#71-08, by GeneraZ Realty. Upon a voice vote, a11 votinq aye, the motion carried

Mr. Adolph Fine, the petitioner, said that the reason he was asking for a
change in the zoning was that, at the present time, there is a filling station
on the site which has been there for many years under a non-conforming use.
They would like it to be in a conforming use and the same use as the property
immediately adjoining it on the North. They did not make an application until
the application for the property to the North was made and received favorably by
the Planning Commi.ssion. �
Wayne Peterson was present and.the owner of the property to the North.
He felt all of the lots abutting University Avenue South o£ his property to 53rd
Avenue should be zoned to commercial.
Chairman Erickson commented on the fact that the application for rezoning
included Lots 16, 17, 18 and 19 in addition to the original requesr for Lots 20,
2]. and 22. Although there was a letter from the Standard Oil Company stating
they were interested in rezoning their property, Chairman Ericicson did not feel
� . this was a formal application.

Public Hearinq of the rezoninq request, ZOA #71-OS, by General Realty to rezone
Lots 16 through 22, Block 13, Hamilton's Addition to Mechanicsville to be rezoned
from R-3 to C-2 (general business areas). Upon a voice vote, a11 voting aye,
the motion carried unanimously.

to Council approval of the rezoning request, ZOA �71-08, by General Realty to

it is desirable to eliminate the non-conforming use to be consistent w.ith the
parcel to the North., and that an application for Lots 16 through .Z9, B1ock 13,

Mr. Bernard Rotter and Mr. Reynold Swanson were present.
MOTION b� 5chmedeke, seconded by Fitzpatrick, that the Planning Commission
waive the reading of the Public Hearing for the rezoning request, ZOA #71-09 and
the request for a Special Use Permit, SP #71-14 by Castle Mobile Homes, Incorpor-
ated. Upon a voice vote, a11 voting aye, the motion carried unanimously.
Mr. Rotter explained that the Mobile Home Sales were located at 7151 High-
way �f65, the Don Harstad property. The Special Use Permit expires next year
and the lease will run out. They are entering into a contract with Mr. Astleford
for a new.location listed in the rezoning request. At this time they were not
proposing a building plan, but asking for a rezoning. Part of the reason for
this was they did not have an immediate plan, but would like to look for a
-possible purchaser for part of this property and then come in with a building
permit and submit a layout.
. Chairman Erickson noted that the initial request was to rez�ne to C-2S and
then come in with a special use permit. He asked for the reason Frostop was
included in the rezoning request.
Darrel Clark said it was included because Frostop comes under commercial
use and is now operating in an industrial zone. The Administration made the
decision and Mr. Sherman was sent a notice.
� Chairman Erickson said the Commission should consider the Special Use
^ Permit first as the petitioner will not be involved in the property unless they
_ get the Special Use Permit.
In answer to the question of how much land this request involves, Mr.
Rotter said just a little under an acre. He said they would like to move from
their present property this year if possible. They would put two mobil.e homes
together for an office. They are taxed by the City, but are not required to
have a license. They are connected to sewer and water at their_present office.
The sewer runs�down Viron Road in front of the lots.
Mr: Rotter said they have to move off the present property and other people
are looking at the property. It was important for them to have a recommendation
at this time.
Mr. Schmedeke said he would like to have more time to study the property.
Mr. Minish asked if this request was similar to the pro'blem last summer
when Bob Schroer came in. Dar.rel Clark said that was for the campers to be sold
__ and a public office with sanitary faci].ities was required. Mr. Minish then
asked why this type of sales should be less restrictive for mobile homes.
Mr. Schmedeke said the reason for bringing this up was that he felt a busi-
ness in Fridley should be required to have a permanent structure and, if at a1_1
possible, he would like some time to check. into this.
,^ . Mr. Rotter said the land is too expensive to sit on. They do not want ta
construct something there that would have to be torn down if they moved.

