Mr. Determan said the first thing they will do is install a 6' chain link _
fence around the property. They have two dogs for security reasons as
they have had many burglaries.of tools and equipment from the trucks
parked on the outside of the building. This fence will be slatted on

Mr. Herlofsky asked about the drainage problem of the property adjacent
to them. Mr. Determan said they didn't want the pipe going across their
property. They want it at the property line.
^ � Mr. Zeglen asked what species of trees they will have in the landscaped
area. Mr. Determan said they have black spruce trees already planted.
The sodded area will be maintained. Mr. Determan said they have some
crushed rock covering tanks that are located in this front area, but the

taaks are too small so they will be installing larger tanks in some
other location on the property and this crushed rock will be replaced
with grass.
Mr. Tonco inquired how they will protect the fence in the parking area.
Mr. Determan said they will use spiked pre-cast curbing. Mr, Tonco
asked if some type of railing could be installed for more protection.
Mr. Determan said they will install this railing in the.concrete along
with:the fence posts.
Mr. Tonco wondered if they might have some dust problems in the area
that was neither paved or blacktopped. Mr. Determan said they could
haul in some class V aggregate if they had a problem. Mr. Tonco said
theq should use an oil spray on the aggregate if they had dust problems.
Mr. Zeglen said he thought they needed more security lighting. Mr,
Determan said they had two lights they could install.
Mr. Determan said the addition will match the existing building. Mr.
Tonco asked if the concrete blocks will be painted and Mr. Determan
said they would be painted the same as on the existing building.
MOTION by Tonco to recommend to the City Council approval of the request
to construct an addition with the following stipulations:
1. Maintain the landscaped area.
2. Install a railing to protect the fence in the parking area.

Mr. William Stewart was present to present the request.
Mr. Stewart brought in a new set of plans for the model home. He said
they were basically the same as the original plans except the garage
� would be on the freeway side and the square footage was increased to
meet the building code of Fridley and other subuxbs.
This will be a conventionally built home that is complete in every
detail except they do not plan to hook-up to sewer and water at the
present time.
This is a new venture. They are going into the housing area to increase
business. They plan to sell this house complete, with th� buyer having

the option of installing his own cabinets, carpets, molding, paneling
and appliances which they plan to provide. The entire cost to the
buyer will be approximately $27,000 including a$3,000 lot and all
accessories. The buyer will have the option of buying with or without
a garage depending upon the community requirements. There will be two
garage $tyles.
MOTION by Tonco to recommend to the City Council approval of the site
for the modeZ home and the Board was pleased vith the'�ype of coastruction
of the model home but made the stipulation that the construction meet
a11 the Fridley Building Codes.

Mr. Zeglen asked about the alley vacation that was pending when Phase I
was approved. Mr. Zeis said the alley had been reinstated.
The building for Phase II will be 58 feet by 200 feet and the Phase III
building will be identical to Phase I, 70 feet by 150 feet. Mr. Zeglen
noted that the length of the three buildings combined will be 500 feet.
He asked Mr. Zeis how much security lighting was planned. Mr. Zeis said
there will be lights on every door in the front of the building. Mr.
� Zeglen asked for more security lighting. He marked 14 more locations
for security lights on the plan. Six additional on the front, six additional
on the rear, and one on eaeh side of the building. .
Mr. Tonco mentioned the•wa�kway along the back of the property to protect
the building from cars parked in the parking area, but there isn't any
type of barrier to protect the building on the north and south ends of
the,building. Mr. Tonco said there should be a curb or barrier of some
type. Mr. Zeis asked if he could extend the walkway on these north and
south ends, and this was satisfactory.
Mr. Tonco asked if the exterior of all the buildings wi�l be the same.
Mr. Zeis said they will all have brick veneer trim around the entrances
and the remainder of the buildings will be painted scored block. He
intends to paint the pilasters a different color.
Mr. Zeglen said one of the stipulations for Phase I had been the inside
storage of trash. This would hold for all phases.
, Mr. Tonco asked Mr. Zeis when he thought this project would be completed.
Mr. Zeis said he thought around the end of December. Mr. Tonco said the
landscaping couldn't be completed then. Mr. Zeis said the project is almost
up to grade now so it might be possible the landscaping could be started
earlier.

