He said he didn't think Mr. DeGardner could provide enough parking �n his property to handle an'increase in business. Mrs. Lester Frieze, 359 79th Way N.E., said if you rezone this property, other people are going to come in and xequest rezoning on the ... vacant land in the area. I am against any rezoning in this area. Mr. Winfred Morphew, 7948 East River Road, said he was against the rezoning because he didn't want to see Mr. DeGardner's business "' get any bigger in a res�dential area. Mr. Schmedeke said maybe a C-R1 district should not have been .� created`in our ordinanee. It seems to create business in a residential area. I think people should be informed when they make a request that spot- rezoning isn�t allowed. He said we knew Mr. DeGardner was in business but were not aware he was hiring people who were officed in his home. Mr. Erickson said the City does not go around policing home businesses unless there is a complaint. There have been no complaints ^ on Mr. DeGardner's operation until tonight. The neighbors seem satisfied with Mr. DeGardner. DeGardne�, to rezone Lots 22 thro�gh 25, exe�pt the Westerly 60 feet, Block 7, Spring Brook Park Addition, from R-1 (single family — dwelling areas) to C-R1 (general office and limited business), because this business was developed contrary to the home occupation ordinance and if we grant this request we would be sanctioning violation of our Code. ... � Mr. Erickson said he was asking for rezoning so he could expand and run his business legally. '�' Mr. Minish said he thought this was the wrong way to go about it. We would be granting de facto rezoning to something developed illegally. I think the character of the neighborhood is residentiai. �.., ^ � .. �, ... Mr. Erickson said he would have to go along with the motion, but he thought it was unfortunate that Mr. DeGard�er wasn't aware his business was in violation of the home occupation ordinance. I think it is possible that in time, all East River Road will be zoned commercial, but I don't think it should be started on one piece of property. This may work a hardship on Mr. DeGardner and I don't feel it's his fault. UPON A VOICE VOTE, all v�ting aye, the motion carried unanimously. 2. Planning Coumission Meeting - March 7, 1973 Page 4 Mr. McGregor said rather than make a presentation, he would answer any questions the Commission had. Mr. Erickson said as he understood the request, you want to install a car washing machine in an existing stall. Mr. Erickson asked Mr. Clark if this was one of the requirements of the ordinance. Mr. Clark said the service station definition doesn't allow a car wash unit, so it has to come under a Special Use Permit. Mr. McGregor said that because the station used the Spring Lake Park sewer facilities, they had talked to Spring Lake Park and they had no objection to the car wash. � Mr. Minish asked the purpose of installing the car wash. Mr. McGregor said it was an inducement to create more business. We have installed 96 of these units in the Metropolitan area and sub�:rbs and have shown. a 3a% increase in business where we have installed these units. Mr. Schmedeke said we have a car wash business a few blocks away and I frown upon putting another car wash operation so close. Mr. McGregor said this was just a quick wash and the cars came out wet. They are not dried or vacuumed on the inside as at a regular car wash . � Mr. Rabt said the businesses. in the shopping center were in favor of the car wash because they,thought it would help draw people to the shopping center. . � .. � — �, .. � �, �, ; Mr. Schmedeke wondered if the property owner would be in favor, because it could lead to icing conditions on the common driveway, when the cars come out wet. Mr. Zeglen said as this station is quite new, why wasn't the car wash.unit put in when the station was built. Mr. McGregor said it probably should have been put in then, but these units weren't so po�ular when the station was planned. Mr. Minish asked the economic effect of this car wash. If you aren't able to put this in, will the station survive. Mr. McGregor said he thought it would. Mr. Erickson asked what per cent of the time they were busy in both bays of the station. Mr. Rabe said they have only been open since November 21, 1972. In the winter they use both bays most of the time. The colder the weather, the more both bays were used. Otherwise, the bay with the hoist was used the most. He didn't think this would pose any problem because the_y didn�t expect people to want a�aet wash during freezing weather. Mr. Fitzpatrick asked'how they would charge for this service. Mr. Schmedeke said he favored denial of the request because he hadn't been in favor of another service station on University Avenue; of the icing .,. conditions that might occur; and because there is a car wash operation not over '� mile from this station. �.. � � Mr. McGregor said that because there was a station in Fridley with a