^ Mr. Schmedeke said that this was a valuable parcel and he wondered what kind
of tax base the City would get with this type of business.
Mr. Rotter said their problem was the same as many other businesses. They
would like to stay in this community and the availability of land in Fridley is
nil now. They realize that eventually they were going to move their operation
from where it is now. If it would be possible yet this year, they would like to
grade, roll the property, put in Class V, sewer and water and hopefully move in
sixty-five days.

Mr. Sherman Hanson, owner of Frostop, said he raas concerned about the loop-
back. Darrel Clark said that if this rezoning request were approved, and the
land became commercial property, they would certainly have to think about a loop-
back.
Mr. Sherman asked if the land was going to be leased or sold. Mr. Rotter
answered that they were purchasing the property.
Chairman Erickson said the petition is for rezoning to C-2S which would
change the setback requirements. If the rezoning would take place, that would
be the time to request the right of way.
Mr. Sherman felt the road should be put in. Darrel Clark said the road
would go all the way down to Fireside from Osborne Road. Mr. Sherman said that
_ he had no objection to the request to rezone the property which would include
.his parcel also. Mr. Sherman asked how far the road would go from his property.
_ Mr. Clark said there would be an island between his South property line and
the new service drive.
Darrel Clark said you could buil.d commercial in industrial areas until in
1969 when the ordinance was changed. He had heard from the Viron Company through
the law firm of Dorsey Marquart Windhorst West & Halladay, attorneys. One of
the attorneys called and said that if they were going to object,-theq would appear
at this hearing. - -
Mr. Minish asked how this area was shown on the long range map.
Mr. Clark said he was not sure how it appears on the Comprehensive Plan, but
on the 17th of this month the Planning Commission will have a new study.
MOTION by Minish, seconded by SchmedeYe, that the Planning Commission close
the Public Hearings on the Rezoning Request, ZDA #`71-09 and fhe request for a
Special Use Permit, 5P #71-14, by Castle Mobile Homes, Incorporated, Upon a
voice vote, a11 voting aye, the motion carried unanimously.
Mr. Schmedeke said he was in favor of tabling these requests until the ne�:t
regular meeting to give the Commission more time for study.

Mr. Rotter said they would have platted, but it was their feeling they would
like to have the land rezoned to commercial to permit them, with their mobile
home sales center, to offset some of the taxes. They felt it was urgent to them
+''� at this time for the Commission to either reconunend denial or appraval.

� Chairman Erickson said the Commission is expecting a preliminary long range
proposal of a comprehensive plan in two weeks and they wished to table this item
until the next meeting.
Mr. Rotter said he has lived in Fridley for the past year and a half and
has a business here. He is in a very bad position where he has to make a
decision before next month. He could not see where that property would have
any other use other than commercial.
Mr. Minish said he was not prepared to accept that statement as far as the
proposed use of the land. It has been known since July, 1969 that Castle Mobile
Homes were in a temporary location.
MOTION by Minish, seconded by Fitzpatrick, that the Planninq Commission table

Chairman Erickson asked Darrel Clark if the plans talked about this evening
were changed from the preliminary plans brought in before. The answer was that
there were no major changes.
MOTION by Fitzpatrick, seconded by Zeglen, that the Planning Commission
waive the reading of the Public Hearinq Notice for the propased preliminary p1at,
P.5. #71-03, by Viewcon, Inc. for Phase I and II for the Townhouse area being a
replat of Outlot F, Innsbruck North. Upon a voice vote, a11 voting aye, the
motion carried unanimously.
Darrel Clark explained that Phase I and II of the complex have been changed
a little. The plat is for Phase I and II, the final approval for the T�ownhouses
is only in Phase I.
Hidden Lake will act as a retention basin for the storm water. It will have
inlets and an outlet. Mr. Van Eeckhout said they had no firm plans developed,
but they were working toward the end of making the area around the lake a public
^ park. The City has requested and they have agreed to give the City walkway
easements. They would ask the City to use this as a park, maintain and develop