The Board asked about the change in drainage if the garage was built.
Mr. Kellner said he Would have to haul out some dirt but the garaga would
not change the drainage that much. It would be draining more toward the.sCreet
then before becauae of the driveway.
Mr. Minish asked if the setbacka on the othar houses in the area are unifo�m.
Mr. Kellner said most of the houee8 are older and the eetbacks a�e not unito�;tq
at all. There are 2 newer houses, one acro8e street, that have unifora� aetbacka.

Mrs. Walhberg asked how he would feel about moving it back 5 feet to com�romis�

Mr. Kellner eaid if he m�ved it back any larther he wouldn't be able to get a
swing set back of the garage. He said he wouldn't want to put the swing eet

afternoon business, a barber shop and beauty salon that will hatve daytime busiciess,
a dry cleaning atore that has daytime businesa and a small�utcher shop that a�so
will have daytime business.
Mr. Minish asked if all these tenants were signed up for the building.
Mr. Ernst said that they were in the "letter of intent" stage but k�e hoped Ch�y
wpuld all have signed a lease within the next two weeks.
Mr. Minish said he didn't like the idea of not having the ex�ected �en�t��s pi��ed
down. �f the variance was approved before the tenants had a lease, ��e tena���s
could ch8nge which might mean unexpected traffic.

Mrs. Shelly Garber was present to introduce what she referred to as the Fridley Creative
Cultural Growth Program. Mrs. Garber explained that she is an artist with a degree in
Art Education from the University of Minnesota. She briefly explained her qualifications
and expexience, along with that of the two women who would be assisting her with this
p�og�am. She said that the purpose was to provide a free, planned, creative play program
directly available within each neighborhood. The activity would be centered on a weekly
theme and geared to the individual as much as possible, eased into group projects when
they're ready. She would also be providing some volleyball, checkers, softball, chinese
checkers, etc., for variety.
!�, M�e �rown had pointed out to Mrs. Garber, in a meeting in his office, that we alxeady
have a playground program and that if she was to proceed with her program, she'd have
to begin in one area to see if there was enough interest to expand to more areas. After
some discussion, Mrs. Garber and Mr. Brown had agreed to begin at Hackman Park.
Mrs. Garber explained that this would be a six weeks program, beginning at 9:00 a.m. and
ending at 12:00 Noon. She has a sum of $300.00 from a Taste Test Program which can be
completely turned over to the program.
Mr. Brown said that the Parks and Recreation Department would be willing to provide
some picnic tables and other such items which we already have. .
Mrs. Garh�er stated that there would be no charge for the children, but that she would
like to have a health certificate stating that the City is not liable for injuries
sustained on the playgrounds. She said that she doesn't anticipate any problems, but
that it was a good idea to protect yourselves.

Mr. Mike 0'Bannon, Anoka County Commissioner, was present at the meeting to present a
check in the amount of $2,000.00, to be used for the development of John �ricksan Park
/� located on Spring i,ake. This is an annual gift which can be applied for, which the
County has made available for the development of public swimming beaches. Thi�s is the
second yeax that Fridley has received this donation.

Mr.'Blair suggested that Mr. Brown do some research on the cost o£ £encing thQ
football field at the Commons Park. Mr. Kirkham agreed that it would be good to
have a permanent structure to eliminate mini bikes and other such vehicles.
Mr, Blair requested copies of the Girl's Flag Football and Girl's Bxoomba�l Ruie��
These are being prepared by Chuck Kasick, the originator of the programs �n Fridley,
Mr. Kirkham suggested that with the installation of a fence, they'd be ab�e to c�ar�e
admission to the games. Mr. Nielsen explained that it would be a controlled cxowd,
but they would rather not charge admission.
FRIDLEY JAYCEE�S PROJECT�
Mr. Richard Janiak, a representative of the Fridley Jaycees, was present to disCUSs
their plans to develop a parcel of City property in the Rice Creek area.
Mr. Brown suggested that the Jaycees prepare a plan for development and possib�y
spread it over several years. Then, when it's ready, they should bring their ideas
back for Commission approval. They also suggested that the Jaycees work with N���,
Betty Ann Mech in respect to this. This area would become a part of the Rice C.reek
�lature Traii.

Expansion of the Girl's Broomball program for 1973 was discussed. It was pointed
out that there has been a tremendous increase in Girl's Athletics within the City
these past few seasons. It is generally agreed that there will be a larger
broomball program for girls next season and it should be considered in prepar�ng
the 1973 Budget.

