
to the Subcommittee. He noticed that homes are pretty well built up on Stinson
Boulevard. The lots in the proposed plat seem to conform pretty much with the
rest of the area. Sewer and water is available, but he would suggest red tagging
the outlot until utilities and streets are in.
MOTION by Fitzpatrick, seconded by Zeglen, that the Planning Commiss_ion
recommend to Council approval of the proposed Preliminary Plat, P.5. #71-01,
Silver Oaks West, by Keith Harstad being part of Lot 7, Auditor's Subdivision
#22, approximately 1� acres, su.bject to red tagqinq the Outlot until such time
as utilities and streets are in. Upon a voice vote, a11 voting aye, the motion
carried unanimously.

2. PUBLIC IiEARING: REZONING REQUEST, ZOA #71-03, AMi:BICAN OIL C0. BY JOiiN �.
^ YOUNGDALE: To rezone that part of the NF}� of the NGA� of Section 11 lying
East of the centerline of University Avenue and North of the centerline of
Osborne Road as said roads are naw laid out and conatructed (1960) from R-3
to C-2. Generally located at the Northeast corner of University Avenue
and Osborne Road.
3. PUBLIC HEARING: SPECIAL USE PERMIT, SP �71-03, AMERICAN OIL C0. BY JOHN P.
YOUNGDALE: To construct on the Northeast corner of University Avenue and
Osborne Road a aervice atation in a C-2 District per City Code, Section
45.101, 3E.
Chairman Erickson informed the audience that the public hearings for the
rezoning request and special use permit would be considered at the same time.
He then read the public hearing notice for the rezoning request, ZOA �i71-03,
American Oil Company.
MOTION by Fi tzpatrtck, seconded by Schmedeke, that the Planning Commission
waive the reading of the public hearing notice for the special use permit,
SP #71-03, Ameracan Oil Company by John P. Younqdale. Upon a voice vote, a11
voting aye, the motion carried unanimously.
Chairman Erickeon explained that the legal description for the special use
permit is part of the area that the rezoning request covered.
Mr. John Youngdale revi�w�ed the previous history of this rezoning request.
/� He said about 13 years ago he was the person involved with the purchase of said
property from Bernard Julkowski and wife. At that time, the land was zoned to
R-3 and a permit could be obtained by special use permit from Council for con--
struction of a service station. The Company transferred him to California and,
while he was gone, the uaes permitted under R-3 were changed in 1969 so that
service stationa were not allo�wed under R-3. Naw an application is made to
rezone the property to C-2 and ask for a special use permit at the same time
to construct a service station which is allowable under C-2. He felt it would
be desirable to plan for the development of the property which would normally
come under a C-2 District. He has entered into a contract to sell the unused
portion of the property to Dick Ernst. The architecture of the service station
they would build would also be used for the type of building planned by Mr.
Ernat.
Mr. Lo�ell (Red) Ridgeway, member of Minnesota Petroleum Council, presented
slides depicting service etations and their contributions to the betterment of
communities.
Mr. Youngdale eontinued that in the development of this property, Mr.
Ernst assisted him in preparing a general land use plan for the portion they
are selling him. In connection with that, Mr. Ernst called upon Anoka County
Highway Engineer to ask if the plans for their driveways, etc., would be
acceptable. Mr. Lundheim gave his approval for the driveway arrangement. The
layout of the service atation was ehawn by Mr. Fred Housenga. He stated they
were alerted to the fact of the trip arr�ngement for the traffic signal at the
intersection, but they felt their driveways would not conflict with it.

^ Mr. Youngdale said that a related issue was the involve�nt with water and
sewer needed to make use of the property and develop it. It was suggested the
Atnerican Oil Company appesl to the Villag� of Spring Lake Park to give them
permisaion to tie into their sanitary seWer connection which abuts the property
on the North line. At the Spriag i.� �srk �ouneil meeting on Monday, April 5,
1971, the Council agreed to acc.ept the derision of Fridley. Copies of the
Spring Lake P ark meeting were given to the Comnisaion. Referring to the layout
of the service station, Mr. Youngdale said tk�is wae a preci9e rendering of what
they would lilce to build. It incorpor�tes all tka� finest �nd lateat featur��
in service station deaign. Mr. Emst°s development would have e��cti3� �.��

