Mr. Qureshi assur Mr. Swanson said two members of the Council looked over his present building in order to see what kind of a building would be coming in. His present location is 782 29th Avenue Southeast and is known as Aetna Lithograph Company. Mrs. Saba, 7345 Central Avenue: She was just wondering if the petitioner would be putting up a�ence between the parking ].ot and the homes. Chairman Erickson told her the Commission and Council would require screening end it is also required in the Ordinance. Mr. 3wanson added that part of the plant is kept in operation all night. At the very most there would be foux or five cars in the parking lot at night. The petitioner was asking for a parking lot, on a landlocked piece of ground, but ao m�ention was made who was going to use it. The suggestion was made by Mx. Qureshi that if the Commission felt this approach might be satisfactory to them, they could approve the Special Use percait subject to getting approval of the plans for the building by the Building Sta�.dards-Design Control Subcommittee and the Council. The part af Mr. Utter's lot that abuts Central Avenue is very lvw and close to a storm cul�rert and that is the reason for putting the accessory building pn high ground. . plannina Commission Meeting - December 8, 1971 Page 3 �-�.-�----- . n Mr. Harold Lind, 6076 Woody Lane: There has been,,��oad put in, but i.f a culvert were installed, Mr. Lind would have no objections. The driveway is in, but no culvert under it. Mr. Utter explained that seven years ago Mr, Nelson and he got the City to put in a temporary storm sewer that goes back to within 40 feet of Old Central and empties there. When the County put in Old Central, he asked the County if they would put a culvert on private land. Water hae been running over the property. As of now, it is in the process of being connected so there would not be any water problem once it is connected. The City Engineer eaid that originally when this area was developed, there was no storm sewer. In 1965 the Public Work� Department put in a storm sewer. Recently they have extended the pipe closer to the culvert. Probably a culvert will be installed under the driveway next spring. Hopefully the drainage problem will be solved in this area and there will be no water standing on the lot South of Lot 6. It is too late in the season now to finish the work. The City wanted tbe East half of this propextq platted iato smaller lots so the land would not be occupied by the railroad company but rather be aold to other developera for amaller industrial sites. They felt thia would be oae way to provide a buffez between the xailroad tracke for the people living Qn the Ea�t side of Main Street and aecondly getting aome �� praperty back on the City tax roll. The railroad compaay is oa the ta�c rall ao� for the land, but the additional tax would be for the buildir�gs. Mr. Schmedeke, Chairman of Plats & Subdivi�ion�-Streets & Utilities Subcom- mittee, added that this item wa� before his committee an hour prior to thia meeCi�g. He was happy to see the land was going to be developed for amal� industrial sitea bordering on Main Street. He thought the people in thaC area, and his area included, were afraid it would be a$witching yard. He fslt the City �hould be complimenting the railroad company for working the prablem out 1n this �anner. Chairman Erickson continued, that supposing the plat is approved a�nd the City does not approve the request for a piggyback yard, would tk�ie affec� the accees? Mr. Qureshi said the City has access at 57th and 61st Avenue, atid tk�e eswer l�ne on Main Street. Chairman Erickson said he was not in favor of a piggyback yard. Mr. Minish questioned whether or not there should be more access ta the interi,or lots. Mr. Herbert H. Neeaer, 6220 Starlite Blvd.: Mr. Neeser understood the railroad tracka would stop at blst, but a track was laid right behind his home and this was in addition to the main 1ine. To him it looked like switch- ing tracks. Mr. Qureshi said it probably was a temporary storage yard until they got their railroad yard on 43rd Avenue built. He understood this was only a ten�porary use of � the property. Mr. Brokopp said he waa not prepared to talk about tracks, as he was not familiar with it at all. It is railroad right of way and they have been the�ca long before any houseB were there. Mr. Qureshi said the City has gone before the Public Service Commission of the Railroad Coamnission requesting a crossing and was turned down. The way it looks now, the railroad crossing is an impossibility. The City is working to get a grade separation on Mississippi Street so that we have better access at that point. Mr. Minish asked if the railroad approved the crossing on 61st Avenue and the an�wer was they opposed it. He then asked why they opposed it. Mr. Brokopp answered that this would be a very large crossing. Extensive hearings were held before the Railroad Ccmauission and permission was refused. The underpass on Mississippi Street is more aenaible in order to keep the cars away from the tracks. Mr. Brokopp said tha City has an easement for 61st Avenue access. They gave up enough of their property �o that access could be provided for Starlite Boulevard. They cooperated