MOTION b� Schmedeke, seconded by Zeglen, that the Planning Commission
^ recommend to Council approval to construct the Zapata Restaurant on Lots 9, 16
and I7, Block .Z3, Hyde Park Addition plus the vacated 59th Street subject to the
recommendations made by the Building Standards-Design Control Subcommittee and
that a row of evergreens be pZanted on the East side of the redwood fence. Upon
a voice vote, aII voting aye, the motion carried unanimously.

Chairman Erickson said the Planning Co�nission had recommended to Council
that they reduce the area requirement from 25,000 to 20,000 square feet and 200
front footage to 160 front footage. This request meets the 160 feet and the
minimum 20,000 square foot requirement. The Ordinance has not passed at this
point. The petitioner has asked permission to build a restaurant on the property.
We are merely requesting Council to grant this request.
� 2. PUBLIC HEARING: REZONING REQUEST: ZOA ��72-03, THE WALL CORP. BY DENN
MADDEN (RIEDEL ESTATE): To rezone from R-1 to R-3 for Townhouses and
Apartments.
MOTION by 5chmedeke, seconded by Fitzpatrick, that the PZanning Commission
waive the reading of the Public Hearing Notice for the Rezoning Request, ZOA
#72-03, The Wa11 Corporation by Dennis Madden (Riedel Estate) to rezone from
R-1 to R-3 for Townhouses and Apartments. Upon a voice vote, a11 voting aye,
the motion carried unanimousZy.
Mr. Neil Weber, Architect for the Wall Corp., said the last proposal was for
four large apartment buildings which was denied. They have a new breakdown with
the 63 townhouse units and 105 apartments which gives a total of 168 dwelling
units. They plan to put a three story and two story apartment structures on the
Western edge of the site. Along the North and East sides they have put their
townhouses. The parking lot is in the low area so that it is not visible from
residential areas. You step down to a different level landscape.. One.of the
big �equirements is'the..ponding area. They have been told by the City that they
need 12 acre feet of ponding area to take care of the run off. Thers are two
story townhouses, but not appreciably larger than the residences across the
street. The three story apartment building is the furthest away from the
existing residences. They have tried to show a lot ot green space and between
the units there is green space. The materials for the apartments would probably
be rough sawn cedar. The apartments are one or two bedrooms, 55 one bedroom
and 50 two bedroom apartments. There are two and three bedroom townhouse units
with 1,150 square feet for the two bedroom and 1,250 square feet for the three
bedroom. The townhouses each have a garage. The zoning requirements for parking
are l� parking stalls per unit and an addition of one:half stall for each addi-
tional bedroom over one per unit. There are 183 parking spaces for apartments
and for townhouses 78 on site open parking and 63 garages.

Mr. Weber said the setback would be 35 feet and berms are to be proposed.
Mr. Wall said he hoped this new plan would be the answer for the use of
this land. He felt they had come a long way from the other plan by having two
story apartment buildings and the townhouses. This plan eliminates the need for
^ an additional storm sewer charge. They were open for further suggestions. The
density is a good 20% less than the previous plan. It dropped from 18 to 12 units
per acre.

A. F. Miller, 525 Bennett Drive: He said they paid for a storm sewer and
�„� drainage and he couldn't see that ponding as a solution to this storm sewer.
The neighbors have all paid their storm sewer assessments. The City made a
deal whereby they run all the water out of the Commons Park into this ground.
He did not feel this should be allowed or that it would be fair for them to
have the drainage pond as it would be stagnant water and would get gretty
deeg during a flash flood. There is a storm sewer in the area which runs up
hill instead of downhill, but does not include the ponding area. The petitioner
should have to put in a storm sewer.
James H. Langenfeld, 79 63'� Way: He asked if it wasn't up to the organiza-
tion and Company to take care of their own drainage rather than the taxpayers
take the burden. He felt the petitioner should take care of their share of the
storm sewer charge. He was not too much against the project itself.
Mr. Wall said that it seems nobody wants a pond there. The water seems to
agpear through the ground. The Riedels also paid for the storm sewer. If a
storm sewer is put into the whole site, the assessments will be split to the
benefiting owners, but the Wall Corp. would be only paying their share.
Mr. Miller said that 15 or 16 years ago Fifth Street was included in the
assessment for that storm sewer. He felt the minutes would show that the Riedel
progerty was not assessed because the storm sewer did not go in there. Each
contractor that developed in this area had to furnish the storm sewer for the
house he built.
� Robert McPherson, 500 Bennett Drive: He wished to discuss the traffic
^ groblem. He said that cars will be going out on Mississippi Street, and wondered
if thi5 would create a big traffic problem. In the rush hours, he said they
cannot get on the street now. The tra£fic is getting so heavy on Mississippi
naw, he was sure they were going to have problems there. This is a school area
and the biggest race track in Fridley. We should attempt to alleviate every
bit of traffic we can from that street for the protection of our children. It
is a big problem. He referred to the setback of 35 feet saying "are we going
to have an asphalt jungle across the street from us"? Mr. Wall is absolutely
wrong to say we would like the property left the way it is. We would like to
have the property developed to something like the conditions were when we came
out here.'.
William A. Hitchings, 6270 6th St.: There are two blocks of residential
there. Seventh Street would be covered with townhouses, but we,..along 63rd
Avenue, West of 7th Street, would be looking into the three story apartment
buildings and they would look right down in his backyard. The traffic problem
is terrific and this will add to it. Anything else he could say about the
rezoning would be against it. He knew Mr. Wall had tried, but he still says
it is not the place for multiples.

