Mr. Chesaut said the exterior will be 4x8x16 alump block �ith a clsy
tile roof with exposed 2x6 cedar tung aad groove rough eawn rafters,
with galvanized matal flashiag. .The alumiaum window frame aad door
will have an anodized bronze finish. There will be a patio area in
front with atane tables. The restaurant can aeat 66 people aad there
will be a drive-ia windaw.
Mr. Tanco asked �rhat the base would be ia the 10 foot strip ia front
of the patio area. Mr. Chesnut said they planned to use wood chips.

on all four sides of the property.
Mr. �ierlofsky said Ehe sign had to be 10 feet fram the property line and
required a separate permit.

Mr. Don Criapin and Mr. A1 Kiemele were preaent to present the request.
Mr. 1Ciemele said they are general contractors who have owned this prop-
ertq for five years. Tbey coastruct=l5=bo��0��houaes a year. Their business
praanpted their decision to use this building mart to retail light build�ng
supplies such as dimeasion lumber, paaeliug, and builders hardra�re.
Mr. Iierlofsky aaked how many people�th�y will employee. Mr. Riemele said
no more than five but they would atart out with three �ployees as Mx.
Crispia and himself aould be in and out also. Mr. lierlofsky noted they
had the plan marked for emploqee parking in the rear of the property
but the parking spaces weren't drai��bn the plan. They probably had room
for five parkiag spaces for employeea and ten parking spacea in the
� front of the building for customer parking. This gives then a total of
15 parking spaces but the size of their buildiag made the parking re-
quirement 30 parking spacea. Mr. Riemele said they thought they had
adequate parkiag for the type of buainess they planned, but they do
o�wn the adjacent propertq and if they found they needed additioual
parkiag, they could provide parking there.

Mr. Tqnco said we wanted a LO' radius on the entrances. Mr. Crispin
asked if the cuxbing had to be poured 6"x12" concrete curb. Mr Teido said
this was a requirement around all blacktop areas and the emploqee's
parking area required the eame.
Mr. Toaco asked about the sidewalk, Mr. Crispia said it would be 8'
wide.
The exterior of the sales area of the building will be stucco or pre-
fintshed white panels vith rough sawn cedar with batten trim. The roof
wtll be machiae shakea with alumiaum flaahing trim. The warehouse area
vill be scored block. Mr. Tonco said all expoaed block had to be painted.
Mr. Crispin and Mr. Riemele were asked about a screeniag fence on the
rear of the property. Theq eaid they would iastall a 6' redwood fence.
Mr. Tonco asked about the diaposal of trash. Mr. Criapin said they would
have an outside dumpster. Mr. Taoco said if any trash gathered arouad the -
dumpater he would want them to acreen the aide facing the street.
Mr. Zeglen asked for an additional security light on tbe South side of the
building..
- Mr. Herlofsky said anq sign requires a separate permit.

Sheridan told him that his assessm`r:t would be 58.59 for the street with
curbing and $5.70 for the street k�ithout curbiny. Mayor Kirkham said that
there was no assessment for the overlay on the driveway. The Finance
Director said that }he assessment for the street _s the same for everyone.
A certain section of a street is not assessed only to those people, but it is
evened out throughout the street. Mr. Potasek would be paying his share of
the main street.
There followed a discussion at the Council table while looking at the Engineering
Department's street maps. Mr. Hoyt agreed that the assessment was fair.
MOTION by Councilman Harris to close the Public Hearing on the Street
Improvement Project wt. 1969-1, 62nd Way, Potasek's Addition. Seconded by
Councilman Breider. Upon a voice vote, all voting aye, Mayor, Kirkham
declared the motion carried unanimously. �

Councilman Liebl said that as this property is located in the Third Ward,
he took the liberty of checking into the special assessments aqainst the
� property. There were assessments levied in 1960, 1962, 1965, 1967, and 1968
�-^ with a spread of 5, 10 and 15 years, amounting to about $32,000 without
interest.. He said that it was stated that the Catholic Church was at one
time interested in buying the land for St. Williams Church. He checked with
the Father of the Church, and he reported that there was never an offer made
because the City of Fridley then had an option on the purchase of the land,
and Mrs. Riedel honored the option. He said that there is an Internal
Revenue Service man interested in the property in return for back taxes,
and he was afraid that the City would not get anything out of it. He said
that he checked with the Assessor on the amount of return there would be
on a tax structure of this kind and was surprised at the amount of return.
The proposed development has 168 one bedroom units, and he did not feel that
that amount of single bedroom units would yield very many children. He
reported that he had checked with five developers and three bankers and they
felt that the land was not developable as R-1. He said that fr�nkly, low
•income housing with all the attending ramifications scared him. He said that
some of the adjacent people have said that they would go along with a com-
mercial development and some were aaainst that also. It is the obligation
of the Co�ncil to protect the school district and also the environmental
, conditions of the City of Fridley. He felt tha thic was one of the best
plans he had ever seen. He questioned whether the traffic problems this
would involve would be substantial grounds on which to refuse the rezoning,
and pointed out that the previous City Attorney thought that the traffic
considerations were not sufficient grounds for refusing a rezoning request,
but that the traffic problem was a problem of the City. This is something
that must be solved after the rezoning is done. He questioned what the
^ity would do in regard to the law suit if we should lose and have to pay.
� The City Attorney said that if the plaintiff was successful, the money would
i have to come out of general funds, and the mill rate wc�uld have to be
� raised. This would not bp assess�ble to the adjacent property owners. He

