Acting Chairman Eitzpatrick called the meeting to order at 8:00 P.M.

MOTION by Schmedeke, seconded by Minish, that the Planning Co�ission
minutes of February 7, 1973 be approved. Upon a voice vote, all voting
aye, the motion carried unanimously.
�' RECEIVE BOARD OF APPEALS MINIITES: FEBRIIARY 13, 1'973
MOTION by Minish, seconded by Zeglen, that the Planning Commission
receive the Board of Appeals minutes of February 13, 1973. Upon a voice
vote, all voting aye, the motion carried unanimously.
1. CONTINU��: Pi]BLIC HEARING: PR.OPOSED COMPREHENSIVE PLAN
Acting Chairman Fitzpatrick asked if there was anyone present who
hadn't seen the slide presentation. Everqone indicated they had been
present at the first Public Hearing and saw th� presentation at that
time. Mr. Fitzpatrick said we would not have the slide presentation
than, but would review any areas anyone had a particular intere�t irx.
Mr. Qureshi said a presentation was made to the League of 4domen Vafiers
and the Chamber of Commerce. Most of the remarks were quite favorable
to the Plan. There were a couple of areas they had questions on, and
if there are any members of these organiza�ions here, we wouid like a �"
chance to answer these questions.
Mr. Fitzpatrick stated that if anyone had questions or input they
� would be recognized by the Chair at this time.
- Mres. Lee Ann Sporre, 301 Iranton Street NaE „ said she was a resident
� of Study Area 1 and she would like a freeze put on any d�veLoFment in
� this area for the present. The City is in the pr��cess of spending $11,000
for a feasibility study of the use of the park land in this area, T;nere
are proposals in the �omprehensive Plan that a�e �;t�ang to affect thzs

� parcel, and will have an anvironmental impact. I feel�the proposed
crosaing at 83rd'-Avenue N;E; will affect a ponding area we call Paulson's
Pond and it wi11 also affect the beaver dam. I feel the proposals are
premature, and we should use the money we are spending for a park study
wis ely .
Chairman Fitzpatrick said the park study was something new and
the Comprehensive Plaa was a long time in the making.
Mrs. Sporre said the 79th Avenue crossing will make East River
Boad accessible to the multiple dwellings. It will create a traffic
problem on 79th and 83rd, because these are not expressways aad:will
create neighborhood traffic, which she.objects to also. You are also
talking about a North/South extension of Main Street to 85th. This
will create two more right of ways along the South border of the gark
laad and on the Easterly part of the park.
Chairman Fitzpatrick said he agreed that this park study should be
brought to the attention of the Planning Commission. There isn't much
stated specifically about this area in the Comprehensive Plan. Mss.
Sporre said there was reference made that there will be new additional
crossings needed in the Northerly part of the City.
Mr. Qureshi said the concerns that have been mentioned are the
.-concerns that the City has i�_the past taken into consideration,
to come up with the proposal that is in the Comprehensive P�.an, He
�, said our concern is two-fold. One, being at present there are three
crossings in this area; one at 77th, one between Liberty an.d Longfellow,
and one at Ironte� Street. These crossings are unprotected erossin.gs,
and there was a family of three killed at one of these crossings iast
qear. The plan we had for this area was made in 1961. The new propasal
will eliminate one crossing and relocate two, to align them with 79th and
83rd, to provide better and safer facilities. The second concerxs is, to
take traffic out of a residential area. All the area along the railroad
tracks is zoned industrial. The property along .79th is all zoned industrial
and multiple. The reason it was zoned this way, was to keep comn►ercial
traffic out of residential areas. The present use in this area is alultiple,
although the�e are a couple af homes on the I�orth side of 79th that are in
industrial or multiple zoning. These lots could�be subdivided and used as
they are zoned. The area abutting 83rd in Coon Rapids is also zoned
industrial. Even though these proposals are ix� the Comprehensive Plan,
and have been in the planning stage for some icime, there would be a
. Public Hearing on any roadways or improvements in this area, to meet the
legal requirements, and this would be a more appropriate time to show
lacal concern. Our concern is for few crossings aad safer crossings.
Mrs. Sporre said there is a holding area for Spring Brook Creek in
,,, this area a�ad the beaver dam. .She felt the proposals made would be
disturbing these things.