The question was asked what the benefits were the project would bring to •
the City of Fridley.
Mr. Wall answered that the taxes that would be generated would be substantial.
He could assume the City of Fridley could use new residential houses. There
/� will be multiple family dwellings but still they are somebody's home. We think
the City needs new houses. 'I'liis type of design would probably produce few
children. Obviously, they are not going to ban children. He would assume there
are less children per acre that would use a school. Very few streets go into ,
that development so street cost and maintenance are less. West of the develop-

� ment is coamnercial. He wauld assume the people living in the townhouses and
apartments would be about the same kind of people that live in Fridley now.
The townhouses would be in the price b�acket of $2$,OOO to $40,000. The town-
� houses are for sale per unit just like a house. A one bedroom unit in the
apartments would rent for $160 and the two bedroom for $200. From a market stand-
point, they would not want to build anything that no one would want to buy or
renC.

Mrs. Joseph Tapsak, 510 Mississippi: She stated she objects to the whole
plan. The only way a child has to get to the Fridley Commons Park is by 7th
Street and because of the traffic there now, she wi.Il not let her child go by
himself to the park. This project would add to the danger.
Mr. Wall said that basically this is not reai expensive land. If the land
were given to him, he would not put single family residential on this property.
Nor are the single family homes being built today the same kind of housing as
are already:built. He admitted the traffic is a problem, but anything going in
there would generate traffic.
Leif Henricksen, 495 Mississippi: Before he came to Fridley he lived in an
apartment and the owner lived there, too. It was kept up nice, but now that the
apartment he occupied is rented,'.i�-looks like a dump. He would hate to see that
happen to a nice piece of ground. He still would like to see Riedel get his
money out of the property. Ae thought there could be 55 lots on this property
which could be sold for single family homes and the Riedels still get a good
"chunk of gold",
William L. Si�s, 6281 5th Street: He said he was against the rezoning
as it affects the whole community around it.
Virgil Mullins, 6331 7th Street: The last time this rezoning was brought
up, the City was asked to make.a study of it. Was it done?

Donald L. Larson, 6310 Jefferson: This project would practically double
the density of single family zoning. He objected.
Lloyd Bennethum, 369 66th Avenue: He asked the rate or percentage of
occupancy of apartments in Fridley at the present time. If these apartments are
built, presuming this rezoning goes through, are they going to have tenants?
Would this establish.an injurious precedent in Fridley? He was particularly
interested in the four lots on the corner of University Avenue and 66th Avenue.
�If a precedent was established now, how can we say "no" to others who want to
rezone?
George Meissner, 373 Mississippi: Regarding occupancy, the occupancy in
Minneapolis of apartments is less than 70% right naw. He would like to say the
Wall Corp. has made an attemgt to meet some of the objections we had the last
time. Traffic is still the same concern. It seems to be understated and
everyone on the Planning Commission knows it. He had asked about having a stop
light on 5th Street and Mississippi because he has seen several accidents there.