car wash unit, he would request that everyone be treated equally and allow them �o have a unit also. Mr. Minish said this was the second request for a car was.h unit we have had recently and the other request was denied. He said he was sure we would see more of these requests and he quoted an excerpt from an article from Forbes magazine that stated that 100,000 stations could be doomed over the next decade because of over expansion. Mobil and Shell Oil have about 10,000 few- er gasoline stations today than they did in 1960. While gasoline consump- tion has been going up steadily. the number of service stztions in the U.S. is declining. "T'he gasoline-station pop- • ulation of the country is probably overbui►t by 100 percent," says Atbert An- ton, the highly respected senior oil analyst at Wall Street's Carl H. Pforzhei- • mer & Co. If these esti- mates are correct, some- thing like 100,000 gasoline stations could be doomed aver the next decade or so, an investment of bil- lions of doliars. Why? Essentially hecause most of them are too smatl to compete in an era of hign wages and scarce ski:led labor. Ho�:� did the majors get trapped in a basically inefficient distri- bution network, with as many as three or four smail stations all fi�hting for a 9imited amount of Uusiness? It was the temp- tation of cheap crude oiL There was so much money in the oil itself that the majors didn't much mind losing some money at the retail end so long as they coutd move all the oil they could produce. But cheap oil has succumbed to do- mestic scarcity and Arab nationalism. Volun�e for volume's sake is no longer prof itable. PUBLIC HEARING: REZONING REQUEST, ZOA ��73-03, BY SAMUEL TEMPLIN: To rezone Lots I and 2, 39 through 42, Block 6, Fridley Park Addition, fram R-1 (single family dwelling areas) to R-3, (general multiple family dwellings) for townhouses. Mr. Sam Templin was present. MOTION by Fitzpatrick, seconded by Schmedeke, that the Planning •Caa�ission waive the reading of the Public Hearing notice on the rezoning request ZOA ��73-03, bp Samuel Templin, to rezone Lots 1, 2, 39 through 42, Block 6, Fridley Park Addition, fram R-1 to R-3. Upon a voice vote, all voting aye, the motion carried unani.mously. Mr. Clark said these can't be called townhouses because the property doesn't have the acreage required for townhouses. When yau see the plans you will see they are a townhouse type of construction. Mr. Erickson said the plan shown has a four unit building facing Rice Creek Way and a five unit building facing East River Road. Mr. Erickson asked Mr. Templin where the entrances would be. Mr. Templin said the entrance would be between the two units eoming out on Rice Creek Way. He said he had talked to the County Commissioner and he said they didn't want any entrances on East River Road. Mr. Erickson asked if these would be rental units, Mr. Templin said �hey would. He said he hadn't checked with the City or the Assessor to see if they could be sold individually. ' Mr. Erickson asked how many square feet are involved in this property. Mr. Templin said it was about 33,000 square feet. Mr. Templin said he felt that the rezoning request for East River Road was the best use for the property. Mr, Don Smith, 81 Rice Creek Way, wondered if everyone understood the project Mr. Templin is proposing. Mr. Erickson answered that he understands that Mr. Templin wants to build two buildings; one with four units and one with five units. The four unit building wi11 face Rice Creek Way and the five unit building wiil face East River Road with a common driveway on Rice Creek Way. The buildings will be rental. He said he was sure that all the people present were familiar with the land and it would appear it would have to be filled rather ex- tensively. Richard Larson, 6580 Aickory Street N:E;, said to him R-3 was a nasty word. It's like a disease. We have agartments behind us now and we have nothing but migrant type individuals living in them. They seem to have more dogs than people. If you want R-2 on East River Road, O.K., but don't put R-3 an Hicko�-y or Rice C�eek Way. He said don't give us t�<:t traffic. He also said he couldn't imagine Hickory Street ever going R-3. ... .. � ... .. .. Planning Commission Meeting - March 7, 1973 Page 7 Fred Halverson, 85 Rice Creek Way N.E., said one of the things we did check when we bought our home was that there was R-1 zoning around us. To the best of my knowledge, this is the fourth time this property has come ug for question or rezoning. If the Commission starts allowing rezoning, it will keep encroaching on residential areas. I'm not concerned about rezoning on East River Road, because of all the traffic. He asked if these units had to face Rice Creek Way or could they face Hickory. Mr. Erickson said it was possible the units could face Hickory. Mr. Halverson said he wouldn't want any units facing his property. He was also concerned about the maintenance of rental