In answer to Mr. Zeglen's question of w�►y the American Oil was building a
station on that particular corner when there was one on Osborne and T.H. #65.
Mr. Youngdale said that he has, for twenty years. been involved in planning
service stationa acroes the country. University and Osborne, in their opinion,
is a definite arterial market. There is the pending development of shopping
centers. They use what they call "halo effect". This is having filling stations
within designated areae, not too far apart so that the people in the area become
familiar with the locations of the at�tions, and if they need a aervice, and
it ia not convenient to go to the usual filling station, they knaw where th�re
is another Standard Station in their areav They feel it is a type of advertising.
Darrel Clark said that the sewer service would coa�e from Spring Lake Park,
and agreed to by their Council, but the REC charges would still have to be worked
^ out. There will not be a service drive adjacent to University Avenue. There
would be two driveways from the service station onto Osborne Road and also an
opening between the service station and the area Mr. Ernst is developing. This
area has a driveway at the Eastern edge of the parking lot onto Osborne Road.
There is the possibility in the future that Spring Lake Park might want an
entrance at the North edge.
Chairman Erickson asked if it would be possible to prohib�.�. �������� drive.
The Engineering Assistant �mi.d �h�;� �� c���s���*�'� ����c� �� ��ca�a�eci to the City of
Fridley unless the City would accept it. Tliere is no service drive at the North
edge of the property because the buildings are tight up to Univeraity Avenue.
Mr. Schmedeke was very pleased to see trees being used in the plan for the
landscaping. Mr. Youngdale said it was in the landacaping plan along with using
a redwood fence.
Peter Herlofaky brought out the fact that the zoning to the North in Spring
Lake Park is industrial -- to the South in Fridley, it is R-1.
The point of the property ends at the curve of Oaborne Road and Terrace
Road in Spring Lake Park is 400 feet to the East.
There was a discueaion about filling stations selling cars, repairing cars,
renting U-Hauls, etc. If a filling atation isn't making a living just selling
gas, the awner turns to other means of earning power. Although he could take
on other products with a epecial use permit requeat, it would be pretty hard to
^ turn dvwn a request becauae of hardship. Mr. Xoungdale said the American Oil Co.
definitely frowns on thie practice and tries to diacourage it as much as possible.
Mr. flousenga said he va� aLo a member of the Minneaota Petroleum Institute and
they are working with the City of Minneapolia for a syaten of renting or a permit
syatem f or trailers� xh3,ch can be included in an ordinaince.

Mr. Schmedeke asked about selling autos at a filling station. Mr. Youngdale
^ said the American Oil Co. does not like to have their etations in the used car
sales.
Mr. Ralph Lynn, 7599 University llvenue: Mr. Lynn said he protested the
request for a filling station the first time it was presented. He had even
conaidered proteating it in court at that *_ime. He felt the City of Fridley
had ample service stations. He noted a gedwood fence would be built to protect
apaztment houses, but every car would illumi.nate his bedroom. Traffic situation:
He understood there would be a trip signal. At times in the morning and after-
noon he has had to wait ten minutes before he could get on Osborne. Another
traffic light would jam it up completely. He thought the Planning Commission
has an obligation to protect the citizen who lives in Fridley. He was against
the rezoning request.
In answer to Chairman Erickson's question of what he would like to see
there, Mr. Lynn said a lesser form of business -- he didn't plan beyond that.
Robert Ahonen, 330 Osborne Road: When this property was under the old
zoning ordinance and the jurisdiction of the Board of Appeals, the Board of
Appeals denied the request for a filling station on this same corner and that
decision was upheld by the City Council. He did not think the situation or
atmosphere changed, but the City of Fridley has ch�nged. Perhaps there should
be a little more cooperation with the property to the North. Apparently this
has been done with sewer and water. He felt the Planning Commission should
wait and see what the developments are going to be to the North before we
� clutter up the intersection. We may have a boulevard dawn the center of the
road which prohibits left hand turns. In line with this, there is the problem
of trailers�.ii�NilR�lwe get people to quit requesting trailer licenses? The
answer is obvious. You aimply limit the number of ga� stations so that everyone
can malce a living without selling trailers. The Planning Com�nission is making
a study of gas stationa. It might be well to wait until the close of that study
to determine whether we have taken a step forward and wish we had taken two
steps backwards. Sometime ago there was a problem of resale of residential
property f acing commercial or industrial zoned property. He did naw know
whether that was atill a consideration with the loaning companies. This is a
conaideration, however, for thoae who are in R-1 District and will be facing
an industrial district in Spring Lake P ark. He thought the Cammission should
wait. He felt there was a better uae for that piece of 1and, and the Commission
should consider if it would be safety wise for their children and in the
best interests for the City of Fridley.
Bill Swanea�, 310.Oaborne Road: Mr. S�anson said he had nothing more to
add. He wari naturally againet the request because he was the one who would be
living acro�s the atreet from the gas atation:
Mr. Ernst said he met with the landowner of the property North of this
area. Negotiations are under waq for the sale of the vacsnt property to the
North for a tn�dical clinic, and North of that is a park. He presented a
petition signed by eight i�nediate property vwners who favored the service
station.