He was told it was not a feasible situation. He opposed the rezoning generally,
� particularly the apartments. The attempt to include apartments is repugnant.
If it were all townhouses, he was not sure that was the answer. He thought the
groblems with setbacks and landscape were minima.l, but ponding and sewer were
difficult. If Mr. Wa11 would like to make a statement that he would guarantee
there would be no storm sewer assessment later to the City, if he would take the
risk of that problem coming up at a later date, it would help.
Mr. Wall said it was his honest opinion, assuming this development would be
approved, thaC because of the neighbors, we have a ponding area, he would take
up his share of the assessments. If they put a pond in there, we have to take
care of it and it has to look good.
The people were afraid the pond would overf low during a heavy rain.
Mr. Meissner asked for a show of hands of the people interested in the
rezoning and then of those who were opposed to the rezoning. It appeared to be
unanimous.
James Liston, 6360 Washington St.: He asked who would maintain the townhouses.
Mr. Wall answered the Association. Then he asked about the depth of the pond.
Mr. Weber said only a small portion would be maintained continually. There will
be a gradual run off so that the pond will anly fill up during a storm.
Mr. Clark said there is an overflow pipe and will connect into the existing
line of 7th Street and Bennett Drive. Chairman Erickson said the pond is
intended to be a retention pond.

Mr. Liston said that every time there is a heavy rain, in front of his
garage they have a fountain six feet high out of the ground. There is a break
in the pipe and he picked up the tab for it.
Mrs. Robert McPherson said that when there is a real bad storm, water comes
down from Mississippi on 7th Street and also comes down Bennett Drive. The
water backs up and lifts up the manhole covers.
Mr. �lark said the City had had hearings on storm sewer systems. Somebody
has to come up with $250,000 to build a new one.
Mrs. McPherson asked why the Riedel property was not purchased for a park.
Mr. Fitzpatrick said it was because when the Park Department put up a bond issue,
only 1,000 voted and 600 were against the issue. This is the main reason the
City does not•have enough money for parks and the closeness of the existing
Commons Park.

Mr. McPherson suggested building housing for the elderly. It is an ideal
location, close to shopping and bus.
Mr. Wall said he thought it was a good idea and they would be willing to
include one or something different. When they look at a piece of ground, it is
as real estate developers. Fortunately they have been right more than wrong or
�„� they would not be here tonight. They felt this area was ideal for apartments
and townhouses. They felt this would improve the area.

Mr. Schmedeke asked if the Riedel property was assessed for the Mississippi
Street improvement? Mr. Clark said he thought it was assessed for curb and gutter
only being Mississippi Street is a State Aid road. 7th Street was assessed as
a normal street. Mr. Schmedeke asked him to see if the Riedel people paid their
share of the storm sewer and sanitary sewer. If properly assessed, they would
have every right to use roads•the same as you and I.
Mr..Meissner aske� for an explanation of the difference between R-3 and R-3A
zoning.
Chairman Erickson replied that R-3A would be strictly multiple units and
H 3 allows apartments and multiple dwellings. He then read from the Ordinance.
James A. Thayer, 377 66th Ave.: He asked if Mr. Wall ever had experience
with ponding -- how it will function under rain conditions? What would happen
if that pond were full up -- where would it flow? Basically, the overflow from
that pond would remain on that site was the answer.
Mr. McPherson wondered if there would be any pollution in connection with
the pond.
MOTION by Schmedeke, seconded by Minish, that the Planning Commission close
the Public Hearing of the Rezoning Request, 20A #72-03, b� the Wa11 Corporation
to-rezone from R-1 to R-3 for Townhouses and Apartments on �he Riedel property.
Upon a voice vote, aZ1 voting-aye, the motion carried unanimously.
Mr. Schmedeke said that he has lived in this area for some time. Ae knows
the Riedel property quite well. He has no connectian with the present developer.
Reviewing the history, the Riedel property was �ented ta a farmer who kept his
cattle on it. Children skated there in the winter. The plan presented this
evening by the Wall Corp. is the first one he has seen and he thought this was
a sensible plan.
Mr. Schmedeke continued that he'd like to read a short excerpt from the
Regular Cbuncil Meeting of May 18, 1970 on Page 6, about the center of the first
paragraph referring to a statement by Norman Riedel: "He said that he could not
find any zoning map for prior to 1956, but he understood that at one time the
Riedel property was zoned commercial". Mr. Schmedeke said this has caused a
hardship to other people, including himself, who knew they were also zoned com-
mercial before 1956 and suddenly their records were lost. If the records had
not been lost, you would have a commercial area today. The developer said he
was willing to contribute an extra amount towards the storm sewer. In his
opinion, a holding pond will solve the situation. A storm sewer had been put
''in. The City should check and see who has �aid for one. In all probability, the
- City may have made an error. In fact they have done it going down University.
This was his humble opinion.
Mr. Schmedeke said he was going to jump around a bit. When the Viewcon people
came in, we had a traffic problem and every time a new developer comes in, we
/�`! have a traffic problem. We cannot tell a developer he cannot own property. The
watershed district is another thing that confuses him or what streets they
entail. He did not see a storm sewer catch basin in either 5th or 6th Streets.

