Chairn►aa $ricksaa coam�ented that the public hearing was elosed at the laat
meeting. He asked sbout the accessibility of the sewer to the property. Mr.
Clark anewered that th�re is no aewer in the aerviee road, but goes up Polk
�treet in ].ine with the Sou�h line o� the property. A map of Terry's Additiom
ahowing the utility ws� atudled. The eew�r ruas about one third of the way
South oE the North line qf the �ot.
Darrel Clark esid the 4ue��ioa of vihether or not the 1ot s;:�.it shauld come
before or after the resoning was diecussed brieflq at the last meeting, and the
Saaning Commisaion M�eetins� - September 1, 1971 �age 2
� Commission decided �o consi.der the rezoning firat. The lot split has been
xecorded at the County but was not a�proved by the City Council. It now is a
matter of the special asse�aments being divided. The original request was for
a lot split on the apartment houses. The taxes are split, but the specials are
not. The apartment owaers applied for a lot split, but were denied by Council
who would rather have them plat than bring in a metes and bounds description.

When Mr. Schmedeke viewed the area just before the Planning Commission
meeting this evening, he said that there were no stakes to show where the
re�oning was planned. Thexe was a pond in the area which he felt would be a
problem for someone to drain. Mr. Clark explained that there was a storm sewer
from the pond which d�cained into Moore Lake. The pond builds up to a certain
level and then drains imto the storm sewer. The problem in this area is platting
and ownership.
Ghairman Erickson said that the reason the plat was never filed was because
of a problem with the t�.tle and a gap in the description. It might have taken
a court order to clear the title. It took a year and more and the developer
and other owners had either lost interest or ran short of money.
kir. Sehmedeke said he did not believe apartment houses are to the best
interest of the City. While he did not believe in zoning this area to CR-1,
he felt after reading the Zoning Ordinance that the City does have quite a bit
of control in Cr-1 Districts. The Commission can be sure of proper screening
in CR-1 so that we can be aure that R-3 zoning is not being infringed upon.
� Because of conflict of interest, Chairman Erickson and Mr. Minish abstained
from voting.
MOTION by Schmedeke, seconded by Zeglen, that the Planninq Commission recom-
.mend to Couneil approval of the rezoning request, ZOA #71-05, Real Estate 10,
Z�c. of part of Lot 5, Auditor's Subdivision No. 25 being rezoned from R-3
(general mu.ltiple family dwellings) �o CR-1 (general office and Zimited business)
subjec� to the followi�g stipulations: That the City and County be given proper
legal descriptions or a plat that can be approved for the parcel, that the City
sewer and water problems are solved satisfactorily, and for screening to p.Iant
a type of �vergreen or blue spruce. Upon a voice vote, Schmedeke and Zeglen
voting aye, Erickson and Minish abstaining, the motion carried.
Mr. Schmedeke said he asked specifically for trees as screening so a plan
would not be for a wooden board fence. More and more cars are being sold and
we need more trees to give ua the oxygen the cara use up. He felt it was time
far this Planning Coaanisaion to consider putting up some live breathing fences.

on the cu1 de sac i$ 59.8', the Noxthwest line is 103' to the center of the
�., Creek, on the Eaat liae, it is 239' to the center of the Creek, the meander line
along the creek is 228'. The dimeneions of the house are 35' back from the
strest, 15' off East line, 32' North/South and 61' East/West, and 61' across
the front. The garage Faces North on the Weat side of the house. A family
room is in back of the gaxage.
Mr. Harris stated th� reason he was requesting a special use permit for a
garage was-because he planned to pursue hie hobby of restoring antique cars.
The garage would be used for this purpose. His lot is approximately equal to
four normal City lota - 35,000 square feet. It will be impossible to see the
prapo8ed etructure from the atreet as it ia protected by trees at the rear of
the property. He had dis�uased his plans with the neighbors and there seemed
to be no objections.
There was no one at th,e meeting objecting to the request.
Mr. Harrie continued that the grade change from the street to the proposed
structure is about 12'. ae said he has a large investment in his home and would
not do anything to jeo�ardi�e the value of�the home. In the past he had never
had a problem about the oil a�d grea$e, as he�would drain it into a pan or put
it in storage. Iie had no de�ire to bui�.d a driveway, but there was room on his
property. Be�ides a dri�veway would not be used that much as sometimes it takes
a year or twa to work on a car.
^ The overall height of the buildiag would bring the building up to about
the street level. There is not much tr�ffic at the end of the cul de sac.
Mr. Schmedeke said he vi,sited the area and that Mr. Harris had a besutiful
hvme aad he fel� this garage would not be detrimental to the area. Hawever,
he had some reaervationa about the Creek. iie wondexed if there was any State
or Federal law relating to bow clos� a structure can be built to a public water-
way. There i.s talk that hiking trails wi11 be made along the Creek, and he
wondered if Mr. Harris could build as close to the Creek as he plans.
Mr. Harris said there ia now an islaad in front of his property wh�ch was
not there when he purchased the land. There are seven trees at the bank, aad
3S feet betweea these treee and the front three trees. He would be able to
save the seven trees if the garage were built as planned, but if he had to
move zhe garage forward, he would have to take all thoae trees out. But he
certainly would not build there if he were in violation of any State laws.
He has lived on this property since 1966 aad last spring was the only time he
noticed there waa water ia theix yard. As soon as the ice jam was removed,
the water left.