property. .. Mr. Erickson asked Mr. Templin why he doesn't feel he can build on this property as it is presently zoned. Mr. Templin said this property has been sitting idle for years, and if any develoger felt this was a �, good site for homes, it wouTd have been built on long ago. I personally feel it would be a mistake to keep this area zoned R-1. .. � � ^ .. Mr. Erickson asked if Mr. Templin didn't think Lots 1 and 2 couldn't be built single family. Mr. Templin said if he builds houses on these lots, the back of the five unit building would be behind them. I thought a long time of the best way to use the property and this is the plan I decided on. Mr. Erickson asked if the people had any suggestians on how this property should be used. Mrs. Larson and Don Johnson, 6600 Hickory Street M:E., said there wasn't any park in the area and this is what they would like it used for. Mr. Erickson said he had heard before about a need for a park in this area, but the property is in the hands of a private developer now. Mr. Larson said he questioned why we have to have every piece of land filled up right now. He said as time goes by, something would fit on this property that would satisfy both the neighborhood and the developer. Mr. Erickson said this is one of the problems of both the Planning Commission and the Council. There is vacant land in an area, and people want it left thati way. But someone is paying taxes on the land and they do have a right to use it. John Swingdorf, 90 Rice Creek Way N.E., said he thought we should -■ go along with the rezoning on East River Road, but not on Hickory Street. ' I think we should be able to make some sort of compromise. ^ ... Mr. Erickson said the Commission does have the authority to rezone a portion of the property and leave the rest as zoned. Mr. Richard French, 1469 Gardena Avenue N,E., said he doesn't live in the area, but is member of a Subcommittee, and has been listening to � ^ the discussion. Chairman Erickson said he would suggest that the Public Hearing be continued until the next meeting to give the petitioner and the people in the area:,time to think it over. Nobody seems to want the rezoning, including the petitioner. AlI he wants is permission to build an addition. Chairman Erickson said if it is agreeable with the Commission and the petitioner, I would like to see this tabled until we can get an opinion from the City Attorney as to whether or not this can be handled through the Board of Appeals, and if he says no, if he can't then write an amendment to our ordinance to permit something like this under a Special IIse Permit. General Cheeseman said that out of twenty communities, we only want an armory in five of them. Mr. Erickson asked how many men would use ,the armory. General Cheeseman said a single unit armory has 120 men. General Cheeseman said we do need highway access and should be able to move our equipment without driving on residential streets. General Cheeseman said he hasn't looked at any sites. He said we are making it known we want to locate five armories in the Minneapolis area.. Lf a community shaws an interest in having an armory and there is same sort of a commitment from the Council to sugport an armory, which he said is quite intangible. He said he didn't want to wave the flag, but it needs the patriotic an d univeral support of the co�unity. He said the Council has shown an interest by referring this to the Pianning Commission. n . Mr. Ciark said he realized that the Subcommittee just got their copy of the �roposed plat this evening. He said if you look at the North Half of Section 12, Spring Lake �ark Lakeside Addition, you will find Lots 12, 13, and 14. Mr. Bayer's proposal is to divide these lots into more conventional residential lots with the dedication of a 25 foot easement off the East for the extension of McKinley Street. The only question I have and Mr. Bayer has of the Subcommittee is the lowering of the minimum lot requirement from 7� feet of frontage to 72 feet on the lots that will f<ice the new McKinley Street. Also, Mr. Bayer plans to sell 20 feet of�the frontage on Lakeside Road to the homeowner to the South. I would suggest that this be made into an Outlot and be included in the Plat, otherwise you are going to have a very small portion of a lot that's going to be difficult to find on a half section at a later date. 2.r. $aqer stated the reason he wants 72 foot lots instead of 90 foot was bec:._:5e the utility cost would be $1,ODO to $150U more on a 90 foot lot compa-n3 to a 75 foot lot. This would make the land cost so high that it would be difficult to keep the homes in the 1ow $30,000 bracket. The minimum lot size requirement is 9,000 square feet. Even though these lots would be only 72 f�t wide, the lot, because of its depth, would be 864 feet above the minimum lot size requirement. On Lakeside the lots would be 85 feet, 10 feet over the requirement. Tt�e lots will be bigger on Lakeside and