The water must have been running into the Riedel property. The rest of the water
� is running North into three culverts on 63rd Avenue. As far as thinking about
this property being a park, he did not feel this should be considered as a park
because the Fridley Commons Park is close. Children have gx'own up in his area
without a playground of any kind. As far as children falling into a pool, he
did not think Rice Creek was fenced. The small children should be watched care-
fully. Until all these questions are.answered, he can't give an answer. If a
home f or the elderly were put up, he did not know if they could be sure it would
be for the elderly, but low income.

business) for Real Estate Office.
MOTION by Fitzpatrick, seconded by Zeglen, that the Planning Commission
waive the reading of the PubZic Hearinq Notice for the Rezoning Request, ZOA
#72-04, Leigh Investment, Inc. bz� John R. Doyle, President. Upon a voice vote,
all voting aye, the motion carried unanimously.
Chairman Erickson, at the request of Mr. Doyle, read the zoning restrictions
on the CR-1 Ordinance.
Mr. Doyle explained his plans using drawings to illustrate the changes in
the home. He said this is a modest home. They would like to go into the house
and use this dwelling as a real estate office for the purpose of conducting a
business. The reason for asking a rezoning was due to the fact that at this
point and time, he did not intend to live in the house, but under CR-1 he could
do so. Ae intends to use the house for conducting of real estate business. He
intends to remodel the structure, give it more of an up-to-date appearance, look
well, blend well with the surrounding neighborhood, complement the houses in the
area. The house will have a chalet appearance, small foyer and front room
�together. They would not be adding more space to the house. They will extend
for a porch and entry on the front of the 'nuilding itself. As far as the way
it fits on the land itself, they were making very little change to the existing
property. The driveway to the garage will have a turn around. There are trees
to the side and fence with provisions for shrubs. Trees to the back and front.
The entrance to the parking lot will be onto 63rd Way, West of the house. It
� will not pass by anyone's driveway.

and would like the type of house he would be developing. In his opinion, if a
party comes in to do commercial business, he should be in a commercial area.

Mr. Zeglen asked if it weren't true that if a man lives in the house he
could have his own business in the house, Pven though it would be a traffic
hazard.
Mr. Minish said he was terribly concerned about the traffic situation.
The problem is severe and serious for a number of years. It has been under study.
Even though the Coumiission completed their plan and came up with a study, he
would be opposed to this request principally because of the fact that up to
ten or more cars being funneled out to the East River Road traffic problem.
Mr. Schmedeke said that this is spot zoning. He was sure even after the
study is completed, the Commission would not approve spot zoning. �
MOTION by Schmedeke, seconded by Minish, that the Planning Corrrmission
recommend to CounciZ denial of the Rezoning Request, ZOA #72-04, by Leigh
Investment, Inc., John R. Doyle, to rezone from R-1 to CR-.Z (general office
and limited business) Lots 12 through 17, and the West 5 feet of Lot 18, B1ock
Z6, FridZey Park for Rea1 Estate Office. Upon a voice vote, a11 voting aye,
the motion carried unanimously.
4. PUBLIC HEARING: REZONING REQUEST: ZOA 4�72-05, EINAR "TED" DORSTAD:

Mr. and Mrs. Einar porstad were present.
MOTION by Fitzpatrick, seconded by Schmedeke, that the P.Zanning Commission
waive the reading of the Public Hearing Notice for the Rezoning Request, ZOA
�72-05, by Einar "Ted" Dorstad to rezone from R-1 to R-3 (general multiple
family dwellinqs) for an apartment complex on Lot 39, Revised Auditor's Sub-
division #77 except Parcel #5640. Upon a voice vote, a11 voting aye, the motion
carried unanimously.
Mr. Dorstad said that when he came to Fridley on December 20, 1970, across
the street from this property was a filling station, A& W Rootbeer and Pizza
Kitchen. Lot 16 was not commercial. There were no new houses. There were
houses across from commercial. They were adivsed by five different people they
should not attempt to make it commercial property. However, it is not really
�R-1 property. If they had R-3, they would build alongside Mr. Greenwood's
property. They want buildings nice enough that they'd want to live next to.
He could understand objections such as different cases where multiple dwellings
were vacant later on. That is nofhing new to anyone. But you just can't count
on selling single dwellings across from all that commercial area. There has
been some thought or discussion putting a street through the middle of his land.
One plan was across the water easement which is the extension of 75th Way and
this was an alternate plan. Tf the street went through, the price of the land
would be cut considerably.