� � Mrs. Sporre said theq were a self-contained neighborhood., and while
it was true theq could sell their lots to fit the zoning, they would be
forced tQ se11, because if the crossing goes in, they would have double
frontage on their lots, and with the increase in taxes, it would be aot
econ.omically f�asible to keep their propertg. ______ _____, ._____.___ _
= Mr. Renneth Sporre, 301 Ironton Street N.E,, said that about a year
�_a�they_went_to__a mee_ting in Coon_ Ragids. _._�-QOn Rapids_presented a study
�� of this area and in this study thera were no roads in this area and it
was laid out for an industrial site.

1+4r. Fitzpatrick asked the City Engineer what amount of coordination
there was in our plan and Goon Rapids.� R4r: Qureshi said the City knows about
� this studq. This property is zoned industrial and is owned by Burlington
Northem. There have been statements made that this crossing would affect
the ecology. At present, the beaver dam is North of this property. There
is a ditch which brings in the drainage from the East and South to a large
culvert. The pon.ding area will not be affected by this crossing. There
are a number of steps the City has to take before it can fulfill the
___ __ _--. -�verall-aleue�opment of this area. We have to get permission from the
Public Service Cammission, there has to be Public Hearings and all
affected property owners notified. This is an overall plaa, and it is
___ _._ -.-�,ot--infa��ihle.---We-a�e concerned about the ponding areas and drainage.
This is public land and whether it is used as a nature center or golf
course or for any other use, our reco�endation would be to keep.the __._
� ---�pona�g areas, but the concern here is for 120 acres in relation to the
, 20,Q00 acres the City has to be concerned about. The development of
Blaine and Coon Rapids will have much more affect on.the'drainage problem.
It also affected our decision on where the public land would.be for a
. - park, because this area does have large ponding areas.
Mr. Schmedeke said there has been reference made to the beaver dam
and beaver house. No.one can say how long one colony can live and multiply.
They could move out on their.own if they run out of food. Mr. Schmedeke
said he had some experience with this.
Mrs. Sporre said she felt we shouldn't make gremature decisions that
can affect the largest area of park land in the City.
Mr. Sehmedeke said that because there are studies going on in this
area at the present time, he didn't think the Planning Commission.would
be making anq firm decisions on this area at this time.
Mrs. Sporre said any proposals that affect the environment will affect
the use of the park land.
I�r. Qureshi used the example the property formally known as Peck's Woods,
� which has been developed, using the same concept, which preserved the
ponding areas and the ecology.
!'�• Ma�. Norwood Nelson, 7321 East River Itoad, asked if there was anything
proposed for a 73rd Street crossing. 1Pr. Qureshi said this crossing is no
longer in the plan because at this tiffie there doe�n't seen to be a need for
a crossing in this area.

