Mx'. Hokemier said years ago a lease with the railroad was very hard to ge�, but now they seek us out as it is a lucrative business for them to have signs along theix entire tracks. He said it costs Naegele $25,000 to erect thie t�pe of s�g� and then they collect $875.00 a u►onth rent for each side of a sign, �."he rai�xoad gets $2;000 a year for each sign plus 20 per cent of rent. Naegele has about 260 paint bulletins in che 7 county market. This number at�ounts to about �/10 of all of their signs. �irs, Wahlberg asked how many more signs Naegele plans to put up in this area. �ix, Hokemier said this would be the end because they have to have 900 �eet of sepaxation between signs. Mr. Beckstrom said this request was for the first unit of construction which will be a 90' x 120' industrial building to be used for a moving and storage business. There will be future expansion at which time the building will be doubled in size. Mr. Ron Gazda said it would be a maximum of three years before they expand. Mr. Tonco asked how many trucks they have in use. Mr. Ron Gazda said they have (8} eight large trucks plus some small trucks. They will have only one entrance at the present time for both the office and truck entrance. This will be on Commerce Lane. After they expand they may make a second entrance off Osborne Road unless the �ne entrance proves to be sufficient. Mr. Tonco said there should be a 10' radius on the entrance. Mr. Beckstrom said all the blacktop area will have a poured 6"x12" concrete curb except the west side of the blacktop. As this blacktop area will be expanded when the building is expanded, they want to use precast ,concrete curb. This was satisfactory to the Board members present. Mr. Beckstrom said there will be a curb and crushed rock around the building. Mr. Ron Gazda said they will sod the permanent areas and will seed where the future expansion will be. He said if they were planted now that by the time they expanded, they would be large enough to provide screening. Mr. Beckstrom and the Gazdas present agreed to this. This is a lot on " the corner of Able and Mississippi Streets. There is 100 feet on Mississippi Street and 200 feet on Able street. A house is on the lot. If the lot were split, the new lot would be 80 feet and abut Mississippi Street. Th�s wauld gi�� � lot of 8,000 square feet, 12 feet between the lot line and existing house, and 10 feet being the side yard minimum. The recommeudation would be for the driveway to come off Able street. ,The City would like to get a 10 foat sidewalk easement along Mississippi Street in case Mississippi were widened. �he side- walk easement would not encroach on the area as it would be considered part of the yard. There is a retaining wall on Mississippi Street which belongs tQ the County. The present house faces Able Street but uses a Mississippi addresa. The reason for the split is that the husband passed away and Mrs. Johnson wou�d like to sell part of the property. Chairman Schmedeke said that the new lot probably would be the smallest in the area. Mr. Clark said the frontage was about average, but the area far less than average. Lots further South are �5'x150'. The lot might appear small to the prospective buyer because the rear yard would be short. Mr. Clark said that the homes in the area were probably built in the 1950's. The date of the present home is about 1940, being a little on the small side and getting rather old. The house to the East (Mr. Paulson's) is a good sized rambler and sets rather far back. The houses across Able Street were probably build in the 50's. They do not meet the standards of today's minimum require- ments. In your Ietter, you indicated that a property owner owns property presently zoned �aommercial. On this property is a gasoline service station and a residence. The owner desires to sell the service station but maintain his residence in the house. You ask whether the city can split the lot and yet maintain soirre control over the use of the property presently having the single famil� residenee. ^ I beZieve that the city and the property owner can enter into an agreement whereb� the use of that portion of the Zot be limited to a single family home, or in the alternative, that if it is to be sold that it must be sold in conjunction with the adjoining propertr� containing the sertrice station. This would be a mutual agreement, the consideration for which would be the granting of the 1ot split. A simiZar type agreement was entered into between the city and the developers of Holiday North. You may wish to examine that agreement. Perhaps a betfer alternative wouZd be to have the propert� owner explore the possibility of selling the entire tract to the prospective buyer of the service station, with a provision in the sale that he may continue to live in the single famiZy home for an agreed upon length of time and at with our without additionaZ consideration, depending on the negotiation between the land owner and the prospective purchaser of the service station. Chairman Schmedeke explained that Mr. Thoe had been before the Subco�ittee on June 16, 1971. 