/1 Bert Ellis, 115 Talmadge Way: He stated he circulated a petition of all
of the people on Talmadge Way and 75th Way. He received signatures of 100% of
everybody involved. They do not want to live across the street from apartment
buildings or industrial the same as Ted. They felt apartment buildings in that
area would affect their property. If you start changing the rezoning in one
area spottedly, it should then be done on a city wide basis, with,.some. thought,,:.,._
of the people involved being landowners. It is a creeping paralysis. Even
if everything on the East side of East River Road were industrial, that is no .
R reason for it to increase.
- MOTION by Schmedeke, seconded by Fitzpatrick, that the PZanning Commission
receive the Petition submitted by Bert El1is objecting to the rezoning request,
ZOA #72-05, by Einax "Ted" Dorstad. Upon a voice vote, a1Z voting aye, the
motion carried unanimously.
Larry Chevalier, 48 Talmadge Way: He said that he lived across from this
land. He had never yet seen a request made for a rezoning without some sort of
plan, plat or building. If the request was granted, what is going up there.
He would like to go on record as opposing because of spot rezoning and he did
not want the area across the street to be a big apartment.
Janice Dean, 65 76th Way: Because of all the apartments and complexes on
East River Road, some of which are about to be rented, Mrs. Dean objected to
the additional traffic problem this rezoning would bring. Why take one little
block for more apartments when three sides are residential? We should think
� about that.

Anthony J. Hogan, 133 75th Way: He believed that many of the people are
very apprehensive as there is another three acres to the North undeveloped.
The rezoning will fall like dominoes when it gets going. He said he would not
build a home across from commercial. The people who live there now are stuck
there.
Harold J. Ploof, 91 75th Way: He stated he was opposed to the rezoning.
C. M. Kam, 120 Talmadge Way: He said he lived in the area approximately
17 years.' He was strongly against the proposal.
A. H. Lucast, 100 Talmadge Way: They would not want to build across from
commercial. There are several lots facing Talmadge. They objected very much.
Jim Bean, 150 Talmadge Way: He has lived there for 25 years. He couldn't
help being sympathetic with Mr. Dorstad, but this request would put the City
in the position of spot rezoning. They appreciate his planning this piece of
4property, but feel it could be divided into single family residences.
George J. Dean, 65 75th Way: He felt the traffic problem should be brought
up again. If the rezoning were approved, Mr. Dorstad would construct his
multiple dwellings and they would add another 100 to 150 cars using East River
Road. They are going to have to get on East River Road somehow or go out to
the South. There will be a lot more traffic than there is now. He would
� definitely have to go on record as being opposed to the rezoning. .

^ Roger Welch, 55 75th Way: Who makes the final decision? Chairman Erickson
, answered that the City Council does. Mr. Welch then.asked if 100% of the
residents are opposed, what leverage have they on the Council? Chairman Erickson
said Council will listen to the people. The present zoning is what you prefer --
the petitioner is the one who has to prove his case.

Upon a voice vote, a11 voting aye, the motion carried unanimously.
Mr. Minish said, that from the discussion, this parcel could be developed
in single family dwellings and still accommodate the part of the property
abutting East River Road. If the petitioner wanted to modify his request, he
would take a second look. It did not seem appropriate to rezone the whole
parcel to R-3.
Mr. Schmedeke said that he agreed. With so many people objecting, it is
hard to agree with the petitioner. He would like to see the owner develop his
land, but with so many people against the rezoning, he felt Mr. Dorstad should
come in with another plan.
Chairman Erickson addressed Mr. Dorstad saying that unless he wanted to
modify the request at this time, then he would have to wait for six months to
bring in any request. He was not threatening him with denial. He could think
it over until the Planning Conmmission meets on June 7th. M"r. Dorstad agreed
to that.
MOTION by Minish, seconded by Schmedeke, that the Planning Commissicn table
to June 7, 1972 the rezoning request, ZOA #72-05, by Einer "Ted" Dorstad, to
rezone from R-1 to R-3 (general multiple fami�y dwellings) Lot 39, Revised

� answered that the City Council does. Mr. Welch then.asked if 100� of the
residents are opposed, what leverage have they on the Council? Chairman Erickson
said Council will listen to the people. The present zoning is what you prefer --
the petitioner is the one who has to prove his case.