'`� Mr, Tom Harren, 1479 Miasissippi Street, wanted to know the relation
between the proposed comprehensive plan and any future rezoning. Mr.
Fitzpatrick said the Comprehensive Plan is not a proposal for rezoning.
Every rezoning request would come fram the property oTaner, as it has in
__ ---- ---�e-.�� ; I�-a- �rropertp owner from one of the study areas came in with
a rezoning request that coincided with the Comprehensive Plan, he was
sure it would have a more favorable response; if it was different, it
�� s�ill wiould-be:judged on its own merits. This Comprehensive Plan is a
generalized statement on what the City would like in these areas. The
five study areas are either undeveloped or under going development with
_-.___-_--- �--o-f-t}re-�ipcle-Park area. Mr: Qureshi said the proposed - --
Comprehensive Plan in no way changes the Iegal requirements for rezoning
requests.
Mr, flarren said there is a green area ia this study area that is
zoned R-1 and you propose high intensity housing in this area. Mr.
Qureshi said such development could be around the ponding areas which
could then be preserved.
Mr. Bi11 Nee, 219 Logan Parkway said he still had stron g reservations
on the 83rd Street crossing. No one has convinced me zhey need a crossing
to East River Road. I have some prejudices about addditional crossings.
Mr. Fitzpatrick said there had been a lot of discussion on where
� --------�_��-��-es-s��gs-s�ould �e. Mr. Qureshi said this area has been studied
C� for a long time and this recommendation came from the Flanning Commission
and Council over two years ago. The recommendation was to eliminate one
crossing and relocate two to keep the truck traffic on the main roadways
--and aut of residential areas. There has been overall planning in this
area and now we are pasticipating in the North Corridor Study. If a
hridge is built between Io694 and Champlin, we will have as many cars on
85th as we have on East River Road now. They estimate that in 1985 there
will be 23,000 cars using 85th and only 10,000 cars using East River Road.
Mr. Nee said that when you give access from Highway No. 47 to East
River Road, it will be t�ao way traffic, so a lot of traffic could be
generated, Mr. Qureshi said that no one is saying this crossing should
go in at this time. This is a study area.
Mr. Miaish asked how extensively the existing crossings are used now.
Mr. Qureahi said the 77th Avenue crossing is used, but not the others.
Mr. Qureshi added that in 1961 they did designate both 79th and 83r3 as
State Aid roads, which gives us money to maintain them, but not to construct
roads. There was a specific hearing for this area, and from this hearing
came the recommendatioa to eliminate one crossing a�,d relbcate two.
� • Mr. Schmedeke said this recommendation may have been a mistake, because
-- the park land wasn't designated as such then. There are different tchings
to consider now. Mr. Fitzpatrick said that after the Public Hearing is
�,, closed, we may want to change our recomm�endation on the crossings. 1Kr.
Boardman said the plan doesn°t recom�end any sp�cific crossings, but
railroad crossings should be designed for safety purposes.

Mr. Nee said in studying this area he thought somehow we should get
�"� pedestrian and bicycle access to the North Park area. It would be quite
remote to children. Mr. Fitzpatrick said �he Park Commission is studying
inCerconnecting paths from one area to another. Mr. Nee said that when
they are developing this as an industrial area,.they should recommend
something that would benefit the people. Mr. Boardman said the City
Sta£f would be raorking on a Park & Recreation Comprehensive Plan and
wi11 be looking:for locations for bicycle paths. Ms. Janice Seeger,
324 Iroaton Street, said there should be some way to get from the park
area to the Y,MoC;Ao also.
Mr. Minish said there were people at the first Public Hearing who
were quite vocal who weren't here tonight so he thought the Public flearing
ahould be continued.
Mr. Schmedeke said he had been told the League of Women Voters were
quite sati�fied with the all-over plan and the Chamber of Commerce had
no objections. He said he wanted to commend the City Staff for coming
up with a plan that wasn't causing agitation or rezoning. He thinks it
is a goad guide and will suggest to the people what the City would like
to see in the study areas.

continue the Public Hearing on the proposed Comprehensive Plan tosM�rch
14, 1973. Upon a voice vote, a11 voting aye, the motion carried unanimously.
� 2. M[TGGLI 9ACATION REQUEST
Mr. Darrel Clark said this item had been recommended to the Subcommittee
and a copy of the letter sent to Mr. Muggli w�s included in this agenda.
Mr. Muggli will be making a formal request.
3. FRANK M. GABRELCIR, S.Pa ��72-19
Mr. C1ark said a letter had been sent to Mr. Gabrelcilc, which was
included in this agenda. Mr. Gabrelcik was requested by the Gity Council
to submit the information asked for by the Planning Commission. Mr.
Gabrelcik has brought in the requested information and this item will be
on the March 7th agenda.
4q P,D. DEVELOPMENT BY CASTLE MOBILE HOMES (FORMERLY HOWARD DLTNIP�IY)
Mr. Dave Rotter, representing Castle Mobile 13omes, was present.
Mr. Darrel Clark said this property is in the 8100 block East of
East River Road. In a PD zoning all the plans should be approved before
any construction begins, In the ariginal plan submitted by Mr. Dumphy,
j some of the land was R-3 and some coamnercial. Castle Mobile Homes wants
to begin construction in the area that was c�esignated as cou�ercial. In
^ order to submit the plans for residential housing individually, they should
' rezone from PD to R-1. They are zeady to start construction now, and
Council has given them perffdssion for two building permits with the
recommendation that they come to �he Planning Co�ission for rezoning. As
the rezoning takes a couple o£ months, they want permission to get building
permits in that part of the PD development that was designa�ed as co�ercial.