it as a park. They would agree to walking paths, children's play equipment, but
� would not let it out as a ball park. It is not really intended for the public
. on a broad scale, just the public in relation to neighbors.
_ Mr. Fitzpatrick said the Parks &�.ecreation Commission discussed this pro-
posed park. There were some objections using City money for a private park, but
on the other hand, the City uses money for immediate parks in other areas of
the City.
Mr. Fitzpatrick continued that the City has not committed itself to develop
the land, but if they did, it would be a low type of development. The usual type
of development would be play equipment, skating rink, but he did not think they
would make this a focal point to attract people outside the bounds of this
general area. The nature�of the area is a neighborhood facility and attraction.
Once the land is dedicated to the City, it will be beyond the control of the
Association. He said he was not prepared to speak for the City at this point.
Mr. Van Eeckhout said they feel they have a very good inventory of lots.
Probably 75% of the lots will be available for first marketing with all the
utilities in. They have one home ready for occupancy, but can't get the deed
ready for the property until the plat is recorded.
Referring to the terrain, Mr. Van Eeckhout said the drawing has all cuts
and fi11s to elevation shown. Darrel Clark said that most of the cuts and fills
are less than 3 or 4 feet.
� They did ignore the trees on the plans, but found they still had many goo�
_ trees left. In the future all the trees will be platted on the map so that
adjustments may be made ahead of time. The trees are predominantly oak, and it
is planned to plant more trees. There will be a minimum interruption of trees.
When the ground dries up a little more, it will be possible to drive through
the area as all roads are cut.
�Mr. Schmedeke said that the part that confused him was that the City will
probably be maintaining the water and sewer. He understood this property was
owned by the corporation.
Mr. Clark said it is a11 private property, but Lot l, Block 9, includes
all the green area, common area and all the streets. Tt was his understanding
the City will have the right to go in and maintain water, sewer and storm sewer
that lies within Lot 1, Block 9. The City will not be maintaining the stree�s,
but will maintain underground utilities.
Mr. Van Eeckhout said that the sewer and water easements will be on public
land. The City will maintain only trunk mains, but will not maintain from that
line into the building. The service going into the house the City would not
maintain. it is a little different from the normal procedure, but quite similar.
Mr. Van Eeckhout said they were giving exclus:ive easements coming out the
front and back of the building to give the people the exclusive right to sit out
in the back yard. Theoretically if they didn't have the easement, the Associatioa
,,� could restrict the use of the area. If a neighbor should pull up and park in
front of a garage, there wouldn`t be rnuch you could do about it, but with this
easement, no one could par'x there.

r„� Mr. Clark explained that one of the reasons why the City would like to main-
tain sewer, water and storm sewer is that these people are residents of Fridley
and individual owners. If there is a sewer problem, the City feels it should
be repaired as soon as possible. If there is a sewer backup, he did not think
anyone would want to wait for a private contractor to get there. It is also
to the City`s interest to see that all hydrants are kept in service.
Regarding the private roads, Mr. Van Eeckhout said that they felt the City
standards for this level of service are excessive. The reason the City did not
object to private roads is that they would not have to maintain or plow them --
the Association will see to that. Some of the sewer and water will be under
City contract. Part is under Dunkley contract now and the balance will be
negotiated soon and perhaps getting Dunkley to do it.
_ MOTION by Minish, seconded by Schmedeke, that the Planning Commission close
the Public Hearing for the proposed plat by Viewcon, Inc. being a replat of
Outlot F, Innsbruck North for Phase I and II for the Townhouse'area. Upon a
voice vote, a11 voting aye, the motion carried unanimously.
Darxel C1ark added that Viewcon could not plat any more until the total
storm sewer system is designed arid settled. There is enough storage in the
area to take care of the present plans. The final pond is to be located in
New Brighton, but until the final storage area is agreed upon by New Brighton,
the future stages cannot be approved.
� Mr. Van Eeckhout said that the storm sewer problem was the most expensive
one and did not want to rush into it.

