Mr. Warmsbecker ezplained that he was represeating Mr. Barbush as he was

Chairmaa Brickson wondered if it were correct that they had no apecific.

Chairman Exiekaon s4ked Mx. Qureshi if Council had taken aaq action regard-
ing utilities. Mr. Qureshi aaid that Council had ordered in the improvenients
for water, sanitary sewer and Qtorm sewer. �

Mr. Schmedeke said that his own opinion is that most af the property bc�r�-
dering on T.H. 4�47 wil�. some day be zoned commercial. He unde�'staod that Mr.
Barbush is the fee owner. If the members of this Commission feel that �hey
woul.d just as soon give him a nod, he would consider going alon�.
Referri.ng to the map, Mr. Fitzpatrick asked if the Commission would be
rexoning an area witln islands.
Mt. Qureshi told him that this is only a reco�rended pattern if the p�opexty
owner wants a service road along University Avenue. We recommended that th�7�e
be no service road, but a road in the middle of the property with f�contage oT�
��in Street. If the proposed buyer insists on having a servic� r�ad alon�
T.H. 4�47, they would have to put in the loopbacks. Main, Stree�, $lst and 83rd
Avenues are committed but the service road is not. Ther� �s no pl�tted se��-
vice road -- the area is all one parcel now.
tyir. Wox�msbecker said they have plans if a service road is needed. Th��►
hav� ��sements across tt�e front of the p�coperty. It would be up to th� peopl.e
wha pur�has� the land whether or not they feel they need a serv�ce road.
Mr. Finkelstein said that the easements have been submitted by the C�.�y
^ Attorney for Mr. Barbush to sign.
The land North of 83rd would be platted.
Chairman Erickson said he was not uecessarily opposed to the use of this
property as commercial. There may be some other uses that would be desixab�,a,
'He was just a bit hesitant zoniag a piece of property withaut k�owing what it
is to be uaed for. He preferxed leavimg the zoning as it is under the ci�cum-
stances. If a reasonable and proper use for commercial w�re �res�nted, he
would be inclined to be in favor of the rezoning, but not to j�st change the
zoming for the sake o€ multiple purposes.
Mr. Finkelstein �ssid the rezoning was not a promotional mattet. It wtsa
just a very �ogical uoe for this particulsr prapexty, especiallq beeaus� o�
the development along IIniversity Avenue. The West portion of this property
is to be industrial. They understood that there would be opposi�ion to an
industrialization of the area across from the park or golf course. It is ,juusC
a matxer of having como�ercial so if something does come up, it would be avsti].�
ab�.e for that use.
Chairman Erickson said that once a piece of property is zoned commerGlal,
there is alm�oat an ualimited number of types of buainesses allowed, sotne oP
which could be objectiona�le.
1�r. Fiakelstein eaid that all they were interested in wae to go along with
^ the terme of granting the easements with the thought they were trying �o coR�
fostia to the use of the property. The taaes are high. It was going to be
either industrial or co�ercial to get anything out of it. 7;hey thoughC com-�
me�cial was the beat.

Chairman Erickson said that without knowing the use for the property at
� this t�me, he could not see how Chere would be any objections to leaving �t
the way it is with the understamd3ng that the City would take another look at
th� a�ea if a proposal came up.
Mr. Finkelstein said that you people want a logical development and t��
be�� for the coammunity. This is the way it should be. When they requested
��zoning to multiple, they were turned down. They are paying in�reased tax��
and assessments since that time. Now they feel this is the propex ar�a fv�
com�ercial develapment to conform with the general development a�Q�g U�ive�sity
�venue.
Chairman Eric�son did not feel that one piece of rezoning would const�tute
general development.
Mr. Finkelstein said Mr. Barbush has owned the property abaut �ight y�ax�,
and it wae zoned M-2 at that time. They thought the M-2 zoning would work uut,
but it didn't. �
Chairman Erickaon said he would be perfectly willing to change when a
desirable plan to the community was presented. He was not opposed to rezoning�
but h� would like ta know hoR+T the land would be used.
Mr. Fitzpatrick said that, being Chairman of th� Park Cott�,�tee, h� Wa�
concerned about the development near the park property.
^ Mr. Schmedeke said he already had mentioned that he felt some of the pzo�
perty close to T.H. �47, probably all of it, from Bob Schroer's to Viking w��.1
be C-2. But he a�so thought the Commiission has to take a good look at what ie
going to go in there. Without having definite plans, he wondered �hat type vf
con��.omeration Would be going in. He felt if a motion could be made signi�yi.a�
that, at some future date if the petitioner came in �ith a C-2 development, th�
�'lanning Commisaion would take a xeal good look at it and give them the oppA��

and the high "knob" on the proposed plat would have ta be taken down.