� . Mr. Rotter said they want this area to revert back to R-1 because
,� the land is more valuable as residential.

Mr. Minish said we are being asked to rezone one part of a PD District
and leave the rest�in a vacuum. When this was rezoned to PD it was
considered as one whole unit and I would like to see it rezoned as all
one unit.
Mr. Qureshi said that is what he is requesting.
Mr. Minish said no, you are asking us to consider only the top
portion of the PD District.
Mr. Qureshi said this is a PD District as it stands now. The City
approved one part as commercial and one part for apartments.. What Mr.�
Rotter is asking is to change the PD plan. He's asking to down grade the
co�ercial area to R-1.
Mr. Minish said it was his position that as long as its zoned as a
PD District we should be considering the entire District and not just a
part of it. If the top portion is rezoned to R-1, the entire PD District
should be R-1. With the urgency of the petition, this is the time to
consider the entire District being rezoned.
Mr. Fitzpatrick stated that as this is zoned PD, it isn't legally
zoned for R-3.
�� Mr. Qureshi said the reason they want to ehange the commercial area
to R-1 is because the sewer and water are in and the streets are already
platted. In the plat South of the Creek, streets and utilities would
have to be put in before it can be developed R-1.
Mr. Fitzpatrick asked if the people who are buying houses in rhis

Mr. Rotter said they caution their buyers to have an attorney before
purchasing a home.
Mr. Fitzpatrick said he didn't know how effective this is because
eneryone who bought a house in Fridley thought they bought a house across
the street from a park..
Mr. Minish said he didn't disagree with the request of changing the
commercial area to R-1, but I question just considering a part o£ it. I
thiak it should all be rezoned R-1. If they want part of it rezoned to
R-3 later, a request can be ma.de at that time. This would protect the
� praperty owners who purchased homes in the R-1 area. They would be notified
of the rezoning requESt and would be aware of R-� zoning across the stree�
from their homes.
/'� Mr. Rotter said h� wanted to get permission to have t'ne building
permits issued. It take� about two months for a rezoning request to
be processed and the peak season for se3.iing homes is nora. Yf the

Planning Commission wants.to have a stipulation on this request that_is
,—� up to them, but his prime concern was getting authorization to obtain
the building permits.
Mr. Qureshi said he is just modifying the commercial area of a
PD Diatrict to R-1.
Mr. Clark said the problem with this modification is if anyone
calls the Citq to find out the zoning is this area, we would have to
tell them it is PD. They would ask what that zoning means and we would
have to tell them it caa be any thing from single family dwellings, up
to and including commercial.

recommend to Council that the entire PD District be rezoned to R-1 witl�
the stipulation that no building permits be issued until petitioner
makes application for the rezoning. iJpon a voice vote, all voting aye,

5. IINDER.GRODIQD UTILITIES
Mr. Sctmnedeke thought a reco�endation should be ma.ke to the City
Council to check into underground utilities for Fridley.
_ Mr. Darrel Clark said this was being done in some new developments
in the City. The high voltage wires couldn't be put underground. If
� underground utilities were put in areas that are already developed, the
property.owner would have to stand the expense.

Mr. Dick Johnson was present to present the request.
Mr. Johnson said they have had the property for about five years and
they had to design the building to meet the restrictions on a corner lot.
The offices of the building are double decked for space reasons. The
Ioading dock is located on Beech StreeC and a drive-in door is on 77th Avenue
NoE.