The Attorney for the estate said that he had a tax computation for July,
196G, and at that time there was owed $22,421.93, and they were allowed 15
months to pay this amount. TYie interest is 8o a year. 2'hey have got an
extention of time, but if it is not paid before June lst of this year the
Government will take it. The $22,000 must be paid. •This property has been
in the Riedel family since 1906-and is the only asset in the estate. He
said that if nothing is done by June lst, he will have to contact the Internal
Revenue Service, but he said that he did not wazt to do this. Mr. Wall's
proposal would benefit everyone. AlI Mr. Riedel wants to do is to liquidate
;�is estate and close it. He said that he could not fi:id any zoning map for f�
prior to 1956, but he understood that at one time the Riedel property was �
zoned commercial.� He said that there was over S31,000 in special assessments,
which included an assessment for curbing, yet this curbing was cut so that the
water could be channeled onto the Riedel property. He asked that this be '
rezoned to R-3. He felt that rather than have low cost housing in there, why
not have something that everyone would be satisfied with. Mr. Wall has
stated that he was willing to contribute an extra amount towaxd the storm
sewer, and the law suit will be disn�isseti against the City if this rezoning
is granted. �
IMr. Leif Henriksen, 495 Mississippi Street N.E., said that he lived on the
Ecorner of 7th Street and Mississippi Street. He said that he has seen some
nice low cost housing for elderly people. '
Mr. Robert McPherson, S00 Bennett Drive N.E., said that the �traffic is still �
a problem for the area. Commons Park is just south of the a'rea and there is
a lot of traffic on 7th Street. There is also a school complex just to the
south. He asked if the next assessment would be for an overhead to take care
of the traffic. He said that the Council should be aware that there will be
a lot of children in this area. • • �
Mr. Carl Paulson asked if there were any plans for low income housing for
elderly people. Mayor Kirkham said that he did not know of any.
Councilman Harris pointed out that this plan has not been approved by the
Council, and is not necessarily the plan that would be followed. !rir. Wall
said that if the Council will approve of their plan, this is the one that they
would like to follow.
Councilman Sheridan indicated to rir. Fred Wall that should this rezoning carry
on the first reading, prior to the secor�d reading would be the approval of
the plans by the subcommittees and the Council, and the application and
issuance of the b��.rlding permit. Then the finat reading would take glace.
He said that Mr. Wall had indicated to him that he is fully aware of this
procedure.
Councilman Liebl said that if this should carry, he would like to be sure that
there is no access on 7th Street, and that the setbacks would be 125 feet.
Mr. Wall said that this would be done. Councilman Liebl said that he could
not agree to the retaining pond, and Mr. Wall said that they would just 3s
soon take it out of the plans also. Councilman Liebl said that the City has
abused this land. �

Councilman Harris asked the density per acre, arid Mr. Wall said that he did
not know, but it was within that allowable by the Zoning Ordinance. He
thought that it would be about 17 pe� acre. Councilman Etarris said that
the entrances on Mississippi Street would create a tremendous amount of
traffic and asked if there had been any consideration given to any entrances
and exits on 5th Si.reet. Mr. Wall said that he �+�ould be happy to work with
the City's traffic coordinator. He said that they would also have the safety
of their tenants at heart. -
.. Mr. Leif Henriksen said that he was told that this was R-1 progerty and that
it would stay that way. He moved out here to get away from apartment
houses, now he would have or,e across the street from him, and a church
behind him.• He said'that he wanted to put in a duplex, but he was refused.
He pointed out that he also pays his fair share of taxes.
Councilman Harris said that under the R-1 zoning the.density is about 12
people per acre and asked Mr. Wall if he would be willinq to work with this
density. Councilman Harris said that 17 exceeds ttie Zoning Ordinance. Mr.
Wall said that if 17 exceeds tize Ordir,anCe, then he must have the wrong figure,
as he was sure that,he was within tlie allowable density. An R-3 development
with a density of R-1 would not be practical.
MOTION by Couricilman Liebl to adopt the rezoning ordinance requested by Mr.
I3ormal Riedel an first reading and waive the reading. Seconded by Council-
man Breider for discussion.
Councilman Breider said that he must speak in opposition to the motion. He
said that Councilman Liebl has spokeri of the moral obligation of the Council
to look at the tax revenues. He pointed out however, that apartment houses
require more services. In checking-he found that there were 28 burglary ,
attempts reported for private homes versus 72 for multiple dwellings. This
is a 41� difference. He said that he had analyzed the apartmerit study and „
finds that there are more children coming from the older apartment houses
in Fridley than from the newer ones. He felt that the tax benefit would not
be as great as it is anticipated to be. He said that he was not quite sure
what there was to be afraid of in regard to the low income housing for
elderly people. He felt that it would be a violation of his oath to say
that.because a person is old the City cannot supply with housing. Ae did
not believe the constitution stipulated between old and young. He said that
the traffic would be horrendous. It seems that there must be someone killed
or mutilated before there can be any action. There was also a petition
against this with about 260 signatures. Because of these points, he felt that
he could not vote in favor of the rezoninq. _
Councilman Liebl �aid that he would like to see the elderly people stay in
their single family homes, but they find that they cannot pay the taxes.
'. Councilman Sheridan said that he has had conversations with people from all
� three wards and the feeling seemed to be fairly evenly split. Some were
/1 f against the proposal and some felt that they could live with it. Some of the
, people indicated�that they had a great deal of faith in Mr. Wall, and felt that
he made a fine presentation, and that they could trust him to keep his word. �
He said that he would also have to consider the petition as Councilman
Breider indicated, and that this would weigh heavily upon his vote this

Councilman Harris told Mr. Wall that he would have to say that the plan
presented is too high in density for this area. He said that he checked
with a number of builders and they have all indicated that they feel that
this would be too dense for the area. Mr. Wall said that there are some
of the nicest apartment houses in the Metropolitan area in Edina and they
have a density of �/3 more than Fridley. He fel:: that they have developed
a plan for the maximum density allowed under the ordinance. He said�that
they have also allowed for the deep setbacks.

Councilman Breider said that he was very pleased with the way the plan was
presented. He said that he hoped that his future plans will be as well
thought out. Councilman Liebl said that the Council has an obligation to
conduct business to the best of their ability. In his opinion the City has
abused this land, and he said that he has tried to look out�for the citizens
of Fridley.

Mayor Kirkham said that with the Council's permission he would like to waive
j the reading of the Public Hearing Notice as it is very lengthy, and pointed out
! to the audience the general location of the request, as the City Engineer showed

i it on the screen. In attendance, representing the Wa11 Corporation were Mr.
Walter L. Whiting, Mr. Lee Coffman, Mr. Richard Schwartz and Mr. Fred Wall.
Mr. Norman Riedel said that he would like to turn the presentation of the
� proposed project over to the Wall Corporation. The proposal is for an apart-
�/� ment complex which was determined to be the highest and best use of the land.

Mr. Lee Coffman said that he would like to go through some points of importance
briefly. He said that the Wall Corporation had a meeting with the residents
of the surrounding area and there was some discussion with them on the survey
the Council made available to them concerning the tax advantage of multiple
units verses one and two family units. He pointed out the fact that 1.78
students come from single family homes while .25 students come from a multiple
dwelling unit. He said that they were asked the problems there would be if
developed to single family residences. He showed a plot plan with the area
developed to single family residences, making a total of 53 lots in the 2
block area with 6th Street extended through. There would still be the problem
of whether to put in the storm sewer. The storm sewer would cost approximately
$236,000 to install. In tezzns of development expense, development would
amount to about $7,000 per lot, this includes the extension of 5th Street,
the putting through of 6th Street, and installing utilities on these streets,
which would make the cost of lots on these str•eets be about $8,900 with special
assessments. About 20� of the cost of building a home in this area would be
land cost. The homes would be in the range of $35,000 to $40,000 homes. This
would not include the special assessment for the installation of the stoz�
sewer, but rather the use of the ponding area. If the ponding area was used
there would be 41 lots available for development, which would make 77 students
and a tax disadvantage to the school district. He said that they are proposing
that the highest and best use of the land would be multiple dwellings.