smaller on McKinley. We will have to do a lot of fiiling on these lots which will add to the cost. Mr. Clark said he had, and had informed Mr. Bayer that it waa up to the various bodies who consider this request whether ^ 72 foot lots would be acceptable. Mr. Meissner said he didn't see any basic problem with the Plat, and while he was sympathetic wit� the economic reasons for smaller lots, he � saw no cou�pelling reason to allow lots below the minimum requirements. This could be platted for four 90 foot lots instead of five 72 foot lots on McKinley. ... Phase IV and V of the plan are being presented tonight. There is a little change made from the original plan. The traffic flow won't change but there have been street alignment changes which are for the better as far as street grades and for development. They have to go to Building Standands for plan approval as far as esthetics and annuities such as a park plan and recreational develcpment so your recom- mendation should include approval by the Building Standards Subcommittee. This plan is less dense than the original plan, They will be able to save more trees with this plan, Mr. Loadon said they have a more accurate topog to work with, so the development will fit with what's existing much better. Mr. London said with the mvre accurate topog they will end up with � less black top area and more green areas. • Mr. Clark said we're working with Darrel Farr on a park plan as to -� what we would like to see in the area. Mr. London said we have always had a park and recreation plan, but we are working with Jerry Boardman and Paul Brown on this now. Mr. Schmedeke asked if the City was contented with the changes. Mr. Clark said the City was more satisfied with this plan than the original. VACATION REQUEST, SAV �k73-02, BY SAMUEL TEMPLIN: To vacate the North/ South Alley, Block 6, Fridley Park Addition, lying between East River . Road and Hickory Street N.E. Mr. Darrel Clark said this alley is in a block of an old plat and isn't being used. It has never been open and I don't think we could open it if we wanted to because there is a cemetery encroachment in about the middle of the block. If it isn't in the alley, it's very close to the alley. The City Administration would have no desire to open the alley and would recounnend approval of the vacation but retain the utility easements, regardless if the rezoning request is approved or denied. Even if this area remains R-1, there is no need for this alley. I have seen Mr. Templin's plan and he doesn't intend to straddle the alley with his buildings, but will use it for a common driveway. Mr. Schmedeke said there might be people opposed to the rezoning. Mr. Clark said there might be, but he didn't expe,ct any opposition to the vacation. Mr. Clark said we shouldn't vacate this parcel until we are sure we � won't need it for street improvement. The circle flow plan is no longer in the plan, but no alternate plan has been suggested. I would have no objection to Mr. Muggli parking vehicles on it, if they don't impede vision � as far as traffic is concerned. � ^ � � i Mr. Schmedeke said he has spoken to Mr. Muggli a number of times about this, and he is not as etrong for this as you might think. I have some thoughts on this �et�:er which are; i. The circle flow plan is not dead, 2. The petioner is not asking to close the al�ey, 3. As the alley is being used, it cannot be closed, 4. The circle flow plan would clean up this unsightly alley aiong a main tharoughfare, 5. The commercial praperty on Block 12, Hyde Park Addition, needs son�ething besided one-way traffic as a traffic solution, and 6. Traffic pro�lems must be solved before this property can be so1d. Mr. Schmedeke said he wanted to make som� comments on the Janu$ry 22, -. 1973 Council minutes on the discussion with Mr. Muggl�. Councilman Nee asked Mr. Muggli how he was going to use the property. Mr. Muggli stated he had no special use for the property at the present time. Mr. Nee sugges�ed that evergreens be planGed for a softening affect of this area. ^ Mr. Muggli also sGated that people are using this alley and drive through his property, The City has put up a dead end sign anc� this has eliminated the problem. If the City needed the land, the City would then have to buy it back from Mr. Muggli, Mr. Schmedeke said he • agreed with both Councilmen. PROPERTY ADJOINING CRAIG PARK Mr. Fitzpatrick called the Commissioner's attention to the letter from Muske - Tansey Company, regarding some property which is presently vacant, and adjoins . Craig Park on the West boundary. The owner would like to sell this property to the City at a cost of $7,500.00. Mr. Fitzpatrick asked for comments on the property. Mr. Brown stated that he had discussed the property with Darrel Clark, who is in ^ charge of the Building Inspection Department, and they had decided that the asking price was too high and development or undevelopment of the lot would not have