Mr. Tonco asked if the loading dock was depressed from the street
elevation and if this would cause any drainage problems. Mr. Johnson said
%`� it does have very little slope on the drive, but it is not lower than th.e
street. He said the building level might have to be adjusted to keep from
depressing the drive and to provide adequate drainage,
Mr. Simoneau asked if the planting shown on the plan was what the� inte:ded
to have on the site. Mr. Johnson said they hadn't really set up any plan�ing
yet.
Mr. Boardman said that the City would require some planting around the
loading area for screening and although it will be more difficult to screen
the dock on Beech Street, yau will be able to screen it from 77th Avenue.
Mr. Tonco asked if the alley was presently blacktopped. Mr. Johnson
said it wasn`t. Mr. Tonco then asked if he intended to blacktop it. :-ir.
Johnson said he would, depending on what the City required as tar as ro�d
capacity. Mr. Tonco told %:r. Johnson he should check to see wnat the Cir.y
has in mind for the a11ey.
Mr. White asked about provisions for handicapged parkiziti. Mr. Johnson
said Mr. Boardman had called him in regard to the parking for the handicapp��.
and said he wauld need one 12 foat stall. He said this action would t:ave t�
be handled at Council level since it taould require reducin� the 20 foot setbacic
on Beech Street to 18 feet.

` P�Ir. Tonco asked Mr. Johnson what he planned to do with the exterior of �
the buiZding to keep it from being another dull looking warehouse. Mr. Johnson
%~ said the building will be painted. The design of the building is such that
it could lend itself to multi-color painting. Also, in the office area,
they will use multi-color panels.
The question was raised about security lighting. Mr. Johnson said this
would be taken care of oy security lights right on the utility poles.
Mr. Simoneau asked where the trash would be stored. Mr. Johnson said
dumpsters wi11 be located inside the building if possible. Mr. Eoardman
said if the dumpsters are stored outside, they must ba properly screened.
If they are going to be stored inside, they must remain inside at all times.
MOTION by Tonco, seconded by White, that the Subcommittee recommend
to Council approval of the request to construct a speculative building
with the following stipulations;
1. That the applicant work with the City S�aff to determine
means of blacktopping the section of alley used for access
of the parking area.
2. Submit landscape plan to the Citq for approval.
3. Provide enough slope for drainage so water won't
collect against building in loading dock area.
/�`'� 4. Dumpster for trash storage will be kept inside
building, but if dumpster is moved outside, then
proper screening will be provided.
5. Security lighting is provided for the building
an� parking area.

Mr. Tonco asked Mr, Boardman to check Shorewood Lounge. He

2. PUBLIC HEARINGc REQTTEST FOR REZOATINGi ZOA �E72-11, BY UNION OIL COMPANY:
5695 Hackmann Avenue to rezone from C-1S (local shopping) ta C-2
(general business).
3. PtTBLIC HEARINGc REQIJEST FOR A SPECIAL USE PERMIT, SP #�72-18, BY UNION
OIL COMPANY: 5695 Hackmann Avenue to construct a convenience store and
continue the service station.
Chairman Erickson said the request £or the:Rezoning and Special Use Permit
� would be heard togetber.
^ MQTION by Schmedeke, seconded by Fitzpatrick, that the Planning Commission
waive the reading of the Public Hearing Notice for rezoning, ZOA #72-18, and
the Special Use Permit request, SP #72-11, by Union Oil Company. Upon a voice
vote, all voting aye, the motion carried unanimously.
Mr. G1en Hubbard, LTnion 0i1 Real Estate Developer, was present to represent
Uni.on Oi 1 Comp any .
Mr. Clark said this is a result of a traffic pattern study made by the City,
County and State Highway Department because of the traffic hazard at this
intersection. The reason for the study was that all parties involved felt the
present service drive is not a good traffic situation. We have worked with
Union Oil to develop a service drive araund behind the site including various
islands to control the traffic flow. The result of this is that Union 76
would like to relocate their structure on .the site. We are still negotiating
with the Highwap Department on the utility easements. No structures would
be on the right of wap. The whole parcel is zoned C-1S. The reason for the
rezoning request is to have the proper zoning classification for a service ,
station. Chr. Erickson said the C-1S zoning classification would allow the
convenience store. The total site was 3/4 acre. Mr. Claric said they would be
losing one third of it so it would be something less than half an acre.