MOTION by 5chmedeke, seconded by Zeglen, that the PZanning Commission
recommend approval to the City Council of the proposed preliminary plat,
Innsbruck North 2nd Addition, P.S. #71-03, by Viewcon, Inc. being a replat of
Outlot F, Innsbruck North, for Phase I and II of the Townhouse Development.
Upon a voice vote, a11 voting aye, the motion carried unanimously.
(Item 5: Approval of Final Townhouse Plan)
Mr. Van Eeckhout said they will be able to move into Phase II without any
problem because the platting of Innsbruck North was approved October 5, 1970.
The final Townhouse plan does not have to go to Building Standards-Design
Control Subcommit�tee.
Chairman Erickson asked if the plan and design presented this evening was
approved by the Building Standards-Design Control Subcommittee. Mr. Van Eeckhout
said it was the same except changing the peak of the roof and changing the
fireplaces by moving them over, and a number of refinements were made in the
interior and cabinets. The firepl.aces will be optional. Each building unit
will have different kinds of units. Al1 driveways from the street to the garage
are hard surfaced.
The asking price is $27,500 and could go up to $40,000 depending on options.
n All areas not left natural will be sodded. The intention is to leave the areas
as natural as they can. They feel it is more attractive that way. It will be
the determination of the Home Association to maintain areas, some grass and some
in natural cover. All disturbed areas will �e sodded.

�'`� Mr. Schmedeke asked if they were trying to save most of the nice trees. Mr.
Van Eeckhout said they were because they have less to gain than anyone else and
more to lose by taking out trees. They cost money to take out -- $50.00. The
loss of trees is bad economically. Th� only thing they have not done a great
deal of is relocating a building to save trees, but are going to do more of that
in the future. They feel there are some areas where there are too many trees
and they felt some thinning would help the remaining trees to develop better.
If the plans are approved for Phase I and II, they will not come back.
Mr. Van Eeckhout continued that under the terms of the Agreement, they
agreed to start the road to Silver Lake Road simultaneously with the starting
of the townhouses and complete the road before occupancy of the townhouses.
The street going out to Silver Lake Road is graded and the road can be used
by trucks. A few construction vehicles could happen to come in from the West,
but the amount of traffic would not approach that of a single family. Council-
man Harris at a previous Council meeting felt no construction vehicle should
come in from the West, and they were trying to accomplish that. He did not
think any where near enough material would come in from the West to cause any
great inconvenience to the people living on Hillwind Road. Hillwind" Road is
used by commercial vehicles now. It would be better for the construction people
to use the.East road as it is a shorter distance to the building site.
Mr. Minish said that even though Viewcon's intentions are good, the truck
drivers do not always do the logical thing. He wondered if the Commission
^ should try to enforce the direction of the traffic.

to Council approval of the Fina1 Townhouse P1an by Viewcon, Inc. for Phase I and
_ II for the townhouse area generally I.ocated one quarter mile East of Matterhorn
Drive and one quarter mile North of Interstate #694 described as Out.Zot F,
Innsbruck North with the condition that the construction traffic could come from.
the West until November 15, 1971 after which aZ.Z traffic to the townhouse site
wi11 have to come in from the East. Upon a voice vote, a1.Z votinq aye, the
motion carried unanimously.