by R. C. Ernst and signed by eight property owners in favor of the rezoning
application, ZOA N71-03, and Special Use Permit, SP i�71-03, and give the date of

letter was in protest to aaother sexvice statlon at the intersection of Univer-
sitq Avenue and Osb.orne Road because there are two filliag stations presently
there.

time for study. Chairman Erickson agreed and also for the eake of not taking
up unnecessary additional time of the petitiouer. It vould be well to continue
for 30 days and reviaw after the studq of gas atatioas.

continned for 30 days at which time the Plann.ing Commission should have come
to same kind of conclusion after the study of the future development of qas

avnerehip at thia tima. The parcel ia divided at the rear of the lot line to
mak� a building aita for aaother airucture facing 63rd Avenue. Both parcels
are 25,000 �quare feet. The only question is that of the legal descriptions.
They are a bit lengthy-but have no angles or bearings. The Subco�ittee felt
that to require a plat foF.juet two lots was asking for a bit too much.
Chairmaa Ericksoa aaked for the deacription. fle explained the reason
beiag the obvious relationship of the partq involved With the City is such that
he did not feel the petitioner ahould be put into a position where he could get
any criticism.
Darrel Clark reul the description of the parcel �here the building nvw ia
� as Lota 2 and 3 except Sandy Terrace. This would be the first description, the
eecond one ia the total deseription of the first one with the exceptions.

Mr. Schmedeke added that if another party came along with two parcels,
under this circumetaA.ce, the Planning Commission would have to allow it.
Aarrel Clark said that on torrens property, metes and bounds descriptions
will not be accepted by the County. They would want eithex a, plat or registered
land survey. Both o� tbeae parcels will be served with sewer from 63rd pvenue.
The sewer line would ruri over to 63rd with a lift ptmo{� to the northerly portion,
of th� new parcel. The watermain is on both 63rd Avenue and University Avenue.

recammend approval to the Council of the 1ot split request, L.S. #�71-04, by

and 3, Auditor's Subd.ivision No. 59, to provide a new building site off 63rd
Avenue. Upon a vo�ce vote, a11 voting aye, the motion carried unanimously.
10. GONTINUED IN1�K1RM�1L HEARING ON ADOPTZON OF 1970 UNIFORM BUILDING CODE AND
THE AMENDMENTS THEREOF :
This is a new paragxaph to explain the resson fax� euggeating the
changes in the Uniform Buildin.g Cc�ae«
46.01. The purpoae of this ordinance is to provide standards suited to
the environment of our cammunity. Some of these standarda are
more restri�tive than other communities by design, with the
intention of offering the citizens of our community safeguards
above the minimum standarda established by the Uniform Building
Code. The aections noted in this chapter of the code do not deal
with the aesthetics of a building but only with the provisions
which govern their construction, and it is our intention to pro-
mote the health, safety, and general welfare of our comm�mity
through realistic, practical and enforceable building construc-
tion etandards.