'I'his request reminded' him of a similar situation in his own exper- ience. The City Manager, at the time he was going to build on his three lots, suggested the home be put on the Northwest corner of the three lots. Afterwards he wished that he`had put the building where �e wanted to instead of taking advice. He felt this could be a similar situation. The Subcommittee knows that this parcel ^ does not meet the area requirements of a C-1.district even before splitting, it has only 22,000 square feet. Mr. Thoe said that he was informed he would have to retain an easement for sewer aud water to serve the house; however, the sewer is in the street and he is hooked up to the sewer. The water he gets from the station. He used to have a well that supglied both the house and station. When water came through, he hooked up to the service station. He has been paying the water bill for both the station and the house. Mr. Schmedeke said that if the split went through, Mr. Thoe would probably want to have a separate hookup for the home�. Mr. Clark said he did not think it would be hard to get a wat:er easement along the Western side of the service station up to 73'� Avenue. He would mention that Mr. Thoe would have to get a certificate of survey fer the exact location of the house and service station. However, as it is expensive to get a certificate of survey, the Planning Commission ma.y not require it until the Council makes a decision. � Mr. Meissner said the driveway was discus�ed, but not solved. He asked Mr. Thoe how wide a driveway was he anticipating and how an�.ch room did he actually have? Mr. Thoe answered that the house is 24 feet fro� the East line and he would ^ have a 10 foot wide driveway. The driveway could al.s� be put on the West side of the house. Mr. Schmedeke said consideration should b e givea that Mr. Thoe is the fee owner and the apglication for the lot split is the way he wants to go. He felt that Mr. Th oe should keep a 10 foot easement on the West side of the station for water. Mr. Clark summarized the comments as follows: A 10 foot easement should be retaiaed either on the Southerly part of the property or the Westerly part. REQUEST FOR A VACATION: SAV �72-02, BY JOSEPH A. T�AURENT: To vacate the Easterly 4.S feet of the Westerly 15 feet of Lot 5, Block 1, Swanstrom's Court Addition. Copies of the letter sent to Mr. Laurent on February 1, 1972 written by the Engineering Department were given the members. The letter was in response to possible vacation of a storm sewer easement adjacent to Mr. Laurent's home. The existing easement was 15 feet wide with a 12 inch pipe placed on the center. The pipe �s between 6 and 6'� feet deep. The Engineering Department and Public Works staff reco�end that the top of the'footing for the proposed garage would be at the same elevation as the bottom of the storm sewer, Mr. French commented that the building would be roughly two feet from the center of the pipe. If the pipe had to be dug up, the deep footing would prevent the risk of the ground collapsing. He could not see t�at he would have any objections. He felt the chance of having to dig up that pipe would be rather small. ' Mr. Clark said that Mr. Laurent could take bids ar estimates to see if it would be a feasible thing to do. Normally, a reinforcement is not put in. This request has been discussed with both Public Works and [he Engineering staff. They � felt there would be no trouble going down to the pipe. Probably just the portion of the easement next to the house would be vacated. The manhole to the West and behind the house is 22 £eet awaq and is four feet in d�ameter. Upon a voice vote, Meissner and Schmedeke voting aye, Pierce, Crawder and•Engdahl voting nag, the M(?TION FAILED. Mr. Crowder said the Subcommnittee was there to serve a purpose. They have seen the site of the proposed plat. If they feel more facts would be beneficial, that is what they should ask for. If they felt the facts are adequate, the members should base the decisioT on that. He would go along with Mr. Meissner but he would xequest that he reword the motion so that it either spells out what we approve or disapprove. Mr. Meissner said that his reasoning was it seemed to him their com4nittee is more or less a fact finding one. There are a number of problems he would