6. VACATION RE�UEST: SAV ��71-06, INDEPENDENT SCHOOL DISTRICT ��16: Request to
vacate 75Z Avenue from Lakeside to proposed Cleveland Street and proposed
Cleveland Street from 75� Avenue North 240 feet.
The Plats & Subdivisions-Streets & Utilities Subcommittee recommended
approval of the request, but asked that notices be sent to the property owners
in the block prior to the Planning Commission meeting. Darrel Clark said the
notices were sent out. �ao of the owners telephoned him and there were two
other owners here this evening.
Mr. Edward Munson, business manage'r for the School District, said that the
School District is attempting to purchase the entire parcel of property for an
elementary school building. They own a Zot of the parcels now, the school has
taken u� the tax forfeit lots, anc? some of the property is in the midst of being
condemned, but the procedure has not reacheci the point where the County Commis-
sioners are appointed. He thought they owned about 50% of the property. They
did not own Lots 2, 3 and 4 in Andco Terrace, but are in the process of picking
them up from the tax forfeit roll.

y� Mr. Clark said there were houses on Lots I and 2. The owner of Lot 1 said
that their biggest concern was that the school should fence the boundaries so
that the children are not permitted access to their rear yard. However, he was
in favor of the vacation. ,
Mrs. Janet Cisewski, 1559 75th Avenue (West 149.5' of Lot 10 and 11, Block 2)
She was against the vacation of the streets until the school purchased her two
lots. The School had made an offer for her lots which she did not feel was
adequate.
Mr. Clark said the concern of Mr. Edward Stumpf, 1545 75th Avenue, was that
if these streets were vacated, the value of his property would drop because the
lot would be landlocked. .He felt the City should not make a final decision on
the vacation until the school is the actual fee owner.
Chairman Erickson agreed that, until the land is actually acquired, the
City cannot vacate it. �
Mrs. CisekTski and Mr. Robert Eigenheer (531 Mississippi Street) both said
they were served with condemnation notices. Darrel Clark explained the procedure
of condemnation to them.

Mr. A1 Johnson said he had made a mistake on the plat as Lot 1 should have
been larger to permit the construction of a two family dwelling. The zoning
was R-1, and in order to build a double bungalow in an R-1 zone, it would have
to be done by a special use permit.
Mr. Clark said approval was given €or a special use permit with the stipu-
lation that there be one common access onto East River Road from Lots 1 and 2.
Mr. Johnson said with a common driveway, he would have to go around behind
the back o£ the house. With the additional 19 feet, the double bungalow could
be placed so that he would meet the setback requirements.

Street Addition. To split off the North 26 2/3 feet of Lot 4 and add to
Lot 3 and to split off the South 13 1/3 feet of Lot 4 and add to Lot 5.
Mr. Wallace Anderson was present.
Mr. Schmedeke, Chairman of the Plats & Subdivisions-Streets & Utilities Sub-
committee explained that the Subcommittee recommended approval.of the lot splits
as requested but he voted nay. He said he voted against the requests for the
following reasons: Lots 1 and 2 are not owned by the petitioner. The petitioner
owns Lots 3, 4, 5, 6 and 7. His thinking was that Lots 3 and 4 could be used
for an 80 foot building site and I,ots 5, 6 and 7 could be split into 60 foot
lots. We had a similar situation when the Planning Commission recently approved
the splitting of Lats 9, 10 and 11 into two 60 foot sites over on Washington
Street. Another strong factor, he believed, is Lots 11 and l2 behind Lots 3 and
4 on Washington have one common owner who would probably built on both lots-.
Lots 8, 9 and 10 are also under"one ownership. He felt his suggestion would
be the sensible way of splitting. He stated the zoning ordinance requires a
75 foot frontage as the minimum size of the lot. He would suggest the following
compromise: The lot on the North would be 75 feet, 65 feet for the next lot
and leave a 60 foot lot on the South. He felt if the Commission would create
too many substandard lots, especially in this instance when it was not a hard-
ship, there may be other requests coming in with 66 foot lots.
.Mr. Anderson said that the property is on a minimal type of street because
the East side of Jefferson Street has never been dedicated. It is a glorified
alley. His thoughts were that the lots were as large as possible with the
rear yard facing living rooms and having attached garages and such. Since the
last meeting he thought of a different kind of building for the lots. He felt
an attached garage would be no problem.
Mr. Anderson continued that there are many lots in the City 65 feet and less.
He felt that by making three equal lots and three comparable building sites that
would be the thing to do. By making the lots of different sizes, you definitely
put a burden on the builder to put something more in one hnuse and not the
others. Three different types of structures would cost more. The average
person would rather see three comparable buildings. There is a problem with
the debris on the property to the South. He felt that in the best interest of
the adjacent property owners and the City, three equal lots would be preferable.
Mr. Schmedeke asked �4r. Anderson how long he had owned the property ancl the
answer was two months, hou�ever he has been acting as the real estate agent for
� the previous owner for t:ao years.