Mr. Louis Hedlund, 93Q Aackmann Ave.t He said he owned the property next
� to the oil station. There was a 10 foot planting strip and a fence between
` his property and the station. The Pure 0i1 Company had put up the fence and
he maintains it. Tlze new service road will eliminate this buffer between
the station and his propertq. He didn't want it. He was also concerned if

the service station sold the property wt�at other kind of general business could
be usiag the site.
Mi. Clark said that all the govermental bodies concerned wanted the ser-
vice road changed.
Chairman Erickson said we have two requests here, one for legalizing the
zoning for a service station and one for a convenience store. Now we are talk-
ing about the loopback that was not mentioned in the requests.
Mr. Clark said that he would assume that the Union 0i1 Company would
dedicate the land for the loopback if they have a usable site for their
station, but if the requests aren't granted, they would not want to dedicate
the road.
Mr. Kenneth Fletcher, 5930 Po1k Streeti He asked what the xeasoning was
in creating the loopback. Mr. Clark answered that it was to have more stack-
room. It will bring the traffic closer to Mr. Hedlund's and Mr. Fletcher's
property.
Mrs. Hedlund said that if the road was going to be moved, they would
want a copy of the survey to see how close their house would be to the street.
Mr. Clark said the closest corner would be 24� feet.
Mr. Hedlund asked if the road were.put.-in, would they be requi.red to fence
it. Mr. Clark answered that could be made a stipulation.
Mr..Fletcher thought they could find an-aiternate plan. He thought the
proposed plan would make the situation worse. •
Mr. Minish asked at what stage the plan for the loopback was at now.
Mr. Clark answered that the State Highway Department will build the road if
the City furnishes the right of ways.
Mr. Schmedeke said he didn't think the Planning Commission could make
any recommendations on this until all the people affected were notified.
Chai.rman Erickson said this intersection had been discussed for over a
year. The City has to come up with a solution. He did agree with Mr.
Schmedeke, however.
MOTION by Zeglen, seconded by Fitzpatrick, that the Planning Commission
continue the Rezoning Request, ZOA #72-11 and the request for a Special Use
Permit, SP #72-18, by Union Oil Company until December 20, 1972 so that the
property owners affected by the loopback can be notified. Upon a voice vote,
all voting aye, the motion carried unanimously.

Levi.s Hedluad, 930 Hacl�ann Avenue: Mr. Hedlund felt the Uniou Oi1 Company
was being coerced into granting the easemeat ia order to provide the loopback.
Chairman Erickson said the 0i1 Compaay can continue the use of the property
without rezoniag because the Use is under a grandfather's clause.
i�Ir. Clark said that the City felt if they were going to chaage the road
and require additional right of way it should be settled now before the new
station is built.
Chairmau Erickson said the Commission,has to make up their minds on several
queations. First, is this corner such a traffic problem that it wi.11 have to
change the traffic pattern. The State has offered t o give the City the land to
Change the traffic. We have had some situations where it cost the City $20,000
to get Iaad for the loopbacks.
G1enII E. Nelson, 5747 Central Aveaue: Mr. Nelson felt this'plan would be
ao improvemeat.
Mr. Clark gave the following traffic count which was taken in 1970, for
24 hours: Rillwind Road, 670; Central Avenue around 3,500 cars per day: The
prediction for 1975 was 5,000 cars on Cential Avenue and 1,000 on Hillwind.
Stella A. Kowa1, 5715 Po1k Street: Ms. Kowal said she was especially
bothered by the semaphore on Central Avenue. She felt the timing was very poor.
George Fletcher, 5725 Polk Street: Mr. Fletcher stated he has been driving
that road for 5� years from 7:00 A.M. to 9:00 P.M. and has never had one iota of
a problem from that area, .
Answering"the ques'tion of traffic accidents at that intersection, Mr. Clark
said he could give the accidents reported'to the Fridley Police Department, which
did not inc2ude the State or County figures. In 1971, from June to December, the
accidents on the East side of Highway ��65 were seven. In 1972 there were six
accidents East of Highway ��65. There were three accidenta oa Central and Hackmann
in 1971 and 1972. The West side of Highway #65 has more traffic accidents.
Vivian Hedlun3, 930 Hacl�ann Avenue:� Mrs. Hedlund dfda't think they could
attribute many of the acc�dents on the East side of the Highway to Hillwind Road.
She did not think this pazticular loopback would do anything for th�t problem.
Chairman Erickson asked if there was anyone present who used Hillwind Road.
There wasn't. He said thP concern with Hillwind Road was what will happen in
the future when the development on top of the hill and the vacant property in
� betweea is'completely developed.
� Joseph J. Branco, 5720 Polk Street, Mr. Branco brought up the fact that the
,buses for ali schools in the area pick up the children at the Hillwind intersecticn.
Wasn't there some way �o direct the traffic away �rom Hillwind Road. He did nct