like to clear up and a public hearing before the P�anning Com�ission is already scheduled. Mr. Pierce said that Mr. Crowder's testimony �ade him change his mind. He ^ did not have any objections as f ar as the lot sizes go. He recognizes all the other problems, b ut , basically, the lot sizes are O.K. if the problems can be solved. THOE: East 125 feet of Lot 18, Block 2, Central View Manor. Mr. Thoe exglained Lot 18 has 175 footage on U�d Central Avenue and is 125 feet deep on 73rd Avenue and 73� Avenue. The residence is on the Southwest corner of the lot, and has a double garage. Re wan�s to split off the resi- dential area which is 70'x103' leaving the rest of �he lot for the service ,� station. The filling station would have 175 feet �long Central Avenue and � 125 feet on 73� Averiue. He left SS feet on 73rd �ve�ue adjacent to the reaidential area for the station to give hi� enougln parking. If the residential lot would not come up to the City requirements, he �rould take the parking area from the station and bring it up to almost 9,000 s�uare feet. Mr. Clark said the property is zoned C-1, and being C-1 under the present ordinance, the lot does not meet the present code. The house has been there for 22 qears . Mr. Thoe said the fellow who is leasing the station now, wants to buy the. land and would like to buy the house, but can't swing both. Mr. Crowder stated he felt uneasy about taking a commercial lot already too small to meet present requirements and splitting off part of it for a R-1 use. He felt that one day the entire parcel would be one cammercial site. He asked what the description would be like. Darrel Clark said it would be the South 103 feet and West 70 feet of the East 125 feet of Lot 18, Block 2, Central V3ew Manor for the residential lot. Mr. Meissner wondered if the garage could be moved and then split the lot. fle felt the request was somewhat questionable as to the feasibility of this split. Mr. Thoe said the station is 40'x60' and the station agent is going to put in another pump. He has room to build out.to the back. Mr. Schmedeke said that if the property owner figures this is what he is ^ going to do, he did not want to deny him this privilege. But Mr. Thoe should have a way into the double garage. Mr. Clark said it might be difficult fio get a mortgage on the house. With the house in C-1 property, it is a non-conforming use. Mr. Crowder said he could not see, basically, creating two lots which are substandard. The use of this lot should be singular. Because of the zoning, it would not meet commercial requirements. It was mentioned he would go to the Board of Appeals for_a variance. The petitioner has to prove why he has to have the variance. The property to the No�th is light industrial, to the East is comu►ercial and light industrial South of 73rd Avenue, the lot to the West is commercial and further West light indus- trial and to the South it is commercial and light industrial. Mr. Crowder said he stil.l did not think he was convinced it would be a good idea because, by splitting the lot, you would be creating too many problems. fle was not certain that the entire lot might be worth a lot more than two par- cels. Because it is zoned commercial and creating a residential lot, he did not believe it was in the best interests of the City of Fridley. He asked if Mr. Thoe could look a little harder to get a buyer for the entire lot. Mr. Thoe said he had to talk to someone else, � selling to someone else, , lot were split, the taxes only one buyer. He was the lessee. There is no chance as he has a five year lease and option. As far as it was aut of the question. The Citiy will be here long after we are gone, but these people will not and the neighbors will not. You should look at the property through the eyes of the present owner. Mr. Crowder said he was more interested in the long range aspects of the corner. We are looking at it for today. Because of the City, we should be looking at it that way. Chairman Schmedeke said.that the Subco�mnittee is not asked to change the zoning. Eventually the property could be sold in a complete package regardless of the lot split. Darrel Clark said Mr. Thoe would have to get an easement for sewer and� water across the filling station property, as the house is served from there now. Mr. Crowder said he would like a motion to continue the lot split and request the petitioner to go back and consider moving the lot line closer to the pumps, some thinking as to easement for sewer and water, some idea how to get the driveway easement from the station out to 73� Avenue exit, to go back and put these thoughts on another piece of paper and come back. Mr. Thoe �aid he could change those lines now.