He said that their development would be 240 units with four buildings having
60 units each. The develo,pment cost expenditure by them would then be spread
� over the entire parcel. Figuring a total expenditure oP 3.6 million would fiqure
out to be about $15,000 per unit. If the storm sewer were put in and 53 homes
built, the tax disadvantage to the school district would be even greater. He
said that they wrote to some of the local employers and got some interesting
information. He said that in 1969, of those questioned there were 1385
employees, in 2 years it is estimated at 2107, and in 5 years 3313. This shows
a 240$ increase in employees. He said that they asked the median income per
employee and were told $7,000. He asked of the audience who then could afford
a $35,000 to $40,000 home.
Mr. Richard Schwaxtz, architect, elaborated on the site plan and showed a model
of the proposed development. He said that they would be 2�i stories high with a
total of 72 two bedroan units and 168 one bedroon units. The proposed setbacks
vary from 120' from 7th Street to 175' on the south side. At the south side
there would be some excavation for the ponding area. There would be swimming
pools, balconies for every unit, a recreational area and a playground. The
parking lot would all be blacktopped to prevent dust. He pointed out that the
parking design provides protection for the�children. Access is fran Mississippi
Street and 5th Street, there is none on ?th Street or on the south side. There
would be no garages. The setback from Mississippi Street is 177' and the normal
depth of a residential lot is 125', so it is deeper than a normal lot.
Mr. Lief �ienricksen, 495 Mississippi Street N.E., asked if there was any
guarantee that there would not be guture access from 7th Street. Mr. Schwartz
said that the traffic pattern is such that it would be highly unlikely. Mr.
� Henricksen said that there is too much traffic an Mississippi Street already.
The City Engineer said that access is on the Sth Street side and the Council
could request an agreement with the developer that there would never be any
access on the 7th Street side.Mr. Henricksen said that he has a two foot
retaining wall, but the cars still come up into his yard.
Mr. Fred Wall said that there was a suggestion that the area be used as a park.
He pointed out that this would cost several hundred tYiousand doI.lars. He said
that he realized that putting apartments into a residential neighborhood is a
touchX business, but that he did not go around looking for trouble. He said that
they looked at this particular piece of property and detennined through studies
that the best use would be apartments. They then asked their architect to
design a good looking, unobtrusive building that would fit into the neighbor-
hood. This, he felt, has been done. He said that they,were aware of the storm
sewer problem and took this into consideration. He said that they could have
put in a row of double bungalows around the apartment houses, but they felt
that this would detract from the development and that an open green area with
trees and shrubs woulc� be more advantageous. He said that they could afford the
increased maintenance on the grounds. They felt that it would be extremely
unlikely that this area would be developed as R-1. He said that they would be
open to any suggestions by the Council or the audience.
Councilman Liebl said that he felt that the retaining pond would not be an
adequate solution. He asked if it would be feasible to develop a well planned
� commercial development there with no access from 7th Street. Mr. Wall said yes,
if this is not developed along the lines they are proposing, it is possible
that before long there will be another proposal for comanercial. The next pro-
posal may be for a shopping center. He said that they did not feei that it would

be feasible right now, but agreed that it may not be far away. He said that he
^ was very surprised that some of the residents were in favor of a commercial
development rahter than the apartment houses. This would generate even more
traffic. Councilman Liebl asked what their basic investment per acre would be.
This is very high value land. Mr. Wall said that 3.5 to 4 million is a somewhat
conservative fugure, but to develop approximately 14 acres would be about
$300,000 per acre. He said that they were flexible in regard to the ponding
area, and that they recognize that the storm sewer may have to be installed.
He felt that perhaps the storm sewer should be put in right away. The sugqestion
of the retaining basin was an attempt to somewhat appease the residents that
do not want any further assessments. The Wall Corporation would be happy to
have the storm sewer right now. Councilman Liebl asked if they would be willinq
to put up the major cost oP the storm sewer. Mr. Wall said that the water does
not come from the 14 acres, but rather from the total district and is retained
in the Riedel property. He said that they would be willing to take more than
their share, but they could not absorb all the cost as they operate on so many
dollars per land area cost and this would make the proposal impractical.
� Councilman Breider asked about the possibility of developsnent into general
office buildings. Mr. Wall said that they are involved in the developnent of
office buildings and they did not feel thaf this is a good area for office
buildings. The total area could be divided up and put to different coimaercial
uses, but it is too big for one general office area. He said that they had
already looked i.nto this. Councilman Breider asked what would be the estimated
cost of the development of the ponding area. Mr. Schwartz said that the total
gradinq would be about $30,000, with $10,000 extra for the ponding area. Mr.
Wall added that it would be deepened and a liner put in. Even thouqh this is
^ done, it may prove to be a temporary solution. He said that at this point it
looks like it might work and worth taking the chanae. Councila►an Breider asked
if the storm sewer were put in, if they would be willing to pick up their share
plus the cost of putting in the pond and Mr. Wall answered yes.
Mr. Robert McPherson, 500 Bennett Drive N.E., said that they have b.een told
several times that tY�ere would be approximately .25 children per unit, but he
was sure that when that survey was taken was several years ago and the same
would not be true today, with the tight money situation. He felt that the
population of children in apartments has grown considerably, and now the figures
have changed. He pointed out, going back to the traffic problem, that it is
�sometimes very difficult to get onto University. Avenue fran Mississippi Street.
The people would take one look and go back down 7th Street, increasing the
traffic on that street. He felt that 7th Street would beoome an overloaded
street. He pointed out that there are three schools in that neighborhood.
Mr. George Meissner, 373 Mississippi Street 2T:E., said that a number of these
azguments were discussed in the Planning Commission Minutes. He said that he
would like to point out that the traffic would be much worse, there is a problem
now. The traffic is sometimes backed up past his driveway at rush hours. The
traffi�c would be divided up between 5th Street and 7th Street all trying to get
onto Mississippi Street. There are about 350 parking spaces provided in the
complex, so that would mean approximately that number of cars. The cars would
be leaving the complex and coming back at about the same time during the day
� as they leave for work and come back home again. He pointed out that also there
would be more law enforcement necessary due to the gzeater concentration of
people. As to the storm sewer problem, this has never been popular with the
people. This was discussed about a year ago. He felt that the number of school