- Charles Buzzell, Jr., 5741 Po1k Street: Mr. Buzzell asked if any of the
s�reets would be changed as far as the width of the street, and how large an
area would be assessed.
Mr. C1ark said the City does not have a cost affecting land owners yet
because this would be joiat construction being this is a County Street with
the City coutributing. Since this pzoject would be a loopback, the adjacent
property owuers would be assessed. Central Avenue will be widened considerably.
The road which intersects with Ceatral A�enue is Haclm�anu. That road is 31 feet,
but the State pays."for what is equivalent to a normal State service drive and the
City picks up the difference. Five feet w_Il be taken because 3i feet is not
, wide enough for passing.

Mr. Clark continued that the convenience store could be built without a
special use permit and without any rezoning. As he understands it, the parcel
is big enough for the convenience store right now without the street.
Mr. Miaish asked if the convenience store was to be a separate building.
Mx, Clark said it was and the only reason the intersection is being consi�ered
is �o avoid the problem of having a new structure built that would have to be
tarn down if something is done in the future with the road.
The question was asked that if this intersection is something of a traffic
' h��ard, why put the store in? Also what direction would the convenience store
#ace, off Hillwind pr th� present site. Mr. Glenn Hubbard said they have occupiEd
,n the station for 15 years under the present zoning. About three years ago, ttie
zoning was changed so that service stati.ons were not permitt�d in that t�n� or
$aning. Tney did not know this until they wanted to do some remodelin� ac.d
�ace liit�n� on the station. "Sr. Hubbard said the remodeling :�ould cciisisi. ca
adding a bay and a mansard roof. He was asked if he were alloweci to make the
changes to the station, without adding a bay, would he still go ahead and put

^ ia the convenience store. Mr. Hubbard said they wanted to put in a convenience
store and sell the laad. They felt the convenience store would be used, but noC
duxing the rush hours of traffic.
Mr. Miuish recalled that this was a problem iatersection a couple of years
ago, when Public Hearings were held for Viewcon, Inc. There was strong concern
that this would be a problem intarsection. It was not the traffic on Hillwind,
but traffic backing up on Central Avenue. �Not just one street, but all of them.
Chairmaa Ericksaa told th� audience that at the time of rezoning for
Viewcon, the Comm►ission had many cou�ents. The audience has to realize t�ere
is gQing to be additional people using these streets when the land is fully
developed. When the Shell station was asked'to give up land for the �oopback,
it cast the City $22,500, We are trying to avoid that expense by planning
ahead. If the station weze remodeled, there would be two accesses to Haclanann,
two to Hillwind, but from a traffic standpoint, the City does not like all these
aCCesses. If this is going to be a part of the trade, it will be part of the
transact:Lon.