46.021. Chairman Erickson.said this section proposes to do what the City
had done before. He wrote a letter to U.B.C. referring to the
question of roof sheathing. They ansWered that the Code does
permit '�" roof sheathing, and edge block, too. Certain '�" ply-
� wood was acceptable for 24" centers. Also 5/8" is acceptable
for 24" center. Part of the inspection duty i� to be assured
the materiale are being used that are required. The Chief
Building Inspector said the plywood is atamped whether it is '�",
'�", etG. When there is �o $tamp, the p�yy�oo� �oea npX taeet the
requirements.

missi on approved 46.023. Upon a voice vote, aZ1 voting aye, the motion carried
unanimously.
46.024. There wits an objection to the last paragraph 1n thia sect�on. "All
walls between attached garages and frame buildings sha11 have sheath-
ing extending from top plate to bottom plate".
The objection was because this wall does not tie the house together
with the garage. It was felt to be an unnecessary expense. The com-
ment was that the sheathing would increase the atrength of the wall,
but being an interior wall, it was unnec�ssary. Other communities
which have adopted the U.B.C. are not requiring some of these things.
MOTION by Schmedeke that the Planning Commission approve 46.024 as
wri t ten .
The MbTION died because of lack of a second.
MOTION by Zeglen, secanded hy Fitzpatrick, that the Planning Conenission
approve 46.024 with the exclusion of the last sentence "A11 walls between
attached garages and frame buildings sha11 have sheathing extending from top
plate to bottam plate". Upon a voi ce vote, Zeglen, Erickson and Fitzpatri ck
votinq aye, and Schmedeke voting nay, the motion carried.
46.025. The Commission felt the 5/8" plywood requirement should be reduced to

request fro�m the Planning Commission for more information.
Chief Aldrich said that H occupancies are apartment buildings. This
section doee not represent a new approach to the problem in Fridley.
As soon as the City adopts a new code, it might.be wise to incorporate
these amendmenta to the code and make for a little easier distribu-
tion of information. We have been requiring standpipea in multiple
dwellings for a couple of years. The Fire Department of the City has
a three man crew for night calls. With standpipes in multiple build-
ings, it is a much easier task for the three men to control a fire
on the inside of the building while additional help is on the way.

46.057. Chief Aldrich said that the Fire Department has been requiring this
type of manual alarm system for the past two years. He said that most
requirements of the other communities are more restrictive than what
Fridley is asking. Based on the Fire Department's experience, he
could not juetify in his own mind the need to go any further in regard
to alarm and warning systems. They have had eaperience here and also
in Columbia Heights. There have been some pretty good sized fires
going and all the people were not aware of it. The alarm is manually
operated and the unite are relatively inexpensive. One of the biggest
_ prob2.ems tn -apartn►ent buildings�-is stairwells and doors. With the
doors clo$ed, there is one hour proteCtion. The alarm rings the bell
and closes the doors.

realize they cannot enforce 100X. Chairman Erickson wondered if the
buildia� department could be held reaponsible if that part of the

a variance were requested, the City ia protected.
Referzing to Item 4, Hank Muhich said that Brooklyn Center adopted thie
and have been real satlsfied with the resulta. Mr. Sch�deke believed
that about 75X would conform, but haw could the City enforce the
ordinance, even with the time limit• Item 4 reads "All existing
^ multiple family buildings not conforming with subsection (2) shall be
corrected, modlfied, adjusted or otherwise made to comply with the
above requirement not later than January, 1973".
Chairman Erickson wondered if they could come in and get a vari aztce on
hardship cases, but the question of #lexibility arises. He felt this
was a problem for the Council and City Attorney to work on,

Mr. Virgil Herrick, representing Brookview Investment Company, was
preaent. He stated that his group bought this property and decided �o build
an office on the land facing University Avenue. At the time of t'he purchase,
the property belanged to one person. He had been told that at one time the
land was two parcels and this accounts for the "T" shaped property. In order
to construct a second office building and get a mortgage for it, the land
would have to be sp1iC. They felt it was a logical split because the present
^ building fronts on University Avenue and the proposed building would front on
63rd Avenue. One copy of the certificate of survey showed the entire parcel
and the second copy Qhawed the piece on University Avenue and the legal descrip-
tions were on each survey.
Darrel Clark conmented that both lots exceed the minimum requ�rements of
this type of zoning which is C-2S, general shopping areas, and requires either
200 feet frontage or 25;000 sq. feet. We have here adequate square footage
but it is a little bit short on frontage. The ordinance requirea only one of
the tWO. Both parcela have access. The legal descriptions are a little bit
long but are not regular metes and bounds descriptions. If there were more
lots involved with similar descriptions, we probably would ask that the land
be platted. The Subcommittee should consider the lot sizes as far as the Code
is concerned and the deacriptions which are a little bit lengthy but not too
much so.
Mr. Schmedeke read the following from Fridley Code:
45.103. Lot Requirement� 6 Setbacks
Xards, lot sizes, and open spacea shall be as required in this section
for buildings hereafter erected in the C-1, C-1S, C-2 and C-2S Districts.