Chairman Erickson said that h� was agreeable with the platt�,ng, the size o�
the lots did not boCher him. Mr. Miller said he felt the peopl.e would prefer

Mr, Goughan stated that The Ground Rouad is a division of the Howard Johnson
Reataurant. H� stated that they have opened several of these resCauraats in
different areas and have had very good reaults so far. He said tha� what they
are mainly doing is changing tha image of the building.

building, The other changes will all be in decorating both on the i.aside and

On the outaide the porcelain shingles will be sandblasted and then paiated
broFm with an epoxy paint. They will also be removing all the plate glae� fram

The Board asked them about the landacaping. They stated that mosC o�' the

The Board told them that a landscaping plan would have to be submitted to �he

Mr. Bxown �xplained the grant to the Commissioners and visitors, and stated that
pexhaps th�y were th�.nking of this same type of grant for the Moor� Lake Be�ch
area. kle in�oarmed the Commission that this was a single grant and couJ,d be
�eauested pnly canGe a year by each Municipality and that they had decided ts� use
it for Jahn �xickson Park this time.
Mr. �xown informed the Commission that he had been over at John Erickson Park and
obsarved th�t there were many peopls on rubber rafts and other types of watex toys,
swimming in th� 1ak�. He pointed out that there was definitely a problem here b�cause
af the lack a� supervision and the £act that fl.oating objects, such as r�fts, �.re
unsafe. Mr. Brpwn. said that Spring Lake was of a cleaner nature than Mooxe Lake,
but i� will b� �evex�� ye�trs beforQ the Beach is in full swin�. We'll t7ey ta Stax'G
aur next �umm�r►s activities with scanne guards, but it'll be a�utu�e da.te t�at'�l

Boa�cd,of Sprin� Lake Park, regarding the proposed School in this area, and the
possibilities of using the School parking lot for our ovexflow parkin�.

both instances.
Mr. C.L. McCline said he was a me�ber of the group that ow� these lo�s in
question. He had originally r�quested'a building pexmi.t, but it was refused
t�nd he was advised to appear befose the Board of Appeals where i� w�s again
refuaed. His group has been the o�rners of there lots for 9 years, have paid
taxe� on them, but the lots have not moved. Now there i� nn Ordinance that
prohibits building ho�s on 40' lats, but at th� time of purc2�se he was
advis�d he could build on them. Reoently, he has a daveloper to build on
these lots. The design of th� 2aa�es. he felt, �ould b� an a��et to the
caa�annity. It would be a 21'9" house, l�i foyQr typr� ho�s�e, and meets all F:A.A.
requizements and the City requir�ents as to ths building st€sndards. His
devoloper advised him that th�y will have $30,00� -$35,00� well constru�ted
ho�ea, that will be an asset to the co�nunity. H� said thc�y would be glad to
do anythinq to �atisfy the City. He �Sas never b�en advi�ed h� c:ould.not build
on these lots. He said he h�� p�aid the taxes and spec�.al asses€�aent� �tc., and
is not hopeful they could obtz:in the variances �o they cou3d build.
Councilman Liebl aaid the Council haa h�d such requests r�s this last y�ar and

refused all the requests, but they have refused most in recent years.
Councilman Liebl said that t�ir. Sondheimer is an architect and enginAer and he
fe�ls the Council should ccr7e up �ith soa�W policy so that everyon� is treated
�alike. Mayoz Kirkham did not see how this could be done, so�-� time� th�re are
different circumstance3 that must be considered.

Councilman Breider said thbs is.similar to the application of �ames Caaserly
where the tornado took his house, and he was l�ft with a substandard lot.
Councilman Liebl reported that the man who os�as the double biuigalows nezct door
bought those lots.

� Mr. McCline said these are i�olated lots. The adjoini.ng lots axe 40' lots and
? there is no way to acquire addit.ional land. The people adjoining these lots are
not interested in purch�.�ing th�. These lot� �a�re puxcha5ed as an i.nvestmen�,
have had taxes paid on them, and ias3 could not understand what the City expects
the land owners to do with thess Zo�s. Councilman Liebl esid that he agreed
with Mr. McCline to a cextain ext�tt, but this Council a few wee)cs ago turned
down a very similar request. Ho a��.�d.if his Y�use would not protrude ahead
of the other houses on the block.
l�ir. Armstrong said that he also had an interest, alang with Mr. McCline.
He would aqree with the Council in its wisdom to make judgment�. Zt is their
respox�sibility through their experience to judge. He said he would also
agree with Mayor Kirkham that there cannot be a single hard rule that can
or should be used. Here is a situation where there is a reasonable request.
iie did not believe the setback would put the house at variance with the
adjoining property. There was som� misunderstanding on this point at the
Board o� Apgeals Meeting, and once the misunderstanding was cleared up, that
the setbacks under consideration would be in conformance with those adjoining
lots, the home owners did not abject on that basi�. The proposal before the
Council as outlined in the plot pl.c�n and tke h�a pla�cement is a good use of
the proparty there. It is, important that this property be put on a tax paying
basis, they cannot afford to keep paying taxes on them. �:e would ask for an
ai�irmative action on their request.
TF� VOTE upon the motion, being a voice vate, Liebl, Harris, Breider and
Kelshaw voting aye, Kirkham voting nay, Mayor Kirkham declared the motion
carried.

Councilman Liebl said he would like to see the Planning Commission make a
reco�zne{�dation of how the subs�andard lots should be developed. The Council has
tried to upgrade their ordinances to nti�ce a better co�unity. He�said a house
$25,000 to $30,000 ir� a nice hc?�°, bu� a_t �:ust not be a hazard being on a
corner lot, but it shauld b� �.e�;�lop�d.
