The agreement with the City sets the maximum density at 850 units. ` Mr. Phillips said all disturbed areas�because of grading�will be sodded with the balance of the area left in the natural state. Mr. Nordaune said any planting that would be done would be non-oak becauae of the predaminaace of oak in the area. Mr. Tonco said the plan presented had on-street parking. Mr. Zeglen asked how wide the streets would be. Mr. Phillips said the stxeets will be 25 feet wide. Mr. Tonco said when cars were parked on the street that only left 17 feet and he was cat►cerned that in ths evept of a fire, the firetrucks would have difficulty getting into the axea. He wondered if some randam off-street parking areas could be provlded. Mr, Phillips said because of the topography of the area, thls would be almost impossible. The facia would be painted the trim color. They will use brick on all lower levels. Mr. Tonco took exception to single wall construction approved by the State BuilCing Code. Mr. Zeglen said there had been some controversy about the fire separation of the garages from the living quarters as two garages would be under one unit. At the last meeting the Building Inspector stated his preference for precast decking as a separation. Mx. Nordaune said he thought they should use a two-hour occupance separation. Mr. Nordaune said they had sent plans to the State Inspector on these garages. Mr. Herlofsky said the Building Inspector may have to go over to the State Building Inspector's office to resolve this issue. He noted there was no separation between the blacktop area and the berm. He suggested they use some type of post or precast curbing to keep the trucks from going off the blacktop area. T�e precast curbing is allowed here aad at the end of the existing parking area to allow for future expansion of the parking and dock areas. Mr. White said he didn't see a landscaping plan. There were notations of evergreen plantings on the drawings but this was not complete enough. Mr. Zeglen said the security lighting wasn't on the plans. MOTION by White to recommend to the City Council approval of the request to construct an office, shop and warehouse building with the following stipulations. 1. Additional landscaping plan. 2. The building will be 90 feet by 190 feet. There will be a fire wall between the office and service building. � Mr. Krank said there had been no decieion on the building material to be used on the exterior of the building. Mr. Krank mentioned sever�l ' materials, all which were acceptable to the Building Standards Board, but Mr. Zeglen said the decision had to be made before they went before the City Council. Mr. Tonco said when the decision was made, a sample of the material should be given to the Building Inspection Depar�ment. Mr. Krank said this was the first time he had seen the landscaping pl$n as he had bees� out of town, and it would be revised before they went to Council because the plantings in the original landscaping plan were too dense and would hide the building. Mr. Zeglen asked about security lighting as there wasn't any showa on the plan. MOTION by Tonco to reco�amnend to the City Council approval of the xequest to construct an office and a service building with the folloWing atip- ulations: � 1. Chainnan Minish asked Mr. Dockter to briefly go over his proposal again for the benefit af the members of the Board who were absent at the last meeting. • � Mr. Omtbedt explained there was an error made by them in drawing the proposed • addition and garage onto the survey in that the measurement asked for in the front yard variance should be 33 feet 4 inches instead of 34.7 feet. Chaizman Minish stated the notices that were sent out stated 34.7 feet and the Board can take action on that request but if the applicant wants to change the request to 33.3 feet, new notices will have to be sent out to the surrounding property ownexs. Mr. Harju stated he couldn't see why the addition and garage couldn't be ' jo�ged back to be more in the back yard. P3r. Dockter said the back wall of the addition is level with the cantilever from the kitchen. It would be more expensive to jog the addition toward the back. Mr. Omtbedt said they would rather defer action on the request until the new variance notices were aent out since the road restrictions are now on. Chainnan Minish stated the item had been tabled at the last meeting ta allow the applicant time to get a letter "of no objection" from his neighbor. Mr. Dockter did submit this letter to the Building Inapection Department. Pictures of the lots and a verification survey were shown to the Board. Mr. Doherty explained he wants to add on a 14 foot by 26 foot addition onto the front of the existing house. The problem is that the existing house is only 3 feet from the lot line so the addition will also be only 3 feet from the line. The existing house was built in 1946. He said his main purpose fnr the additi.on is to get more room since the main hou�e is small to begin with. It will be used for a living room, family room and a small office. Mr. A1 Williams, who has an interest in Lots 27 and 28, Mr. Dennis Berry, 680 Ironton Street and Mr. Raymond Weitbrecht, 690 Ironton Street, were present and interested in learning what Mr. Doherty was proposing. Mr. Williams stated he has a purchase agreement on the two adjacent lots to the North that are owned by an estate. The lota were probated in Wisconsin �but have to be probated again in Minnesota. The owners live in California. He said he owns the 3rd & 4th adjacent lots to the North. ^ CY:ainnan Minish asked Mr. Belisle if granting the variance would create problems for Mr. 4dilliams in building on his lots. Mr. Belisle answered the variance would add to an existing non-conforming use and would restrict building on the adjacent lots