Because of the terrain, there is a lift pump at the street for
the sanitary sewer to serve the present building. Darrel Clark said he did
not think a second pum� would be needed as Mr. Herrick had said that when the
plans were drawn for the present building, the utilities were planned for
both lots.
Mr. Herrick asked about the storm sewer and the Engineering Assistant
explained that the storm sewer manhole was at the southwest corner of Moon
Plaza.

Streets & Utili ties Subcommittee recommend to the Planning Commission approval
of the Iot spli t request, L.S. #71-04, Brookview Investment Company by Virgil
Herrick with the description of that portion of the property as contained in
the Suburban Engineering Document written November 17, 1967 showing the
en tire parcel and a second document showing the piece of property facing
University Avenue. Upon a voice vote, a11 voting aye, the motion carried

2. CONTINUED REVIEW OF EXISTING PLAN FOR STREET LAYOUT IQURTH OF OSBORNE ROAD:
Chairman Schmedeke said he visited the area and found it was larger than
he had expected. He felt the area would be a hard one to drain and to install
sanitary sewer.
Darrel Clark explained the area to be discussed included Osborne Road on
the South 85th Avenue on the North, University Avenue on the East and East
River Road on the West. Referring to the crossover on University Avenue and
85th Avenue, a signal has been proposed for that intersection and the Agree-
ment has been drawn. There are existing signals at Oaborne Road and University
Avenue and East River Road and Osborne Road. There are no additional signals
proposed in 1971 for East River Road.
Referring to crossovers, there are three streets that go to East River
Road, namely 79th, 83rd and Osborne Road.

Pointing out the railroad crossings at the present time, Darrel Clark
said there were crossings at 77th Avenue (grade crossing with stop sign and
possible elimination), one North of 79th Avenue, Iron�on and 85th Avenue.

� The plan calls for five railroad crossinga: one at $Sth, one at 83rd,
one at 79th,�o�:at 77t�.aad one at Osborne Road and that consideration could
be given to elimination of the 77th croasing when the 79th is put in. It was
noted all of the pre�ent railroad crossings existed.before the incorporation
of the Village af Fridley. We are not increasing crosaovers, but moving two
of them.
The area on the West side of the tracks is pretty well developed. Part
of the area on the East side of the tracks is platted a8d about 30X of the
land developed. There ia no plat between Main Street, University Avenue from
79th to 85th Avenues, except for the golf driving raage which was platted as
University Golf Estates. This plat dedicated a SO foot service drive with loop-
back., 33 feet for 81st Avenue and 30 feet on Main Street for roads.
In speaking of service drives, the Engiaeering Assiatant said perhaps
these aervice drives are not the answer. The loopbacks meet the area require-
ments of industrial zoaed lots as they are 1� acres. However, they seem to
be ideal sites for filling stations, and the gasoline campsnies are willing
to pay a good price for the land. We seem to lose sight of the fact that
a loopback can be used for something besides filling stations, such as office
building, restaurant or grocery convenience store.
In the area of this study, a possible solution would be to put in a
North/South road down the middle between Main Street and University Avenue.
While the buildings may face University, they could have access at the rear
� of the lots. However, he said he could not point out any example where it
has been done.
Mr. Schmedeke co�om4ented that commercial would like a service drive so
that the business could be seen from the highway and have access to the front
of their business.
Darrel Clark said that the reason for the detachment 1a to eliminate
cars stacking up in front of a service drive entrance. If a service drive is
put in adjacent to University Avenue, they would have a Mississippi Street
problem with cars backtag up in front of the service drive entrance.
Mr. Schmedeke suggested the Com�ission should consider one item at a
tlme and that the railroad crosaing should be taken up first. They knaw
there is going to be a crossing at 85th Avenue with flashing lights and arms.
When the apartment complex on 79th and University is finished, the Ironton
grade crossing would be moved to 79th. We have had from the railroad a letter
whereon they state they will not oppose the City before the Railroad Warehouse
Commiasion for a request that crossings be placed at 79th and 83rd Avenues.
The City had requested these crossings about 1965 and 1966 and was turned
down.
1NC�TION by Crowder, seconded by EngdahZ, that the Planning Commission
make the following recoaanendations to Council: Additional railroad crossings
should go in at 79th and 83rd Avenues and reconsider el�minating the cros-
sing at 77th Avenue at t�ie time 79th Avenue crossing is opened. The crossing