again with the City at that time. This platting of 61st Avenue is not anything new, but was put on the"p lat by coincidence with the platting down in Sylvan Hills. Mr. Minish aeked if two access roads would be sufficient. Mr. Fitzpatrick said he had the sau�e question. This propoeal would be for pretty heavy traffic ^ along 61�t Avenue. t , Mx. Ferris D. Palmer, 6018 2nd St. N.E.: He said he did not know how long th� railroad company owned the groperty. In 1950 cows were grazing behind their lot. Why isn't the property zoned cou�ercial? Upon a voice vote, all voting aye, the motion carried unanimously. Chairman E�icksoa asked to see a copy of the Council Agreement with the railroad company. The City Engineer passed out copies to all the members. Mr. Qureshi said that the railroad would participate in the railroad separation on Mississippi 5treet, which, basically, is County road. The City requeated by Resolution the need af the grade separation. Anoka County has engaged Eugineers to make a feasibility atudy. He continued that in the last eight years the crossovex at Mississippi Street has been discussed but the County controls the road. Originally it was the railroad company that was not favorable to the crossover, but that has been solved. The only eupport the railroad will give Fridley is before the Railroad Com�aission. The reaaons given for the delay by Anoka County were money and the people in the North area who feel because it is a large sum of money, wish the money could be spent better elsewhere in the County. The County stil�. has a rural flavor. Mr. Ma.rvin Anderson, a member of the church, was also . present. Mr. Peugh explained the reason they are requesting the area variance is because the overall area of the sign is 6 feet by 8 feet but the copy area of the sign is only 5 feet by 7 feet. The remaining area of the sign is molding. .The variance on the height,is being requested, to get the sign high enough so the children in the area would not be able to get into the sign to change the message on it. The height is also wanted to get the sign higher than the average pile up of snow so it could be seen during the winter months. Mr. Lawrance stated the sign will be a double face interior illuminated, soft glaw, sign with a total height of 10 feet. It will have a plastic face with a11 steel construction. The top of the sign, which will have the church name, pastor`s name and service times, will have a black background with white letters. The bottom, a five line attraction panel, will be white with black letters. The Board asked•why they couldn't usP smaller letters and decrease the sign size. Mr. Lawrance answered there are stock letters of 2 inches, 4 inches and larger. They are using the 4 inch letters on this sign as it wi11 be positioned about 50 yards from Osborne Road and they want the moving traffic to be able to see and to read the sign. Mr. Reiter started this type of wori. at a Northside Settlement House and worked there for 18 years before it closed down. Mr. Reiter and his son-in-law are now operating a gym in Colwnbia Heights „ which was opened seven years ago. Last year they had 305 boys. They've been open four �ights a week and they've won the Championship for seven years in a row. They could only enter 201 boys due to the increaed entry fee, so some of the boys were unable to attend. "fhe program involves boys ages 10 to 14 years. They hold their sessions at the Junior High Schaol two nights a week and at the Field House on the other two nights, from 6:30 to 9:00 p.m. This year, Columbia Heights will be sponsoring the National Golden Gloves Tournament. The entry fee will be $2.50 per boy, and it will begin on March 16, 1972, and lasting a minimwa of five days, depending on the number of teams entexed. The boxing program is operated in conjunCtion with President Kennedy's Physical Fitness Progra.ms. Mr. Reiter stated that he had often times he has paid money out of his own pocket, to operate the program and enter boys, but he is now retired and can no longer do this. He mentioned that there were 38 or 39 Fridley boys registered last year and they anticipate nearly 100 boys this year. y' Mx. Stimmler ask what the overall cost of the program was? Mr. Reiter �auldn't give ' a figure, but he explained that each boy gets a trophy, regardless of whether he was � a winnex ar not, and they have a fund raising dinner to help pay for these. They have seven teams and each team wins a team trophy. Mr. Fitzpatrick asked what the yearly total budget was? Mr. Reiter stated that they � bought 305 trophies. A part of the agreement was that the railroad company would plat the property North of the Freeway and make the land available to the public for sale. The plat meeta the City lot minimum requirements and also, in the agreement, an access was to be provided West of 57th Avenue. The City has an easement provided in the middle of the plat for exieting watermain. Mr. Schmedek.e aslced if there was a narr.ow piece of land that did not belong to anyone. Mr. Qureahi answered that th�re is what is called a description gap sometimes in the older aaaps where the surveyor was unable to make the lot lines meet. There is a small description gap between Lots 7 and 6, and because