^ Mr. Fitzpatrick said that if he lived on Washington Street, he would consider
this proposal down grading. He asked if Mr. Anderson would consider two lots
unreasonable. Mr. Anderson said he felt it would be unreasonable when you con-
sider the area. ;
Chairman Erickson said to Mr. Schmedeke that he could see his point, but it
is permissible under our zoning ordinance to reduce the size of lots if they
were on record before 1955. '
Mr. Clark said that Jefferson Street has been surfaced, water and sewer put
' in, and assessed on one side only.
Mr. Anderson said he.hoped to built about a$30,000 house. The assessments
are almost $7,000 which is not quite double with what the average owner is faced
with. The ordinance calls for a garage. He could not put anything on the lots
and sell for less than $28,000 or $25,000.
Mr. Anderson continued that he did not want the alley. He said he had a
plan for a building that takes up 48 feet of the lot and should sell for
$28,900..
Mr. Schmedeke asked if Mr. Anderson would be prepared to settle for a com-
promise, such as the North lot 75 feet, next lot 65 feet, and a 60•foot lot on
the South end.
� Mr. Anderson replied that he would prefer to use the method of splitti_ng
in the request.
The Chairman asked if there was any problem with the legal descriptions.
Mr. Clark said that the middle site will be parts of two lots. The
description will be a little bit lengthy, but still not a problem.
Chairman Erickson said that he understood Mr. Schmedeke's position, but
did not see any problem equalizing the lots being inconsistant with what is
going on in the general area. He did not see anything wrong with three equal
lots. He could se+e several reasons why it is better. He also didn't see why
lot lines have to line up with those lots in the back.
Darrel Clark said that in a grid pattern the lines do coincide. In contour
plats, the lines are less likely to line up.
Mr. Minish felt the additional 6 2/3 feet would give the petitioner a lii:tle
bit more to work with.
MOTION by Minish, seconded by Zeglen, that the Planninq Commission recommend
approval of the I.ot Sp1i.t applications, L.S. #171-�2 and #71-13 for Wallace E.
Anderson splitting five 40 foot .Zots into equal size Iots (66 2/3 feet) for

11. VACATION REQUEST: SAV �i71-07, MRS. VIRGINIA T. JACOBSEN: Vacate East/West
alley in Block 3, Spring Brook Park Addition.
Mr. Minish said that Mrs. Jacobsen appeared before the Board of Appeals to
reduce the rear yard requirement for a garage. The certificate of survey showed
a 12 foot alley behind her property was vacated, but according to the Anoka
County records, it had never been vacated. At first the neighbors were against
the vacation of the alley because of a misunderstanding, but when properly under-
stood, they were in favor. -
Mr. Clark said the vacation would allow the petitioner to build that much
closer to the center of the dedicated alley. Mrs. Jacobsen wants to build a
^ garage and preserve the green area. The access to the parking lot was over
Lot 11.
Mr. Minish said that a majority were present at the Board of Appeals hearing
and they approved the variance. ,
Chairman Erickson asked if the Commission could vacate an alley without
everyone signing the petition. Mr. Clark answered that Council_makes the decision
at the hearing. If one person objects, and has a good reason, they won't
vacate.
Mr. Minish said that there was no urgency with this request. It appeared
the opportunity was there to get this alley vacated.
The Chairman and the members of the Commission felt the item should be
tabled for further checking.