The next itea wae Signals. Chairanan Schmedeke said there were two signals
� on University Avenue -- the one oa 85th was oxdered in and the other was at
Osborne Road. When 83rd Avenue is developed, hopefully it will go from Univer-
sity Avenue to Esst River Road. To the East of University, which is Spring
Lake Park, 83rd Avenue is only two blocks long. 81st Avenue, hawever, goes
through to Highway No. 65 in Spring Lake Park.
Mr. Crowder commented that it would be hard to know where to put eignals
before the land ia developed. Darrel Clark sai.d that a criteria could be
considered such as the need, car counta, and the State feels there.should t�e
a count of 3,000 cars a day to warrant installing a signal.

doubt be installed. 79th Avenue is a State Aid road and East River Road a
County Road. Where 83rd Avenue inter�ects East River Road, it was felt 83rd
Avenue should be dropped to meet Kimball Street. In the case of 85th Avenue,
if it were econamically feasible to pull it up to be opposite of 85th Lane.
in Coon Rapids, why not do it?

Streets � Utilities Subcammittee recoma�end to the Planning Commission the
following: 1) Reg�rdinq trafffc light pattern for East River Road: Consider
the first traffic liqht at 79th Avenue and East Ri ver Road. 2) Intersection
of 83rd Avenue moving South to be oppasite Janesville. 3) Move 85th Avenue
jogging to meet 85th Lane in Coon Rppids. Upon a voice vote, all votinq aye,

Regarding the auggestion of the vacation of 78th Avenue between Beech,
Elm and Main, the Subcommittee felt there would be no advantage changing the
grid pattern of the area. The atreet between Beech and Elm, they felt,
should be improved on a temporary basis as long as the people are using it.
This would help keep the area clean.
MOTION by Pierce, seconded by Crowder, that the Plats & Subdivisions-
Streets 6 Utili ties Subcommittee recommend to the PZanning Commission that
78th Avenue from Beech to Main NOT be vacated and recoarunend a temporary sur-
face from Beech to Elm Streets. Upon a voice vote, a11 votinq aye, the motion

Darrel Clark explained that Parcel 3600 at preaent has one fee owner.
University Golf Estates plat is located on 81st Avenue and University Avenue.
There are two loopback islands, one at 81st and one at 83rd. Quite a bit of
right of way has been obtained from this parcel. The service drive and loop-
backs are strictly for bueineas. An alternative was suggested to put a street
down the middle (North/South) of Parcel 3600, but this may not be practical
^ because commercial property needs a service road on a main highway.

Mr. Melvin Ford, Production Manager for Richard Miller Homes, Inc., was present
to present the request.
Mr. Ford stated the basement is already in with the setback of 9.5 feet. The
dimension of 9.5 feet was noticed when they had the verification survey made.
There is exactly enough room on this lot for this house and there would have
been no problem if the workmen had installed the basement correctly.

Seconded by Harju. Upon a voice vote, there being no nays, the motion carried
unanimously.
M�OTION by Iiarju to recom�nend to the Council approval of the variance as it is
only a 6 inch variance that was caused by an error and there would be a considerable
expense created by having to de�olish and reconstruct the basement.