as there has to be 15 feet between structures and 20 feet between living areas. The addition would also be increasing the fire hazard between structures. He asked Mr. Doherty it he had considered building onto any other part of the house. Mr. Doherty stated thet economics dictated which way they could add on. This is the only way to go to get the maximum henefit for them. Any other way would disrupt all of their plans. This plan would also blend in very nice with the existing house. He said in answer to the Boards questlons, that the addition w ill not have a second story and there will be just a crawl space under it. Mr. Crowder asked if Mr. Doherty had talked to a builder and if the builder could build the addition as propoaed. Mr. Doherty said his sketch is just a rough aketch and some ideas could be changed but he has had estimates from 3 contractora and they can build according to his measurements. Mr. Williams said that with a 50 foot lot you don't have to s�uch choice. Christenson stated they proposed to put up a nice looking double dwelling on this lot. All the code requirements are met except for the one side yard. He said they could put up a different type of bungalow that would meet all the codes but it wouldn't be as nice looking as the one that they propoae. ' Mr. Lennox said he had wanted to buy this lot and build a double bungalow � on it but the City Assessor had told him that this lot had only 9,770 square feet. Mr. Christenson said he had discussed this plan with the City Engineering Assistant and they agreed there was 10,380 square feet. He said they are building a double garage on one side of the dwelling and a single garage on the other side but they also have to have a parking apace or caxport in the rear yard to meet the code. They havea't decided exactly where the parking space would be yet but they do know they have to have the parking space. Mr. Belisle added the parking space would have to be 25 feet fro� the property line so the car would not be parked on the boulevard. Chairman Minish stated it is not the Boards responaibility to check the area of the lot, that ia the responsibility of the Building Inspection Departcnent ' or the Engineering Department. If there is an error in the lot area, the applicant would have to come back for another variance request. The petition stated the 13 surrounding property awnera �+ho had signed the petition wished the Board to grant the variance but only if Mr. Christensan built the dwelling according to the plana that were submitted to the Board. Zhe e�tension will be a 4.4 foot by 10 foot sign to go on top of the existi.ng sign. It will be the newest type of sign as it ia a remote control sign that :�.s controlled from inside of the store. There are 4 lines of 12 modules each. Each module has the letters of the alphabet on it. The sign is double faced but wtll not rotate. The sign is leased from the company and not purchased. Mr. Schroer added they also need a height variance as the gas statian s�$n on the corner hides there existing siga som�what. The Board asked if the signs on the building wouid come down if th�e aign was approved. Mr. Schroer said there are 2 separate casp a.�►ies at this loca;tia�; �Qb's Produce Ranch and Green Giant. SMITH: Lots 15 and 16, Block 4 and Lots 8,�9, 10, Block 1, Adams Street Addition. To make three 66 2/3 foot lots from five 40 foot lots. Mr. David Anderson represented the petitioner as Mr. Smith was out of town. Mr. Anderson said that he was a builder. Mr. Clark stated that about a year ago, the five lots (Lots 3, 4, 5, 6, and 7) behind these lots were considered. In this area there are lots that are smaller than 9,000 square feet. The discussio� had been whether or not we should try to get one large lot of 80 feet and two 60 foot lots. The question was would three 66 2/3 foot lots be better than two 60 foot lots and one 8Q foot /, lot. The Council finally approved t�ree 66 2/3 foot lots on these five lots. Mr. Schmedeke asked Mr. Anderson if he was informed by the City about the lots being 66 2/3 feet. Mr. Anderson said Mr. Smith had been handling this request and he could not answer that. Mr. Clark said he informed Mr. Smith of the former lot splits and Mr. Smith said he would make the request this way and be willing to discuss other possibilities. Chairman Schmedeke said that in the light of the fact the Subcommittee had already approved lots of this nature which back up to these lots, in his opinion, it would be virtually impossible for the Subcommittee to deny this request. Mr. Clark added that there was no problem as far as the City is concexned as there were no easements necessary other than the easement fo�e uti�.ities i.n the alley which is not vacated nor open for traffic. The sugges- tion had been made that a study be conducted to determine which streets and alleys could be vacated. In his opinion, the signers should be 100� for the vacation, especially if the alley or street is in use at the present time. Mr. Clark said he talked with Dick Harris in the office last Friday. He did not have strong feelings for or against, but really felt he would favor the vacation. *ir. Hetland said the people on 77th Way do not need the alley and favor the vacation. Mr. Clark continued that if the Subcommittee were going to recommend the vacation, the City should retain the utility rights within the alley. There will be access to three sides of most of the buildings in the block even with the alley vacated. . Mr. French said the lots to the East and some of those behind on the West which are not developed, are strewn with junk automobiles, etc. Mr. Clark said a storm sewer is now going to be put in the area and the area of the creek will then be cleaned up. MOTI"ON by French, seconded by Forster, that the Plats & Subdivisions- Streets & Utilities Subcommittee recommend approval to the Planninq Commission of the Vacation Request, 5AV #72-03, by Gene Hetland, to v�cate the a11ey between Beech Street and E1m Street, 77th Way and 78th Avenue as shown by the map on � Page 7 of the Agenda, subject to utility easement in the a11ey that exists now and subject to approval of a11 affected properties. MIKE PRELIMINARY PLAT, P.S. ��72-01, HEATHER HILLS 2ND ADDI NNON: A replat of Auditor's Subdivision No. 22 Present to explain the request was Mike 0'Bannon and his partner Merlin Gaslin. Chairanan Schmedeke explained th�t th�s item has been studied since 1968, and the final plan was felt to be a gooc! one. Now there is interest in the West end of the property and he hoped to get the people to agree with a kind of plan they and the City can live with. Mr. 0'Bannon explained the amount of developing he had done it� the axea to date using the final plan of the Rice Creek Road Study. His p�an fo�lowed very cl,osely to the original one, but there was a slight deviation in the pXeaent pl,an. Where, originally, a road would be put through the p�operty of th� People's Church, he has used a cul de sac eliminating an exit �4 Central Ave�ue. fle said the Chies property has still to be cl�aned up and graded. Chairman Schmedeke said he did not think he would ask for an ordinance at this time. He would rather have the Subcommittee come up with a strong recom- mendation for the Planning Commission to look at. If the Council decided an ordinance change should come about, that is the level where it should happen. He was not preaching that old lots have the same requirement as the loopback parcels. Mr. Clark said that, while the Highway Departunent encouraged the loopbacks, they do not have any jurisdiction over them. Fridley is the first suburb to try them and sometimes they are called "Fridley Loopbacks". They have good points and bad points. We are talking about loopback lots being three quaxtexs of an acre or 1� acres. This amount of land is large enough for a service st�tion. The City is going to court because the request for a servic� statipn and xezon- ing on '19th Avenue and East River Road was denied. Mr. French said he agreed to some extent. He wondered if the recommetndation to the Planning Commission should stress the need or desire on the part pf the Subco�mnittee to recommend access of the setback other than 75 feet and/or restricted more so than has been tried up until now. A lot depends on what kind of use you are going to put this island to. Mr. Clark said the islands can still be attractive and also k�e laxge enough to meet zoning requirements. A lot under heavy industxia,l �equ��rea �.� acres and for light industrial 3/4 of an acre. The access can be cantxvllsd. Mr. French said that a 75 foot distance for an access is very inadequate. From a traffic design and safety standpoint, something more than 75 €eet is definitely warranted. Chairman Schmedeke suggested there be no access onto a busy stree�. Bob Schroer and Andie Haugen were present. ti Bob Schroer explained this request was for the sale of above the ground . swiuIIning pools and a cabana type of building which cQUld be used for a dressing ' roam or shelter. The cabana on display would be resaleable. The area would I have five pools and the cabana, and is a triangular piece of property located ( at the Northeast corner of the loopback on University Avenue. To the North I of�this pr.operty would be the next request, the Recreation Equipment Sales, Inc. This area has been leveled off, and will be used for excess parking. There • wil.l also be parkino made available inside the rental and �.les area. The _ camping trailers will be fenced with a Western stackade type of fence across the front and back 30 feet. Mr. Schroer said the pools are fenced in and cars do not enter the pool area. Mr._Schroer said the Company handling the recreational equipment is from � Roseville. Mr. Schmedeke said that a company se3.ling used rentals or used auto trailers has to have sanitary facilities with a permanent building. This I is what every dealer has to do. If the City allows one person to disregard this stipulation, he knew of one half dozen other auto agencies that would ,�,,, like to come in under such a temporary b asis. Mr. Schmedeke then read from the . State of Minnesota Dealers Guide. Mr. Schroer said he was not selling recrea- tional equip�ent, but he was representing the company and he was certain they were aware of those problems. The discussion returned to the request for the swimming pools. Mr. Schroer said the cabana and almost all the pools would be removed in the fall. He stated the Green Giant paople have the contraet far the swimming pools and the contract stated the area was to be cleaned up by October 31st. Mr. Schroer was asked if there would be book work done in the cabana. He � said the sales probably would be written up there, but the final sales trans- action would be in the main building through the central check out. � � Chairman Erickson said the basic question is whether or not the sales of swimming pools require a special use permit. Peter Herlofsky referred to Section 45.101, B-3N "--- sporting equipment and like enterprises having its � merchandise in the open and not under the cover of a display salesroom." and said that was why they felt a special use permit was needed. Mr. Schmedeke said he had no objection to the pool center providing the �building was not used for an office. .Mr. Andie Haugen said that on October 31st, Green Giant will decide if the ^ praject is to be c�n�inued. If the decision is not in favor of being continued, all the equipment will be removed; otherwise most of the pools would be removed and the cabana could be placed on joist-like skids to �!ove it if it were not sold.