Mr. Ray Wollery of Midland and Peter Zubert of Adolphson & Peterson were
present. Mr. L. E. Torrey of Midland made the presentation.

Mr. Torrey said this additi.on onto the main warehouse building will be 252 feet
long and 264 feet wide. It will be a two story building with approximately
134,000 square feet of space. It will be used for warehouse storage, some
offices and meeting rooms and for a lunch room. There will be an elevator
used mostly for transporting some handicapped employees to the second floor.
He said that one of the advantages of a two story building was th3t the
ceilings were only 11 ft. 4 in. high from floor to floor and the warehouse
area would be used for shelf and bin items. In a one store warehouse building
with high ceilings there is a lot of wasted space because you can only stack
the merchandise so high. They are leasing 80,000 square feet of space in
the Roseville area and they•will replace this leased space with this building.
They will have all their merchandise in one location.
They are going to dress up the new building. It wi11 have dark glass around
the windows and will feature a canopy at the new entrance. This canopied
enfrance will have the height to accommodate buses as they have many people
coming for tours. The buildi,ng will have decorative lighting, both on the
building and on the perimeter. They are adding additional parking, blacktopping,
and landscaping. Mr. Torrey said the new landscaping would be extended along
the property lines on the North and East. They are planting green ash trees.
Mr. 2eglen asked if there was enough additional parking. It is the understanding
there would be enough parking by the time the eatire concept was completed.
Mr. Muhich said there had been previous disc�.ission about curbi_ng the black�opp�.n�;.
Mr. Torrey said they really didn't want curbing because in the winter they
have to have some place to put the snow. He said some times the snow piles were
• 14 feet high and the curb would interfere witli this. He said as it was their
employees using the parking area he thought they could control keeping them off
the sodded area. He had passed this request for some type of barrier on to
his builder and was sure this could be worked out to every one's satisfaction,
n Mr. Zeglen asked about the radius on the corners and Mr. Muhich said the;�

Muhich told hiia 40% of their total area. Mr. Tor;ey said they had, gotten
100 feet on the rear of their lot in an exchange with Burlington and they
would be moving the existir, fence back and would be putting in a concrete pad
for trailer storage there. The area on the west side of the building they
used for this purpose before wil� be blacktapped.
Mr. White asked if the expansion would be the same as th� existing bu�lding.
Mr. Torrey said they would be dressing up the existing building to conform to
the new addition. They existing building would have more color.
Mr. Lindblad asked if there would be more tra�fic and w�s told no, except aS
the business grows. �
Mr. White asked if there would be any shipping or receiving in this new
building. Mr. Torrey said no, but there would be a door in the build�Lng
they could use if �ecessary.
Mr. Lindblad asked when they expected this addition tq be completed, Mr.
Torrey said they w�re hoping for completion in May of 1972. Mr. Zeglen aSkec�
if the wall between the two building �aould remain and �Sr. Muhich saici th::.s
would remain as a�ire wall.
Mr. Torrey said he would like to request the Subcommittee to recommend approval
of their final plans and the issuance of a foundat�.on pexmit. Because of the
season of the year they were anxious to get started. Mr. Zeglen said as th��r
plans were quite complete they would consider this request. Mr. Muhich said
they should have detailed plans of the interior of the building before they
go,to Council. Mr. Zubert said the plans would be ready be£ore the November
�15th Council meeting.

of the present building and recommend the granting uf a foundation peru+it.