Mr. Robert Dietrich was preaent to present the request.
Mr. Dietrich explained his present garage is a tuck under and is 13 feet wide. The
proposed addition is 12 feet wide and will have a gabled roof , a type to match the
existing house, and the peak of the roof will come up under the existing eaves. It
will be a block garage and there will be just a door cut in the existing wall between
the 2 stalls.

showing how it will be attached to the existing house at the time he applies for

Harju asked the applicant if there was any special reason why he wanted a
double garage.
Mr. Dietrich answered he did have two cars and he would like to park them both
off from the street.
Chairman Minish asked if the applicant had considered getting along with less
space to stay within the Code requirements.

Mr. Russel Beck was present to present the request. A survey of the lot showing
the proposed location of the dwelling was shown to thei:�osrd.
Chairman Minish asked the applicant which option variance he preferred.
Mr. Beck stated he would like to go with the variance from 10 feet to 6 feet to
keep the 10 feet on the North side yard as the lot adjacent to the North is vacant
at this time. The house to the South of his property is built in the middle of
two lots and is set back approximately 100 feet and approximately 60 feet from
the lot line.
Mr. Beck submitted a letter�eff no objection to the Board from Mr. Alvin Schramn
^ the owner of the adjacent lots to the South.

Mr. Bagstad stated the Building Inspection Department also preferred the
variance from 10 feet to 6 feet.

MOTION by Drigans to reco�end to the Council approval of the variance.
Mr. Drigans co�ented there doesn't seem to be a hardship as such. Mr. Beck
would like to build a home that would require a little additional room. He
has received pexmission from Mr. Schra�mn and Mr. Schra�'s home does set in the
middle of 2 lots and would be somewhere around 60 feet away from the proposed
dwelling. This variance would give the proper setback on the other side of the
home.

Mr. Haxju added he did concur with the motion as there will be no windows on
the South side of the home.
Upon a voice vote on the 1�DTION, there being no nays, the motion carried
unanimously.

There was some discussiou then as to the location of the garage. Mrs.
�aiEr said that there were some trees in the backyard that she wanted
to save if at all possible. Mr. Kiel said the trees were back about
55� f�om the lot line, After so�e discussion it was decided that the
garage would have to be setback a minimum of 25' from the property line
to giye enough room for a car to back out and get out of the driveway
without going beyond the common driveway. By using this setback alI
the existing trees could also be saved.
1�O�ION by Gnerre to recommend approval of a building permit subject to
�he ipllowing stipulation:
1. T�at the Building Inspection Department receive a written agreement
stati�g th�t the driveway between the buildings is a common driveway.

RELATING TO SIDEYAP.D REQUIREMENTS IN THE R-1 DISTRIGT,
THE COUjTCIL OF THE CITY OF FRIDLEY DO ORDAIN AS FOLLOWS:
SECTION 1. Section 45.053 Subdivision 4 Paragraph B of the Fridley City Code
is hereby amended to read as follows:
B. Side Yard
Two side yards are required, each with a width of not less than ten
(10) feet, except as follows; '
1) Where a house is built with a sin�le attached garage on lots
of 9,000 square feet and with a minimum lot width af 75 feet,
�(�,,�,v8�'�� a minimum side lot requirement shall be necessary of -� feet
"� on one side and 15 feet on the garage side so that a double_
car attached garaa�e could be built without a side lot variance.
2) Where a house is built without an attached garage on lots up
to 60 feet wide, a minimum side lot requirement sha11 be
`�`necessary of k� feet on one side and 13 feet on the other side
^ ��� so that there would be access to the rear yard for a possible
, detached garage at some future date.
— 3) Where a house is built without an attached garage on Zots more
than 60 £eet wide, a minimum side lot requirement shall be

�',L� that a future attached garage 14 feet wide could be built without

4) The side yard adjoining an attached garage may �e reduced to not
less than 5 feet, provided the height of the ;arage �n that si.de

a. The side yard width on a street side of a corner lot shall be
not less than 17.� feet. When the lot to the rear �as fron�age
along a side street, uo accessory buildzr.b on the corner lot,
within 25 feet of the common prop�rty line, shall be closer to
� said side street than 30 feet; provided, ho��ever, that this
�4i�� �'� regulation shall not be so ir.terpreted as to r�duc:e the 'builda�,Ie
width of a corner lot to less than 25 feet.