Mr. Minish said, that from the discussion, this parcel could be developed
in single family dwellings and still accommodate the part of the property
abutting East River Road. If the petitioner wanted to modify his request, he
would take a second look. It did not seem appropriate to rezone the whole
parcel to R-3.
Mr. Schmedeke said that he agreed. With so many people objecting, it is
hard to agree with the petitioner. He would like to see the owner develop his
land, but with so many people against the rezoning, he felt Mr. Dorstad should
come in with another plan.
Chairman Erickson addressed Mr. Dorstad saying that unless he wanted to
modify the request at this time, then he would have to wait for six months to
bring in any request. He was not threatening him with denial. He could think
it over until the Planning Commission meets on June 7th. Mr. Dorstad agreed
to that.
MOTION by Minish, seconded by 5chmedeke, that the Planning Commission table
to June 7, .Z972 the rezoning request, ZOA #72-05, by Einer "Ted" Dorstad, to
rezone from R-1 to R-3 (general multiple family dwellings) Lot 39, Revised
Auditor's Subdivision #77 except part to Greenwood #5640. Upon a voice vote,
a1I voting aye, the motion carried unanimously.

voting aye, the motion carried unanimously.

Mr. Haug explained that about April lst they set up a miniature garden
center. They found they were selling on public property. They quickly withdrew.
They were told to apply for a Special Use Permit. He found out, when he applied
for the Special Use Fermit, that in 1968 the station opened for business and
at that time, they were zoned C-1. A station was permitted in that district.
Then in 1969 the service s.tation category changed from C-1 to C-2. From 1969
the station has bee�. operating under C-1 instead of C-2. ._..._ __.
Referring to maps, he showed where the green area was located. The total
area they are using now is 19'x80'. They would like a Special Use Permit where
they would be restricted in their use of the miniature garden center from
April lst to July lst, renewable each year.
Mr. Schmedeke said he did not think a service station should have an outside
display. He felt that Holiday should aiso be deterred because they will be
displaying their fertilizers outside.
Mr. Minish said he had no objection to the rezoning. He wanted to adjust
himself to the other request. The statement was made that the miniature garden
would be put up in April and taken down in July. When he was on the Board of
Agpeals in 1968, the station was given permission to exceed the sign area with
the stipulation that no other signs would be displayed other than the Western
sign on the service station and the free standing pylon sign. They displayed
excessive signs and advertising devices in violation of the agreement in 1971.
Mr. Haug said he came to this station from Iowa a year ago. Right now
they have a b lacktop company coming in. At the entrance they didn't end up with
any real curbing and now they have the dirt washing away. The blacktop curbing
will come in at the entrance and then they will get the grass growing again.
The investment in the miniature garden is about $2,500. The manager had stopped
down at the City offices and asked if a.special use permit was needed. He was
tald just to keep the area clean. Now they have all this merchandise. What
he really was saying was that he was at the mercy of the City of Fridley. He
would like to have until June 15th to clear the stock. That will be the last
time they will have a garden center.

FORTY FOOT LOTS IN FRIDLEY:
Mayor Liebl said that Fridley still has some 40 foot lots left undeveloped, and
if anyone should show an interest in purchasing them, he would like to have a
policy already formulated that would be fair and impartial to all. The
Engineering Assistant pointed out that last December the Planning Commission
made a reco�endation on the use of some of the 40' lots in Plymouth Addition.
There cannot be a blanket policy for use on all 40` lots, because some of.them
are in the interior of a block and some are on a corner where if they were built
upon, they would create a traffic hazard. Mayor Liebl said that over the past
five years, he has received calls from people having 40` lots and they wondered
what they should do with them. He said fie would like to see every lot utilized
and on the tax rolls. He urged tfie Planning Commission to continue working
on some sort of a policy.
1�TION by Councilman Breider to receive the Minutes of the Planning Commission
Meeting of April 5, 1972. Seconded by Councilman Mittelstadt. Upon a voice
vate, all ayes, Mayor Liebl declared the motion carried unanimously.