children was grossly understated. He said that Mr. Habel and Mr. Thayer were
at the Planning Commission meetings and they made a statement concerning the
^ number of school children, especialiy regarding the Stevensan School. They
are getting more than .25 per unit at that school. There are two and three ,
children coming from a one bedroom unit. He said that figures and statistics
can always be found to.justify a case. He said that in regard �o taxes, yes,
that would be a large tax base, but there is more at stake than taxes. These
people moved here thinking that this was a residential neighborhood, and that they
would not have the problems generated by an apartment house. The Council must
consider the feelings of the people in that regard. He said that scme of the
residents have taken the time to circulate a petition an8 there ar� Mow about
263 siqnatures. He said that he thought that he could get double the amount of
siqnatures if a larger area was taken in. He then came forward and presented the
petition.

PETITION #2-1970 - IN OPPOSITION TO REZONING OF THE RIEDEL PROPERTY FROM
R-1 TO R-3:
MOTION by Councilman Harris to receive Petition #2-1970. The motion was seconded
and upon a voice vote, all voting aye, Mayor Kirkham declared the motion carried.
Mr. Meissner continued that the petition covers loosely.the area north of
Mississippi and from University to behind the school and Mr. McPherson circulated
the petition covering the two block area south of Mississippi. M�ny of the people
were not aware of the Public Hearing and expressed displeasure that they had
not been notified. There is a large interest in this area and it goes beyond
just those fronting on the property. There was no one in favor of the•rezoning
and no one refused to sign the petition. He said that as an alternate to this
proposal he would suggest the possibility of a park development. He said that he
did carry along another petition for a park and that will be turned into the
Parks and Recreation Commission. A large number of people signed this petition
also. The gark envisioned is not the same.to all people and would have to be
worked out. Most had in mind some sort of a City park.
Mr. Ken McLellan, 67�9 Kennaston Drive N.E. asked about the maintenance of the
building. Mr. Wall said that with an expenditure of about 4 million, it would
behoove them to take good care of it. There is a large setback and a great
amount of greens to be attended to. He said that they would have gardeners for
this. The income from the apartment complex will provide for the caretakers. rir.
McLellan asked if the pond would be fenced. Mr. Wail said that this had not been
considered, but he would prefer not to. Mr. McLellan said that he felt that this
should be a requirement. It does not take much water for a small child to drown.
Mr. Wall said that he would agree, but he did not feel that a fence would be
aesthetically pleasing. He said that he would aqree to what the Council determines
in this regard.
Mr. Lief Henricksen said that they have stated that they cannot build $45,000
homes in this area, yet there are other $45,000 homes in the City nf Fridley. He
said that he lives on the corner of 7th Street and Mississippi and there was a
request to put in a double bungalow near there, but it was turned down. This
property is zoned residential and he felt that they could get a lot of nice homes
in there. Mr. Wall felt that you could not take land near commercial, City Hall,
and a county road and put,in $45,000 homes. He asked Mr. Henricksen if he would
prefer double bungalows in there and Mr. Henricksen said no. Mr. Henricksen asked
if Mr. Wall would guarantee that there would never be any garages in there. Mr.