any major effect on the Park. We presently use the property for access to the Park ,� for maintenance purposes, but the loss of this access would not create any problems. Mr. Kirkham said that we don't have any money for purchase in 1973. Mr. Brown said that this wouldn't be a problem because the purchase of land in the 1973 '� Budget is not itemized. .. � Mr. Fitzpatrick said that we should answer the letter, informing the realtor and seller that we're not interested in purchasing the property. Mr. Boardman was concerned about the parking problem. He said based on the size of the building and havin� a 70a usage, there would have to be 225 parking stalls. Mr. Shin�gen said the buiiding capacity of the upper and lower floors•is 500. Mr. Zeglen said based on a 500 capacity, the present 125 parking stalls would be sufficient. Mr. Shint�en said any additional parking would also be blacktopped. Mr. Zeglen also noted that the parking stalls are only 9' x 18', and will have to be brought up to code standards of 10' x 20'. There will also have to be 25' back-up aisles. Both Mr. Brenny and Mr. Shingten agreed, �- Mr. Zeglen s�id there has been a drainage problem along the South boundary, also known as 68th Place. ,� Mr. Shintgen said this draina�e problem was not on their property. . � � ^ Mr. Boardman said he would talk ta �ir. Mr. Boardman noted that the ordinance was chaneed in 1969, and thev could be asked to bring this up to present standards, even though it was constructed pro- "' perly in 1965. Mr. Tonco did not feel it was right to ask them to tear out this -• blacktop. Mr. Simoneau asked what the.,practicality of tearing it out would be. .. � � ... � ^ Mr. Tonco asked for a land survey to see where their lot line began in regards to determining where the 20' vlanting area should end and the parking lot begin. A survey was not available at the meeting. Mr. Boardman said to hold on a decision until they work out the parking lot layout and property dispute on the South boundarv, and bring this information into City Hall_ _ Mr. Brenny and Mr. Shintgen ;said the addition would match the painted blocks of the present building. It was also noted that the doors in the front will be enclosed, with the door to the side. Mr. Zeglen'said safetv features such as safety glass, etc., wDUld have to be brought up with the Inspection Department. Mr. Brenny said a ramp for the handicapped would be provided. Mr. Tonco asked if the landscaping plan drawn in was the one they would be using. �� Mr. Boardman said that he had drawn the landscaping in, as none was provided on the plans, and he wanted to give them an idea of what the City would like to see. ., .. The committee asked if North Air Homes will be buying any land to ,^ the back of their present structure and narking area in the future. Mr. Brenny and Mr. Shintgen sai3 they had contacted the owners, but they did not want to sell at �resent. Therefore they wanted to use .... precast curbing on the parking area along the East boundary. Mr. Tonco felt break-off brick would not be necessary on the rear and left sides since future expansion will be on these two sides of the I .. building . Mr. Zeglen wanted to know if this parcel was big enough for this ,� expansion. Mr. Zbikowski said yes, he has 3.8 acres. Mr. Zeglen asked what they would be manufacturing. Mr. Boardman said he would alsa have to replace the curb at the driveway entrance with an apron. They would also be asked to put poured concrete curbing (6" x 18") around the edges of the varking lot and along the driveway. Mr. Zeglen said that the width of the driveway was only 24 feet and they would like to see it 25 feet wide. Therefore, an additional 6 inches on bath sides of the driveway would be recommended to correct this problem. Mr. Ze�len also pointed out that there will have to be a 10 foot radius at the entrance of the drivewav. Mr. Boardman asked what tvpe of truck would be using the loading dock. Mr. Zbikowski said there is mainly small truck delivery with an occasional semi-truck delivery. Mr. Tonco said with the narking lot moved back the 60 feet, this would give the semi-trucks and smaller trucks plenty of room for loading and turnin� around without breakin� down the edge of the blacktop. Mr. Boardman said that there would have to be a 6 foot screen for the loadin� dock because the loading area is on the side of the ^ building. Mr. Zbikowski a�reed on a 6 foot redwood screen fence. Mr. Tonco asked Mr. Zbikowski if he agreed with all of what had been '" said as far as the parking lot, curbin� changes, loading area and the screen fence. Mr. Zbikowski said yes, since it was his only choice on these matters. .. .. .. .. � Mr. Lindblad asked what kind of security lights would be provided. Mr. Zbikowski said there are large sensary lights on the back of the-building over the doors, and six lights on the front of the build- ing. This would give plenty of light for police surveillance.