Mr. C1ark said that if there is going to be a chaage in the intersectioa,
��and the Oil Company agrees to give the laad, let.'s do it now and not after the
station is built.

the majority of the people here live in the iamediate area, Her driveway
is the first driveway from that intersection on the North side of Hact�ann.
She has very seldom had to atop when she backed out of her driveway onto

A citizen commented that the assessor said they would be as$essed if the
road went through. He was told it was true.
Mr. Hubbard said he would like to get back to the original issue of the
rezoning regardless of the statioa. They were agreeable either way about Lhe
station.
Mr. Minish said if the Planning Commission were to grant the rezoning, thert
IInion Oi.l would be able to expand and add'a bay or rebuild. He asked Mr. Hubbard
if he envisioned there would be an increase of cars entering the station.
Mr. Hubbard answered there would be a total of three bavs in either case.
They were most concerned about protecting what business they�have. You have
to be modern and keep up to date in order to keep the business you have got. Any
� aew station built today is a three bay station. Fie was not convinced this woula
cause a traffic problem. .
^ Mr. Minish said whatever the traffic volume is, if the station is improved,
` traffic will increase. Mr. Hubbard said their building would not generate tza�fic,

and the request for a Special Use Permit, SP #72-18, by Union Oil Company.
Opon a voice vote, all voting aye, the motioa carried unanimously.
Mr. Clark said that Parcel #2 is 30,821 square feet, the road easement
is 10,592 square feet, Part of Parce2 �2 would be on Che opposite side of the
service station.
Mr. Fitzpatrick explained that it seemed to him this all came about because
the Commission felt there was a necessity for improving traffic at this inter-
sectioa. The Eagineering Departur.ent submitted a proposal that is supposed to
do just that. He didri'.t knov is thgy were to set themselves up as jud�es as to
whether this does it or not. He was not personally convinced this is a big .
improvement in traffic coatrol, but on the other.hand, he was not an authority
to do that either.
Mr. Minish thought that this plan represents, probably, Lhe best approach
to the problem at the least cost, but not necessary the optimum�to solve the
prpblem at iacreased cost.

Mr. Clark explained that just the extension of Che island will pronibit
cars getting into the Station site and that will be better than i,t was before,
�iowever, the station people must feel they would not grant an easec�ent without
. coSt to the City if the access is cut off at this point. This plan is part of
; a report made by a tra£fic engineering firm and approved in 1971 and they came
up with about the same thiag for this section. .
Concerning the petition, Mr. Clark said the Special Use Permit was needed
oulq for the station, but if Uuion Oil changed the plans and sr.ade one structure
and bay and accessory use for the station, the rezoning was necessazy. '
Ghairqian Ezickson added that the couvenience store part of the request was
really nothing Co d�scuss at this noint. The Commission could just allow him
to go ahead under the grand,�ather clause without any action.
Mr. Schmedeke said he was not sold on the street plan at all.
Chairman Erickson said thP Gou�mission at this point had two choices. One,
deny the requesk foz rezoniag and Special Use Permit to aiiow the staticn to
exisC as is. Secondly, grant the request for re�oning so [hat the petitioner
c�tt expand the station with stipulations whether or not th.e service statXon be
reloCated and that right nf way be re-dedicated, .
Mr. Minish said he was concerned about the safety factors of this inter-
sectiono One of the concerns at the time of the Viewcoa rezoniag was the proble�:

If so, it would give the City time to solve the traffic problem.
Mr. Fitzpatrick said the whoe thing is brought about by the Commission's
misgivings ahout this proposed solution to the traffic problem. He would like
to poiat out to the Union OiI Company that what they were requesting might make
a bad situation worse, although it was not relative to the Counaission's problem.
Chairman Erickson said he had asked for an opinian about the feasibility of
changing the Ordinan�e adding a non-conforneiag Use without rezoning. This is
a possible solution to their problem.

establish plans for the relocation of some Nationai Guard units irom the
Minneapolis downtown armory to the suburban communities . The reason

leaders and your current and future planning grouos, that the iViinnesota
Army National Guard is interested in establishir.g National Guard units in
communities close to, or adjacent to, Minneapolis, and if a city is in�er�s'_e�?

A policy of decentralization of units has been in effect for a nurlber of ��e�rs
and has been accomplished in St. P�u�. Our long ranae decentraliza�icn
plan for Minneapolis will require five (5) necv locaticns outsi�e of �linne-
apolis proper, with new armories being const,--ucted in five {5) suburban
communities . �
If the National Guard is to establish a unit in a co:nmunity, the communi�y