Wal� s�aid that he could only say that they are not planning on building any. Mr.
^ Arvil Miller, 525 Bennett Drive N.E., said that they have been talking about •
- maintenance, yet they might not own it in 7 years or so. Mr. Wall said that
their corporation is planned over a long range and they plan on keeping this com-
plex, but no one could predict the future, and if they should sell it, the new -
owners would still have a 4 million dollar invest�aent to protect. He felt that it
would be taken care of and pointed out that they conld afford caretakers and
qardeners. He did not feel that with this amourit of inpestment, it could becane
a tenament area. He agreed that it is difficult to predict the future, but
pointed out that single family homes can also become a slum area. When an area
qoes downhill, apartment houses are always the last to go, because of the revenue
caming fro� them. .
Mrs. Nora►an Riedel asked What the rent would be. Mr. Wall said that for a one
bedroon. it would be about $170 and for a two bedroom between $190 and $200.
These aparta►ents could be considered semi-delux. He added that they were not
designed for children.
A member of the audience said that he hoped that Mr. Wall did not consider it a
valid argument that the Council has to provide living space for people warking in
Fridley. He questioned the $7,000 quoted`as income. Mr. Wall explained that
this was per capita income. The member of the audience said that there would be
about 150 cars at each exit trying to get into the stream of traffic, which is
bad now.
Mrs. Riedel asked when 5th Street would be finish�d between 63rd and 64th.
Mayar Kirkham said that there has been no request for this. Mrs. Riedel asked
�� if the City did not buy the property. The City Engineer said that there.is
still � of the right of way needed from the Riedel property. Mrs. Riedel pointed
out that when the pipe was put in to make her property a retainage basin the
people were not.concerned about their children drowning then, only now that they
feel that they have something to lose. She said that they were not even asked
if the City could do it. She said that the residents have not worried about
the pond for the last fiva years, now suddenly they are. This was done withaut
� their permission.
Mr. William Hutchings, 6270 6th Street N.E., said that they moved in about 4�S
years ago before the City put the drainage into the Riedel property. There used
to be ducks nesting in this area, but for the last few years it has dried up.
A member of the audience said that there are storm sewers in Bennett Drive now
and since the curbs and gutters with the catch basins have been put in, this takes
care of much of the water. That storm sewer has been there 14 years.
Mr. Dean Habel, 392 66th Avenue N.E., said that there would have to be something
other than a retaining pond put in. The retaining pond is a temporary solution to
apgease the people, but it would still have to be done right someti.me. He said
that this is a concern of his as he would eventually be in the assessment area.
He said that he felt that the City did too much short range planning. He asked
if the same area would be in the assessment area as was presented previously.
The City Engineer showed the plan given to people 2 years ago. He commented that
storm sewers are very unpopular with the people, however, they never had a
^ drainage district where there was so much opposition as in this area. This would
be the right and the best solution, but whether the property owners are willing
to pay for it is another question. Mr. Habel asked if the assessment would be over
the same area and the City Engineer sai,d �ha� he assumed that the Councii would

follow the same policy. Mr. George Meissner asked how much that project would �`.
^ be. The City Engineer said that it was $236,000 at that time, and it would pro- �
bably be about $300,000 now. Mr. Meissner said that no one has a problem except
the Riedel property. �Mayor Kirkham said that this was not strictly�true,
everyone contributes to the problem within the district. The State Statutes '
state that water that falls within a district is part of that district and must
be assessed. Mr. Meissner said that the City should be able to condemn the land
and build a fence around it. There �uld be a lot of public support for a park.
Cvuncilman Liebl said that he could not say that the City should put a ience
around the Riedel property and call it a catch basin. The City of Fridley has
used this property. A man has the right to try to develop his property. He
asked Mr. Meissner how he would like it if he were treated this way. This
Council has a responsibility for levying taxes for the next three years. The
decision has to be made while looking toward both tax relief and environmental
standards. He�said that here is someone willing to pick up more than their
share of the storm sewer assessment. The Council has been irresponsible in the
past years in pushing this problem onto someone else. It must be recognized
that this groperty will at some time be de�eloped. He said that he realized
that he is also obligated to protect the adjacent property owners, but the
City cannot have a sump in the heart of the City; Fridlep is not a village
anymore.
Mr. Miller asked if this was the first time the Riedels had a chance to sell.
Mr. Riedel said that his father bouqht this property about 70 years ago. He
said that his mother always wanted what was the best for Fridley and they have
tried to honor this wish. It is felt that single family homes canriot be built as
� it would be too expensive. He said that they are now being pressured to pay an
inheritance tax and they can no longer carry the financial burden. Mra. Riedel
added that the City had an option on the land for a new City Hall at the time
St. Williams Church wanted to bup the property and her�mother honored the City's
option. She said that the Government is taking what land it can get in the
suburbs to put in low income housing and she asked the residents if they would
like that next to them. The Federal Government has told her that they will take
any parcel of land, and that either they develop the land or the Government
will. She warned them that they would be in your county and you would then be
paying their welfare. Councilman Liebl asked if they would go along with
letting the Government come in. Mrs. Riedel said that they have not been able
to get anyone else to buy it. She said that they have gone as far as they can
go, taxes are not cheap, and they can bear the financial burden no longer.
Councilman Liebl said that this is the heart of the community and he would like
to get something in there that would fit into the environment. He said that he
recognized that there was R-1 on the east side of the parcel, but how could they
afford to let a 4 million dollar investment run down? Mrs. Riedel said that this
fa the only company that has come forward wanting to develop the land. There
has been no one i'or commercial. Councilman Liebl asked if there have been any
requests to buy the land for single family homes and Mrs. Riedel said no.
Mr. Lief Henricksen said that he came from Norway 10 years ago and in the
Scandinavian countries there are City parks in the middle of the City with ducks
and swans etc. He felt that this would be very nice for Fridley. He said that
^ he still felt that single family residences cou2d be built in there.
Councilman Harris said that this is the first time he has seen this presentation
and he must compliment the Wall Corporation on the plans and presentation. He
said as to the legal notices sent out, the City follows the State Statutes in
regard to sending them out. The notices are also published in th� legal news-