Councilman Harris asked if this was a rear-front split. The City Enqineer
said yes, and added that the City will need aome easements fro� him. Council-
man Sheridan asked if this was not the same type of split he requested behind
the mortuary. The City Engineer said no, because there is access in the back
of this lot. There is a 16' dedicated alley along the back of the lot so the
City will need some additional right of way for a future road. He explained
that the split is between the two zoning categories. The back portion is
zoned residential. These lots are 300 feet deep so they will not be double
frontage lots, they are plenty big enough to split.
MOTION by Councilman Sheridan to grant the Lot Sp1it L.S. #69-13 reque�ted
by George L. Walquist on the west 150' of Lot 18, Block 1, Spring Valley
Addition, subject to his deda.cating the easterly 34' for the purpose of a road

Mr. Bernard Rotter -President of Castle Mobile Homes, Mr. Willis Johnson-Secretary-
Treasurer of Caetle Mobile Homes and Mr. Mike Kubiatowicz-Representing Macey Signs
were present to present the request.
Mr. Rotter explained to the Board where the land ie located, and that it is 160
feet wide and 325 feet deep. He also explained that they feel Highway �65 is the
best loQatiori they could find for a mobile ho�e sales establishment as 90 per cEn�
of the traffic travels on Highway #65. We don't require a very large piece of
land ae we only plan to have around 11 mobile homea, and this lot is what we are
looking for. We would be leasing this land, fron Mr. Harstad, for a th�ee year
period. He has indicated he is not �nterested in selling the land.
Mr. Rotter wae aeked what type of a building would the main office be.
He anewered they operate out of a mobile home that has been partitioned into
offices. It would be 12 feet by 60 feet long. To pt:t up a permanent structure
would be a dieadvantage for them.
Mr. Harris asked if they were planning on b•l�,cktopping any area of the �roper.ty.
Mr. Rotter said they were�planning on blacktopping the entrance and pas,king �ea.
The area where the mobile homes are parked would be rock.
Mr. Harris asked if they had any sanitary facilitiea as the City Code calls
for two restrooms.
Mr. Rotter said they would install two restroo�ns inside of the main office mobile
home. -
The Board was shown aketches, of the proposed l�.ycut, drawr. up by Macey signs.
The Board asked about the proposed 2ighting and fencin�.
Mr. Rotter said they planned �n having quartz l�g�hts, colored lights and security
lighte. They had not plsxined on any fencing.
MO`I'IpN by Harris to close the public hearing.
Seconded by Minish. Upon a voice voi;e, a17. voting aye, the motian carried
unanimously.

� Chairman Mittelstadt informed the applicant that if the requ�st was granted the
Special IIse Permit would terminate when the three year lease was up and the property
would revert automatically back to M-1 Zoning unless the applicant reapplied and was
granted another permit.
MOTION by 0'Bannon to approve the request with the Yollowing stipulations;
1. There will be no permanent residence in the mobile homes, anfl no repairing of _
or stor�.ge of damaged trailers. _
2. The Special Use Permit will expire when the three year lease expires and the
property will revert back to M-1 Zoning.
3. Adequate security lighting be installed for better observation by the Police.
$. The entrance and parking area are to be blacktopped.
5. Two restrooms be installed for the public's use.
6. There be a minimum distance of 15 feet i►etween structures and tYie trailers be
pa.rked horizontally on one side of the lot and vertically on the other side
to provide an adequate pa.rking area.
Seconded by Harris. Upon a voice vote, Ahonen and Minish voting nay, the motion
• carried. �

Mr. Minieh explained his vote by saying that he had no�t�iing against this pa.rticular
— oper�tion but he felt Central Avenue was developin� into a mobile homes eales str�et
and by allowing another mobile home sales operation into this area would onl.y
worsen this condition, and we would be encouragin.g other mobile home operatione
to come into the City to request more spot rezoning along Central Avenue. He f�lt
it would be laetter if the applicant would look for a piece of land where they
eould have permanent occupa,ncy instead of asking for a Special Use Permit where
they would �only be assured of a three year occupancy.
Mr. Ahonen agreed with Mr. Minish in his reasons for voting aga.inst the request.
�hairman Mittelstadt asked the applicant to bring� in a copy of their lease with
Mr. Haretad, which the public could examine if they so wished, to be assured that
the lease and the permit would be for a three �ear period only.