Mr. Roger L. Peterson, the son-in--law of Mr. Berry, represented the petitioner
aa Mr. Berry was out of town, He brought out the fact that this same request wae
made severaJ. yeaxs ago for a double bungalow on Lot 3. The Planning Commission
and the Boaxd of Appeal� approved, but the Counci], denied the request. Both lota
axe 1aw� and will require a large ataount of fill to bring them up to the level
of the road.
These lots are not the most attractive onee due to the cost of fill and
overhead there is a high liae that runs above the front yard, and being on East
River Road does not h�l� a 1.0�.. Ti�e actual expense of building a single family
hom� would not make it a practical investment• They tried ta main�sin the lote
and had some �ill brought, in, but people are still dumping garbage and traeh
there.
Mr. Peterson said they would try to get so�►e kind of turn around sa that the
caz$ could drive onto East River Road facing the traffic and not backin$ out.
It w�as noted that ther� was an error in the public hearing notice --
the notiae stated "a double bungalow -° on Lota 3 and 4", but the application

Mr, William Edberg and Mr. Henry Stenquist were present to present the request.
Mr. Stenquist aaid they had presented their requeat during the visitor section
of the City Council meeting ara �londay, August 3�, 1971. The Minnesota Linseed
Oil Company has contracte with farmera to buy their aun flawer crop. They had
contxacted for storage facili.tiea in C�he MidWay district but due to internal
problems they caa not have thaC apace, They are faced with aa eme�gency situation
where they have to accept the e�op they contrac4ed for and do not have enough
storage space for this crop, They explained this to the City Council and he said
they were told that if they met with this cammittea and met all the requirements
aad stipulationa of this comsaitt��ee a permit would be granted.

stee� storage buildiag. This building is for storage of flamable material such
as paint thiame�c, It wil� be 75 ft. away from the building to meet fire insur-
auce requirementa. The cement slab is already in place for the building.

all good looking buildinga and they wouldn't want anything to spoiY the looks of
what they already had. Mr, Lewkiwicz said.they could use a vinyl wash oa the
building and �hen it could ba peinted.
A letter was read from the Carter-Day Company dated August 18, 1971, stating
that they would t�'y to include fGncing in, their 1972 budget. Mr. Tonco asked
if curbing for their black top could be included in the 1972 budget also.

to its exiating building. They wi.11 £ollaw the same design as on the existing
building. The back of the addition wi11 be elevated so that semi-trailers can
use this area. �he exterior finish will be cement block with matching face brick
in the front of the building. Approximately 100 Ft, of the easement to the East

Mr. Jamison said they wanted app�roval to camplete the retaining wall across
the back and arour;d the cornGr. They also Wanted to complete a metal building
that had been staxted some time ago. �it the time �he original building was
started, the construction was atopped because of the location of the building.
They did get a varia�ae so they could com�lete the building but this has never
been done. The steel columas and piers are there. They want to complete the�
walls and roof with the mater�al they bave. Thia would be a 3 sided building
with the Nor�h end being open. They would use it as a screened storage area.•
They will paint it the same color as the building is now.
The fence wi11 be b Ft. high with redwood slats. The building is 10 Ft. high
so only 4 Ft. of the building will protrude above the screening fence.

Mr. Belisle shawed the Board the aerial photo of the area and pointed out the
iota are on the corner of Washington Street and a paved alley inst.ead of 57th
Avec�ue.
Mr. Elasky stated the lots are each 40 feet wide and 129 feet deep. He said the
taxes on all the lots were $816.00 last year, including assessments, so he is
forced to develope the land and not just let it sit there. He continued that the
house proposed for both lots has the same floor plan and he wanted one house to
face Washington Street and the other to face the alley so they would not be
identical.
Mr. Belisle pointed out that the Zoning Ordinance states, "For lots resulting
from lot splits having less than the 75 foot lot width shall have a minimum of
a single attached garage." Mr. Eiasky shc�ws detached garages for bo�h lots
which would have to be c�ged to be atLached.
Chaixman Minish suggested that since the house has to be addressed on Washington
Street, as the house cannot be addressed on the alley, that the principle
entrance be changed to also face Washington Street. If this house was to have
it's main entrance on Washington the variances asked for would be unnecessary.

� Mr. Belisle suggested alCernate designs for the houses, like having one house roof
gabled and the other hipped to change the similarity between them if they were
both to face Washington Street.
Chairn�an Minish stated that since the applicant can build on the lots without a
variance, he could not see where the hardship exists. However, he could see a
reason for granting a variance if after splitting the lots there was no way in
which to build on them.
Chairman Minish said Mr. Harju had talked to him and he was concerned about the
house facing the alley as it would also be facing the back yards of houses across
the street.
There were no adjacent property owners present to object to the variance.
Mr. Elasky stated the only reason he could think of for the neighbors to object to
him building this house would be that they would be losing a place for their
children to play.
Mr. Drigans stated he would like to see Mr. Elasky withdraw this request because
at this time the Board could not see a hardship and if they were to vote on the
request and deny it the applicant could not come before the Board again for 6
months. He felt the applicant should first apply for the lot split and then try
to fit the house on the 1ot to confoxm to the code, with the Board of Appeals
being the last resort.

Mr. Wall said he agreed with Mr. Drigans in that the attached garage was ust
brought up to the applicant tonighc and possibly he could co�e up with a better
arra ngement for the house on the lot.
MOTION by Drigans to table this request until Mr. Elasky comes in with a more
presentable plan and until after the lot split has been acted on.
Seconded by Sondheimer. Upon a voice vote, there being no nays, the motion carried
unaninwus ly .