paper. There has been no effort to try to keep people away from the Public
Hearing Meetinq. Under certain circumstances it appears that the property cannot
be developed as residential. The storm sewer assessment would then be placed
against a much lesser number of people. It appears this is not feasible. Iie
said that as to the traffic problem he also questioned whether this would be
an adequate solution. As to the suggestion of a park, there was a park bond
issue which was turned down by the voters. This Iost chance for getting park
land was a disappointment. The City cannot take general revenue money for a
park, there would hane to be another park bond issue.� He Peit-that the City
must take a positive approach and that when considering the Riedal property,
all the other surroumling property should also be part and parcel ot the over-
all plan. This �rould include the propertp behind the.Bank and along Mississippi
Street to University Avenue. He said that he hoped that this idea �rould meet
with the Council's approval and consider the much larger area in an overall
plan. He asked if the people would be willing to go along with the instali-
ation of the storm sewer and pay their fair share. He pointed.out that here
is a developer willing to pay more than his fair share. Mr. Habel said that he
c�Zd speak for a few of the people that were not here tonight. He said that
he knows of some retired couples that pay a lot of specia]. assessments within

Councilman Liebl asked if the people would be more willing to support a project
with commercial going in there. A member of the audience said that this wauld
depend on how much it would cost for the storm sewer. Councilman Harris said
that you could figure roughly $3.50 to $4.00 per hundred square feet. Mayor
Kirkham added that the figures are not available at this meeting, and would have
to be redone. Mr. Habel asked if everyone would be assessed equally within
the drainage district. The City Engineer said that there was a credit due
sane of the people.