the property on both sides of the gap are owned by the same party, the gap will be eliminated in the new plat. Mr. Qureshi continued that the railroad company meets all the requirements the City has in the agreement and gives the City all the needed easements. The City wanted to malce sure the railroad did not use this property for railroad purposes so that this propexty could be developed and be owned by private indus- tries and put on the taac roll and provide a buffer between the East side of Main Street and West �f�these lots. ORDINANCE #497 - TO AMEND TF� CITY CODE OF THE CZTY OF FRIDLEY, MINNESOTA BY MAKING A CHANGE IN ZONING DISTRICTS (TO REZONE FRUM M-1 TO C-2S). ARF.A GENERALZY LOCATED AT Tf� SOUTHEAST CORNER OF dSBORNE ROAD AND T.H. #65, AND CONSIDERATION OF SPECIAL USE PERMIT - CASTLE MOBILE IiOMES: _ 1 �� Councilman Harris said that at the last meeting, it had been his understanding that the request for a special use permit would qo to the Planning Gommission December_15th, and would be back at the Council meeting with their recoaarnendation. The Petitioner called him and said he found there was no Planning Commission .Meeting until after the first of the year, and he had requested that the item be put on this Council Agenda. He stated that the Petitioner is in the audience tonight. Councilman Iiarris said that as lonq as the Planning Cc�►ission was not meeting, the staff set up stipulations�for the sgecial use percnit. He said he would like to have the Corranent to the Council in the index of the Agenda changed to read that the item was on the Agenda at the request of the Petitioner. Councilman Breider asked to see the landscaping plans, and the City Engineer handed out copies. Councilman Kelsharr asked about the original stipulation _^ calling for the units to be 15 feet ap.art. Councilman Harris said that this was evidently a decision made at the time of the original request at the old location, wiiich was residential to the rear and had developed property on both sides, but it is very open at the new location. MOTION by Councilman Breider to adopt Oxdinance #497 on second reading, waive the reading and publish. Seconded by Councilman Kelshaw. Upon a roll call vote, Kirkham, Mittelstadt, Hariis, Breider and Kelshaw all voting aye, Mayor Kirkham declared the motion carried un3nimously. Conncilman Harris said he had certain things to pass on for Council consideration concerning the special use pe�tnit. (1) The special use permit i� to be governed by a certificate of occupancy, issued after the impro�rement is in place and all City Inspectors have signed it that all conditions have been met. (2) The s�acial use permit is to be effective for a period of five years duration. (3) When perman�nt facilities are built, the owner is to provide an ea�ement for roadway to Osborne Road b�hind the Frostop Drive--in. (4) The area outlined on the Plot Plan is to be blacktopp�d. (5) The office is to be at least 24' X 48' on cAncrete blocks and to be skirted to give the appearanre of a permanent struc- ture. (6) The landscaping is to be done according to the landseaping plan and blac}ctopped and curbed. (7) Units to be a minimi:m of 8 feet apart with a maxi- u�um of 30 units at the site. (8) The parking lot to be'curbed with blacktop curb and striped for custanexs and ersployee parking. (9) There shall be not less tlaan four security lights aroun� tl:e perin:�ter. Councilr�i�n Harris said the petitioner had indicated there is a Naeyele Company sign there now. r ^ � REGULAR COUNCIL MEETING OF DECEP'SBER 20, 1971 PAGE 5 Mr. Eldon Schmedeke, visitor.to the Council Meeting, asked if there were going to be sewer and water connections to the restrooms. Councilman Harris said they will have to provide these. Mr. Schmedeke also asked if they will be able to assess this, as not being able to assess it would be one objection to a tempo- rary office. The Petitioner, Mr. Rr�tter, stood up in the audience and said he would go on record that he would allow it to be taxed as a permanent structure or real estate. Counci].man Kelshaw requested this be listed as a stipulati,on: (14j The office will be taxed as a permanent structure. Mr. Schmedeke expressed concern that this would be the start oP another mobile park. The City Attorney said that it would take a rezoning before it could become a mobile park. - The Petitioner, Mr. R,�tter, was asked if he �uld agree ta the 14 stipulations mentioned. FIRST READING OF AN ORDINANCE FQR �EZONING FRU1K� R-3 TO C-2 - GENERAI, REALTY: The City Engineer showed the area requested for reaoninq�on the overhead pro- jector. He pointed out tiyat the Planning Cox�aission reco�a►ended approval, after � discussing that they would like to r�ee tiie al�.ey i�roved :to 53rd Avenue when - the rest of the alley is being-done. Gouncila�an Harris agreed, as he would not want to see the alley done just half way in this area. The City Eriqineer said that the rezoning for.the Way Dar Land Corporation (Little Dearborn - antique car shop) will be co�inq back to the Cauncil at the same time this rezoning will be back for a second reading and the alley can be discussed at that time. MOTION by Conncilman Harris to adopt the Ordinance on first reading and waive the reading.