Mr. Doyle said first he would like to thank the Council foT the oppoxtunity of

;was picked because of the size, location, and the large amount of shrubbery
and trees already on the lot. There is an existing building on the lot,
. ' and presented a sketch of what the building looks like. He then presented "
a sketch of what they would like to do with the building, in making it appear
more modernistic and with a chalet flavor. He said he was associated with
��Leigh Investments, Inc. and they would divide up the interior into offices
� to give it a feeling of spaciousness. They plan on adding a dormer across
the front and adding a lot of windqws. He said they figures they would need
l0 parking stalls and showed a plot pIan on the easel. There is 135 feet
frontage on East River Road and 245 feet frontage on 63rd Way. The existing
building is located in approximately the center of the lot. T'here would be
about 80 feet between the building and East River Road and also between the
� building and 63rd Way. The parking lot would be between the building and
East River Road. The access would be from 63rd Way, then out to East Rivex
Road. He said they feel that traffic will not be a great problem due to the
fact that there are lights both north and south on East River Road just a
few blocks away. He said they are willing to meet the Code in regaxd to the
parking and will have the proper setback. '
' Mayor Liebl asked how many parking lots he was speaking of. Mr. Doyle said
' they anticipate one lot with 10 stalls, however, there would be access to the
`'� ; rear where there vrould be more than adequate parking. This lot is sheltered
from the neighborhood on the east and north by quite a few trees, there are
� aiso many trees on the west side. Mayor Liebl asked if he knew of any
. opposition from the people on the west or north side. Mr. Doyle said on
/1? the north, the property is zoned for duplexes. He said he had not talked to
; - the owner, but he has talked to some of the residents. On the west side
� �� across East River Road and to the south there is a duplex. He said he had
, �� not talked to the people directly across the street. He said he felt it
� would be an improvement ta the area, because the building as it exists now
� would receive a face lifting.
� Councilman Breider asked what was the zoning. Mr." Doyle answered R-1. Council-
mari Breider wondered what zoning he would ask for. The City Engineer said
., there were two types of zoning available. He could fit under the C-2 zoning,
� �. ar if the building is only to be used for offices, he could request a CR-1
��zoning, which is more restrictive. If the plan is to use the building only
for offices, he would suggest that Mr. Doyle request the CR-1 as he could rece�vQ
�ess opposition from the neigh��rs if t.���,� ,vc�; a.ss�:a�:�d that it would ba only
office use and that at some future time somthing else, such as a grocexy stoxy
or a gas station, could not go in.
Councilman Breider explained to Mr. Doyle, that under the State law hearings must
� be held �or any change in zoning classification. He said the procedure was ta
make an application in the �ngineering Depart�rent, notices of the hQaring are
� sent out to people within 300', the hearing is held before the Planning Cam-
'� mission, and a xecommendation is made to the Council. Then notices aTe aqain
sent out for the hearing before the Council. After the hearing is held, i� th�
. Cauncil approves the request, �n ordinance for the zoning change must h�ve two
' � readin�s and be published. . �

� 'Council have any desire to consider rezoning a larger piece of property at this
; location? There was at one time some talk of changing the zoning to commercial -
: in this area, and suggested that the Planning Commission could look into this.
� : Councilman Breider said that tahen the question �tas put to the people in the
' , neighborhood, they did not express any particular desi�e to rezone to c,ommercial.
' : He said ne assumed it would be acceptable when they come before the Planning
; � Commission after the notification, they could give their views on rezoning
;� their property. Councilman Mittelstadt said that he felt this should encompass
° � moxe than just the 300' and should cover the area from 61st Way to Mississippi
� �� � ��;'' Street,� and all�those peop�le should be notified. Mayor Liebl said that the
' �' City Engineer will have to proceed as the Charter provides, which is 300 feet.
� ,; He added there is a fee for this request to cover publication costs etc.

, Mr. Doyle said that he has a list of the people within the 300' radius; ar#d
` � that he could get the names of.all those from 61st Way to I�Iississippi. He said

' , he was willing to go one step further and personally contact each person within
� the 300'.radius and ask them to sign a petition on what they would like to hav�
3 done. Counc�Iman Breider said that the Czt�� A�ni:�is�ration goes through the
� procedure oi getting all the names for the hearing notification$, so he could �et
� the list from City Hall.

� Mayor Liebl asked how lang the procedure would take until it is com�leted. Ths
� City Engineer said, considering the meetings and the requirements fox all the
^ � publications, aucut 3 months. Mr. Doyle commented that. if this property evex
did go back to residential, the building still would not be obnoxious ta the

j� The City Engineer said that he did not have a clear understanding of what th+�
" Council wishes were in regard to the notification. Did they want only thoss
� within the 300' or the entire area notified. Councilman Mittelstadt said on�y
� within the 300! for this particular property, but if the Planning Commission
"� would want to consider this totally from 61st to Mississippi on a broad bas�t�,
.`��' then all the residents in this section would have to be notified. He sa�d he
;'would recommend going aiiead with this particular piece of property, then let tho
� Planning Commission consider the overall zoning concept for the area. The Ci.ty
;:t: Engineer said that the Planning Commission is working on a comprehensi.ye pl�ri`
� for the City, they could consider this in relation to the overall plan.
\� Mx C H Benjamin, 5708 Jefferson Street: Request for "No Parking" Signs;
Mr. Benjamin said that he has a 24' street both on the east and south of hi.m.
There is a difficult problem in this area with cars parked on bpth sides of the
street, especially in the winter with the snow banks narrowing the street even
more. He said he would like to request "No Parking" signs for.both sides of
th� street from Lakeside (57�) to 58th Avenue and on Lakeside fxom .I�ffexsan
to 7th Street.
He said he would also like to request another stxeet light. Wher3 the theat�'�
^ opens, this area is used as a Iover's lane, and disturbs peopls at night.
Thexe is one on Jefferson and Lakeside now, and he would like one further north.
Mayor Liebl said that there should not be a problem i.n puttin� in the "No PaxkiA��'
signs, this would appear a difficult situation and would ba a�xeasonable reque��.
